THE MINUTES OF THE REGULAR COUNCIL MEETING OF DECEMBER 21, 1970
PLEDGE OF ALLEGIANCE:
The Mayor lead the Council and the audience in saying the Pledge of Allegiance
to the Flag.

Reverend Bergren, Redeemer Lutheran Church, offered the Invocation.
Mayor Kirkham called the Regular Council Meeting of December 21, 1970, to
order at 7:45 P. M.
ROLL CALL:

APPROVAL OF MINUTES OF THE REGULAR COUNCIL MEETING OF DECEMBER 7 1970:
MOTION By Councilman Breider to adopt the Minutes of the Regular Council
Meeting of December 7, 1970, as presented. Seconded by Councilman Liebl.
Upon a voice vote,�there being no nays, Mayor Kirkham declared the motion
carried.

VISITORS:
Request to Operate a Flea Market•
Mr. Cyril Link, who operates the Fridley Auction at 7500 University Avenue N. E.,
said he would like to operate a flea market on Sunday afternoons from 1:00 P.M.
to 6:00 P.M. Mayor Kirkham said that this is an item that should have been
brought to the Council on the agenda. Mr. Link said they were told to come
back to the Council for any hour changes, or any other changes. He explained
that people would be selling their own items and the suction would just be
renting them stalls. The City Engineer requested that the Administration be
given time to investigate and report back at the next regular Council Meeting.
The Council agreed there should be time to look into this fully. Mr. Link
was requested to present a letter o� come in and discuss the hours and other
details with the administration, and was told that this item will be back on
the Agenda of January 4, 1971.

CONSID�RATION OF THE SECOND READING OF AN ORDINA.NCE FOR REZONING REQUEST
ZOA ��'69-11 AND SPECIAL USE PERMIT REQUEST SP ��69-01, BY BURLINGTON NORTHERN:
PETITION ��21-1970:
The City Engineer stated that the Council h�s received the revised petition
prior to the meeting, and that the changes have been underlined. The
material in the agenda is what has been presented by the Railroad Company.
If the Council agrees, they could pass the ordinance on second reading and
approve the variance requested and the special us� permit.
Coun�ilman Liebl referred the Council to Item "�" in the petition dealing
with relocating the existing old railroad crossir�gs. He said there was a
petition to be presented to the Council and called on the gentle�ean in the
audience.
Receiving Petition �k20-1970 to remove that portion of the agreement
between the City of Fridley and Burlington North�rn, Iu�c. that will
allow the installation of the proposed crossings at 79th and 83rd Way
Mr. Winston Jacobson, 121 79th Way N. E., came forward with a petition. He
said that it was the responsibility of the Council to look after the well
being of their constituents, and he felt they were neglecting this duty.
He mentioned the recent deaths because of a train/car accident and said
this must be borne by the Council for not Loo�Cing after its citizens. He
said that the 77th Avenue crossing should not taave been there, and this
would not have occurred. He said that although the railroad had been
against the crossings previously because of safety, nora they agree to get
the total improvement on their rezonings. He asked why th� Council wanted
additional crossings. He said the signers of the petition had four reasons
for their opposition. 1. The construction of suc.h crossings would be
detri�ental to tfie safety of residents living in the area. 2. The crossings
will increase the noise pollution in the area. 3. Traffic patterns must
be better controlled. 4. The groposal to buy property or► the north end of
the,City would be ruined l�y traffic with a crassing $t 83rd. Mr. Jacobson
then presented a four step plan to insure the safety of thE residents in the
area. 1. Close 77th crossing immediately. 2. Close the crossings at
Ironton and Liberty as soon as possible. 3. Procure, and,if necessary,
condemn land to extend Ashton Avenue to the north City limits as an induetrial
service road. 4. If North Park is built he proposed to build a road to
University one block south of the park that would reduce noise to the park
ecology. He read the heading on the petition and presented it to the Council.
MOTION by Councilman Breider to receive Petition 4k20-1970. Seconded by
Councilman Sheridan. Upon a voice vote, there being no nays, Mayor Kirkham ,
declared the motion carried. .
Mayor Kirkham said that as far as he was concerned, the petition is worth
very little because when the petition was circulated, it was indicated that
the Council was asking for additional crossings and this is not the case.
He s8id the railroad is agreeing not to oppose the relocation of crossings,
but they are not proposing additional crossings. Mayor Kirkham said that as
far as safety for the citizens was concerned, t�e remembered how hard the
Council had worked for a grade spearation at Missiasippi Street.
Councilman Harris said he was concerned that Mr. Jacobson felt the Council
was not concerned about the safety of the residents, especially at railroad
crossinga. He eaid that through this agreement the City has an opportunity

