REGULAR COUNGIL MEETING OF JULY 6, 1970
VISITORS:
Mr. Carl PaulSOn: Hazardous Buildin at 415 57th Avenue N.E.
PAGE Z
Mr. Carl Paulson said that this.is re.lating to a dangerous building on Lot 4,
Block 4, City View Addition. There is currently a district court case concerning
this garage. There has been a hearing and there is another one coming up and
he would like the Council to designate him as a witness so that he can testify.
He said that there has been some erroneous information and he is in a position
to clarify it. The attorney for this case is one held over froan the last
Administration and he needs the authorization of the Council for Mr. Paulson to
testify. He said that the property has been tax delinquent for four years, and
the structures adjoini.ng the dilapidated qarage are nery close aa8 he cauld nqt
see what would happen to this property.
bSOTION by Councilman Liebl to authorize Mr. Carl Paulson designated as friend of
the City and able to appear as aitness. Seconded by Councilman Breider.
Upon a voice vote, all voting aye, Mayor Harris 8ro te,m declared the motion
carried.
Mr. Paulsan said that he . would -like to be on the Agenda . when blatyor Kirkhant get
back to discuss qarbage pick-up costs. He said that the cost now a. hiqh, arid
he flt that it ould be going hiqher. Mayor Harris Pro tem r.aid that because
of tha gnitude of the problems relating to this question, t,h.is .iem w.l], be
back on the Agenda for the next reguiar Meeting.
Mike 0'Bannon.- Heather Hills Plat
Mr. Mike O'Bannon said that in the Heather Hills plat, there will eventually be
about 41 lots at the most. He hopes for three_entrances into the lots. He '
would likg to request that the 36' requirement be reduced to 31' for the entranve
road. There is 50' riqht of way and he would be makinq the road 31.feet back to
back.
The City Fanqineer explained that the Council has adopted a policy of 36'
roadways.in new pla.ts. An except.an.could be made_baeause of.th,e steepness of
the lope of the roadway on that section of the road that will be conerete if
the Council wants to allow a 31' road. Mr. O'Bannon agreed that the aoncrete
would be on the steepest part of the street up the.hill, and pointed out there
would be no parking on the hill.
MOTION by Councilman Sheridan to grant a waiver of policy of the City Counail and
allow Mike O'Bannon to put in a 31' road back to back on the concrete portion pf
the street, ta start at Rice Creek Road and qo southerly 300'. Seconded by
CounciLaan Liebl.
Councilman Harris said that he would like to see the concrete extend through the
interseation. The City Engineer added that of course, concrete i.s leaa costly
to tnaintain. Mr. O'Bannon said that this would add onto the cost of the lpt and
they are high already. The City Engineer asked if he planned to keep the blacktop
poztion at 36' within the plat._ Mr. O'Bannon said:that this wauld mean tak;i.ny
out sane beautiful maple and birch trees. There is one maple tree that would be
los that would probably cost about $500. Concilman Sheridan suggested off-
aeting the street within the right of way to save the trees. This has been
done before in the City to save soqne very lovelY old trees.

CONSIDERATIOW OT' GROUP HOSPITAirIZATI02d PLAN FOR THE NEXT 3EVENTEEN MONTHS:
(HENNEPZN COUNTY BLUE CROSS MII): --
The City Manager said that this infoiznation is the same as was presented
previously by the Finance Director. He said that Mr• Middaq, Purchasinq Aqent,
is pressnt to anawer any questions in the absence of the Finance Director.
The coaunittee made the recommendation to the Counci,l that the City accept the
Hennepin County Blue Cross MII plan. This would be effective Auqust lst.
Councilman Liebl at the last meeting asked if they were under the control of
the State and the City Attorney has researched it and presented his memorandum
to the Council.

CounciLaan ,Libl said that it appesrs that MII is a sock company, but Blue
Cross aud Biue Shield axe not, but are mutuals, And as such are not directly
under the jtuisdictian of the 5tate. He asked the City Attorney if, ia his
opinion, the City could take this risk.. The City ►ttarny explained that a
stock campany is subject ta mors direct control thari is a mutual caapany.
Mutual are, hoWever, under the jurisdiction of the Attorney Genez'al of the
State of Minnesota, and they have requested the-Inaurance Coamissi.va►ez to

REGIJI.AR C'AUNCIL MEETING OF JULY 6, 1970 ,
PAG 4
The City Manager pointed out that with a group of 4000 people, the nuppbex of
people that would be making a claim would not have a great affect on the
Premiuins• At least not as much as.if the group were smaller. CounciLaan
Harris said that he underatood that this plan is being considered as the plan the
City is now under would be accelerating their rates. The City Manager said that
this is txue, the old plan is going higher. .zf the eity oinc with Hennepin
County ths rates would be lawer and it appears that tha, woul,d $tay.laer_
beaause af the number of people involved. Councilmaa arri$ cpete ,at,th
purpoea is to ge t the most the City can for the least a.mount oi money.
Councilman Liebl said that he would vote for this policy a t.he cpnaitte
recanmended it, but he would put nare trust in a stock company. He felt Uut t.he
Gity should try it, as,it does qive the employees more coverage, lthough the
guaxantee is not there as it is in a stoak companr. Ig thi does.uot work,ou,
the City is nat bound for more than the 17 months, .ara,d .than it could be open,

it could be re-bid. Every quarter there is a review amd there could be ari inarease

