COLLECTED UNDBR THE PROVISIONS OF RSSOLUTION NO. 61-1967.
BB IT RESOLVBD, by the Council of the City of Fridley,
Anoka County, Minnesota, as follaws:
WHBR$AS, the City of Fridley Council in Resolution No.
61-1967, established permit fees and connection charges for
installation of sewage disposal facilities and water supply facilities,
and
WHEREAS, the City Council has directed refunds to be made
on Residential-equivalent charqes (REC charges) paid the City by
Industrial and Commercial property and residential property in
certain areas of the City, and
WHERBAS, Z'he City Council has directed that a study and
recommendations be made by the Administrative Staff and City Attoraey
on methods to be used in accnmplishing a refund of sewer R$C charges
established in Resolution No. 61-1967, and �
WHEREAS, it is desirable to cease collection of s�ara�tc RBC
charges to eliminate administration in collection when refund i8
being scheduled for past cha3rges paid.
' NOW THEREFOR$, BE IT RESOLVED, that no further sewer RBC
charges will be collected under the provisions of Resolution No.
61-1967.

I have received inquiries about the City's position on open burning
of refuse in barrels or fire containers. A review of the air pollution
control ordinance, Nhich is attached, appears to restrict such burning
in areas that have public or commercial refuse collection service.
If the Council agrees with this interpretation and position, it would
be my suggestion that an announcement or notice be placed in the
newspaper to the effect that such burning is'now prohibited and that
violations would be prosecuted.
I would appreciate it if you would place this Memo on the agenda for
discussion at the next Council meeting.

A. Refuse Burning Restrictions.
(1) No person shall dispose of refuse by open burning, or cause, suffer, allow
or permit open burning of refuse. In areas where no public or commercial
refuse col!ection service is available on the effective date of this regulation,
open burninq of refuse on residential premises, or refuse originatinq from
dwellinq units on premises shall �ot be in violation of this section until
such refuse collection service becomes available but no later than three�
years from the effective date of this requ�l_a_tion.
B. Prohibition of �alvage operations by open burning.
No person shall conduct, cause or permit the conduct of salvage operation by
open burning. •
C. Restriction on open burniny of tr�e le.:v��.
The open burning of leaves is prohibited effective two months after a genera)
solid waste �ick-up system is devetoped by a municipaiity that is part of a
comprehensive plan for solid waste disposal, Until.such time, burninq of leaves
only in containers meetinq fire safety standards is permitted.
D. Exceptions.
' Exceptions herefrom may be allowed upon application and approval by the Director
provided that the burning is not prohibited by or is conductec� in compliance with
other applicable laws, ordinances and regulations. Exemption to conduct open
� burning under the provision of this regulation does not excuse a person from the
consequences, damages or injuries which may result therefrom. The following are
exceptions for which application may be made:

(1) Fire purposely set far the instruction and training of public ared .
�industrial fire-fighting personnel.
(2) Fires set for the elimination of a fire hazard which cannot be abated by
any other practicable means.
(3) Fires purposely set for forest or game management an aeeordanee with.praetices
recommended by the Minnesota Department of Conservateon, the Minnesota
Department of Agriculture and the United States Forest Service.
(4) The burning of hydrocarbons which must be�wasted through the use of
atmospheric flares
� The burning of trees, brush, grass' and other vegetable matter in the
clearing of land, right of way mainte�ance operations and agricultural
crop burning is permitted under the following conditions:

�a) The prevailing winds at thP time of burning must be away from
any city or town.
(b)� The location of burning must not be within 1,000 feet of an
occupied residence other than those located on the pr�pe��y on
which the burning is conducted.
(c) Oils, rubb�r or other similar materials which produce unreasonable
amount of air contaminants may not be burned.
(d) The burning must not be conducted within 1,000 feet of any highway
or public road and in any event must be controlled so that a traffic
hazard is not created.
(e) The burning must not be conducted within one mile of any military,
commercial, county, municipal or private airport or Tanding strip.