for two grade separations, one at 43rd and the other at Mississippi Street.
Mr. Jacobson said that he has not lived in the City long enough to know the
past, but he hoped the four proposals he presented would be considered by
the Council.
Councilman Breider asked the City Engineer whether there was a time frame-
work on these crossings. The City Engineers said that a plan was adopted
in 19b2, and they are moving in that direction. He said that 77th was a
bad intersection, and they had cut through a road from 77th to Osborne to
make it safer, so thaE the cars would go to controlled crossings. Gouncilman
Breider asked if the City Engineer felt they could close 77th Avenue. The
City Engineer said that if we get the control sig�al8, the need for 77th
Avenue will be minimal and, as the road in the area is not finished, closing
it now would be a matter of judgement. He said they could study this more
and give the Council an opinion, but it will be difficult to close because
of the road not being improved yet, but hope to have it completed aext
suam�er. Councilman Breider asked Mr. Thompson from Burlington Northern the
speed the trains were traveling in this area. Mr. Thompson said the passengers
would be going about 65 miles per hour, and the freights would be going soa►e-
what slower.
Councilman Harris said that included in the agreement is the statement that
if the Council appears before the Public Service Commission regarding
crossings, the Railroad will not oppose us. He asked Mr. Thompson if this
was correct. Mr. Thompson agreed that they would not oppoae the City.
Councilman Harris asked Mr. Thompson if they would oppose the City if they
asked for signalization. Mr. Thompson said they have participated in the
signalization of crossings at normal cost to the railroad, and they would
not object if they were warranted. Councilman Breider asked what they
planned to do with the signals on Mississippi and 43rd Avenue after the
underpass and overpass are installed. Mr. Thompson said that the relocation
would be by the City and the State, and if the State pays 90% they will have
the say. Councilman Harris asked if there was any reason why they could not
communcate to the City through the Public Service Commission so that when the
signals are removed, they could go to the other two crossings in Fridley.
Mr. Thompson said they would have no objection to doing this.
The Council reviewed the agreement with Burlington Northern and Councilman
Harris drew their attention to Section "Q", He read the sentence in
parenthesis, "($79,000 to be base December 31, 1970)", and stated that he
felt this should be changed to 1971, as the agreement is being acted on this
year, but the ordinance will not go into effect until 15 days after publi-
cation which will be after January 1. He felt the way it was stated, they
would be able to add the 10% figure during the first year if this work was
started. There was a discussion among the City Attorney, the representatives
of the r8ilroad and the City Council on the language in this Section. To
clarify this, the Railroad Company agreed to amend the sentence to read,
"($79;000 to be base until December 31, 1971)". They cha►iged the original
petition and initialed the change.
MOTION by Councilman Harris to receive the amended petition in regard to the
expansion and operation of the railroad classification yard from the Burling-
ton Northern Inc. Seconded by Councilman Sheridan. Upon a voice vote, there
being no nays, Mayor Kirkham declared the motion carried.

MOTION by Councilman Liebl to adopt Ordinance #470 to amend the City Code
of the City of Fridley, Minnesota by making a change in zoning Districts
upon second reading, waiving the reading and ordering publication. Seconded
by Councilman Harris. Upon a roll call vote, Kirkham, Harris, Sheridan,
Liebl, Breider voting aye, there being no nays, the motion carried.
MOTION by Councilman Liebl to grant Burlington Northern the Special Use
Permit and Variance as requested. Seconded by Councilman Harris for
discussion. Councilcnan Harris said that since the Special Use Permit was
drawn up for Tract A and Tract A& B, we have added another section in the
petition under Section N1. He asked if this would affect the property to
the north of I. 694. The City Engineer said that this present request is
only for the area shown. He would assume they will have to make a new
application for the rest. The City Attorney said that the variance is only
for yard construction. He said his feelings would be that the agreement
affects only area A& B. Upon a voice vote, there being no nays, Mayor
Kirkhem declared the motion carried.
Councilman Harris requested that Mr. Thompson and the Attorney, Mr. Bartholic,
direct a letter to the Public Service Commission that they will concur with
the desires of the City if at any future date the signal apparatus is to be
moved, and that they will suggest it be placed at designated crossings
which may occur, so that the City would have the first opportunity when
they are made available. The City Attorney asked the Railroad if they would
draft the letter and give it to the City for the Public Service Commission.
The Attorney Mr. Bartholic agreed.
MOTION by Councilman Harris requesting a letter from the Burlington Northern
Railroad, Inc., that they concur with the City in its desires that signal
apparatus remain in Fridley at designated crossings when they are to be
moved. Seconded by Councilman Sheridan. Upon a voxce vote, there being no
nays, Mayor Kirkham declared the motion carried.
Councilman Breider went to the map and poiated out the area east of the rail-
road tracts and north of 79th Avenue and said he would like to see the
Engineering Department reevaluate our philosophy in this area, He said it
would probably be to our advantage to channel traffic out to the east toward
University and keep the crossing of the railroad to a minimum. The City
Engineer said he was sure the Engineering Department could come up with more
information on the direction of traffic in the area.
Mr. Andrew Kohlan presented the Council with a letter from the DFL Party
regarding the matter of several additional proposed railroad crossings they
thought the Council was requesting. Mr. Kohlan outlined an idea to the
Council using the NSSSD sewer easement adjacent to the railroad tracta for
road usage. The Council explained that they were not seeking additional
crossings, but are only trying to improve the crossings. Mr. Kohlan said
that the information he has received is incorrect then.
MOTION by Councilman Liebl to receive the coaununication from the Fridley DFL
Club dated December 20, 1970. Seconded by Councilman Breider. Upon a voice
vote, there being no nays, Mayor Kirkham declared the motion carried.

