motion carried unanimously.
PUBLIC HEARING UN REZONING REQUEST ZOA #72-02 BY ROBERT L. MCGREGOR, GENERALLY
LOCATED SOUTH OF 69TH AVENUE, 1000 FEET WEST OF TtiE CITY LIMITS: (R-1 TO R-2)
Mayor Liebl read the public hearing notice aloud, and announced that the public
hearing is opened for any comments. The City Engineer showed the area on the
overhead projector, and said the location is just west of the Roger Larson
townhouse project. This plan would fit the overall concept the c;ity is aiming
at in acquiring park land on Rice Creek. He said if the Council grants the
rezoning request, he would like to suggest that there be some stipulations,
such as the deed for the park property at the south end by the creek. He said
the developer has some rough sketches ar►d a layout, and showed them to the
Council and said the Planning Commission recommended approval of Lhe rezoing.
Councilman Breider asked just where the 890 contour line is. The City Bngineer
said that the creek meanders through here, but the 890 line is 60' - 80'
noxth of the creek. The banks are very steep, so the flat area is proposed
to be developed with the steep bank maintained as natural terrain. There is
no flat area in that 890 contour line. He then showed the Council a contour
map of the area.
Councilman Utter asked if the road easement spoken of in the Commission
Minutes is on the east or west side of this parcel. The City Engineer said
it would be on the east side. The City has an easement from the Larson pxo-
perty, so this road would serve both complexes and the park property to the

south also. hlayor Liebl asked liw r,i;;y u>>its tlir: would b:. Mr. Robert
P3cGre;or acis;;cred 33 units, the property is a little over 6 acres and they
have agreed to dedicate the property requested for parks wiien tt;e property
is rezoned. `1'he City Engineer said that in the past an agreement has been
drawii up wit}i the developer, tlie first readin is held, then if the developer
meets all the stipulations the seoid reading is held arid the ordinance
publ.ished.
Mayor Liebl asked ,tilr. bfcGregor what he a,iticipated his construction costs wauld
be for one i;nit. A9r. McGregor said aro:nd 35,000 including the land, or about
432,000 -33,000 without the land. 1layor Liebl said he could not rcall what
the price xange was for the Larson coiiiplex, and asked what it was. The City
Engineer said the figures given at the Council meeting were low, but it is
still less of an investment than h1r. McGregor is anticipating. Mr. McGregor
agreed, and said that they intenc! to build single family dwellings to sell,
the plan to the east of them is to rent the units. They hope to sell all
43 units, but if they cannot, they have thought of renting with option to
buy. This is a flat piece of ground ancl they plan on excavating two ponds
and creatirig a rore aesthetically appealing complex. They had planned on
draining into the creek, but there is a storm sewer to the east already, so
they coulci drain the overflow into the storrn sewer. The ponds woulc! be main-
tained with the drainage of the flat land, and would be their responsibility
to maintain. They had thought of putting in a well, or pumping water from
Rice Creek and then recirculating it back down. 'The overall idea is to create
a little different setting. During the winter the gates would be closed off,
and they plan on putting in a warmir,g house and using the ponds as a skating
area for the chilciren. In that way it would be £unctional as well as serving
as a holding poid and adding aesthetic value.
hlayor Liebl said this is a little different concept than we have seen in Fxidley
before. He explairied to Mr. McGregor that his plans would have to be presented
to the Buildin Standards - Design Control for their recommendation before
coming to the Council. The proper criteria must be laid out and the agreement
would absolve Fridley from any responsibility ancl it would be the owners duty
to maintain the area. h1r. McGregor dgreed and added that the poncls would have
to be engineered so there would be no problem, and the gates should be able
ta be opened up for cleaning. He said ttiey would probably be lined with asphaltp
;
Mr. McGregor explained that under the zoning ordinance they would be allowed 4t3
units, but there is not room physically to put that many on the parcel.
Councilman 13reider asked, when a unit is sold, how will the upkeep of the pro-
perty other thai that which goes with the deed, be arranged? Mr. McGregor
said there woulcl be a condominiwn association for the upkeep of all the com-
munity property outside the home owiiers bouridaries, and would be maintained
by the townhouse association. The City Attorney said he believed the by-laws
would he available prior to ordinance approval. Mr. McGregor said yes, the
by-laws must be approved by Council.
Councilman helshaw asked if all the surrounding property owners were notified,
aiid if there was anyone who wished to speak on this project. The City Engineex
said they were notified.

