COMMENT: These letters have been sent out to the
Metropolitan Sewer Board and the industries in the
City of Fridley. City Engineer has talked to some

Special Use Permit for Crushing Rock within the Confines
of the Burlington Northern Railroad Yard Expansion Project

COMMENT: Normally a special use permit requires a
hearing unless the Council wants to consider this as
part of the total expansion yard hearing held
previously. The permit should provide safeguards for
existing residents.
16. Receiving Report Regarding Sidewalks at Corner of 67th
Avenue and Monroe Street
COMMENT: This is on the southwest corner of 67th &
Monroe. The road is scheduled to be improved in 1973.
It might be advisable to improve the road and sidewalk
at the same time.

Mr. Farr continued that �he new location w�ould not interfere v►ith the eas�ment
at all, but he.would sti11 need a 3' varianae. He plans on building a
16' X Z4' qaxage. The C�ty Enqineer said that Mr. Farr has diacussed his
plans with him, and he a�vised him to qet thm letters stating no objection
from the neiqhbars. The driveway to the park vrould be maintained. The
problem with tl�e presviou$ plan was that he would have to trespass on his
neiqhbor's land. CounciLnan I3arris asked him if ha planned on puttiaq in
a ha�rd surface drivevay �tnd Mr. Farr repiied yea. Councilman Breider

The City Assessox shawed the location oF the �rovement on the overhead

a sewer repair job on Ga�rdena Avenue that anwunted to $10,237.19, but that
amount is to be charged to the utility fund.
MOTION by Councilman Harris to close the public hsarinq on Impro�vement
Project #100. Seconded by CounciLaan Liebl for discussion.
Councilman Liebl asked the City Enqineer i� the prices a�e oousistant w�th
those charqed in other areas. The City Enqinee�r $aid theQe faciliti�s were
put in baasically to serve the Aaderson Developm�ent plat. There are already
facilities on the east side of Central so 100g had to be chasqed to the

CONSIDE�iATION OF AN ORDINANCE REGULATING THE LICENSING AND MANNaR O�F'
C�NDUCTING DANCES:
The City Attorney said thia Qrdinance was prepared at the request Af the "
Police Departn►ent and is quite similar to those other cammunities have.
Zt is built around the Sta�e Statutes and qivet� municipalities the authority
to requlate dances. He smid he would suggest the following changes: 4n
paqe+ 3, Section I�I, the last sentence could read: "An officer, or
officerg, the number to be appxoved by Council, of the law must be present
---". On Page 4, the Eirst paraqraph vould be changed to read: "--- �
upon conviction thereof sl�all be punished by a fine of not mor� than
5300.Q0, or impriaonment �or not more than 90 days, or botli"• He said this
prdinance was designeS to regulate public dances. There has been �aae
d'iscussion on.whether an Ordinance is necessary to regulate rock testivals,
but this Ordinanae was not desiqned for that purpose, and another one w�ould
k�e neaessary to cover them.
Gouncilman Liebl questioned the paraqraph in Section ZI where it states
the fees for one cAay is $10, for one week $20, for one month $50 and Eor one
year $1�0. He asked what about the businesses, or what i� a person wanted
to have a dance. The City Attorney said that for bu�inessea such as
Casirio Royale, they would pay the 5100 fee, and this Ordina�nce is meant
for public dances as defined by the State Statutea and would apply where a
�e� is charged. The fiqqrea ior fees used are those used in other comaunities.
Cou�c�.lman Liebl questioned Mhether the stipuiation that there n�ust be an
officer of the iaw prese�}t was not in conflict with, the rules set out in
the Police Manual. The Gity Attorney said he did not recall the stipulations
in the Folice Manual, and asked the City Manager to check it out to see if
there was a co�nflict. He added that this Ordinance would cover such dances
as tiie Knig'�ts of Columbus put on, the V.F.W „ etc., where there ia admission
charqed. It is not meant for neiqhborhood dances, achool dances, etc.
Councilman Liebl asked if the KCs wo�ld have to pay the $10 fee evexy time
they hana a dance. The City Attorney said that if an orqanization such as
the KGs have m�ny dances a year, they w�ould be better off to qet the year's
license for $100. Mayor Kirkhara suggested that to have an offices of the
law present, they ac�uld perhaps use a private aqency. The City Manaqer said
this r+as discussed at the staff aeeeting. There are reserve officer$ that
are sworn in and have police po�wers under the State, that are not City
emplAyees.
MOTION by CounciLaan Harris to table this item aad instruct tha Acbainistration
to research the Police Manual in regard to off-duty vrork, such as patrollinq
dances,
Councilman Breider said the City Attorney spoke of public dances, and asked
' how a publ3.c dance is d�termined. The City Attorney said it is deiined in
the State Statutes, but it could be spelled out aqain in this Ordinance to
save qoinq from on� reference to another. Mayor Kirkham said that he would
like to see �ome pXeliminary work done on an Ordinance to control rock
, �estivals. The City Manager said he would start vNOrk on one and added that
ae�ne p� the �omn►unities do have this type of Ordinance.

