AN ORDINANCE TO AMEND THE CITY CODE OF THE CITY
OF FRIDLEY, MINNESOTA BY MAKING A CHANGE IN
ZONING DISTRICTS
The Council of the City of Fridley do ordain as follows:
SECTION 1. Appendix D of the City Code of Fridley is amended as
hereinafter indicated.
SECTION 2. The tract or area within the County of Anoka and ttie.
City of Fridley and described as:
All that part of the Northeast Quarter of the
Northwest Quarter of Section 11, T-30, R-24,
that lies East of the centerline of University
Avenue and North of the centerline of Osborne
Road, as said roads are now laid out and
constructed (1960),
Is hereby designated to be in the Zoned District
C-2 (general business areas).
SECTION 3. That the Zoning Administrator is directed to change
the official zoning map to show said tract or area
to be rezoned from Zoned District R-3 (general
multiple family dwellings) to C-2 (general business
areas) .

PROPOSED DANCE ORDINANCE
On your Agenda for reconsideration is the proposed ordinance
regulating public dances. This ordinance simply implements State
Law in this matter. A report clarifying this matter from Chief McCarthy
and concurred with by the City Prosecutor is attached, as well as the
pertinent sections from the Minnesota Statutes on the regulation of
public dances.
The major change in the ordinance from State Law is that it imposes
a fee by the City to be collected for processing the permits for public
dances. As noted in M.S.A. Section 624.44, the permit is required, and
in Section 624.54 there is a requirement that an officer must attend all
public dances. It is proposed by the City Prosecutor that this be
specified in the ordinance as "a Peace Officer or Officers", rather than
"officer", since it is not known if officer means "sworn police officer"

Most of the requirements of the proposed ordinance would be enforced
whether the ordinance is passed or not. The matter of dance permit fees
is up to Council discretion both in terms of whether a fee is to be imposed,
and, if imposed, the amount of the fee. The fee schedule suggested was
based upon that used by a nearby community in an ordinance regulating public
dances.

I have attached a typewritten copy of the State Statute pertaining to
public dancing and dance halls.
Section 624.50 states very definitely that an officer of the law must
be present at all public dances and it states that the chief peace officer
of the municipality shall designate such officer.
Under the state statute a permit is required, but no fee is set.
In the proposed ordinance I submitted to you, we would be adopting the
state statute by reference and would be addinq the proviso for as many
police officers as the Council feels necessary and also set fees for the
dance permit, Which I feel necessary.

DANCE HALLS
624.42 DANCE HALL. A public dancing place, as the term is used in section�
624.42 to 624.54, shall be taken to mean any room, place, or space open to pub1ic
patronage in which dancing, wherein the public a�ay participate, is carried on and to
which admission may be had by the public by payment, directly or indirectly, of
an admission fee or price for dancing. A public dance, as the term is used in ti�ose
sections, shall be taken to mean any danc� a�herein the public may participate by
payment, directly or indirectly, of an admission fee or price for dar�cing, or a fee
for a mernbership in a club, and shall include any manner of holding a dance which
may be participated in by the pub1ic through the payment of money, directly or
indirectly. When used in sections 624.42 to 624.54, the term "ini;oxicating liquor"
and "liquor", "se11" and "sale" shall be given the same meaning, respectively, as
is rescribed in Laws 1919j Chapter 455, Section 1, and acts amendatory thereof.