SPECIAL PUBLIC HEARING MEETING OF MAKCII 13, 1972 PAGE 3
` Mr. Leslie Tikkanen, 1400 69th Avenue N.E., said he thought this property was'-
sold before for apartments. The City ngineer explained that at one time
this property was considered for apartments, the hearing was held and the
first reading of the ordinance was given. The proposal was not completed, so
the plan is inactive. Mr. Tikkanen asked if the setback would be the same
as the rest of the houses on the street. The City Engineer said it would
be the same as for residential property, at least 35 feet.
Mr. Floyd F. Foslien, 3345 University Avenue S.E., said he had propexty to
the west of this project. He said he is familiar with the work of their archi-
tect. What he has seen has been very nicely done, and he would be in favor of
rhe project.
MOTION by Councilman Mittelstadt to close the Public Hearing on the rezoning
request by Robert McGregor, ZOA #72-02. Seconded by Councilman Kelshaw. Upon
a voice vote, all ayes, Mayor Liebl declared the motion carried unanimously and
the hearing closed at 8:00 P.M.
Mayor Liebl informed the applicant the Council cvill take action on his request
at the Meeting of March 20th, when they will consider the first reading of the
ordinance. He added that before the second reading all the plans have to be
presented'to the subcommittee.
RECEIVING REPORT ON LIQUOR STORAGE COSTS:
, The City Manager summarized his report dated March 10, 1972 regarding the re-
modeling of the former Police Department area beneath the Fridley Fire Depart-
ment offices, which could be used for liquor storage. At the present time the
' storage area is reduced because of the sale of Shorewood. The $2,100 for re-
modeling would allow the City to move from the Shorewood basement and save $1500
in rental per year. The cost of storage and transportation of liquor stocks at
present is about $9,867 per year, including clerk's wages, deliveries and vehicle
' costs. If the lease is terminated for the storage area in the basement of
Shorewood, this would reduce the available area by 750 square feet. Nonsales
areas in Shorewood Liquor Store are large because it is not a self service
' store as the other liquor stores are. Returned beer cases account for much of
the use of the nonsales area and with wine sales becoming a bigger portion of
the liquor business, storage space in the stores is critical. The remodeling
' , would utilize an area that is, as of now, no use to the City. Shipments coming
into the City could be received at one place, at one time by the liquor inventory
clerk, who is already at City Hall. Taking inventory of the stock in stoxage,
which occurs four times a year, can be done at City Hall by the clerk during
' normal working hours without overtime expense. The utilization of this area for
stoxage would reduce the cost of storage by $1500 per yeax by eliminating the
Shorewood basement storage area. There is a good security system planned for
1 the liquor stock. It is near the entrance to the Police Department, and thexe
would be an alarm system wixed into the Police Department.

1OTION by Councilman Mittelstadt to xeceive tha report from the City Manager
dated March 10, 1972 entitled Liquor Storage Costs. Seconded by Councilman
Kelshaw. Upon a voice vote, all ayes, Mayor Liebl declared the motion carried
unanimously.
5P}:CIAL PUBLIC 11EAR1tiG ti1E'1'ING UF MRCki 13, 197? F'AGE 4
MOTION by Councilman Mittelstadt to authorize the remodeling of the old City
Hall area under the Fire lleartment offices at a cost not to exceed $2100, and
to terminate the lease for the Shorewood basement storage axea upon completion
of the conversion. Seconded by Cuncilman Kelshaw.
Councilman ireider asked what was the inventory value on warehousing in normal
times. The Finance Director said tlie total inventory would be about $45,000 -
$50,000 in storage, this does not include what is on the shelf. Councilman
Breider asked if the case discounts are received on what is bought per month
on a one time basis ar on a multiple delivexy basis. The Finance Director
said it is on a one time basis. Councilman Breider asked if the same price
could be obtained if some contract was entered into with multiple deliveries.
The Finance llirector said he could not answer that without checking with the
suppliers. At certain times of the year the City can make a large purchase
and have the deliverie:s staggered, but this may not be true for every item.
Councilman Breider thought it would be a good idea to check into ettering
into some kind of a contract whereby the amount of purchases needed for t}ie
year woulci be projected, the City would receive a large discount for l:uyi.ng in
bulk, then the deliveries could be made, perhaps 4 times a year.
The City h9anager said that one reason wholesalers ofer volume disaunts is to
cut down on delivery costs. Trying to predict future sales based or past s:iles
can be ctiancy, because of the rapidly changing tastes of pople. Councilman
reider said that buying $50,000 of liquor is taking a chanc.e too, and that amount
of money is a lot to be lying around gathering dust wlten it could be invested.
He said he would hate to remodel the unused area because of£ice personnel will
be increasing and it may be needed. Then the liquor would have to be moved out
and the City would have to get another building, and it would surely be more
than the cast of the Shorewood basement. $2.00 per square foot is a pretty
good price.
Councilman Breider asked why an inventory is taken four tilnes a year. The
Finance Director replied to get a 100% accurate profit and loss figure. The
alternative would be a perpetual inventory which, he felt, woud cost the City
more, and would not be 100% accurate.
Councilman Sreider asked that during the next three weeks the Liquor Store
Manager contact the liquor suppliers to see what their reaction would be to
a contract for vne year, with the right to cancel, and with deliveries maybe
four times a year. The City Attorney suggested that the contract need not be
absolutely firm, and that there could be an iqterchange of brands w.th the
same dealer if necessary. Negotiations could proceed with the suppliers with
the City agreeing to accept so many cases per month. Mayor Liebl agreed the
City does not want dead stock, that is money being wasted. Councilmara Breider
said that this plan, if possible, would move the responsibility of large
storage back onto the supplier.
Councilman Kelshaw asked if this program could be imlemented, is Courcilman
Breider still opposed to remodeling? Councilman Breider said he was not
necessarily opposed to remodeling, but he would like to have the supliers be
resonsible for the storage of the merchandise. tie painted out that in
other industries, there is a large contract or the purchase of some item,
but the deliveries are staggered as needed. The City Manager sa3d ir1 this
business it is very important to carry enough merchandise to meet the demand.