The City Engineer explained that the request is to realiqn Matterhorn Drive
through the Grace High Sehool property. At present there is a water main
a�nd an easement running through their property, and the roadway would be
nwved tQ th� westerly side of the property so the existing right of way
could be vacated. There �wauld have to be a 20' easea�nt for the water line
at the present right of way alignment. '

alonq Main Street wh�re Summit Gear Co. us�d to be. It is not a coamercial
lookinq buildinq, it ia more of a residential nature. It is a 6 stall
qarage and is in reasonably qood shape. He showed on the plot plan Mhere
thi�s temporarX buildi�g would be and said it �tould be west of the existinq
building. It is a wood frame building and w�ould be used for storage.
Councilman Harris askec� what w�ould be stored in the buildinq, Mr. Laren J.
Simer said it vrould be used ior storage of steel and excess parts of eomieyor
sy�tems that they want to store outaide their building rather than inside.

on the second shift. The City Attorney asked if it would be a seven day
week. Mr• Mc1�on�ld said it would be a five day week. The �aY�t MC��ld
said by that ;ne assumed there would be no hauling on Sunday
said no, not unless they came�back and asked pern�ission.
The City Enqineer said on Page 20 of the Agenda is a map �howing the areas
where the dumping is to be. This is going to be a fairly large project
with a lot of trucks rut�ninq on the City atreets and highways. He questioned
whether the p�rait ehould be qiven vith a tise lie�it to see if this v�ould
cause any traffic problem�� or inconvenience to other areas. They should
understand it could be revpked or withdrawn. Mr. biaDonald said if there is
an undue tra��ic hazard, they would expect that samething would have to be
done. t�tayar Kirkhaan caa�ented that the Council would have ti►e authority
to withdraw pEZmiS�iOn anyhow. The City Attorney suqgested that the permit
be given on that basis. Mr• McDonald coaaaented that the�e would probably

anticipated. H� would like to have �re time to work on this project
before the Gonaulting Engineers, Comstock and Davis, Inc,, suggest any
alternate methods o# ge�ting the work done.
Councilman Lieb1 asked a.�° the City r�oved the big p�le o� debris by the
lake, and asked ha�w it s�ot there. The City Engine�r said that material
co�lected by the normal �law of water froa� the creek cominq into the lake.
Th� City did clean the �haxe lirne and the area cl��e tc� the shoXe line and
it has`been hauled away at the City expense. Councilman Liebl asked how
many lpads it was; the City Enqineer said he did not know, but it was a
considerabie amonnt of m�,terial,
Councilman 8reider said he w�ould aqree with the City Enginoer. The Council
should receive.the bids and di�ec� the Ac�nini�tration to s�atudy the dam
project. He asked that the City F�nqineer re-evaluate this project to get
it comgleted, and point�d out that the abutting property awners were told
a cost fic�ure of $10,00p. The City Attorney added that dt the hearing
the estimate was approx�teZy $15,060 to repair and improve the d�m, with
the City to pay $5,000 fo� the repair and the remaining $10,000 to be
a��essed.
MOTION by CounciLnan Breider to receive the bids atid instruct the Ada►inis-
tration to re-evaluate th� bids Lo see what can be done to qat the project
completed within the estimated fiqure. He would also direct that if the
a�sessmiEnt portion of th� project exceeds $10,000 Ehat another public
hearinq.be held to apprise tt�e property owners of the chanq�a and the
reasons €or the changes. Seconded by Councilman Harris.
Mr. D.A. Schultz, 15 Rice Creek Way N.E., asked iF to satisfy Dr. Akbar's
problem, the $5,000 could not come out of general funds. Councilman
Hreider said he understoocl that in the earlier part of July there could have
been serious trouble with the dam. The Ci.ty Engineer said that accordinq
to Dr. Akbar the water level was vesy high.
CounciLnan Sxeider said that the Locke Lake Ho�meownzsrs Assxiation have met
and discussed whether.the people want�d the-lake. The queetion was whether
to do something tq the.dam to allaw the lake to exist for future years, or
try to get by for the present time. The $5,000 relates only to i�ediate
repai�s to the dam. He said his hope was that the Council can coanplete
the project to ensure that ihe dam remains there. He pointed out there has
been slow progrese made, some of the debris has been cleaned up and they
have gotten some of the industries to stop dumpinq into Rice Creek. He
haped they could w�ork with the coaanunities upstream, but it has to be taken
one step at a time.
Mr. Schulta said he could not see spendinq money on-a daai, which is qoinq to
bottle up nothinq but mud. He said he was eurpris�d at the a►dditional
amount of fill there wae in the lake just over the �,reek end. The lake
ahould be sAVed now or it will cost more later. It may be if you pzo-
crnsti,nate the lake cannot be saved. He said he called Anoka County and

tha,n with the lake. H� asked �f you are taxed on the basis of privacy,
whi.ch is more private? Councilman Harris said if he qot that ttnswer, it
was unfortunate. The law states that taxes must be based on the aiaY'ket
value of the home, and it ia not based on amenities. If there is a Setxi-
ment end conditions change, the market value will chanqe, thus taxes. but
th@y ,are only based on market value.
M�yor Kirkham said that nobody disagrees on the value of the lake. He did
not feel there was procrastination, or why the-continued interest in the
Rice Creek Watershed D�.strict? Mr. Schults said the colleetion of material
is not sand washing down from the banks of the stream, the n�jor cause is
conatruction within th� City of Fridley. The east side o# the trestle
looks nic�, and he wondered if the City had givsn con�idera�ion to cleaning
u� the other €�ide of the trestle now. He questioned how muei► ma►terfal has
washed down from construction work. Mayor Kirki�a* said there rn►s satse

the aame thing; that it is tha construction upstream from them that causea
their problems. You cannot satisfy the problems of Locke Lake until you

