The area involves the Onaway 9ddition, lying Pdorth of Osborne Road and t�lest of

Comments:
The amount of this street assessmen� as prESently coraputed keeping the cost
of each street separately does not put the cost of Piain Street excessively
high as compared to other streets that have been assessed in the past or
that are being assess�d in 1971. This is true in comparing Main Street
with both residential and commercial areas (see Exhibit A on costs of streets
in other areas). The cost quoted at the improvement hearing for all streets
in the area was $14.?_1 per foot. The Engineer estimates that the contract
cost of installing the final ma� on Main Street nortti of 77th G?ay would be
$3�545 i£ doize at this time. t�]ith normal overhead costs, the total cost
would be about �4,?54. This would raise the total cost per foot for the
' street assessment to $1.5.30 including the final mat and curb and gutter.

c. This method would be hard to defend in court if soneone on one of the
other s�reets were to challenge the assessment.
d, It would set an undesirable preceden�.
Comments:
There have been circumsfiances similar �o thi.s in the past, such as 79th
Avenue, adjacent to the Riverview Hei�hts area, where the cost of the
street was assessed to the abuttin� property and caas not spread over the
entire area. Industrial property has been assessed at much higher rates
in other areas in previous years than is the case with tl�is section of
rlain Street. The Council would have to think of applying the same formula
to future assessr.ients.
4. Take the money out of General Fund or out of �he Sta�e Aid Revolving Account
for a portion of the cost of Main Street.
The advantage:
a. It ioould tend to lower the cost of the assessment on Main Street.
Disadvantage:
a. It is not in conformance with past City policy with respect to industrial
or arterial s�reets.
b. Other industrial streets in the past have been assessed at much higher
rates than this stree� is being charoed. 'there �vill be industrial streets
to be assessed in the future which will have as hi�h, or higher rates. '
If �he Council decides to pay for pari; of this street out of the General
Fund or some oi.her fUnd, it would almost be committed to do ttie saale for
other streets.
5. Determine what it caould cost to put the final mat �n the streets that are not -
no�i completed in the area. Add this fi�ure to the acttaal cost for all the
streets in the area for the purpose of determining th� assessment rate. After
the assessment rate is deternined, the streets where the mat has not been
installed would be given a credit in the amount sufficien� to pay for the current,
es�imated cost of this wor?c.
The advantag�:
a. All the streets would theoretically be treated the same and would have
the same assessment rate.
Disadvanta�e:
a. They would not actually have the same assessznent rate if the mat were not
installed in 1971.

It is evi�ent that a difference exis�s among the stre�ts in the area, not only in
such areas as street widths, but in areas suc}.i as the amount of peat that had to
be removed. It cost $b,000 to remove peat in the section of Main Street, north
of 77th Avenue. Nearly 11 feet of peat had to be removed.. �
My recomnendation is that the roll be adopted as originally prepared, keeping the
present costs of each street separate.

on a Franchise Ordinance. We are suggesting the date of October 12, 1971,
(Council Meeting on Tuesday because Monday, October llth, is a Holiday)
since Councilman Breider has indicated he will not be present at the Council

of the four school districts in Fridley and the Anoka County Library System
to discuss CATV with them and secure their comments regarding the prepara-

Television Conference sponsored by the Educational Research and Development
Council of the Twin Cities. Purpose of the conference is to discuss the
impact of cable television on educatianal processes and how CATV ordinances
can be written so as to best meet educational needs.

detennined to be necessary to borrow said amount for the payment of obligations

property by reason of ch� making of Street Improvement Projects ST. 1971-1

Manager. When said bonds have been executed and authenticated they shall be
delivered by the Treasurer to the purchaser thereof, upon paycuent of the purchase
price heretofor.e agreed upon and accrued interest w date of delivery and said

SEC. 11. The City Manager is hereby authorized and directed to file a certified
copy of this resolution with County Auditor of Anoka County, together with such
other infonnation as he shall require and to abtain from said County Auditor a
certificate that said bonds have been entered on this bond register.
SEC. 12. The bonds issued hereunder sllall be payable for Street Improvement
Projects ST. 1971-1 and ST. 1971-2 which is hereby created. The
Treasurer shall cause all monies received from the proceeds of said bonds, all
monies appropriated and transferred from other funds and all special assessments
for the improvements provided that if any payraent of principal or interest shall
become due when there is not sufficient money in said fund to pay the same, the
Treasurer shall pay such principal or interest from the general fund of the City
and such fund shall be reimbursed for such advances out of monies to be credited
to said fund when said monies are collected. A1.1 proceec3s £or said bonds except
accrued interest shall'be credited to the fund and used to p�y the cost of said ,
improvements.
SEC. 13. It is further provided that should it appear at any time that the monies
credited to said fund and provided for the payment of principal or interest on the