1 There is a turn-over four times a year and it is not gathering dust. If some
product is running low, he vondered if a supplier would make a delivery
promptly.
, Mayor Liebl said that it was very important to run an efficient business now
that Fridley is out of the on-sale business. Now, if a product is not moving,
it cannot be pushed through the bar. He said there were items pointed out in
' the survey by Ed Phillips and Sons Co., that could be changed for better profit,
such as relaying the shelves, realigning of inerchandise and changing the traffic
flow. The City Manager said that these have been done. Mayor Liebl said that
' Councilman Breider has raised some good points and suggested the Council
could sit down in executive session with the Liquor Store Manager to discuss
ways of making the operation more profitable.
'

'
'
Councilman Utter said that remodeling the basement at City Hall would save
$150Q through the termination of the lease for the Shorewood basement, but the
rest of the costs would remain the same, or may go up. There is $480 projected
for vehicle costs, but it would stand to reason that if the storage is centxally
located, the delivery costs would be more, because at least at one loeation,
Shorewood, the liquor would already be there and would not have to be trans-
ported again.
Mayor Liebl asked what was the rental for other nonsales areas? The City
Manager said that amounted to $5,665 and is the area in the rear of the other
stores. There has to be some space for the empty beer cases etc. Skywood and
Holly have a very limited space in the back.
' Councilman Breider said there would be a saving of $1500 per year now, true, but
what about the future years? As the City gxows, this may not be so, and Fridley
may end up having to rent some space at $4 per square foot, and added that the
last proposal he saw was for $4. The Finance Director said that the figure
' of $9,867 represents the annual costs of liquor stoxage and transportation,
and the only saving there would be through centralization would be the $1500.
By centralizing, there would not be a significant amount saved in vehicle,
' transportation, or preparation of shipment costs. We are using Shorewood as
the central location now.

,

'
C
Mayor Liebl asked if Shorewood wants the storage area for their use. The City
Manager said they are not forcing the City out, but have agxeed to terminate
the lease, if so desired, without penalty. Mayor Liebl asked the Finance
Director his recommendation.
The Finance Director said that the question boils down to whether it would be
better to keep the Shorewood basement at $1500 a year, or spend $2100 for the
renovation of the basement at City Hall. If the renovation is done, Fridley
would have their money back in two years. He said he would agree with the
suggestion made by Councilman Breider, and that more work should be done in
that area. He added there was some work scheduled to be done anyhow with the
addition of a sprinkler systera. He said it would be moxe economical, even if
only fox two years, to spend the $2100. Councilman Kelshaw asked if there has
ever been any trouble with vandalism or burglary. The Finance Airsctox said
there have been some attempts, but the City has never lost money ox stock
items.

THE VOTE UPON 'THF: MOTION, being a voice vote, Kelshaw, Liebl and Mittelstadt
voting aye, Breider and Utter voting nay, Iiayor Liebl declared the motion
carried.
Mayor Liebl said that when $50,000 is spent, we must be very careful to have
the proper merchandise to meet the market. Fridley has to be more frugal
since we no longer have the on-sale operation. The City must not end up with
too much dead stock.
Councilman Breider requested the Administration to prepare.a plan which would
show where the office personnel will be situated in the next five years. ile
said he would like to see where we are heading and he certainly would not want
to have to put an addition onto City tiall because some vacant space was used
for liquor storage.
The City Manager said he assumed that he should wait until there can be some
meetings between the Liquor Store Manager, the suppliers and himself before he
goes ahead iaith the remodeling. Thei•e is not a time limit on the remodeling,
so it can be started after the investigation is completed on the proposal
Councilman Breider has suggested.
Councilman Mittelstadt said that the Council turned down the proposal to have a
private firm come in and do a study, but he did not want to get the feeling from
the Administration that they are stopping work on it, and he did not want the
Council to get into the liquor store management business. The City has hired
personnel to do that and they had better do it and do it effectively.

