THE MINUTES OF THE REGULAR COUNCIL MEETING OF MAY 3� 1971
PLEDGE OF ALLEGIANCE:
Mayor Kirkham led the Council and the audience in saying the Pledge of
Allegiance to the Flag.
INVOCATION:
Father Chmielewski, St. William's Church offered the Ivocation.
Mayor Kirkham called the Regular Council Meeting of May 3, 1971 to
order at 7:35 P.M.

PRESENTATION OF AW11RD5:
Certificates of Youth Achievement were given to Steven Engelstad and Steven
Aurzada on becoming Eagle Scouts. The Council conuratulated the new Eagle
Scouts on their achievement.
APPROVAL OF THE MINUTES OF THE REGUL�IR COUNCIL MEETING OF APRIL 19, 197 L•
MOTION by Councilman Liebl to adopt the Minutes of the Regular Council Meeting
of April 19, 1971 as presented. Seconded by Councilman Kelshaw. Upon a voice
vote, all vota.ng aye, Mayor Kirkham declared the motion carried unanimously.
APPROVAL OF THE MINUTES OF THE SPECIAL COUNCIL MEETING OF APRIL 27, 1971:
MOTION by Councilman Harris to adopt the Minutes of the Special Council
Meeting of April 27, 1971 as presented. Seconded by Councilman Kelshaw.
Upon a voice vote, all voting aye, Mayor Kirkham declared the motion
carried unanimously.
ADOPTION OF AGENDA:
Mayor Kirkham added Item C under Communa.cations: "Petition From the Citizens
on Jackson Street" to the Agenda.
MOTION by Councilman Harris to adopt the Agenda as amended. Seconded by
Councilman Breider. Upon a voice vote, all voting aye, Mayor Kirkham
declared the motion carried unanimously.

Mr. A.L. Williams� 947 86th Avenue N.E., Building Plans:
Mr. Williams had been requested by the City Council at the Council Meeting of
April 19, 1971 to bring his building plans back for Council review when they

were ready. Councilman Harris asked about the Ordinance requirements for �
a garage. The City Engineer said that on substandard lots there is not a
requirement to build a garage, the only requirement a.s for a hard surface
driveway. He pointed out that if this is granted, it will be the first
permit without a garage this year. The Council studied the side yard
variances, and agreed it would be a difficult lot to put a garage on.
Councilman Kelshaw mentioned the possibility of a carport, but Mr. Williams
was not in favor of this. Councilman xarris asked how many sunilar lots
were left in the area and the City Engineer answered there were about a
half dozen in this area.
MOTION by Councilman Breider to approve the building plans and issue the
building permit. Seconded by Councilman Liebl. Upon a voice vote, all
voting aye, Mayor Y.s.rkham declared the motion carried unanunously.
Robert Schroer, East Ranch Estates, Permit for Swimming Pool SaleS :
Nir. Robert Schroer introduced Nlr. Andie Haugen who is interested in leasing
space from Mr. Schroer for displaying his swimming pools. Sales would be
conducted from a moveable building which would also be saleable as a
dressing room or cabana type building. Mr. Schroer said they were not
clear whether they would need a permit to sell swimming pools and also
whether a permrt was needed for the building.
Mr. Schroer explained 7ust where the pool sales would be located and said that �
the area would be landscaped. The Council studied the plan that was
presented. Councilman Harris said that this would require a special use
permit and he read the part of the Ordinance covering sale of inerchandise
in the open rather than in a salesroom. The City Engineer explained that
there is not a yearly license required, but will be a special use permit
covering a certain time limit.
The Council said that this would need a hearing before the Planning Com-
mission, and the Commission would ordinarily set up a public hearing
before the surrounding property owners, but as there are only a couple
of surrounding property owners, perhaps if they were willing to waive the
public hearing, it could go to the Planning Commission for their recom-
mend.�tion at their meeting of May 6th, and come back to the Council at
their meeting of May 10, 1971.
There was a discussion regarding the building that will be used. The City
Attorney said that he would really think this would be called merchandise
rather than a building as it is saleable, and will not be there pexmanently.
Councilman Liebl pointed out that each year Holiday puts up a temporary
building outdoors which does not require a permit. Councilman Harris asked
if the building would be removed after the season is over. Mr. Schroer
said that agreement with the swimming pool company was £or one year, with
a one year option. Councilman Harris felt that the Planning Commission
could set some mutually agreeable stipulations on how long the building
could be on the premises. The City Engineer said that he would work with '
Mr. Schroer to see if the waivers could be received from the other pro-
perty owners.