bonds when the sums become due are not sufficient to pay the same, that then the -
City shall issue further definitive improvement bonds as authorized and provided
in accordance with Minnesota Statutes, Sec. 429.091, Chapter 475, and that the
process of said further definitive bonds shall be first used to pay the principal
and interest as is then due and to redeem the temporary bonds issued thereunder.

SEC. 14. The City Council has determined that not less than twenty �e�c�:n� (2
of the total cost of said improvements will be paid by special assessments to be
levied against every lot, piece or parcel of land benefited by the said improvements.
The City hereby covenants and agrees that it will do and perform, as soon as they
can be done, all acts and things necessary for the final and valid levy of such
special assessments, and in the event that any such assessments be at any time
held invalid with respect to any lot, piece or parcel of land, due to any error,
defect or irregularity, or in any action or proceeding taken or to be taken by
the Council or any of the City Officers or employees, either in the making of
such assessment or in the performance of any condition precedent thereto, the
City and this Council will forthwith do all such further proceedin�s as may be
required by law to make such assessments valid and binding liens again.t such
property, and also shall take such further proceedings as may be required by law
to provide monies for the payment of principal and interest as the same fall due
on the bonds issued hereunder and��o provide for the redemption of the same..
SEC. 15. It is hereby determined that the collection of special assessments
and the proceeds of monies appropriated and transferred frcm other funds is
and will be in an araount of at least five per cent (5%) in excess of the amount
required to pay the principal of and the interest on said bonds when due and �
that no ad valor �n tax levy is accordingly required.
SEC. 16. The officers of the City and the County Auditor of Anoka County are
hereby authorized and directed to prepare and furniah to the purchaser of said
bonds and to the attorneys approving the legal.ity of the. issuance thereof,
certified copies of all proceedings and records relating to said bonds and to
the financial'affairs of said City, and such other affidavits, certificates and
inforcnation as may be required, to show the facts relating to the legality and
marketability of said bonds as the same appear from the books and records under
their custody and control or as ottierwise known to the, and such certificates,
cex'tified copies and affidavits, including any heretofore furnished, shall be
deemed representations ot the City as to the correctness of all statem�nts
contained therein. � •

A RESOLUTION RELEASING TAX FORFEIT LOTS IN THE CITY OF FRIDLEY
FOR SALE PROVIDING THE LOTS ARE NOT BEING HELD FOR CITY PURPOSES
WHEREAS, by letter on March 31, 1971 and April 7, 1971 the Anoka
County Auditor's Office was asked to withhold from sale all tax forfeit
lots within the City of Fridley and,
WHEREAS, it is the desire of the City Council of the City of Fridley
to now release all tax forfeit lots for sale in the City of Fridley
providing the special assessments are considered part of the appraised
value and selling price of the tax forfeit lots and providing the City of
Fridley has not made a special request to hold these lots from sale as
they are needed for City purposes.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Fridley that the County Auditor's Office is hereby requested to place
for sale those tax forfeit lots in the City of Fridley which meet the
above criteria and are not needed for City purposes.

SUBJECT: OPEN SPACE APPLICATION FOR PARK LAND IN RIVERVIEW HEIGHTS
On your Agenda, at Councilman Breider's request, is an item directing
the City Manager to investigate the feasibility of preparing an Open Space
Application for Riverview Heights area which is subject to flooding.
The first step in this procedure would be to have a pre-application
� conference with officials of the Department of Housing and Urban Develop-
ment to review with them our proposed appli:cation plans and to see if an
open space application would meet the criteria for this Federal program.
Also, I would like to determine if HUD has Federal money to fund these
types of applications. If the preliminary indications look good for the
program, we would then begin the preparation of th� application for Council's
consideration. At some stage of this process you may want to consider
getting the review and comments of the Park and Recreation Commission
regarding this proposed plan. Also, if it looks favorable that HUD would
accept an application, I feel we should begin an intensive public relations
program to convince the residents of the area that this is the best solution
to the Riverview Heights flooding problem.
Enclosed for your information is a descriptivesta.tement outlining the
purpose of the Open Space Land Program.