CONSIDERATION OF APPROVAL OF CHANGE ORDER #2 FOR WATER, SANTTARY SEWER AND

The City Engineer said, as the Council will recall, there was some difficulty`
in getting easements, and because the bid price was lower than the estimate,
ihe proposal was before the Council to put in a piped system from Main Street
to the railroad tracks and from 79th to 78th along the tracks. There was a
property owner heard that was in favor of the improvement and he believed
there was another property owner that was also in favor. He said he noticed
Mr. Richard Harris, who is a property owner, in the audience.
Mayor Liebl asked Mr. Dick Harris if he was in favor of the improvement, and

officer" to "public officer" and describes what that term means. The efect
would be that establishments could then use someone other than sworn police
officers for their dances as required in the dance ordinanee.

Mayor Liebl asked liow much land there was involved and Mr. Warren Caldwell

- real este office on 63rd Way and East River Road. This piece of property
was picked because of the size, location, and the large amount of shrubbery
and trees already on the lot. There is an existing building on the lot,
atid preseted a sketch of what the building looks like. He then presented
a sketch of what they wquld like to do with the building, in making it appear
more raodernistic and with a chalet flavor. He said he was associated with
Leigh Investments, Inc. and they would divide up the interior into offices
: to give it a feeling of spaciousness. They plan on adding a dormer acxoss
the front and adding a lot of windqws. He said they figures they would need
10 parking stalls and showed a plat plan on the easel. There is 135 feet
frontage an East River Road and 245 feet frontage on 63rd Way. The existing
building is located in approximately the center of the lot: There would be
about 80 feet between the building and East River Road and also between the
building and 63rd Way. The parking lot would be between the building and
East River Road. The access would be from 63rd Way, then out to East River
Road. He said they feel that traffic will not be a great problem due to the
fact that there are lights both north and south on East River Road just a
few blocks away. He said they are willing to meet the Code in xegaxd to the
parking and will have the proper setback. '
Mayor Liebl asked tlow many parking lots he s speaking af. Mr. Doyle said
they anticipate one 1ot with 10 stalls, hoever, there wauld be access to the
rear where there ould be more than adequate parking. This lot is sheltexed
from the neighborhood on the east and north by quite a few trees, ther axe
also many trees on the west side. Mayor Liebl asked if he knew of any
opposition from the people on the west or north side. Mr. Doyle said o
the north, the property is zoned for duplexes. He said he had not talked to
the owner, but he has talked to some of the residents. On the west side
` across East River Road and to the south thexe is a duplex. He said he had
not talked to the people directly across the street. He said he felt it
would be an improvement to the area, because the building as it exists now
would receive a face lifting.
Councilman Breider asked what was the zoning. Mr. Doyle answered R-1. Cotulcil
mari Breider wondered what Zoning he would ask for. The City Engineex said
there were two types of zoning available. He could fit undex the C-2 zonng,,
or if the building is nly to be used for offices, he could request a CR-1
zoning, which is more restrictive. If the plan is to use the building only
or offices, he would suggest that Mr. Doyle request the CR-1 as he could receve
ess opposition from the neighbors if they were assured that it would be only
office use and that at some future time somthing else, such as a grocexy soxy
or a gas station, could not ga in.
Councilman Breider explained to Mr. Doyle, that under the State law hearigs mttt
be hd for ary change in zoning classification. He said the procsdure was to
make an application n the Bngineering Department, notices of he hearng are
sent out to people within 300', the hearing is held before ths Flannng Gm
missian, and a recommendation is ade to the Council. Te notices e gi
sent out for the hearing befoxe te Council. After the heaxig i d, th
Gvucl ppatoves the request, , ordinance for the zoning chang mu v two