AISCUSSION REGARDING ASSESSINT ON JEFFERSON STREE'Pj
Counci.lman Sheridau eommented that ,i.t . app.eared that <'Q:;,re: ame people
Fesent on this item. He said that the Council ha8 recai, ved sone ma#.erial o
this particular section ot,the street. At has been the policy. oi the Council in
the past on doubie frontage lots the assessment has been placed or the ncu-
addxess side at a rate of 25 of the normal asseasment charged for that street.
This has been the po.iicY- in the ast and he did- not: want to ee i,t chanqed.
Tn every case there has been a full right of way, but in the cas og Jeffersora
Stxeet, and the street on the scuth side of theplat, knamm as I,ayel,ar, or
57th Avenue extenrled, these are not full ridth .riqht ,Qt- ways or driving awcEaces.

their hames with this new street. Because the street is not full riqht of way
width, and never has been, his suggestion to the Council is that the people
in Donnays Addition cn. 57th and Madison be excluded fraaa the asaessment for
the impravement of Lak,eland Avenue.and Jefferson Street. He added that he
understood that the streets would be done in 1970 and would be on the assessment
rolls in 1971.
Mx. Ed. Marciniac, 601 58th Avenue N.E., said that the east 30' has been in-
corpoxated into their lots.
Councilu►an Lieb1 said that if there is a motion made,. he would like to acaent
that this is not full right of way width and the previous Cwncil gave of
thm street to Donnay, so that is part of their property. This malses this a
specific case, and he felt that the people backinq onto Jefferson could not be
assassed that iront on Madison. The street is there for the peaple living on
the west side and they should bear their share of the assessment. Since there
is na curbinq, the assessment would be less. Counciluian Sher.idan said that
,e Ccauricil never vacated the east of the street, as it was uever dedicated.
Tf the latting of Aonnays_Adc3ition had gone in as the Adams Street Addition

Councilman Harris asked if there was any chance that the property owner to the
south would see fit to clean up his property. Mr• Giancola said that this is a
foreclosure and he did not know what was going to happen with it. Councilman
Harris said that there have been a numlaer of complaints about debris laying on
the ground. The Council would surely like to see this area cleaed up. Mr•
Giancola said that he would make this request.
Councilman Sheridan explained that it is the practice of the Council to hold the
second reading of the rezoning ordinance in abeyance until all the plans and
specifications are in and the building permit is applied for, and they are ready
to start construction. The City has had cases in the past were a piece of
property has been rezoned, then there isnever anything done with the property.
This procedure is to eliminate this happening. There is no problem as long
as the petitioner proceeds with the plans. The rezoning ordinance can be
held in abeyance for 6 months awaiting the plans and specifications and if
nothing has transpired, the petitioner has to start all over aqain and go
through the subcommittees. Mr. Giancola said hat he was representing the fee
owner of the property and that Skelly Oil will have to take care of the plans
and speeifications and the application for the buildi.ng permit. Mx'. R.G.
Sundberq, Skelly Qii Company, said that the plans ar_ready and they cari malee
application for a building permit immediately.
Councilman Breider said that he would like to see the adjoininq rotY cleaned
up also. There is an old junk cac sitting there that 1e kn's of and. miscellaneous
other junk. Mr. Giaracola said that he would urge hiaa to do so. He said that he
has never discussed this problem with him sa he could not answer for him.
The City Attorney said he believed that there was already some action on
this. The City Engineer said that-a notice has been served to the property owner
and then everything has been turned over to the Giy Attorney. The Gity
Attorney said that he would check it out, and have a rport at the next regular
Council Meeting.
Mr. Giancola said that he was also going to start with the rgistered land survey
to take care of Lots 7 and 8 and the south of Lot 20. The Planning Gom-
mission had suggested that this be under a registered land survey. The City
Engin.eer said that he did not believe that the County would accept a registered
land survey and that it would have.to be platted.
The City Engineer said that their next step woul.d be to go to the Buildinq
Standards-Design Control Subcoaamittee afor approval of their plans., As-to the
special use permit he suggested that it should include the followinq stipulations:
1. That they would dedicate a 15' strip, plus a radius at 73rd Avanue and
Cantral Avenue.
2. That they would pave the additional lane and put in curbing on the north and
east sides, both to be dedicated to the City.
3. Curb all the blacktopped area.
4. Understand that the special use permit is for gas station and service station
only.
Mr. Richard Harris, Building Standards - Design Control Subcommittee, said that if
the plans are ready, there is a meeting next Thursday and they may.be able to get
on the Aqenda. Mr. Sundberg said that the plans are ready. Councilman Harris
said that if the plans are approved before the 20th, they would be back on the
Council Agenda at that time.

DISCUSSION REGARDING STATUS OF PROJECT #93 (NOYES):
Mr. Comstock of Comstock and Davis, Inc., Consulting Engineers, handed out
copies of a letter to the Council under date of July 13, 1970. He said that
he had met with the consulting advisor of the bonding company and it appears
' difficult to arrive at a total estimate of funds to complete the woxk until
the existing sanitary sewer ork is checked. Ae felt that it should be
examined by televising so as to be able to estimate the cost of repairs to
bring the project up to the specifications. He said that in the discussions
, with the consultant there are three ways to get the project conpleted. One
would be to have Noyes complete the work, the second would be for the
bonding company to take it over and coiaplete and the third would be or the
City crews to complete the work. He felt that by televising the sanitary
sewer lines the City would be in a better position to state an estimate to
complete the work.
Councilman Harris asked if this would be a commitment of additiona funds
from the retainage. Mr. Comstock said that this could be a point of argument
after the fact. The bonding copany could say that the cost of televising
' was a needless expense, and that the facility could be tested by normal
means. Even so, he felt that this would be the best way to proceed.
Councilman Liebl asked how much of the total contrac.t has been paid. Mr.
Comstock said that about $116,000 has been paid of a total contract of
about $235,000. Councilman Liebl asked if 80$ of the work has been campleted.

