THE MINUTES OF THE REGULAR COUNCIL MEETZNG OF MARCH 16, 1970
Mayor Kirkham called the Regular Council Meetinq of March 16, 1970 to order
at 7:55 P.M.
PLEDGE OF ALLEGIANCE:
Mayor Kirkham requested the audience to stand and join the Council in
reciting the Pledge of Allegiance to the Flag.
INVOCATION: .
Reverend Bergren, Redeemer Lutheran Church offered the Invocation.
ROLL CALL:

APPROVAL OF MINUTES OF THE REGUI.AR COUNCIL MEETING OF MARCH 2, 1970:
MOTION by Councilman Liebl to adopt the Minutes of the Regular Council
Meeting of March 2, 1970. Seconded by Councilman Breider. Upon a voice
vote, all voting aye, Mayor Kirkham declared the motion carried unanimously.
APPROVAL OF MINUTES OF THE SPECIAL PUBLIC HEARING MEETING OF MARCH 9, 1970:
MOTION by Councilman Harris to adopt the Minutes of the Special Public Hearinq
Meeting of March 9, 1970. Seconded by Councilman Sheridan. Upon a voice
vote, all voting aye, Mayor Kirkham declared the motion carried unanimously.
ADOPTIOI3 OF AGENDA:
Mayor Kirkham stated that there was one item to add under cammunications:
D. Letter from Chamber of Commerce regarding favoring competitive private
garbage pickup.
MOTION by Councilman Harris to adopt the Agenda as amended. Seconded by
Councilman Breider. Upon a voice vote, all votinq aye, Mayor Kirkham declared
the motion carried unanimously.
VISITORS:
Mr. Carl Paulson came forward and submitted a letter to Mayor Kirkham and
asked that copies be made and given to the Council Members. Mayor Kirkham
read the letter aloud which called for the resignation of Councilman Raymond
Sheridan and Councilman At Large David Harris, with a request for time on the
next Council Agenda to explain the reasons why this request is made.
Mr. J.R. Nichols, 931 Mississippi Street N.E., said that he w�ould like infor-
mation on the refund of the REC cha:_ges. He said that in his case he paid
the plumber, and the plumber paid the City. He felt that he was entitled to
the refund of the $100. Mayor Kirkham told him that this was an item on the
Agenda.

CONSIDERATIDPI OF SECOND READING OF AN ORDINANCE FOR REZONiNG IN HYDE PARK AND
CITY VIEW ADDITION:
Councilman Liebl said that every member of the Council is fully aware of this
item, and the only member with any questions would be Councilman Breider.
Councilman Breider answered that he had no questions.
MOTION by Councilman Liebl to adopt the Ordinance on second reading and waive
the reading. Seconded by Councilman Breider.
Councilman Sheridan suggested that as the first reading was on November 3,
1969, and over 120 days have elapsed, that perhaps someone in the audience
would li�e to have it read. There was no�response, so Councilman Sheridan
withdrew his suggestion.
Councilman Harris said that this plan presented by the City Manager is an
off-shoot of the plan drawn up by the planner the Planning Commission hired
for the development of the overall area and the Council felt at that time that
it would be difficult to implement. Since that time he has talked to some
of the Planning Commission members and studied the plan further and is of the
opinion that the plan presented by the Planning Commission could be implemented.
He said th�t he must vote against this proposal as he felt that the original
plan is superior.
UPON A ROLL CALL VOTE, Liebl, Breider, and Sheridan voting aye, Kirkham and
Harris voting nay, Mayor Kirkham declared the motion FAILED. (A 4/5 vote is
required on any rezoning ordinance).
CONSIDERATION OF APPOINTMENTS TO LEGAL COUNSEL, BOARDS, COMMITTEES AND COMMIS-
SIONS: �
Planning Commission
MOTION by Councilman�Sheridan to appoint Oliver R. Erickson, 1315 Hillcrest °'
Drive N.E., as Chairman of the Planning Commission. Seconded by Councilman
xarris for discussion.
Councilman Harris asked if this was done with the concurrence of the dates as
suggested in the Agenda. Councilman Sheridan said that at this time he would
prefer not to go by the dates as set out. Mayor Kirkham agreed that the
appointments will be made subject to a later definition of the length of
terms.
THE VOTE, upon the motion, being a voice vote, all voting aye, Mayor Kirkham;
declared the motion carried unanimously.
Boarc� of Appeals
MOTION by Councilman Harris to appoint Robert Minish, 331 Pearson Way N.E.,
as Chairman of the Board of Appeals. Seconded by Councilman Breider. Upon�a
voice vote, all voting aye, Mayor Kirkham declared the motion carried
unanim�usly.
MOTION by Councilman Harris to appoint William Driggans, 106Q Lyncie Drive iJ.E.
to the unexpired term of Robert Minish. The motion was seconded and upon a
voice vote, all voting aye, Mayor Kirkham declared the motion carried unanimously.

MOTION by Councilman Harris to nominate George Zeglen, 841 Rice Creek Terrace
N.E. as Chairman. The motion was seconded and Mayor Kirkham called for a vote
for Eldon Schmedeke as Chairman, with Liebl, Sheridan and Breide� voting aye,
Harris and Kirkham voting nay.

N.E. to the Parks and Recreation Commission. Seconded by Councilman Liebl.

job. The motion was seconded and the Mayor called for a vote for Alexander
Novitsky with Sheridan, Liebl and Breider voting aye, and Harris and Kirkham
voting nay.
UPON THE MOTION to appoint Gary Stimmler, Harris and Kirkham voting aye,
Breider, Liebl and Sheridan voting nay, Mayor Kirkham declared this motion
FAILED and Alexander Novitsky appointed.
MOTION by Councilman Liebl to appoint Elmer Olson, 5361 Horizon Drive N.E.
to the Parks and Recreation Commission. Seconded by Councilman Harris. Upon
a voice vote, all voting aye, Mayor Kirkham declared the motion carried
unanimously.
Human Relations
Mayor Kirkham said that he had not contacted all the members and he would like
to have these appointments wait until the April 6, 1970 Meeting also.

Board of Health
MOTION by Councilman Harris to appoint Dr. H.S. Strait, 7635 Alden Way N.E.
as Health Officer; Dr. Donald L. Wright, 101 Logan Parkway N.E., and Harvey J.
McPhee, 3463 Zarthan Avenue South, St. Louis Park, 55416 as Public Health
Sanitarian. Seconded by Councilman Liebl. Upon a voice vote, all voting aye,
Mayor Kirkham declared the motion carried unanimously.
Legal Counsel
MOTION by Councilman Liebl to appoint the law firm of Hall, Smith, Juster,
Feikema, and Haskvitz, with Leonard T. Juster to be named as City Attorney
effective April 1, 1970. Seconded by Councilman Breider.
Councilman Harris commented that he would abide by the wishes of the City
Attorney, and not debate the issue, but he had to say that he felt that this is
a shame and a disgrace to the City of Fridley, and that Virgil Herrick has
served the City Council excellently. He has served in all fairness to everyone
throughout the City. He thought that the City ought to recognize that Fridley
got more than a City Attorney in Virgil Herrick as he took an active interest
in trying to entice new firms into moving into the City. He was always
willing to meet with him to talk about the virtues of this community, in his
dealings with a prospective company. He felt that the decisions on the part of
some of the firms to move into this City was due in part to his contributions.
The question was asked of him if he did not do the job, however, this move
was politically motivated, and the citizens of Fridley are the losers. He
said that he would like to take this time to say "Thank You" and further say
that it has been good working with him.

