authorized this work to be paid by City funds. The
hearing for the improvement is being held to give the
people the choice if they want the dam improved and
the cost is proposed to be assessed for this work)
2. Public. Hearing on Street Improvement Project ST. 1970-4,
Addendum ��3 - 78th Avenue: Beech to Main Street
COI�ll�1ENT: It,seems it is going to take considerable
time to get the law suit settled with Spring Lake Park. .
We are proposing to ��t in a temporary pavement on 78th
to avoid washing of dirt onto newly paved road)
3. Public Hearing on Vacation (SAV ��71-01), Project
ST. 1970-3, Vacate Portions of T.H. ��47 East Service
Road.
COMMFNT: Council has requested the riinnesota Highway
Department to release thzs right of way to the City.
This vacation would facilitate the negotiations of
acquisitioc, of the right of way for loopbacks at 61st

Auditor's Subdivision 108, rezone fram R-1 to R-3 the South 2/3rds.
The Public Hearing Notice was read by Acting Chairman Fitzpatrick.
The petitioner, Mr. Sid Bader, explained that they were hoping to con-
struct a 22 to 24 unit apartment building if granted the rezoning. They
have just finished building an apartsent at 1441 73rd Avenue Northeast, and
feel it is a desirable building. They will build a well constructed apartment
which �rill be an asset to the community.
The public hearing wae opened to the sudience.
Mr. and Mre. Dr�, residing at 1641 73rd Avenue which is the hame
adjacent to and East of the lot being �onsidered for rezoning ttated
that his home was of average value with recent remodeling coating him about
$5,000.00. He stated that he was in sales and that it wae not uncommon for
him to be transfered on fairly short notice �rhich would make it necessary
to aell his home with a ahorter,other than normal�amount of time to dispose
of it. He felt that if this property w�ys rezoned, it would hinder his ability

Mr. Drw;mn had the following cotrments and questions; First, he wondered
if anyone could te1J. him when this conatruction would commence and when it
was completed, where would it be located with reference to his West line. He
questioned the location of outside facilities such as garbage cans, parking lot
and driveway. He also wondered if there was any control over the number and
ages of the children in the families renting in the proposed building.
Mr. Bader stated that he could not answer all of Mr. Druuan's questions
becauae they have not gone into much detail on the plan for a building on [his
area yet. However, he would offer the following data: He would estimate that:
it would take them about 30 days £rom the date of rezoning approval. The draw-
ing that was submitted with his petition shows the building 15 feet fram your
West line *uith the driveway along the West side of the lot leading to a parking
lot to be located North of the proposed building.
Mr. Bader went on .:o �tate tliat all the uniLS would be two bedroom and
, they had not thouglit oi any restrictio:is on the size of a family wanting to
live there. He would estimate, hawever, that the average age of the children
in their building at 1441 Wae about 14 years.

Mrs. Dru� co�aented that most people will not buy next door to a�n apart-
ment. Mr. Bader answered that when single family 1�ts are close to lots zoned
R-3, there is the possibility that the ir�iedi:=�r.e ar��= may be considered for
apartments and it would make th�t pruperry wor�-h ��:-�
Mr. Drumm felt that their home was too valL�ible tv offset the increased
� value if it were re$oned to R-3 therefore he felt his property would more th8n
likely remain R-1 and would feel much better i� the pr::�;�osed structure were
smaller, say a fourplex.
Mr. �tobert S. Bigelow, 6322 Bass Lake Road, Minneapolis: He stated that
in all hie real estate experience, he would h�ve to say he would have as much,
or better, chance of selling Mr. Drumm's hocne witt► the type of building Mr. Bader
ia constructing as oppased to the kind of hou�.e that is th2re naw.
Mrs. Drumm stated they bought their house in that area for privacy and
there were just ten children in the block, but naw the number would increase.
� Mr. Drumm felt the height o� the building would affect the amount of light
his houae would receive.
Tom Marxen, 1620 Onondaga Street (Lot 5): He explained his property was
adjacent and lies East and North of the property under discussion. The pro-
posed road in the center of his property has been dedicated and he has built
one home on the front lot, and he intended to build another one on Onondaga.
He has put in a lot of time and money so far, and felt that someth�ng had to
be resolved regarding the zoning and the dedicated street.
Vice Chairman Fitzpatrick believed the subject of the roadway ought to be
taken up at this time. Originally the proposed plan was for an East/West
street midway between Onondaga Street and 73rd Avenue in order ta serve the
interior part of the block.