REPORT �'ROM CITY ATTORNEY REGARDING REGULATION OF SNaWMOBILES:

The City Attorney discussed the proposed uniform snowmobile ordinance received
from the Hennepin County League of Municipalities. He said there could be a
little more control in the ordinance by placing a speed limit, he said they
could make it ten to twenty miles per hour if they wanted, and could add
more specifications on safety equipment. He said that the advantage of a .
uniform ordinance would be for socneone driving from community to community
to have standard regulations. Only six communities have passed this ordinance,
but it has only been circulated since November. He said he has not had time
to receive comments from the Chief of Police yet, but if he approves, the City
Attoraey would urge adoption. Mayor Kirkham thought it would be to the
Council's advantage to adopt a uniform ordinance, and he thought it could be
adopted on first reading, and changes made before the second re,ading. Council-
man Harris thought it would need some changes, not b�cause it was not inclusive,
but he thought there were tsreas nat quite defined, Mr. Holm, the gentlman
who had circulated•a petition regarding snowmc�biles, as�ced how you regulate a
speed limit. Mayor Kirkham said that it will be their �wcx responsibility, and
they will just have to travel slowly. Mr. Hola3 said he would like to see a
speed limit of 10 or 15 MPH. Councilman Liebl ssid �hat it would be hard to
keep the speed down that Low on snowmDbiles, he felt 10 MPH would be unrealistic.
Councilman Sheridan said he could understand the peapl�'s concern about their
children'as snowmobiles have little control as far ae stopping. Councilman
Harris said that he nated that the slower they goy r.he quieter they are. It
was also pointed oue that some communities req�ire th;�t fl�gs be flown for
safety purposes.

The City Engineer put the map of the area on the projector and explained that
this would rezone half of Lot 4.
MOTION by Councilman Harris to set the Public Hearing for rezoning request
, ZOA 4�70-12 to rezone the south half of Lot 4, Auditor's Subdivision �108,
from R-1 to R-3 for February 8, 1971. Seconded by Councilman Breider. Upon
a voice vote, there being no nays, Mayor Kirkham declared the motion carried.

2. PUBLIC HEARING, REQUEST FOR SPECIAL USE PERMIT, 9P ��70-12, ALVIN A. NITSCHKE:
The City Engineer said that this Special Use Permit is for a double bungalow
and goes along with an exchange of property in the Jay Park area. The City
would get 15.4 feet of property and Mr. Nitschke would end up with an 80
foot lot. Mr. Nitschke would also give the City $250 with the exchange. He
showed the Council a picture of the type of bungalow planned. The Planning
Commission had recommended approval subject to Mr. Nitschke getting approval
from the Building Standarc{s - Desi�n Control Subcommittee of the building
plans prior to submission to the Cauncil.

Councilman Sheridan questioned the Special Use Permit in R-1 zoning as he
thought a public hearing was required. The City Engineer looked this up
and stated that a Spe�ial Use Permit in R-1 zonin� requires a 4/5 vote of
the Council, but a public hearin� can be held if th� Council wishes..

