CHARTER TO VACATE STREETS A�1D ALLEYS AND TO
AMEND APPENDIX C OF THE CITY CODE
The Council of the City of.Fridley do ordain as follows:
SECTION 1. For the vacation of an alley described as follows:
That part of the existing alley in Block 10,
_ Fridley Park Addition lying South of the
Easterly extension of the North line of Lot 1,
Block 10 of said Fridley Park Addition,
All lying in the Northeast Quarter of Section 15,
T-30, R-24, City.of Fridley, County of Anoka,
- Minnesota,
Be and is hereby vacated except that the City of
- Fridley retains easements for drainage and utility
purposes over the portions of the alley herein
described and vacated.
SECTION 2. The said Vacation has been made in conformance with
Minnesota Statutes and pursuant to Section 12.07 of
the City Charter and Appendix C of the City Code
shall be so amended.

On Thursday, March 2, 1972, I had a meeting with the
, xepresentatives of U-Haul as directed by the City Council and I
suggested the following 7 stipulations:

1. That the trailers be parked on the Northeast corner of the
property (see attached map) and the parking area will be
at least 20 feet from the North right of way line. The
Northerly 30 ft. x 30 ft. space will be used for parking
trailers and the Southexly 30 ft. x 30 ft. space used for
U-Haul trucks.
2. The outlined area will also be striped to show the maximum
� area allowed for U-Haul trailer and trucking parking.
3. Plant 6 additional ma.ple or ash trees. 4 along the East .
property line and 2 along the North property line. (See
attached map)
4. The car wash would not be in business and the area around
it would be used �or parking.
S. The abandoned island on the North part of the pxoperty will
not be reused,
6. There will be no additional advertising signs advertising
U-Haul.
' 7. The permit will be granted only for the duxation of 1 year
from the date of issuance and it is renewable only after
approval by the City Council.

, They indicated agreement to the above stipulations. Additionally,
after reviewal of the station property, I would suggest that there
be additional stipulations rec�uired of them to clean up the outside
' area, especially tn.e car wash area and the area South of it from all
litter, replace all broken windows and provide proper garbage
storage and disposal arrangements.

He said that the Planning Couunission was a very important unit in the City �
of Fridley. He has been a member of several Subcommittees and also rhe Planning �
Commission and he fe�t the research work of these committees is necessary to ,
conduct Ci.ty Business. The City Council relies exclusively on the Planning Com- �
mission for the physical aspects of the City, and tteere are political involve- ,;
ments that concern Council decision. His proposal was that all of the Subcom- ;I
mittees under the Plannin� Commission report their minutes to the Planni� Com- �
mission. This is the purpose for having the chairman of the Subcommittees a �,
member of the Plannina Co�,mission. When you receive the minutes of the Subcom- •�
mittee, review and chsck and take action. If you do not agree with the recom- k,
mendations as passed, you turn it over to the chairman o£ the subcommittee and
he has the resgazsibility to return it back to the Subcommittee for recansidera- `}
tion. - 1
Councilman rlitteistadt continued that the petitioner should be informed
that sometimes these requests take quite a bit of time when public hearings
are inv�Ived and theg should allo�r for that and not expect to be taken care of
within a feca•da;�s. He said he proposes that the Commission thoroughly review
the Subco�mittee min��vs, and that the P2annzng Cammission recommendation
should be given top p�iflrity by the Council. If it takes a resolution to accom-
plish this chang�, it can be done. He said he knecv the Council would go along
with him �,*ith this presposal and they wi11 have a much better relationship
between the City Counc�l and the Planning Commission.
Chairman Ericksa� stated the Commission did discuss this. He did not
think the Commission �,Tc�uld want to delay a decision on a request, and if they
did agree to his propasal, they would have to change some of the Subcommittee
and Planning Com�nissica� meeting schedules.
Mr. Sch�.edeke sazd that the Chairman's suggestion made sense to him. It
seens time is the eleme:�t that all petitioners shout about. His recommendation
would be, if the systE;� did change, a representative from each of the Commis-
sions and the CZty De��rtment representative meet with the Planning Commission.
Then th2 responsi�ility for any error would directly fall on the individual.
It is the time eZement to be considered as the members of the commissions and
subco�Mittees are not paid.
Chaircian E�ickso� said that his understanding of Councilman riittelstadt's
pxoposal is that the ��abconimittee mi.nutes be acted on and appraved by the
Plannino Co�u-�ission. in the past they haye merely been rec�ived with Council
ac�ing on the request. . . � .' � �
There follotiaecI a discussion by tlie members and the councilman of tha proce-
dure used c,;hen �nose r::��;�4�ers served on the Subcomi:�ittees. rir. Qureshi explained
how, in the case of tlz� Board of Appeals, the original set up was that the
Soard made the recomsn�ndations and the Council male the finaZ decision. Then
in 1g66, tne Council, in trying to shorten the procedure, gave the Board of
Appeals the final say, with right of appeal oi the dznial to the City Council.
Later on Council caas �ot satistied with this arrangement because of decisions
by the Eoar_d and the Cc�uncil reverted bnck to the original set up.