The Engineering Assietant gave the fo1la,Ting b;ief hietory for the area:
Zn 1961 the Planning Cammiasion and City Council adopted a atreet plaa for the
axea of Fridley North of 73rd Avenue and East of Central Avenue. In thie so-
called sc�per block, being bounded by Hayea Street on the Weat,on the Eaet by
Stinson Boulevard, on the North by Onondaga Street and on the South by 73rd Avenue,
the plan indicated the need for an additional street to run East and Weet and to
be located half way between 73rd and Onondaga. There was also a couple of lega
off fro� thia street out to either Onondaga or 73rd Avenue. Hawever, at the time
thie plan was adopted, the entire block was zoned R-1.
In 1963 Council approved some rezoning to R-3 in the West half along 73rd
Avenue in this super block thereby reducing the need for street accesa to the
rear of the 300 foot depth lots along 73rd Avenue that are zoned R-3. 8a►ever,
there atill ia a need for atreet accesa to the rear of the long lote facing Onoa-
dag�.
The area West of Z�ricki property h,3s been pretty Well reaolved by the
Council approval of the George Nelson land use lssr_ Monday night. The two parcels
lying Eaet of the Zywicki property have previous].y been split or platted With the
dedications of right of way to ff�eet the plan for th� addition of a atreet std-
block between 73rd aad Oaonda�a.
This then makes it nearly mandatory that we extend the dedication through
the Zywicki property of which �ee are considering tonight.
Acting Chairsaan Fitzpatrick asked if Darrel would explain the George Nelson
development a little more in detail.
It was then explained that Mr. Nelson was to dedicate a 35 foot atreet
easement along the West edge of Lot 30 from Onondaga South to midway between
Onondaga and 73rd to pravide for an outlet if the East/West streets were to be
dedicated from Lot 30 to the Weat. He was not required to dedicate right of vay
for the East/Weat etreet through lota 30 or 31 becauae he plana to leave the area
North of the R-3 property (being the South half of Lots 30 and 31) open and to be
used for recreation area for the building to be conatructed along 73rd Avenue.
Mr. Nelson will be platting aix lots along Onondaga for single family houaes. It
Was also explained that Mr. Nelson was given approval to increase the number of
unite allo�ed on the R-3 portion by the number of sin6le family dwellinga that
could have been built on the R-1 vacant property adjacent to the R-3.
� It was also pointed out that if a street were put in between land zoned
R-1 and R-3 with the R-3 property having already been served by a atreet and
sewer and water on the opposite ead,that more than likely all the cost of the
sewer and water would have to be born by the R-1 property and 75X of the coat df
1 the street to be paid by the R-1 property. If this method were used to asseas '�he
improvementa, it would put the cost so high that it could make it uneconomical
to have the street put in at all.

Mr. Drumm asked if the proposed rezoning would affect his taxes - would
they,increase or decrease?
Daxrel Clark anawered that as far ae the valuation of the property is
concerned, he would think it would stay the same because it is R-1 property.
Mr. Drumm wondered, with the land already zoned for ap,��tmenta in that
area, and which is for sale having a lszger area than what is now being rezoned,
why they need this la�d.

