02/24/1969 - 00019678� � � THE MINUTE5 OF THE SPECIAL COUNCIL MEETING OF FEBRUARY 24, 1969 Mayor Kirkham called the Special Council Meeting of February 24, 1969 to order at 5:15 P.M. PLEDGE OF ALLEGIANCE: The Council and Administration rose to say the Pledge of Allegiance to the Flag. ROLL CALL: MEMBERS PRESENT: Sheridan, Kirkham, Liebl, Samuelson (Arrived at 5.30 P.M.) MEMBERS ABSENT: Harris ADOPTION OF AGENDA: MOTION Uy Councilman Sheridan to adopt Councilman Liebl. Upon a voice vote, the motion carried. the Agenda as presented. Seconded by all voting aye, Mayor Kirkham declared 12.07 OF THE C SeYVice Drive Easement - Robert Schroez TO The City Engineex said that this vacation is in the axea where the car wash is to go on East River Road and Mississippi Place. He e�cplained that the City is getting an additional 13' right o£ way along East River Road. He said that the City has already received some of the necessary dedications, but theze are still some to be obtained� and he would suggest that the second reading be held, but publication be held up until all the required documents are received. COUNCILMAN SAMUELSON ARRIVED AT 5:30 P.M. MOTION by Councilman Sheridan to adopt Ordinance �/410 on second reading, waive reading and hold up publication until the Engineering Department receives all the necessaxy dedications. Upon a roll call vote, Kirkham, Samuelson, Sheridan and Liebl voting aye, Mayor Kirkham declared the motion carried. RECEIVING THE PLANNING COMMISSION MINIITES OF FEBRUARY 13, 1969: The City Engineer said that the Planning Commission had denied the first which was a Rezoning Request by George M. Nelson, so there was no acCion necessary by the Council. He added that the Council has already set the PuU1ic Hearings for March 10, 1969. The only other item for Council con- sideration is Item 416: STREET STUDY: PROPOSED STREET PATTERN NORTH OF OSBORNE ROAD BEZ'WEEN RAILROAD TRACKS AND T.H. f�47: item two ; � ,- 'i L� � yl �l� � SPECIAL COUNCIL MEETING OF FEBRIIARY 24, 1969 PAGE 2 The City Engineer showed the proposed street layout on the screen £or � extending Main Street southerly across the open land and connecting up with Commerce Lane, and the service drive constructed along University Avenue to be looped back awa}' from the highway at Osborne Road and 79th Avenue. He said that the Engineering Department is working on an agreement with St. Paul Waterworks for the easement to line the street loop back along University Avenue up witn the street south of Osborne Road. Councilman Sheridan brought up the question if the person who owns the land along 77th Avenue would want, in the future to develop his land, would this road be a hindera.�ce to him, He said that he thought that most of that land was under one ownership. The City Engineer said yes, and that the only present access at this time to this property is from East River Road. Councilman Sheridan asked if this was presented only as a possible concept. The City Engineer sald yes, and that he feels that it would fit in fairly well with the area. Councilman Samuelson agreed that another access is needed into this area. The City Engtneer commented that there is no water service east of the railroad tracks except for the water main tha*_ runs along University Avenue up to 83rd Avenue, then it runs east and west. APPROVAL OF I,ETTF.A TO BE SENT TO NORTHERN PACIFIC R9ILROAD: It was pointed out that Northern Pacifir_ has requested permission from the City of Fridley to negotiate with the City of Minneapolis for a water connection to a trailer house located on 43rd Avenue west of the Minnesota Lin�eed Plant. Councilman Sheridan asked if the City did not have water there. The City Fngineer sa�d no, that they have to get permission from the City of Fridley, then they wzll go to Minneapolis for their permission. MOTION by Councilman Samuelson to authorize permission for Northern PacZfie Railroad to negotiate with the City of Minneapol�_s for a domestic water connection to a trailer house. Seconded by Councilman Sheridan. U�pon a votce vote, all vnting aye, Mayor Kirkham declared the motion carried. (Bi ds February 24, ]969, 12:00 The City Engineer said that there Were good bids received. He said that this pro�ect was for an increase in saze of the culvert that runs under T.he Mznnesota Transfer Railway tracks. FIe pointed out that the Engineering estimat.e was $16,900.00 and the lowest bid was $11,105.00. He said that , under the contract, a completion time is given. The second lowest bidder was C.S. Days As Specified Councilman Samuelson pointed out that the completion time is blank for the low bidder and asked if he will sign some sort of agreement to have it done hy a specific time. Mx. Comstock said that in the contract the completion time is specified as Apri1 15, 1969. MOTION by Councilman Samuelson to award the contract to Robert L. Upon a voice vote, all voting aye� Mayoz Kirkham declared the motlon carried. ,TER PROJECT !�92: The City Engineer said that this is for the water line that is to run on ' 66th Avenue and that the Council has already ordered it in, and this Resolution is fox authorization to advextise for bids. Mayor Kirkham said that as he recalled, at the Public Heara.ng some of the people were talking about a - petition against the street improvement and asked the City Engineer if any had been received. The Ca.ty Engineer saa.d not to his knowledge. MOTION by Councilman Sanuelson to adopt Resolutian ��31-1969. Seconded by Councilman Sheridan. PAGE 4 RES07.IITION i/32-]969 - RSSOLUTION ON PROPOSED NEW b1ETROPOLITAN TAX PROGRAM Councilman Liebl in referring to the Aesolution asked if Minnesota was seventh in the Nation. The City Manager said that tha_ Assessor had checked this and by some tables, we were fifth, Mayox Kirkham raised the question, if the City should acknowledge that there are fiscal disparikies. Council- man Samuelson said that if there is any f�scal disparity, then why should this not be done at the State level. The Czty Manager agreed, and wondered why �ust the seven county area, and not the whole state, or Nation. He felt that this could conceivable cause an exodus of people, impede growth and discourage further construction of new facilities in the seven counT.y metropolitan complex. Councilman Sheridan suggested passing the Resolution, but deleting: '"while realizing fiscal disparities do exist". MOTION by Councilman Sheridan to adopt Resolution 1132-1969 with the correction as noted. Seconded by C�uncilman Liebl. Upon a voice vote, all voting aye, Mayor Kirkham decJ_ared the motion carried, Councilman Liebl asked about the distribution of this Resolution. Council- man Sheridan said that it will be ready to pass out at the Legislative Meeting in Anoka on March 1, 1969. He also suggested sending copies to the League of Municipalities. Mayor Kirkham suggested sending copies to our Representatives in Yhe House and our Senators. Councilman Samuelson suggested also sending copies to all the other suburban communities �n this seven county area. CONSIDET2ATION OF WAIVING PLUMBING AND HEATING PERMIT FEES FOR COLUMRIA ICE ARENA: The City Manager said that Anoka County has requested that the Council con- sider oraiving the plumbing and heating permit fees for the Ice Arena. He said that he had talked to Bernie Steffans, County Adminlstrator, and he had i-old him about the request for waiuer from the contractor, and whether the bid was based on the permzt fee being paid by the contractor and the County wou]d have to make the request, not the contractor. The Ctity Manager talked to the County Admanistrator and he said it was not included and he �,�ould send us a letter of request, MOTION by Counrilman Samuelcon to waive the permit fees for plurobing and heating for the Columbia lce Arena.