Th Gxt Engineer xepoxted that Mr. Doyle has received an appliation pxm,

REGULAR COUNCIL MEETING OF MARCH 20, 1972

The City Attorney said, in considering this particular rezoning, would the
Council have any desire to consider rezoning a larger piece of property at this
location? There was at one time some talk of changing the zonirig to com►excial
in this area, and suggested that the Planning Commission could look into this.
Councilman Breider said that rhen the question ras put to the peole in the
neighborhood, they did not expxess any particular desie to rezone to c.ammercial.
He said he assumed it would be acceptable when they come before the Planning
Commission after the notification, they could give their views on rezoning
their property. Councilman Mittelstadt said that he felt this shauld encompass
moxe than just the 300' and should cover the area from 61st Way to Mississippi
Street, and all those people should be notified. Mayor Liebl said that the
City Engineer will have to proceed as ihe Charter provides, which is 300 feet.
He added there is a fee for this request to cover publication costs etc.
Mr. Doyle aid that he has a list of the people within the 300' rad.us; uld
that he could get the names o€,all those from 61st Way to Iississippi. He said
he was willing to go one step further and personally contact each person withiri
the 300'.radius and ask them to sign a petition on what they would Iike to haVa
done. Counc.iJ.man Breider sad that the Ca.ty Adani°xation goes through he
procedure of geiting all the zasr►es for the hea°ing notificatiot, so he could et
the list from City Hall.
Mayor Liebl asked how long the procedure would take until it is completed- ThD
Ci.ty Engineer said, considering the meetings and the requiremettts for 11 the
publications, arut 3 months. Mx. Doyle commented that if thi.s proerty eve7C
did go back to residential, the building still would not be obnoxi.ous ta the
neighborhood. .
The City Engineer said that he did not have a clear nnderstanding of what ths
Council wishes were in regard to the notificatian. Did they want orily those
within the 300' or the entire area notified. Councilman Mittelstadt said only
within the 300' for this particular property, but if the Panning Comdais8ion
would want to consider this totally from 61st to Mississippi on a broad basis,
then all the residents in this section would Fiave to Tie notified. He sad e
would recommend going ead with this particular piece of property, then let th
Planning Commission consider the overall zoning concept for the area. The C.ty
Engineer said that the Planning Commission is rorking on a comgrehensiYe plail'
for the City, they could consider this in xelation to the ovexall plan.
Mr C H Benjamin, 5708 Jefferson Street: Request for "No Parking' Sigtls.;
, Mr. Benjamin said that be has a 24' street both on the east and south of him.
Thre is a difficult pxoblem in this area with cars parked on th sides of the
stxeet, especially in the winter with the snow banks narrowing the street even
more. kie said he would like to request "No Parking" signs for.both sides of
the street from Lakeside (57) to 58th Avenue and on I,akeside fcom Jffarsan
to 7th Street.
' He s,d he would also like to request another stxeet light. When the theatxe
apzs, this area is used as a lovers lane, and disturbs peoplq at ti8ht,
'I'haxe is one on Jefferson and Lakeside now, and h would like qna further north.
' Mayox Liebl said that there should ot be a pxoblom irt puttin i th "Na Parkin"
sign, this would appear a difficult situaior arad wauld be a' xeasonable 7cquesx.
'
REGULAR COUNCIL MEETING OF MARCH 20, 1972 PAGE 4
As to the street light, he told Mr. Benjamin that the City feels the first
priority must be intersection lights. All the intersections in the City axe
nat lit yet, and the City puts in as many as they can afford every year. There
are still street lights available for 1972, and asked that the Administration
check into Mr. Benjarain's request.
MQTION by Councilman Kelshaw to concur with the request for "Na Parking" sigris
for Jefferson from Lakeside to 58th Avenue and on Lakeside from Jefferson to
7th Street, and instruct the Administration to follow through on this. As to the
street lighting, he would refer this to the Administratior to check out, takig
into cansideration those most needed, and monies available. Seconded by Courci.l-'
man Mittelstadt.
The City Manager asked if there would be any problem in limiting the parking on
both sides of the street. Mr. Benjamin said that the other streets ars 6p', He
said he had company about a week and one half ago and thexe wexe ars parked ort
both sides of t3e street, p3.us a lot of snow, and a car could barely squeee
,thxoigh. He went up to the Police Department, and they came out and had the.
.cars moved. They said they could see no reason the cars would have ta be parked
on:this narrow street. If there were "No Parking" signs, the Police Aepartment
would have the right to do something about it.
'I'HE VOTE UPON THE MOTION, being a voice vote, all voting aye, Mayor i.ebl
declared the motion carried unanimously.
Mr. Carl Paulson, 430 57 Place N.E., Request for Txaffic Control on 57th
Place, 57th Avenue and 4th Street: ' " ""
Mr. Carl Paulson said that in considering signs, the Council and AdministTation
should consider some "No Parking" signs in the area of 57th P1ace, 57th Averus
_ and 4th Street where the service drive loops around. This area i a bottl-
neck, and there should be some sort of irttpravement to the conflics at tis
locata.on.
Mr. Paulson said that he would also like to have the Councl justify hixing p new
man to head the Police Department at a high salary at a time when evexyone
trying to cut costs. He added that he was on the Police Commission whar Ghie€
McCarthy was hired. Mayor Liebl said that the Council will make th cec.sion
when it is on the Agenda, and they are nox a.. , prsition ta answex at this t1m.
It was pointed aut that the recruxtrarent rracess nas already started and fihere i.&
money provided fox this position in the 1972 budget. Mr. Paulsort sa,d that he