� The City Attorney suggested that to save time Item No. 9 on the Agenda,
"Request by Robert Schroes for Campes 5ales and Rental on Lot 7, Block 2,
East Ranch Estates, 2nd Addition" could be handled in the same manner, as
that will require a special use permit also.
Mr. Schroer informed the Council he has been approached by a company from
Roseville to sell and rent campers, Councilman Harris asked Mr. Schroer
if all items under his original permit have been completed, as normally the
Council would not issue any furthex permits until a11 things have been
taken care of. Mr. Schroer said that 10 or 15 more parking spaces are the
only things not in. Councilman Harris suggested he check with the City
Engineer on this.
The Counczl discussed tabling Item 16 on the Agenda, "Consideration of
Request by Shelter Homes Corp. to Locate Model Home Sales Center on Target
Pxoperty" to the next meeting also to give the Planning Commission a chance
to look at the request.
MOTION by Councilman Harris to table the special use permit for selling
swimming pools and the special use permit for selling campers requested by
Robert Schroer, and the request by Shelter Homes Corp. to locate a model
home sales center on Target property to the Council Meeting of May 10,
1971, so that the Plannxng Commission can review the requests at their
Meeting of May 6, 1971. Seconded by Counca.lman Breider. Upon a voice vote,
all voting aye, Mayor Kirkham declared the motion carried unanimously.

MR• DON NEUMAN, 615 IRONTON STREET N.E., AND MR. STEVE GRAVES, 620 IRONTON
STREET N.E., COMPLAING ON DOGS RUNNING LOOSE=
Mr. Neuman, 615 Ironton Street N.E., said that they have a problem in their
neighborhood with dogs running loose and they do not feel they are getting
any satisfaction from the Dog Patrol or the Police Department. He said that
most of the dogs are large and they are worried about the children, so
something must be done about it. He said that their area has a large open
field and the river which seems to attract the dogs.
Councilman Harris said that the Council has 7ust had a meeting with the B& E
Patrol President and they are talking about more than doubling the amount of
service.
Mr. Robert Schxoer said that he la.ved south of Mr. Neuman and he agreed thexe
have been a lot of dog packs around. Just last week a child had been bitten
by a dog. He said the Police Department had canvassed the whole area door
to door and had done a fine job in finding the dog.
Mr. Steve Graves, 620 Ironton 5treet N.E., asked if the owners were not
� required to keep their dogs leashed. Councilman Harris said that the Ordi-
nance requires dogs to be licensed and leashed or undex voice command at
all times. He said that B& E Patrol is picking up about 50 dogs each
month. Mx. Graves said that B& E has told him he could go along with them
any day he wanted to, but that was hard when you are working.

Mr. Graves said they had another problem in the neighborhood and this was a
lot of cars driving fast in the area, some without mufflers. Mayor Kirkham
said he felt that this was a problem all over and not �ust in this area.
He said that all the patrolling is being done that is possible, but you
have to admit that the Police cannot always be there on the spot. Mr.
Graves also said that there is a problem with children leaving books and
things on the roads forcing drivers into the other lane, also children are
sitting right in the street. Councilman Harris said that this was a
parental responsibility, and he thought the parents of these children would
like to know this is going on.
Mr. Richard Harris said that Dr. Dudley of the Veterinarian Clinic had a
good idea. He had suggested that every dog licensed in Fridley be tattooed.
The number could not be removed and could correspond with the registration
number for easy identificata.on of the owner. He said that out of 450 dogs
picked up in Fridley the previous year only al�out 30 dogs were reclauned.
He felt our present ordinance cannot be enforced, and the Council should
take another look at it.
Mr. Carl Paulson said he understood there was a new ordinance and he asked if
there is not a prwision for the City to hire an individual to do some work
on the situation. He said now that the cost of a license was $5 there should
be some money to hire tha.s person. Mayor Kirkham said that the Council was
doing some work on revising the situation. They are reviewing the contract
with the Dog Patrol Service to get better results. Mr. Paulson suggested
maybe a letter could be sent to the people informing them of the requirements
Mayor Kirkham said that this had been part of the discussion with the Dog
Patrol President.
MRS. MECH, 1315 66TH AVENUE N.E., PARK RESERVE BOARD BILL:
Mrs. Mech said she would like to discuss the Park Reserve Board Bill. The
Council has previously passed a resolution regarding this bill, and re-
affirmation of their previous action is on the Agenda as Item No. 26. Mrs.
Mech said she believed they had received a letter on this sub�ect from N1r.
Al Kordiak, County Commissioner. Mrs. Mech reminded the Council that she
and Mr. Jerome Hegstrom, Metropolitan Council, had appeared before them
several months ago, and at that t.une they had promised to go along with the
Rice Creek Nature Trail. She told of the lobbying she has been doing
before the Legislature on the bill. Councilman Liebl asked how much money
it will cost and how much would the City get in return. Mrs. Mech said that
we have been promised the Nature Center wha.ch is going to cost $200,000.
Councilman Sreider asked if this bill gave the Board the power of eminent
domain. Mrs. Mech said yes, except for homesteads. Councilman Breider said
that this was his ob�ection to the bill. He thought the Nature Trail was a
good idea, but he did not want someone else coming in with eminent domain.
Mrs. Mech said that the Board will not come in where they are not wanted.
Councilman Liebl asked if the money will be raised from sales tax or pro-
perty taxes. Mrs. Mech said that 2 mills can be levied, bu tthe property
tax would be a backup for the excise tax.
Mayor Kirkham said his ob�ection to the bill was that it provides for an
already appointed body to be the Park Board and it given them power of
eminent domain, and taxing power. This would be removing the power too far

