If posslble they would prefer not to have gutters in the stipulation� but have the wording � in such a way that Xhey would be open to other alternates. That would be appreciated. Our examittatioA of the records of accidents (See Attachment �1) and a p�yaical exami.nation pf �tte intersection shows that a"STOP" sign at Ch3s inter'section is not waF=anted (See also� Attachment #2, a letter from Chief of ?olice, E, McCarthy to Public Safety Di.rector� James Hill, concurring in this analysis). The standards set in the "Uniform Traffic Control Devices Manual" specify ' Chat, because a"STOP" sign esuaes substantial inconvenience to motorists, it ehould only be'used where warranted (See Attachment #3) and this intarsec- tlon doas not meet these sCandards. St. and there are no hquses on 60th From 2� St. east. Go1ng north on 2k St. it is difficult to see to tha east due to a high lot on the corner. This is not blind, however, Travei� from any pth� direction is npt biocked at ait. The apartment honse on the corner ts set fa� enough back so there is no sight pr qb 1 an, I Rit at the intersection from 0915 this date until 1020 and duri�g that period of time, seven vehicles went through the in- tersectian. I can see no reason why there is a stop sign at Sgth Avenue and 7th Street except for speed control. This is just a three-way corner with very little traffic on Sqth. If a stop sign were to be Placed on 7th Street to do traffic any good, the sign should be at 57th Avenue and 7th Street -- 57th Avenue being the through street to University. This stop sign creates so much noise from the cars stopping ' and gunning the cars to take off. All committee members were present. General Television was represented by Jim Goetz, ' the president of the company, Bob Hi.nkley, Mr. Goetz assistant, and Ned Cogswell, the executive vice-president and director of engineering of General Television Ink. Father Ed began the questioning. What is the company going to give the citizens of Fridley in the immediate future, and what does it see for the next fifteen years. How can this franchise guanantee productive use of this new median which has such high potential and how can it be co.mmerically rewarding so that it's stockholders likewise are satisfied and find it a worthwhile gamble2 Jim Goetz anawered the question, It may be beneficial for me tonight to try and share with you the many segements that make up the composite that we talk about---�ATV itself. I think theres eome confusion concerning what CATV is in the market place, who's involved in it, and what it can do. First I should explain alittle about General Television Minnesota Ink who is the nominee of this franchise. General Television I�A7 Ink is one of five subsidiaries of General Telesision in!c. General $elevision Ink is the current cooperation that stock is traded pubically, its been a public coop�ation for over a decade. We also have a subsidiary of First Televlsion Cooperation which is a common carrior of Micrawave Incorporation. We provide CAT�� pic- tures and the distribution of signal to many other systems including most of ouz competitors in the count�y. We also have a system known as Telefact Research Systems Ink. Now �'ll talk about who's going to regulate what they carry. The FCC does all the regulating of all af these. They tell us what signals we can carry, which we can't carry, and whieh we must carry. This gets into the real heart , of cable televisiori, There is a communication gap in tne City of Fridley. The commera*al regional stations don't have a reporter here tonight, do they? You don't have a daily newspaper that has ' a reporter h�re tonight. You don't have a radio station that has a reporter here. There is a communication gap in the metzopolit- ian areas of this country, This is what the FCC tries to address ' itself to, was that there raust be programing of local origination. This is a channel that is regulated in its programing content by _ the company with supervision of tha FCC. The cable television system company has nothinq to do with it. It has nothing to do with educational access Channel. Father Ed asked, By whom? The company must keep a log and we must put down and,the person must siqn the log that on sucn and such a date, at such and such a time they requested such and such. And we must nave thern sign what they requestad. It is our responsibility to keep records. Its a new field, a.new idea, We are going to have to learn to wal}: before we run. So these are the public aacess channels. As you multiply them, say education is going to need more ci:annels, the same guidelines apply. In the FCC regulations, they say this is the basics that must be provided-one channel Aor government, one channel £or edu- cational use, etc. What we have said in our proposal already to this community is that we will reserve 5 channels...