SUBJECT: LOCKE LAKE DAM IMPROVEMENT PROJECT N0. 104
DATE: FEBRUARY 10, 1972
Costs incurred in connection with the improvement to Locke Lake Dam total
$19,339.02. Of this amount, $831.00 appears to be directly related to
�mpr vo �men of the City beach area and taking debris from the lake. This
leaves a net cost of $18s508.02. In my opinion as Finance Director, this
is the total cost of the improvement project.
I The original engineer's estimate of the cost of the improvement at the time
' of the public hearing was 15 310.00. At that time there was discussion of
the City picking up total costs in the amount of $5,230.00, which would
leave $10.080.00 to assess. The assessment roll for the public hearing was
I made up on the basis of a total cost of $15,310.00 being assessed to the
' property owners.

A revised cost estimate of $16,300.00 4ras presented to the Council on � ,
August 30, 1971. The Council authorized a transfer of $6,200.00 from the
Generai Fund at that time.
' It is rrly recommendation that the City Council authorize a transfer of
$831.00 from the Emergency Reserve to pay for the portion of the impravement
that is directly related to the Park Department, and lake dredging. This
' leaves a balance of $12,308.02 to assess, or $11,068.02 if the cost of
catwalk and extra fencing is subtracted from the total price and is charged
against the Emergency Reserve of the General Fund. �
In summary, there are three possible amounts the City could assess for this
improvement project:
The original estimated cost to be assessed in the amount of
$10,080.00 ; 45 lots = $224.00 per lot.
$11,068.02 ; 45 lots =$245.96 per lot, which represents the cost
after the expense of the extra fencing and the catwalk is subtracted.
� The gross cost of $12,308.02 ; 45 lots =$273.02 per lot.
In any event, a transfer of $831.00 to $3,059.02 will have to be made from the
Emergency Reserve Account of the Generai Fund to provide sufficient monies to
finance the improvement.

Planning Commission Meeting - Januarv 12, 1972 pak.- �
1. CONTINUED PUBLIC HEARING: PROPOSED PRELIMINARY PLAT. P.S. ��71-05, EDGEWATER
GARDENS, PLAT 2, BY SAM TEMPLIN: Being a replat of Lots 1 through 9, Block 10,
FridZey Park Addition.
2. CONTINUED VACATION R�QUEST: SAM TEMPLIN, SAV ��71-08: To vacate axisting �lley
. in Block 10, Fridley Park Addition.
Mr. Templin was present.
The Chairman said he recalled that the petition was continued to discuss a
possible land trade. �
Referring to the land trade, Darrel Clark said the lots to the South of Mr.
Templin's plat (Lot 1, 89'x142', and Lot 2, 88'x142', B2ock 7, Edgewater Gardens)
were tax forfeit. These Zots are being held by the County wno plaune3 to use
them as a fi11 for excess dirt. The City would have to wait for Mr. 0'Bannon to
get a release of the lots from the County.
Mr. Templin s�id that the City had asked him to inake a distinctly clear state-
ment of what he would consider as a fair trade. He felt he could not trade one
1ot for. one forfeit lot because of the price he paid for the property. He had
called the Village of New Brighton regarding building on lots which were platted
before the present regulations and he was told they consider any plat platted
a long time ago with small lots, that they allow construction on parcels that
contain 75% of the present minimum requirements or 60 foot frontage. He would like
to know the policy of the City of Fridley in this instance. Fridley Fark Addition
was platted in 1886 with nine lots. If he could build on smaller lots such as
using three lots to make two lots, he could try to see how it would come out.
TEiese lots would have a lot and block description and not by metes and bound�.
Ghairman Erickson suggestea platting into six, rather than five, lots and
swapping the North lot on an even basis could be considered. If Mr. Templin did
that, the Planning Commission would have to send the petition back. to the Plats &
5ubdivisions-Streets & UtiliCies Subcomanittee and the Parks and Itecreation Commissian
to make a determinatian whether that North lot cut do�m 10 feet would be adequate
for park purposes.
Mr. Clark said that if the two tax forf.eit lots were purchased, it would cost
the City so��where near $5,000 before givin� them to Mr. Templin. The assessments
on each lot are approximately $2,_ OOO�.n specials plus a possible charge of $500.00
per lot by the County for relinquishin� the8. �
� Chairman Erickson said that the City would be losing about 10 feet on the
second proposal.