UPON A ROLL CALL VOTE, Liebl, Breider and Sheridan voting aye, Harris and
Kirkham voting nay, Mayor Kirkham declared the motion carried, and Leoaard T.
.7uster the new City Attorney.
Mr. Virgil Herrick, City Attorney, said that he w�ould like to say that he has
enjoyed serving as City Attorney and that he recognizes the riqht and privi-
lege of the City Council in having whom they want to serve as Legal Counsel.
He said that he understood the reasons for their vote, and bore no personal
animosity. He tried to do a good job and he thouqht t.hat he had. If he had
erred, it was not due to lack of effort. He said that he would pledge his
support to the City of Fridley and the City Council in the future.
RESOLUTION #63-1970 - RESOLUTION DE5IGNATING DIRECTOR AND ALTERNATE DIRECTOR
TO SUBURBAN RATE AUTHORITY:

Representative to the Board of Trustees of the North Suburban Sanitary Sewer

Council to call this the first reading and to notify N.S.S.S.D. that the second
reading would be held upon receipt by the City of Minneapolis of the necessary
easement. _

The City Engineer said that copies of the necessary document have been provided
and he handed out copies to the Council. The City Attorney said that he would
look at them and suggested that the City Manager and.the Mayor be authorized to
execute them when they are proven correct.
MOTION by Councilman Harris to authorize the City Manaqer and Mayor Kirkham
executing the easement for the water line leading to the water treatment plant.
Seconded by Councilman Sheridan. Upon a voice vote, all voting aye, Mayor
Kirkham declared the motion carried unanimously.
ORDINANCE #449 ° AN ORDINANCE UNDER SECTION 12.07 OF THE CITY CHARTER TO
VACATE STREETS AND ALLEYS AND TO AMEND APPENDIX C OF THE CITY CODE:

The City Engineer said that the City has received the necessary easement,
alonq with the agreement for the relocation of the fire hydrant.
MOTION by Councilman Sheridan to adopt Ordinance #449 on second reading,
waive the reading and order publication. Seconded by Councilman Liebl. Upon
a voice vote, all voting aye, Mayor Kirkham declared the motion carried
unanimously. -
CONSIDERATION OF CASINO ROYALE LICENSE:
Councilman Breider asked if the previous motion that failed included operation
on regular hours.and Mayor Kirkham said yes.
Mr. Carl Rostberg, 2217 Humboldt Avenue South, of Casino Royale, said that
he had his license suspended because of mis-management. He said that he hired
a manager and since that time he had two violations. If his license is
returned to him, he will be operating the business himself and will abide by
the City regulations.
Mr. John Lindell, Representative of Shorewood Associates, said that he felt
that Mr. Rostberg has done a good job. He said that it was unfortunate that
Mr. Rostberg, due to mis-management, allowed the violations to occur, but if
his license is returned to him, he will be there in person to supervise and
he felt that it would be operated as a contribution to the co�nmunity.
Councilanan Harris asked what protection the City has under the Ordinances when
an owner has a manager operate a buainess under his license. The City Attorney
said that the owner would still be responsible for the manager operatin;g the
business. In this case the owner just did not keep close enough watch on
what was going on in his establishment. Councilman Harris asked if there was
any way that the City could be notified in the event an owner would not be
managing the business and hires a manager to rux� it. The City Attorney said
that there is included information relating to managers in the on sale license
forms and with very little trouble it could also include 3.2 establishments.
Councilman Sheridan suggested that this be updated for the new licensing
period. Councilman Harris said that in this way everyone would be protected,

includinq the owner. Councilman Liebl said that the City AttoYnsy sxplained
at the last meeting that the license could not be tranoferred, and if the
businesa is sold the City must be noti�ied. He also pointed out that th�C'•
is no teen age operation there anymore and it was suggested to hin► that whsa
there is a�riy public dance that a police officer be in attendarice. Th� Fri8ley

CounciLaan Harris said that he understood that Mr. Rostberg will be at the
bueiness to supervise and Mr. Rostberg answered yes. Councilman Harri� asked
if he wanted to sell, and Mr. Rostberg said that he would like to aell, arid
if a buyer is found, he will notify the City, in the meantime he viill opsrat�
the business himself.

March 12, 1970, and Mrs. Thomas Arth, 5241 Fillmore Street N.E., dated March
11, 1970. Seconded by Councilman Liebl. Upon a voice vote, all voting aye,

The City At�orney said that as concerns the City of Fridley - Clemron,
Johanson et al lawsuit they have said that they are entitled to the money and
further that they would hold the City harmless. He said that he had talk�d
to a gentleman and he told him to contact Clemron. It may have to be arbi-
trated.
Mr. Dick Waldstein, 7373 Memory Lane N.E., said that Clemron has said that the
people are not entitled to the money, �et the people feel that they have been
indirectly charged for this connection. Clemron has said that this was not
part of the pt�rchase agreement. He asked if, since the Council has approved
the refund of the money, will not that have to be macie up samewhere e15e.
Councilman Harris said that this money was only held by the City and will not
have to be made up in any way be levying taxes. He asked the City AttornQy
if both names could not be put on the checks. The City Attorney said that the
plaintiffs in the law suit were handled flifferently. If less than.$200,
letters were sent out to ascertain if anyone other than the payor would be
entitled to the money. Were a party to present evidence that they paid the
contractor, the money should be paid to them. If more than $200, both the
payor and the property owner should be ori the check. The reason for tine .
difference is the amount of research that wo�uld have to be done would make it
not feasible to do for every $100 payment.

CounciLnan Liebl sugqested that the only solution may be a test case in court.
The Finance Director sacid that he has received many calls fro�n people �ayinq
that they either paid the $100 directly or indirectly. He said that he under-
stood that the check should be made out to the person the money was received
froen. Thexe have been no refunds sent out to date. The City Attorney said
that these people should be told to send in evidence of payment. The
Finance Director asked what criteria should be used; just their word, or
should they be required to sign some document. Msyor Kirkham said that he
thought that Che money ehould be returned to the person who paid the City and
if anyone else feels that they are entitled to the monay, that is their pri-
vate affair. The City Manager said that so�ne feel that the connectfon charqe
is part of the purchase price of their h�ne. Councilman Breider said that he
aqreed with CounciLnan Liebl, that this should be settled in court. It could
not jast be thrown up for grabs. The Finance Diractor said that he has told
people that nothing will be done for perhaps 30 more days. Councilmari Liebl
said that the people should be told that the Council is not clear on what
position to take and that this should be a court determination. Mayor Kirkham
said that the question arises, how do you ascertain if the person making the
request is entitled to the money. The City At�orney said that if both
names are on the check, then they would have to resoZve it. Councilman B�eider
asked if there was any time limit for paying the money back. The Finance
Director said no, that most people seem to be worried that the money will be
returned too soon befoYe they have a ohance to talk to their builder. There
have been many more telephone calls than have written letters. Mayor Kirkham
said to tell the people that all refunds would be delayed until all the replies
are in, then the �ouncil will proceed according td the new City Attorney's
instructions.