624.44 ISSUANCE OF PER��ITT. In all cities, villages, and boroughs of this
state the permit must be procured from the governing body of the municipality;
provided, that in any county within which there no�v exists a city having a pepula-
tion of 225,000, or more, such permits may be issued only by the to�vn board of the
town within which such public dance is to be held, except �vhen the public dancing
place is owned by the municipality and the dance to be given or held therein is to
be given by and under the super�!ision of the public authorities of the municipality.
In all other cases the permit must be procured from the county board of the county
in which the public dance is to be held. Such permits may be issued for one or more
public dances or for a period of time not exceeding one year; provided, that in any
case where a permit for one single dance is desired, the to�+rn board of the to�•�n
where the dance is to be held shall have a right to grant the sam�, but any person
owning or operating a dance pavilion or dance hall in any such town ��h�.re dances
are regularT,� held during the year, or a part thereof, must make application for
such dance permit to the county commissioners; and, provided that this shall not
apply to counties having a population of 225,00, or more. The permit shall be
issued at a fee and under such conditioris as such governing body or countv bcard
may prescribe, not inconsistent µ�ith the provisions of sections 624.42 to 624.54;
provided, no such permit shall be granted in any organized town outsid� o�f the

organization t�rho are to give, hold, and conduct the same, the time and p1ace vr(�erc
such public dance is to be held, and the area o�f the dance floor where the danc� is

body or the county board shall fix the fee to be paid by the applicant for such
permit and shall direct the proper officers to issue the same upon the payment of th�
fee and upon payment of the expense of the investigation herein provided for in case
such investigation is made. The permit shall specify the names and addresses of the
persons to whom issued, the amount paid therefor, and the time and place where
the public dance is to be held. The permit shall be posted in a public place in th�
dance hall described therein during the time the public dance mentioned therein
is being given, and the persons namas in the permit shall be responsible under the
lat•r for the manr�er in which the public dance is being held and conducted. Such
permit may be acted upon at any special meeting of the governing body or county
board, whether included in the call for the special meeting or otherwise.

624.46 APPLICATIONS. All applications for such permits shall be made upon
blanks furnished by the city, village, or county, as the case may be, and shall be
accompanied by the affidavit of two freeholders and shall affirmatively shot�r by the
application and affidavits that the applicant is a person of good moral character
and reputation in the community in which he lives and that the applicant has not,
within five years prior to the making of the application, been convicted of a felor1y,
gross misdemeanor, or of any of the provisions of sections 624.42 to 624.54, and na
such application shall be granted to any person of bad character or 41ho has been
so convicted as aforesaid, nor to any person who is keeper of any disorderly house
of any kind, nor any place which has any director or indirect communication with
any room in which intoxicating liquor is sold, given away, or otherwise used, nor
for any place having any so-called "private apartmznts" or "private rooms" fur-
nished or used for any other than legitimate business purposes which adjoin such
dancing place or which may be reached by stairs, elevator, or passageway leading
from such dancing place. No permit shall be issued under the terms of sections
624.42 to 624.54 unless the governing body or county board is satisfied that the
place arhere the public dance is to be given or held is properly ventilated and equip-
ped with necessary toilets, wash-rooms, lighting fac�lities, and that such place is not
likely to becom� a public nuisance or detrimental to public morals.

624.47 IMMODEST DANCES PROHIBITED. No person shall dance, nor shall any person
to whom such permit is issued permit or suffer any person to dance in any public
dance ha11 any indecent or immoral dances or any dance which is characterized by
immodest motion of the body. No person shall in any public dance hall act or speak
in rude, boisterous, obscene, or indecent manner, nor shall any person to whom a
permit has been issued suffer or permit any person to so act or speak therein.

624.50 OFFICER P�iUST ATTEND ALL PUBLIC DANCES. It shall be incumbent upon
the person to whom such permit is issued to have an officer of the law present
at every public dance to be given or held thereunder during all the timz the
public dance is being held. Tn the case of a public dance to be held or given
in a city, village, or borough, such officer of the law shall be designated by the
chief peace officer thereof. In all other cases such officer of the lativ shall be
desginated by the sheriff of the county. In all cases the fees and expenses of
such officer of the law shall be paid in advance by the person to whom the permit
has been issued. In case any person, not a public officer, shall be designated
as such officer of the law, the person to whom the permit has been issued shall
be responsible for his acts and conduct and there shall be no liability for his
acts and conduct on the part of the officer designating him under the provisions
of sections 624.42 to 624.54.

