Lmpioyers Mutual three year no penalty bid for the retro-
spec[ive rating on a no penalty basis with a basic premium ef
514,139 a tninimum premium of $40,017 would produce a premium
of $69,083 at a 43X loss ratio and is clearly the best three
year retrospective plan available from the bids submitted.
Retroapective - one year no penalty plan - Plan II.
Employers Mutual's plan on a no penalty basis using a
hasic pre�um of $7,707, a minimum premium of $14,339 and
a maximum premium of $29,642 is the best one year retru-,
spective. The one year bid should not be considered in view
of the subatan[ial impcovement in fac[ors in the three year plan.
Federated Insurance through EaYl M. Commerstad did not
bid on the specifications but did present their "Variable
Dividend Plan" which is attractive because of its simplicicy.
Because of not having bid on comparable apecificat�ona and be-
cause there is no apparent appreciable benefit to the Clty ih
considering this, we have diaqualified Federated.
It is your consultants opinion that [he interests for the City of Fridley
Y cap best be protected at this time, by purchasing a three year plan. The
i variance of your loss ratios through the years, together with the questionable
k legali[y of commiting fwnds under a penalty retrospective p1an, causes us �
to recommend the acceptance of the bid of P. M. Endsley, the Slidin Scale
Dlvidend Plan in Fireman's Fund with a maximum three year premium of 584, 49.

Accepting a three year plan will permit the immc�diate institutio.^. of a
' workable safety plan and we would recommend thaf the insurance be purchased on
the proviso that Fizeman's Fund will guarantee a minimum of four safety
meetings annually and the institution of a safety program for the benefit
of the City of Fzidley.

Section 2 of the above entitled or6inance sha1l be amended as
Section 2. License Reguired.
1. No person, exeept wholesalers or manaiacturers to the extent authorized
vnder State Licens�, sha11 directly or indirectly deal in, sell, or
keep for sa2e any intpxicating liquor without first having received
a license to do so aS provided in this ordinance,
2. "On Sa1e" licenses sha11 be issued only to hote2s and restaurants.
3. No person shal2 se21 any intoxicating liquor on Sundays without
obtaining a separate license for said Sunday sales.
Section 7 of the above entitIed ordinance sha11 be amended by
adding subdivision 10 pf said sectionr said subdivision to read as follavs:
10. The annual license fee for "Sunday tiyuor Sa1es" sha12 be 5200.00. 2'his
fee �s in addition to the fee charged for an "On Sale" Iicense. a1I pro-
visions of this oz'dZnance pertaining to the "O» Sale" license sha1l apply

A RESOLUTION RELEASING CERTAIN TAX FORFEIT IOTS ENTIRELY, REQUESTING
EASEMENTS ON CERTAIN TAX FORFEIT LOTS TO THE CITY OF FRIDLEY AND REQUESTING
A DEED T� THE CITY OE FRIDLEY ON ONE TAX FORFEIT LOT
AND PUTTING A HOLO ON THREE TAX FORFEIT LOTS.
WHEREAS, The City of Fridley has reviewed the list of Tax Forfeit lots, sent
it by the County Auditar,
WHEREAS, After rev�ew, it has been determined to put no hold on most of the
lots,
NOW, THEREFORE, BE IT RESOLVEU, That the following listed lots are hereby
considered not needed by the Gity of Fridley and released by the City for sale
by the County of Anoka, sub,ject to the provisions of MS 282.08 which provides
that the net proceeds of the sale shall be apportioned by the County Auditor as
follows:
(1) Such portion as may be required to pay any amounts included in the
appraised value under secti0n 282.01, subdivision 3, as represenk�ng increased
value due to ar�y public improVement made after forfeiture of such parcel to the
state, but not exceeding the amount certified by the clerk of the municipality,
shall be appartioned to the municipal subdivision entitled thereto;
(2) Such portiqn of the remainder as may be required to discharge aRy
special assessment chargeable against such parcel for drainage or other purpose
whether due or deferred at the time of forfeiture, shall be apportioned to the
municipal subdivision entitled thereto; ....