SPECIAL FUBLIC HEARING MEETING OF JULY 13, 1970
PAGE 19
Mr. CautStxk said no, about 80$ of the pipe is in the ground but saae of it
is not satisfactory. He added that there is about 5400' of the pipe to be
televised. Gouncilman Haxris said that it seems that this is the only way
to proceed, the course of action for the City is rather limited. The
City Attorney said that they feel that they cannot proceed until it is
known what shape the pipes are in. He said that the bGnding caapany has
shown quite a bit of interest in this job, and have shown a real inent to
work with the City and pay their share. He agreed that there may be an
argument about the televisinq later, but he did not want the City to
accept worlananship that they would have trouble with later. Counci.lman
Breider asked when the cleaning could start. Mr. Canstock said that the
woxk could be startedin the morning and the television people have been
alsrted that if the Council approved this action, they are to start
Wednesdax morning.
MOTON by Counci]man Liebl to authorize probeeding according to the
recommendations of the Consulting Engineer. Seconded by Councilman Breider.
Upon a vaice vote, all voting sye, Mayor Kirkham declared the motion carried.
Counci].man Liebl asked if they could expect the project to be coc►pleted by
tha .st o September. Mr. Camstxk asid that this is a big queston mark
and once the televisinq and cleaning is done an estimate of time cauld be
qiven. He said that he should •be able to give aui estimate of the am►ount
of time left on the project in two weeks. He added that perhaps the industries
that axe waiting fox the facilities, could hook onto the water line, rather
than wazting for the completion of the project. There dces not seem to
be any trouble with the water line. If they hooked on, it would be subject
to the City Administration inspection and approval.
DISCUSSION REGARDING RETAINING TAX FORFEIT LOTS:
The City Engineer said that at the last meeting a map was shown the Council
showing some lots that could be retained fran the tax forfeit sale for
dumping street sweepings and material from constuction. There are two
lots along Alden Way that Councilman Breider had said that he would check
out. He said that he talked to the Parks and Recreation Director and the
Park Department would be very much interestedin these lots if the price is
right.
Councilman Breider said that he had talked to some of the property owners
and they would like to have the lots filled but not necessarily with street
sweepings. 'I"hese two lots are considered unbtiildable, but they Would give
the Park Department access to ]11den Way. T'he people did not feel.that
dwnping street sweepings would be desirable. Mayor Kirkham said that it
sounds more abjectionsble than it really is. It would be fine sand and
good clean fill. Councilman Breider wondered if thia would not mean that
the sand would be blawing aUout. The City Engineer pointed out that the
City has material that it must get rid of. No matter where it is put,
someone would be unhappy. He said that a snow fence could be put in to
try to keep the sand fran bowing. Councilman Harris said that the lots
are too law to benefit the Park Department without the fill. It would seem
silly to purchase tax torPeit lots and also have to buy more fill, when the
City needs a place to dump ciean fill anyhow. The City Assessor said that
the lots would not be appraised very high since they are considered
unbuildable.
' SPECIAL PUBLIC HEARING MEETING OF JULY 13, 1970
PAGE 20
'
Councilman Bxeider said that he would not have too much objection so
' long as the dumping was kept in an orderly manaer and there were no big
piles allaved to remain. The City Enqineer said that there would be sane
problem, but the lots have to be filled to use.

The City Engineer questioned retaining Lot 10, Block 22 in Donnays Addition.
This is a stretch of property that could be used for entrance onto 7th
Street. Now service is only fran T.H. #65 at Moore Lake. Z'his ccaxld be
retained as public right of way for future development for access onto
7th Stxeet. He asked how nuch this would cost. The City Assessor said
about $6000 to $7000. Councilman Hsrris pointed out that this would not
be a drive-in theater forever. He said that there would be more and more
traffic generated. Would this be a way to avoid channelling all the traffic
back onto T.H. #652 Councilman Liebl said that this is a long narrow stretch
of land that the City could use ae right of way. It could be a sound
investment to hold in abeyance. The City Engineer said that it would have
to be part of a total plan involving the whole parcel. Whoever develops it
would have to provide access onto 7th Street. The City could be spending
$6000 for public uight of way that is riot neaessary. It would be up to
the developex to develop the property. CounciLnan Harris said that he hated
to see a piece of property remain dormant and continue to be a maintemance
problem. He suggested alertinq the property owne to the south with the
suqgestion that it be purchased and added to the parcel. The City Asessor
said that the property owner to the south is interested in the land, but he
did not know to what etent. Councilman Liebl said that the only one who
would benefit is the man owning the drive-in theater and he is the one tha8
properly should pick up the land. Z"he City Assessor said that this lot has
already been released. Councilman Harris asked that if the lot is not
picked up at the auction, that the Council be apprised so that they may
reconsider acquiring it. The City Assessor said that he would make it a
special point to call the County the next day after the sale to see if the
lot was acquired by somebody.
The City Engineer said that regarding the lots on Pierce Street, Councilman
Sheridan had said that he would look at the lots. He said that he did not
seem to favor the ide8 as this is a nice reaidential neighborhood and there
is a very steep bank. Unless Councilman Sheridan told any of the Council
differently, he would recommaend that these lots be released.
MOTION by Councilman Harris to retain those lots on Alden Way and south of
69th Avenye as outlined on the map submitted by the City Enqineer, and
relsase those on Pierce Street. Seconded by Councilman Breider. Upon a
voice vote, all voting aye, Mayor Kirkham decTared the motion carried.
Mayor Kixkham brouqht up the queation oi what to do with unbuildable 40'
tax delinquent lots. He wondered if there has ever been any cases where
the assessments were forgiven, so that the lots could be picked up by the
adjoining property owners who could not afford to pay the old assessments.
In this way they could be qotton onto the tax rolls. The City Enqineer said
that the assessments could be re-spread, but to his knowledge they have
never been forqiuen. He said that the Administration could research this
more and report back. Mayor Kirkham said that he knew of cases where the
adjoining property owner would ike to pick up a tax delinquent lot but
cannot afford the assessments. ,