The City Engineer explained that this was a variance for a pylon sign on
property in Skywood Mall Shapping Center. The sign has to be moved because

signs and will clean up the area and be an improvement.

stipulation that all extra signs be taken down and that the owner of the
property and operator of the car wash submit letters stating there will be

The City Engineer explained that they want to put up a new sign, and to be
able to erect it in the best location, this variance is needed. It would be

sign setback fo� the Conoco Station and request the Administration to obtain

The representatives of the Continental Oil Company, present at the CouRCil

AWARD OF PACKAGE PROPERTY AND CASUALTY INSURANC: BIDS:
The City Manager said that the City had received two bids, but one bid did
not reall.y meet specifications. He introduced Mr. Leland Douglas from
Bachman-Anderson, Inc., who was present at the meeting to answer any questions
the Council might have. Mr, Douglas said that there was one decision to be
made by the Council. There is a base bid and two alternates, which would
give additional Ll3UY'bity coverage, for liquor only or for the entire City
operation. This is known as umbrella liability� Mr. Douglas also went
on to explain why the prerniums are up. He said zhat the value of the
property 'has gone ug, automobile insuraiice is much higher, payrolls are
up, and the value of the buildings and equipmeat is up, so that the premium
has increased 36%.
The City Attorney questioned whether the additional liability coverage on
the liquor would be necessttry now that a Government Tort Act is in effect
setting the limit a municipality can be held liable for. There was a
discussion between the Attorney, Council and Mr. Douglas on the advisability
of having this extra coverage, The City Attorney said he would like to
research this further. Mr. Douglas said it probably would be possible to
award the bid with Option �k2 for additional liquor liability coverage,and if
after fur.ther research, they feel they do not need the coverage, he was sure
the P. M. Endsley Company would delete the umbrella liability pro-rata.
Mr. Dale V. Hadtrath, representing P. M. Endsley Company, said that he was
sure the company would agree to that cancellation.
MOTION by Councilman Harris to concur with ttae recommendation of the admini-
stration and Mr. Douglas of Bachman-Anderson, Inc, and award the bid for
property and casualty insurance coverage to P. M. Endsley Company, subject
to final Feview of the exact policy and submission of a letter from the
P. M. Endsley Company stating they will cancel the umbrella liability on
the excess on the liquor coverage if the City requests. Seconded by Council-
man Sheridan. Upon a voice vote, there being no nays, Mayor Kirkham
declared the motion carried.

CONSIDERATION OF JOINT POWERS AGREEMENT TO ESTABLISH NORTH SUBURBAN SEWER
SERVICE BOARD•

Councilman Harris said that he has gone over the agreement and the Board has
gone over it a number of times. He felt it was a good agreement as ft
provides'for direct information relative to what the Metropolitan Sewer
Board might do and all the communities in the service area will be able to
use this method to let the Metropolitan Sewer Board know of the needa of
this area. He recommended that the Council approve the agreement and join
the Sewer Service Board, The Council decided to bring this agreement back
on the Agenda next October'for renewal.
MOTION by Councilman Harris to approve the Joint Powers Agreement to
establish a North Suburban Sewer Service Board and that the agreement be
brought back before the Council next October for renewal in November.
Seconded by Councilman Sheridan. Upon a voice vote, there being no nays,
Mayor Kirkham declared the motion carried.
CONSIDERATION OF SEWER RATES:
The Council discussed the need for reevaluation of the sewer rates according
' to the needs of the City and asked the City Manager to bring back a memo
at the next City Council Meeting with recommendations on this item.

CONSIDERATION OF CITY EMPLOYEE AND EQUIPMENT USE POLICY
The City Manager outlined the policy for the Council and explained that we
do not have a policy covering the use of employees and equipment on such
things as tournaments and playoffs at the present time, and there have been
some questions on this in the past. Councilman Harris said he thought it
was a good idea to have a definite policy.
Councilman Sheridan drew the Council's attention to Item S, "Authority", and
said he felt the City Manager rather than the City Council could authorize
the use of the employees and equipment. The Council agreed with this.
MOTION by Councilman Liebl to amend Section 5 to read City Manager rather than
City Council and to adopt the City Employee and Equipment Use Policy.
Seconded by Councilman Harris. Upon a voice vote, there being no nays, Mayor
Kirkham declared the motion carried.