Mr. Schmedeke said that Mr. Templin has been very cooperative trying to come
up with a solution of some type. It would seem the Parks and Recreation would
have to be the committee this problem should be sent to in order for them to see if
this is something they are interested in and give to the Plats & Subdivisions-
Streets & Utilities Subcommittee to study what kind of property would fit it.
' � Mr. Fitzpatrick said the land can be purchased as recommended by the Parks &
Recreation and O.K,'d by Council, and sometimes the Council just simply handles
this kind of transaction which does happen on occasion. .
' Mr. Templin said that this requ�st could be passed around for another year
and he still wouldn't know which way to go. He felt the City should tell him
what way he should work. He did not like to sit with the property. He did not
' know whether or�not the City had the money to purchase the lots or were interested
in doing so, but he would like to start building right away.

Analyzin� the financial end, Mr. Clark said it boils down to the fact that
Council would have to approve the transaction. For 10 feet, $5,000 is a pretty
expensive piece of ground. If the City does buy, we will then have to go along
with the 60 foot lots.
Chairmari Erickson said that, generally speaking, the City has only allowed
60 foot lots in areas that hav� other 60 foot lots. He preferred the original
, proposal over the second one because the lots in this area all exceed 60 feet.
Mr. Minish said that the Plats & Subdivisions-Streets & Utilities Subcommittee
�recommanded approval of the five lots and felt that 6Q foot lots would not be
�\` approved. The su�gestion made by Dar'rel Clark of appr`oving the request and red
tagging_Lot 1 would be workable and still allow the Parks & Recreation Commission
' an opportunity to reconsider this, give the City time to consider, and al?.ow Mx.
Templin to proceed.
Mr. Swetz felt the City should try to acquire as much land as possible for
park, and at the same time not hold up Mr. Templin.
Mr. Fitzpatrick assured Mr. Swetz that the Parks & itecreation is interested

vote against it. He said that he could see this type of questionnaire
fostering racism and bigotry. He said that he has entertained other races
in his home and he had a feeling that they would agree with him. Council-
man Liebl agreed also that the questionnaire should include all minorities.
�He said that he did not see that this type of questionnaire would stir up
any r�cism.
A Representative of the League of Women Voters said that as they looked at
the questionnaire, they had much the same feeling as the concensus of the
Council. They felt that there should be more romm for comments, and that
there should be a cover letter go out with it telling what the Human
Relations intends doing with the information. She also felt that there
should not be any signatures requested.
Mrs. Richard Pratt, 821 Rice Creek Terrace, said that the churches in Roseville
and New Brighton sent out this type of a questionnaire and she did not think
it aroused any strong feelings. She said that she would agree that the word
"minority" should be use3, and added that she understood that the schools
are also interested in this questionnaire.
MOTION by Councilman Harris to table consideration of this auestionnaire
and bring it back after the�Human Relations Committee has met again.
Seconded by Councilman Samuels�n. Upon a voice vote, all voting aye, Mayor
Kirkham declared the motion carried unanimotisly.
' x CONSIDERATION OF REGISTERED LAND SURVEY, GEORGETOWN APARTMF.NT AREA, MR.

The City Attorney introducted Mr. Sam Caplan, Attorney for M�-. Filister
� and said that Mr. Caplan, Mr. Filister, the City Manager and himself had had
a meeting some time ago regarding the registered land survey and the tr.affic
pattern. Mr, Caplan F�ould like to request that the regzstered land survey
' be considered as a separate item from the dedication of the land for the
roadway.

Mr. Caplan said that Mr. Filister purchased the land as one integrated piece
of land. The financing of it made it necessary to develop and finance it
in three separate phases. For the mortgage implementation it is necessary
that it be split up into three separate units. The registered land survey
was requested for this reason. The City Engineer then wanted Mr. Filister
to dedicate a street to this property. The registered land survey approval
was made contingent upon the street dedication. It is questionable whether
or not the Council's approval is necessary and it came about anly because
the Attorney General has stated that a Council should act on every redes-
cription of land. A semaphore should be installed at this intersection
without any other cars coming into the intersection. He said that this is
their belief, but they are not sure, and neither is the City Engineer,
therefore his suggestion would be to have an independent study made and both
parties agree to accede to the determination of an impartial third party on
the determination of the traffic pattern. If it is found that the road is
needed and will not impair the Georgetown development in any way, they will
make the dedication. He pointed out that the City is always in a position
to condemn the land. The only question is whether they voluntarily dedicate
the land and if the study shows that they should, they are willing to do so.