what Council wants. How much of the decisions does the Council want. He knows
� what rlr. riittelstadt wants, but if it is the feeling of the Council that they
. want the Planning Cocwission to take over the subcommittee, maybe the whole
subcommittee should be �ade members of the Planning Commission.

rir. Fitzpatrick said the example they mentioned earlier was one request
that more time could have been used and that is the tin shed on rfain Street.
• It may occur once out of 100 tines, b�t he would not want that kind of thing to
' happen too of ten...
Councilman Mittelstadt said that the Planning Commission should be the
planning body of the City because his point was that the Council does not
necessarily have the expertise for all the varied requests. With the recom-
mendation from the Commissions, the Council could act with confidence. If we
chose this metitod, the Council would be in a position where it would rely almost
Lotally on the recommendations of the Planning Cor.unission. The fallacy that
the general pubZic has of a City Councilman, that once he is elected, he is
all seeing and all knoTaing. Councilmen should take great pains in the selection
of the Couz.:rtitteemen so that they �vould be qualified to render good reco:�rnenda-
tions to the Coun�il. There�ore Council w�ould be a policy making body.

_ Chairman Erickson said that if they were going to have a Building Standards
Com.�nittee that really are going to be experienced, then those members should be
appointed from the prafession itself, but the next thing is to get a qualified
man �aho will say "yes" and serve. , �
Member Minish arrived.
Councilman Mittlestadt said he was not changing the ordinance. He was not
saying the Planning Com�-nission would have the final decision, ho�aever,.their
: recommendation would be considered'top priarity.

City such as szdewalks. If it could be shown the suggested proposal does not

Planning Commission found that the Council has, at times, ignored their recom-

Mr. Minish said he would like to see the Planning Commission have authority
' to ma�:e.the final decision of granting permits for variances. If the Planning
Commission gave a-negative decision, the next high court would be the Council.

Chairman Erickson asked rir. Qureshi if, to his knowledge, the public ever
influenced the Council as ta the issuance of a building permit or issuance of
variances. Mr. Qureshi said there have been discussions regarding buffers,
_ landscaping, etc. Chairman Brickson said he felt that type of thing couZd be
done at another level. Mr. Qureshi said there is a public hearing before the
_ Board of Appeals and then goes to the Council. Chairnan Erickson said `that
if the Plann�ng G�mmission were to act on variances, the Council has to give
that autfiority or release that control if the Planning Commission is to be
upgraded as a d�cision making body.

Mr. Schmedeke called attention to Pages 8, 9 and IO of the February 9th
minutes which re€erred to lots under C-1 and C-2 districts whose area did not
meet the requirer�4�nts of the ordinance and therefore c��ere unbuildable lots.
Upon further chec�:ing, he found it �•3as not the Planning Commission that definitely
recom:mended the Iot area or lot width, The Comriission has alxeady run inro
three situations where they cannot live with in our present zoning ordinance.
The last request the Planning Comr��ission receiued, even with Changing the, zoni.ng
f ro� C-1 to C-2, the land could not be utilizec� u�der that zoning. Adjoining
-this property are three more parcels of the same size that are too small for
the Fresenfi ordir��nce. To be certain that this situation does not continue,
he proposed to na�:e an a�endnent to Ordinar�ce No. 459. He proposed that the
Iot area be 20,Ot10 square feet, and the width 160 feet. Mr. Schmedeke said
he thouoht it was a lo�ical request and prop�r. Even t•�ith these chanoes,
variances will be requested.
Chairman Erickson said that first of all, he was happy to hear Mr. Schmedeke

The Chairman asked him how the change in the area requirements would affect

Mr. Schmedeke answered that there would still be variances. He found out
-. that 25,000 square feet was quite expensive to buy because of assessments. He
was asked.if anyone tried to develop the area around him under C-1.
' Mr. Schmedeke said that he thought it would help that situation. The house
to the North of his property has 20,000 square feet. With the change in the
ordinance, that area could develop commercial.
.- Mr. Minish said that then there would be no. need for a Special Use Permit.