Mr. Schultz said it seemed that it would be an easY solution tro build same
kind of a catch point. Saaething could be conatructed to catch the silt and
sand that could be easily cleaned. Then it would not entail dredqing the
v�hole lake. Thero is a reason for haste. The material is apreading out in
i,,4cke Lake, so consider how much more would it coat to clean it up after
the material spreads out. Councilman Harrie said yes, it wau�ld ooQt less,
but if you curtail the flaw of the areek the sand and silt would pile up on
private pzoperty. He pointeS out there are areas on Rice Creek along the
eastern City limits thnt could possibly be used for control of the water.

whether they �speciiied footage or read to the Water line. The ownership
w4uld depend an how the individuals took �itle at �he time they bought the
pzoperty. Mr. Schultz said in his case he has about 40' into the lake. On
the adjacent piece of proparty it is owned down tp the water line. He
has been told that the ownership would follow that water line.
Dr. Akbar said that .�t seemed that the dam project is being poetponed, but
nod part of the wall is $a3ling down.�" He asked who wnuld be res,ponsible
if aoa�eon� is killed. Mayor Rirkham said the Council has received the
bids and turned them ovex to the Administration and they will be brought back
to the Council at some future meeting with a recommendation. The Council
ia not abandoning the project. The City Engit�eer added that it is his
department's revommendatinn that the repair w�ork on fhe dam be campleted
this �rear. As far.as the unprove�ent is cbncerned, where the abutting
haae owners wi11 have to be Assessed, he will try to w�ork with the con-
tractors to find a way �or them to do the work at a more reasonable cost.

ca�se the ci�m washed out. He eaid he would iike to continue w�orking with the

The City Manaqer said the bid opening for the City garage expansion was
this morninq and the bids received were quite favorable. As pointed out in
the recomanendation froip Mr. Patch, they were eubstantially below the architect's
estimates. He said prior to awarding the bids, there will have to be some
agreement prepared for workinq out the financial arranqea�ent with the Fridley
Fire Relief Association. He suggested tabling the �wa►rd and instructing that

Councilman 8reider asked how long the terms would be. The Finance Director
said 10 years. The City Engineer said the total contract price is $86,353,
but there is always some additional expense such as the architect's fees, so
for the purposes of setting up the agreement, he suggested using the round
figure of $100,000. Councilman Harris said there was a base bid and also
alternates. He asked what the alternates were for. The City Enqineer showed
the plans at the Council table and pointed out where the concrete floor
was in the plans. He sai.d there was also a qravel floor shown in one section
and the alternate provides for a concrete floor there also. The mechanical
alternate is for the extension of the drainaqe for the floor. aIe said it
was presented as an alternate because he did not want to go over the
budqetted amount, but upon reaeiving the bids, his recoumendation wpuld be
to include the alte�nates. He added that without the alternate the General
Contractor low bidder is Henning Nelson, but with the alternates, the co�abined
prices show Loeffel-Engstrand law bidder. Councilman Harris comQnented there
were 16 general contractvr invitations to bid sent out and 15�responses.
The City Enqineer said yes, there was keen intereet aha�n'i in this project.

he r�ould have to deal with. This has not been done on other Pm]ects
because for the most part the soil in'Fridley is sandy. Councilman Harris

The C�Lty Engineer said this report covers the rules and regulation$ pro-
posed by the Metropolitan �ewer Board. There is goin� to be a public
hearinq in the near future. There are a few items that the Council should
be aware pf as they may get reactions from some people. one caf their
requireme�t$ is that people with cesspools have to coruzect to a municipal
or mstropolitan sewer syetem within one year after the rules are adqpted.
Thie vaul.d involve quite a few people in Fridley. _
Counciiman Harris pointed out there are some areaa in the City where due
to the construction ot the a�rer lina in relation �o the street elevatiom;
there would have to be l�l�t stations, which w�ould be very costly. The City
Engi�nesr said he `wouid bring thie point to their attention. i�k�en we irulicated
Fridleg's concern at their budget hearing, they aaid they are trying to
control pollution. Another item of concern is that th�y are proposing an
individual can deal directly��with the Metropolitan Sewer B�ard for hooking
up �p a system, but he fsit that in a municipality such as Fridley, the
individual should w�ork throuqh the municipality. The Metropolitan Sewer
eoard ia also going to require an extensive testinq proqram for industrial
effluent goinq into the system. They are proposing �hat they would have to
submit a monthly report, bnt he felt that such a Dlanket rule w�uid not be
necessary. '
Councilman Breider pointed out on Page 5, Section 4�9 the costs are left
blank. The City Engineer said that would only apply if dealing directly
With the Metropolitan 3ewer Board. Councilman Breider said a� Pag�e 6 in
regard to mercury levels, it says, "None at levels acutely toxic to humans
or plant life". He felt that should be spelled out and that it t�ras an
amlaiquous �tatement. Councilman Breider also felt that on.Paqes 7, 8, and

