receive the minutes of the Board of Appeals meetinq of Plarch 11, 1970. Upon

Chairman Erickson stated that Item �2 had been withdrawn. The petitioner
far the rezoning request, ZOA $69-12, Robert V. Pritchard, to rezone from R-1
(aingle family dwellings) to R-3A (apartments and multiple dwellings) the
South 2/3rds of Lot 4, Auditor's Subdivision �108 withdrew his request a�d t+ill
seapply for rezoning on a larger area.

Preaent to discuss the rezoning request were George Nelson, Sr., William
l�erlin, George Nelsc�, Jr. and Otto Sc-.luuid.
The layout for the apartment complex was displayed. Mr. Schmid called
attention to the profile of the buildings, laadacaping and parking, explaining
again that thev were trying to "play down" the parking lot as much as poseible
pith the use �af berms as a screen.
Mr. Myhra recalled that at the last meeting someone mentioned that, at the
� present time, there is a problem cancerning the children trying to get over to
i� � Flanary Park which is on the North side of Onondaga Street. He felt the Plan-
ning Com�nission should, at tha.s time, consider a type of path to the Park,

Geozg4 A. Hanaon, 1476 Onondaga Street: Ae reiterated his for�er coa�ente,
and said the neighbors and he were wonderiag why R-1 property should be resoned
to apartments when there i� plenty of R-3 land atill available. Further, there
vas never a request to put a street through the middle of the lots. The neigh-
bors have recentZy received a notice fram the schoolboard that they are going
to bus 150 children from that area to �laine. He felt apartmenta would bring in
more children and this would aggravate the problem.
Chairman Erickson explained the easement through the center of the lota wae
put there in caee the people would want to sell off the back part of their lota,
but it would not be used if they did not wish to sell. Pertaining to the placing
of the apartment buildings on the property, the City does have control through
the Building Inepection Department and Building Standards-Design Control Subcom-
taittee.
Dennia Herbet, 1482 Onondaga Street: He said he was still againet rhe idea
of apartments.
Gordon Gnasdoskey, 1491 Onondaga Street: He said that he moved in that
area to specifically get away from apartm�nts. New homes are still being built
there.
Mr. Myhra, referring to the Apartment Study the Planning Commission recently
com�pleted, eaid that what we have always thought to be true is not necessarily
so. People do move out fr4m apsrt�nts and the ratio in older apartments is
lower than the n�w oaes. The commenta most heard were basically the mobility
of the renters which presenta problems of children coming and going.
Mr. Fitzpatrick added that the apartr:ent study ahowed that the oldest
apartments in Fri3ley do n�t have more children than the newest ones.
Mr. Mittelatadt thanked the people for comir.g again to the Public Hearing,
and especially Mr. Hanson who took time off vork to do so.

to develop their property. The propoeal provides for the open apace adjacent
to tl�e lt-1 and therefore seems to be a good plan. The building would be on that
portion of the land already zaaed for apartme.nta. He stated, that to deny thia
1 requeat� would not solve the problerr of developing this area. The idea of
R-3 and R-1 joining at rear lines is better than having them face each other
on a street.

Mr. Myhra felt that the motion passed last year expresaed the Planning
Commisaion feelings.
Mr. Jenser. referred to the motion sent to the Council on May 22, 1969
which shaws t�►e thinking of the Planning Com�isaion. He said he did not like
to disagree with the neighbors, but he did feel that the point of contact
between single family and multiple is atill the best when developed along the
rear lot line rather than a etreet and this plan does achieve this sort of
development. If the Planning Commission can provide options for future
developing, they are serving the neig::borhood and com�unity in proper fashion.
MOTION by Jensen, seconded by Mittelstadt, that the Planning Comau ssion
recommend approval of the rezoning request, ZOA 1�70-03, by George N. Nelson,
to rezone.from R-1 (single famiZy dwellings) to R-3A (apartments and maltiple
dwellinqs) that part of the 1V� of Lots 30 and 31, except the North 125 feet
of Auditor's Subdivision No. 1?9 with the provision that the petitioner provide
an easement for street, walkway and utility purposes on the West 30 feet from
Onondaga Street to a point 25 feet South of the Southeast corner of Lot 28, and
provide no vehicular access be allowed frorrt the mvltiple zoning to the street
easement, and that such area of this said easement be allowed in computing
density of the multiple dw+elling pro�ect .an R-3A. Upon a voice vote, all voting
aye, the motion carried unanimously.

