08/10/1970 - 00018622�m�� � THE MINUTES OF THE SPECIAL PUBLIC HEARING AND WORKSHOP MEETING OF AUGUST 10, 197G Mayor Kirkham called the Special Public Hearing and Workshop Meeting of August 10, 1970 to order at 8:00 P.M. PLEDGE OF ALLEGIANCE: Mayos Kaxkham lead the Council and the audience in saying the Pledge o£ Allegiance to the Flag. ROLL CALL: MEMBERS PRESENT: Breider, Sherldan, Kirkham, Liebl, Harris MEMBERS ABSENT: None ADOPTION OF AGENDA: Mayor Kirkham said that there were a number of items to add as follows: Awarding bids £or fire apparatus. Approval of display at Moon Plaza requested by the Air Force. Receiving Northern States Power i.ransma.ssion line reports. � Approval of Jaycee concession for regional softball tournament. MOTION by Councilman Liebl to adopt the Agenda as amended. Seconded by Councilman Breider. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried unanimously. PUBLIC HEARING ON IMPROVEMENT� STREET IMPROVEMENT PROJECT ST. 1970-1, ADDENDUM #3. Mayor Kirkham said that he would da.spense with the formal reading of the public hearinq notice, but informed the audience where the proposed improve- ment is located. The City Engineer said that the proposed improvement is for the installation of sidewalks on the south side of Osborne Road from the west property line � of Unity Hospital to the existing sidewalk about 110 feet east of Baker. To provide for a proper boulevard, a 5' sidewalk easement is needed along this area. There is an existing contract and it is hoped that if this improve- ment is ordered in by the Council, that rt could be added onto the pro7ect, to take advantage of the 197D construction prices. Mr. A1 Rahnge, 7431 Lyra.c Lane N.E., said that he is a member of the District #16 School Board, and he wondered why the sidewalks are to stop at the west property line of Unity Hospital rather than go all the way over to Sth � Street. The City Engineer said that when this was first discussed by the Council, it was felt that this portion could be the first stage, then it could be added onto at a later date. On west of the hospital is residential property and the difficulties would be greater. I£ the Council would want to add on tha.s portion, there would have to be another public hearing. �,191 SPECIAL PUBLIC HEARING MEETING OF AUGUST 10, 1970 PAGE 2 Councilman Harris said that in the City's plans for the sidewalk program, � there were other streets that they had planned to put in sidewalks on, but it was found that the grade was too great, so they were abandoned; so the City could work to get the sidewalks on Osborne Road. He wondered if Spring Lake Park has any plans for sidewalks on the north side of Osborne Road. Mr. Rahnge said that he could not say, none that he knew o£. He felt that for a relatively small additional sum of money, the sidewalks could be extended to Sth Street to enahle those children to be able to walk to school on the sidewalks. Councilman Harris said that as you go west there are a greater number of trees. The City Engineer said that the sidewalks could be extended to 5th Street without doing too much damage. He said that there is a church, which has 5 lots, and a residence between the church and 5th Street. Councilman Sheridan said that this would have to be handled under another public hearing unless there was 100o aqreement with the addition. If there was a petition with 100o approval, there would not have to be another public hearing. Councilman Harris suggested sendin g a letter to try to get the lOD% approval. Councilman Breider asked Mr. Rahnge if he knew how many school age children come out of that area. Mr. Rahnge said about 70 elem.entary. Shese children are bused during the wznter months at a cost of about $500 a month. Councilman Harris said that he felt that this was a good sugqestion and the Administration should pursue getting the approval of the two property � owners. Councilman Breider said that this particular s�.dewalk pro�ect was originally scheduled for installation in 1974. He said that the Council felt that by at least getting this much done, it would help the foot traffic problem. A member of the audience said that he lives on the corner of Jackson and Osborne Road and with the 5' easement, he would lose some trees and a fence. The City Engineer said that these trees were installed recently and would have to relocate them, and the fence. RESOLUTION '�155-1970 - RE50LUTION RECEIVING PRELIMSNARY REPORT AND CALLING A PUBLIC HEARING ON THE MATTER OF CONSTRUCTION OF CERTAIN IMPROVEMENTS: STREET IMPROVEMENT PR07ECT ST. 1970-1, ADDENDUM #4c MOTION by Councilman Sheridan to adopt Resolution #155-1970 and set the public hearing date for September 8, 197D. Councilman Breider asked if this addition to the pro�ect would affect the completion date. The City Engineer said that the City would have to move quickly to get it done this year If a new contract