, away from the local community. Councilman Harris said he agreed with the
Mayor, he was in favor oP parks, but we had suffered trying to work out a
fair and equitable sewage bill wrth the Metropolrtan Sewer Board and we did
not need any more taxing agencies working on that premise. He would rather
see us do it than someone else in a building downtown.
ORDINANCE #478 - AN ORDINANCE TO AMEND THE CITY CODE OF THE CITY OF FRIDLEY,
MINNESOTA BY MAKING A CHANGE IN ZONING DISTRICTS: COLONIAL SERVICE, ZOA
#71-02:
Councilman Liebl asked if the deed has been received by the City. The City
Engineer said that the deed had been received and filed.
MOTION by Councilman Breider to adopt Ordinance #478 on second reading,
waive the reading and publish. Seconded by Councilman Liebl. Upon a roll
call vote, Kirkham, Harrls, Brea.der, Kelshaw, and Liebl voting aye, the
motion carried unanimously.
ORDINANCE #479 - AN ORDINANCE AMENDING AND RECODIFYING CHAPTER 46 OF THE
FRIDLEY CITY CODE. KNOWN AS THE BUILDING ORDINANCE:
Councilman Liebl asked Dick Harris if he was aware of the minor changes made
in the ordinance by the City Council. Mr. Dick Harris said that while he was
on the Planning Commission he had missed one of the meetings at which this
� had been discussed, but from what he remembered some of the provisions in
the building ordinance are good, but some are very unnecessary, such as
having a stair hatch to the roof in a very small building. Councilman Liebl
said that basically it will be adopting the 1970 Building Code. He thought
it would make our requirements a little tougher and upgrade our commercial
and industrial buildings. Mayor Kirkham said the Council would be interested
in any constructive crrticism Mr. Harris may have to offer, and the Ordinance
can be amended at any time there are a.mprovements to be made in it. He
suggested Dick get a copy of it and look it over.
MOTION by Councilman Harris, with the thought in mind that chanqes can be
made to the Code if 7ustifications are shown, to adopt Ordinance #479 upon
second reading, waiving the reading, and publish. Seconded by Councilman
Breider. Upon a roll call vote, Harris, Breider, Kelshaw, Liebl and Kirkham
voting aye, the motion carried unanimously.
PROGRESS REPORT FROM NSP:
Mr. Warren Johnson from NSP brought the Council up to date on the progress of
the relocation of the transmission line. He stated that one section of the
Iine has been built from I. 694 and Main Street north io 61 Way. They ran
into a conflict wrth the railroad facility at 61st Way where the line will
cross over the railroad property, and they are working with Burlington
Northern on this. They have had five meetings together since he last reported
to the Council March 5, 1971. He said they are close to resolving the in-
� duction problem, but they cannot commit themselves to a date that an agree-
ment will be reached. This will have to be completely resolved before
energizing the line. Mr. Johnson was thanked by the Council for his report.