The City Enqineer said that this lot split request ia for a�lot on Baker
5treet and Osborne Road and gave Gn explanation at the screen. He said that he
wanted to point out that this split would isolate a long lot about 100' wide
and 300' long. Councilman Harris pointed out that this�lot would face Osborne
Road rather than Baker �Street.. The City Engineer said that when e lot abuts
an R-1 district there is 100' required for a set back and this requirement makes
this an unbuildable lot. He explained that Fridley Auto Body wants to expand
onto their existing building to the south. Councilman Sheridan asked if Lot
3 and Lot 4 were still owner by Vi Nagel and Mr. Bonnet said yes. The City
Attorney added, except for that portion owned by the Telephone Company.

The City Engineer pointed out that the Planning Commission passed a resolntion

Repor� available to public use. Councilman Sheridan asked if there should not
be a fee for this survey. Councilman Harris said that much tune and effort
went into this survey and suggested a fee of $25.00. Mayor Kirkham said that
he felt that this would be a.fair f��ure. The City Engineer said that some
infozmation relating to legal descriptions, valuations and census data
ralative to individual parcels should be taken out.

Remarke, 510 Cheri Lane N.E. said that they repre8ented saae of the people who
petitioned against the grantinq of these variances, as it was felt that the

A Representative of Twin City Ap$rtment Developers Inc., said.that same of the
property was taken for the street, but they felt that it was still larqe

Counciln►an Liebl asked where the people lived that signed the petition. Mrs.
Asmark said that the_petition was supposed to be submitted to the City Council.
The majority of the people live along Cheri Lane. There is an apart�uent
buildinq on 7th Street and the residents suffer fran this. She said that there
are always cars parked there that create problems in the winter. She aaid that
they realize that the property is properly zoned, but felt that this is an
example of spot zoning. She said they did not feel that there was eno�ngh
property to take care of the people that would be living there. Obvialsly
there is a City Code, and she believed that it should be followed.
MOTION by Councilman Sheridan to concur with the Board of Appeals and deny
the request for a double bungalow for the reasons outlined by the Board.

The City Engineez said.that these were the bids for the street project for the
year 1970. When the estimate was figured, they used last year.s fiqurea and added
on 20� and they thought that would be high. However, he said tihat he was sorry
to report that the bids were up 25� over lact year's bid. Last year the bids
were let about this same time of the year. Hs said that they were studying to
see if the c�sts would still stay under the estimate given to the public. He
asked that the bids only be received and not awarsied at this time as �he laa
bidder is a new company and he would like some time to check on the coanpany.
Stinson Boulevard is also included in the City street improvement project and
New Brighton is holding their public hearing March 24th to see if the resi-
dents want the street in, and he would like to wait for that.

Counci Lnan Liebl said that his unders�anding was that the Council would also
get an appraisal of the Lounge on 37th and Marshall. The City ]�ttorney said
that this was not his understanding. He understood that he was to hold up
on the second appraisal. Councilman Liebl said that onae Shorewood is sold,
both bars will have to be closed. He felt that they should b� done toqether.
The City Attorney.said that this was sugges�ed to the Council not lonq aqo and
the concensus of the Counc�l was not to do the 37tA Avenue Lounge becau�e i�
was not considered salable for this purpoae. Councilman Harris added that he
felt that by the time it was brought up to Code and made to meet the speci-
fications set down in the Liquor Ordinance it would not be salable. Council-
man Liebl said that the Council would have to consider replacement revenues.
There inust be a smooth fiscally sound takeover. If both bars ate ciosed up,
other money will have to be used for a replacement. �
The Finance Director said that the 37th Avenue off-sale business is quite
profitable. He added that there has been a suggestion that it be used as a
warehouse to serve all the off�sale establishments. This would be a.
Counc3l decision.
Councilman Sheridan said �hat he was not in disagreement with the 37th Avenue
Lounge appraisal, but he did not think it shoul.d be advertised at the same
time. He said that he did not see the reasoning for holding up the Shorewood
bid for the appraisal of the Marshall Street operation. He said that he had
reservations on the use of that opera{:,ion as a warehouse. He felt that in
this day and age, h� could see no reason why the City should have a.warehouse.
With the ability to make deliveries, it would be a poor investment to tie up
the land and building as a warehouse. Councilman Harris agreed that the one
should not be held up for the other. As it has to be a supper club or a hotel-
motel type of operation, it does not seem feasible at that site. The Metro-
politan Sewer Board may be interested in purchasing so�ne land in this area.
The City Attorney suggested that Shorewood also be advertised in the txade
journals. -
MOTION by Councilman Harris to authorize advertisement for bids for Shorewood
Lounge with the change that all the coordination should be through the City
Manager's office and that sealed bids will be received until 1:30 P.M., June
1, 1970. 5econded by CounciLaan Sheridan.
Counc�.lman Breider asked what plans the City has to cover this deficit. The
Finance Director said that there would be no im�nediate problem. Se�ae money
will be recei.ved from the sale of Shor�wood, but to sustain the amount of

revenue, the off-sale will have to be increwsed. Cotincilman Hax'ris aadea
that when the Liquor Ordinance was passed the thought was that some o� the
revenue would be replaced bp new, quality business establishinq themselves in
Fridley. Councilman Liebl said that the City must be careful not to squander
the licenses and must be very responsible to the public, and be sure that the
right decision is made. Mayor Kirkham said that until the bids are received
the Council will not be_sur.e which way ta.go._ If the.:bids ars tco low, the
City will not sell. Councilman Liebl asked what was the hurry, money is being
made right now. Last year $231,000 was made clear profit. Councilman Breider
asked what total tax valuation would have to be accumulated to make up the
deficit. The Finance Director said that he did not have those figures
readily available. :

Councilman Liebl said that the Council was advised by the Administration that
Albert Johnson was sent a notice, yet this letter states the opposite, and
asked for clarification. The City Engineer said that the records show that
he was sent a n+otice of hearing, and that he just must have not looked at it.

The City Attorney said that he had talked to the Insurance Coa�aission on two
occasians and they advised him that Home Owners Inaurance Company, 100 i�lest
Fran)tlin, Minneapolis,Minnesota is still authorized to do business�in the Stste
of Minnesota, although they are nbt to write any bonds. As far as they kne�t
they wer.e still responsible. He said that he also talked to D.M. Noyes _
Constructian Company and it seems that they made a bad bid and are losinq
money on the praject, and are having trouble paying their subcontractass.
Mr. Ice Comstock, of Coanstock and Davis, Inc., Consultinq Engineers, s8id that
they have not been paying their suppliers. There had been no payment up to
the lst of March and he did not believe that there had been any since. This
normally would be of no concern to the Council, except that the question atose
on the bondinq company. He said that there �as an astimate in the Aqenda for
payment to D.M. Noyes`Construction Company and he felt that the City �ta�
entitled to an agreement that this money would be applied to the !'�idley job,
rather tha�a some other job that the company is currently workinq on...
Councilman Liebl asked if a good job has been done so far �nd Mr. Caaastock said
yes. The City Attorney asked how must is still unpaid. Mr. Comstock an�wered
that if the estimate is authorized to be paid tonight, it v�rould leave about
$75,000 I.eft unpaid. He said that he would like some protection so that the
money is applied for materials on our site. The City Attorney suggested
makinq the payment jointly with the bonding company and D.M. Nopes Construc-
tion Company, with an agreement that the maney will be used on the Fridley
site. He said that the City w�ould have to watch to make sure that it was dorie,
and if not, no more payments w�ould be made. He advised that the City would be
all right, unless the bonding company and the bidding company both go out of
business. Aa long as the bonding company is authorized to do busineas in the
City of Fridley, he did not feel that there was too much cause for worry.
MOTION by Councilman Harris to instruct that the payment of the estimate be
on the basis of both tha bonding company and the bidding compa�ny appearing on
the check, and that there be an agreement �with D.M. i�oyes Conatruction Cccnpany
that ariy monay paid by the City of Fridley is to be used on the Fridley site.

Mr. Richard Harris asked if the D.M. Noyes Construction Company intend to
complete the project. The City Attnrney said that he has seen nothing to
lead.him to believe otherwise. Mr. Richard Harris then asked when it is sup-
posed to be.completed. Mr. Comstock, after checking the specificatior� book,
said July 1, 1970. Mr. Harris said that he, as a property owner, has been
concerned with the progress of the project.. He said that he has been planning

a well and a cess pool. Mr. Comstock said that in the past businesse� have
been allowed to hook on prior to the full acceptance of the project, provided
it is acceFtable to the contractor and the inspectors for the City. Mr.
Harris said that the property owners 'in his area are also in need of the storm
sewer system. He said that perhaps the dewatering of the area had been more
than Noyes Construction Canpany anticipated..

DI9CUSSION REGARDING NSP POWER LINE ALONG 73RD AVENtJE BETWEEN T.H. �47 11ND
T.H. #65: . _ _
The City Engineex handed_out fiqures suhmitted bp NSP coanparing the cost of the
overhead line with the underground line for 73rd Avenue. He said that an
alternate sugge�tion has been made, that the poles be placed in Locka Park with
the lines.running up to 73rd from the park to eliminate the need for poles on
73rd Avenue. He expiained the proposal on the screen for the Council. The
poles would be along the south right of way of Minnesota Transfer Railway.
This is in the vicinity of the 345 KV line. The,re are poles now on the north
side of 73rd Avenue service road for street lights. rIt is not known haw the
property west oE Carter Day will be developed. The poles wauld be the same.
size as those on the north side of 73rd Avenue now. Councilman Harris asked why
not use the same poles as for the 345 KV line. Mr. Larry.Benson, N�P, said that
that could not be doxie, the voltage interference would.be uncontrollable. He
said that the line on 73rd Avenue was originall,y proposed as an undergraund
feeder. He said that �t this time it looks feasible to connect onto .the line
in Locke Park. Councilman Harris asked if all the lines for Coon Rapids do
not have to be undergraund. Mr. Benson said yes, by Ordinance.- If the �ouncil
should insist on an underground line, NSP would then have to go back and look
over the entire area aqain.
Councilman Sheridan explained that in a discussion with John Pearce, NSP,
he understood that if the cable was buried, but the property not fully de-
veloped, there would be no way to know where:to place the splice boxes. He
said that he understood that the splice boxes have to be put in at the time of
burial of the cable. Councilman Harris asked if that cauld not be done later
and Mr. Benson said that it was quite difficult. It w�ould mean that a customer
w�ould be without service for sane time. Each splice box would take several
hours. Councilman.5heridan said that Mr. Pearce_indicated that.they were not
saying that the line �rill nener go underground, but rather that they would
rather go along with an overhead until the potential developinent is known for
the area abutting Carter Day and ir. Commerce Park. This would allow them to
properly size the line. -
Counci].man Breider asked if he understood correctly that if this was to go
underground, that the whole area wou�.d have to go back to the planning stage.
Mr. Benson said yes, and perhaps there would not be an underground line on
Osborne Road in that event. The whole area would have to be redone as concerns
feeder lines. Councilman Breider said that it may never go underground. Mr.
Benson said that as the area develops it may be required to furnish necessary
power. It i$ not felt feasible at this time. Councilman Harris sai.d that he
did not like to consider more poles through the park. The City Engineer said
that it would be a matter of perhaps eight more poles, and they w�ould be

following the Minn�sota Transfer Railway tracks,_rather than directly through
the park. Counci Lnan Sheridan asked if there was any connection to Columbia
Arena and 13rd Avenue. The City Engineer eaid yes, there is a line on the
west side of Carter Day already through there. -
Councilman Sheridan asked if the poles could be mov�d from�the north�-side of
' 73rd ]�venuEa service road into the median to light both sides of the road with
long extension azms. The City Engineer said that the boulevard is�vety wide
there and i:he light would not reach. The maximum overhang is 20 feet. He
� pointed out that the 345 KV line would be on the north side of the txacks and
this propoaed line would be on the south side. Mr. Benson added that this
would be the limit as to how close they could be. He said that he tavorad
following the right of way. Councilman Liebl said that he vranted to make
� sure that t:he duct line went in on Osborne Road. Mr. Benson said that it is
proposed at: this time. Councilne�n Liebl said that he felt-that�to.put in
burial cab�.e on 73�d Avenue also would be � wa$te�of money. He felt that it was
� necessary t:o get a commitment from NSP that they wi11 put in duct lines under-
ground from University Avenue to T.H. #65 on Osbprne Road. Mayor Kirkham said
that he fel.t that they should be allowed to put the lines in along the railroad
� track right: of way along Carter Day. He felt that thia would be only a minor
detraction. Councilman Sheridan agreed, and said that he w�ould ntuch prefer
them there, rather than on 73rd Avenue.
MOTION by C'ouncilman HaYris to approve the reute along the south right.of way
of the Minn�esota Transfer Railway for a 13.8 KV feeder line reqt�ested by NSP,
with the ad.ditional agreement that NSP must put the line on 73rd Avenue under-
ground by 1.975, or show justification at that time why not, unless development
in the area. makes it necessary to go underground sooner. Seconded by Council-
man Liebl.
Mr. Benson said that the Council would have to realize that to install an
underground. feeder the loads would have to be there. It is possible that.the
area might develop into several small industrial firms and the load still would
not be too great. It may not be necessary in 1975. Councilman Sheridan said
that it may not be that the KV is changed, but in the event it ia, tiian it
should go underground. Councilman Harris felt that this agreement should be
in writing and asked the Administration to prepare one covering these stipu-
lations. .
THE VOTE upon the motion, being a voice vote, all voting aye, Mayor Kirkham
declared the motion carried unanimously.

BY N.S.S.S.D. FOR 69TH AVENUE AND HICKORY DRIVE STREET IMPROVEMENT:�
The City Engineer explained that this agreement is for the cost participation
by N.S.S.S.D. for the work on 69th Avenue, Hickory Drive and Hickory Circle.
The break down pr!ovides that N.S.S.S.D. will pay for blacktopping, base and the
boulevard work on the south side in the amount of about $20 thousand, and the
City will pay for concrete curbing and the boulevard work on the north side in
an amount of about $27 thousand. The reason for the City's share being larger
is that there is some storm sewer work necessary.
Councilman Liebl asked if this agreement will be advantageous to the City.
The City Enqinee� said yes, if N.S.S�S.D. will siqn it.

AN ORDINANCE TO AMEND THE CITY CODE OF THE CITY OF FRIDLEY,
MINNESOTA BY MAKING A CHANGE IN ZONING DISTRICTS.
The Council of the City of Fridley do ordain as follows:
SECTION Z. Appendix D of the City Code of Fridley is amended
as hereinafter indicated.
SECTION 2. The tract or area within the County of Anoka and
the City of Fridley and described as:
Commencing at a point which is the intersection
of the South line of 40th Avenue N.E. and the
center line of Main Street; thence Westerly along
an extension of said South line a distance of
450.79 feet to the point of beginning; thence
continuing Westerly along the last described line
a distance of 27�4.21 feet to a point; thence
NortherZy at right angles to the last described
line a distance of 696.96 feet to a point; thence
Southeasterly along a straight line to the point
of beginning. The premises last above described
being herea£ter described as Tract A.
All lying in Section 34, T-30, R-24, City of
Fridley, County of Anoka, Minnesota.
Is hereby designated to be in the Zoned District
known as M-2 (Heavy Industrial Areas).
SECTION 3. That the Zoning Administrator is directed to change

Negotiating sessions with Bartender's Union Local 152, representing Bartenders
and Aotels, RestauranC Employees and Beverage Dispensers Union Local No. 458
AFL-CIO, representing waitresses have resulted in the following recommeadationa
for City Council approval; �
1, prnposal Demand: Increased health and welfare benefits, including
dependents coverage. .
Proposed Reaolvement: It was resolved that the Union shall be authorized
repreaentation to the Employee Insurance Negotiating Committee as established
in 1969.
2. Proposal Demand; Jury duty pay for jury duty.
Propoaed Resolvement; At present City pexsonnel ordinance provides
that employee receive diffe.rence between jury or witnesa pay and base
Aalary. It was agreed the pezsonnel ordinance would apply to full
time liquor e�ployees as perrain to jury and witn�gs duty.
3. proposal Demand: Funeral leave pay (d�ath in immediate family - limited
�' to the wife, husband, son, daughter, sister, brother, mother or fathex,
father-in-law or mother-in-law.

Remarks: In 1969 it was established that "On-Sale�' liquor full tiane

business. Employee a to stay until opexation ceases to be eligible.

as a bonua be�°droped. If "On Sale" is discontinued and full time employee
remains until the on-sale liquor lounge is no longer under City operation,
that the full time employee shall receive one weeks pay for each years
service as` a bonus. It was further agreed that the bonus would be on a
basis of a minimum of two weeks and a maximum of eight weeks allowable for
the full time employee. City to give a minimum of 30 days notification to
full tiaee employee, before going out of "On-Sale" liqu or busineas.
6. Proposal Demand: Day for day on sick Leave instead of � of accumulated
� sick leave, with a maximum of aixty days, if City goea out of the
"On-Sale" liquor business.
Proposed Resolvement: "On-Sale" full time liquor employees to revert
to normal sick leave policy as provided in City Personnel Ordinance.
7. Proposal Demand: Three weeks vacation after five years, four weeks after
eight years.
' Proposal Retolvement: It was reaolved there would be no change and
vacation benefits wauld remain in accordance with personnel ordinance.
8. Proposal Demand: Employee contribute 5 cents per hour toward a pension
program. (a new retirement program)

The N� of Lot 30 and the N� of Lot 31, except the North 125 feet of
Auditor's Subdivision #129 to be rezoned from R-1 (single familq) to
R-3A (apartments and multiple dwellings).
Present to discuss the rezoning request were George Nelson, Sr., William
Merlin, George Nelson, Jr. and Otto Schmid.
. The layout for the apart�nt complex was displayed. Mr. Schmid called
' attention to the profile of Che buildings, landscaping and parking, explaining
again that they were trying to "play down" the parking lot as much as possible
with the use of berms as a screen.

Mr. Myhra recalled that at the last meeting someone mentioned that, at the
present time, there is a problem cancerning the children trying to get over to
Flanary Park which is on the North side of Onondaga Street. He felt the Plan-
ning Commnission should, at this time, consider a type of path to the Park,

especially if the North 125 feet of Lots 30 and 31 were to be developed for
single fam.ily residences, that there wouid be children Wanting to get over to
the playground.
In the discusaion that follo�ed, tLe Pl.anning Com�iasion decided this was
not s pxoblem for the Commission to coiwider in conjunction vith the rezoning
requeat, but ehould be discuesed and called to the attention of the;Council.
They felt a path or walkway on the site of the 25 foot easement at the West
edge of Lot 30 w�ould suffice. Mr. Nelson, Sr. said Chat they would be willing
to put up a fence to keep the children from cutting through the yarda, and
havin� an opening for a bicycle or walk.
Mr. Merlin asked it be part of the minutes that the petitioner would be
agreeable to put up a fence if it were Council's wishea.
George A. Hanson, 1476 Onondaga Street: He reiterated his former co�ente,
and said the neighbors and he were wondering why R-1 property should be rezaned
to apartments when there ie plenty of R-3 land still available. Further, there
Was never a request to put a street through the middle of the lots. The neigh-
bors have recently received a notice from the schoolboard that they are going
to bus 150 children from that area to Blaine. He felt apartments would briug in
more children and this would ag�ravate the problem.
Chairman Erickson explained the easement through the center of the lots was
' put there in case the people would want to sell off the back part of their lota,
but it would not be used if they did not wish to sell. Pertaining to the placing
of the apartment buildings on the property, the City does have control through
� the Building Inagection Degartment and Building Standards-Design Control Subcomr
mittee.

Dennis Aexbst, 1482 Qnondaga Street: He said he was still against the idea
of apartments.
Gordon Gnasdoskey, 1491 Onondaga Street: He said that he moved in that
area to specifically get away froffi apartm�nts. New homes are still being built
there.
Mr. Myhra, referring to the Apartment Study the Planning Co�ission recently
completed, said that what we have always thought to be true is not necessarily
so. People do move out from ap�.rtments and the ratio in older apartments is
lawer than the new ones. The co�nents most heard were basically the mobility
of the renters which presents problems of children coming and going.
Mr. Fitzpatrick added that the apartr:ent study showed that the oldest
apartments in Fridley do n�t have more children than the newest ones.
Mr. Mittelstadt thanked the people for comir.g again to the Public Hearing,
and especially Mr. Iianson who took time off work to do sa.

Mr. Fitzpatrick felt that, inasmuch as varioue Citp Co�isaions.have
heard thia request eleven times, that it Mas sent to the Council and sent back
dawn, the Yezoning requeat shouid noa� be a Council decision.
Mr. Myhra atated that the situation ha�• not changed since the laat time
this aaa�ee request was before the Planning Commiesion. There is sc�nae 600 feet
between atreets and if there is going to be eingle family develop�ent West of
this complex, we must provide a street pattern which could be used, if and
vhen, people on the South side of Onondaga Street and West of this proposal
wish to develop the South half of their property.
This apartment proposal, if developed with the dedication of a atreet
easement along the West boundary, gives the people to the West a�n opportunity
to sievelop their property. The propoaal provides for the open apace adjacent
to tbe x 1 and therefore seems to be a good plan. The building would be on that
portion of the land already zoned for apartments. He stated, that to deny this
request, would not solve the problem of developing this area. The idea of
R-3 and R-1 joining at rear lines is better than having them face each other
on a street.
Mr. Myhra felt that the motion passed last year expreased the Planning
Commiseion feelings.
Mr. Jensen referred to the motion sent to the Council on May 22, 1969
' which shaws t�e thinking of the Plaaning Com�3ssion. He said he did aot like
to disagree with the neighbors;> but he did feel that the point of contact
between single family and a�ultiple is still the best when developed along the
� rear lot line rather than a street and this plan does achieve this sort of
development. If the Planning Coaunission can provide options for future
developing, they are serving the neigh�orhood and community in proper fashion.

this is the only direction he can go to expand his home aa the home is a two
story walk out in the back and there is a steep alope to the land which prevents

I requirement now.