WHEREAS, the hazardous, busy intersection of University Avenue
(T.H. ��47) and 61st Avenue Northeast has beeh the scene of eleven
accidents thus far in 1970, several of which involved left turns, to
' include one fatal from said left turns, and

WHEREAS, left turn lanes and signal pole and light is installed,
but does not allow for a left turn only period for north and south
bound traffic,
NOW THEREFORE, BE IT RESOLVED, by the City Council of the City
of Fridley that the Minnesota Highway Department be and is requested
to install left turn directional signal arrow lamps with left turn
only time allocated by green arrow for motorists makic�g left turns

Pursuant to Minnesota Statutes i967, as amended, Section 471.62,
Air Poliution Control Regulations and Ambient Air Quality Standards
1-15, inclusive, of the Minnesota Pallution Control Agency as adopted
pursuant to Minnesota 5tatutes 1967, Section 116.07, as filed with
the Commissioner of Administration of th�. State af Minnesata an July
7, 1969, are hereby adopted by reference. Three copies of the Regulations
shall be marked as official copies and filed for use and examination '
by the pubiic in the office of the City�Clerk. ,

The City may require the instaltation of auxiliary combustion
facilities in all incinerators to meet the emission requirements of
the Regulations.

20NING: (George Balthazor, 1374 Hiqhway 100 N.E.}
' . The Assistant City Attorney explained that at one time Mr. Balthazor ca�e fn
and applied for a special use percnit to allow for a two family dwellinq. Si.nce
that time, the Building Inspectiox� Department discovered three electrical
' serviaes going into the house and reported it. It was checked out and found
that there were three fatt►i2ies residing there, and a summons was.issued. He
��\� said that it was his position that the Council could not legally grant anythinq
� tinder R-1 zoning under the present Ordinance.
Mr. Balthazor said that this is a double lot, so there is plenty of roosn. He
� �aid that there were twa families in the other section, no chiZdren. Council-
� man Liebl asked how this was first brought to his attention. Mr. Gibbs re-
pliecl that he believed it was first reported to the Buildinq Inspection
� Department be a neighbor, whereupon, the Inspector went out to check. Mr.
Balthazor said that they have lived there 18 years, and hdve had no complaints
fran neighbors that he knew of.

Mayor Kixkham advised Mr. Balthazor that the lega2 department for the City
has informed the Council that there is nothinq legally they could do under the
Statutes. He said that Mr. Balthazor's only recourse would be to appl.y for a
• rezoninq, but he did not want to give him the impression that he would encourage
� it, and he did not feel, personally, that it would qo thraugh.

The City Engineer suggested that the•resolution be passed before the appli-
cation be made, as he felt that it would carry more weiqht if the improvement
is already ordered in. Councilman Liebl said that concerning Main Street,
the industry on the west side has no objections to the improvement, but the
residents on the east side have been vigorously objecting. He said that he
felt that the parking problems should be solved before the street improvement
qoes in.
Councilman Harris said that he felt that if the improvement is already ordered
in, the City could go before the County and speak in stronger terms. Council-
man Liebl said that he did not want parking on the street. Councilman Harris
replied that if Main Street is taken over as a county road, they will place
certain restrictions on the street. Mayor Kirkham wondered if the apartment
house owners should not be approached on their parking problems as he felt
that it w�ould be a shame to wait another yeaz. Councilman Samuelson pointed
out that the City does have a Tagging Ordinance for taqging parked cars, and
if enforced along Main Street, with renters getting tickets, they will brinq
pressure on the apartment house owners. �
MOTION by Councilman Harris to table this resolution �o the Regular Council
Meeting of September 15, 1969. Seconded by Councilman Samuelson. Upon a voice
vote, all voting aye, Mayor Kirkham declared the motion carried unanimously.

he would suggest a solution for Mr. Balthazor. Mr. Balthazor is partially
retired now, and will be fully retired December, 1970. With full retirement,
he could receive a better tax break for disposing of his property. In the
meantime, he suggested granting an occupancy permit for the lower level to
run through December 31, 1970. Mayor Kirkham and Councilman Samuelson
concurred with this suggestion.
MOTIOt1 by Councilman Sheridan to deny the rezoning request by Mr. George
Balthazor. Seconded by Councilman Liebl. Upon a voice vote, all voting aye,
Mayor Kirkham declared the motion carried unanimously.
MOTION by Councilman Sheridan to grant an occupancy permit to Mr. b Mrs.
George Balthazor only, 1374 Highway #100, for the lower level third family
dwellinq, only at this address, with the permit to expire December 31, 1970
or sooner if he disposes of his property, with the permit non-renewable. The
motion was seconded and upon a voice vote, all votinq aye, Mayor Kirkham de-
clared the motion carried unanimously.