The City Manager said that definitely, if you are going to consider traffic
controls, a four way stop w�ould be preferable to a siqnal. He would assu�
there would be soane cost sharing involved. He said it is a situation where
you must decide if you want to move the traffic alonq, or provide additional
safety.
Counailman Harris said that he has noticed�on the corner of 67th Avenue �and
Monroe, the children walking to Hayes School cut across the bou�evard area
and it is badly wor� dart�m, and impossible to maintain. He wondered if a
portion of sidew�lk could not be put in there. The City Enqineer said this
i.s part of the five year sidewalk program. Councilman Harris suqqested it
could bes made a part o� another project to get it in sooner.

It was pointQd out that if a resolution is passed, the CountX would.want it
this week. There was some discussion on whether they should recommend
reducinq the speed limit to 30 MPH, but the Council felt this might cause
the traffic to go down to Bennett Drive rather than travel on Mississippi
Street, and that would be no solution. They surely w�ould not want the traffic
on a residential street. Councilman Breider said that the advantage of a
four.way stap is that it could be easily removed..if it is found to aause
tra�iic problems. CaunciLnan Harris said in looking for safety at that
intersection, he felt a£e�ur way stop w�ould accomplish this.

installation of street surfacing and curb and gutter
qn West Moare Lake Drive and a portion of 58th Avenue.
The total cost of the improvement is $82,304.15. The
total amount assessed is $30,729.38. These are State
Aid Streefis abutting on residential property, therefore,
�he full cost of the improvement is not assessed against
the abutting property. The assessment rate is the same
as the assessment rate for adjacent streets done under
the ST. 1970-1 Street Improvement Project which were
done according to the normal City street specifications.

The ST. 1970-4 Street Improvement Project involves the installation of
' street surfacing, curb and gutter in two areas of the City. The first
area is the Onaway Addition which lies north of Osborne Road and west
af University Avenue. The second general area is a street running along
the westerly side of the Target Warehouse property and south of 73rd
Avenue, together with the surfacing of a parking lot for the Park
peparbnent in that general area.

that the costs have been computed separately for each street. The assessment
roll shows the combined cost for each of the separate improvements. such as
front street assessment, side street assessment and curb assessment. The

lay out all the steps and try tp put an estimate on the price of it.

had to be done again this would be an expense to the City.

Concernin9 your memo of August 12, 1971 relating to certain costs in
Ghanging precinct boundaries, etc., please see the answers as outlined
below: '
The estimated cost of changing precinct boundaries and records for
the redistricing plan is $2,500.00. This would include about
$700.00 worth of postage and necessary maps.
The specific steps that must be gone through ars as follows:
1. '�he set of voter registration cards that are filed by
address and would be used for the initial step. A
determination would have to be made whether the entire
� street or any part of it has been switched to another
� precinct or voting place. If it has, the necessary
change must be made on each indiyidual card involved
in that street, giving great care to the matter of
whether or not an address might be within or outside
�of the new precinct boundaries. This would be necessary
for every street and address within the City of Fridley.
After this is done, and this set cards filed according
�o the new Ward and Precinct boundary lines, the other
set of cards would have to be changed. This means, you
would get the name of the.person from each card file by
address, pull that person's name from the alphabetical
file, make the correction on that card and refile that
card in the new precinct file. Af ter all this has been
� accomplished, the persons who would have a precinct or
voting place change would have to be notified by mail.
In addition to this, there would be the cost of publishing
' maps, printing up necessary maps, and otherwise desseminating
information through newspapers and by whatever other method
is available.

legislative districts, you have two separate precincts.
The voters would have to be physically barred from
crossing from one area to another by a rope or some other
means, that is, you would have to prevent a voter from
getting his ballot in the ballot box for the other legislative
district. This means, also, that in the steps outlined
beforehand in addition to separating the cards into precincts
they would have to be separated into the two groups within
the precinct, just as if they were two separate precincts.
It would mean as an example, having in effect thirteen
rather than nine voting districts and an accompaning
increase in the number of judges. This increase in judges
would not necessarily be in direct ratio to the increase
in precincts, as some of the smaller sub-precincts could
get by with a smaller number of judges. As a practical
matter, it would be preferable that separate rooms or
separate parts of the building be used as polling places
for the people in the two legislative districts, as it
would be almost impossible to keep people out of the
incorrect ballot box otherwise.
2. The last general election cost $2,795.00 for judges and
$2,068.00 for all other help, including the work before
and af ter the election. If there were thirteen voting
districts, rather than nine,I estimate the cost of judges
could rise �o �13,600.00.