REPORT ON COMPLAINT REGARDING YARD FLOODING PROBLEM AT 6335 PIERCE STREET� �

The City Engineer drew the Co;mcil's attention to the letter in the Agenda,
that had been prepared to be sent to the propexty owners in that area,
offering them fill for their yards. He said that if the Council felt it
was satisfactory, it would be mailed to the residents in the area.
MOTION by Councilman Harris to approve the communication foT mailing.
Seconded by Councilman Liebl. Upon a voice vote, all voting aye, Mayor
Kirkham declared the motion carried unanimously.
DISCUSSION REGARDING ACQUISITION OF PROPERTY FROM ST. WILLIAM'S CHUiZCH FOR
TRUNK HIGHWAY #47 SERVICE ROAD DETACHMENT NORTH OF 61ST:
The City Engineer gave the Council a copy of a letter received from St.
William's Church dated May 3, 1971. He said that it is in regard to the
proposal worked out with the Church cammittee with several minor changes.
He read Item #7 which asked that the City pay the stun of $275 to the Church
for expenditures incurred in the appraisal of the property under discussion,
and ztem #10 which asked that the City pay all legal fees and other costs
for transfer of said property to City. Councilman Harris asked the City
Attorney if there would be any problems with Item #10 and the City Attorney
said no.
MOTION by Counca.lman Harris to change the figure in Item #6 which the City is �
to pay the Church for professional traffic £low survey to be made of Church
parking lot from $600 to $875, delete Item 7, and approve the agreement with
these changes. Second�d by Councilman Lie151. Upon a voice vote, all ayes,
Mayor Kirkham declared the motion carried unanimously.
DISCUSSION REGARDING ACQUISITION OF PROPERTY FROM SHELL OIL COMPANY FOR
TRUNK HIGHWAY #47 SERVICE ROAD DETACHMENT NORTH OF 61ST:
The City Engineer pointed out that in their letter, Shell Oil Company
suggests working out an agreement to resolve the deed, and the City can
proceed on that basis. The City has agreed to pay $23�250.00, and if they
comply with the conditions the City can pay the money.
MOTION by Councilman Harris to reaffirm our proceedings on the acquisition
of property £rom Shell Oil Company. Seconded by Councilman Liebl. Upon a
voice vote, all voting aye, Mayor Kirkham declared the motion carriefl
unanimously.
REQUEST TO BUILD GARAGE IN COMMERCIAL AREA� SY RICHARD BISTODEAU:
The City Engineer explained that Mr. Bistodeau owned a 60 foot wide lot with
a single family dwelling ancl he wished to put up a garage. Our ordinance
requires that non-conforming use cannot be expanded on, and his lot is in a
commercial axea. The Council looked at the plan showing where Nlr. Bistodeau �
wished to place the garage. The garage wa.11 be way at the back of his lot
and the dra.veway will come out on Main Street. Mr. Bistodeau explained that
he would like to build a garage to house his camper truck and boat and
trailes so people will not be aware when he is away. His home has been

� broken into once. Councilman Harris said there is no big commercial
development going in this area at present, and he felt the gentleman
should have the right to build a garage. Councilman Ltebl suggested
that the building permit state that this is not the proper zoning. The
City Attorney said that in effect the Council would be waiving the pro-
vision that you cannot expand on non-conforming use when they authorized
the building permit for the garage. He pointed out that if Mr. Bistodeau
wanted to sell for commercial purposes he ran the risk of possibly not
gettxng the money back that he has spent on the garage. Mr, Bistodeau said
that he realized this, but he planned on living there and needed this garage.
MOTION by Councilman Harris to authorize the building permit €or a garage
with the stipulation that the owner understands this is a non-conforming
use. Seconded by Councilman Liebl. Mr. Bistodeau acknowledged that he
understood this. Upon a vo.tce vote, all voting aye, Mayor Kirkham declared
the motion carried unanimously.
RECEIVSNG PRELIMSNARY PLANS AND COST ESTIMATES - ADDITION Tp CITY GARAGE:
The Acting City Manager introduced Mr. Patch, the archrtect, to the Council.
NLr. Hrunsell said that Mr. Patch has taken the requests submitted by the
Parks and Recreation Department and the Public Works Department and has
drawn up three proposals for adding onto the Crty garage in different ways.
The size of the addition has been cut from the original request. The Acting
� City Manager showed the Council the three plans and explained what would be
included.
Counci]man Liebl asked if it would be the same type of construction as
previously, and what the cost would be. Mr. Patch said that it would match
the construction of the existing building and that the preliminaxy cost
estimate was $16 per square foot. Councilman Liebl asked if the building
would be complete at $16 per foot. Mr. Patch said yes.
Mr. Dick Harris asked if this price would include landscaping, blacktopping
and all the other requirements the Council asks of other builders, or would
they be running hose from fire hydrants as they did before. He said that the
Crty paid $14 a square foot for the original building and had not gotten
all the floor poured. Mr. Harris felt that the new addition should be
cheaper than $16. The Council reminded him that these were �ust preliminary
cost estimates, and that the City does everything by bids, and it will be
awarded to the lowest responsible bidder.
Councilman Kelshaw asked if these plans would go before the Building Standards -
Design Control Committee. Mayor Kirkham said that the original building plans
had gone to the Board, but this would be 7ust matching the original.
The Acting City Manager said that the 1971 budget provides for the pre-
liminary plans. They have brought it be£ore the Council to get approval of
the concept so that final plans can be drawn and bids let this year, if the
� Council desires, so that it can be built in 1972.
Councilman Liebl asked the City Engineer if all the concrete has been poured
in every stall in the present garage. The Crty Engineer said yes. He
explained that this had been bid as an alternate on the original contract.