TYPE OF PROGRA��I . .
Under tlie Ope�i Space Land Progranl, matchinb federal funds may be obtained for tiiF
acquisition of undeveloped land or developed land, if undeveloped land is not adequate,
sui[able for permanent open s�ace use. "Opezi space use" is defined as land �vhicli has
value for park and recreational purposes, conservation, scenic, or historic purposes.
For land acquired �vitt� open space grant assistance, a federal grant may also be avail-
able for development or making appropriate impro��ements. �� .
Types of inipi-ovements �vYiich could be eligible for federal assistance under this rr.o-
gram inclu�le: Roadta: ays and vehicular bridges necessary for circulation within the
area. Paths, paving, wal�.�vays, footbrid;es, bridle paths, and bicycle trails. Retain-
ing �valls, bulkheads, curbing, fencing, signs, and fi.�tures necessary for safety� mea-
sures. Basic utilities needed to serve�the area, including s�lnitar�• se�;�ers, storm.
sewers, and drai-n�� svstems, water lines anci �v�ter facili�ies_ and electric facili-
ties and li�titinj fi:ctures. Grading and landscaping. Fountaiiis and reflectinJ pools.
Basic recreational facilities and equipment having long-term usefuLness, i�cl�.rc'in�_
swings and jungle gyms; tennis; �handball, and basketball courts: baseball, soccer,
and football fields; and equipizlent for use by particular age �roups, such as rhe
elderly. Small buildings and structures such as rain shelters, Iavatories, and
equipment sheds. • Fireplaces for picnic areas, trash receptacles, benches, tlbles,
and ottler facilities and equipilient havin� lon�-term usefulness.

The planning agency sliould also have a�vork program for short-range (5-10 years) area-
wide open space pr.ograminj undenvay which includes sucti elements as schedule of
prio��ities, estimates of costs,and analysis of financing methods.
In metropolitan areas, there must be local comprehensive planning for the area in which the
pro��osed open space project will be located. Local plaiuiing must be coordinated �vith
the areawide comprehensive planning process, and a proposed pr.oject must be consis-
tent��vith the area�vide comprehensive planni.ng. An open space application is to be
revie�ved Uy the comprehensi��e planning agency and, if the applicant is not a unit of
local general government, by the unit of local general government in which a proposed
project will be located. Thirty days are allo�ved for revie�v and comment on an appli-
cation.

Eligil.�le costs �vhich may be included in computing a S0� grant for the acquisition of
undeveloped land include the cost of acquiring title or lesser interests, such as
development rights and scenic easements, that serve the purpose of preserving the
open space chara•cter of the land. Generally, the cost of demo2ition and removal of
improvements on predominantly undeveloped land may not be included in computuig a
grant.
A grant to acquire developed land in a built-up portion of an urban area may be made
only if it is detcrmined the open space use proposed cannot be provided by undeveloped
land in tlie same area. F.ligible costs for grant assistance could include acquisition of
tlie land and certain buildin�s and structures and demolition of inappropriate structures.
Up to 50� of land developmcnt or improvement costs may also be financed �vith an open
s�ace grant. The non-federal share may be provided in cash or in materials and
services �vilich easily can be appraised oi- valued for audit pur.poses.

APPLICATION PRIORITIES FOR DEVELOPED LAND PROIECTS
All applications submitted for grants under the Open Space. Land Program for acquisi-
tion of developed land in built-up urban areas, must me�t the follo�ving� requir.ements:
the proposed site (1) must not exceed four acres, or o�e city block; (2) may not con-
tain a structur.e exceeding $I00, 000 in appraised value; (3) must be cleared within
one year from the date of grant approval.
The follo�vinb priorities will be applied «rith respect to application funding:
�` First �r-iority. Sites located in older or low income areas ��vhere open space
shortages may be alleviateci only through acquisition and develapinent of
developed land. �� .
Secolld Priority. Sites which terrd to complement other �IUD assistance pro-
grams such as land adjacent to funded neighborhood facilities, or located in
code enforcement or rehabilitation project areas. .
Third Priority. Sites which may satisfy a specific need in areas �vhich may
othenvise not have inadequate open space facilities. �
Fourth Prioriry. Sites to be acquired for the provision �f malls, plazas, or
similar lo�v intensity use areas.
After June 30, 1967, applications for Open Space grant assistance must conform to the
referral procedures developed -in accordance �vith Section 20� of the Demonstr�.tion .
Cities and Metropolitan Development Act of 1966 (see page 12�. 1).