would have to be let, it would probably delay construction another year. He pointed out that the prices received this year were quite good. THE MOTION seconded by Councilman Harris. (Part of the SW'-, of the NW; o� Section 2 for golf driving range) The City Engineer said that the plat is broken into three parcels, Parcel A is for the gol£ driving range. There are roads planned all around the plat with a detached road at Slst Avenue. The recommendation of the Planning Commission was that the island be made 1'� acres rather than 1 3/10 acres. This would require a few changes. MOTION by Councilman Harris to close the public hearing and approve the final plat, University Golf Estates. Seconded by Councilman Sheridan. Upon a voice vote, all voting aye, Mayor Kirkham declared the hearing closed at 8:25 P.M. PUBLIC HEARING ON IMPROVEMENT, STREET IMPROV�MENT PROSECT ST. 1970-3: University Ave. East Service Road Detachment Erom South property line af Lot 23, Block 4, Hyde Park Addition to 100 feet South of North property line of Parcel 440, Part o£ Lot 5, Auditor's Subdivision #59 The City Engineer showed this area on the screen £or the benefit of the audience and said that there has been discussion of this detachment for some time, but there have been right o£ way problems. The unprovement would eliminate the existing service road, and the road would loop behind the Shell Oil Service Station and the Texaco Service Station. The unprovement in- cludes widening 61st Avenue to make three lanes going west and two lan�s going east to give adequate storage at the intersection. There are side- walks proposed going north and south along University Avenue and along 61st Avenue to the loop back. There is also a divider provided in 61st Avenue. Councilman Sheridan asked if there were not proposed at one time to have sidewalks along the north loop by the church. The City Engineer said that it was da.scussed and showed him the plans at the Council table. He said that he has given a copp of the plans to the church architect. Councilman Harris said that there had been consideration given to putting in a slip off ramp into Moon Plaza. At one time the Highway Department felt that it would not be feasible, but he felt that anot.her appeal should be made to the State, as he felt that it was a necessary part of the total improvement, Councilman Liebl said that the reason given by the Highway Department was that the grade was too great. It was agreed by the Council to reactivate this request. Star Lane: From 61st Avenue to University Avenue West 5ervice Drive To the North property line of Lot 16, Block 2, Sylvan Hills The City Engineer said that the existing service road would be closed and � �ust used for access for the apartment house. The residential traffic would be diverted to Star Lane. All the commercial traffic has already been diverted away from this area by a sla.p on` to University Avenue. �'}+ 4 (.� A � SPECIAI, PUBLIC HEARING MEETING OF AUGUST 10, 197D PAGE 4 Mrs. Darlene Anderson, 6021 Star Lane, asked why it would not be possible to have the traffic stay �ust as it is The City Engineer said that the possible solutions to the traffic problems at this intersection have been under discussion for about five years. The improvement was held up because of right of way acquisition problems. Now since there has been a death at 61st Avenue and University, the State has been more cooperative. He said that there are many conflicts of traffic and presents a dangerous situation. Mrs. Anderson asked if there were any accidents at the service road and Unviersity Avenue and 61st Avenue intersection. The City Engineer ex- plained that there are too many streets merging and the people cannot tell where they are supposed to go. This results in accidents. Ccuncilman Liebl then went to the screen and explained the project, and said that this proposal is to eluninate congestion at this intersection. He said that there were not sidewalks planned on this street as there is not enough right of way. The goal is to make a safer corner at 61st Avenue and University The traffic on Star Lane will be strictly residential. Councilman Sheridan said that the Highway Department has stated that unless the City were to put in this improvement they would put in a median that would block off the traffic without any benefit of the improved street. Mr. Mylan Carrigan, 6074 4th Street, said that he lives east of Texaco and asked if any of his property would be taken. The City Engineer said no, and that he would try to save his trees. A property owner at 6164 Star Lane asked how this is to be financed. The Finance Director said that the total cost of the improvement is estimated at $216,110. The total amount of the assessment roll is $74,189.29. The difference of $141,920.71 will be made up from the State Aid fund. He explained that the basis for the assessment on affected property is