Councilman Harris asked the Administration if they could get information on
the cost of the original building per square foot, what was in the building,
what was not in the building and what is needed for the builda.ng. He said
they may want to consider additions to the existing building at this time.
REQUEST BY ROBERT SCHROER FOR CAMPER SALES AND RENTAL ON LOT 7� BLOCK 2�
EAST RAIQCH ESTATES, 2ND ADDITION:
This Ltem had been briefly discussed under the "Visrtor" section of the
Council Meeting and had been tahled to the Council Meeting of May 10, 1971
to give the Planning Commission a chance to review the request.
RECEIVING THE MINUTES OF THE PLANNING COMMISSION MEETING OF APRIL 21� 1971:
l. LOT SPLIT REQUEST, L.S. #71-05, WALKER AND CURRY: The Easterly 365
feet of the Westerly 740 £eet, Auditor's Subdivision #89, building
site for a 42 unit apartment.
The City Engineer pointed out the lot to be split on the map on the pxo-
7ection screen. He explained the owner w�shed to build a 42 unit building. �
They would like the lot split sub7ect to getting a building permit. The
petitioners showed the Council their plans at the Council table. They
said they need the lot split to get £inancing, and if their financing
falls through, they may have to ask £or di£ferent zoniny, as they are
having trouble finding financing fox this area.
MOTION by Councilman Kelshaw to grant the Lot Split #71-OS for a building
site for a 42 unit apartment, sub�ect to the issuance of a building permit.
Seconded by Councilman Liebl. Upon a voice vote, all votinq aye� Mayor
Kirkham declared the motion carried unanimously.
2. LOT SPLIT REQUEST, L.S. #71-06, STANLEY DAHLMEIER BY ROSERT BIGELDW:
Lot 7, Auditor's Subdivision #108, split in half for two building
sites.
The City Engineer pointed out the lot to be split on the map on the pro-
�ection screen. He said that there were no problems but they want the
petitioners to be aware that the lot, after it is built, might have water
standing on the south of the property. Mr. Bigelow was present and said
that they realized this. Councilman Kelshaw asked about the signature of
Mr. Dahlmeier on the lot splrt application as mentioned in the Planning
Commission Minutes. Mr. Bigelow said that he had the requested signature
and gave it to the City Engineer.
MOTION by Councilman Harris to grant the Lot Split #71-06 to make two '
builda.ng sites. Seconded by Councilman Kelshaw. Upon a voice vote, all
voting aye, Mayor Kirkham declared the motion carried unanitnously.

' 3. CONSIDERATION OF AN ORDINANCE AMENDING AND RECODIFYING SECTION 45.053
RELATING TO SIDEYARD REQUIREMENTS IN THE R-1 DISTRICT:
The purpose of this ordinance was to set sideyard requirements in an R-1
district to allow for future double garages. The City Engineer handed out
copies of the sketches studied by the Planning Commission. He read Section
1 of the ordinance which was the only change made in the ordinance. The
Council discussed what the minimum side yard requirements should be, and
how the section should be worded so that a double car attached garage could
be built without a side yard variance. The City Engineer said that it would
work if a minimum of 11 feet is set on the garage side yard and 10 feet on
the house sideyard o£ a 75 foot frontage lot with a 40 foot wide house. If
the house is narrower, the garage side yard requirements would be increased
accordingly up to 15 feet. The Council agreed with this.
MOTION by Councilman Kelshaw to request the Administration to prepare the
ordinance with sideyard minimums as discussed by the Council this eveninq
and bring it back to the Council for first reading. Seconded by Councilman
La.ebl. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion
carried unan�.mously.

� 6. REVIEW AND REEVALUATION OF EXISTING PLANNING NORTH OF OSBORNE ROAD AND
WEST OF UNIVERSITY AVENUE TO CITY LIMITS:
The City Engineer reviewed the six motions passed by the Planning Commission
concerning their recommendations on planning in the area north of Osborne
Road and west of University Avenue to the City limits.
Councilman Breider asked if the City still had plans for a signal light
at Riverwood School on East R�.ver Road. The City Engineer said that the
County has ordered this signal. The City Engineer said that the City has
had plans for this area since 1961, but because of the new developments in
the area, the information and data was given to the Planning Commission to
look at aqain.
Councilman Breider asked if there was some way to direct the traffic toward
University at the 79th Avenue crossing when it is opened. He wondered if
a crossing at 79th Avenue would decrease or inerease the traffic on East
River Road. The City Engineer said that traEfic is going to increase on
all roads through normal progress. He felt that the traffic will travel the
better facility in this area, which is University Avenue. East River Road will
not be as convenient because of the signals. If all the proposed signals are
added there will be 8 signals on East River Road from I. 694 to the north
border of the City.
' Councilman Harris wondered if there was room for some kind of construction
in the area of 83rd to direct traffic to University instead of coming
straight ahead. The City Engineer said that Burlington Northern has an
industrial plat before the Coon Rapids Council, and we have presented them
with the plans. We have suggested their right of way be connected to our

83rd. Councilman Harris said he was talking about the intersections where ,
the County has control. Perhaps this could be done by off-setting the
intersection at 83rd or 85th. The City Engineer said they have made
suggestions for the 83rd intersection. They have drawn up a plan and sub-
mitted it to Coon Rapids.
MOTION by Councilman Kelshaw to concur with the six motions as passed by
the Planning Commission. Seconded by Councilman Liebl for discussion.
Councilman Liebl said that he felt it was impexative to try to do what the
Planning Commission's sixth motion concerning having as many utilities
brought out ad�acent to University Avenue as possible. He said he would
really like to see as many utilities ad7acent to University as possible so
that the more valuable property will bear the assessment.
Dick Harris asked about the recommendation to do with a temporary ally
between Elm and Beech Street. Councilman Liebl read Motion 4 to him
recommending that 78th Avenue from Beech Street to Main Street not He
vacated and recommending a temporary surface from Beech to Elm Street.
Mr. Harris said that originally he had been opposed to it, but now he is not
ob�ecting as hard as before, although he felt the City would be putting some
pretty tough assessments on the property south of 78th Street and it is not
usable for anything. He thought if a request is made for a small building
between the creek and 78th, the City maybe could waive some of the require-
ments far parking ox something to make it easier on them. Councilman '
Harris said that whatever develops in that area does not preclude the City
from doing something. He said it is certainly within the realm of
possibility there could be a closed culvert.
UPON A VOICE VOTE, Councilman Breider voting nay, the motion carried.
Councilman Breider said that he would like to vote nay on the first motion,
but would concur with the rest of the motions. (See motion for reconsideration).
MOTION by Councilman Kelshaw to reconsider the previous motion concerning
the six motions passed by the Planning Commission. Seconded by Councilman
FIarris. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion
carried unanimously.
MOTION by Councilman Kelshaw to concur wrth Motion No. 1 by the Planning
Commission recommending that additional railroad crossings should go in a�
79th and 83rd Avenues, and reconsader eliminating the crossing at 77th
Avenue at the time when 79th Avenue crossing is opened. The crossing on
the John Hayes property and Ironton Street should be eliminated, and to
align the proposed slgnals on East River Road with 79th Avenue and 83rd
Avenue. Seconded by Councilman Harsis. Upon a voice vote, Breider and
Liebl voting nay, the motion carried.
MOTION by Councilman Kelshaw to concur wrth tfie remaining five motions as
passed by the Planning Commission in their minutes of April 21, 1971
regarding recommendations for planning north of Osborne Road and west of �
Oniversity Avenue to the City lunits. Seconded by Councilman Harris. Upon
a voice vote, there being no nays, Mayor Kirkham declared the motion �
carried unanimously.

The Crty Engineer explained that this request was to reduce the setback
from 100 feet to 86 feet and also requesting a variance on a driveway
location. The Board of Appeals recommended approval of the setback
variance with a stipulation that no driveway be allowed onto Osborne
Road and recommended denial of a variance for a driveway on Osborne
Road.
Councilman Harris asked if there will be all blacktop parking. The City
Engineer said yes. He said that Mr. Bonnett is doubling the size of his
building. He said he believed Mr. Bonnett was interested in gettinq an
address on Osborne Road, but he thought this could still be done with ingress
and egress on Baker Street. The Council discussed requiring all cars that
he is working on be parked south of the existing area rather than in the
parking lot. The City Engineer said this would be coming back to the Council
when they request a building permit.
MOTION by Councilman Breider to grant a setback variance from 100 feet to 86
feet with the stipulation no driveway be allowed onto Osborne Road, and to
deny the requested variance to reduce the distance of a curb opening from
an intersection as no driveway is to be in front of the building. Seconded
by Councilman Liebl. Upon a voice vote, all voting aye, Mayor Kirkham
declared the motion carried unanimously.

The Acting City Manager said that Shorty's Towing Service was the only
company that submitted a bid. He said the specifications were basically
the same as previously, and he reviewed the ba.d prices for the Council.
MOTION by Councilman Harris to award the towing contract to Shorty's Towing
Service. Seconded by Counca.lman Breider. Upon a voice vote, all voting
iye, Mayor Kirkham declared the motion carried unanimously.
CONSIDERATION OF PURCHASE OF PROPERTY AT 5951 3RD STREET: (LAPIDES ESTATE)
The City Attorney said that technically these lots were still R-2, 6ecause
when the Council rezoned this area, these lots were omitted, however, if
this went to court they would argue that the rest of the area was rezoned
� and the City did it so as not to have to pay the commercial price.
Councilman Harris asked what the original price had been. The City Attorney
said he believed he had asked for $17,000. Councilman Liebl thought that
$15,000 was a fair price considering what other lots have sold for in this
area. The City Attorney said he thought if they condemned the land, they