AN ORDINANCE TO AMEND THE CITY CODE OF THE CITY
OF FRIDLEY, MINNESOTA BY MAitING A CHANGE IN
ZONING DISTRICTS
The Council of the City of Fridley do ordain as follows:
SECTION 1. Appendix D of the Ci'ty Code of Fridley is amended as
hereinafter indicated.
SECTION 2. The tract or area within the County of Anoka and the
City of Fridley and described as:
All that part of the Northeast Quarter of the
Northwest Quarter of Section 11, T-30, R-24,
that lies East of the ceaterline of University
Avenue and North of the centerline of Osborne
Road, as said roads are now laid out and
constructed (1960),
Is hereby designated to be in the Zoned District
C-2 (general business areas).
SECTION 3. That the Zoning Administrator is directed to change
the offieial zoning map to show said tract or area
to be rezoned from Zoned District R-3 (general
multiple family dwellings) to C-2 (general business
areas).

Miss Jean Shrum and Mr. James Leidich represented the petitioner.
Acting Chairman Fitzpatrick informed the audience that the public hearing
was closed but no recom�endation was made to the Council. The City Attorney
was asked to give an opinion whether or not the City could permit nursery
schools in an R-1 District provided a special uae permit was approved. Iiis

^ Mr. Zeglen stated he had driven by the Learning Center in Robbinsdale �C �
and he thought it was a nice looking building.
Mr. I.eidich �aid the building in Fridley would be architectural.ly the
same except it would be larger. The lots in Fridley are on the same level as
Target.
Darrel Clark added that the adjoining residents were not objecting to the
use, but had questione about the trespassers on the vacant lots between their
houses and the proposed building. He continued the utilities will come down
from the North, and the petitioner is prepared to petition Council for them.
Mr. Minish felt the day nursery and lesrning center was a reasonable use
of the property. The question before the Planning Commission was whether or
not a day nursery would be permissible under R-1 zoning, and that has been
answered by the City Attorney. The other concern was fencing Lots 1, 2 and 3,
but rather wait to see if, in spite of the proposed building, the trespassers
continued to use Lot 3 to get to Target, the stipulation of fencing Lot 3 could
be made a condition of the Special Use Permit., Mr. Clark said Chgt Mr. Herrin-
ger, owner of the property, would have to be contacted, and hopefully, would
agree.
MOTION by Minish, seconded by Zeglen, that the Planning Commission recom-
mend approval.of the �equest for a 5pecial Use Permit, SP #71�09, by Social
Dynamics, Inc. to construct and operate a day nursery and learning center on
Lots 1 and 2, Block 1, Oak Hill Addition under Section 45.052, 3, F, of the
City Code with the conditiion that the petitioner follow through on the petition
for utilities, and t1»t the fence be extended across the rear of Lot 3 to pre-
vent people cutting across to go to Target. Upon a voice vote, all voting aye,

Phillip J. 0'Loughlin, 5387 Altura Road: Mr. 0'Loughlin sa�d he was
speaking for his father. He said they owned the lot directly to the South of
Lot 16. He asked Mr. Reese where the buildings would be placed.
Mr. Reese said the house on the North half would be facing County Road fl,
and the bungalow on the South half would face Central Avenue. He said they had
not requested a lot split at this time. He said there would be no changes in
the elevation of the Noxth half.
Mr. 0'Laughlin said they would object to splitting of the lots and the
building of two double bungalows. He asked Mr. Reese what type of double
bungalow he planned to build.
Mr., Reese said there would be a three car garage for each unit, but they
had not ordered plans until the zoning was decided.
' Mr. Clark said that if the request were granted, Mr. Reese would have to
have an easement to be served by water from 69th Avenue. Chairman Fitzpatrick
asked for area requirements. Mr. Clark answered that the lot ia large enough
' tQ split. It is more than 20,000 square feet making 10,000 square feet for
each double bungalow. The area is sufficient to meet the requirements.
1 Mr. 0'Loughlin said that he would like to see plans of the proposed
buildings.
Chairman Fitzpatrick explained that the application is a rezoning
, request. If the rezoning were approved, they would then be building within
the permitted uses. The request will come up again before the Council.
, Mr. Reese said that it is a large lot and they did not feei they could
afford the taxe5 for the whole lot, and that was why they would build on half
until they could see their way clear to build another bungalow.

Mrs. Reese also added that they are buying the lot, and plan to build a
doubl� bungalow on the North end of the lot and they would be moving in and
renting out the other part. They hoped some day, with the t�es on the
whole lot being high, to split the lot and build a�econd bungalow, as they
did not anticipate being able to pay taxes on the large lot indefinitely. If
they didn't split the lot, it would put them in the position where they would
have to lawer the quality of the construction. To help them out with the
financing of the double bungalow, they might have to sell the second lot. They
did not plan to change anything on the lot, such as trees and elevation. The
lot adjoining on the East is on the same level. Mr. 0'Loughlin's lot is on
the South, and South of that is Rice Creek.