Councilman Harris said that somewhere along the line it must be in writing
that hir, Filister will agree to dedicate the land if it is f�und to be in
the best interest of the City. Mr. Caplan said that the quesi.ion s:iould be
if the intersection can reasonably take the influx of additional tra£fic.
The City Engineer said that they feel that there should be two signals, one
at 592 A�=enue and one at the Georgetown entrarice, 1he question should be
whether there should be two signals, or only o7e and where it should be
located. If it is shown that there is a need for two, there would be no
need of the dedication. Councilman 5heridan pointed out that the City and
County have been trying to eliminate left hand turns. If the signal went
in at 59� Avenue there would have to also be some type of service road. Mr.
Caplan said that this is what they wanted in the firs� place, but it cannot
be done because of the apartment houses in the way. Councilman Sheridan
pointed out that another consideration should be ho�a fa.r from I. 694 the
signalization would be. I-le said that speak.ing for hin�s�lf, he has always
objected to registered land surveys. There is no �,rovision for ar.y dedi-
cation of land for public use as there is in a plat.

block is owned by a different mortgage co;:�pany. The City Attorney as�ced if
this would affect more than one parcel. N�r. Caplan sai.d two, bu�c the fee
owner is the same. The City Attorney said that if the o�rners}�ip i•;as to be
in the hands of someone other than A4r. Filis�er, an agreenent iaas niade, but
Mr. Filister was no longer the fee holder of all tlie parcels, then t}�e
agreement would not be binding.
The City Engineer said that the signalization at Lhe I. 694 ramp and East
River Road should be ready to go in in the middle of tlie next �ear. T'he
intersection of the Georgetown apartments t�c?uld not be t}ie ideaJ. location
because of the proximity of I. 694. There i� now a siudy beinb made on
East River Road from I. 694 to Rice Creelc on the �traffic patterns by a
traffic consultant firm for the County. .
The City Attorney said that the concern of Mr. Filister is that the traffic
generated may be more than the signal would be able to handle. There may be
a concentration at certain times of the day. He said that the idea of the
third party determination is not a bad idea. The movement, concentration,
and number should be factors to be weighed.
Councilman Harris said that if the Council should see fit to approve the
registered land survey, then the Administration should set forth some sort
of criteria for Mr. Filister, and he should have to live up to it, depending
on the outcome of the studies.
The City.Engineer pointed out that the Minutes of the conversation are in
the Agenda, and since that time Mr. Filister has built the garages and they
were not built according to the plans submitted. Mr. Caplan said the reason
for this_was because at the time the comment was made that the City could
always condemn, and rather than lose an expensive building, the garages were
moved on his advice. •
The City Attorney said that as Mr. Caplan has promised to abide by the
decision of an independent third party, he did not feel that an agreement

would be necessary. He said that perhaps the consultant the County is using
would be adequate. I�tr. Caplan said in regard to the street, he would be
willing to sit down with the City Manager and the Ciiy Attorney, and after the
traffic study is made, the options will be evident and the__�will__abi.dg--b�--'
the determination.
Councilman Sheridan asked the City Attorney if he ever• got any comments
from the Registrar of Deeds concerning registered land surveys. The City
Attorney said that he had talked to the Registrar of Titles and they take
the position that they will not act on a�registered land survey un�il the
Council passes on them. He is satis£ied with �this registered land survey,
but will not act until the Counczl does. Council�nan Sheridan said that it
has been the policy of the Council to require platting and he considered
registered land surveys as a way around dedicating land for public use.