Vice Chairman Fitzpatrick e�cplained that the request fpr the rezoning vae
by Mr. Zywicki, the owner of the land, and he had asked Mr. Bader to develop it
for him. The petitioner hae the right to petition for rezoning of his ovn property.
He then asked Darrel Clark how muctt R-3 land ia available in that area.
Aarrel Clark explained that abou�t 10% of the area zoned R-3 had R-3 develop-
ment on it naw with the assumption that George Nelson is building on his property,
it would bring the developed R-3 property to about 40X.
Mr. Harris asked Mr. Marxen if he were planning on splitting his lot.
Mr. Marxen replied that he platted the area because he did not know the kind pf
homes he could build because of the frontage. If hia land remained R-1, he would
need a street acceas, otheYwise if there should be a po�sibility that the area
would all be developed R-3, the street acceas could be removed.
It was also explained that the outlet for the E�st/West street would make
it necessary for additional right of way aloag the East edge of Lot 32 nvw awned
by E. H. Stein. It was noted that a letter from E. H. Stein, owner of Lot 32,
did not abject to the rezoning. Mr. Harris then wondered if it might be neceesary
t� acquire another 30 feet of right away from Lot 32 to provide access to the East
lu��. National Funds, former owners of Lot 32, platted the land including the
30 foot dedication, but never filed the plat.
Mr. Bigelow said he still didn't see how this access was affected by the
� petition. It was explained that, assuming this East/West street were improved
right now with the area on both sides zoned R-1, the improvement coat would
probably be borne equally on either side of the new street. Now assume Zyvicki
� property were zoned R-3 and developed prior to the new street being improved, then
you see the North side or R-1 property would pay nearly all the improvement coet
and the area on the South side of the new street very little because they already
have been served by 73rd Avenue.
Mr. Mzrxen said in answer to Mr. Bigelow's question that he could not, at
this time, decide whether he would want his land zoned R-3 without access or r
wbethl� � could posaibly accept the additional fmprovement cost for the new street
if the �iywickf<=parcel were rezoned to R-3. Hie main concern would be haW could he
develop his land with some profit to him and beat fit the area as far as use was
concerned.
Mr. Harris cammented that the depth of the North one third of Lot 4�.s 200
feet, the parcel remaining would be 101 feet deep. If a street were put through,
that would leave Mr. Zywicki with a lot Narth of the street less than 100 fe�t in
depth. In order to make that into buildable lots, he would almost have to p�rchaee
some of the lot that faces Onondaga. It will take cooperation of the people in
the block to make the plan work. The Engineering Assiatant said that the artia
awned by Mr. Zwicki North of the area being rezoned would be about 75 feet North
and South by 175 feet East and West along the proposed street.
A comment was made that the houses in this area are, for the most par�,
very nice homes. ;
MOTION by Minish, seconded by Harris, that the Planning Commissian cl�se
the publi c hearinq of the rezoning request, ZOA �i70-06, Sid Bader, to rezone'frpm

