2. CONTINUED• REZONING REQUEST, ZOA 1i7�-03, AMERICAN OIL C0. BY JOHN P. YOUNG-
DALE: To rezone that part of the NE�i of the 1�T4� of Section 11 lying East
of centerline of University Avenue and North o� the centerline of Osborne
Road as said roads are now laid out and constructed (1960) from R-3 to C-2.
(Northeast corner of University and Osborne Road) Yublic hearing closed 4/7/71.
Wyman Smith,.John P. Xoungdale and R. L. Ernat were pre�ent.
. Chairman�Erickaon explained that the public hearfngs had been closed on
� April 7, 1971, but if any member of the Planning Com�nission wished to have it
` saopened, a motion would be in order.
Mr. Smith said they were not asking for the heasing to be opened. �ie has
read t'h� mtnutes of the last meeting and Mr. Ernst has a statemeat he would like
to make of a conversation with the pastor of the Church. He thought he would
xeport ta Che Planning Commission meJnbers that two houses have for sale signs
and one is sold.
Chairman Erickaon gave a short resume of the previous rezoning of the
property. He said it was rezoned for this particular puzpose. The Co�niasion
ha$ been furn3shed with iniormation regarding taxation and service stations re-
latiag to other property. A study has just been completed relating to Special
Use Permit ot any property as well as the problem we may have oa thia property
as it relates to the communitq itself. They have al8o received information fro�
the Mianesota Yetroleum Council relating to the deus�ty of filling statioas.
Mr. Zeglen referred to the St. Paul Waterworks easement. Darre� Clark ex-
plained that any type of development that vould want to cross the easement
voald have to have a 6 inch concrete croesover. The capacit9 of the oil trucks
ie ,�0,000 pounda, Shell Oil has built alabs over existing main.
Mr. Youngdale aaid he was not prepared to ans�►er that specifically, but

Mx. Schmedeke said his thoughts were about the same as Mr. �eglen's. Ws
now have two service stations on the West side oi T.H. �47. Rezoning nvw wou�d
be spot zoning, though pxobably in its best form. At the last taeeting neighboYs
ver� preaent objecting and the Ctiurch objected, because of more traffic coa-
gestio�. With the Company�having two stations in cloae proximity, one on Central
Aqenue aad Qaborne Road and one at the car wash, consider�ng another Standard
�station that close doea not make sense'in his eyea.
Mr. Youngdale said agair. he wanted to say it is a tnatter of timing -- how
Che an�u�l budget is allocated. In this instanc�, he thought ef�orts were
�` d�.rected in not simply proposing to construct a Standard Station, but to incor-
porate a.planned land use contributing to taxes and many other things. The
pxoposed station has architectural arrsngement and treaGnent. It is very impor-
tan�, in his view, to make it a compatible thing to the City of Fridley. They
ate not here tonight solely askin� for rezoning and special use permit, but tbey
vere off�ring a suggestion ta the City of Fridley an ove�all plan use for land
naw being used and it would be campatible with the Spring Lake Park development
to the North.
The amount of land in the rezoning request is 1.8 acree, Which is the total
pareel at�d 1.0 aere is the amount of land in the Special Use Permit.

UTILITY FUND TO VARIOUS IMPROVEMENT BOND FUNDS
DATE: AUGUST 3, 1971
The attached resolution is similar to the one that has been
passed each year for the past several years. By adopting
this resolution, no tax levies would be necessary for any
of the improvement bond funds. These bond funds were for
the most part, in whole or in part, for the purpose of
financing improvements to �he Public Utility, Fund. Special
assessments were not levied at all, �r were not levied for
the entire cost of the improvement as assessments were not
levied for such things as wells, reservoirs, part of the
main line system, etc. The Public Utility Fund does have
sufficient surplus at the present time ta make this transfer.

WHEREAS, Tax levies have been adopted or transfers into Bond Funds are
necessary to provide the required amount of money in certain Improvement Bond
Funds,
NOW, THEREFORE, BE IT RESOLVED, By the City Council of the City of
Fridley, meeting at a special session on the 9th day of August, 1971 as follows:
1. That a transfer from the Public Utility Operating Fund to the
Waterworks Improvement Bond Fund W-75 in the amount of �49,271.00
is authorized for the purpose of eliminating the tax levy for the
year 1971, collectible in the year 1972.
2. That a transfer from the Public Utility Operating Fund to the
Waterworks Bond of 1970 Fund in the amount of $19,749.00 is authorized
for the purpose of eliminating the tax levy for the year 1971, collectible
in the year 1972.
�. That a transfer from the Public Utility Operating Fund to the

66. WATER AND SEWER ADP1INISTRATIOt�
66.01. The City Manager in the City of Fridley shall
have the responsibility of the management and operation of
the municipal water system, sanitary sewer and storm sewer
System in the.City of Fridley. He shall have immediate
control and custody of all properties, b� responsible for
their safeke�eping and their proper storage �nd care, and shall
provide for the keep�ng of a full and accurate record of all
wark done with respect thereto, the cost thereof, the names
af inen employed, hours worked and such other information and
records as may be required by the Ci�cy Council.

66.02. t�o person shall make any type connection to the
municipal water system or the sanitary sewer system or the
storm sewer system except upon making an application there-
for on a form provided by the City and receiving a permit
issued by the City for such purpose. The application shall
include an exact description of the property to be served,
the uses for which the connection is requested and the size
of the service lines requested or to be used. At the time
of making such application, there shall be paid to the City
the following fees which shall be apRlied to, paid for,
received by th� City for the purpose indicated:
66.021. No connection shall be made or continued in use
a�t any time with respect to any sewer or water connection
serving property if any person or occupants of the land,
parcel or premises affected have not paid or provided for
the payment of the full and proportionate share of the
systems, services or improvement to be used as determined
by the City Council, which share of the cost of said system,
ser.vice or impravement shall be payable as follows:

66.022. Prior to the constructing ar repair of any water
or sewer line connecting the existing municipal system and
arLy house or building for which the applicatio� is made,
the c�mer or contractor shall be required to obtain a permit
for�such connection, and shall pay a permit fee in the amount
ofi �10.0Q for any water cannection, and $20.00 for any sewer
connection. After such connection.has been made, the Water
m�d Sewer Department shall be notified. It shall,be unlaw-
ful �Co cover any connecting line until an inspection has been
made and such connection and the work incident thereto has
been approved by the City'as a proper and suitable connection.
66.023. Befi'ore any water conveyed through the municipal
water system'_shall be used Or utilized on the land or premises
of any person, firm or corporat�on, there shall first be in-
stalled a water meter that will accurately measure the water
consumed on the premises, except and unless such installation
s�ha11 be exempted by the City_. The applicant for water ser-
vice shall deposit in the City Treasury at the time of his
application for permit as set forth above, an amount determined
by the City to be sufficient to cover the cost of said meter.
Such money deposited will be used by the City to procure such
meter �nd the City may return the deposit tb the owner of
the premises thereaf ter in accordance with the regulations
hereinafter set forth.