PUSLIC HEARING ON STREET IMPIiQVEMENT PRA7ECT ST . 1971-1 I►ND ST . 1971-2 (DlS,AS ):
Mayor Kirkhattt read the public hearing notice aloud for the benefit of the
audience, and said that these streets are part of the City's l0:yeaC street
improveraent prograttt. Counciman'-Harris added that these streets wovld be
constructed in the construction year of 1971 with the assessaaent going on
the 1972 rolls. He added that any sreet could be accelerated into an
earlier oonstruction year if the people so desired as the cost of con-
struction is going hiqher every year. It could be to their advantaqe to
do them sooner than scheduled, rather than waiting for the scheduled ysar.

Dover Street: 100 feet East of Broad Avenue to 450 feet to the East ar►d

Altura Road: 53rd Avenue to Horizon Drive
Mr. Michael I,ewkowicz, 5407 Altura Road N.E., asked why the estimated cpst
is $14.95 when a few years ago it was many dollars lesa. setar ie
already in. Mayor Kirkham said that this is only an estiatated price and
there has not been an actual bid as yet. The Enqineering Departmeat ariti-
cipatea the cost. if the actual cost is less, that is the amount that the
people will be assassed. Mr. L,ewkowicz asked about the City park. Maypc
Kirkham said that the City park is assessed to the City of Frdley.
Councilman Liebl said that the estimated cost for Altuxa Road is $14.05. The
City Manaqer added that the bids have gone up about 25. Mr. Lewkoticz said
that their land is in the same con8ition as any other street, so why is it
more. Mayor Kirkham said that this is all done by open Bid. Mr. Lewkary+iaz
said that he thought that the price was way out ot line. He asked why sane
streets are higher than others. The City Enqineer said that it depends on
te eoil conditions and the lay of the land. This is also a curved street
and is assessed somewhat differently. The proposal is to add saane catch
basins to catch the water so it does not run so far. These things all
affect the total cost of the street. Whatever the total cost of the street
is, after it is bid, will be the amounZ assessed to each property oamer.
Hopefully this esti.mate is high. He said that they try to keep the esti, mates
high so the people will not be misled and upset when the bids cane in. The
cost of construction has been going up at a fantastic rate. Mr. Lewkowic
said that maybe it should be let go for another tive yeara, the casts are
bound to level off sometime. Councilman Harris said that as the Mayor
indicated this is an improvement hearing not an asseasment hearing. He
pointed out that when a project is iaid out, streets are grouped toqether in
the same general area to try to keep the costs to the contractor down.
This saving is passed on to the property owners. He added that there will
probably be about 20 invitations to bid sent.out. Mr. Lewkowic asked if
that estimate includes the aost of the storm sewer work nnd the City
Engineer said that it did.

Mr. Glenn Mostoller, 5420 5th Street N.E. asked wha was pro,}ased for the .I.ley.
The City Enqineer said tha the work proposeri is to put down a gravel base
underneath, then blacktop it. Mr. Mosto]:ier said that his troble in the
past has been to get the City to snowplow the alley. He gat a tag last year
,from the Health Officer because the gaxbage was not picked up, but the
gaxbage haulers could not get down the alley. Counczlman Harris said that
the City does not maintain alleys that are not improved. Mr. Mostoller
said that he weuld be assessed both in the back and the front and his
assessment would be quite h:>gh. He could not see what he got for his tax
dollar. Councilman Harris informed him that 11C of every dollar is taxes to
the City and for that tae get-s police protection, fire protection, parks, eto.
This would be an assessment, not a tax. Mr. Mostoller said tha►t ast wintex
the Citx Police Department would not allaw cars to park on the street, but
'khey could not get into the nlley because it was not plowed. Councilutan
Harris said that this would correct ths.situation, as.inlproved alleys are
maintained. He pointed out that if the plows tried to plow unimproved alleys,
they would damage their equignent. Mr. Mostoller said that his llt shoud
buy something. Mayor Kirkham said that street and alley improvements are
assessable and thy do not come from general tax money. With the black-
topping, the alley will qualify for snowplawing. Mr. Mostoller asked if
there was any storm sewer work. The City Engineer said that the storm
sewer was already in. Counci].man Harris pointed out that in the public
heairng notice it specifies all the necessay improvezaents, as a standard
form is used and some streets need sane additionai work, such as sorm
sewer or sanitary sewer.
5th Street: 53rd Avenue to 54th Avenue
Idz'. Richard Byers, 5300 5th Street.N.E., asked the cost of the in►provement
and he was told that the estimated cost was $14.90 per foot. Mr. Byers
asked why the rest of the area is not included in this project. The City
Engineer explained that Sth Street north of 54th Avenue is already under
contract for this year. He said that he was not notified that 5th Street
was going to be improved. Councilman Harris asked if he was buying under
contract, and Mr. Byer said yes. Councilman iiarris said that the listing
for sendinq out the notices is received fran the County and they list the
fee owner.
!rlrs."vin Layland, 5331 5th Street N..E., said that she understood that
this was for curb, gutter and street and the eost was $14.90 per foot.
Mayor Kirkham said yes. She asked if that estimate included everything and
the City Engineer said yes. She then asked the coet of the alley and was
told $2.37 per foot, and that it would be maintained.