possibly could get it for less; however, when you add the costs for the
condemnation, he was not sure they would save that much, as he has not
done a study of the property values in the area. Councilman Harris felt
that the Council would be open to crrtiaism if they paid more than the
going market rate for the property. The City Attorney said that the City
would get right of entry once the papers were filed so condemnation would
not hold anything up. Mr. Eldon Schmedeke said he thought the house will
be in the way and something should be done as soon as possible.
MOTION by Councilman Harris to enter into condemnation proceedings to
acquire the property of 5981 3rd Street N.E., Seconded by Councilman Liebl.
Upon a voice vote, all voting aye, Mayor Kirkham declared the motion
carried unanunously.
REPORT ON STATUS OF CITY'S REQUEST FOR ACCESS PERMIT� T.H. #47 SLIP OFF
AT 60TH AVENUE:
The City Engineer said that the City had received a copy of an interoffice
memo in regard to the City's application to the State Highway Department
last year for a slip off at 60th Avenue. We still have not receive per-
mission, but this is to get permission going. The City Enqineer saa.d that if
Mr. Schmedeke could give the City a letter about his plans and what he has on
his property, and if he talked to the other businesses in tl:e area to get
letters in to be sent on to the State, we may be able to convince them that
there are enough commitments to open up the slip off. He explained that it
was not the local office but the Federal Bureau of Public Roads that has
control on it. Mr. Schmedeke brought forth a letter he had written to the
City Council that could be forwarded on to the Minnesota Highway Department.
MOTION by Councilman Liebl to receive the communication from Mr. Eldon
Schmedeke dated May 3, 1971. Seconded by Councilman Kelshaw. Upon a voice
vote, all voting aye, Mayor Kirkham declared the motion carried unanimously.
MOTION by Councilman Harris to receive the communication fYOm the Minne5ota
Highway Department dated April 21, 1971 regarding the slip off at 60th
Avenue. Seconded by Councilman Liebl. Upon a voice vote, all voting aye,
Mayor Kirkham declared the motion carried unanunously.
Mr. Schmedeke suggested that the City Attorney write to the people in the
area to get them to write letters to the Highway Department to help push
for this access. The City Engineer felt that too much pressure might hurt
the City's cause at this time, but this can be done later if the slip off
is not proceeding at all. The City Attorney said he would write to the
business people in the area asking them to write letters to the City, to
be forwarded to the Highway Department.
RECESS:
Mayor Kirkham called a recess of the Meeting at 10:10 P.M. The Meeting was

This item has been talked about briefly earlier in the Meeting during the
Visitor's section of the Agenda, under the heading "Robert Schroer, East
Ranch Estates". At that time it was decided to table this item until the
meeting of May 10, 1971 to give the Planning Commission a chance to look
at the request.

A➢DENDUM #3:
MOTION by Councilman Breider to adopt Resoluta.on #52-1971, with the condrtion
that any money spent on the temporary improvement will be credited toward
any permanent improvement of the storm sewer and roadways in this area.
Seconded by Councilman Harris.
There was a discussion on the aduisability of widening the xailroad crossing
at 77th Avenue because of the possibility of it being closed in the future.
It cannot be left as it is at present because previously only the north side
had been dedicated, but now the south side is being acquired also, so the
road will be put in the middle of the right of way. 77th Avenue cannot be
closed at this time because there is no street at 79th Avenue so that
crossing cannot be opened to replace 77th Avenue. The City Engineer said
that a street could be put in at 79th Avenue this year if the Council wished
as the utilities are in all the way.
THE VOTE, upon the motion was a voice vote, Counci]man Kelshaw voting nay,
Mayor Kirkham declared the motion carried.

was to direct the City Engineer to go ahead with the widening of the
crossing at 77th Avenue.

County Commissionexs through Commissioner Mike O'Bannon. Upon a voice

RESOLUTION #56-1971 - AUTHORIZING MULTI-EMPLOYER APPROACH WITH REGARD TO
POLICE AND FIREMEN BARGAINING FOR THE 1972 CONTRACT YEAR:
Councilman Liebl asked if this step will relieve the City Manager from
doing the negotiating himself and Councilman Breider asked if this would
relate to salaries only. The Acting City Manager explained that this would
be similar to the area wide negotiating done for the last 5 or 6 years in
the Public Works ➢epartment. An area wide committee would set salaries,
but local items would be settled locally. This would give a united
bargaining front.
MOTION by Councilman Liebl to adopt Resolution #56-1971. Seconded by
Councilman Harris. Upon a voice vote, all voting aye, Mayor Kirkham
declared the motion carried unanimously.