Mr. Glenn Wong was present to present the request to construct an
addition to enlarge the kitchen and install new restrooms. Mr. Wong
said they have a Iack of kitchen space and they need to improve their
facilities. They will try to beautify the entire exterior of the
building. He said he would appr.eciate any comn�en�s�the Building Stand-
ards Subcommittee wanted to make. Mr. Wong said they were extending
the kitchen. wa11 16 to 18 feet. T':.ey are evening the outside walls
for a better appear.a.nce. The new kitchen will have a quarry tile floor
and ceramic tile walls. Mr. Muh.ich said he h.ad to cove all corners of
the ceramic tile. Mr. Tonco asked Mr. Won� if he was familiar with
cement blocks with a porcelain finish that could be used in place of
ceramic tile. As the addition will be constructed of cement blocks,
with a stucco finish, he thought rSr. Wong might want to check on this
material. Mr. Wong said the kitchen would have a11. stainZess steel
equipment. The plan calls for a six £oot cioor to facilitate delivery
and replacement of equipr.:ent. He said they were putting new joists
under the kitchen floor to ensure the iloor was strong enough to hold
all the equipment.

The Fridley Health Inspector and the members of the Board felt the
entrances to the restrooms are poor, but there is nothing in the code
that`says they have to be different. Mr. Wong said he would see if
they could be changed but he might have to remove a booth. Mr. Tonco
said he didn't want him to loose any seating capacity because of the
change.
Mr. White asked what arrangements they had for disposal of trash and
gazbage. Mr. Wong said they have a dumpster for trash and the garbage
was picked up daily by a private party. Mr. Tonco asked Mr. Muhich if
there had been any complaints recently. Mr. Muhich said he didn't know
of any at this time. Mr. Tonco said if the City received any complaints
we would require a screened area for trash.
Mr. Wong said they would be doing some painting on the inside and he was
quite sure he «ould be installing a sprinkling system. As previously
stated, the new addition will have a stucco exterior, and the existing
building wi11 be resplashed to match.
Mr. Tonco askeei about landscaping. Mr. Wong had some colored drawings
with him with evergreens drawn on the p2an. Mr. �'onco said he had to
present a landscaping plan showing the size and species of plantings.
Mr: Muhich said they were going to landscape around the existing sign also.
Mr. Tonco asked Mr. Wong if he had any kind o� barrier between the park-
ing lot and the green area of his home. Mr. Wong said he had some small
posts. Mr. 5iu��neau suggested he install some type of railing between
the posts.. Mr. Wong asked if he shauld put up a fence. Mr. Tonco said
the fence wauld have ta be 5 feet from the property line so the cars
wouldn't damage the fence. Mr, Tonco said it usually is a requirement
to have poured concrete curbing around blacktop areas but as the black-
top was already there, they would a11.ow Mr, Wong to use precast curbing
along with the posts, if he wanted co use this as a barrier to protect
the property around h.is home. Mr. MuhicY: said if Mr. Wong �hould decide,
at a fceture time, ta expand the parking area he would be required to
install conerete curbing around tha blacktop area. Mr. Tonco said we
require a l0 foot typical radius on the driveway entrances also.