a normal residential street assessment rate. The assessment rate is $12.50 per foot for concrete curb, gutter and street. A resident on Star Lane said that there were 5 bungalows and an apartment house and asked how the assessment was divided. The Finance Director said that the assessment is by footage, at $12.50 per foot. The apartment house would be paying the normal rate plus 1/3 for the short side yard side. The resident said that the street is filled up with cars on the apartment side. The cars are sticking out into the street. He would like to have no parking signs put up. The City Engineer said that the street wou3d be 36' wide, and that no parking signs could be put up. He said that he would work with the apartment house on their parking. Mr. Carrigan said that he would be assessed for two streets. Mayor Kirkham explained the policy for lots such as his that ar� actually double frontage lots. Mrs. Anderson asked where this will all end. She said that she has four assessments on their land now. The City Engineer said that this would hopefully be the last. NLrs. Anderson said that she would prefer the island that the Highway Department said that they would put in if the City did not do something with that intersection. Councilman Sheridan said that they would still have all the traffic without the benefit of the improved street. Mrs. Anderson said that she did not think that the service road was the cause of the accidents, Mayor Kirkham said that the City really did not have a , � � � � �� �II SPECIAL PUSLIC HEARING MEETING OF AUGUST 10, 1970 PAGE 5 choice in the matter. The agreement has already been made with the state. Mrs. Anderson asked why they were asked to attend then. Mayor Kirkham said that this is an improvement hearing. The actual assessment will not be known until the bids are let, this is an estimated figure. Mrs. Anderson asked if there was no way to change the plans. Mayor Kirkham said no, there have been othex improvement hearings. The City Engineer added that this has been going on for some time. 61st Avenue: From University Avenue to 4th Street There was no one present to speak on this street. The next five streets were considered together as they are in the same general area. 57th Avenue 57th Place: University 4th Street: From 3rd Street to 4th Street �rom IIniversitv Avenue to 4th Avenue East Serv. Rd.: From 57th Avenue to 57� Avenue From Interstate #694 Outer"Drive to 57th Place Mr. Richaxd Simmons, 360-362 57th Avenue N.E., said that he had not received a notice before this. The City Engineer asked when he bought the property. Mr. Simmons said in September, 1967. The City Engineer sa��d that this plan was star�ed in 1965 and he did not live there then. The City Attorney added that this is a hearing on the improvement and that the concept was approved in 1966. Mrs. Anderson said that rt appears that the people do not have a choice in selecting the island rather than the elimination of the service road. Mayor Kirkham said that the point Councilman Sheridan was making was that if the City did not do something about this corner, that the State would put in a median, and they would still be stuck with the same amount of traffic. Councilman Harris said that the plan was engineered in 1965. It resulted from the Highway Department making University Avenue into a four lane expressway. This gave the (ity of Fridley some corners that they could not live with. The City then asked the State to �oin with Fridley to xectify the satuations the impxovement of University caused, One of the terms o.f the agreement was that the City must acquire the property, but the pro�ect was initiated by the State. The people have been called in at various times to discuss the plans and this may have been prior to some of the people present toniqht buying their homes This is a State approved plan. A resident of the area asked when the construction is scheduled to start. The City Engineer said hopefully next construction season. The plans will be worked on this winter. Mr. Simmons asked if Minnie Pearl, Holiday, McDonalds, etc. were notified. The City Engineer said that they were told when they applied for the building permits. Mr. Simmons asked why, then, he was not told when he built his house. Councilman Sheridan 5aid that a11 commerca.al and industrial building permits come be£ore the Council, residences do not. Mr. Simmons said that he felt tY�.at this street was a detriment to his property, yet he is being asked to pay for it. He said that there are many children in the neighborhood, and there is no neighbor- hood park, as a result there axe children in the street. Mayor Kirkham said that that would be a matter of judgment, there would not be any speeders, he did not believe, on a street that is only � block long. He said that when there is a service xoad running parallel to an expressway, you get these impossible corners. This plan was designed as most feasible geographically and economically. Mr. Simmons asked where he should take his protest now. He said that he will have a piece of property with traf£ic on three sides. For that the City will charge him, yet it will depreciate his property. The City Attorney said that he had a legal right to protest his assessment. This would be at the final assessment hearing; these are �ust preliminary figures. The only issue before the Council at this time is the improyement. The concept is approved. He said that he may register his ob�ection. Mr. Simmons said that whether he did or not, he would be getting the street. The City Attorney said �hat the plans are drawn to do the greatest good £or the ma�ority of the citizens. Mr. Theodore Biermaier, 349-353 57th Avenue N.E., said that he was a neighbor oP Mr. Simmons' and he felt much the same. He said that there were children in his apartment house also. The City Engineer polnted out that this is a multiple zoned area. Mr. Biermaier asked why, if this is a State approved plan, the State did not have to pay for it, The City Engineer said that the State is paying a portion of the cost. Councilman Liebl said that he was fully aware of their problems as he went down into the neighborhood to look it over. He said that he could see these problems coming, and was not whole heartedly in favor of the pro�ect, but he talked to the Highway Department and the City Enqineer about the traffic problems. He said from the cost and safety standpoint, this seems to be the best plan. He said that it was impossible to please everyone. He said that the plan was drawn wrth financial responsibilrty and safety in mind. Councilman Harris said that Mr. Simmons does have a valid point and the Council should take cognizance of it. They tried to find a plan that was the least ob7ectionable. Other plans with more costs would involve more people. He said that they tried to do the best 7ob possible and if he lived where Mr. Simmons does, he would probably voice the same complaint. He said that there has been a lot of thought put into this concept, and actuallp these lookbacks should have been there in the first place. A gentleman in the audience said that he ran the DX Service Station and he wondered if his driveways would be closed. Mayor Kirkham said that the contractor and the City Enqineer would work with him to keep them open. Mr. H.S. Babb, Sun Oil Company, 470 West 70th Street, said that he would like to have the City Engineer go through the traffic pattern. He asked when the plans would be done and, if he could see them then. The City Engineer said that they would be done in aHout a month. Mr, Babb said that he would welcome the opportunity to work with the City Engineer on these plans. The City Engineer said that he would work with him on access, and other related details. MOTION by Councilman Liebl to close the Public Hearing on 5treet Improvement Pro7ect St, 1970-3. ROBINSON, BY G.D. GIANCOLA, HIS ATTORNEY: (Vacation of Brooks Street) N1r. Giancola saa.d that this request is for the vacation of Brooks Street in con7vnction with the negotiations entered into for a Skelly Oil Service Station. He would like to attach Brooks Street to the remaining property owned by Mx. Robinson. He said that he would order a registered land survey and the City Engineer has asked that the parcel for the Skelly Oil Service Station be separate from the other parcel. The City Engineer said that the street could be vacated, but the City would ask for easements over the land. He said that they would own, hold title to, and could use the property as their own, except that they could not build on it. Councilman Harris commented that these easements are seldom used. Mr. Giancola said that he would be very agreeable to working these easements out. CouncLlman Haxris asked what assuxance the City would have that the property bea.ng taken would be kepY. and maintained. If this is vacant land, there may be the same problem as with the property to the south. Mr. Giancola said that what remains would be cleaned up. He added that as to the property to the south, within a couple of weeks it will be going under foreclosure. Possibly the new owner would clean it up, it is too valuable land to leave lying dormant. He said that the large pieces of cement would be removed � from the Skelly Oil srte. Councilman Harris said that he did not want rt removed and placed on the adjoining property. Councilman Breider said that the 7unk cars in this area are an eyesore. Councilman Harris asked that this be considered notzce to them that the Council wants this area cleaned up. Mr. Giancola saa.d that notice is taken and he would pass the informat�.on along. MOTION by Councilman Harris to close the public hearing on the vacation request SAV #7D-04, by James L Robinson. Seconded by Councilman Breider. Upon a voice vote, all voting aye, Mayor Kirkham declared the hearing closed at 9:35 P.M. STATUS REPORT ON PROJECT #93� (➢.M. Noyes Constructa.on Company) MOTION by Councilman Harris to receive the report from the City Attorney regarding the status of Project #93. Seconded by Councilman Sheridan. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried unana.mously. CONSIDERATION OF FLAG ORDINANCE: Mayor Kirkham saa.d that he had asked the Crty Attorney to get an opinion from the Attorney General's office to determine if the ordinance is proper and �,� the City Council could adopt such an Oxdinance. These has been no answer to date so he asked that this be back on the Agenda when the reply � is received MOTIDN by Councilman Breider to table consideration of this Flag Ordinance until there is an opinion received from the Attorney General, then it is to be back on the Agenda. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried unanimously. �� I � Ld 1 � SPECIAL PUBLIC HEARING MEETING OF AUGUST 10� 1970 PAGE 8 CONSIDERATION OF AN ORDINANCE REPEALING CHAPTER 6"DOG CONTROL" OF THE CITY � CODE AND ADOPTING AN "ANIMAL CONTROL ORDINANCE" The City Manager said that the City Attornep questioned why the charge of $5 for a male dog and $15 for an unspayed female, for the permit. He said that the Humane Society and other sources recommend that the permit fee should be one half of the cost of spaying the female animal. Councilman Harris said that he felt that the Ordinance was basically good, but he would question the worciing of Section 7- Impounding of Animals. This has to do with people entering upon prlvate premises without a search warrant. He thought the intent was good, but felt that it should be re- worded. Councilman Liebl agreed and comznented that he did not want to see the City give anyone a free hand. Councilman Harris felt that this was not restrictive enough and could be used as an excuse for going onto private property. Councilman Liebl suggested that it be worded so that the Animal Control Of£icer could enter upon receiving a signed complaint. Councilman Harris agreed, there should be some wordage to cover a signed complaint being received. The Crty Manager said that he would check the wording with the City Attorney. Councilman Harris said that in Section 11 - Unclaimed Impounded Animals, there is no mention of the duties of persons impounding to notify the owner. The City Manager said that this is covered elsewhere in the Ordinance. (Section 7). Councilman Liebl said that the point of the Ordinance is not to � penalize the dog, but the owner. This would qive the law enforcement officers a firmer legal hand. The City Manager explained that the Animal Control Officer would pick up the dogs. The Warden would make a census of the dogs, and would not be picking up any dogs. He would a.ssue the tags. Councilman Harris said that he did not think that the City should get into the posa.tion of destroying dogs. The utrnost should be done to find the owners. On some occasions the dog breaks the leash through no fault of the owner. The City Manager said that the Warden could be a man or a woman and it would be a census type function. A portion of the permit fees could be taken to pay his wages. It would not be his funetion to catch the dogs. The Ordinance works on the basis of an owner being required to have a permit to own an animal. If an animal is allowed to run at large, the Council could revoke the permit and that person could then not own an animal for one year. Councilman Breider said that a large amount of his calls concern dogs and cats running loose. He said that he had talked about this ordinance to some of the dog and cat owners and even though they are dog lovers, they felt that the Orda.nance was a good thing, even with zts stringent requirements. Because of other dogs running loose, people get complaints on their dogs. Councilman Harris suggested that the wording of Item 4, Page 2 also should be checked. � MOTION by Councilman Liebl to table consideration o£ this Ordinance and have it back on the next regular Council Meeting Agenda after review by the City Attorney and the City Manager of Section 7, and Section 2, Item 4. The motion was seconded and upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried unanimously. ��7 � SPECTAL COUNCIL MEETING OF AUGUST 10, 1970 PAGL 9 AWARDING BIDS FOR 1250 GPM TRIPLE COMBINATION PUMPER: (F�.re Department - Bids received July 6, 1970) Bidder American Fire Apparatus Marshalltown, Iowa Peter Pirsch Kenosha, Wisconsin American LaFrance Elmira, New York Base Bid $38,195.80 $38,291.00 $38,614.00 Alternate "A" $3,800.00 $3,448.00 $5,931.00 The City Manager explained that the Fixe Chief and the Eire Prevention Bureau Chief made a trip to Marshalltown, Iowa to review the equipment. It was found that they could not meet the specifications, so they have requested to be allowed to withdraw their bid. This