(see* on chart, page 3) If at anytime, anybody in these fields coqles in an� they $ay. look we have a program, we think we can use it, we'd like to do it. P7e'd say fine, if you believe it, fine. Why would you do that Jim? [ae are concerned with the uti]�ization of the services and the system, this is our best interest and this has been in_our history in St. Cloud. I have worked very closely with the people in St. Cloud and we think cabZe television is like anyching else; it's only a value if it's used, My understanding from discussions that have yone on here in the ' City of Eridley was that this group £ormed under the ordinance, was to advise the city council as to what to do and who would get time on channels. This seems like a qood role for a group like ' this to do is to evaluate the commuaities needs and interests on these two service channels. �Phis is the greatest £lexibility within cab],e television and iP people say this is unclear and it won't ' work, thGn what they are really saying is that they can't work with their own community. Now this is the public access side as we talk about it. Naa all of these channels are free. Cable television company gets absolut- ely no revenues from any of these people. The use them absolutley for nothing. The Federal government says that if anyone comes in off the stxeet and he wants to go on television and you have t,o produce a camera man, and a technician to run the whole program, you have tq do that free up to f:ive minutes a time. vrho pays for it? �he cable television company must pay for it up to iive min- utes a time. Beyond that, no one can raquire a cable televis?_on compdny to pro4ide more money or more time free. If anyone wants to make a presentation on a public access channel for more than fj.ve minutes, they have to be prepared to pay for it. We provide absol,utely free the total vechile throughout the community to every home that is a subscriber. Theres no sense in using something just because its there. Someday we believe, there isn't going to be a educational institution in chis couniry that won't recognize the great value that cable television can liave to them. I wonder what che company intends to do to develop this kind of interest in the use of these access channels. Jim said, I'll get into this thorougnly alittZe later. To say for now theres little we can do. The only thing we can do is to promote on a local origination channel community involvement. 4Te can't knock on everyones door and say, look, your city council is great or the cable commission �s great. People have got to see it in action. Whatever company is in here needs your guidance, you pro- ple knaw whats best, you live here. I think this is a significant part that �he advisory co�nittee will play--a total involvement oi it all. The local origination station will start out at minimum of forty hours a week which we will provide in the`eomaunity. Once we get the franchise and knaa that we're going to operate in a community, we take a survey to detarmine viewing trends of p�ople. We also try to determi.ne the time that theis home, the time that they do have their television sets on. I happen to believe that any o£ tha companies who made application to the city of Fridley would treat them well. You would not have a problem with any company because of two reasons. Number one, they have a moral commitment, and number two, if we would do that sort of thing, economics would get us because we are a totally voluntary service and if the subscrjber feels that it is not worth- while, he just quits payi.ng, r�nd unfortunately £or the company but Eortunatley for the guy that wants to do that, your city ordits- 3nce says that the company cannot charge a disconnection fee, which means as soom as the guy decides to stop paying his $5.50 a month, We've got to spend the money to go disconneet him and he has no penalty. So your ordinance put all the economic burden for bad per�ormance on the franchisee and not on tne subscriber. The second side of service channels are the lease channels. These , are channels that are available to business usage, medical etc. (see chart, page 3) The FCC clearly regulates it. i9e must as a cable television company lease that channel to any user who wants ' it and he has certain oblj.gations. The £ee is arrived at by the cable television company. The iees that we charge must be submit- ted to the FCC and they evaluate it� This area is the s�de that ' their talking about in essence going into a common carr3or stace. trhdt common carrior is, is that everyona has equal access and everyone ha:s same xate. The i.nterconnection ques- tion in our judgement could be strengthened, improved, and clarified by substituting this amendement for section 2o in your ordinance. The ques�ion of fact in each instance as to w}tether or not the fire equipment and personnel of the ➢arty of the first pgrt are ready and able to respond to a�all in the Village of Hilltop shall bR determined by the Fire Chief or his next in command or agent. 4. The party of the first part shall act in good faith �n sending its equipment and men, to any such fire as herein provided; and no liability shall attach to the first party by teason of any negligent act or commission of the driver or any men sent with said equipment to said fire. It is particularly understood that the first party is not obligated to send said equipment and men upon call, if in the judgement of the Fire Chief of the first party, or his next in co�and or agent, said equipment and men are required�at the time wit�in the limits of the first party, to fight any fires then existing. Should road or weather conditions be unfavorable, in the judgement of the Fire Chief of the first partyt as to the furnishing of said equipment and men at �he time, then the first party is not obligated to respond to said call; and should a fire start within the corpoxate limits of the first party during the time such equipment and men are traveling to said fire, or while they �xQ actually engaged in fighting said fire, or while they are standing by, Baid equipment and men may be'recalled or sent back to the City of the first p�rty, provided in th� judg��pent of the Fire Chief or his next 1n command or ��pnt of the first pa*t�� su�h action 1s ggCessary and advisable.
