business, but in addition, the Commission can affirm or deny the sale of trailere
on the same premises.
Mr. Schmedeke said that this seems to be the type of thing the Planning Com-
mission has been trying to prevent. He would be the last to deny the petitioner
the'operation of the station. To approve selling travel trailers would open
the door to used cars, motorcycles, two wheel trailers. He was afraid that what
they would be doing would be allowing each station to come in and start with
this procedure and eventually selling used cars and trailers out of the s�ationo
Mr. Clark said the petitioner had been selling the trailefs�� anSpecialiUss
came to our attention, he was notified he would have to app y
Permit.
Leonard Samuelson, former Councilman, said that he agreed with Mr. Schmedeke
and was on that side of the fence. Generally speaking, the service stations in
Fridley have insufficient land areas to dispense trailers. He thought that
suxiliary sales such as this does somewhat ruin the aesthetics of a service
station. It does not give a clean look he would desire for Fridley.
Referring to "covers" (camper units for pickup trucks) Mr. Minish asked if
the request is denied, did that mean the station cannot sell covers as well?
Mr. Clark said the Commission could limit what they felt could be sold in _
the open.
MOTION by Schmedeke, seconded by Zeglen, that the Planning Commission close
the Public Hearing of the request for a Special Use Permit, 5P �Y71-23, Dick's
North Star to sell recreational trailers on Lots 3, 4 and 5, Block 7, Ber1�n
Addition as per City Code 45.101, 3, N, and to recommend the continuing use o!
the Service Station, but to deny the addition of retail sales on the followi�g
qrounds: Service Stations are not permitted to sell travel trailers under the
Fridley Ordinance No. 483. Used travel trailers and used autos�are sold under
the same state license. Approving this permit could be the procedure to
encourage the sale of used travel trailers and used cars on service station
sites. Upon a voice vote, all voting aye, the motion carried unanimously.

fifty sale tags per day; in the winter about twenty to forty. They have four
full time employees and two employees part time, and the number increases in the

Block 5, Onaway Addition.

Darrel Clark said the application was brought in today together with the
signatures of almost all the people concerned. Mr. Houser shouldNorthwestern
release from Northern States Power Co., Minneapolis Gas Company,
Bell Telephone Co. and the owner of Block 5 to dedicate the other part of the
cul de sac for turn around on 78th Avenue. The North half of the land is vacant.
The petitioner will either sell or build. The Southern half is occupied.
Access is on 77th Way. The power line is on Gumwood and is overhead. Mr. Kouser
has built his own sewer -- one lot depth North of 77th Way• The North half
of the block will be served by 78th Avenue. The easements for the Gas Company
and North Suburban Sanitary Sewer District are along the railroad tracks• The
huge 315 KV power lines�are also along the tracks.
The alley will be dedica[ed back to the City for utility easements. This
will prohibit the alley being opened outside of the land owners.
MOZ'ION by Minish, seconded by Schmedeke, that.the Planning Commission reCOAr
mend that the Council act favorably on the vacation request of SAV iY71-04, by
Edgar Houser, for the vacation of Gumwood Street between ���tW8linedfromh77�nue
and also the vacation of the alley running on Westerly proPe 9
Way to 78th Avenue in Lots 1 through 8, Block 5, Onaway Addition because it is
appropriate with the current development of the area, subject to the dedication
of the cul de sac on 78th Avenue at Western terminus and dedication of easements
for any existing utilities. Upon a voice vote, a1I voting aye, the motion carried
unanimously.

MOTION by Zeglen, seconded by Minish, that the Planning Commission recommend
approval of the Rezoning Request, ZOA #71-07, by Way Dar Land Corp., Wayne
Peterson, to rezone from R-3 (general multiple family dwellings) to C-2 (genez'a2
business area), Lots 23 through 30, Block 13, Xamilton's Addition to Mechani�s-
vi11e to construct a warehouse and sales office for a Little Dearborn, with the
stipulation that the second reading of the Ordinance be held up until the building
permit was given. Upon a voice vote, all voting aye, the motion carried unani-
mously.
� 4. VACATION REQUEST: SAV #71-04, EDGAR A. HOU5ER: Vacation of Gumwood Stt'eeC
between 77th Way and 78th Avenue and also vacation of the alley running
on Westerly property line from 77th Way to 78th Avenue in Lots 1 through 8.
Block 5, Onaway Addition.
Darrel Clark said the application was brought in today together with the
signatures of almost all the people concerned. Mr. Houser should also get a
release from Northem States Power Co., Minneapolis Gas Company, Northwestern
Bell Telephone Co. and the owner of Block 5 to dedicate the other part of the
cul de sac for turn around on 78th Avenue. The North half of the land is vacant.
The petitioner will either sell or build. The Southern half is occupied.
Access ie on 77th Way. The power line is on Gumwood and is overhead. Mr. Houser
has built his own sewer -- one lot depth North of 77th Way. The North half
of the block will be served by 78th Avenue. The easements for the Gas Company
and North Suburban Sanitary Sewer District are along the railroad tracks. The
huge 315 KV power Iines�are also along the tracks.
The alley will be dedicated back to the City for utility eas�enta. .This
will prohibit the alley being opened outside of the land owaers.

bonds were previously issued for these street projects.

BE IT RESOLVED By the Council of the City of Fridley, Moka County, Minne�ota,
as follows:
SEC, l. The total estimated cost of Street Improvement Projects ST. 1970-1,
ST. 1970-2 and ST. 1970-4 has been estimated at $400,000.00 •
SEC. 2. It is now estimated that the su� of $75,000.00 is currently
a�cessary to provide financing of the projects above noted, and it is hereby
deteimined to be necessary to borrow said amount for the payment of obligationa
now incurred and for expenses necessarily incurred in connection with the
construction of said improvement project.
SSC. 3. There is hereby created Street Improvement Projects ST. 1970-1,
'ST. 1970-2 and ST. 1970-4 which shall contain a construction accou�t
a� part thereof into which shall be paid all proceeds of tamporary bonds iasued
purauant to this reaolution and similarq subsequent resolutions, and out of

and interest when due on said temporary improvement bonds and on any definitive

and such fund shall be reimbursed for such advances out of monies to be credited

BE IT 1tESOLVED By the Council of the City of Fridley, Anoka County, Minnesota,
as follows:
38C. 1. The totai estimaced cost of Water, Sanitary Sewer and Storm Sewer
Imarovement Proiect No. 103 has been estimated at $340,000.00 .
SEC. 2. It is now estimated that the s� of $325,000.00 is curreatly
aecesaary to provide financing of the projects above noted, and it is hereby
determined to be necessary to borrow said amouat for the payment of obligations
now incurred and for expenses necessarily incurred in connection with the
construction of said improvement project.
sSC. 3. There is hereby created .Water, Sanitary Sewer and Storm Sewer

SEC. 6. Said bonds shall be payable from the 'P & I Fund of the following;

Water, Sanitary Sewer and Storm Sewer Improvement Proiect No. 03 but
the City further recognized its duty under the law, as provided by Sec. 429.091,
and cavenants and agrees with the purchaser and all holders fram time to time,
of said temporary impravement bonds, at or prior to the maturity thereof that it
will pay and retire such bonds and the interest thereon out of the proceeds of
definitive improvement bonds which ttie Council shall issue and sell at or prior
to the maturity of the temporary improvement bonds to the extent that the same
cannot be paid our of funds available in the P& I• Fund of Wdtel^, Sanitarv
Sewer and Storm Sewer Improvement Project No. 103 or out of other Municipal
funds which are properly aeailable and are appropriated by the Council for such
purpose. ,
SEC. 7. It is hereby dete�ined to levy apecial assessments against benefited

property by reason of the making of Water, Sanitary Sewer and Storm Sewer Improvement
�- Pro� ect'No. 103 and to levy ad valorem taxes, if necessary, to
produce �ums at least 5% in excess of the amounts sufficient to pay principal
and interest when due on said temporary improv �nent bonds and on any definitive
bonds to be issued as herein pravided, such apecial assessYnents to be placed
on the tax rolls at such time when said improvement projects have been campleted
or the total cost thereof has been d�termined.
SECyB. Said temporary improvecuent bonds in the amount of $325,000.00 ahall
be dencaninated Water; Sanitary Sewer and Storm Sewer Improvement Project No. 103
� Bond Series "A" shali be sixty-five (65) in number
and numbered from 1 to 65 inclusive, each in the denomination of $5,000.00
shall bear interest at the rate of �� per annum, payable semi-annually on