leaves Peter Pirsch the second lowest bidder. The Fire Department also felt that they would like to have Alternate A re�ected as the bidders could not meet all the specifications, and they would call for bids for the Alternate at a later date. The Fire Chief said that j�nerican Fire Apparatus builds good equipment, but it is not what they wanted. The Depart�nent wanted the engine in the front. � They checked and found that they could not build the apparatus to meet the City's specificata.ons. Councilman Sreider asked what Alternate A was. The Fire Chief said that this was for hoses, nozzles etc. The ba.dders would have to purchase them, then resell them to Fridley after addinq on their profit and it was felt that these could be rebid at a better price later. Council- man Breider asked if they would be standard fittings and would fit any fire truck, and the Pire Chief said yes. Councilman Harris asked what was the specifa.ed date of delivery. The Fire Prevention Bureau Chief said that Peter Pirsch specified 540 days and American LaFrance said 280 working days. MOTION by Councilman Harris to concur with the recommendation of the Fire Department and award the base bid only to Peter Pirsch a.n the amount of $38,291.00, noting that they ase the second lowest biddex; the low biddex having withdrawn the bid due to not meeting the specifications. Seconded by Councilman Sheridan. Upon a voice vote, a11 voting aye, Mayor Kirkham declared the motion carried unanimously. The Fire Chie£ said that they would like authorization by the City Council to start checking into a new aerial device. He said that it would be 1972 or 1973 before they would get it. The ladder truck is 27 years old this year. By the time they were to get a new one, it would be 30 years old. Ae explained that parts are getting hard to buy and they are running into more and more apartment houses. APPROVAL OF DISPLAY AT MOON PLAZA BY AIR FORCE: MOTION by Councilman Harris to approve the request for an Air Force display at Moon Plaza August 29 through September 7, 1970. RECEIVING NORTHERN STATES POWER COMPANY TRANSMISSION LTNE REPORT DATED � AUGUST 7, 1970: Councilman Harris asked if there had been any reply to the letter the City sent them in regard to meeting their scheduled date of completion. APPROVAL OF JAYCEE REQUEST FOR CONCESSION FOR REGIONAL SOFTBALL TOURNAM�NT: There was some discussion by the Council on rewrrting the Ordinance in regard to concessions in the City parks when it is a non-prof�t organization. MOTION by Councilman Liebl to authorize the concessions in Commons Park on August 15, 1970 as requested by the Fridley Jaycees, in their letter dated August 10, 197D. Seconded by Councilman Harris. DISCUSSION OF STAKING ON WEST MOORE LAKE DRIVE: Councilman Sheridan said that it has come to his attention that the staking done on the south end of West Moore Lake Drive near SSth Avenue puts the curbing very close to the property line. In some places it looks like 30" to 36" away from the property line. The City Engineer said that West Moore Lake Drive near the intersection on 58th Avenue was shifted to save some trees, but it is still basically following the old blacktopping. There � should be at least 5' from the property line. Mr Art Olson, 5771 West Moore Lake Drive, said that when he came home one evening the stakes had been moved 3' closer to the house This would put his house only 37' from the road. Ae said that if they were put back where they were, it would probably save some of the trees. MOTION by Councilman Harris to instruct the City Engineer to check the staking on West Moore Lake Drive early the next morriing. Seconded by Councilman Sheridan. Upon a voice vote, all voting aye, Mayor Kirk.iam declared the motion carried unanimously. DISCUSSION REGARDING GAS STATION BEING BUILT BY SPRING LAKE PARK ON OSBORNE ROAD AND T.H. #65; Councilman Harris said that he had received a notice of a gas station being built on the N.E. corner of Osborne Road and T.H. #65. He said that he would like to have Spring Lake Park send the City o£ Fridley a copy of the plans. At some time there may be a necessity of a loopback at this location also, and he did not want a road running parallel to T.H. #65 similar to that on University Avenue. DISCUSSION REGARDING ALTERATION OF CREEK AND LAKE SEDS: There was some discussion on the City Attorney's report regarding the Minder - � Erkel matter of dredging in Rice Creek. The Council felt that there should be some provision, perhaps in the land alteration Ordinance, or through the excavation Ordinance, whereby the City of Fridley would have to be notified of any alterations to be done to the creek, river, and lake beds prior to the �.� _�/ � SPECIAL PUBLIC HEARING MEETING OF AUGUST 10, 1970 PAGE 12 Conservation Department permit being taken out. It was agreed that the City Manager and the City Attorney should look into thi5 matter.