Mr. Schmedeke aaked that if the propoaed road were to go through, in

errners wanted it, the few undedicated parcele would probably be taken by condemnation.
Mr. Harris said he wae impreased by the presentation thie evening as the
petitioaer ha�d done a lot of ground work, such as getting signatures from most of
the p�ople ia the block. He wae certain that in soffie waq, if the petition were
greated, Mr. Drumm'e property could be psotected by berms, landscaping, etc. But
before he could vote for any reaoning on Lot 4, the petitioner would have to agree
to dedicate the 50 foot ri�ht of way for the re�t of the other street. The South
half of Lot 32 is R-3 aa well es all the lots to the West. With Mr. Nelson's
prpject going ahead and one other apartment building in the area, that as time goe�
on, he Was certain the reat of R-3 prapeity will be developed. Perhape Lot 4 is a
good place to stop, with �Ir. Marxen developing hia property R-1. If the rezoning
zequeet were granted, in order to protect Mr. Drum�m, the Planning Commis�ion would
recommend the dedication of the atreet, adequate acreening between R-1 and R-3
with trees. berms, etc. Mr. Schmedeke said he also felt that R-3 should etop with
Lot 4.
Mr. Marxen etated he would prefer a proper buffer on the North end of the
R-3 property.
In the case of rI�, I�?e�lsc,nT �he �;ngineerin� As�i.stant said it waa atipu-
lated there would be no acceas to the North.
Mr. Schmedeke seked what the effect would be on the number of units in the
apartment if the street in the middle of the block would be dedicated. The Eagineer�
ing Assietant answered that by taking the right of way, the petitioner Would lose about
5,000 square feet which would amount to the loas of about 2 unite. Sasetimee a
street dedication is allawed in figuring the density of an area. �
MbTION by Schmedeke, seconded by Harris, that the Planning Commission reaom-
mend approval of the rezoning request, ZOA N70-06, Sid Bader to rezo�e the Soutb
Bal � of Lot 4, Audi tor's Subdi vision M108, from R-1 to R-3 District with the stipu-
lation that Mr. Zywicki continue the necessary dedications to connect a right of
way up with the slready dedicated portion to the East, the access to this new
street be controlled or limtted, the new R-3 area be properly and adequstely
screened adjacent to the R-1 properties. Upon a voice vote, aZ1 voting sye, except
Minish, voting nay, the motion carried.

Mr. Harris felt the proper action would be that when the minutea are

Ordinance requires the Planning Commission recommendation prior to Council
approval, this procedure should be followed.

Mr. Harris said that all the Subcommittee saw was :�tside elev��iczs of

were given the Planning Commission thia edening.
The petitioners went befare the Boar� of Appeals for high rise apart-
ments and got approval. When they consulted the bank, they were told it was
not feasible or economical and then they ceme back with the townhouse concept.
Council said they liked the idea.
MOTIDN by Minish, seconded by Harris, that the Planning Commission
table considera tion of a preliminary plan for Townhouse Development by N.C.R.
Corporation to be constructed on Lots 3 and 4, Block 2, Hayes River Lots,
until the final plan is filed with the BuiZding Inspection Department.
Upon a voice vote, all voting aye, the motion carried unanimously.
MbTION by Minish, seconded by Harris, that the Planning Comatssion
recornmend to Council that the City Attorney be instructed to review Sec�ion
45.14 Townhouse Development and that the proposed amendment for Item 2 under
Sectian 45.141 inclvde a provision for review of the final plans by the
Building Standards-Design Control Subcommittee prior to submission to the
Planning Commission, and to have four subdivisions as Item 1 has. Upon a_
voice v�ote, a11 voting aye, the motion carried unanimously.
Vice Chairman Fitzpatrick said he suspected, because the 4th subdivision
had been omitted, and that there seems to be an error in Item 2 C, eometi�in�
has been del.eted by accident.
4. REQUEST FOR VACATION OF A PORTION OF A tTTILITY EASEMENT BY JERRY
ABRAMSHUR. SAV �70-05: To vacate the Northerly 7 feet of the Southerly

on the rear part of the lot and, without knawing, encroached eome 6 feet on
the easement. Mr. Abramshuk. wants to add to the garage for storage purposes
and had heard he did not need a permit, When a building inspector drove by,
he noticed the construction and stopped it. WhEr� a certificate of survey
was brought in, it ahowed encroachmen� of the existing garage into 15 feet
of the easement. The City contacted Northern States Power and Northweetern
Bell Telephone to get their opinion of the petition for vacation of the
Northerly 8 feet. Both responded in thia that�they have no objection, and
the City has no objection because we have no utilltiea in the area.
' , Mr. Abramshuk wae very apologetic to the City for not folla�wing the
proper procedure. The total easement is 25 feet which would atill leave 17
feet after vacation. The lo� next door has a 15 foot easement also.