Alle between 5th Street & 6th Street: 53rd J►venue to 54th Avenue
Mr. Earl Miller, 401 53rd Avenue N.E., said that he could see no purpose
for this alley to go throuqh. There are two garage that use the alley r►ow,
so the improved alley voud be in the nature of a pri:vate driveway. The
rest of the garages use the street entrance. Cowzca.lman Harris explained
that normally when there is work to be done in an area, an opportunity is
given for all the work ta be done necessary in that area, as it can be
dane cheaper when the contractor is in the neighborhoad. It is presented
as an option if the people are interested in pursaing it.
Mrs. Layland said that they hava to have the garbag cans sitting in ths fxont
so that they would be picked up. She felt that there was a definite need
for the alley, and that it was a good price. Courxcilman Liebl said that
there are a lot of ticket. givexz in this area and if the alley is improved
and maintained by the City cres, it ahould take care of the qarbatge
problems and the problem with the snow p1ow. He felt that iE th improve-
ment went in, it wauld b a help to the whole block.
6th Street: 53rd Avenue to 54th Avenue
Gouncilman Harris commsnted that the cast of this treet per foot.is $14.90,
as it i.s with the other treets in t.lais neiqhborhood.
54th Avenue: 13Q feat West of 4th 5treet to 5th Street
Counci, lman Liebl asked if thexe woulci be any trauble with the water
drainage. 'he City Engineer said that the storm sewer would take care of
it. There are catch basins planned. The catch basins now do not take care
of the water because it is a dirt street.
Mayor Kirkham informed the audience that the Council does not take action
on any of these streets at the public hearing meeting. Action will be at
a subsequent meeting. Councilman Liebl said that in the next week, he
will check out these streets anci review the camments made at this meeting.
On occasion, streets are deleted by the Council because of hardship cases.
These streeta are in the l0 year street provement program, and there must
be a public hearing.held. He said that he would also check the people's
tax problema. Upgrading the streets in the area, brings about an increase
in property value, and would also take care of sane of the canplaints
generated froa this area.
MOTIODi by Councilman Lieb1 to close the public hearing on St. 1971-1.
Seconded by Councilman Breider. Upon a voice vote, ail voting aye`

Mr. Richard French, 1469 Gardena Avenue N.E., asked if this wld be a
wider than normal residential street. He said that Gardena Avenue is a
drag strip and the speec3ing is quite a problem. He said that his personal
feeling ie that if the road is improved, the speeing would be worse.

residential street. The City Engineer said that the proposal is to keep the
same width as the existing width of about 40' blacktop plus curb and gutter.
Mr, French asked about the drainage coming from Grace High School. Unless
the drainage is taken care of the street would not last. Mayor Kirkham
said that this street is intended to be permanent, so the drainage would
be taken care of, along with curb and gutter.
Mr. Bailer Tiller, 1535 Gardena Avenue N.E., asked if just because the street
is in the 10 year street improvement proqram, does t►is mean that it cannot
change. Counci].man Liebl said that this is the reason for the public
hearing; to hear the wishes of the people affected. He said that he did
realize that interest:is very high. Mr. Tiller aked why there was never
a sealer put on every two years to preserve the old Gardena Avenue. He
said that he wou].d have liked to see the old street saved. He said that
there was nevex a sealer put on the street. The City Manager explained that
one of the reaons for the 10 year stree't improvement program is to eliminate
putting a sealer on a street that is schedul•tersaid that itltheing
year. This would be a waste of tax money•
street had received a sealer, it would not be in the condition it is in.
He painted out that there are sane peaple living on Gardena witheac ed
incacne and this assessment would hurt them• It seeias that pEOp
affoxd tp kaep their homes when they retire. He said that he knew of no
one that was in favor of the sidewalk$t .He pointed vut that on Mississippi
the childran atill walk on the street, so sidewi3ks are not the answer.
The children do not have to walk on any sidewalks to-get to Gardena
Schoal, there are other walkways provided and paid for by the school.
It wauld be cheaper to bus them than to put in the sidwalks. He added
that frou► Arthur Street, the water will run the other way, towards Stinson.
Mr. Robert Gunville, 1110 Gardena Avenue N.E. said that he was speaking for
about 24 property owners and would like to present a petition. He then
read the petition aloud.
PETITION NO. 9-1970 - IN FAVOR OF.TIiE.STREE'T IMpRVEMNT T ECTING
TO THE PRAPOSED SIDEWALKS ON GARDENA AVENUE
MOTION by Councilman Harris to receive Petition No. 9-1970• Seconded by
Cauncilman Breider. Upon a voice vote, all voting aye, Mayor Kirkham
declared the motion carried.
Mx.French said that he had covered every home but one, on the north side of
Gardena from Central to Arthux' and the People were unanin►ously objecting to
the sidewalks. Councilman Liebl said that he had walked up Gardena ere
Avenue and he felt that the street must be put in. Mr. French agreed,
was almost unanimous appraval of the street improvement. It was only the
sidewalk that the people objected to. It is felt that there would not be
adequate room for snow storage, and the children still would not be using
the sidewalks. Gardena is centrally located and there are blacktopped
walkways in a wagon wheel fashion for the children to walk on. T1zeY are
already there and have been paid for by tax money.
Mr. Joe Randall, 5901 Central Avenue N, E. said that he lives on sition
' Mississippi Street and his mother lives on Gardena and spoke in oppo
to the sidewalks. He said that he did not feel`that the sidewalks were a
success on Mississippi Street.