Everett Swanson was resent to resent the re uest to construct a � r���

20,000 square foot office, shop and warehouse building to be used for
a commercial printing plant. 1,200 square feet wi1l contain the office,
6,000 square feet wili be used for storage of paper, and 12,800 square
feet for the shop. The building will be 200 feet wide on 73rd Avenue and
100 feet in length, with 50 foot setbacks .
There are some existing structures on the property. There is a capped
' basement Mr. Swanson would like to use for storage of files and office
equipment. This basement is tiled and paneled and so is usable. There
is also a smaLl cement block building and an old s[ructure that probably
' should be to�-� down. Mr. Swanson said he didn't know where these struc-
tures were located in relation to where he wants to place the new build-
ing so what he can use and what has to be town do�,m has not been deter-
' mined. Mr. Simoneau said if he planned to use the capped basement a
better entrance would have to be provided.
Mr. Swanson said he employs about 45 people and didn't want the present
parking area as Iarge now as it is showrt on the plan. Mr. Muhich checked
the Code for parking requirements and it was, determined that Mr. Swanson
could reduce the parking area, until future needs required mcre parking.
Upon discussian, the Board decided Mr. Swanso.Z could use precast curbing
at the termination of the present parking area until such tirle as he
needs the entire parking area and then poured cancrete curbzng would be
required. The balance of the blacktop area and driveway will have to
have poured cerncrete curbing no*.a. The East side of fihe dr?veway and
the East and North sides of the parking area have to be fenced in accord-
ance with the Zoning Ordinance.
Mr. Tonco raised the question if a bitumi.nous surface would be heavy
enough for the �rucks delivering paper supplies.
Mr. Lindblad asked what arrangement there would be for trash disposal.
Mr. Swanson said a11 refuse is stored inside the building. SO per cent
of the paper is sold for recycling and 50 percent is given away.
Mr. Swanson said chemicals, ink, and other similar supplies would be kept
in a locked storage room. Mr: Zeglen asked how big the printing presses
were and Mr. �wanson said the largest was SO feet Iang.

approximately two weeks. We also need three sets of plans which inclu�e

Mr. Dave Philli�s and Mr. Kenneth Nordaune were present to present the
request. Of the 850 unit density allowed in this area, approximately
320 units wi11 be quadrominiums. Mr. Phillips said the difference be-
tween the regular townhouses and the quadrominiums was that in a town-
house you own the land the townhouse is built on and in a quadrominium
you just own the air space. This is because the tuck-under garages ,
for the four units are only under two units. Two units will have a full
basement and the units that have the garages will have half basements.
Two units will have patio areas on the ground, and two units will have
patio decks over the garages. Mr. Muhich sai_d he would prefer precast
decking as a fire separation between the garage and the living quarters
above, but Mr. Phillips has a letter from the State Building Inspection
Department where, in the judgement oi Chester J. Zimniewicz, P.E., all
that is required between the two occupancies is a one-hour occupance
separation.
Mr. Simoneau asked if the real estate tax basis would be different
� from a regular toGmhouse. The Board asked the secretary to get tttzs ___
information.(Mr. Mervin Herrmann, Assesscr, said they would be taxed
by value, the same as the toc,mhouses.)
Mr. Nordaune said they already nad units like this in Inver Grove and
Brooklyn Par?c. He said each unit of. four would have four heating

Mr. Tonco asked about the exterior finish. Mr. Nordaune said it would
be texture 111 siding over 5/8" plywood. He sa:d the buildings might
vary in color but they would all be compatible. The roof would be
composition shingle, the same �son their other units. There will be
cedar trim.
Mr, Tonco asked about soundproofing. :ir. Nordaune said all party walls
would have two separate walls with two separate studs and two separate
,plates._ Each wall will have double Type X sheetrock. This givesa FBC
'rating of 52.

be sloped for drainage. ,

positioned as proposed. To position the house this way would save some trees,
as this is a wooded lot, and would also preserve the back yard. The grade of

which could be done w ithout variances, would involve removing part of this bank.
To position the house to meet the side yard requirement, while facing toward
Alden Way, would also require removing part af the bank.
lizere is a vacant Iot adjacent to the south, but there would be no problems
in building on this lot whether the variance on Lat 1 was granted or no�.

read portions of these minutes to the Board, and all the minutes, even as
late as November of i970, were covering a 294 or 295 unit complex.
The mistake in computing the land area was made by Dolan Engineering who made
the site plan for the original owners. When drawing up the site pl.an they
apgarently took the acreage from the half section map, which included half of
the East River Road. right of way along the west side of the property. The
site plan dated July 26, 1970 that was submitted by the original owners to
the various committees and Council showed a land use schedule which s�ated
"actual land area 17 acres", This acreage was incorrect in that it did
include the right of way��mEasurement. ������ ;�� ' �

� ' Mr. Fudali explained to the Board that alI of their contracts and orders
' are all signed and ordered for a 295 unit compl�. To cancel the contracts

would involve thousands of dollars.

Therefore no green area caould be talcen a�aay from this specific building by

;� He said he understood that the entire berm was to be 5 feet high and it is
� not. In some places it drops down to 1- 1'� feet above the ground. The
M' initial berm comes up to the eave of the garage and if the rest could be
� that high it would be okay.