The Metropolitan Sevrer Board has proposed a nea� method of collecting
charges from municipalities. Part of the charge wi11 novr be based on a
"SAC" or connection charge. In order to t�ll tiahat af�°ect the "SAC"
charoe would have on the City of Fridley, I have orepared material sno�vinct
what the charges to the City of Fridley t-�ould have been if the "SAC° charge
had been in effect during 1971 anci 1972, I have also made a projection for
the year 1973.
If the "SAC" charge had been in effect during the year 1971, a total of
$338,918.00 would have been charged to tl�e City of fridley. Under the
previous method or" billirg a total of 5307,E�}6,00 o-ras charged io the City.
This is a difference of y�81,072.00. The previous method of billing
included an item called "Deferred Cnarges" in the ariount of $39,202.00.
This charge was in the form of an advance to otfier comr;aniiies ir the
area. Theoretically this money 4•io�ald have been returned to the City of
Fridley at some future date. Tnis has the affect of further ircrzasing
the difference between the taao rnethods of billing.
For the year 1972, the City was bi]led $364,007.00 under the previous
billing policy. It is estimated ihat the City �•rould 'nave paic! $407,421.3�{
if the "SAC" charge has been in erfect during 1972. TLe previous method
of billing included 321,052.00 in "Deferred Charges" �.vhich theoretically
would have been returned to the City of Fridley at so�Te future daie.
I have made an estimate of the year 1973 based on estimated "SAC" charges
at the sam2 levei as 1971. This sho�as that under the previous method
of billing the City would have paid S324,61&.00. la�ith the °SAC" charges
in effect, and usiny the 1971 connections in the compuiatiors, the City
would be billed $412,500.00 for 1973,
Included in the 1973 bill using the previous method of billing is a charge
of �21,000.00 for current ,year cieferred charges, o-�hich as e�plained
earlier, is a charge that a�ould 'oe returned tc the City at some future
time.
The 1973 bill contains to-�o, one ti!rie CdSfl CPSd;ts t�rhich ti?e City ;:ould
, receive regardless of :rhich method of biljing is used. These credits
were in the a�nount of $�2,092.00 ;or the ;,brtii Suburban Sanitary Se4;er
District and a casii credit of �,19,522,Or as an adjustment on
' the 1971 bi11. As stated, these are ene time casn creuits and �rill not be
recurring on future b;11s, They would be given renardless of �,hich method
of bi]ling �;ere used.

In order to have some idea of what the "SAC" charges would cost the City
in the future, one could use the Me�mr:oli*an Se�aer Goard's estimate of
the increase in ti�e sewer flow for the City of Fridley for the next
fifteen years. Their estimate is tiiat thcre would be an increase of
270 MGD for the fifteen year period. This is equivalent of 2,700 one
family housing starts, or an equivalent am�unt of co�:,n:��rcial and
industrial construction. 6ased or an average "S(�r_° charc�e of 5358.00,
this would cost fridley $966,600.00 over the �'ifteen year period or an
average of $6�r,440.00 per year. For the thi- y year perio�, the increased
flow is expected to be the equivalent of 5,6sU one family housing starts.
Using an average connection charge of 5375.00, this would cost the City
$2,101,250.00, or an average of $70,375.00 per year. One word of caution,
for the "SAC" charge to be reduced to an average of �64,440.00 �er y2ar
would mean that construction activity for the fifteen year period would be
approximately one-third of what it has been for the past few years.
The items that change on the sewer bill with the new method of billing
are the reserve capacity �harges and tl�e current deferred charges. All
other parts of the bill would remain the same. Substituted for the reserve
capacity charges and current year deferred charges would be the "SAC"
charges.
The City should keep in mind that regardless of which method of billing
the Metropolitan Sewer Board uses, the City has the option of collecting
the money in any manner it chooses. That is, it could cplleCt ail the
money from current u5ers, or put part of the cost on a connection charge
basis and part on a user basis. As an examole, Coon Rapids has been
collecting $150.00 per connection for several year5� and uses the money
collected to help pay their operatinq costs.