Mr. Wells explained his home, on the North side ot the North � of Lot SC,
is setback approximately 100 feet from the street and the house to the South
of the North 100' of Lot 8C ia setback only 36 feet. The average setback of
the two would be 67� feet.

This lot split was granted last fall. He explained further that the North
100 feet of Lot 8B is now landlocked and unbuildable and he plana to leave
it that way for a plaqground.
In the event the land was sold, the road would be constructed on the East
side of the landlocked property and it would not effect the North 100 feet
of Lot 8C ,

3. The adjacent property to the East is zoned M-1 and in M-1 the chance of
a sipnilar situation arising is minimal.
4. With proper supervision of the structure and proper maintenance there

5. The structure be inepected by the City after it is erected.
6. There is a certain amount of control under our Public Nuieance Chapter
in the City Code to protect the surrounding neighbors from exceseive
interference.

Mr. Minish: I understand that I will shortly be taking over as Chairman
of the Board of Appeals and I would like to say that in the last two years
or more that I have been associated with Don Mittelstadt and Dick Harris

to miss our association on the Board and wish them well.
Mr. Mittelstadt: Thank youy we appreciate it. I've never had a nicer
asaociation than I've had on the Board of Appeais snd the Plaaning Co�miseion.
It's an experience you should not deny yourself if you ever get the chance.
Mr. Ahonen: I just want to inject that the City Council should take heed
of the great deal of experience you have had on the Board of Appeals and the
Planning Conmission and I'm sure there are positions on other commissions
within the City that cauld use your experience and its been a very enjoyable
experience working with you both.

RICE CREEK NATURE TRAIL.
, Mrs. Betty Ann Mech was invited to ihe meeting to better explain her proposal
for a Nature Trail and Nature Center along Rice Creek. She opened her
presentation with a 20 minute film on tt�e importance and operation of such a
' center. Mrs. Mech stated that she had already met With the Parks and Recreation
Commission in New Brighton, Minnesota, and that they are planning to build a
Nature Center along the east side of Long Lake, which could be very easily
connected with one in Fridley. She indicated that Metronics owns some of the
' land along the creek and that they plan to put picnic tables in this area �vith
the hope of preserving its natural beauty.

Mr. Ron Burton, a teacher in the Fridley School System, stated that he felt a
Nature Center would be a great asset to the schools. He said that they are
already using the creek for study in Conservation and Horticulture classes.
Mr. Burtori, a member of M.A.C.E., said that with the over population problem
as it is, soon there will be very little, if any, natural habitation left.
Mr. Burton felt that people are using all the facilities along Rice Creek and
especially Locke Park. He said that he knew of several people who would be
willing to man such a center, so it wouldn't necessarily involve money for
manpower in the actual operation of the center.
Mr. Fitzpatrick stated that we°ve had this in mind for some time, but that
we've been waiting for the owners of the homes in this area to request such
a project. -
, Mr. Blair asked if a Citizens Committee could contact some of the people to
see just how many of them would be interested? Mr. Burton said that.they
would and that he felt that Locke Park is over-used to the point that if Me
� worked at it hard enough, he was relatively sure that we could $et sone
firtancing for the proj ect .
� Mr. Wayne Wellan, a represen�ative of th� Fridley Jaycees, was prese�tt and
said that he was sure his organization would be willing to back a Nature Center
as long as it didn't involve a lot of land purchasing.

there were members of the League of iVomen Voters and the Fridley Womea's Club
who'd be very,interested in this type of a project, since they have always
supported the Parks and Recreati�n Programs.

Mrs. Mech used the example of the Hennepin County Center, and pointed out
that they had gone outside of Hennepin County to find a suitable area.
Mr. Fitzpatrick said that there seems to be enough civic interest. Mr.
Fitzpatrick said that a Commission member could volunteer to be on the
committee.
MOTION by Blair, Secondsd by Stimmler, to form a Citizens Committee to
investigate the proposal of a Natural Trail and Nature Center along Rice
Creek and to see if there is any encouragement from the citizens of Fridley.
The Motion carried.
FRIDLEY YOUTH FOOTBALL ASSOCIATION.
Mr. Larry Stickler, Mr. Frank Hart, Mr. Glenn Engstrom, and Mr. Sam Iaquinto
were invited to present their rec�mmendations for the 1970 - 1971 Youth
Football Season.
Mr. Iaquinto said that there were 325 boys, ages 8 to 13, registered for the
1969 - 1970 season. There are three traveling teams and they play with 8
other communities. The three divisions are Pee Wee, ages 9 to 10, with a
maximum weight of 100 pounds; Light Cubs, ages 11 to 12, with a maximum
weight of 110 pounds; and H�avy Cubs, ages 12 to 13, with a maximum weight
of 120 pounds. Each team has a maximum of 25 boys. The classification for
divisions that they use are set up by the N.R.P.A. The Fridley Parks and
Recreation Dixector, plus the Fridley Parks and Recreation Commission, are
members of the N.R.P.A.
For the 1970 - 1971 Season, they plan to have 6 P�e Wee teams, ages 8 to 10,
with a maximum of 100 pounds, and 4 Cub teams, ages 11 to 13, with a maximum
of 120�pounds. The season will begin the third week of August and will run
until the second Sunday in November. The 3 t�°aveling teams are covered by a
Major Medical Insurance policy and the other teams are covered by Major Dental.
Mr. Iaquinto said he f�lt the fields were inadequate for play, due to the�turf.
He said there wers plenty of fields and the size was no problem, but that they
were overly dry. Mr. Brown stated t',_3t �n overland irrigation system for parks
is planned for the coming season.
Mr. Iaquinto made a request �or a fui�-time coordinator for Football, like there
is in several of the other sports.
The Association said that all the Cubs try out for the traveling teams before
� the House teams are formed. The registration fee is $2.00 and each boy must
have at least one of his parents present to register. The parents must sign
a waiver.

The Football Association's main complaint was the overlapping between the
Football Season and the Hoekey Season, along with the condition of the
fields. Mr. Brown said that there should be a week rest period between the
two sports and the Cemmission agreed.

Mr. Fttzpatrick asked if the well house project.for Locke Park was not
passed by the council, would it affect any of the programs planned by the
Parks and Recreation Department? Mr. Brown said that the anly thing it
would affect is the 1971 Budget.
MOTION by Ash, Seconded by Blair, to accept the 1969 Review and Z970 Summer
Program. The Motion carried.
REVIEW CONCES5IONS.
� MOTION by Blair, Seconded by Stimmler, for the Parks and Recreation Department
to operate the Concessions at Moore Lake Beach this summer. Mr. Ash was
concerned over the sale of too many items.