Mr. Fudali ans�aered that he felt that this was not the right time to bring
up the berm, as it has nothino to do with the variance. He said he had.
discussed this with the City Engineer and he had suggested making the berm
flowing. He did not remember, at this time, whether the City had stipulated
it being 5 feet high.
Mr. Belisle stated the apartments are occupied under a temporary certificate
of occupancy and a final certificate of.occupancy wi11 not be issued until
all exterior development is completed according to the approved plot plan.
If it was stipulated that the berm be 5 feet high, it wi11 have to be
corrected before this final certificate of occupancy is issued.
Mr. Fudali added they also have landscaping bonds on each building that are
still in effect.
Mrs. Jacobson stated the berm looks like it is as high as they are going to
make it as it has trees planted on top of it but those trees are not going
to hide the garages from view. •
Mr. Fudaii said he was working with the City in getting fill and this could
be used if need be for the berm.
There was a discussion on other requirements, as parking, and it was brought
out that a1I of these requirements have been complied with.

Mx. Harju stated there was indeed a hardship in the error that was made even
though it was not the City's error. The developer has pursued this project
witn good intentions and this is a reasonable request. HP did sympathize with
the people on the north who had the view of the garages and parking area but
if there was a mzstake in building the berm, he was sure the Building Inspection
Department would w�ork toward rectifying it.

It was asked if the drivecaays are still going to be put together?
Mr. Bogucki answered that the garages could be tooethex but they wouldn't

It was asked what would be done with the ponding area?
Mr. Bogucki answer.ed that it would be up to the peopl� who bought the land.

They could possibly keep the water at a higher level if they wanted to.
The main concerns of the property owners were; the back of the house being
just cement block, landscaping in the front yards, the blanket variance,
2 drivew�ys together, and 1 property owner was against the garages being
ahead of the house.
Mr. Bogucki explai_ned that he does not need a variance to huild the house.
This will be set back the required 35 feet. The variance is only on setting
the garage ahead of the house. 1'he house will be built the way the buyer

would want it. The houses will be higher in cost than the surrounding homes
because there will be more material necessary to build them. They would not
devalue the surrounding homes, in fact, they could possibly raise the value.

Mr. Belisle stated the Engineering Department had found the existing
� elevations for each of these lots. The difference in elevations fxom the
'! existing curbing to 70 feet back onto the lots is between 13 and ].6 feet.

lot around the corner to the north, and the City will not alloca the proposed

Mr. Harju stated his feelings have not changed since the Iast meetingo No
new information has been brought �n. We dan't have a particular house for
a specific lot to consider as there are na buyers. I think goi:�g on an
individual lot basis instead of a blanket variance would woxk out better.
I have no specific objection to moving the garages ahead of the house.
Mr. Crowder stated he is opposed to a blanket variance. As far as adjusting
the garage setback, thexe is a probl.em in the tremendous amount of fill
needed if the garage was to be set back 35 feet. I have no qualms about
deviating the setback. It would be easier for the build�r if he ceuld get
a blanket variance and I think we ahould give him some assurance that he
has a better than a 50 per cent chance of getting a variance if he was to
find a buyer and come up with a specific plan for a lot.
Mr. Bogucki asked if there would have to be a hearix►g on each varianc� for
each lot when he found buyers for them.
Chairnan Minish ans��ered yes. He added t.hat if the Board rec�mmended denial
- of the xequest tonight, and the Council concurred, it �aould be 6 r,►onths before
this request could be brought up again and this mi�ht hindex the dsvelope•r
if he happened to find a buyer before then.

SUBJECT: 1971 EARNINGS ON INVESTMENTS
The attached sheet shows interest earned by the City of Fridley
during the year 1971 on investments of temporarily idle funds,
Earnings for the year totaled $333,765.60.
7he interest earned by each fund is retained in that fund as
required by law and is credited as income of the fund earning
the interest.
A large portion of the interest earned is for special assessment
funds. When special assessments are prepaid, the City is no
longer collecting interest on the assessments and it is, therefore,
very important that the City do a good job of investing the money
it has collected on prepaid assessments so that there will be
sufficient money in the assessment fund. Interest earned by
construction funds is credited against the cost af the project.
Interest earned on funds that require tax levies means that less
taxes wiTl have to be 7evied during the coming year for that
fund than would otherwise be the case. As an example, in the case
of the General Fund, part of the estimated receipts for each
budget contains an item entitled estimated interest earnings.