Mr. Schmedeke noticed that the fence is right on the lot line and that
he felt the request ahould be approved.
� MOTION by Schmedeke, seconded by 1�linish, that the Planning Commission
reco�mmend approval of the vacation request, SAV #70-05, by Jaroslaw Abram-
shuk, of the Northerly 7 feet of the Southerly 15 feet of Lot 1, Block 5,
' Rice Creek PZaza South. Upon a voice vote, a11 voting aye, the motion
carried unanimously.
Darrel Clark added that the Administration has allowed Mr. Abramshuk
to continue hia construction without a permit because one half of the struc-
ture is up and because of winter, it would be a hardship not to finish it.
5. OONSIDER DATE OF SEOOND MEETING OF THE PLANNING COI�fISSION IN DECE�ffiER:
December 23, 1970.
The Commission agreed not to meet on December 23, 1970, but if requests
came in that were urgent and could not wait until January 6, 1971, the next
regular meeting, the members would be polled.

CHANGES IN COUNTY FLAN
FOR EAST RIVER ROAD SAFETY F� IMPROVEMENTS
TO THE BENEFIT QF FRIDLEY RESIDENTS IN THE AREA
1. The road connecting Rivers Edge Way and 6Znd Way has
been eliminated.
2. Three fully activated signals (at Georgetown Apartment
complex, 61st Way, and Mississippi Street) will be
installed on East River Road instead of only two as
originally proposed.
3. 'I'he entrance to Robert Louis Stevenson School has been
moved from South of the school to North of the school.
4. The East service road North of Downing Box has been
eliminated.
5. The West service road North of the Georgetown Apartment
complex has been planned to go straight to 59 1/2 Way
instead of going behind the garages.
6. The service road along the Georgetown Apartment complex
will be moved further East from the existing location.
7. A signal will be located just North of Interstate #694
at the Georgetown Apartment complex and LaMaur entrances.
8. Additional right of way will not be taken on the
West side of East River Road near the new homes which
are already close to the roadway.
9. The main traffic lanes will be moved six (6) feet
� further away from the homes ��hich are closer to East
River Road on the West sicle.

14. The City of Fridley's original estimate for the
preliminary assessment roll was $476,735.00, the total
project cost was $939,161.00. This cost was figured
without Federal assis.tance and with the following
conditions the City would pay:
' A. All work on the service roads.
B. All right of way acquisition.
C. One half the signal cost.
� D. All drainage improvements.
E. Al1 lighting costs.
, Now we are assured of Federal assistance of fifty per
cent. This would cut our costs to less than $250,000.00,
but with additional County participation and project
modifications our dollar participation has been estimated
' to be around $100,000.00, which is approximately 10 per
cent of the project. The following items have been
negotiated with the County:

A. All paving on side connecting roads will be Charged to
the County including Ashton Avenue extension.
B. All right of way along East River Road main line
including the home at Ri.vers Edge Way and the gas

SUBJECT: Street Sweeper
I have discussed the street sweeper at some length with Mr. Les Chesney
and the following information is submitted:
1. The present Elgin sweeper is in constant use when weather
permitting from the last half of April through early
November, or until the weather is such that the operation
is not to the best interest of the City. The only time
the sweeper is not used is during rainy weather or
maintenance repairs.
2. There have been numerous complaints from tax payers that
the streets are not kept clean. Consequently, our one
(1) street sweeper can only cover the City a maximum of
22 to 3 times a year.
3. During an eight hour day, the operational time for a
sweeper is as follows:
A. Make ready time for operation - approximately
' 3/4 hours in the morning. The sweeper must
be completely lubricated. The drives, belts
and bearings must be checked and any adjustments
1 needed must be made at that time, plus refueling
and general care.

