RESOLUTION NO. 195 -1969
A RESOLUTION AUTHORIZING ACQUISITION OF ADDITIONAL EASEMENTS AND RIGHT OF WAYS
FOR WATER, SEWER AND STREET IMPROVEMENT PROJECTS
WHEREAS, it is necessary to acquire easements and right of ways for the
construction of Water, Sewer and Street Improvement Projects as listed below:
1. Water and sanitary sewer: S & W #93
a) The road right of way connecting Main Street and Osborne Road at
Commerce Lane.
b) South half of 77th Avenue east of the railroad tracks to the pro-
posed Rancher's Road.
c) North half of 79th Avenue west of University Avenue and the rail-
road tracks.
d) North half of Lot 5, Block 5, Onaway Addition.
e) South half of Lot 4, Block 5, Onaway Addition.
2.. Street Improvement Project St. 1970 -1
a) Northwest corner of Lot 9, Block 8, Donnay's Lakeview Manor Addition
b) 61st Avenue between Benjamin Street and Stinson Boulevard.
3. Street Improvement Project St. 1970 -2.
Sidewalk easement along the west side of West Moore Lake Drive
from Highway No. 65 south end of West Moore Lake Drive to north end
of Donnay's Lakeview Manor Addition.
WHEREAS, the City Council previously determined that the projects were
feasible and necessary and has approved the plans and specifications.
NOW, THEREFORE, be it resolved by the City Council of the City of Fridley
that:
The City Administration, assisted by the City Attorney is authorized to
acquire the said easements and right of ways for the purposes of the
improvements of public utilities and streets.
BE IT FURTHER RESOLVED, that if the Administration is not able to acquire
said easements and right of ways upon terms agreeable to the City Council,
that the City Attorney is hereby authorized to commence condemnation action in
the Anoka District Court for the above described easements.
