This objection came from a property ocaner who owns property abutting on Main Street between 77th and 79th Avenues. Tho property in question is industrial propery and carries an assessment rate of $13.60 per front foo for the wbrk comPleted at this time, including the cost of the curb, The area involves the Onaway 9ddition, lying Pdorth of Osborne Road and tlest of rlain Street. Soreadino the cost of the improvement involves some problems because some of the streets do not have final mats, and some streets are complete. etc. ExaMple: Elm Street - 37' drivin surface - future mat and concrete curb and gu.tter needed Beech Street - 37' driving surface - future concrete curb & gutter needed Main Street (No. of 77th)- 37' drivinb surface - future mat and concrete curb and gu'.ter needed Right-of-coay costs on one side of street involved hlain Street (So. of 77th)-_37' driving surface aih some variations - future . concrete curb and guter needed Righi:-oF-oay costs on both sides of the street 77th Avenue - 37' driving surface - future concrete curb and gutter needed _Righ-of-way costs on one side of street. 1,000 charge for railroad crossinU. . 78th Avenue - 24' driving surface - temporary mat with credit to be alloaed when sorm seoaer and perman2nt street . installed. 79th Avenue - 44' driving surface - futur.e mat nd concrete curb and gutter needed There are several clays the cost oi this street improvement project could be spread. Among the possibilities are: 1. Keep thP cost of each street separate and assess that street as an individual ' iter.►saithout regard to the other streets in the area. The advantaes: a. The cost could be defended in court as it cari definitely be proved ttlat the amount assessed applies to that street and that street only. b, The construction of. ea,h of the streets varies sornewhat, as some of the streets have final cas and some do IlOt, some are different widths, etc. sa there are valid reasons for keepin the cost separately. Page 2 Street Improvement Project St. 1970-4 Street Assessment, Cnaway Addition Disadvantae: a. The assessment rate between streets in the area varies. - Example Cost of Present Jorl; with rb and Gutter $11.26 10.78 13.60 ' 19.41 14,82 6.18 13 .46 Street Beech Elm Main Street - Pdo. of. 77th Way Main Street - So. of 77th ,'ay 77 th t•Tay 78th Way 7:`th TIay _ - Comments: The amount of this street assessmen as prESently coraputed keeping the cost of each street separately does not put the cost of Piain Street excessively high as compared to other streets that have been assessed in the past or that are being assessd in 1971. This is true in comparing Main Street with both residential and commercial areas (see Exhibit A on costs of streets in other areas). The cost quoted at the improvement hearing for all streets in the area was $14.?_1 per foot. The Engineer estimates that the contract cost of installing the final ma on Main Street nortti of 77th G?ay would be $3545 i£ doize at this time. t]ith normal overhead costs, the total cost would be about 4,?54. This would raise the total cost per foot for the ' street assessment to $1.5.30 including the final mat and curb and gutter. 2. Group all the streets in the Onaaay Addition The advantages: I ' a. All the streets in the area would have an even assessment rate for not•. Disadvantaoe: ' a. The construction of the streets in the area varies in that some streets are wider han others, some are in different staes of cotnpletion, etc. so the • streets are not directly comparable. ' ' ' ' 3. ' ' ' b. This• type of assessment caould be harder to defe.r.d in court if someone did take us o court on the matter. e. The final cost of. the streets in the area caoUld still not be the same, as some of the streets must have additional work done in the future and would end up with hiher costs. _ Comments: The total cost of the street assessment at this time using this method, including..curb and gutter vauld be $12.65 per foot. Assign a certain share of the cost of Main Street to other streets in the area. The advan ages : a. It would tend to lower the costs of the assessment on Niain Street. ' J , ' ' ' ' ' - : Page 3 Stree Improvement Project St. 1970-4 Street Assessmen, Onaaay Addition Disadvantage: a. It would .raise the cost of other streets in the area. b. It would be entirely an arbitrary decision as to what part o£ tie cost should be assigned to some of the other streets in the area. c. This method would be hard to defend in court if soneone on one of the other sreets were to challenge the assessment. d, It would set an undesirable preceden. Comments: There have been circumsfiances similar o thi.s in the past, such as 79th Avenue, adjacent to the Riverview Heihts area, where the cost of the street was assessed to the abuttin property and caas not spread over the entire area. Industrial property has been assessed at much higher rates in other areas in previous years than is the case with tlis section of rlain Street. The Council would have to think of applying the same formula to future assessr.ients. 