B. When the sweeper returns to the garage after the
daily operation, it must be completely washed down,
This is done so as to remove all sand, dust and
dirt from the mechanical parts. The sweeper is
then left to dry so that proper maintenance can
be given before going back on the street.
4. The following companies have submitted quotations on a lease
arrangement:
A. Hayden Murphy Equipment Company will lease as per
their quotation. (See let�er attached.)
B. McQueen Equipment Inc. is not interested in leasing
any equipment a�: this time. (See letter a�tash�d.)

C. Hall Equipment for a minimum of six (6) months
only at the rate of $975.00 per month. Their
confirmation or lease plan will be received
February 2, 1971. Hall Equipment will lease
new equipment with the expectation of selling
the equipment to the City after the lease
program.
, 5. Leasing old equipment is not always the wise thing to do.
Example: The new concept in street sweepers is automatic
' unloading into a truck, and the truck will haul to the
dumping area, or the sweeper is a mobile unit that will go
to the dumping area and unload. The above two methods are
1 labor saving programs. This concept of street sweeping is
a must for fast operation and economy.
� Mr. Chesney assured me that the additional sweeper would be on the street
from the last half of April until the weather is such that it cannot be
operated efficiently.
I' With. the above information assured, it would be more economical to purchase
a new sweeper than to purchase used equipment. The dealers will give a
warrantly on used equipment by increasing the p^ice of the equipment, then
' you still have old equipment.

Gentlemen:
In reply to your inquir-,• relative to the leasing of a Mobil Four-
Wheel Ztain Engine Staeeper, we wish to advise that we do not have any
new machines available, but we do have an exceptionally good used
unit.available for your consideration. 1'he specific machine we are
recammending is the unit described on the enclosed quotation. This
is a 1965 Mod'el machine that we have taken in trade from the City of
Rochester. This machine has been thoroughly serviced and repaired
and should do an outstanding job for your city. Special terms and
conditions of this lease transaction would be as follows:
Monthly Rental Rate -$950.00 per month
Minunum Rental Period - Six (6) months
Sale Price - $8,500.00
Purchase Option - City of Fridley would have the option of purchasing
the unit at the end of the lease period, applying 100% of the
rental. If the option is not exercised at the end of the lease
period, the option will be null and void. '
Mafntenance - City of Fridley is responsible for all maintenance on the�
sweeper, T'he sweeper will be deliver��d in good operating condition
and will have a new set of brooms. Sweeper to be returned to Hayden
Murphy at termination of lease (if option to purchase is not exercised)
with a new set of brooms.
Taxes - We assiune that the City of Fridley is exempt from all sales, use'
and or personal property taxes. However, the City will be respons�ble

was assigned as the central contact poiat for the Tour and was appointed as the
Fridley Industrial Development Commission Coord3nator by the City Mana.ger.
Propo$al to consider the Fridleg Chamber of Commerce as an equal partner �aith
the Commission in hosting the Tour was approved by the ChaYaber President,

diaplays� and the luncheon were pla.nned in specific detail and additiona�
assignments made. Plans were formulated to attend the Fridley Chamber of

The Fridley.Industrial Tour for 197� was held on this date for aome 75 to 100
attendees. The Tour included a stop at the new Fridley Post Office. The
diaplays at City Ha.11 were excellent with credit going to the City gigineering
Department for their efforts and in particular� Leon Madsen, who did an excellent
overall job. Three speakers at the luncheon at Sandeea were in order:
De,ve Harris (Welcome to Fridley), M. E. Layer (on behalf of the City Post Offiae)�
and Kermit Reedstrom (Medtronic, Inc.). The event was covered by the Suburban
S� Newapaper. �ao letters, shown as Attachments A and B, attest to the succesa
of the Tour.
December 3, �970
Plan� to include Fridley as a showplace within the industrial community were
formulated with the Minneapolis Star repreaentative, Conrad Kriudeon. It waa
decided that Fridley and several industries would be featured in a half-page
article in the newspaper�s "Upper Midwest Feature�' 3n January. A lay-out wae
��oposed by the Commission and Chamber membex�s. Solicitations to fund the
article (approximately �1,700) were to be ma.de by personal contaet by
Mr. Knudson. Letters of iritroduation and explanatory messages were sent to all
Fx�idley industry by the City Menagerts office. Commission members in attendance
were:

Because of economic conditions, most industry in F�idley turned down the offer
to be a part of the "Upper Midwest Feature.�' Decision to withdraw the proposal
to the Miuneapolis Star was made by Chairman Mittelstadt. Decision to be
ineluded in the �'Feature�� as a part of an Industrial Index, which included a few
brief words on behalf of the City of F`ridley� was made by Chairman Mittelstadt.
The clecision was made in concurrence with Mr. Leon Madsen. The cost of the insertion
was $38.

CONSIDERATION OF CHANGE IN AUTHORIZED EXPENDITURES,
PARK AND RECREATION DEPARTMENT
The Parks and Recreation Commission at their December 28, 1970,
meeting concurred in the request of the Park Department that certain
changes be made in the 1971 Budget. The items that are proposed to
be deleted from the 1971 Budget are those items shown on the Park
Department budget sheets attached hereto which have been lined out.
Also enclosed herewith is a resolution making the budget changes if
the Council concurs with the recommendation of the Park and Recrea-
tion Commission.
The Park Director will be present at the Council Meeting to
answer any questions the Council may have on the matter.

and $15.00 monthly for rental. �Ve could not purchase the system, anly rent it. He
offers this as one solution and asks both the City Council and the Commission for any
qthers they might have.

The Commission discussed this problem and agreed with Mr. Volkman, that somethi^g had
to be done. Mx. Brown informed the Commission that the Department can not af£ord to
replace these tools and equipment until the fear of theft is removed or the situation
corrected.
Mr. Volkman said that the Park Department men are presently driving to the City Garage
to borrow tools, if they have those needed, and the men have been clocking themselves,
to report the amount of time lost in travel. He said they are presently working an
average of 4� hours of an eight hour day, due to the loss of time in travel.

SALE OF PARK PROPERTY.

,The City Assessor was asked to research the backround of the Cheri Lane Property and
',the Horizon Heights Property, located at 53rd $ Lincoln.
Tha Cheri Lane Property was donated by Target Stores, Inc., for park purposes and
cannot be sold.
The Horizon Heights property, located in Innsbruck. was purchased for a Tot-Lot and
it would be expensive for the Ci.ty to develop, due to the facilities needed. such as
a storm sewer and sanitary sewer easement and construction.
Mr. Fitzpatrick directed Mr. Brown to place these three properties on the agenda for
the January 25, 1971, meeting: �1. Cheri Lane Property. #2. 53rd and Horizon Height,s
Property. �3. Flanery Park.
FLANERY ESTATE.
Mr. Bxown informed the Commis.sion that he was having a problem getting together with
the people in charge of the Flanery Estate. He said that he had communicated with
these people and it was his understanding that they were going to endorse the check
and then give it to the City. This has been some time ago, and he's heard nothing mpre
about it. Mr. Brown suggested that this be placed in the hands of the City Attorney,
for further action.

succeed $7,900.00. The Commission feels additional funds must be met in

CLARIFICATION OF ITEM IN PARK AND RECREATION COMMISSION
MINUTES OF DECEMBER 28, 1971, REFERENCE: FLANERY PARK
The item in the Park and Recreation Minutes of December 28, 1970,
refers to the matter of the Flanery Estate giving a$900 check to the
City of Fridley. This check was not for the sale of property, but
an outright gift. It was apparently given with the understanding that
the name of the park would continue to be Flanery Park. There is a
problem in getting the proper people to endorse the check and turn
it over to the City. The Park Department has had correspondence with
the Administrator of the Estate several times and has been unsuccessful
in bringing the matter to a conclusion, and therefore has su ggested
that the City Attorney become involved in the matter.

with is•Security Alarm Systems, and tlieir system will cost $127.00 for installation
and $15.00 monthly for rental. We could not purchase the system, only rent it. He
offers this as one solutio�i and asks both the City Council and the Commission for any
other� they might have.
The Commission discussed this problem and agreed with Mr. Volkman, that something had
to be done. Mr. Brown informed the Commission that the Department can not afford to
replace these tools and equipment until the fear of theft is removed or the situation
corrected.

