NOTICE OF HEARING OF ASSESSM.ENT
SANITARY SEWER IMPROVEMENT PROJECT N0. S 91
NOTICE IS HEREBY given that the Councii of the City of Fridley wilt meet
at the City Hall in said City on the 8th day of June, 1970 ,
at 7:30 P.M., to hear and pass upon all— ob ctions, if any, to the pro-
posed assessments in respect to the fotlowing improvement, to-wit:
SANITARY SEWER IMPROVEMENT PROJECT NQ. S 91
The proposed assessment roll for each of said improvements is now on file
and open to public inspection by all persons interested, in the office of
the Clerk of said City.
At said hearing, the Council wi11 consider written or oral objections to
the proposed assessments for each of said improvements.
The general nature of the improvements and each of them is the instatlation
of sanitary sewer laterals and service connections and appurtenances in the
lands and streets designated in manner as fotlows:
SANITARY SEWER
All that part of Outlots 1, 2, and 3, Block 1, Moore Lake Highlands
4th Addition not now served, and that part of Herwal 2nd Addition
not now served.
The area proposed to be assessed for said improvements and each of them is
all that land benefited by said improvements or each of them and lying
within the areas bounded by the fotlowing lines:
A11 that property lying within the above described areas.
Said improvements wiil be assessed against the properties within the above
noted area in whole or in part proportionately to each of the lands therein
contained according to the benefits received. The total cost of the
improvement is $13,948.60. '

RESOLUTION CONFIRMING ASSESSMENT FOR SANITARY SEWER IMPROVEMENT PROJECT N0. S 91
BE IT RESOLUED by the City Councit of the City of Fridley, Minrtesota, as foltows:
, 1. The City Clerk has with the assistance of the engineers heretofore selected
by this Council for such purpose, catcutatea the proper amounts to be
specialty assessed for the
_SANITARY SEWER IMPROVEMENT PROJECT N0. S 91
in said City against every assessabie tot, piece, or parcel of land in
accordance with the provisions of law, and has prepared and filed with the
City Cterk tabulated statements in dupiicate showing the proper description
of each and every lot, piece, or parcel of tand to be speciatly assessed
and the amount calculated against the same.
2. Notice has been duly published as required by taw that this Council wouid
meet in regular session at this time and place to pass on the proposed
assessment.
3. Said proposed assessment has at all times since its filing been open to
inspection and copying by all persons interested, and an opportunity has
been given to alt interested persons to present their objections, if any,
to such proposed assessment, or to any item thereof, and no objections
have been filed; except
4. The amounts specified in the proposed assessment are changed and altered
as foltows:
5. This Councit finds that each of the lots, pieces, or parcels of land
enumerated in said proposed assessment as altered and modified was and is
specialty benefited by the �

in the amount in said proposed assessment as altered and modified by the
corrective ro11 in the amount set opposite the description of each such
lot, piece, or parcel of land, and that said amount so set out is hereby
levied against each of the respective lots, pieces, or parcels of land

6. Such propased assessment as attered, modified and corrected is affirmed,
adopted, and confirmed, and the sums fixed and named in said proposed
assessment as altered, modified, and corrected, with the changes and
alterations h°rein above made, are affirmed, adopted and confirmed as the
proper spAcial assessments for each of said.lots, pieces, or parcels of
land respectively.

7� Said assessment so affirmed, adopted, and confirmed shall be certified to
by the City Clerk and filed in his office and shatl thereupon be and con-
stitute the special assessment for
SANITARY SEWER IMPROVEMENT PROJEC7 N0. S 91
8. The amounts assessed against each lot, piece, or parcel of tand shall bear
interest from the date hereof until the same have been paid at the rate of
seven and one-half (7'2) per cent per annum. �
9. Such assessment shalt be payabte in twenty annual installments payable on
the first day of January in each year, beginning in the year 1971, and
continuing until alt of said installments sha]T have been paid, each
installment to be collected with taxes cottectible during said year by the
County Auditor.
10. The City Cterk is hereby directed to make up and file in the office of the
County Auditor of Anoka County a certified statement of the amount oF a)1
such unpaid assessments and the amount r�hich wilt be due thereon on the
first day of January in each year.
The motion for the adoption of the foreqoing resalution was duly seconded by

NOTICE OF HEARING ON IMPROVEMENTS

WHEREAS, the City Council of the City of Fridley, Anoka County,
Minnesota, has deemed it expedient to receive evidence pertaining to the
improvements hereinafter described.
�IOW THEREFORE, NOTICE IS HEREBY GIVEN THAT on the 8th day of
June , 1970 at 8��� o'clock P.M. the City Council will
meet at the City Hall in said City� and will at said time and place hear
all parties interested in said improvements in whole or in part.

HARTMAN CIRCLE AREA
The City Council of Fridley.has received a
petition from some property owners in the Hartman
Circle area requesting installation of additional
storm sewer system to better handle the drainage
and to improve the general design of the streets
in this area, which �are being constructed under
Street Improvement Project ST. 1970-1 this year,
from a minimal standard. Installation of this
additional system would increase the cost of the
street, and so in turn, the assessment to the
area property owners.
The City Council would like all the property
owners in the Hartman Circle area to appear before
the Council at 8:30 P.M., Monda , June 8, 1970 to
discuss this pro lem so that Council can ma e a
determination in regard to the petition.