DISCUSSION: Mr. Blair asked if there'd be any expense in taking over these
Concessions. Mr. Fitzpatrick said that there was, but it should be considered
in terms of an added service. The Canada Dry Company provides the pop machinery,
so it wo�ld only involve the purchasing of a pop corn maker, and a freezer for
the ice cream. Mr. Brown felt that it would eventually be self-supporting.
Mr. Ash asked to amend the Mot�on to include only the sale of pop, pop corn,
and ice cream. All agreed. The Motion carried.
DONATIONS.
Mr. Stimmler suggested that the three donations being held in the General
Fund £or the Parks and Recreation Department, be used to purchase a
camera and projector, as requested by Mr. Brown in the 1971 Preliminary Program
Plan, under division "F". All agreed that this was a good idea.
2971 PRELIMINAItY PROGRAM.
Reviewing letter "b" under the Summer Recreation Program, Mr. Stimmler questioned
how much interest there'd be in a Couples Softball Program. Both Mr. Brown and
Mr. Blair confirmed that the*e was interest �nd th�t there'd been requests for
such a program.
Reviewing letter "d", under the Summer Recreation , Mr. Stimmler and Mr. Ash
asked about the demand for paddle boats and their approximate cost. Mr. Brown
said that he felt that theae would be good ar�eptance of this part of the
program and used Como Park in St. Paul as an example.

Letter "g" under Winter Recreation, requosts a Movie Night. Nr. Stimmler felt
, there were plenty of other groups in the City who offered such a program and
that we'd merely be duplicating and competing with them. Everyone agreed that
. this item should be omitted. .
Mr. Brown indicated that letter "e" under Winter Recreation should be omitted
because of lack of communication between the school system and his department.
He stated that the schools seem to have a complete program of their own. All
agreed that this item should also be omitted.
Mr. Stimmler questioned letter "b", division 18, under Park Development. He
I� asked Mr. Brown if there was any plan to develop the Riverview Heights property,
in the near future, and Mr. Brown indicated that there wasn�t. All agreed that
this item should be omitted from the program.

It was suggested that Mr. Ed Braddock, Fridley Park Consultant, be invited to
attend the April Commission meeting to discuss Locke Park and Chases Island.
MOTION by Stimmler, Seconded by Blair, to invite Mr. Ed Braddock to attend the
April 27th Commission Meeting. The Motion carried.
Mr. Stimmler suggestad that the naming of the new parks be given much thought
and made a separate item on the agenda.
MOTION by Ash, Seconded by Blair, to accept the 1971 Preliminary Program Plan
with the suggested changes. The Motion carried.
CORRESPONDENCE.
MOTION by Blair, Seconded by Ash, to receive the letter from Miss Kathleen
Fletcher. The Motion carrieda Mr. Fatzpatrick will.answer the letter.
MOTION by Blair, Seconded by Stirnmmler, to receive the letter from the Surburban
Recreation Association, dated March 6, 1970. The Commission felt that they
presently did not have $300.00 to devote t�. this proposal.
ELECTION OF VICE CHAIRMAN,
The Commission members agreed to delay the election of a Vice Chairman until
such time as the City Council has appointed the new Commission members.

THE CITY OF FRIDLEY
This agreement entered into this day of , , by and

hereinafter referred to as the contractor and the City of Fridley, a municipal
corporation with offices aC 6431 University Avenue Northeast, Fridley, Mianesota
55421, hereinafter referred to as the City.
WHEREAS, the contractor has proposed to do towing and storage of police
impounded automobiles and automobiles deCermined to be, and found to be, in
violation of the Fridley City Code or ordinances and the State Stautes.
AND WHEREAS, it is in the best interests of the City that the contractor
show responsibility to the City and the public and indicate the charges and rates
for towing and storage of motor vehicles,
ANH WI�REAS, it is the intention of the City and the contractor that this
agreement shall run for the period of a year from to
NOW, THEREFORE, it is mutually agreed;
1. That the contractor will do towing, removal, and storage of vehicles
promptly upon the order of the Police Department of the City.
2. That the contractor will file a certificate of insurance of public liability
coverages with limits of $10,000 for property damage, and personal injury limits of

$100,000 for any person, and $300,000 per accident protecting the City of Fridley
from any loss or liability by reason of the act or acts of the contractor. The
certificate of insurance is to be filed with the City Clerk of the City of Fridley
and the insurance is to remain in force during the term of this contract and for any
renewal thereof.

3. The contractor shall maintain either indoor or outdoor storage for at
least twenty two (22) vehiclea. It shall be the responsibility of the contractor
to provide additional outside storage if needed to meet storage volume requirements.
The outside storage yard shall be screened in accordance with the policy established
by the City Council of the City of Fridley and all storage shall conform with City
of Fridley Code (Ordinances) and Minnesota State Statutes.
4. The rate per day for inside storage shall be $ The raCe per

6. The City shall not be liable, or reaponsible, for any Lowing or storage
fees or for any unpaid fees for storage or towing.
7. The contractor shall maintain at least one (1) wrecker available to the
Police Department of the City of Fridley for emergency call for a fulltwenty-four
� (24) hour service for the purpose of towing, removal, or storage of vehicle. Such
wrecker shall be not less than 8,000 lbs, gross weight, equiped with crane and
' winch as defined in Minnesot� State Statutes, 1967, 169.01 Subdivision 52.

8. The contractor agrees to have an individual available on call from 6:00
A.M to 12 Midnight daily to return vehicles impounded within one (1) hour after
request to tt�e owner or operator's custody upan payment of fees or costs due and
presentation of proof that the requestor is in fact the owner or authorized
operator of the vehicle.

I, ' 9. The contractor agrees to conduct all transactions with individuals whose
automobiles have been towed in at the request of a City representative, in a polite,
i� courteous and businesslike manner and will inform�the individual of tow charges and
not exceed tow charges specified in this contract for towing in conjunction with
� City requests, nor will such charges be exceeded without express approval of the

10. The contractor further agrees that this contract shall remain in force
' for a period of twelve (12) months from date of contract and shall continue in
force during such specified period and thereafter, unless canceled by either party

that Mrs. Marvin 0'Ber.g is present in the audience. She had requested
luzther study into the matter of the pending�assessments at the last
meetinq. He wondered if there was any time limit. Mrs. O'Berq said si�s
did not believe there was any. time limit. She said that if this
rezoning was voted out and the rezoning would not qo through, she assutae8
that she would get her money back from escrow. Councilman Harris said
that there would be a pending assessment as 1on, as the resolution orderinq
the improvement was passed. If it would,have been passed conditional on
the rezoninq going through, it would sti�l be questionable whether FHA
Mrould consider it a pendinq assessment. Mrs. O'Berg said that it should
have not been ordered in until after the rezoninq was passed. Counctl-
aaan Liebl said that the Council ha3 to adopt the resolution to indicate
to t�e ,people that tiiere would be pending assessments, and give them
an idea of how much it w�uld be. Also, to indicate to the Hiqhway
Department that the City is serious about pursuing this project. He
said that he felt that to be responsible to the people in that area, the
Council �hould adopt the Ordinance on second reading. If it is voted
out, there �rould be no pendinq assessments.
Mrs. O'Berg said that she was told on the telephone, by the Third Ward
Councilman, that there could be no pending assessments. She said that
she objected ta beinq given the wrong information. She said that she
would have priced her hous� for sale differently had she known that she
was goinq to have to put money in escrow. Councilman Liebl pointed out
that Mrs. O'Berg and Mr. Ken Strand are the only two people opposed to
this rezoning and that about 98+t of the people in the area are in favor
of it. Mrs. O'Berq pointed out that there was also a petition for the
rezoning first, then the people could sell their hoznes to c0�nercial
enterprises and they could put in the improvements.
Councilman Harris said that the Council is bound by the existance of
the resolution on the books. The resolution perhaps should have been
worded so that the im�rovement would be depenc:ent on the rezoninq
passing. He said that he was sorry that ther.e was a laak of communi-
cation. The City Attorney said that the FHA de�ermines whether there is
a pending assessment or not, and he did not know if modifyinq the
resolution would have any effect on the FHA's 8etermination. Council-
man Sheridan pointed out that if the reso_'_ution was worded to be depen-
dent on the rezoninq, it would have served no purpose. The purpose o!
the resolution was to alera:. the people in the area that there would
be an assessment anci to show the Highway Department that ths City
wanted the slip-off. ,