LAW SUIT ON SAC CHARGES

The following communities are row part of the law suit on SAC charges:
Brooklyn Center, Columbia Heights, Edina, Golden Valley, Plymouth, Robbinsdale,
White Bear Lake, Hopkins, Maplewood, Forest Lake, Burnsville and St. Anthony.
The following communities are still considering.the matter of whether they
want to be part of the law suit: North St. Paul, South St. Paul and Fridlev.
One of the contentions of the group which has filed the law suit is that the
new formula penalizes the developing communities or inner ring suburbs. Among
the reasons advanced for this is as follows: The SAC charges or reserve
capacity charges, which the SAC charges replaced, are primarily for the retire-
ment of bonds. The portion of the bond payments that is to be picked up by
SAC charges is determined by the ratio of unused capacity of the lines to
design capacity. As an example, if $10,000,000.00 in debt service were
required for the current year, and current flow occupied sever�ty percent of
the capacity of the facility, seventy percent of the charge would be put on
current users and thirty percent on SAC charges.
Developing communities in paying the SAC charges are paying the bulk of the
cost of new construction. This also has the effect of reducing the reserve
capacity charges, or reducing the percentage of reserve ca�acity and of
increasing the percentage for current use. The developing community is
adding each year to its current use even though it is paying the bulk of the large
connection charges. Eventually the community will have paid a substantia7 amount
in connection charges and also will pay for a percentage of the bonus forever
until they are retired under the current use category. As new 6onds are sold,
the split is made on the same ratio, tha*_ is, the ratio between current use and
unused capacity so that the people who paid the connection charges nf $275.00
wilt also help to pay a large percentaye of new bonas sold for construction.

NEWS RELEASE
MUNICIPALTTIES FILE LAW SUIT AGAINST THE METROPOLITAN COUNCIL AND SEWER
BOARD IN NATTER OF RESERVB SEWER CAPACITY CHARGES
Plymouth Mayor Al Hilde and Brooklyn Center Mayor Phil Cohen, spokesmen
for those municipalities opposed to the new SAC sewer charge formula adopted by
the N4etropolitan Council, announced filing of a law suit in Hennepin County
District Court challenging the Metropolitan Council's authority and decision.
In proceeding with the court test the mayors pointed out that the author of
the Metropolitan Sewer Bi11, State Senator Robert O. Ashbach, appeared with them
before the Metropolitan Council's Referral Committee to testify that the proposed
alteration to the �ewer charge formula was inconsistent with the intent oi ttie
law and that such change could only be accomplished by the legislature.
In addition to the communities named as plaintiffs in the law suit, it is
expected that other communities aggrieved by the Metropolitan Council action will
enter the suit as interveners.
The mayors emphasized that the legal action is the last possible recourse at
this point of time, having exhausted administrative appeals which were rejected by
a majority vote of the Metropolitan Council. The rejections followed offers from
municipal officials to work with the Metropolitan Council and Sewer Board in
developing a more equitable formula for presentation to anci adoption by the State
Legislature. Such pleas also were summarily reJec'ted by a majority of the
Metropolitan Council members and Sewer Board.

Mayors Hilde and Cohen stressed the irony of having to seek legal
recourse to require appointive structures such as the Metropolitan Council
and the highly insulated Metropolitan Sewer Board to conform to the provisions
spelled out by the State Legislature.

Mr. Erickson aeked if the old building had been cheSked.
Mr. Mugg�i said the old building is in A-1 condition. IC is about 25'K2p'

MOTION by Erickson, seconded by Zeglen, that the Planning Commission
waive the reading of the Pw'�lic Hearing Notice for the request for a Speci_al
Use Permit, SP #F72-16, by phillips Fetrolewn Company. Upon a voice vote, all
voting aye, the motion carried unanimously.
Mr. Palmquist explained that they would like to take the existing North
bay and install a mini-avto car c�ash. To avoid remeving tl�e rear �aall, they
would make a drive-through stall. The c2rs a*ould enter from the West side
and exit on the E2st side. hlodification to the buil.din� would consist of
installing an overhead door. This would be one of these smaller car o.ashes
operated by one individual. It probably would be a free car wash �•rith a fill
of gasoline.
Acting Chairman Fitzpatrick asked if it would be open to the pub].ic if
they did not purchase gasoline. Mr. Palmquist said they u�ould not have a
charge for the car wash, but it would be tied in with the gasoline sal�. .
Mr. Zeglen asked what a fill meant.
Mr. Palmquist said whatever it takes to fill the tank.
Mr. Zeglen asked what was so wrong about having the cars go in from the
back of the station and go around to the front.
Mr. Palmquist answered that the management would rather have them co�ne
from the West and go out to the East.
Mr. Fitzpatricic said if they came in from the tdest, they would be exitin�
' as they do now from the pu�p. He added that the intent is then to have the
people in for gasoline and leave the pump for the car wash.
' Mr. Palmquist said they were trying to educate tnem to use the island on
Mississippi and have them go through to the North and enter on the West side
of the building.