The 1969 Ninnesota Legislature enacted as Chapter 590 a comprehensive act
which is cited as the �tinnesota Flood Plain �tanafiement Act. Section 1, Subdiv-
isions 2 and 3 of the act establishes the following policy and purpose of the
act:
Subd. 2. The legislature finds and declares that: (a) A larQe
portion of the state's land resources is subject to recurrent flood-
ing by overflo�o of streams and other watercourses causin� loss of li£e
and property, disruption of commerce and governmental services, unsan-
itary conditions, and interruption of transportation and communications,
all of which arc detrimental to the health, safety, welfare, and property
of the occupants of flooded lands and the peoPle of this state; and
(b) The public interest necessitates sound land use development as land
is a limited and irreplaceable resource, and the flood plains of this
state are a land resource to be developed in a manner w}iich will result
in �ninimum loss of life and threat to health, and reduction of private
and public economic loss caused by floodinR..
Subd. 3. It is the policy of t}�is state and the purpose of this
act not to prohibit but to Ruide development of the flood plains of
this state consistent with the enumerated le�islative findings to pro-
vidc state coordination and assistance to local governmental units in
flood plain mana�ement, to encourage local governmental units to adopt,
enforce and administer sound flood plain manaqement ordinances, and to
provide the commissioner of conservation with authority necessary �o
carry out a flood Plain management program for tho state and to coord-
inate federal, state, and local flood plain management activitics in
this state.
Section 4, Subdivision 2 requires that local povernment units complcte ancl
submit a lcttcr of inrcnt (forms attached) to co�nply with provisions of the act.
Subd. 2. ho later than June 30, 1970, every local governmental
unit shall submit a letter of intent to comply with this act, on a
form provided by the commissioner including any existing flood plain

The letter of intent will Provide valuaUlc information to assist state and
local a�encies in implementation and adninistration of the Flood f'lain �tanagement
Act. In addition, the letter of intent will Pernit the stltc to inForm the
Departmcnt of Ilousin� and Urban Development (EIUU), thc fcdcral aQcncy adminis-
trating the Federal Flood Insiirance Program, that local govcrnments intend to
cooperate with the state by implementing a local flood plain management program
in accordance with state standards.
The Federal Flood Insurance Act of 1965, {'ublic Law 90-4�18, provides for
a pro�ram of flood insurance for residents and small businesses. Section 1305
(c)(2) of.tlie law requires satisfactory assurance that rermanent land use
control measures will be adoPted by the statc or subdivisions thereof wttich are
consistent with land mana�ement and use criteria under Section 1361 of the lato.
The local letter of intent �aill Provide tliis satisfactorv assurance when com-
bined with the other rrovisions of tlie '•iinnesota Flood f lain �fanaRement Act
which requires local governmenLal units to ado�t effective flood Plain manage-
ment ordinances consistent with local governmental land use Plans and statewide
minimum flood plain management criteria and standards. The act rcquires that
the enclosed letter of intent forms Ue comrleted and returned t- o tFie_Commissioner
of Conscrvation by June 30, 1970.

WHEREAS the City has entered into an agreement dated , 19 ,
with Minneapolis whereby tiinneapolis has agreed to make certain of its se�aers and
its capacity in the Minneapolis-St. Paul Sanitary District sewerage worka available
for use by the City, and the City has agreed to pay for such use; and
WHEREAS Minneapolis is required each year to pay a share of the costs of
' the Minneapolis-St. Paul Sanitary District for its aewerage works and their
operation and maintenance in accordance with the budgeC adopted by the Sanitary
District Board° and
WHEREAS on Aupust ly 1970 the District, and all of its property and
contract rights, including the obligations of Minneapolis and St. Paul to make
payments to the District in accordance with its 1970 budget, will be taken over,
acquired and assumed by the Metrapolitan Sewer Board pursuant to ;�tinnesota Laws
1969, Chapter 449, Section S; and
WHEREAS Minneapolis and St. Paul will be required by the Metropolitan
Sewer Board to continue to fund the Sanitary District 1970 bud�et and to provide
funds for payment of debt ser�ice in 1970 on bonds issued for Sanitary District
sewerage works to be assumed by the Sec�er Board;

This letter is in response to y�r R�esolutioa Nc�. 93-1970 requesting
left turn arrows or phases off of T.H. k7 unto 61st Avenue N.E. The
Traffic Engineering Department has conEluded a study in ord�r to ds-
termine �ether this additional phase was warrartted. Accider� star-
tiatica from 1968 and 1969 were studied and a camparison ot the lePt
turn accident inv�olvemerit was made to similar interaeations whers
left turn ghases are in operation. Based an the results of this stuc�y�
we are reca�mmending that the necessary re�risions be performed to the
signal system to provide for the request. We will malte an atte�mpt to
make the modification as soon as possible. The only limitation being
design lead time and the availability of manies.