FIRST READING OF AN ORDINANCE AMENDING SECTTON 3.03 OF THE CITY COA -_HOI.TDAYS:
The City Manager explained that this amendment to the Code had the fixst reading
on February 1, 1971. The ordinance would incorporate the Monday Holaday I.aw
passed by the State Legislature. The reason the second reading was tot hed
last year was because the labor negotiations wexe not settled arld they felt
they should wait to see if a different set af olidays taould come xom the uriiat
negotiations. Most of the union settlements coincide with the 9 holidays set
out in the ordinance. The ordinance has the effect of xeducing the 11 holiday
to 9. This amendment would not take ef£ect before Good Fxiday, whh is allc►Wd
in the Code, so he would l,ke a recommendation on that.
The City Attorney suggested, in view of the length of time betweeA tha frst and

Mayor Liebl said that he had asked that this be on the Agenda, and he would l.ke

The City Attorney said there are tvo lat suits involving cable television. The
first suit of Koropchak vs City of Fridley has to do with the petition for a

Fridley, qnestions the effect of the 0'rdinance as passed. The first law suit
has had two sessions before the District Court. The City filed a motion to

Councilman Breider said that he would assume by tis recommendation th.t thexe
are many substandard lots commercial zoning in Fridley now. Mx. ldo
Schmedeke, Planning Commission Member, said that the zoning oxdinance was
pa,ssed in 1969. Throughout the Planning Commission Minutes ovex the past
month, he said he has txied to explain what has happened. The Planning Com-
mission has had 5- 6 requests for ciianges in zoning rhich involve substandaxd
lots. There are four lots across from Sandee's Cafe which wauld fit the
20,000 square foot xequiret but have to be considered substar►dard now. lfiey
have also had a request just north a Sandee's Gafe by Mr. Walc{uist whih in-
volved only 17,000 square feet. At the iae the oxdinance was adopted, his
recommendation was a minimum of 15,000 square feet rhich he felt would be
proger, but the requirement was made 25,000 square feet, so the 20,000 square
feet would be in the nature of a compromise. He said most sertrice satians xo
on 20,000 square feet or less and the lot rhere Minnie Pearl was is less than
15,000 square feet. He said as the ordinance is written now, they just catot
live with it, and he was sire there were gaing o be are si.ila ec{uests in
the future. This ordinance was made for one area, and it should nat hsve been
done. He commen'ted that he had thought that the recammendation fox the 25,QOQ
sqtxare feet came fxom the City staff, but he has since found out differeitly,
Councilmar4 Breider asked if he knew approximateiy how many lots in Fidley wuuld
be involved. Councilman Mittelstadt estimated about 50 to 75, and Mr. SchmedQke
agreed there would probably be that many.

1. Since the timint af r. equest for plan approval of
tle quadrominiums is so near July I, 1972, the date the new
ltilinnesota State Bui2ding Code becomes effetive, we request
permissioi to subxnit working drawings conforrring to that
Code. This would elirninate changes to the specifications
and drawings at a later date and gxeatly reduce chances of
4 error in cost estimating and construction processes.
2. Upon preliminary approval of the quadrominiurn
p2ans by the City Couneil, we request the Council approve
the issuing of a building permit for the model block. Barring
unzoreseen problems, scheduled Council review and approval
of the preliminary plan would be April l0, 1972. We would
like *.o start construction of the madel block the week of
April l Ot.h.

MOTIBN by Sondheimer to approve fihe minutes of the March 14, 1972 meeting as
written.
Seconded by Harju. Upon a voice vote, there being no nays, the motion carried
unanimously.
1. A REQUEST FOR VAR7ANCES OF: SECTION 45.053, 4B, 4, FRIDT,EY CITY CODE. TO REDUCE
THE SIDE YARD ADJOINING AN ATTACHED GARAGE FROM 5 FEET TO 4.7 FEET AND SECTION
45.053, 4B, TO REDUCE THE SIDE YARD ADJOINING LIVING AREA OF A 1XJELLING FROM
10 FEET TO 4.7 FEET, AND SECTION 45.053, 4A, TO REDUCE THE FRONT YARD RDC?UIREMENT
FROM 35 FEET TO 34.7 FEET. TO ALLOW THE CONSTRUCTION OF AN ATTACHED GARACE AND AN
PLAT 3, THE SAME BEING 440 - 67TH AVENUE N.E.. FRIDLEY, MINNESOTA. CREQUEST BY
MR._DAVID DOCKTER, 440 - 67TH AVENUE N.E.,_FRIDLEY, MINNESOTA.
Mr. Dockter and Mr. Omtbedt, of Sussel Company, were present to present the
request.
Chairman Minish asked Mr. Dockter to briefly go over his proposal again for the
benefit of the members of the Board who were absent at the last meeting.
Mr. OmCbedt explained there was an error made by them in drawing the proposed
addition and garage onto the aurvey in that the aasurement asked for in the
front yard variance should be 33 feet 4 inches instead of 34.7 feet.
Chaian Minish stated the notices that were sent out stated 34.7 feet and the
Board can ta%e action on that request but if the applicant wants to change zhe
request to 33.3 feet, new notices will have to be sent out to the surxounding
property owners.
Mr. Harju stated he couldn't see why the addition and garage couldn't be
jogged back to be more in the back yard.
Mr. Dockter said the bacic wall of the addition is level with the cantilever
from the kitchen. It would be more expenaive to jog the addition toward the
back.
Mr. Omtbedt said they would rather defer action on the xequest until the new
variance notices were sent out since the road restrictions are now on.
Chairman Minish stated the item had been tabled at the last meeting to allow
the applicant time to get a letter "of no objection" from hia neighbor. Mr.
Dockter did aubmit this letter to the Building Inspection Department.
Ai0TI0N by Wahlberg to table this item until the April 11, 1972 meeting to
allow notices with the ne► measurement to be aent out again.
Seconded by Crowder. Upon a voice vote, there being no nays, the motion
carried unanimously.