4. Take the money out of General Fund or out of he Stae Aid Revolving Account for a portion of the cost of Main Street. The advantage: a. It ioould tend to lower the cost of the assessment on Main Street. Disadvantage: a. It is not in conformance with past City policy with respect to industrial or arterial sreets. b. Other industrial streets in the past have been assessed at much higher rates than this stree is being charoed. 'there vill be industrial streets to be assessed in the future which will have as hih, or higher rates. ' If he Council decides to pay for pari; of this street out of the General Fund or some oi.her fUnd, it would almost be committed to do ttie saale for other streets. 5. Determine what it caould cost to put the final mat n the streets that are not - noi completed in the area. Add this fiure to the acttaal cost for all the streets in the area for the purpose of determining th assessment rate. After the assessment rate is deternined, the streets where the mat has not been installed would be given a credit in the amount sufficien to pay for the current, esimated cost of this wor?c. The advantag: a. All the streets would theoretically be treated the same and would have the same assessment rate. Disadvantae: a. They would not actually have the same assessznent rate if the mat were not installed in 1971. '. The streets are not all the sane, that is, not the sarne width, etc., so it may not be desirable to have the sarte assessment rate for the entire area. . l' .' ' ' , , , ' — ' ' ' Page 4 Street Improvement Project St. 1970-4 Street Assessment, Onaway Addition u - .. . 3 Disadvantage Continued: c. Some of the streets that are noa compleCe would end up paying extra costs for streets that are not noa complete. Er.ample: It costs more to do the partial street job as now done with a 12" mat and then coming in at a later time and instal2ing another 1" mat, compared to the cost of: doing the complete joh at this time with a?_" mat. Comments: Cost of work now complete in the Onaway Area: Estimate cost of completing curb, gu:r and street worlc: Elm Street $8,318.90 x 120i _$ 9,982.68 Beech Street b,694.30 r, 1200 = 8,033.16 Main Street, No. of 77th 10,20.00 x 120% = 12,288.00 Main Street, So. of 77th 5,836.00 x 120i = 7,003.20 7gth ti,Tay 5,343..90 x 1?_0% = 6,412.68 79th tiJay 6,079.10 x 120'Io = 6,079.10 77th 4?ay 3,04.45 Total addiional worlc $53,203.27 GRAND TOTAL $123,511.97 53 , 203.27 $176,715.24 $176,715.24 - 12,362' _ $14.30 per foot £or complete job of curb, gutter and street surfacino, etc. if done noo. Sunmarv and Recommendai:i_ons It is evient that a difference exiss among the strets in the area, not only in such areas as street widths, but in areas suc}.i as the amount of peat that had to be removed. It cost $b,000 to remove peat in the section of Main Street, north of 77th Avenue. Nearly 11 feet of peat had to be removed.. My recomnendation is that the roll be adopted as originally prepared, keeping the present costs of each street separate. The first step in this procedure would be to have a pre-application conference with officials of the Department of Housing and Urban Develop- ment to review with them our proposed appli:cation plans and to see if an open space application would meet the criteria for this Federal program. Also, I would like to determine if HUD has Federal money to fund these types of applications. If the preliminary indications look good for the program, we would then begin the preparation of th application for Council's consideration. At some stage of this process you may want to consider getting the review and comments of the Park and Recreation Commission regarding this proposed plan. Also, if it looks favorable that HUD would accept an application, I feel we should begin an intensive public relations program to convince the residents of the area that this is the best solution to the Riverview Heights flooding problem.