SPECIAL PUBLIC HEARING MEETING OF JULY 13, 1970
PAGE 25 I
Mr. Glenn Lillars, 1561 Gardena Avenue N.E., said that he lives between
Arthur and the City line and received a notice, and wondered if he was in
the project. The City Engineer said that if the water runs taward Stinson,
he would not be in the assessment area. He asked why not do the rest of
Gardena this year. The City Engineer said that this area is in the worst
shape. They felt that the rest of Gardena cauld stand another year of
wear. If the residents want the rest doae, it could be added into the
construction project. He said that the assesment is $13.38 per foot and
there ia sonae additional cost being picked up fran state aid funda. He
added that there could be state aid money for the sidewalks.
Mrs. Hazel 0'Brien, 1080 6ardena Avenue N.E. asked what happens when the
sidewalks need repair. Mayor Kirkham answered that this problem has never
come up as yet. Mrs. O'Brien said that she was not in favor of the side-
walks.
Mr. French asked how the storm sewer districts would be deteriained. He
said that about 1/3 of hi.s lot drains toward the street and 2/3 ia held i
the back yard. The City Engineer said that tiiisstorar sewer dietric is
basically to take cere of Gardena Avenue. He added that everyone is ir one
storm sewer district oz another, and also it is possible to have one
property in two drainage districts. Mr. French said that he did not mind
paying for storm sewer to take care of the water.that ww2d contribute to
the erosion of Gardena Avenue. The City Engineer said ttxat thia distriat
ie only to liminate the erosion of Gardena Avenue. Mr. Tiller felt that
the hole by Grace Hiqh School would hold back a lot of the water and it
would cause no problem.
Mr. Robert Sather, 5927 Central Avenue N.E. said.that he received a notice
and wondered if he was in any assessment area. The Gity AssesSOr said yes,
he would receive a side yard assessment. Counciiman Harris then explaired
the poliy with side yard assessments, and advised the audience that if ttiey
wished to know their individual assessments to call the City Assessor the
next day.
Mr. Raymond Renar, 1564 Gardena Avenue 1I.E. sa.id that hs asumed that the
same would apply to him, in that he would not be in the storm sewer assesa-
ment area if the water drained toward Stinson, and the City Enqineex said
that this was correct. .
West Moore.Lake'Drive: Carol Drive to 136.feet East.of Baker Avenue
Mr. So1 Gunzburger, 6209 Baker Avenue jd.E. said that he received a notice
but his street is already in and wondered what was proposed. The City
Engineer said that he received a.notice because of the sidewalks. Mr.
Gunzburger felt that his land was already ruined with the putting in of
the street. He said that the sidewalks would be put in over his dead
body:
Councilman Liebl asked the audience for an expresaion of their sentiment in
regard to putting in the street improrement. The Fire Department feels.
that it is in bad shape and should be replaced. Mr. Gunzburger said that the
black-between Baker and University is a race track. This street has been
graded three times and blacktopped three timas sinc he has lived there.
He said that when he bouqht this property there was er any talk of a
sidewalk. - -

time people did not want the i.mprovement. At that time the estimated
improvement was $8.47 per foot, so there has been over-a SO$ increase in
cost in the last four years. The trend is that construction costs are
going up faster than the cost of living. He explained that the 10 year
program is so that everyone will eventually have a street up to eity
standards. Maintenance funds came from the general tax dollar and it is
not fair for those that have paid for a street to also have to pay for
someone elses street,,through maintenance funds, because they do not
warit the assessment. Once the streets are in to Citr standards, they are
treated and seal coated to try to lengthen their li€e.
Mr, Savelkoul said that he felt that the residents should be responsible
for normal residential use but not for the extra wear and tear fraa ths
trucks etc.' The usual standards of neighborhood traific do not apply.
This is an unequitable proposal and he would be opposed to the $13.92 per
foot assessment.
Mrs. Warren Hansonad that she lived next door to Don 5avelkoul and the
statement was made that the cUrve would act as a traffi.c deterrent. She
felt that this was not true as euery year there are cars that end up in
her fxont rard, and there are always several collisions in f=ont of her
house. The City Engineer said that:the point waa that curbing was ueeded
to help contain the cars and keep them out of hr front xard.
CounciLnan Harris suggested that sane control over the traffic aould be
done by a three Taay stop between T.H. #65 and Able street. Between 61st._
and University the traffic is slowed down by the stop sign on 7th Street.
The City Engineer said that he would study this and look over the accident
records of the Police Department. -
Mr. Francis Van Dan, 63a2 Baker Avenue N.E., said that he had the.south S
of Lot 10 and the north of Lot Z1 and he did not think that he should be
assessed. he City Assessor said that there was an assessment S voay up the
block. Mr. Van Dan said that at one time 61st and West Doore Lake Drive
were county roads. The City Enqineer said that they were not to his
knowledge. Mr. Van Dan said that he would have to agree that it was a race
track. Fie suggested a"School Zone" sign, or iimiting fihe speed to 15
miles per hour, as there is a complex of three schools in the viinity.
He suggested that it could be made one way.to the church. This would be
sanewhat of a hardship, but it would reduce trafie to the residents.
Mrs. Don Savelkoul said that in reqard to sidewalks. all the children are
bused to Rice Creek School. All the children across T.H. F65 are bused.
There is getting to be fewer and fewer children that walk to schools.- The
Senior High students drive cars and there are only a few Junior High that
walk. She said that she could see no point in sidewalks, and did not want
to lose any of her land.
Mr. Warren Hanson, 900 West Moora Lake Drive N.E., said that he ould like
to add his objection to the proposed sidewalks also.
Mr. A. Amerslav, 870 West Moore Lake Drive N.E., said that he tould agree
with his neighbors. The street is needed, but the sidewalks are not.
SPCIAL PUBI,IC HEARiNG MEETING OF JULY 13, 1970 a8
rir. Richard Anderson, 861 West Moore Lake Drive N.E•, said that he agreed
that the street needed fixing, although he must a3so agree with Mr•
Savelkoul. This street is not strictly a residential street, there is too
much traffic. He felt that a three way stop sign at Able might help to
contxol the traffic. He said that he did not understand why the pxoposal
fcsr the sidewalks. They rould qo out to T.H. #65 and quit at the Highway.
Councilman Harris said that the sidwalks were part of an overall plan
that include$ a controlied access at that intersection. Mr. Anderson
asked if•there vrere any plans for sidewaiks for AbYe.or Baker. MaYor
Kirkham said not to his knawledge. Mr. Anderson asked how wide the street
was qoing to be and how much boulevard there is for the sidewalks• The
City Enqineer said that the street would be tlze-same width as by the St.
Philips Chuxeh. If the same procedure-for the sidewaks is follved,
the property wiould be given by tiie property owner and t31en they would not
be asseased. The sidewalks would then be on the property owner's land.
If the land is not given freely, he would recm►end that there not be
sidewalks as there would be no roan for snow storage. Usually S' is
needed in t11e boulevard, but there have been-cases=where.sidewalks trave
been put in with iess:. Mr• Ar►dersan aske8 if there was considerabie amount
of objections, could the City condemn. ''he"CitY FuJiuer said that they
da have that xight. The sidewalk program was adopted in conjunctivn, with the
schoola. .t►d this sidewalk wae in-the pians. _ --_ __.
A resident asked about the drainage. The City Engineer said that the
sstem vas:installed when the rest of West Moore.Lake-Drive_was:paved-
in 1966:• The storm sewer-system is already pro►ided for. The resident
said that he also wuld.object to the sidevalks. He.felt that he waild
not be able to maintain the grass because of the salt xised-:and the
grass would not qrow in the boulevard area. -
Mayor Kirkha sugqested jurt putting the sidewalks on the north side of
the streot and off centering the street within, the riqht of way. g
City Engineer said that there was only 69' riqht ot vy here, but it
cauld probably be worked out.
Mr. Stan Carlson, 6219 Baker Street N.E. said that he agreed with his
neighbors on the sidewalks. He said_that he.could see no qood use
during the chool year, when.they would be needed, they would be covered
with snow. The sidewalka by the ciurch are not cleared• Consideration
must be given to how to clean And maintain them once they are put in.
A resident from the area Said that he belonqed to St. Philips Church and
they have found it itapossible to keeg.their sidewalk cleared in winter.
He said that he was not in favor of sidewaiks, - and be tfiou9ht t 1e
City wauld have trnuble getting land iram th north side of the street.