Building: He said that the Shopping Center is opposed to the Special L'se
Permit, as the car wash would just add to the traffic problem. The main con-
cern is the ingress and egress. Three or four cars backed up would bloc'.c a
number of the accesses. There isn't enougn room. There would be blockin� cz
traffic on the frontage road and on either side of the station.
Mr. Palmquist ans�oered that this is the tyPe of car ccash in the Silliag
station at Interstate i,�694 and Universi.ty Avenue. These w;ashes do not ��nerate
this type of Lraffic.
Mr. Klaverkamp felt they could easily have four to si;: cars c�aitinr, but
there wouldn't be room for this kind at Chis station. There is a uniyue
situation of the fron[age roau surrounding the station.
Mr. Palmquist said the buil.ding itselY is 45 feet wi�_L stacl:ing for sis
cars. The access to the service road is on tiie South side of ttie proper.ty.

The e�lanatien was that there is an access as sho�an on the Southeast cor-
ner just off L'niversity. Another entrance is just off Mississippi. o^ the Soutl:-
west corner and a third access on the Northeast- corner of the lot. Mr. C7ark
then asked Pfr. Palmquist if Phillips Petroleum was considering closin; ofi the
access on the Southwest corner of the property. His anscaer was "no".
Mr. Clark said one opinion caas that there is the possibility of peeple
trying to get in the station on the South�•*est cor.ner if they can't �et on to
the lot because of cars backed up. This could affect the traffic on the
service drive. There is quite a bit of difference in stacking room if }�on
eliminate the Southwest entraace.
Mr. Fitzpatrick said that if the people are encouraged to use L-he Ea>tern
access, should the Western be closed off?
Mr. Clark said that the concern o;ould be the probability of so:�een� bac'.:ir.�
out on the service drive. This type of car wash that we have seen in tiie City
does not have a large volume of traffic.

is basically on Lot 5 and part of Lot 6.

Mr. & Mxs. Hayes� owners of the property acrosa the railroad tracks were concerned
about accesa to their property, Mr. Windhurst and Mr. Castner discussed this
matter with them in private and the Hayes atated they had no objections to the
variancas being granted.
The Boyera, reaiding aC 159 Longfelloco Street, south of the proposed parking lot,
aeked about fencing and screening be�ueen the two properties.
Mss. Straub, owner of the property on the West side of the proposed parking lot,
naa concerned about the pazking lot being adjacent to her apparently builda6le
60 foot lot and wheCher the pxopoaed addition would mean more employee parking.
Mrs. Straub also asked that any notices be mailed to her residence at 3141 Clinto�i
Avenue, Minneapolis.
A discussion zegarding the alley on the south revealed that the applicant
aaeumed the alley was only a utility easement so they had asked for a variance
of rear yard reduction from the required 25 feet to 5 feet. A review of the
old aurveys, the hali eection, aerial photo and a photo looking west at the
alley indicates the alleyi abthough inactive, has not been vacated, and that both
the applicants building and the frame shop are on or pear the alley property li.nes.

WHEREAS, The Commissioner of Taxation is in the process of
issuing rules and regulations regarding local government levy
limitations, and
WHEREAS, Rules and Regulations Relating to Local Government
Levy Limitations, Tar, L.L. 14 and 15 appear to give the Commissioner
of Taxation undue discretion to determine the types and levels of
services to be provided by municipalities, contrary to the letter
and intent of Extra Sessions Laws 1971, Chapter 31;
NOW, THEREFORE, BE IT RESOLVED, Ti�at the Council of ±he
City of Fridley is cpposed to the adoption of any regulations
which would permit the Commissioner of Taxation to exarcise undue
discretien in determining the types and levels of services to be