lot could be developed under R-1.
Ghairman Fitzpatrick said the MOTION was open for further discussion.
Mrs. Reese said that when they applied for R-2 zoning, they talked to the
peop7�e raho owned the neighboring lots. They told the owners of their intentions
and felt these people would be at the meeting if they opposed the request. Oa
the North is Medtronics and Onan's. The 0'Loughlin lot is between their
pzoperty and the park. They did not believe their plans would detract from the
neighborhood. In the listing of the lot in the local paper, it was stated that
the land could be zoned R-2.
Chairman Fitzpatrick asked how many single family residences were in the
close area. He was told nine. Then he asked how many were notified. Three
of them were within 300 feet and were notified.
Mr. Zeglen asked about the lots to the East, Lots 17, 18, 19 and 20.
Mr. Clark said these houses on 69th are older homes and are set back about 60
feet and a little more centrally located on the lot's. The owners have not
expressed any idea of splitting, and there are no easements on the South end
of the lots. They could be landlocked lots.

estate business, there will be very little traffic as far as the public is con-

� Mr. Axt Gearman, White Bear Lake, Minn.: He said that he owned the ��
adjacent property on the corn�r. He has been involved with the area fo� the last
four or five years with the.D�oon Corpor�tion a�,tempting to get a 1ot split. He
' owns two apartment buildinge right behind this parcel. If the whole corner
were zoned or developed like it should be, it would be one development. He did
not know what the proposed building would do to the rest of the property,
' whether it would increase or decrease the valuation.
Mr. Clark said the apartment houses were built when the Terry Addition
' was sti�l active, but the plat was never recorded. Council would like a plat
rather than a lot split. The whole area ahould be platted.
Mr. Gearman said that to put CR-1 zoning in the center o€ what is now
iR-3 property would detract from the whole area.
Mr. Girdler said Mr. Gearman's concern is that he would like the property
� R-3 for multipie dwellings. An office building of this size has been in resi-
dential communities and there were no complaints.
, Mr. Sheridan said that he believed that when this area was originally
platted, it went through and was approved by Council. It was the intention
of the Council that the lot would be split. fle found out now that Lots 3, 4
and S are not split as far as the City records show. It was split at the
' time of the sale and registered with the County. It would seeta to him eplitting
�.ots 3, 4 and 5 would be the logical way to proceed.
, Chairman Fitzpatrick aaid that the question of whether or not the lot split
request was denied does not apply to the rezoning request. This item will be
continued of necessity until the next Planning Commission on September 1, 1971.

connected with this property for seven or eight years with the people who tried
to reeord the plat. They had to give it up. Is there sewer and water on the
' street that goes in front (Hillwind)? He was told there is a watermain but
no sewer. The petitioner would have ta get an easement acros$ Mr. Iwin's
property to get to the sewer on Polk Street. If this rezoning request goes
� through, Mr. Iwin asked if it would be possible for the whole area to be rezoned?
It would be detrimental to the residential property.

Wyman Smith, Jerry Brady and Kenneth Isaacson.

Mr. Wyman Smith explained that he was before the Planning Commission on
behalf of Viking Chevrolet. The Comm�isaion was kind enough to rezone the
property on Univereity Avenue last spring. Since then they found out the Com-
mittee fram General Motors would not approve the location. In order to stay
in Fridley, this was the one thing he encouraged them to do. The Viking people
have signed an agreement for the purchase of this property where the Edison
flomes are. Mx. Toberman, who owned the Edison Homes, hae sold the company.
They are going to vacate the land and the lease will be terminated. Viking will
be able to make use of the existing building. Jerry Bradg and Ken Isaacson
have met with the City Engineering staff. There will have to be some upgrading
of the site requirements. �
Mr. Brady said the recomm�endations of the City Engineer for the black-
topped area on �he South would be some curb cuts for service areas and closing
in pr�sent blacktop. There would be no structural changes on the outside of
the building, but there wouid be some internally.

The improvements in the green areas were noted. Mr. Reese said that
attached garages or tuck under garages are better adapted to sloping land--
this land is leve�, so that it would be no improvement in this instance. They
now have 60 feet between structures. 7,'he sidewalks and doors are basically
the same circulation system. Dumpsters will be inside of the building and
refuse will be hauled away. There is a forty foot right of way along the East
side, which will be deeded over at the time of the building. They are allowing
for a future right o� way along the West side.
' Chairman Fitzpatrick explained that the City will have a slope easement
of 160 feet North on Rice Creek and the developers cannot build on it, but can
use it for density and the City would retain ownership.
, Mr. Reese continued that there will be trees around the homes. The homes
will be three bedrooms, full bath, full basement, no walkout, have individual
furnace and central air conditioning.

Darrel Clark explained that the preliminary plan before the Planning Com-
mission becomes the basis for the final plan after Council approves it. The
Commission now is to approve the arrangement of buildings, density and the units
for every 3,000 square feet and accept the layout.