624.51 HOURS. No public dance shall be held or conducted between the hours
of one o'clock and six o'clock a.m., of any day; provided, that no public dance
shall be held or conducted on Sunday during the hours preceding 12 o'clock noon
thereof. In all other cases the public authorities issuing the permit herein
provided for may, if they so desire, fix the hours within which public dances
may be held, not inconsistent herewith, and shall also have authority, by ordinance,
resolution, or by-law, to regulate or to prohibit the s,ame on Sunday, within the
limits of the city, village, or territory within which such public authorities
may grant permits for public dancing as herein providedv

624.53 REVOCA7ION OF PERhiIT. The governing body or town board issuing a
permit hereunder may at any time revoke the same and shall revoke any such permit
held by any person convicted of violating any of the provisions of sections
624.42 to 624.54; provided, any five or more freeholders residing in any village
having a population of not more than 1,000, or in any town, may petition such
town board or villaye council of any such town or village, setting forth that any
dancing place for wnich a permit has been issued is being conducted contrary to
law, whereupon it shall be the duty of such board or village council to hear and
act upon such petition within ten days after the same shall have been filed with
the town clerk or village recorder; and, in case any such petition shall be denied,
or not acted upon, within such time, then any five freeholders of such town or
villaye may file a petition with the county board of the county, setting forth the
facts. Thereupon it shall be the duty of such county board to hear and determine
such petition, and such permit if it finds that such dancing place has been
conducted contrary to la�v. It shall be the duty of the county attorney in each county
to er�force 1:he privisions of sections 62�.�2 to G24.54 and prosecute all violations

AN ORDINANCE REGULATING THE LICENSING AND MANNER OF CONDUCTING DANCES
THE COUNCIL OF THE CITY OF FRIDLEY DOES ORDAIN AS FOLLOWS:
SECTION I.
All public dances within said City sha11 be conducted in accordance with
Minnesota Statutes which requlate the conduct of dances.
SECTION II.
No person shall conduct a public dance unless he sha11 have first�obtained
a permit therefore from the City.
Fees for such permit shall be as follows:
� For_ Qne--d�r�-�3i3.Ofi; for one week $20.00, for one month $50.00 and for
_on��}ear-- $��0. 00.
� It is further provided that the Council may grant permits without charge,
when it is satisfied that the dance is non-profit or is the nature of a
civic undertaking.

• The verified application to the C1erk sha11 be upon blanks furnished by
the City. It shall state the name and address of the applicant or
orqanization. It shall state the location where the dance is to be held
and the size of the dance area. The applicant shall be required to
state if he has been �nvicted of a felony or gross misdemeanor within
the past five years.
The Clerk shaZl svbmit said application to the Council.
The Council may grant or refuse said permit in its discretion. It sha11
not grant a permit unless it is satisfied that the applicant is a person
of good reputation, has r�t been convicted of a felony or gross misdemeanor
for five years, that the location is proper and suitable, that sanitary
facilities are proper, and that applicant is capable of maintaining order.
SECTION III. -
The permit shall be posted in a visable place at said dance. The applicants
for said permit shall be held responsible for the manner of ctinducting said
dance. An offic�r_of.the 1aw must be present at a1Z times while said
public dance i's being held.

SECTION IV. '
Any person violating any provision of this ordinance shall be yuilty of a
misdemeanor, and upon conviction thereof sha11 be punished by a fine of
note more than $300.00, imprisonment for not more than 90 days.
Person means any person, persons, firms or corporations.
SECTION V.
This ordinance sha11 be effective on passage and pubZication acoording
to law.