Councilman Sheridan said that he had asked that this be tabled at the
last meeting until he had talked to the City l�ianaqer. The Asaistant
Liquor Store Manaqer hae been deleted fr� the liat. He saia tbat A� had
discusaa8 this with soms of the City�employees and they ar� satislied
vrith the proposal. CounciLnan Samuels�n said that he thouqht that this
vras a qood proposal. Councilman Liebl a.sked if the City is authorized
to pay a lump sum amount. Th� City Attorney said that he woultl submit
a written report at the next reqular meeting. Councilman Harris said that
he noticed that most are an equal aa►ount, and wonder�d if the milet ua
equal. The City Manaqer said that they should be equal as far as
iaaintenance qoes, aa the Buildiny Inspectors d�cive more miles, but the
Asaessors are constantly sfi.arting and atopps.ng and thia would cause mora
wear and tear on the cars. Councilman Sheridan asked if the liability

DISCUSSION REGARDING NSP RELOCATIUN OF li5 KV LINE:
CounciLnan Harris said that the Council has seen the proposal for the
relxation of the 115 1N line. The concensus of opinion of the Council
was that they �+�ould not approve the alternate route proposed, and in tha
discussion suqqested another route, �thich vtuuld be p�rmissible. The
Council h�s indicated a dis-satislaction in the Map this has been handled.

Brian W. Porter, 6870 Channel Road, Fridley,
Minnesota submitted a claim for costs incurred in
digging up sewer service line from his residence to the
main. •Cost was $200.
When digging was completed it was discovered that
the blockage was cau�ed by roots in the portion of the
service (stub in from main iine) that was installed by
the City. The line installed by Mr. Porter was free
of blockage.
Recommend Mr. Porter be reimbursed the $200, since
the infiltration of roots into the sewage service line
was in the portion of the line installed by the City,

RE: SEWER BACKUP - BRIAN i�i. PORTER
6870 CHANNEL ROAD
I received a call fram Mr. Porter on December 12, 1969, regarding
a backed up sewer in his home (above address). I sent the aewer man up
to see what could be done to give Mr. Porter some relief from hie pro-
blem. I then went to said home and after conferring with our sewer
man, Arthur Silseth, we both agreed that the only way to detex�ine what
was wrong with the service would be to expose it. I informed Mr. Porter
of this and proceeded to help him find a sewer contractor that could do
the work im�ediately.
After exposing the sewer service, we found that the part of the
service that was put in by the City was completely plugged with tree
roots. As there were no roots in the section of sewer service line that
was put in by the homeowner, I can only assume that the City service was
faulty; thereby throwing the responsibility of the plug-up to the City,
as it was in our service line.
I would recommend that the City pay all or at least part of the
cost of repair to our service line. �ur Ordinance states that the pro-
perty owner is responsible for his own service, from the home to the
sewer main in the street. I�wonder if this will hold true in this case.

From late October through Deceraber 11th. 1969, rre had a reputab2e ss�ver
cleaning contractor out to open up our sevrer iine five times, an serrage
aas backed up in our basement. On the last sertiice call the contractor
Ras unable to clear the line and rer�ove the bacl�ed - up :�:ater.
�On Decesber 12th. t9E9, � called t1r. Chesney for some assistance and he
i��mediately had Mr. Silseth cong to ���e '�ouse ..o ascertain the cause of
the prebleM. , -
After measuring the line it �rras determined that the obstruction in the
line vras 78 feet from the house founda*.ion. This pZaced it outside t'�:e
property line. Nr. Silseth and I decided that in vienr of this, there vras
no ans�er excegt to excavate and ex�nose the line.

The attached aheet ahows interest earned by the City of Fridley during the
year 1969 on inveatment of temporarily idle funds. Earninga for the year
totaled $268,691.50. This campares with $220,399.02 in 1968. The higher
earnings are due principally to higher interest rates obtained on im►est-
ments.
The intQreat earned by each of the funda ia retained by that fund, aa required
by law, and ia credited as income of �he fund earning the interest. A large
part of the interest earned will have e�t��� a direct or indirect affect on
taxes that Will have to be levied in 1970 ox in future years. As an example,
' interest earned•by a bond fund that requires a tax levy, will �ean that leas
taxes will have to be levied by that fund in the future. Interest earned by'
, a fund such as the Liquor Fund, means there i� that much more money available
for tranafer to the General Fund.
A great deal of the intereat earned is for apecial assessment funds. Interest
' earned on apecial assessment construction accounta is credited against the
, cost of the project as the interest the City is paying on the bonds during
construction, is charged to that pro�ect. The money available for inveatment

in the apecial assessment principal and interest accounta as available primarily
because of prepayments of apecial assessments. When apecial assessments are
prepaid the City no longer collects interest on them, therefore, it ia important
that the maximum amount of interest be earned on imrestments in these funda.
Earnings frbm juat two of the funds, general and public utility, total more than
the cost of operating the Clerk-Treasurer's office during the year of 1969.

The following activities took place the week of March lb relative to the
subject relocation project:
A) Engineering Act ivity
Due to a minor reroute on the southerly end of the project, a
revision was made on the drawings this week and said drawings
will now be transmitted to the Right-of-Way Section the first
part of the week of March 23. .
8) Right-of-Way Activity
1. An option for easement was pregared and sub�itted to one parcel
' owner. This owner is gresently revie�ing the docw�cnt and it
is now anticipated that an agreea�ent may be reached the week of
March 23. As stated previously, the owners of t�+o other parcels,
for which easements are required, will not be available for fur-

North, Minneapolis, 55428, herein referred to as the Petitioner,
hereby requests the City of Fridley, Minnesota for permit
approval for the 13.8 KV Feeder Line located along the South
side of Minnesota Transfer Railway right of way between T.H. #47
and T.H. #65.
If said permit is granted, the undersigned agrees to
the following conditions and acknowledges that the permit is
conditioned upon the performance by the Petitioner of said
following conditions:
1 1) That 13.8 KV Feeder Line along the South side of
Minnesota Trans£ex Railway between T.H. #47 and
T.H. #65 will be removed and the underground
, feeder line will be installed in 73rd Avenue
between Hwy. #47 and #65 by 1975.
2) If Northern States Power Company did not plan to

Fridley Sanilotion has changad its nomt; therefore, ait chetks should be made
payable to ALL-SVATE DISPASAL SERVICE, INC.
Telephone number and address, however, remoin the same.
Regulor service consists of weekly remo�al of hows�hoid garbage, cons, bot-
tles, ashes or p�eper in as mar�s cons as is �aecessary to handle a week's
occumulation.
Yard cleon-up ( weeds, grass, leaves ) will be picked up for no additional
charge if placed directly next to the street in plestic bags or other small con-
fainen on pick-up day. Christmas trees and cardboord boxes may be disposed
of in a like manner.
Except for above changes, pick-up days and service policr will continue as