R1VERi1IEW TERRACE N.E., FRIDLEY, MINNESOTA. {REQUEST BY MR. ROBERT P. DOHERTY,
8215 RIVERVIEW TEkRACE N.E., FRIDLEY, MINNESOTA.)
Mr. Doherty was present to present the request. Pictures of the lots and a
verification survey were shown to the Board. "
Mr. Doherty explained he wants to add on a 14 foot by 26 foot addition onto
the front of the existing house. The problem is that the existing house is
only 3 feet from the lot line so the addition will also be only 3 feet from
the line. The existing house aas built in 1946. He sid his main purpose
fr the addition is to get more room since the mai houae is small to begin
with. It will be used for a living room, family room and a small office.
Mr. A1 Williams, who has an interest in Lots 27 and 28, Mr. Dennis Berry,
680 Zronton Street and Mr. Raymond Weitbrecht, 690 Ironton Street, were
present and interested in learning what Mr. Doherty was proposing.
Mr. Williams stated he has a purchase agreement on the two adjacent lots
to the North that are owned by an estate. The lota were probated in Wisconsin
but have to be probated again in Minnesota. The owners live in California.

He said he owns the 3rd & 4th adjacent lots to the North.
Ci:ainnan Minish asked Mr. Belisle if granting the variance would create
problems for Mr. Williams in building on his lots.
Mr. Belisle answered the variance would add to an existing non-conforming use
and would restrict building on the adjacent lots as there haa to be 15 feet
between structures and 20 feet between living areas. The addition would also
be increasing the fire hazard between structures. He asked Mr. Doherty if he
had considered building onto any other part of the house.
Mr. Doherty stated that economics dictated which way they could add on. Thia
is the only way to go to get the maximum benefit for them. Any other way
would disrupt all of their plans. This plan would also blenci in very nice with
the existing house. He said in answer to the Boards questions, that the addition
will not have a second story and there wi21 be just a crawl space under it.
Mr. Crowder asked if Mr. Doherty had talked to a builder and if the builder
could build the addition as proposed.
Mr. Doherty said his sketch is just a rough aketch and some ideas could be
changed but he has had estimates from 3 contractors and they c$n build
according to his measurements.
Mr. Williams asked if it would make any difference on his lota if he placed
the garage in the rear yard and ran the dziveway along the property line.
Mr. Belisle said there would have to be 15 feet between atructures.

The Minutes of the Board of Appeals Meeting of March 28, 1972 Page 3
Mr. Sondheimer asked why the building Mr. Williams will build has to be so close
to the existing dwelling.
Mr. Williams said that with a 50 foot lot you don't have to meuch choice. He said
he doesn't wish any hardship on Mr. Doherty but he ia concemed about building on
his property.
Mr. Sondheimer asked what the north wa11 of the house and addition will be covered
with.
Mr. Doherty said the outside wall will have wood shingles.
K?TION by Harju to clase the Qublic hearing.
Seaonded bq Sondheimer. Upon a voice vote, there being no nays, the motion
carried unanimously.
Chairman Minish asked Mr. Doherty if he had planned any windawa on the north
side of the addition.
Mr. Doherty said they had p2anned to have 1 window. The existing dwelling has
4 windows on that side.
", Mr. Sondheimer stated he was concerned about the position of the garage to the
adjacent dwelling and making it safe in case of fire. This could be eepecially
dangerous with wood shingles.
1TION by Wahlberg to recommend to Council approval of the variance if consideratiof
if given to elixninate the fire hazards.

3.