the names and addresses of the holders of said bonds insofar as such information
is made available to him by the holders thereof, for the purpose of mailiag
said notices. The principal and all interest on said bonds shall be payable
at Fridley City Hall, 6431 University Avenue, N.E., Minneapolis� Minnesota
55421.
SEC. 9. Said temporary improvecnent bonds shall be mimeographed and when ao
mimeographed shall have attached thereto an interest coupon which bond and
coupon shall be substantially in the following form:

Manager. When said bonds have been executed and authenticated they shall be
delivered by the Treasurer to the purchaser thereof, upon payment of the purchase
price heretofore agreed upon and accrued interestco date of delivery and said
purchaser shall not be obliged to see to the application thereof.
SEC. 11. The City Manager is hereby authorized and directed to file a certified
copy of this resolution with County Auditor of Anoka County, together with such
other information as he shall require and to obtain frora said County Auditor a
certificate that said bonds have been entered on thi:s bond register.
SEC. 12. The bonds issued hereunder shall be payable for Water, Sanitary Sewer
and Storm Sewer Improvement Project No. 103 which is hereby created. The
Treasurer shall cause all monies received fram the proceeds of said bonds, all
monies appropriated and transferred fram other funds and all special assessments
for the improvements provided that if any payment of principal or interest shall
become due when there is not sufficient money in said fund to pay the same, the
Treasurer shall pay such principal or interest fram the general fund of the City
and such fund shall be reimbursed for such advances out of monies to be credited
to said fund when said monies are collected. All proceeds for said bonds except
accrued interest shall be credited to the fund and used to p3y the cost of said
improvements .
SEC. 13. It is further provided that should it appear at any time that the monies
credited to said fund and provided for the payment of principal or interest, on the
bonds when the sums become due are not sufficient to pay the same, that then the
City shall issue further definitive improvement bonds as authorized and provided
in accordance with Minnesota 5tatutes, Sec. 429.091, Chapter 475, and that the
process of said further definitive bonds shall be first used to pay the principal
and interest as is then due and ta redeem the temparary bonds issued thereunder.

of the total cost of said impravements will be paid by special assessmenis to be
levied against every lot, piece or parcel of land benefited by the said improvements.
The City hereby cavenants and agrees that it will do and perform, as soon as they
can be done, all acts and things necessary for the final and valid levy of auch
special assessments, and in the event that any such assessments be at any time
held invalid with reapect to any lot, piece or parcel of land, due to any error,
defect or irregularity, or in any action or proceeding taken or to be taken by
the Council or any of the City Officers or employees, either in the making of
such assessment or in the performance of any condition precedent thereto, the
City and this Council will forthwith do all such further proceedings as may be
required by law to make such assessments valid and binding liens againEt such
property, and also shall take such further proceedings as may be required by law
to pravide monies for the payment of principal and interest as the same fall due
on the bonds iasued hereunder and to provide for the redemption of the same. '
SEC. 15. It is hereby determined that the eollection of special assessmenta
and the proceeds of monies appropriated and transferred fram other funds is
and will be in an amount of at least five per cent (5�') in excess of the amouat
required to pay the principal of and the interest on said bonds when due and
that no ad valorem tax levy is accordingly required.

SEC.. 16. The officers of the City and the County Auditor of Anoka County are':
hereby authorized and directed to prepare and furniah to the purchaser of sai�
bonds and to the attorneys approving the legality of the issuance thereof,
certified copies of all proceedings and recorde relating to said bonds and to
the financial affairs of said City, and such other affidavits, certificates d
information as may be required, to show the facta relating to the legality at�d
marketability of said bonds as the same appear from the books and records under
their custody and control or as otY►erwise known to the, and such .:ertiilcates,
certified copies and affidavits, including any heretofore furnished, shall be
daemed representations of the City as to the correctness of all statementa
contained therein.

under date of November 1, 1971 _
UPON Their initial issuance in accordance with the provisions of Minnesota Statutes,