the Administration and the Filister pevplc to agree upon the guidelir.es for

VIEW ADDITION:
The City Engineer explained that this is the �ame land that was discussed
at the last meeting when a double bungalo�v was contemplai:ed . T'li� s is a
120' X 140' parcel, and they would like tc put a house., alor�� with a
large garage on the land. Mr. Leslie Tranby is � ro�fe�� by trade and would
liek to have the garage to store his truck and mat�i•ialG in, rather than
renting a garage somewhere else. They would like to ?;now if t;�ey will nave
any trouble getting a building permit before they purc}iase the lats, They
would be building a large home with an atcached gax•age ?vit�i tl�e detached
�garage in the rear. •
Mr. Tranby said that he planned on putting in a concrete driveway, His
truck is 1z tons. The attached garagz would be to the east, and the entrance
to the detached garage would be off 57th Avenue. It would be lZ' to 2' higher
than a normal garage. Councilman Harris asked if there would be any de-
liveries by semi. Mr. Tranby said perhaps four times a year there would be
shingles delivered. Councilman Samuelson corrunented that this would be more
like a warehouse and in that case you are talking about M-1 zoning. Mr.
Tranby said that this would be for storage only and there would be no work
done from his home. The garage is planned to be about 30' X 40'.
Mr. Carl Paulson asked if this is permissible. The City Attorney said yes,
if there is no visible signs of home occupation; it must appear as a home.
There must not be any scraps visible. Mr, Paulson wondered if there would not
be objections from the people in the area if they kneca what was b�ing con-
templated. He said that he could not see where this wou2d be compatible
with a residential neighborhood. The City Attorney asked if he felt that
this would be less desirable than a duplex, It is zo?ied R-2 now. Mr. Paulson
said that he felt that this would be a downgrading situation, and would not
be good for the neighborhood. He pointed out that there are garages available

SUBJECT; RESdLUTION PROTESTTNG 1972 SEWER BTLL FROM THE
METROPOLITAN SEWER DISTRICT
Enclosed on your Agenda is a draft of a Resolution con-
cerning the 1972 sewer bill. As you know, the City staff
and the Metropolitan Sewer Board staff have reached a tentative
agreement on the 1971 bill, and have tentatively agreed to make
a partial payment on the 1972 bill to July, 1�72. By this
time it is hope that the measurements of sewage flow and other
problems which are unresolved at this point will be res�lved so
that we can settle the 197? bill.
� The tentative settlement reached on the 1971 bill and
procedure for the partial payment of the 1972 bill must be
� approved by the Metropolitan Sewer Board and the City Council
prior to final resolution of the problem. The Metro Sewer Board
is considering this matter on their agenda o£ February 19, 1972,
' and I have tentatively planned to bring this matter back to you
at the Council Meeting of February 28, 1972. It_�s felt that
until this matter is finalized the City of Fridley should lodge
an official protest of the 1972 bill, so that if the matter of
' assessment of penalties for delinquency of the bill comes u,
that Fridley be on record as having an official protest in �

have entered into negotiations for the purpose of arriving at a

A RESOLUTION REQUESTING SCHOOL DISTRICTS N0. 11, 13 AND 16 TO CONSIDER
CHANGE OF SCHOOLS NAMES
WHEREAS, Anoka-Hennepin Independent School District #11, Columbia
Heights Independent School District #13 and Independent School District
#16 includes within its boundaries more than one municipality, and parts
thereof which include the City of Fridley, and
WHEREAS, The School Boards have heretofare named some secondary
, (Junior and Senior High) schools with the name of the municipality in
which it is located, and
WHEREAS, All of the students enrolled at these Junior and Senior
, High Schools are not necessarily residents of the municipality of �he
same name, and
WHEREAS, All the students residing in a municipality do not attend
secondary schools within that municipality, and
WHEREAS, These conditions create confusion in the minds of students,
other residents, and sports fans.
NOW, THEREFORE, BE IT RESOLVED, By the Gity Council of the City of
Fridley that the Board of Education of Anoka-Hennepin Independent School
District #11 be requested to rename Coon Rapids Junior High School and
� Coon Rapids Senior High School, the Board of Education of Columbia Heights
Independent School District #13 be requested to rename Columbia Heights
Senior High School and the Board of Education of Independent School
District #16 be requested to rename Spring Lake Park Junior and Spring
Lake Park Senior High Schools,
BE IT FUR?HER RESOLVED, That the new names chosen be selected in
consultation with community leaders from the names of natjonally famous
people, educators, early local pioneers or settlers, or Indian tribes of
local origin. �
