The Regular Council. Meeting of the Fridley City Council was called to
order at 7:40 P.M., September 11, 1972. ,

P4ayor Liebl read the Certificate aloud thanking her for her service on the
Fridley Human Reiations Committee, and as Mrs. Bonine was not present, asked
that the Administration send her Certificate to her.
Youth Achievement Awards: David Linton, Tim Buckley and Tom
Mayor Liebl asked the three Eagle Scouts to come forward, read their Certi-
fiqates, and presented them with the Council's congratulations.

Mayor Liebl said that when Mr• Wong appeared before the Council, it was his
intention ta meet all the City �odes and on that basis tMe Council was
Willing to give him a liquor license when his work was completed. Once
he gets his license, he must provide for the safety of the customers and put
in the sprinkler system.
Councilman Mittelstadt pointed out that this is actually bypassfng the Building
S�andaxds - Aesign Control Subcommittee and asked Mr.. Bropks if ;they have to
gst started th3s,week. Mr• Brooks said they have tp get this started, they
hdve already spent 6 weeks on the plans and their men are availdble now. He
a$ded that thdy had a building permit once before and this is actudlly the
same plan thdt was presented at that time.
The C;ty pttorney pointed out that since July lst� all of Minnespta is under
the State Building Code, snd he was not sure thi$ plan could ba approved with-
out approval of the State Inspector, so before the permit is actually issued,
someq�e ought to check with the State Inspector. This will also have to be
apprvved by the County Heilth Inspector. It would be a shame for him to go
ahead, thsn be stopped by SOmeone from the State, There is only a certain
amqunt a person is allowed ta spend on any additiops before they are required
tq bz'ing the whple building up to Code.
CouneiJ.man Breider asked hqw this would affect the fire rating. The Fire
PraventipA Bui^eau Chief i+ePlied that it would have no dffect Qn the City of
F�idl�y, but if the permit i� going to be approved, there should be a
waivex granted tak�ng tha stFUCture out of the fire limits. Mayor Liebl asked
i� dping thls wvuld make any difference to the citizens pf Fridley. The Fire
preve�t�qn Bure�u Chief replied no, there would be no difference in the rates

the ordinance was put intp e�fect cannot be added onto. In effect, nothir�g
can be dsane with a frame building within the fire limits.

He said he was happy to recommend the Council acting favorably on this
oz�dinance. He felt there was a need for a special emphasis toward pro-
tecting qur total gnvironment.

MOTION by Councilman Mittelstadt to cublicly cite Winston Jacobson for
the outstanding job he has done in heading up this ad hoc citizens comrnittee,
and direct the City Administration to prepare a citation for Mr. Jacobson.
Seconded by Councilman Utter. Upon a voice vote, all ayes, Mayor Liebl
declared the motion carried unanimously.
Councilman Mittelstadt then asked Mr. Jacobson to stand and led the Council
and the audience in applause. Mayor Liebl said he was ves+y proud to have
Mr. Jacobspn as a citizen of Fridley. �
Mayor Liebl said that before the second reading of this ordinance, the
question shquld be answered whether this commission will be given autonomy
and be considered an independent body or whether they should be answerable
to the Planning Comrr.ission, or work directly with the Planning Commission.
He asked the City Attorney if he could foresee any conflicts with the
Planning Commission in pursuing their goals.
The City Attorney said that the original ordinance was presented to him
along with many recommendations from the various organizations, many of
which were not consistent. He said he drafted up the second draft now
before the Council by picking and choosing amor.g the many suggestions.
The words XXX'ed out in the Agenda are the words the ad hoc committee
would like to have eliminated. He could see no problem with a conflict
between the Planning Commission and the Environmental Quality Commission.
The one area the Council should consider is to coordinate the commissions
properly as far as the tjme element is concerned. Fridley now has a
fairly streamlined procedure for handling requests with as short a time
lapse as possible. This, he felt, has been an inducement in getting
industry into Fridley. If �n item should have to go before the Planning
Commission and the Environmental Quality Commission both, they should be
timed so that the recommendations are ready to go to the Council at the
same time. There could be better coordination if the Chairman of the
Environmental Quality Commission was made a member of the Planning Commission.
If the Council decides not to do this, then rules should be laid down on
when matters would go to them and when they are due back.
, Councilmar� Breider said that it seemed we are talking about two different
functions. When he thinks of an Environmental Quality Commission for
Fridley, he does not envision all the plans, variances, plats etc. going
, through them. He had in mind more of such studies as "Ban the Can" or
problems wxth creeks and waterways etc.
The City Attorney said he thought it would be a part of both. He didn't
, think every request should go tp the Commission, but there may be piats that
have an erosion problem, or a new industry coming ln with some unique
pollution concerns. Councilman Breider said he could not see the point
'. j,n t�aving all rec�uestsa �uch �s �ezonings go to the Commission. For
such things as noise pol�ution# there 3s already control in the Zoning
Ordinance. The City Attorney said that if this is the concensus of the
Council, it should be made explicit in the ordinance. Councilman A!i�tel-
' stadt said that he did not envision the Commission studying every propcsal
coming before the Planning �ommission.

ENVIRQNMENTAL QUALITY COMMI6SI4N:

�s. Kay M�tcalfe said she would like to bring up one more point concerning
the Cpmmisglon, and that is the need for a recyqling center in Fridley. She
¢aid She h�s done $ome res�arch on this and Columbia Heights and St. Anthony
both have recycling centers. The League would like a cente� to be set up
on a�egular baSls with the serv�ce organizations alternating with the work.
�he said she has not contacted all the members on the ad hoc committee, but
she would like the Council to consider this proposal.
CONSIAERATION OF FUNDING PLAN - STONYBROOK CREEK:
The City Manager said that there is a memo from the Finance Directar dated
Septet�er 7, 1972 in the Council Agenda presenting the alternates for
fina�cing the work th�t has been started on Stonybrqok Creek. His suggestion,
and that pf the FinanCe Director, is that the work be funded from funds
otMer than the eme�gency �eserve. If $22,000 were to be taken from that
fund, it wouZd leave a balance of only $12,173 which would run the fund
dangerousiy lqw, cansidering there r.ould be some unforeseen emergency before
�he end pf the year, Anather consideration is that he has just completed his
review of the budget and if this money is taken out� it would neduce the
car�y-over into 1973 if it is pot used for soma unforeseen Use. It has been
�if��cult to prepdre the budget this year due to the State levy limitations.
The suggestion €or funding is utilizing some $44,000 that was set aside out
of 55&SW #101 f for daWnstream work. This was originally planned to
take care of the storm wdter in Stonyb�ook Creek. If the Council desires
to �ollowa his �oute the �ngineering Department will have to be directed to
prQg�re plans dnd spec����dtions and call for bids fqr the work. When the
bidS ax'e �eceived it CaR the� be determined whether it would be more
econ4miGa1 to award the b�d to a contractor or do the work with City personnel.
H6 suggested the bids qould be received on September 25th, t�en the work
could be finished in the month of October.

Councilman Breider said that throughout the discussions with the Island Of
Peace Committ2e the gtatements have been made time and again that the Com-
m�ttee would be responsiLle for all the funding and that the City wouid only
be asked to provide administrative assistance. If the Committee cannot pay
their bills of a few hundred dollars, he wondered if the City should sponsor
#his gxant for about $30,000, The thing that bothers him is that the indi-
cdtions all along have been that there would be no problem in raising the
fuAds. He said he d1d not want to advance money to something he has
sdid dil along he would not make an advancement to, and that he could not ap-
pxove this advancement o� funds because it violates the original.idea.
The City Attorney said that the two items for $245 are for legal services. They
were included with their regular monthly billing. This charge is in conjunction
with meeting with the State to work out the lease. Councilman Breider said, in
his apinion, the legal sexvioes should be paid, because the City did promise
administrative assistance, and that would include legal services, the printing
of the brochures etc, are not a City responsibility.
Councilman Breider continued there are a number of service organizations that
certainly do a lot of good for the community, but he would not want to make it
a practice to advance them money either. This request, if approved, would set
an undesirable precident.
MOTION by Councilman Breider to approve payment of the legal services in the
amount of $245 and to disapprove the remainder of the items, totaling $273.84.
Seconded by Councilman Utter. Upon a voice vote, all ayes, Mayor Liebl
declared the motion carried unanimously.
Mr. Henry Dorff, ot the Bropklyn Center Conservation Commission, said that he
was representing the Commisszon, and would like to verify some of the statements
that Mr. W31mes has made, and determine what actions the Council has taken.
He commented that the creation of the Environmental Commission is to be com-
mended. In talking to Mr. Wilmes, Durnam Island is included in the Islands of
Peace project. Councilman Mittelstadt said no, only Chase Island and the small
uncharted island to the north of Chase.
Mr. Dqrff continued that $rqoklyn Center has taken the position that they
' would not approve of any struGtures on Durnam Island. Mr. Wilmes is talking
in terms of buildings on the i5land, and although the Islands of Peace is
certainly a commendable project, he did not want the'natural beauty of Durnam
' destroyed. He said that Brooklyn Center feels that with the additions of a
' building and walkways on the island the wildlife that Mr. Wilmes is so con-
cez^ned about preserving will be destroyed. Mr. Wilmes is a very persuasive
' person and his praject is very important, but they feel that protecting the
natural state of the island is also important. Durnam gets flooded every year
and walkWays would encourage erosion.

apinion and explained that there has been some confusion between the Committee
mQmpers� pyt the�� is a meeting scheduled for Wednesday, September 13th and
hopefully some o� the �rob�ei�� g�n be ironed out.

Adminis*ration should be directed to hire one or more professional water
consultants to look at this p1an. He said he did not believe there �aas
' anyone in the City Engineering Department with the expertise tc take the
brown water problem out of Fridley.

sultants to look at this plan and determine its credibility. Seconded Ly
Councilman Utter.
Councilman Breider said this could be compared to the liquor store construction.
At the time that was being discussed, the comment was made that the City
hires competent people on the staff, and they should be able to get the job
done. The Engineering pepartment has just gone through a reorganization and
he would like to see what Mr. Qureshi would like to do. If Councilman
Mittelstadt meant by his motion, that he would approve the hiring of some
professional assistance at various times during these studies, fine, but if
he meant to examine the report, then he would not agree with the motion.
Councilman Breider asked Mr. Qureshi if he could solve the rusty water problem.
' The City Engineer replied that the problem has existed for many years, how-
ever, for the last three years, the Publjc Works Department hds not been
under his control and there 3re not good records of the worst.problem are3s.
' With the reorganization of the Engineeririg Department, he now has the capability
to attack the problem. Since this problem has existed many years, now it will
take some time to find out the causes of the rusty water and how to attack it
with the right solution. He said he has now sketched the areas they get the
' most calls from onto a map. Included in the report that was submitted is a
report by an independent lab, The analysis reports are hand written as he

three level system which is unique in this area. As to Councilman Breider's

step has to be to determine what is causing the problem before a cure can be
found.

Councilmap Breider asked how long it would be before he could establish the
problem. 'Phe City Engineer said that we plan to collect pipe pieces when we
make cuts in the pipes in various parts of the City, collect all the data
obtained from this, then analyze what we have found. Over a period of time,
this should present a good pj.cture of the job to be done. This is a difficult,
time consuming problem.
Mayor Liebl said that after six years with this problem, he was very anxious
to get it solved and Mr. Qureshi should be given the assistance he needs.

Mrs. Barbara Hughes said that the purpose of this showing is to emphasize
the League's stand that North Park's best use would be a nature eenter. This
area is already in its natural state and would need no funds for reclamation,
as has been the case with �ny other nature center projects. She introduced
the narrator, Mrs. Mary Martin, and running the slide pxojector is Mrs.
Eleanor Jensen. The slide show was then presented which lasted for approxi-
mately 20 minutes.

under a non-conforming use. The Planning Commission recommended approval of the
rezoning request to bring the station into the proper zoning category. Mayor

RECEIVING REPORT FROh1 THE CATV ADVISORY COMMITTEE:
Mayor Liebl asked if the recommendations of the CATV Advisory Committee were
adopted unanimously. Father Ed Chmielewski answered yes, and added that he was
very pleasad ttith the other committee members, who have been conscientious in
their deliberations. The committee was made up of very busy people who served out
of a re3� sense of responsibility. 'Pheir object was to perfect the or3inance to
the point where it would be acceptable to che citizens, and although they may not
have solved all the problems, h� felt they have helped lead to a solution.
Mayor Liebl said thank you to Father Ed and the members of the committee from the
Council dnd the citizens of the City of Fridley for coming up with a job well done.
MOTION by Councllman Mittelstadt to receive the report from the CATV Advisory
Committee dated September 15, 1972 dlong with the following Exhibits: A- Cable
Television Infprmation Center Me�eorandum, September 12, 1972; B- An Annotated
Outline of an Ordinance, Third Draft, August 10, 1972; C- A Proposal of General
Television, Inc., August 29, 1972; D- A Plan of Services from General Television,
Inc „ September 1, 1972; and E- Technical Charactexistics from General Television,
Inc., September 8, 1972. Seconded by Councilman Breider. Upon a voice vote,all

Councilman Mittelstadt then offered the following statement:
"Ypur Honor and membars of the Council, in accepting the report of the
Cable Television Advisory Committee I would like to commend the committee
for the tremendous job it has done j.n a lim�ted dmount of time. I believe
the committee has become extxemely knowledgeable in the important questions
surrounding cable television in Fr3dley. In addition, the committee
reached its conclusions through a series of open public hearings that were
�dirly conducted. The committee not only encouraged all interested citizens
�o make their viewpoints known, they in fact actively solicited information
from persons representing all sides of the issue.

Finally, the committee had the wisdom to seek out and obtain the advise of an
impartial expert representing a national non-proPit cable television
advisory center.

With the Advisory Committee's amendments, we will have a strong and safe
ordinance. It is now up to the citizens to decide whether they want it
implemented at this time.
And while I am mpving to accept the referendum petitions, I must add that
I do so simply because T believe that is the fairest cqurse to follow in
resolving the issue. It is sti11 my opinion that some of the signatures
Were not obtained acCOrding to the requirements of the city charter.
� However, it seems to me that question is no longer as important to the
, c�tizens of Fridley as the larger issue of whether to have cable now that
the ordinance can be amended to meet the community's desires.

That must be settled in November when it will mean no extra cost to the
people as opposed to the expense which would be required to conduct a
special referendum at a later date. We also know that many more citizens
vote in a general election, meaning the decision could be made by the
largest possible number of people.
Gentlemen, a referendum this Fall is the fairest course.
The petitioners had a referendum as their goal --- the concerned citizens
sought a referendum --- the plaintiffs in the lawsuit asked for a
referendum, --- and a portion of this Council has previously expressed
a desire to have a referendum."
MOTION by CouncilmaA Mittelstadt that the Cable Television Advisory Committee be
' enthusiastically commended for its report, and instruct that Certificates of
Appxeaiation be prepared. Seconded by Councilman Breider. Upon a voice vote,
all ayes, Mayor Liebl declared the motion carried unanimously.
MOTION by Councilman Mittel&tadt that the Council noW accept the referendum
petitions, which were collected in December 1971 as a result of the Cable
T�levision Ordinance. Seconded by Councilman Breider.
Councilman Breider questioned if these actions were progressing in the r3ght
order and the Acting City Attorney replied yes, first the petitions should be
accepted if this is the Council's intention, then the ordinance must either be
reaffirmed or repealed according to the City Charter requirements. He said he
has advisec? the City Manager that this ordinance requires a 4/5 vote and in this
Case with only four members on the Council, it must be unanimous.
THE VOTE UPON THE MOTION, being a roll call vote, Utter, Mittelstadt, Breider
and Liebl voting aye, Mayor Liebl declared the motiOn caxried unanimously.
MOTION by Councilman Mittelstadt to reaffirm the Cable Televisipn Ordinance and
to instruct the City Clerk to pldce the question of whether or not to have
Cable Television j.n Fridley pn the general election ballot November 7th.

Mayop Liebl asked the Liquor Store Manager if he approved of the plans and if
these plans will accommodate the customer comfortably. Mr. McGuire answered yqs,
there are wide aisles with room for carts and there is also room for a second
checkout Counter. The center portion will be accentuated with lighting. Mayor
Liebl said that one of the Councilmen was concerned about how the product is to
be gotten from the storage area up to the front, and how do you take care of the
empty cases? Mr. McGuire said the stock would be brought from the storeroom in the
back on carts and the empties could be taken back on the carts.
� Councilman Utter asked how many employees there would be at all times. Mr.
McGuire said at slow times such as in the mornings, probably two, in the peak
hours probably three or four. He thought the two would be full time and the
rest part-time, Mayor Liebl said that in designing the store, overhead must be
' cut down to a minimum. Fridley must be most thrifty and design a store with the
greatest efficiency to draw customers not only from this community but from the
neighboring communities as well.

Cquacilman Utter said that it seemed that there would always have to be at least
two people working at the store. It would be difficult to receive deliveries
and manager the cash register also. The Liquor Store Manager explained that the
layoUt of this store will be better than Holly, deliveries are received in the
front and can be seen from the front register.
' Mayor Liebl said that the walls should be gotten up as soon as possible so that
the work on the inside can continue when it is cold. Mr. McGuire said yes, they
plan on putting in the parking lot before the frost goes into the ground.

Councilman Utter said, in looking at the plans, that a delivery truck would have
to pull into the parking lot, turn around and back into the receiving area. He
suggested that rather than have the green area in front of the loading dock, that
the driveway come direCtly out toward 63rd Avenue. Then, if there were two
trucks trying to make deliveries, they would not take up all the room that customers
would want to use in the parking lot. The City �ngineer explained that the
thought was to present a green area toward the residential neighborhood on 63rd
Avenue. Ho�ver. it was pointed out that if a driveway was put in, it would be
roughly across from the second pump of the Texaco station and would not seem too
objectionable. Councilman Breider agreed with Councilman Utter in that the
trµcJc access should not be through the parking lot.
MOTION by Councilman Breider to approv6 the preliminary pZans and authorize the
' archltects to proceed with the working drawings and specifications. Seconded by

proceed as rapidly as they could. After the bids are received, when the store can
become operable will also depend on when the contractor specifies the work will be
done. In this case, it is possible the second lowest bidder may recieve the bid.
He said he understood that he would also have rto take the plans before the

Mrs. BertrWn Booth said that the residents feel that there are very rmny dangers
associated with this corner as outlined in the letter. There are many children,
both on foot and on bicycles. There are many teen-agers •iriving from the south on
2� Street at high speeds. The school bus dces not even sJow doc�m: The children
have to cross the street to catch the school bus. She said luckily, there have
not been very many accidents at this corner, but she and her neighborhood feel
that if they could get some stop signs it would be a great help and would maybe
prevent an accident, and a child getting killed or hurt.
Mayor Liebl said that the staff has prepared a thorough report and it shows that
since 1964 there have been 5 accidents, all on clear days and only one was icy,
and that onq was caused by speed. The Police Department was asked to investigate
and the Chief of Palice sat at this corner from 9:15 A.M. to 10:20 A.M, on
September 13th and his recommendation is that there is no justification for a
s�op sign at this intersection at this time. The City Engineer has stated in
his report that the standards set in the "Uniform Control Devices Manual" are
not met•and a sign is not warranted. Mayor Liebl asked if she could only have
a sYop one way, which would the residents want and Mre. Booth replied on 2�
Street to Stop the north/south t�ffic. She said that at that time in the morning,
thare would not be too much traffic, most of the traffic is when people come home
from work and on the weekends. Mayor Liebl said that Mrs. Booth must realize that
there cannot be a stpp sign on every corner of the City, but in this case, there
may be some justification in that the area has been zoned commercial and there is
the slip-off coming into this area now, Mrs. Booth said that ds she went around
with the patition,people said to her -"what about our corner?" sd she could under-
�tand how everyone feels thdt their situation is the worst. At this intersection,
however, it is blind approaching from Some directions and she, along with her
neighbors� felt it would be wdrranted. Mayor Liebl said that he wanted to emphasize
to the mothers in the neighborhood that they must not let,a stop sign give them a
false sense of security and that vigilance would still be very necessary.

signs on 2'� Street to stop the north/south traffic at 60th Avenue N.E. Seconded

A RESOLUTION DETERMININ6 THE NECESSITY OF AND PROVIDING FOR A TAJ( LEVY IN

BE IT RESOLYED, By the Council of the City of fridley as follows:
SECTION 1: That the Council of the City of Fridley heretofore received from the
City Manager a proposed budget of the City of Fridley for the year 1973 which
proposed budget when examined evidenced the necessity of an additional tax levy
in excess of the City Charter limits and, accordingly, there was then adopted on
the llth day of September, 1972, a resolution declaring the necessity for an
additional tax levy and specifying the purpose for which such additional tax
levy is required.
, FURTHER, The Council proceeded to hold public hearings pursuant to three �
(3) weeks published notice in the official newspaper of the City. That such
public hearing was held on the 2nd day of October, 1972, and all persons interested
tf►erein were afforded an opportunity to be heard and make objections, i,f any
, there be, to the budget as then proposed. That after such hearing and after full
discussion of the contents of the budget and all objections thereto the Council
Purther proceeded to correct and amend the budget in such way as was deerr�d
' necessary by the Council to be in the best interests of the City; and after such
corrections and amendments the Council did pass and adopt by Ordinance on first
reading on the p�to6�r p , 1972, a budget for the City of Fridley
� for the operation of its us� iness during the year 1973 a copy of which budget is
attached hereto for reference purposes as EXHIBIT "A".
SECTION 2: Further, upon the examination of such budget originally proposed,
' corrected, and amended and adopted by the City of Fridley on the �n� �a„ �p
, 1972, it reasonably appears, and the Council does not find that.
e tax evy necessary to provide monies for the operation of the business of the
' City of Fridley during the year 1973 under said budget, is and will be, !��hen
computed in accordance with law, in excess of the normal City Charter limit of
thirty (30) mills on each dollar oP the assessed valuation of the property in the
, City, but that, nevertheless, it is reasonable and to the best interest of the
City in order to provide for the proper operation of the business and functions
of the City during the year of 1973, to exceed such normal City Charter tax levy
limit, and to levy taxes thereof sufficient to provide the monies necessary to
' the operation of the business of the City in accordance with said budget.
SECTION 3: That to provide money in accordance with the needs and purposes of
' t e udget of the City for the year of 1973, taxes shall be levied in accordance
with law sufficient to provide monies provided for any purpose herein shall be
appropriated to and used for any other purpose, except as might otherwise be
' authorized by law, either under the generaT law of the State of Minnesota or the
City Charter of Fridley..

The meeting was called to order by Chairman Minish at 7:35 P.M.

MOTION by Sondheimer to apprwe the minutes of the September 12, 1972 meeting as
written.
Seconded by Wahlberg. Upon a voice vote, there being no nays, the motion carried
unanimously.
Chaixtcan Minish said this item will be held over until the October 10,�1972 meeting
by the request of the applicant.

Mr. Charles Peugh, of Signcrafters, Inc., was present to present Lhe reque'st.
1�1(1TION by Wahlberg, seconded by Sondheimer, to waive reading the public hearing notice.
Upon a voice vote, there being no nays, the motion carried unanimously.
Sketches of the proposed sign were shown to the Boatd.
Mr. Peugh explained they are proposing this particular sign as it looks good, the
owner of the building likes it, and it covers up the vents, air conditioners, etc.,
that are on the roof, from the view of the public.
Chairuian Minish asked Mr. Peugh if he was aware of the letter dated September 8, 1972,
' wTitten to Viking Chevrolet by Mr. Darrel Clark� stating that na sign permits wou13 be
issued to them until a completion schedule is received for the outside improvements
stipulated on their original building pezmit.

Mr. Peugh said he was not aware of this letter.
Mrs. Wahlberg asked if the.Board should continue with the pu6lic hearing or should the
item be held up until the letter is agreed to.
Chaitman Minish said he felt they could consider the item and if the variance was
, approved� a stj,pu�ation could be added that the letter would have to be agreed to
before a permit would be issued�

Mr. Yeugh explained the front of the building is 120 feet wide and 13 feet high. The
sign will consist of seventeen 4 feot by 6 foot modules. The modules will spell uut
'biking Chevrolet" and have a design module on either end. There will be a sign
sYructural background behind the modules'that is 40 inches high and will run around the
entire front of the building. The modules wi11 extend l foot above and 1 foot below the
structural backing. The letters on the modules are only 3 feet by 2 feet. The modules
are made of inetal and acrylic plastic and only the letters will light up.
ChaiYman Minish asked if the space in between the modules was added into the area
asked for in the variance. Mr. Belisle said the total area of just the modules is 408
square feet, 579 square feet for modules plus e:cposed b.;ckground and 720 sqnarc feet if
we follaw the Code in tLe strictest sen�e by using �he smallest rectangle which can be
toade to circumscribe the message.
There was a discussion on how the sign area for the variance should have been measured.
It was decided that the space between each module should have been added into the
variance area which would have brought the total area up to 579 square fe�t.
MOTION by Sondheimer to close the public hearing. Seconded by Wahlberg. Upon a voice
vote, there being no nays, the motion carried unanimously. '
Mr. Harju stated this is a difficult variance as the sign is very eye pleasing but
when the total area is looked at, it is a drastic variance. When you look at the
shopping centers, that are a long way from the road, you can see we have�held them
at or near the required ZS% of the wa11 area, and it wouldn't be fair to thesc
businesses to allow this variance.
Mr. Sondheimer said if the backing was built up as a parapet� it would not be
considered a part of the sign. He said he felt the fillers should not be considered
a part of the sign. ile felt this was a pleasing sign and excellently done, but the
Board might set a precedent if they approve the sign.
Mrs. Wahlberg said the building is lower than what is normally built, so in a way
' he is being penalized hy the height of the building. The 6uilding will look better
with the sign up as it wili screen the equipment on the roof.

Chairaian Minish asked what the owner would'think of cutting down the size of the sign.
Mr. Peugh said he had no idea of how the owner would feel about reducing the sign area.
Theae modules are stock sized and to make them smaller would require more time and the
owner would like to get the sign up as soon as possible, He said he would prefer to
have the Board take action on'the variance rather than teibling it.
MOTION by Sondheimer to recommend to Council approval of the variance as proposed,
even with the excess of footage involved for the total area of the sign.
' Seconded by Wahlberg. Mrs. Wahlberg added the stipulation that Viking Chevrolet would
have to comply with the letter dated September 8, 1972 that was sent to them by Mr.
Darrei Clark before the sign permit could be issued.

the motion failed for lack of a majority.

PARK/SCHOOL RANGER EVALUATZON REPORT
On June 12, 1972, the City Council suthorized the employement of a
Park/School Ranger for the period June l9, 1972 through September 24, 1972,
and had requested an evaluation of this program in October, 1972. The
following report complies with that request.
Enclosed for your information are the following items pertaining to
this subject:
A. My initial report to you of June 12, 1972 proposing this program.
B. Report from the Park and Recreation Director dated September 27,
1972, on evaluation of,the program.
C. Letter from Mr. Richard Stanton, Principal of Fridley Junior
High School, with his evaluation of the program this year. We
had worked with Mr. Stanton in setting up the program and the
hiring of Charles Spano, the Park/School Ranger.
D. The report from Charles D. Spano, Park/School Ranger.
Based on the apparent success of this program, I recommend the employ-
ment of a Park/School Ranger during 1973 for 22 weeks, from the period May 1
through September 30. School District �k14 hasindicated they wish to
participate again next year on a one-quarter basis and we have also had an
indication from Anoka County that they wonld also like to participate for
protection of the Anoka County Park within the City of Fridley.
Mr. Chuck Spano will be present Monday evening to answer any questions
concerning his experiences while serving as Park/School Range*. Every
indication is that Mr. Spano did an excellent job in filling the task as Laid
out for him. He had excellent liaison with the Police Departr�ent as he
serves as a reserve police officer in addition to his Park/Ranger activities.
RECOMMENDATION: I would recommend the City Council continue the Park/
School Ranger program in 1973.

Recently I had occasion to meet with Mr. Ray Mondloh of the School Board and
several administrators in School District 4�14 to discuss joint school/city relations.
One of the ideas that came out of this meeting was a common need of the City and the
School District for a park and school ranger. This position would be utilized to
patrol the Fridley Junior and Senior High School complex 10 hours per week and
the remainder of the parks system 26 hours per week. Specifically the diyties of
the ranger would be:
A. Observation and detection of vandalism, and to work with the Fridley
' Police Department in apphrension of suspected vandals.
B. Detection of misuse of facilities and property and correction of same
� C. Work closely with the Fridley Police in enfarcing the prohibition of
motorized equipment of a11 kinds on the athletic and park areas,
, D. Make certain only authorized personnel are using the facilities.
E. Curtail certain dangerous and unauthorized activities on hoth school
' and park property.
F. Control parking on all sites.

It was jointly decided that employment of a park and school ranger could be
tried on an experimental fourteen week basis, and such a program would be presented
to the City Council and the School Board of District ��14.
It is envisioned that if this program is approved, the park and school ranger
would begin on June 19 for a fourteen week trial period. The person would be
required to wear a uniform and be equipped with a two-way radio on the police
network, and also equipped with a vehicle. The payment for the position's salary
would be on a 3/4 City basis, 1/4 School District. The City would supply a
vehicle, radio, and appropriate uniform.
The hours of duty of the ranger would be 5:00 P. M. until 11:00 P. M. six
days per week with the day off rotated so no pattern of the ranger's patrol is
established.

One possible monetary benefit to the City is the reduction of vandalism in
park and school property. Records are kept on the cost of vandalism in our parks
snd the cost by quarters for the past two years are as follow:

It is suggested the funding of the City's share of this program ($1644) be paid
for out of the recent transfer of the unused portion of the Ward ltao Councilman's
salary which amounted to $2310. I realize this effort would affec[ more than parks
is the Second Ward; however, I believe the money can best be spent on this project.
After the 14 week experimentai period of the program, it would be evaluated to
determine the results.
The park and school patrol program suggested in this memo is not new to park
' departments at least; the Minneapolis Park and Recreation Board recently voted to
employ 24 additional seasonal "park patrol agents" to patrol city parks (aee
newsclipping attached).

REVIEW: Chuck Spano was hired to fill the position of Park School Ranger. The
program was adopted to run for 14 weeks, 6 hours a day (5:00 - 11:00 p.m.), 6 days a
week, at a cost of $2,114.00 for salary, vehicle, and uniform, and to be divided by
the City of Fridley and School District #14.
' EVALUATION: It is my personal observation that the program was very successful.
Listed below are a few points which we feel have been beneficial to the Parks and
Recreation programs in Fridley:
1. Use of fields and facilities, both scheduled and unscheduled.
2. Curbed both major and minor vandalism attempts.
3. Handled problems arising while on duty, thus relieving the regular
police force.
4. Obtained public identification and respect.
5. Created better public relations regarding department policies and
ordinances.
6. Minimized vehicle violations.
7. Minimized dumping in parks and on school properties.
8. Minimized after hours parking.
9. Assisted maintenance sta£f by noting unsafe conditions or litter
problems.
We feel that the Ranger applied the City�s Rules and Regulations governing the
use and abuse of park lands, to the manner in which the general public use of the
facili�ties available. Chuck did a fine job of keeping everyone informed and used
much discretion in his handling of the situations which he encountered.
RESULTS; Success of such a program is difficult to determine in such a short
time. Vandalism repair costs are noted below, for your comparison:

our grounds. We experienced a minimum of vandalism during this
period, as canpared with past years. For the first time, use of
our outside facilities by the public was control1ed.
Based upon my review of the daily reports by Mr. Spano, it would
seem that the school district paid its fair share of his salary,
based upon time spent at the various parks and schools. Should
the county becane involved in any future program, this percent-
age arrangement would need revievr.
In summary, I hope we will be able ta coopel^ate on a similar
undertakinq next year. Before I recoimiend any specific plan to

RESOLUTION CERTIFYING CHARGES TO THE COUNTY AUDITOR TO BE LEVIED AGAINST CERTAIN
PROPERTIES FOR COLLECTION WITH THE TAXES PAYABLE IN 1973
WHEREAS, a nuisance condition has been found to exist on the lots listed
below,
WHfREAS, the owner of such property was given notice to abate such nuisance,
and
WHEREAS, the owner of such property did not abate such nuisance and the City
of Fridley, under authority of Section 145.23, Minnesota State Statute of 1953, did
therefore abate the nuisance at a total cost of $3,723.16

SUBJECT: RECERTIfICATION OF SPECIAL ASSESSMENTS ON PARCEL 4800,
SECTION 11
DATE: SEPTEMBER 27, 1972
The County condemned Parcel 6660, Section ll for the Ice Arena. The
City then put in 71st Avenue over Parcel 6660, leaving a fifty foot
strip oP land along the north side of 71st Avenue. The fifty foot
strip is located irtmediately south of Parcel 4800 and owned by Minnesota
Transfer Railway Co. The railway company protested the assessment
because they said they did not fiave access to 71st Avenue. They
were technically correct on tfiis matter. An agreement has now been
worked out whereby the Minnesota Transfer Railway Co. will regain
title to the fifty foot strip and it xould 6e in order to recertify
the assessment.