Mr. Haxju added the stipulation that there be no windows or overhang on the xoxth
side of the addition.
Seconded by Harju. Upon a voice vote, there being no nays, the motion carried
unanimously.
Mr. John Christenson and Mr. Roger Chxistenaon were pxesent to preaemt the
request.
A house plan of the proposed two family dwelling was shown to the Boaxd.
The follawing peop2e were preaent and were intereated in seeing whaG wae bein

", The Minutes of the Board of Appeals Meeting of March 28, 1972 Page 4
Mr. J. Christenson stated they proposed to put up a nice looking double
dwelling on this lot. A11 the code requirements are met except fox the
one side yard. He said they could put up a different type of bungalow
that would meet all the codes but it wouldn't be as nice looking as the
one that they propose.
Mr. Lennox said he had wanted to buy this lot and build a double bungalow
on it but the City Assessor had told him that this lot had only 9,770 sQuare
feet.
Mr. Christenson said he had discussed this plan with the City Engineering
Assistant and they agreed there was 10,380 square feet. He said they are
building a double garage on one side of the dwelling and a single garage
on the other side but they also have to have a parking space or caxport in
the rear yard to meet the code. They haven't decided exactly where the
parking space would be yet but they do know they have to have the parking
space.
Mr. Belisle added the parking space would have to be 25 feet from the property
Iine so the car would not be parked on the boulevard.
Chairman Minish stated it is not the Boards responsibility to check the area
of the 1ot, that ia the responsi6ility of the Building Inspection Department
' or the Engineering Department. If there is an error in the lot area, the
applicant would have to come back for another variance request. The Board is
only to act on the 5 foot variance that is asked for at this time.
Cynthia Schreiner came forward and psesented a petitioa to the Board. 1'he
petition stated the 13 surrounding property awnera who had signed the petition
wished the Board to grant the variance but only if Mr. Chrisenson built the
dwelling according to the plans that were submitted to the Board.
MOTION by Wahlberg to receive the petition.
Seconded by Crowder. Upon a voice vote, there being no nays, the motion
carried unanimously.
MOTION by Cxowder to close Che public hearing.
Seconded by Harju. Upon a voice vote, there being no nays, the mation crried
unanimously.
Mr. Crawder said he was concerned about the 4th parking area as it meant 1
drive off frocn 74th and 2 dxives off from Symphony. He didn't know if thia
was bad or not. They could put a amaller dwelling on the lot to mest he
codes but he wouldn't want to see a box like building built thexe.
Mr. Aarju said he would hate to sacrifice a building like this fox the mattex
of i parking space but he felt the Soard would feel more comfortable i.f thie
groblem was rasolved.
Mr. Wahlberg said she likes the basic plan fox the dwelling but she wouldn'fi
-. ''' want the extra parki.ng area to be unsightly to the ne,ighboxhood.

The Minutes of the Board of Anpeals Meetin of March 28, 1972 Pae 5
MOTION bq Sondhei.mer to approve the variance from 17.5 feet to 12.5 feet
under the contxngency that the 4th parking space (10' x 20') be positioned
i.n a suitable pace in the back yard. Also the variance be approved wich
the stipulatio that the plan be used that was shown to the Board.
Seconded by Crawder. Upon a voice vote, there bing ao ays, he motion
carried unanimously.
Mr. Bob Schroer was present to present the request. Pictuea of the xisxig
pylon sign and a sketch of the proposed sign addition were shown to the 8oaxd.
Mx. Schroer stated he is asking for an extenSion onto the existing sign. The
extension will be a 4.4 foot by 1Q foot sign to go on top of the existing sign.
It will be the newest type of sign as it is a remote control sign that .s
controlled from inside of the store. There are 4 lines of 12 modules each.
Each module has the letters of the alphabet on it. The sign is double faced
but will not rotate. The sign is leased from the company and not purchased.
Mr. Schroer added they also need a ieight variance as the gas station si$n
on the corner hides there existing sign somewhat.
The Board asked if the signs on the building wouid con down if ttt.a aign
was approved.
Mr. Schroer said there are 2 separate eomp anies at this Iocatio:; $ab's
Produee Ranch anc Green Giant. Both companies might be using Ch ex.s.tt
pylon. He said he could not speak for Green Giant but he though the s,gna
attached to the wa11 would come down.
Chairman Minish stated that as he understaod the code, all sns that axs
non-conforming would hve to come down after 1974.
Mx. Belisle said he did.n`t think this sign would be considered non,o,oaemi
if Council approved the request.
Mr. Schroer said if it had to conform in 1974 then part of the ign wauld b
taken down.
Mx. Crowder asked if the new aign would have 2 poles as the exist.xg ai.gr► has.
Mr. Schroer said the poles from the existig sign would be extendad ox he
new sign. The sign plus the poles will have the weafiern moti, The ein wi.11
be strictly a message sign and will run from 6:00 A.M. to 12:p0 F,M,
The Board asked how large each module was and what was Che dj,stitcs xom
which the sign could be resd.
a The Minutes of the Boaxd of Appeals Meetin of March 28, 1972 _ Page 6
Mr. Schroer answered the modules were 9 inches high and at night the sign can be
read from about 2 blocks away and during the day about block away. He added that
this sign would help their business with the shopping ceter going in to the