VOTE ON LEAGUE PROPOSAL ON STATE GUARANTEE OF LOCAL BOND ISSUES AND VOTE

Mayor Kirkham explained that the League of Minnesota Municipalities and
othe �groups are asking that State Statutes be adopted to allow the full
credit of the State to be used to back up bonds for municipalities. He
said that both he and the City Manager were opposed to this. He said it
could happen that the State could be bonded to its capacity and some City
that has the ability to -back their pwn bonds could not get it. Councilman
Herris said he liked theidea of short term financing, but the idea tha,t the
full fsith of the State lowers the interest rate is not always right. The
City Manager said that the two proposals are unrelated and should be�handled
separately. Councilman Harris said if the Council is agreed on these two
proposals, copies of the Couc�cil's action should be sent to our State
Legislators, the League of Minnesota Municipalities and the Anoka County
Association of Municipalities, so they know how the Council stands.

Municipalities that the Council is not in favor of,the State guarantee of

DISCUSSION REGARDING COST OF TRAFFIC SIGNAL AT T.H. #47 AND COUNTY RQAD
132 (85TH AVENiTE N,W. )
Mayor Kirkham said he did not see where any one of the communities could
say this signal is of any value to another community as each of the
communities will have traffic going through the signal. The City.Eagineer
said that this intersection is very bad as far as accidents are concerned.
l�e said that the remaining $10,000 in construction cost has to be financed
by the local municipalities. He thought our share probably should be $2500.
The City Engineer said that the maintenance and electric power for the
signal's operation should come from someone other than Fridley. The Council
agreed on the figure of $2500.
MOTION by Councilman Sheridan to concur with the recommendation of the
Engineering Department and approve the amount of $2500 as Fridley's ehare
of a traffic signal at the intersection of T.H. ��47 and County Road 132
(85th Avenue N.W.), with the understanding that maintenance and electric
power are to come from someone other than Fridley. Seconded by Councilman
Liebl. Upon a voice vote, there being no nays, Mayor Kirkham declared the

REPORT ON ACQUISITION OF EASEMENTS FOR SANITARY SEWER EAST OF CENTRAL NEAR

The City Engineer pointed out that the City needed the two easements from the
two property owners. He said they have negotiated what they feel is a
reasonable price.

Councilman Breider said that he wondered if the Council would not be
creating another office within the City, and giving each department head
two bosoes. Councilman Harris felt the City was now large enought for an
Assistant City Manager to give the City Manager assistance in certain
areas and to have the powera to act on behalf of the City Manag�r in his
absence. He said he did not �eel it was creating two boases. Councilman
Breider felt the Council should not do this in tihe absence of a City Manager,
as a new City Manager might not be in favor of this. Mr. Brunsell said that
this is basically what is in the present resolution naming.him Acting City
Manager, and that he is not asking for this appointment himself. Councilman
Liebl suggested this be laid over until we have a new City Manager. Mayor
Kirkham said he could not see where it created two boses, as it was just
making an Assistant City Manager.. Councilman Breider atat�d that he read
the Resolution as creating a full time position with the power of the City
Manager, with his authority. He said that the City Manager hae created a
personnel chart, and this is t�e function of the Ci�y M,anager. Couacilman
Harris said that it was up to the Council to create positioae oa the basis of

HIGHIAND TAXICAB LICENSE:

Mr. William Bennett asked to address the Council about a taxicab application.
He explained that he had an arrangement with Mr. Kahles whereby Mr. Bennett
would furnish equipment, cars and in return Mr. Kahles would operate one car
and the company artd be the night dispatcher, and pay his part of the expenses.
Since that time Mr. Kahles who owns the Highland Taxi Cab License has not
done anything on his end of the agreement. Mr. Bennett said that the business
does not seem to be profitable unless he can combine it with the company he
owna, but Mr. Kahles will not surrender the License. He said that he has
just shyt the company down this evening. He explained that Mr. Kshles will
not come to town as there is a warrant for his arrest. The Council asked
Mr. Bennett what part of the business he owned. Mr. Bennett said that he
owned the equipment and Mr. Kahles owns the license. He said there are two
cars in good shape which he has title to. He was asked if Mr. Kahles would
have equipment to run the company if Mr. Bennett pulled his cabs out, and
he said that Mr. Kahles would not have any equipment. Councilman Harris
said that if Mr. Kahles cannot maintain his service, there is no raason to
maintain his license, but this would have to be checked out. The Manager
of Aighland Taxicab Company said they would like to shut down the Highland
Taxicab Company and have an operation of their own, but they cannot get
Mr. Kahles to appear to give up his license. He .said that theq do operate
the Red Cab Company out of the same business office and he has eome equipment
in the Valley Cab Company, and he is not asking the Council to cancel Mr. Kahles
license, but he is asking for his own license. Mr. Bennett explained that
they have service contracts with serveral businesses in Fridley, and they are
afraid they will lose them if they are not able to operate their cabs while
a new license application is being processed, and they asked if they would be
able to run the cabs until the next regular meeting. He said he had some
available under the Red Cab name. The City Attorney pointed out that the
service contract for passengers was with Highland Cab and if they pick them
up in a Red Cab, there could be a problem. The City Manager said that the
City wouldhave to have the cab licenses registered. The Manager of Highland
Cab Company said that the insurance on the cabe is twice the amount the City
requires.
Councilman Sheridaa asked why they couldn't ope.rate as Highland Cab until they
have a chance to get a license for Red Cab processed, show ownerahip of the
cabs and have them inspected. Councilman Harris asked Mr. Bennett if he didn't
have one good Highland �ab they could pick up their customers with until the
next Council Meeting. Councilman Liebl eaid he �tould like to m,akQ sure the
service contract is honored because there is an obligation to the people from
the different companies that use this cab company.

There was a discussion about having the name of the cab companies painted
on the doors of the cab so a person would know what cab company he is
dealing with. Mr. Bennett was told that this would only be a temporary
solution, and there is two weeks before this meeting and the next regular
Council meeting which should be enough time for them to get all their
papers in, and then this should appear on the Council Agenda of January 4,
1971.

CERTIFICATE OF APPRECIATION - DAVID IARSON, NSSSD:
Councilman Harris suggested that the City Council suthorize a Certificate
of Appreciation for David Larson, Chairman of the NSSSD Board of Directors,
for the untold houra of work he has put in. Councilman Harris said that
all the member communities are benefiting from the work he has done, aad that
he has been meeting about twice a week with the Metropolitan Sewer Board.
Councilman Harris requested that this be on the agenda of January 4, 1970,
and that Mr. Larsen be requested to attend the Council Meeting to receive
the award. The Council agreed wholeheartedly with the suggestion.
ORGANIZATIONAL MEETING FOR 1971;
Councilman Harris suggested the Council set the date for the organizational
meeting, so that it can be held prior to the first Regular Meeting in
January. The Council discussed a date, and it was decided that the �eeting
is to be held at 7;30 P. M., Monday, December 28` 1970.

' The City Engineer said that this vacation is part of the overall plan of the
area and the development of Skelly Oil Service Station on the corner of
j Central Avenue and Osborne Road. The vacation is for Brooks Street. The
� City will need some easements, but the first reading could be held, then the
� second reading held up until receipt of the easements.
Mayor Kirkham asked if there was anything new on the clean-up of the property
� � directly south. The City Attorney said that he had visited with the Prose-
cuting Attorney on this. There are three tenants occupying the property.
The building is not too bad structurally, but there is a lot of debris that
� needs cleaning up. He said that he had asked that an inspection be made by
A1 Bagstad, Building Inspector. He said also that the weeds need cutting.

to enforce the stipulations in regard to plantings and fencing as 7.years have
elapsed, but the building itself would not look too bad with some plantings
and a fence. Councilman Harris said that an indication should be given that
� unless the Ordinance is complied with, the City would clean it up and the
cost would be billed back to the property owner. The City Attorney said that
he would do that.

� The Chief of Police has recomnended a speed limit of 20 miles
per hour be used in Subdivision 3 of Section 2 of the proposed
snowmobile ordinance and that the hours of operation be the same as
� the other communities are using.
I would like to draw your attention to Paragraph d, Subdivision
� 2 of Section 2 relating to crossing of divided streets or highways
only at the intersection with another public street or highway. If
snowmobiles are to cross only at an intersection with another street
or highway, will the same problems arise as with pedestrians crossing
� at intersections. The area that is fenced now of course would not be
affected.
The proposed ordinance is not in its final form. That is, it
will have to be redrafted as a change to our City Code.

AN ORDINANCE REGULATING THE OPERATION OF SNOWMOBILES.
� The �@(Y�( (City) Council of the Vt�;y�� (City) of Fridley
ordains as follows:
�Section 1. LtEFINITIONS. For the purposes of this Ordinance
, the terms defined herein shall have the following meanings
ascribed to them.
�
Subdivision 1. "Person" includes an individual, partnership, cor-
poration, the state and its agencies and subdivisions, and any
body of persons, whether incorporated or not.
Subd. 2. "Snowmobile" means a self-propelled vehicle designed
for travel on snow or ice or natural terrain steered by wheels,
skis or runners.