Dear Mr, Henick:
September 6, 1972
In reply to your settlement offer, please be advised that I have recommended
and the plaintiff has agreed to accept the offer based upon the following
terms:
1. That the City of Fridley will reduce the amount of speciai assessments
against each of the lots as listed upon the recertification statements
dated November 23, 1970, and recent exhibit descrihing each of those
parcels prepared by the City of Fridley in an amount equal to 33-1/3�
of the,"specials" as listed therein.
2. The balance of the special assessments to be spread over a period of
years equivalent to the term of the improvemant bonds and payable with
the annual real astate taxes at the customary interest rate.
3. 1he City of Fridley will reduce the interest due and payab2e on the
subject special assessments by an amount equal to 33-1/3� of the total
interest obligation for the years 1970 and 1971 against the subject
parcels, and furnish plaintiff with a list sho�aing the amount due and
payable and the amount of reduction.
4. That neither James Gund or James Limd Construction, Inc. shall be
personally liable for the payment of any of the special assessments
due and owing againsi said praperty but such obligation shali be en-
forceable against the land only.
S. That the obligation to pay the balance of the special assessments sha12
be binding upon the plaintiff and any successors in title.
The foregoing is an outline as to what I have understood your offer to be at

tmless there is some offer of consideration to be paid by the City, we
see no reason why we should execute a Quit Claim Deed or release our in-
terest in that parcel since we are not receiving any consideration for
such action. Therefore, the above proposal contemplates including all
parcels as listed upon the aforementioned docwnents.
It has also been brought to my attention that the special assessments on
Lot T�o (2), Biock Three (3), Edgewater Gardens and Lot One (1), Rlock
Four (4), Edgewater Gardens have apparently been paid under protest and,
accordingly, it appaars that based upon your settiement offer that it
will prove to be necessary that the City issue a refund check to us for
a 1/3 reduction in the amount of speeial assessments already paid on
those two lots, which amoimts to a totai of $3,813.70 before the re-
duct3on.

Dear Mr. Qureahi:
Due to the increasing volume and speed of the traffic within the Melody Manor
development and the use of several residential atreets as thoroughfarea, I
should like to propose that the whole of Melody Menor be posted with a
residential apeed>limit, preferably not to be over 20 milea pez hwr.

At the same time I should like to requeat that each accesa road to the Melody
Manor development be poated with a Children Playing sign,
Residente in the area have expresaed increasing concern that there may be a
tragic accident because of [he high density of children in the area. The new
Stop signs recently installed, both at Lyric Lane and the Unity Hospital corner,
and also at 74th and Jackson have improved the situation slightly; however, this
has not significantly reduced the speed of the traffic through the area.

Mr. Holum makes a very good point in his letter of September 26. 1972,
and that is if the special assessments were reduced, he could buy the
lot for less money. This vrould also insure that the home he is
building for sale would have a larger lot.
bne probl'em with this is that the City would then be setting a precedent.
It would only be fair that every property owner in the City of Fridley
would then have the rigfit to request the same reduction on their special
assessments, based on what they feel the assessments should be in
relation to the selling price of the property. "

We recently purchased Lot 1 and 2, Block 5� Spring Broak Park
Addition� vith the intention of erecting a single family dwelling,
When we applied for a building permit, we were informed by the
Building Inspector that the city would prefer that we try to
utilize the adjoining Lot 3, We £ind that as of October 31� 1972
Lot 3 has $986,33 in assessments� back taxes and penalties levied
against it.
It ia ous contention that if this amount of money is going to be
added to the cost of construction, it would no longer be feasible
for us to utilize this property, However� we do feel that we could
abaorb one half of this expense and the city and coimty the remain-
ing half. The property could then again be on a taxable basis� no
long�er be considered a nuisance lot, and enhance the immediate are.=.,
2`he sixty feet (Lot 1 and 2� is large enough for a building site�
but as has been indicated to us� if the above can be accomplished�
this would be one less problem for the City,

' m. John Erickson Park - Commission discussed the development of John Erickson Park with
groups from Moundsview and Spring Lake Park. A request was made to Anoka County,
for their annual $2,OOO.DO Beach Grant for John Erickson Park. Apparatus area and
' paxk sign have beeq installed. The dedication program is pending• The $2,000.00
Beach Grant was received frqm Anoka County on March 27th, in a presentation made
by Commissioner Mike 0'Bannon.
� n. Fridley Jaycees Park Project - Commission met with J.C. President, .Adolph Kukowski,
to determine a park area for their volunteer hours and materials. Rice Creek Park
has been seleCted , but no act�on has been taken to date.

p. Fridley City Band - JoAnn Johnson presented the Summer Schedule to the Commission. -

program for 1972. He requested fencing for the Commons Football field.
'� r, Moore Lake Pollution Study - Brother Thomas Sullivan presented plans and the program
to study Moore Lake this Swnmer. The request for financial assistance was forwarded
to the City Council.
' s. Adventure Playground - Craig Johnson, University of Minnesota student, presented a
new concept for playgrounds to the Commission. - Completed.
' t, Oak Hill fark - Fence was requested by Mr. Walter Onerman to protect his yard from
balls. The City Administration has presented Mr. Onerman with a solution to his

to combat environmental pollutions. - Pending.

some of the parks this Fall, so that other fields could be used for practices. They
also requested that the Commission consider fencing the Commons field, in their 1973

that a member of the Locke Lake Improvement Association attend a meeting to discuss

a 14 week program, six hours a day, six days a week. The program has been cery
successful to date.

for an a�ditional tennis court. The Con�ission has reviewed the petition and
studied the park area iaith the following conclusions being drawn: There's no