REPORT ON WATER LINE IN HZCKORY DRIVE:
The City Engineer explained that the Council previously authorized giving the
contract for the repair of the joints in the water line to G.L. Contracting
Ine. Since then his department has found that there is more repair necessary
than was anticipated. He suggested that the laying of the new line in
Hickory Circle could be put into the street improvement project (although
it would not be assessed) and have that contractor do•this work, and have
G.L. Contracting Inc. continue to replace the joints. Councilman Liebl
asked if this would save any money. The City Engineer.said no, it would
just be splitting up the work t.o eliminate letting nother contract.
Councilman Liebl said that this would have to be done before the new stxeet
is put in anyhow. He asked what preventions were going to be taken to
forestall this happen.ing again. The City Enqineer said that the 4" line
in Hickory Circle was goir,g to be increased to 6" sca that it could be
flushed and the joints axe going to be wrapped with polyethylene. Council-
man Breider asked how much the new line would cost. The City Engineer said
that it would be over $35Q0 and would not be assessable it would be in
the nature of a repair.

Mr. Winters of Skelly Oil Company was present to present the request.
Mr. Winters stated that the station will be a 3 bay station. The outside

would provide a design for them to follow.
The Board questioned whether or not the driveway entrances were set back =
far-en+ough froan the intersection. The Board also stated that the station
would have to have 16" centers on all wood framing instead of 24" centers
as showu on the plans because of City ordinance. They also said that there
should be some type of security lighting behind the building.
Mr. Winters stated that they would also have poured concrete curbiag arout►d
al the lanting area.
i The Board warned Mr. Winters against storage of any snowbirds aud junk cars
an the property and also asked him where the trash would be stored. He
pointed out the proposed trash enclosure on the plans.
MOTION by Tonco to recammend that a permit be issued subject to the

The Ptbli.c iieax.ng tice was xead by Chairman Friakson.
Mr. Sb'medeke aaid the proposed Preliminary Plat had been heard before the
Subcommittse earlier in the evening. The Subcomm4ittee previously had tabled the
request unt1 all members wexe present. The street pattern had been set and an
isl.and ofi 1,3 acres was created to prevent traffic congestion on Uaiversity Avenue.
The Subcammittee wauld have liked to see the slip-off ineet the ordinance requre-

preeted.
Mr. Harris e1t .3 acrea would not be large enough to put amy ecrt of iadus-

but the deiga might not meet the Code because of the setback requiremeata.
;t w mentioned that South of this area, there are three filling gtations

° Mr. Janes said he appreciated the f act that the Planning Commssian's concera
thaC the island hould be ]..S acrea, but he had been asked to work with the City,
ead his eurveyor had done so, and under the circumstances, he fe].t that hat thy
had come up with, ehould be adhered to. The surveyor had made a dtailed plaa.
and to have the pcoperty re-surveyed, would coat conaiderably more. Ae felt for
b1m to go to this added expense, was not quite fair. He wondered if he had to
chaxtige i.t, if the City would pay for the additional cost. The comaent waa made to
him that h3s $urveqor had dane more than he had to do f or a preliminary plat.