' Subd. 3. "Owner" means a person, other than a lien holder havinq
the property in or title to snowmobile entitled to the use or
possession thereof.
Subd. 4. "Operate" means to ride in or on and control the oper-
ation of a snowmobile.
Subd. 5. "Operator" means every person who operates or is in
actual physical control of a snowmobile.
� Subd. 6. "Roadway" means that portion of a highway improved,
designed, or ordinarily used for vehicular travel, including
the shoulder.
Subd. 7. "Street or highway" means the entire width between
boundary �ines of any way or place when any part thereof is
open to the use of ti�e public, as a matter of right, for the
purposes of vehicular traffic.

Subd. 8. "Right of way" means the entire strip of land
traversed by a highway or street in which the public owns the
fee or an easement for roadway purposes.
Subd. 9. "Safety or deadman" throttle is defined as a
� device which, when pressure is removed from the engine acceler-
ator or throttle, causes the motor to be disengaged from the
driving track.

Section 2. OPERATION ON STREETS AND HIGHWAYS. Subdivision 1.
No person shall operate a snowmobile upon the roadway, shoulder
or inside bank or slope of any trunk, county state aid, or county
highway in this ��t�gr� (City) and, in the case of a divided trunk or
county highway, on the right of �aay between the opposing lanes
of traffic, except as provided in this Ordinance, nor shall oper-
ation on any such highway be permitted where the roadway directly
abuts a publiC sidewalk or walkway or property used for private
purposes. No person shall operate a snowmobile y►�ithin the right
of way of any trunk, county state aid, or county�highway
between the hours of one-half hour after sunset to one-
half hour bef�re sunrise, except on the right hazd side of such
right of way and in the same direction as the highway traffic
on the nearest lane of the roadway adjacent thereto. No snow-
mobile shall be operated at any time within the right of way of
any interstate highway or freeway within this state.'
Subdivision l. No person shall operate a snowmobile upon the
roadway, shoulder or inside bank or slope of any street or highway

ditch or on the outside bank wit�iin t e right of way of any street
or highway except interstate highways or freeways is permitted in
conformance with state law and �r,jc�k�t4i (City) ordinances, unless

used for private purposes. Between the hours of one-half hour
after sunset to one-half hour before sunrise, any operation may
only be on the right hand side of such street or highway and in
the same direction as the highway traffic on the nearest lane of
the roadway adjacent thereto.
Subd. 2. A Snowmobile may make 3 direct crossing of a street
or highway except an interstate highway or freeway, provided:
a. The crossing is made at an angle of approx-�
imately 90 degrees to the direction of the street
or highway and at a place where no obstruction
prevents a quick and safe crossing.

Subd. 5. Notwithstanding any prohibition in this Ordinance, a
sr�owmobile may be operated on a public thoroughfare in an
emergency during the period of time when and at locations where
sncw upon the roadway r.enders travel by automobile impractical.
Section 3. OPERATION GENERALLY. Except as otherwise specifically
permitted and authorized, it is unlawful for any person to �
eperate a snowmobile within the limits of the ��i (City) of

person shall use a muffler cutout, by-pass, straight pipe or
similar device on a snowmobile motor, and the exhaust system
shall not emit or produce a sharp popping or crackling sound.
Subd. 2. Brakes adequate to control the movement of and to
stop and hold the snowmobile under any conditions of operation.
Subd. 3. A safety or so-called "deadman" throttle in operating
condition, so that when pressure is removed from the accelerator
or throttle, the motor is disengaged from the driving track.
Subd. 4. At least one clear lamp attached to the front, with
sufficient intensity to reveal persons and vehicles at a
distance of at least 100 feet ahead during the hours of dark-
ness under no�mal atmospheric conditions. Such head lamp
shall be so aimed that glaring rays are not projected into the
eyes of an oncoming vehicle operator. It shall also be
equipped with at least one red tail lamp having a minimum
candle power of sufficient intensity to exhibit a red light
plainly visible from a distance of 500 feet to the rear during
the hours of darkness under normal atmospheric conditions.
The equipment to be in operating condition when the vehicle is
operated between the hours of one-half hour after sunset to
one-half hour before sunrise or at times of reduced visibility.
Subd. 5. Reflective material at least 16 square inches on each
side, forward of the handlebars, so as to reflect or beam light
at a ninety degree angle.
Section 5. APPLICATION OF OTHER LAWS. ���?�ce (City) traffic
ordinances shall apply to the operation of snowmobiles upon
streets and highways, and Minnesota Statutes 1969, Sections 84.81

o ., and Minnesota Statutes 1969, Chapter 169 except for
�� those provisions relating to required equipment, are hereby
adopted by reference, except those provisions which by their
nature have no application.

Section 6. PERSONS UNDER 18. Subdivision 1. No person
under 14 years of age shall operate on streets or highways or
make a direct crossing of a street or highway as the opera.tor
of a snowmobile. A person 14 years of age or older, but
less than 18 years of age, may operate a snowmobile on streets
or hiqhways as permitted under this Ordinance and make a direct

crossing thereof only if he has in his immediate possession a
valid snocamobile safety certificate issued by the commissioner
of conservation as provided by Minnesota Statutes 1969,
Section 84.86. '
Subd. 2. It is unlawful for the owner of a snowmobile to
permit the snowmobile to be operated contrary to the provi-
sions of this section.
Section 7. LEAVING SNOWP�OBILE UNATTENDED. Every person leaving
� a snowmobile in a public place shall lock the ignition, remove
the key and take the same with him.
� Section 8. CHASING ANIMALS F'OR�IDDEN. It is unlawful to
intentionally drive, chase, run over or kill any animal, wild .
or domestic, with a snowmobile.

', Section 9. VIOLATIONS. Every person convicted of a violation
� of any of the provisions of this Ordinance shall be punished by
a fine of not more than three hundred dollars ($300.00) or by
1 imprisonment for a period of not more than ninety (90) days, or both,
but in either case the costs of prosecu�ion may be added.
� Section 10. SEVERABILITY. Should any section, subdivision,
clause or other provision of this Ordinance be held to be
invalid by a court of competent jurisdiction, such decision
� shall not affect the validity of the Ordinance as a whole, or
of any part thereof, other than the part held to be invalid.

streets only for going to ar►d from open apacoa. They became a nuisance and a
safety hazard. He said he was concerned about ti�o safaty of the sno�wmobile
drivers also. Cour�cilman Harrie said that 'he sscoqnis�d that �here Mas more
and more opposition to the operation of �nowwo�biles and the City in aacepting
this petition must realize that a substantial amount of people do twt vant
snawn►obiles on the City streets. There should ba aaaa control to eliminate the
safety hazard.

This letter is a request for permission to use Madsen Park
property for construction of a swimming pool at the above address.
A digqing machine will be brought in along with building material
and approximately five loads of dirt will be hauled out. The pool
will be constructed in the spring of 1971 as soon as the ground is
dry and permits, construction, probably the end of April or first
part of May. It will take about a week and a half to two weeks to
complete. .

A RESOLUTION TRANSFERRING FUNDS FROM THE 1969-3 STREET IMPROVEMENT
PROJEC7 TO THE GENERAL FUND
WHEREAS, By Council motion on December 15, 1969, the Council
authorized the transfer of $10,000.00 from the City's General Fund
to the 1969-3 Street Improvement Fund (Street Work - Riverview
Heights), and
WHEREAS, The City received $17,263.20 from the Federal
Government which was applied to said street project, and
WHEREAS, The total of the above two amounts is more than is
necessary to offset the cost of easements, etc., and
WHEREAS, Said project has been assessed to the property
owners in the amount of $68,339.45, and
WHEREAS, If $7,946.83 is returned to the General Fund the net
cost of the project will be $68,339.45.
NOW, THEREFORE, BE IT RESOLVED, That a transfer of $7,946.83
be made from the 1969 Street Improvement Project to the General
Fund.

ii. Mobile Warming House - The newly constructed warming house has been delivered and

for the winter skating season.

f. New Key System - A newly formed key system has been installed in all of our
warming houses and also at all locations where keys are needed. This was done
in order to protect our property from vandals and robbery due to our break-in at
the Park Garage.
g. Madsen Park -'l�vo additional light standards were installed at Madsen Park, in
order to improve the lighting situation.
h.� Commons Park - The hockey rink received new globes in order to deflect better
light on the rink.
i. Summit Sc{uare Park - Globes were installed to better the lighting for the general
skating rink.
III. Recreation:
a. Chess Clinic - Classes to begin in January on Tuesday nights.
' b. Wrestling Clinic and Tournament - No dates set.
c. Jr. High Basketball Tournament - Teams will be invited to attend tournament in
� March.
d. Girl's Ballet Classes - A new series begins at Rice Creek School on Wednesday,
IJanuary 13th. The classes have been very successful to date.
e. Children's Table Tennis Tournament - No dates set.

h. Hockey Field Trip - H.A.F. will set this date. Looks like late February game
at the U. of M.

not having very good response to date.

Arena.