AN ORDINANCE TO AMEND THE CITY CODE OF THE CITY
OF FRIDLEY, MINNESOTA BY MAKING A CHANGE IN ZONING
DISTRICTS
The Council of the City of Fridley do ordain as follows:
SECTION 1. Appendix D of the City Code of Fridley is amended as
hereinafter indicated.
SECTION 2. The tract or area within the County of Anoka and the
City of Fridley and described as:
Lot 5(except that part thereof lying West of the Northeasterly
right of way line of the outer drive of State Trunk Highway)
and (except that part thereof lying East of a line drawn from
a point in the North line of said Lot 5 distant 1505.96 feet
West from the Northeast corner thereof to a point in the
South line of said Lot 5 distant 1393.62 feet West from the
Southeast corner thereof) Auditor's Subdivision No. 25
lying in Section 24, T-30 North, R-24 West, City of Fridley,
County of Anoka, Minnesota,
Is hereby designated to be in the Zoned District known as
CR-1 (General Office and Liffiited Business).
SECTION 3. That the Zoning Administrator is directed to change the
official zoning map to show said tract or area to be rezoned
from R-3 (General Multiple Family Dwellings) to CR-1
(General Office and Limited Business).

Mr. Adolph Elasky was present.
� Mr. Minish explained that when the Board of Appeals heard Mr. Elasl�y�p
request for variances on September 21, 1971, the suggestion was made that the
entrance for the house on the South lot face Washington Street. That change
, would enable Mr. Elasky to build on the lots without requiring any varlance�.
The Board of Appeals tabled the request for that reason and also because Mr.
Elasky had a Lot Split application pending. Mx. Minish noted that Mr. �laeky
had changed the position of the houses on the lots on the sketch submitte�

Mr. Minish said that Washington Street is improved from 59th Avenue to
57th Avenue and eventually Jefferson Street will be. Unmarked 57th Avetiue �,�
alsv improved but it is not a full width street. Sewer and water are in thq
area.
The three lots are 40 feet in width and 129 feet in length. Chairmat�
Erickson said that if Mr. Elasky would put an attached garage onto tha ho1���
making an L-shaped structure, the sideyard requirements would be met, �AQ h�l
wc�uld have enough land to add a second garage later. There would j�� �q aaed
to apply for variances.

Mr. Elasky had no objection to an L-shaped structure and thought havin� &t�
' attached garage facing the street was a good suggestion because of the Winzera,
to be able to drive straight in rather than having a turn. His impression was
that the Ordinance restricted the use to not more than a single garage. Chai�'m�n
' Erickson said the purpose of the Ordinance was to build at least a single cax'
garage, but with the proper sideyard, it would allow the addition of another
car stall at a later date.
' MOTION by Minish, seconded by Schmedeke, that the Planning Commission
recommend to Council approval of the Lot Sp1it Request, L.S. #71-I0, Adolph R.
Elasky, to split Lots 9, 10 and 11, B1ock 4, Adams 5treet Addition into two
� building sites with the provision that the house on the North lot be located
10 feet from the South lot line and the garaqe be attached to the house in an
L-shaped fashion so that the entrance wi11 be directly from Washinqton Street.

Mr. Tonco asked that the minutes of the Septeniber 23, 1971 meeting be
corrected to read that the motion by White to approve the minutes of the
September 2, 1971 meeting be changed to Tonco.

1. CONSIDER�ITION OF A REQUEST TO CONSTRUCT A DAY NURSEP.Y TO BE LOCATED ON
LOTS 1 AND 2; BLOCK l, OAK HILL ADDITION THE SAME BEING 5310 MONROE STREET
NoE;, FRIDLEY, MINNESOTA; (REQUEST BY SOCIAL DYNAMICS INC , 4570 WEST 77TH
STREET, MINNEAPOLIS, MINNESOTA 55435.)
Mr. James A, Leidich, President of Social Dynamics, was present to present
the request. Mr.Leidich started his presentation by showing colored slides
of two existing facilities �n Bloomington and Robbinsdale.
The request is to build a similar buila-wng in Fridley. This wou]_d be a
5700 Sq. Ft. building with Texture 111 Redwood siding. The site would be
completely enclosed with a redwood fence.. The inside would be furnished
with furniture in tbv primary colors with all the floors carpeted. This
gives the school a warm and inviting look for children.
Mr. Muhich said he noted on the plans that the fence went all the way to the
lot line on 53rd Avenue. O�.a of the stipulations of the special use permit
the Learning Tree obtained was that they would continue the sidewalk that is
in at Target on 53rd Avenue. They can either put the sidewalk in themselves
or the City would put it in ��nd they would be assessed for it. Mr. Tonco
asked if that would change the 35' reqairement for setback but Mr. Muhich
said the set back would remain the same. Mr. Leidich �ei.d the state required
them to have 75 squ.xre feet of play area for each child but without the
additional five feet on 53rd Avenue they would still have more than enough
area. _
' Mr. Zeglen ashed him about the parking facilities. Mr; Leidich . said they .
have space for 15 cars. They will be employing about ten people and it has
been their experience that about 60 to 70�/ of their employees drive to