' Councilman Breider said that his concern was whether this was the exact
procedure he wanted to follow. He said thep were trying to impress upon
the legislators that Fridley is having problems with some of the things
they are facing in the legislature. He said that this is one tax bill, but
there are already so many tax bills before �he legislature right now, that
perhaps the Council should not go in favor of one tax ba.11, but �usti point
out that they are concerned about the taxes and other sources of revenue.
The Acting City Manager said that if there is a tax freeze, we will have
to have something else. Councilman Harris felt the Council should stand
up for one that is good for Fridley, and he felt thls one looked like the
x best one. Councilman Breider said that the school taxes are 700 of the
total, and he thought it would be presumptious on his part if he only
wanted to deal with the 10� rather than the larger portion. Councilman
Harris saa.d that the school people are working on proposals that will help
the school ta�c burden, and he did not think the Council should assume what
the school might think is best for them. He felt the Council had to look
� at what is best for us.

THE VOTE upon the motion was a voice vote, Liebl and Breider voting nay,
the motion carried.
There was a discussa.on on whether business and indu�try would pay as much
of the tax burden as they axe presently. The Acting City Manager said that
the proposed tax bill would allow a lower tax levy. The City would
receive almost as many dollars as with the property tax. Councilman Harris
said that the City mill rate would still apply to all property.
CONFIRMATION OF RESOLUTION #50-1971 OPPOSING SENATE FILE 1237 AND HOUSE
FILE 1678 WHICH WOULD AUTHORIZE CREATION OF A METROPOLITAN PARK RESERVE
BOARD:
MOTION by Councilman Harris to confirm the adoption of Resolution #50-1971
opposing Senate File 1237 and House File 1678 which would authorize
creation of a Metropolitan Park Reserve Board. (See discussion regarding
this bill under Visitor section of Agenda). Seconded by Councilman Liebl.
Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried
unanimously.

A. SAMUEL FINKELST$IN: VIKING CHEVROLET REZONING:
MOTION by Councilman Breider to receive the communicatlon regarding the Viking
Chevrolet rezoning dated April 27, 1971. The motion was seconded.
The City Attorney said that it was his understanda.ng that with this letter
and when the City receives the easement (and the forms have been sent to
them) Viking Chevrolet will have fulfilled the requirements as far as
publication of the ordinance. The City Engineer said that this letter
modifies their original letter. Councilman Harris asked if they will drop
the appeal when the property is rezoned. The City Attorney said it will
be dismissed, but not until the rezoning is completed. Councilman Harrls
asked what guarantee there was that they would not change their minds.
The City Attorney said that the rezoning is based on the dismissal.
THE VOTE upon the motion was a voice vote, all ayes, Mayor Kirkham declared
the motion carried unanimously.

� B. CITY MANAGER: POLICE PENSION FUND:
MOTION by Councilman Liebl to receive the communication from the Acting City
Manager dated April 23, 1971.
The Acting City Manager said that the reason he put this back on the Agenda
is because this would be the last chance if the Council did want to do
something about changing the Police Pension Fund, and �.t may be too late
already. He said the Police Pension Association does not plan to do any-
thing until they recea.ve their actuary from Hewitt and Associates, and tha�
will not be until the Legisl.ature is over, he is sure. Mr. Brunsell saa.d
that the Council will have a tax increase or a mill rate increase this next
year if they are gmng to meet the Guidelines Act. If there is a tax
freeze the City would really be in a bind. This could mean a quartez
million dollars out of some other operation of the City's budqet eventually.
Councilman Harris said that if they did not spend any of the fund, they would
not have to meet tkte Guidelines Act. The City Attorney said he felt that
this was the action that had to be taken. The Acting City Manaqer said that
the money budgeted in 1972 would have to be under the Guidelines Act.
Councilman Liebl asked if this would mean that under the Guidela.nes Act,
the County Auditor could force the Council to levy that amount. The
Attorney said that tha.s was correct. Councilman Liebl said he thought it
had been worked out at 21a for the City and 7% for the Officers. Mayor
Kirkham said that several of the men have said they thought they could go
� along with this as a temporary thing until the 1973 session of the
Legislature. Councilman Harris asked how difficult it would be to prepare
a bill for this session. The Attorney said that it was too late now. If
the Association did not change their By-Laws, the City could staxt action
in District Court to interpret the City's responsibilities. Councilman
Breider said he felt 210 was more than generous.
Mayor Kirkham said that the City has made their offer, the only thing to
do now is wait for the Police Pension Fund Association to reply.
THE MOTION was seconded and upon a voice vote, all voting aye, Mayor
Kirkham declared the motion carried unanimously.
C. PETITION #15-1971 FROM THE CITIZENS ON SACKSON STREET FOR A STOP SIGN
ON JACKSON STREET AND 75TH AVENUE N.E.
MOTION by Councilman Sreider to receive Petition #15-1971 dated April 28,
1971 and direct the Ca.ty Engineer to investigate the problem and report
back to the Council at the next meeting. Seconded by Councilman Liebl.
Upon a voice vote, all voting aye, the motion carried unanimously.