- 9. DISCUSSION OF LOW SWAMP LAND NORTH OF 79TH BETWEEN UNIVERSITY AND BURLING-
TON-NORTHERN RAILROAD TRACKS:
Chairman Fitzpatrick said that the letter from Mr. Winston Jacobson dated
July 18, 1971 regarding this land came before the Park Commission. Because the
amount of the property involved is large, they felt whatever could be done
should be by the County Commissioners in conjunction with the City. The area is
too large and expensive, but it is the kind of thing they would like to preserve
for open space. Mr. Jacobson's concern was that he was afraid the City of
Fridley was about to dump Burlington-Northern excavation there. The area is
much more wild and populated with wild life than any other piece of property in
Fxidley.
Mr. Clark said that the City would have to give the land owner permission
to have fill dumped on the land. The land will be opened up with sewer and
water soon.
Chairman Fitzpatrick wondered if the City could postpone the land getting
fill.
Mr, Minish wondered if it would be permissible to make a recommendation
now to permit fill to be dumped in that area while the City contacts the
appropriate County Agencies for their recommendation. In the meantime, the
boundary lines should be set.
Mr. Clark suggested Main Street which runs about 1300 feet West of Univer-
sity Avenue and at the East edge of the park. This lan� is lower than the park
land and has peaty soil. Council's attention could be trought to the fact
that filling this land and developing it would be a los�, of wild life preserve.

Mr. Minish said he realized this is a late time to bring up the matter, ��
but something should be sent to the County for their permission and a resolu-
tion drawn up requesting the preservation of this land.

SUBJECT: GARAGE EXPANSION '
1. Councilman Breider had previously mentioned a concer'n
that if Fridley proceeded with the garage expansion and purchase of a ',
ladder truck it may be in a position of having to lay off employees or ',
cut back essential services. Also at that time the possiblity of a tax ,
freeze by the Legislature existed which has now, at least temporarily, ',
been removed. I am proceedinq with the preparation of the budget for
submission to the Council in a normal manner and not trying to "second '
guess any action the Legislature may take in regard to the tax limitatidn
which"it may impose on cities. It is doubtful that a tax package could '
be prepared prior to October 10, 1971, the date that we certifX the mill'
rate to the County Auditor. ',
2. These past two weeks, we have been working on the
budget and after reviewing same, I feel we will be in a position to
absorb the capital outlays items of tiie garage expansion and ladder
truck without a cut in services or personnel.
3. The total cost for the garage expansion is going to
be app�oximately 20� under anticipated cost. We calculate that const-
ruction costs, architectural fees and contingency funds to be $100,000.
This amount, plus i.nterest, will require a total annual payment of
$12,956.25 split up as Pollows: Park Department: 50�, Public Works:
37��, and Utilities: 12��.
4. In summary, Fridley is financially capable of
proceeding with the garage expansion. I would recommend the Council
direct us to proceed with making the necessary arrangements with the
Fridley Volunteer Firemen's Relief Association and have prepared two
resolutions for your consideration.

We would like to make the following comments regarding the -
proposed rules and regulations:

SECTION 4-2: Connection A lication - We feel that any person
nee ing a irect connection to the Metro Sewer line
within a municipality should apply to the City �nd their
application be forwarded to the Metro Sewer Board with
its concurrance.
SECTION 4-7: Time Limits - A 12 month time limit might be all right
in tie cases where people now being served by private
disposal systems can connect their properties by gravity
but, in cases where they cannot because of the elevation
difference and may require ejector pumps and lift
stations, additional time should be provided when
requested and concurred with by the municipality.
SkCTION 4-9: Connection Charges - No fees or charges are indicated.

will have discussions wit}i the municipalities regarding
these.
SECTION 5�3: Limitations On Discharges - There is no definite level
in�icate regar ing mercury, because of the ambiguity
of the rule it would be difficult to enforce.

SECTION 5-10: Industrial. Waste Anal sis - We feel that in some
cases mont ly reports might be unnecessary and in
' other cases it might be advisable to have reporis
more often then monthly. So, it might be more
appropriate to have the frequency for reporting
' established by your department, depending upon the
type of effluent and the need.

regulations to the different industries in the City for their
comments and reaction and we will forward these to you when received.

tracted the excavating and crushing of this material to Barton Cnntract-
ing Company.
We hereby request permission to blast and crush the rock on this site.
All precautions and safety measures relating to an operation of this type
will be observed. There will be a seismograph on the �te recording the
blasting operation. This work will be done by an independent testing
organization.

R�: Sidewalks On Monroe Street Between 67th Avenue and
Mississippi Street.
This item was brought up at the City Council meeting of
August 16, 1971. The improvement of the stxeets and sidewalks
i�nder our 10 Year Street Improvement Project and our 5 Year
Sidewalk Improvement Project is scheduled to be done in 1973
alar�g wi.th all Qf the substandard streets in the general area.
Most oi the substandaxd streets in the area were improved
in 1969 or eaxlier because of the desires of the property owners.
When we reviewed the area I talked with some of the property
own�xs and they showed a desire to have both streets and
sidewalks impxoved as soon as possible.
It is our recommendation that both sidewalks and streets
be done at the same time as:
1. it will avoid tearing up the general area twice.
2. it will make a savings in total cost.
I feel that the City Council should authorize a Public
' Hearing for the improvement and if the people want the improvement
we can build both facilities at the same time next year, otherwise
we will just build the sidewalks.
� Some of the costs involved are indicated on the attached sheet.
If the City bui�ds the streets and sidewalks together we can get the
cost of the sidewalks from State Aid Funds as Monroe Street is a
' State Aid street. If we do the sidewalks seperately the cost will
have to come from General Funds.