variance. The reason he needs a variance is because there is an apple tree

said this is a fairly large tree and he would hate to lose it.
Mr. Bailey continued he is planning on building a detached garage and then
corrverting his existing attached garage into a family room.
Chairman Minish asked haw much time would be imiolved for building the
proposed garage and corrverting the present garage.
Mr. Bailey answered that he plans on starti:tg the proposed garage this fall
and then starting the conversion as soon as possible after completion of
the garage.
Mr. Belisle stated both building pennits could be issued simultaneously which
; would give Mr. Bailey one year to complete both projecta.
Mr. Bailey stated he also asked for a variance to build a patio onto the back
� of his present garage. He did aot know how much of a variance he would need
as he did not have a survey but according to his approximate measurement for
' the proposed garage, the patio would be closer than 17� feet to the street.

owners on this variance which would state the patio would be jogged 6 inchee
in from the south side of the dwelling instead of using an exact measureme�t.

Mr. Nielsen has positioned the pxoposed garage so there is enough room to

WHEREAS, the City Council of the City of Fridley has studied and thoroughly
consi.dered the proposal for central dispatching in Anoka County as outlined in the
' minutes of the Commi.ttee on Central Communicatinns of the Joint Law Enforcement
Council of Anoka County, dated September 7, 1971; and

WHEREAS, after careful consideration of the proposal as outlined, we the City
Council feel it to be unsuitable for Fridley because of the following reasons;
1. The proposal makes no provisions for Fire Department dispatching
which is absolutely necessary on a 7 day a week, 24 hour basis.
This means that if Police dispatching was done on a central basis,
it would still be necessary for the City of Fridley to have dis-
patchers around the clock to handle fire calls. County central
dispatching then would mean a duplication of manpower because it
would not replace our need for Fire dispatchers.
2. During the hours proposed for central dispatching, it wouid be
difficult to train dispatchers to answer questions concerning a
particu�lar City's operation which are received from a citizen of
that City. A dispatcher handles many questions of information
themselves concerning City operations and other questions in
addition to their dispatching duties. In addition, it would be
difficult for any one dispatcher to have an intimate knowledge
required of the physical layout of all cities and county areas
and know all operating procedures for the various Police agencies
necessary to do a superior job of dispatching.
3. The proposal as outlined would have the effect of not utilizing our
present communications equipment. Although, it is commendable that
the County is applying for a Federal Grant to purchase the latest
and most sophisticated communication equipment, it appears uneconomi-
cal not to consider a system in which existing equipment can be
utilized:
4. Local autonomy and local service is being transferred from the
City to the County. Under a system of shared authority, it is
often difficult to fix responsibility. By placing the dispatching
under control of the Anoka County Sheriff's Department and 2eaving
the remainder of the Police activities under control of the City
Police Departments a system of shared authority is created. We
believe such a system limits the ability of the Fridley Police
Department to do its job.

5. The freque�cies assigned for the local non-emergency dispatch
calls appear to be too few, by having one for the north half of
the County and one for the south half of the County. This will,
in effect, jam up the airwaves delaying police response to
citizen's calls. '
NOiW THEREFORE, BE IT RESOLVED, that�for the above stated reasons, the City of
Fridley at this time does not desire to participate in central dispatching in Anoka
County. We commend the committee for their analysis of this proposal as we believe
new ideas should be constantly considered; however, in this case, we, the City Council,
are unable to agree with the conclusions of the committee; and therefore, decline to
have the City of Fridley participate in this program.