Mr. Volkman said that the Park Department men are presently driving to the City Gar�age
to borrow tools, if they have those needed, and the men have been clocking themselves,
to report the amount of time lost in travel, He said they are presently working an
average of 4'� hours of an eight hour day, due to the loss of time in travel.

The City Assessor was asked to research the backround of the Cheri Lane_Property and
the Horizon Heights Property, located at 53rd �, Lincoln.
The Cheri Lane Property was donated by Target Stores, Inc., for paxk purposes and
cannot be sold.
The Horizon Heights property, located in Innsbruck, was purchased for a Tot-Lot and
it would be expensive for the City to develop, due to the facilities needed. such as
a storm sewer and sanitary sewer easement and construction.
Mr. Fitzpatrick directed Mr. Brown to place these three properties on the agenda for
the January 25, 1971, meeting: #1. Cheri Lane Property. #�2. 53rd and Horizon Height.s
Property. #3, Flanery Park.
LANERY ESTATE.
, Mr. Brown informed the Commission that he was having a problem getting together with
the people in charge of the Flanery Estate. He said that he had communieated with
these people and it was his understanding that they were going to endorse the check
�and then give it to the City. This has been some time ago, and he's heard nothing more
about it. Mr. Brown suggested that this be placed in the hands of the City Attorney,
for further action.

The Metropol�tan Council has been asked hy the municipalities of Brooklyn
Park, Coon Rapids, Fridley and Maple Grove to coordinate a transportation study
in the area bounded generally by I 694-94, Lexington Ave. , TH 101, and TH 242-
CSAH 49 , particularly the need for a new Mississippi River crossing . The Mefixo-
politan Council has agreed to undertake this study, in the context of its Trans-
portation Planning Program, and has developed a preliminary study concept, which
is attached. It is proposed that the study be a cooperative effort, and that
affected government agencies be involved in the study direction and review.
To accomplish this direction and review function, it is proposed that a Management
Team be designated, composed of one representative from each agency affected
by this study, a chief staff person of the agency. In particular, we are asking for
a representative from:
Brooklyn Park
Coon Rapids
Fridley
Maple Grove
Anoka County
Hennepin County
Ramsey County
Metropolitan Transit Commission .
Minnesota Highway Department
The chairman will be Eugene V. Avery, Director of Transportation Planning for the
Council. This yroup will meet at least every t:�ree months, and more often vti:ien
necessary to review principal policies and study products. -

The City of Fridley has not yet adopted the new State Plumbing Code
which permits use of plastic pipe.
The Inspection Department is working on the adoption of the new
cade and present study dictates that we recommend the proposed waiver of
the present code to permit installation of plastic pipe for wasta and vents
in the remodeling at 1565-73rd Avenue N.E. by Chester Ewer.

STATUS OF NEGOTIATIONS WITH BURLINGTON NORTHERN,

On January 7, 1971 I wrote a letter to Burlington Northern
requesting permission to use a portion of their property on a
temporary basis. I explained the City wished to put a hockey rink
on the property for the ralance of the season. I also stated the
City would like to enter into negotiations with Burlington NortherZ
for the lease of the property on a long term basis for park and
playground purposes.
Burlington Northern asked for additional information includin�
the exact legal description of the plot we wished to use for a
hockey rink and the exact description of the property we wished to
lease on a long term basis. They also requested detailed drawings.
This information was furnished to Burlington Northern with a letter
dated January 18, 1971. Since that time we have had no further
contact with the railroad.