FORFEIT PROPERTY WHICN AS BEEN REPURCHASED
DATE: AUGUST 25, 1971 �
The attached resolution would recertify the assessments on tax
forfeit lots which have been purchased through the County Auditor's
office during the last year. The term of the assessment
recertification and the amount of the assessment is shown in the
resolution.
As you know, the City has a hold on the sale of all tax forfeit
lots in Fridley. I suggest the City release the hold on these
lots except for the ones the City has an interest in, providing
the assessments are paid in full at the time of the purchase.
The County does have arrangements for paying for tax forfeit lots
over a four year period. A minimum of $500 must be paid at the
time of purchase and a minimum of $500 must be paid each year.
This is an arrangment that is separate from the arrangement which
had been in effect on spreading assessments over a period of years.

WHEREAS, A hazardous condition was found to exist on Lots 15 and
16, Block 1, Riverview Heights Addition, otherwise known as 531 Fairmont
Street Northeast, and
WHEREAS, The awner of such property was given notice to abate such
hazardous condition, and
WHEREAS, The owner of the property did not abate such hazardous
condition and the City of Fridley under authority of Section 463 of
Minnesota Statutes did therefore abate the hazardous condition at a
total cost of $837.75,
NOW, THEREFORE, BE IT RESOLUED, That the City Clerk is hereby
authorized and directed to certify to the County Auditor for collection
over a one year period beginning with the taxes payable in the year
1972 the charges as listed below:

BE IT RESOLVED By the Council of the City of Fridley as follows:
SECTION 1. That the Council of the City of Fridley in the month of
August 1971 received f rom the City Manager a proposed budget of the City of
Fridley for the year of 1972, which proposed budget when examined evidenced
the necessity of an additional tax levy in excess of the City Charter
limitation.
SECTION 2. That the purposes for which such additional tax levy is
required include additional sums for the General Fund, additional sums for
Firemen's Relief, additional sums for Police Relief, additional sums for a
debt service on Parks, additional sums for a debt service on Civic Center,
and additional sums for contribution to the Public Employees Retirement Fund.
SECTION 3. That a public hearing be held before the City Council at
the City Hall at 7:30 P.M. on September 20, 1971 to consider this matter.
That a copy of this Resolution be published in the official newspaper of
the City on September 1, 8 and 15, 1971 to give notice of such Public Hearing.

Fridley to participate in the cost of a construction project located on T.H.
No. 47=156 within the limits of said municipality, and
WHEREAS, Said construction project has been approved by the Depaxtment
of Highways and identified in its records as S.P. No. 0205-24.

our Municipal State-Aid Street Funds the sum of

There were several items that the Office of Emergency
Preparedness did not allow reimbursement for in connection
with the 1969 Flood. The attached resolution would authorize
charging these items to the Utility Fund and the closing out
of the 1969 Flood Fund. A recap of the expenses and the
amount received from the Federal Government is as follows:
Total expenses incurred $113,237.49
Amount received from Federal Government 105,211.89
Not allowed $ 8,025.60
Less interest earned 5,457.78

A RESOLUTION AUTHORIZING CHARGING CERTAIN EXPENSES TO THE
UTILITY FUNA AND AUTNORIZING THE CLOSING OUT OF THE 1969
FLOOD DISASTER FUND
WHEREAS, Expenses in the amount of $113,237.49 were
incurred under the 1969 Flood Disaster, and
WHEREAS, The amount received from the Federal Government
totaled $105,211.89, and
WHEREAS, Additional interest in the amount of $5,457.78
was earned, and
WHEREAS, This leaves a difference of $2,567.82, and
WHEREAS, These expenses were primarily for engineering
services for utility repairs,
NOW, THEREFORE, BE IT RESOLVED, That $2,567.82 shall be
charged to the Utility Fund and the 1969 Flood Fund shall
be closed out.

The average response to General Alarms was down during
the month of July, due to several of the firefighters
being on vacation.
Thexe were four training sessions held this month, with
an average attendance of 18.75.
The regular business meeting of the department was held
Thursday July 1, with 29 members in attendance.
September lst is the 20th Anniversary of the Fridley
Fire Department. I appointed the Officers of the
department to act as a committee to arrange £or an
open house program open to the public.
� The�e are seven (7) men on the depaxtment who have completed twenty (20) years of
servie�. Five (5� of these wil.l be xetiring. They are Edward Ellis, Lester Chesney,
A2bext Faulson, Peter Viger and Leo Schroedl. A committee has been appointed to arrange
for a xeta�rement dinner.

At the business meeting of the department Asst. Chief Arthur Olson, Asst. Fire Prev, Chi�f
Edwarcl Ellis and myself repo�ted on the Conferences held at Bemidji.
A re�axt was given by Chief Aldrich in regard.to the speci£ications for the new aerial
truck.
� Fire losses for the month amounted to approximately $1,000.00. Most of the 2oss was due
to automotive £ixes.