1971 ANNUAL CONFERENCE OF THE INTERNATIONAL CITY MANAGEMENT
ASSOCIATION
The 1971 ICMA Conference will be held November 7 to 11, 1971, in
Hollywood, Florida, with the theme of the conference being "Managing the
Modern City". This conference will bring together some 2000 City Managers
from the United States, Canada and Europe, covering such wide topics as
Executive Development, Urban Issues, Municipal Services, and the latest
developments in each of these. I believe the ideas and information
received in the exchange with other managers is an extremely important
element in.improving the professional capability to perform my duties.
I would, therefore, respectfully request that you authorize my attendance
at this conference. Sufficient monies are budgeted for this purpose.
During my aBsence from November 5, 1971 through November 12, 1971,
Mr. Marvin Brunsell, Assistant City Manager, will be Acting City Manager as set
forth in Resolution No. 232-1970 (Copy attached).

A RESOLUTION PROVIDING FOR TI-I� APPOINTM�NT
OF AN ASSISTANT CITY MANAGER AND PRESCRIBING
HIS DUTIES
�
WHEREAS, the functions and administration of the City Manager's
office requires assistance in certain areas during the normal course of
business in addition to the need for continuity of administration
during the City Manager's absence,
NOW THEREFORE, BE IT RESOLVED by the City Council of the City
of Fridley that Marvin Brunsell is appointed Assistant City Manager
and is authorized,empowered and directed to do all things that the
City Manager would be authorized to do by Charter, State Statute or
City Code during the absence of the City Manager, and is further
authorized to act for and on behalf of the City Manager on all matters
that normally come under the direction of the City Manager's office
as may be authorized by the City Manager during the Manager's presence.

BE IT FURTHER RESOLVED, that Resolution No. 80-1970 is hereby
repealed.

were changed in order to help eliminate some of the parking problems over at

lots in this addition be set aside for Tot Lot. Property has been red tagged
for park purposes.

w. Gift from Fridley Lions Club - Fountain, plus equipment received from the
• Fridley Lions Club, valued at $18,000.00. Fountain plus equipment was install�d

x. Gift from Shell Oil Company - Trees and shrubs donated from Shell Oil Company
were transplanted at Moore Lake Beach and Park, Madsen Park, and The Gommons
Park - Completed.
y. Viewcon Project - Commission personally reviewed area on foot and made specific
recommendations to the Engineering Department.
z. Dredging Moore Lake - Bids were received in respect to the dredging of Moore
Lake Beach Front. After further study and considerations, it does not become
necessary to dredge the front of the beach area.

wi11 be installed next Spring. Contract has been awarded. Lights donated by�
Fridley Softball Association has been installed. Additional poles wer� al�o
donated and installed. Black dirt for top dressing next spring has been
stoek piled by the Public Works Department. The entire park has been sesded,

f. Eisenhower Square Park - Park has received four (4) Rose Bushes from a GardeA
, CJ.ub Member. The park has been top dressed with rich black soil.. The plaAts
donated by Shell Oil were transplanted into the park. The area will be seeded
just before Winter sets in.
g, Erickson Park - Received $2,000.00 check from County. Dedication of Park will
be rescheduled for next summer.
h. Flanery Park - Truck drove through park and damaged fence while being chased
by Police. Fence has been repaired. No decisions have been made to date
on the $1,000.00 gift from Flanery Estate. Please make some suggestions,

j. Hackman Park - Apparatus has been installed. Trialer for park is still pending.
k. Jay Park - Apparatus has been installed. Curbing area will be completad thi9

private swimming pool installed. Football Association is using field for

q. Moore Lake Beach and Park - Park Benches will be installed along the shorslina