names at ttight. He added that if we could save a life by police, aanbulaxtce or
fire depaxtment by putting these signs on the main intersections, it would be
mor than worth it.
The cost per block for installation would be about $50.00. Whenever a street
is reaux'faced, curb and gutter, or a new street isput in, then provision could be
made for this in the project.
The Chairman auggested that~i he-sgas qtere plgccdtaqr,r jY:harough-
fre first, such as =eplacing all signs on Miasissippi Street frrnn University Ave-
nue to Central Avenue, the reaction from the public would indicate whether or aot
they wexe well received and should be considered for the rest of the City. It was
further suggested that in six months, this item should be brought back ta thg
Planning Coannission for study.
MOTION by Minish, seconded by Schmedeke, that the Planning Commiss.ion recaa►med
to the Council the installat.ton of the 9 inch blade street sign, reflectorized d
with a qreen backgxound on Mississippi Street from University Avenue to Old Central
Avenue, and the metter be eviewed six months after installation to determin
whether or not said signs would be appropriate for other streets. Upon a voice

12. 40 FOOT PLANTING BOULEVARD IN Mi00RE LAI HIGHLANDS 4TH ADDITIOII:
' Mr. Schmedeke referred to the request for a Special Use Permit for the sale
of recreational equipment in Herwal 2nd Addition and the objections of the neigh-
bors. He suggested the Planning Comission take a good look at the GO foot plant-
, ing strip and consider planting some evergreen trees so that it would make a more
desirable buffer and attract a developer.
' Mr. Harris said that if the planting strip is deeded to the City, who is
responsible for the trash and litter that has accumulated there? He wondered iP
this would be a good place to dump street sweepings as the land is pretty law.
' Mr. Minish mentioned that trees produce more oxygen, and wondered f the
evergreen tree produced as much oxygen as the deciduous trees, and also if they
did in th winter. Mr. Schmedeke said it should be looked into, and added that
' every time we can plant a tree, it will benefit our children. He felt the
deciduous trea l.00k very good in the sumer, but the evergreen treea can be enjoyd
al. year around.

Seconded by Ahonen. Upon a voice vofie, there being no nays, the motion carried
unanimously.
Mc. Bakex was asked i he had conaidered building a detached garage, aince the
diatxce between his proposed garage and the adjacent garage would be only 6 feet.
Mx. Baker answered that to build a detached garage would mean cutting dom aatae
uice txes. He explained that they do have two care eo they need the double►
garage and that the psesent houee has 3 bedroomt and they have 3 girle und 1
bay eo thy could use the extra roan.
Mx. Joseph Melin, 541-53 Avenue, stated he was in favor of the variaac ae it

The:'e waa adiscussioa on building only partially we the garage to kep tha
living axea 10 feet fraa the property line.
Mr. Baker explained tha to build only partially over the garaga would involve
puting a ceaient roQf on the garage instead of a wood roof which Would run iato
tnare money, but he would agree to limiting the addition to 14 feet to stay 1Q
fee from the line.
1UTION by Drigans to xecommend to the City Council, denial of the v&rianee of
Section +5.053, 48, and to recomanend appraval of the variance of Section 45.053,
4B, Subpaxagraph 3. The reason for the denial is that the area between the two
strucfiures would be only 6 feet and the structuxes would be too ¢se'-filds.
Sylveeex evex decided to build on top of his present garage.
The reaeors for the appraval are:
1. The hardahip is the need for a garage.
2. The grade af the present driveway makea it difficult to get in aad out of
the driveway, e-specially in the winter eeason.

4. As a result of preliminary appraisals parcel 3200 was
withdrawn from the North Park paxcel and a like size parcel was substituted

Re: Proposed Traff.c Sigtal
at 37th Ave. NE and E.
River Road
The City of Minneapolis has canducted a traffic signal
waxrants investigation at the 3ntersection of 37th AVe• N
and E. Ri.vex Road (County Defense Highway) to determine the
neGesaity of traffic signalization at this intersection. Re-
8ults of this investigation indicate installation of traific
s3gnals is warranted.
Traffic counts at this intersection have shown that
signalization warrants one and two are saeedsitend totbehigh-
. River Road being a divided roadway, sp
er causing difficulty for 37th Ave. NE traffic to make any
turn onto the R1ver Road. The City of Minneapolis doea have
p7.ans fot constructing a new 42nd Ave. N. (Camden Bridge) in
the near future, and upon completion of this bridge it is an-
ticipated that the traffic volumes using this bridge to get
to the vi.cinities surrounding 37th Ave. NE and the E. River Y_ _
xoad wi11 increase eubstantially. Taking into considexat3on
sll of the factors evidenced by this location, it is felt that
this interaection ehould be programed for traffic signals at
this time. A copy of the traffic count conducted at this in-
Lersection is enclosed for your information.

Da Sir:
, I would .a.ke to br3ng to your attentiqn; the attention 01
the first ward Alderman and the Chief of Police, a mo8t
pres.ng and serious problem.

he construction af a dike and roadway on Riverview TerAO3,
,qeyra reidents o th area were concerned that ooe tis•
qadway was completed it would be turned into a epoedway .
Oon after the paving was completed, I heard th screechinq
of tires and the roar of motora.
I don't want to make it sound as though this is somethinq
tht happens everyday, but the very fact that it is hpp@ninq
constitutes, in my mind, the beginning of a serious problea.
I am afraid that the question that was raised one year aqo
ta,iqh turn into a reality and froan reality into a tragedy
for ozle oi the many children that walk or ride bicyclee alonq

x urq you as the head of the City Council and Mayor of
