The Regular Council Meeting of the Fridley City Council was convened at
7:45 P.M., June 19, 1972.
PLEDGE OF ALLEGIANCE:
Mayor Liebl led the Council and the audience in saying the Pledge of
Allegiance to the Flag.

The City Manager, Gerald R. Davis, of£ered the Invocation.

Certificate. Mrs. Wegler was not present, so Councilman Mittelstadt volun-
teered to deliver her Certificate to her. The City Manager was directed to
mail Mrs. Kelshaw's Certificate.

OFFICE OF ASSISTANT CITY MANAGER/PUSLIC SAFETY DIRECTOR AND AUTHORIZING
DUTIES FOR SAID POSITION:

CONSIDERATION OF REZONING REQUEST ZOA #72-04 SY LEIGH INVESTMENT, INC. TO
REZONE FROM R-1 (SINGLE FAMILY DWELLINGS) TO CR-1 (G�NERAL OFFICE AND LIMITED
BUSINESS) - 63RD WAY AND EAST RIVER ROAD:
Councilman Mittelstadt said there were a number o£ opta.ons open to the Council
in �his case. The first would be to approve the rezoning to CR-1, however,
at the public hearing there was a petition presented to the Council statiny
the majority of the property owners were opposed to the rezoning. He said
through a survey he made, their concern is that if CR-1 is allowed here,
there would be adda.tional requests for commercial and they fear the area
between 61st and Mississippi would gradually become a commercial area. They
also £ear that the Planning Commission's comprehensive plan will describe
this area as a commercial area. He said in talk�nq to these people, he tried
to supress these fears. Another option would be to allow the business in a
residential area with a special use permit providing the applicant lived
� there, but he bela.eved Mr. Doyle did not plan on living in this dwelling.
Another option would be to send the request Uack to the Soard of Appeals £or
a variance on the gsc�unds this would be a hardship. He did not feel this was
a valid consideration because the Board oP Appeals is a subcommittee of the
Planning Commission which already denied the request. The last option open
to the Council would be to change the Code to allow special use permrts to be
given in residential areas. This, it would seem, would bring a flood o£
requests. He said as to the question of whether or not to rezone to CR-1,
because these people are opposed to the rezoning and this is a representative
form of government, he did not feel he could approve the request.
MOTION by Councilman Mittelstadt to deny the request of Mr. John Doyle of
Leigh Investment Ine. to rezone from R-1 to CR-1. Seconded by Councilman
Breider for discussion.
Councilman Breider asked if it would be possible to issue a special use permit.
The Acting Czty Attorney replied no, not under the present zoning. Mayor Liebl
asked iP it was rezoned to R-2, could a special use pexmit be given. It seems
the people are opposed to the rezoning, but not the use. The Acting City
Attorney replied no, there is no provision in the Code for special use permits
under the residential zoning categora.es. He then read from the Code Bwk the
uses that would be permitted under R-2 wx.th a special use permit, none of
which are strictly a commercial venture. The only way this could be allowed
under the Code woul d be if the applicant lived in the dwelling.
' Councilman Breider said that his impression at the public hearing was that the
people were concerned with their neighborhood, not knowing in what da.rection
they were moving. The system used for issuing special use permits creates
tight controls over a building. In this case if the zoning were to remain
the same, but the use was permitted wath a special use permit, if and when the

use ceased, the building would revert back to R-1. This type of business �
would suit itself toihe area along East River Road and he said it bothexed
him to have something that could be worked out but it could not be done without
changing the ordinance. He wondered if this particxzlar case did not point up
the need to take a closer look at the special use permit section o£ the Code
Bopk. He said he shared the resident's concern, he would not like to take a
small chunk out of the middle of their neighborhood and rezone it to commercial.
The Acting City Attorney said that their office is in the process of recodi-
fication of the Code Book, so if the Council is thinking in terms of a possible
change in this direction, it should be done so that it could be incorporated.
They hope to have the recodification done by September lst. He suggested the
Council may want to table this item, as if it is denied the ordinance precludes
another application £or a rezoning for six months. Councilman Breider said
that would not apply to a special use permit application, which could still
be made. He said he did not think any of the Council members are considering
a zoning change, but are working toward a special use permit.
THE VOTE UPON THE MOTION, being a voice vote, all ayes, Mayor L1eb1 declared
the motion carried unanimously.
Councilman Breider asked the Acting City Attorney to work on this special use
permit situation, not only £or this case but for others in other areas where a
special use permit would be satis£actory but a rezoning would not. The Acting
City Attorney said he would meet with the Staff.
ORDINANCE #515 - AN ORDINANCE FOR REZONING REQUEST ZOA #71-08 BY GENERAL REALTY �
COMPANY, LOTS 16-22. BLOCK 13. HAMILTON'S ADDITION TO MECHANICSVILLE.
The City Engineer refreshed the Council's memory by saying this rezoning is to
bring a gas station out of a non-conforming use. It has been in R-3 zoning,
which was allowed at one time, but is no longer. Their concern is if the station
burned, they could not rebuild. The second reading has been held up until a
letter is received from the petitioner stating they will pay their share of
paving the alley. This letter has now been received.

Councilman Mittelstadt suggested, since the Council has no ob�ection with the
unzts themselves, that the discussion center around the addrtional parking and
the garage location. Mayor Liebl asked how things were progressing with New
Brighton. Mr. Darrel Farr replied that they have been meeting with New Brighton
and are getting much closex, the only snag now is density. Mayor Liebl said he
realized Viewcon is trying to utila.ze the natural terrain as much as possible
and preserve the existing amenities. The Council requested a new plan £or the
quadraminiums, which they have drawn. He asked a.£ he would foresee any traffic
problems with the present layout. Mr. Farr said that he thought any traffic
problem would be more serious in the existing townhouse area In the quadra-
minium area there is a garage plus a parking space £or each unrt, with no
tandem parking. Mayor Liebl said he felt the layout of the street fit into
the area, and that he was concerned about the stability of the street, but Viewcon
has taken into consideration utilizing the ex�sting land and qreen areas avail-
able to them.
� Mr. Farr said yes, the street follows a natural ridge and will be double loaded
with houses on both sides. He said it would be very difficult to build any
other way, and still maintain the natural amenities. Councilman IItter said
his concern was that the garages were so close to the street that when a car
would back out of the garage, he would actually be into the street when he
was about '� way out of the garage and there would be poor visibility. In the
winter time when the snow is piled high, the yroblem would be greater. Mr.
Farr said that this could be considered more like a parking 7�ot in an apartment
complex and that it was actually a private street. Councilman Utter said with
60 units, therr could be up to 120 cars. Mayor Liebl said these streets would
not be plowed by the City of Fridley, but would be maintained by the Home
Owners Association. The City would still have to get in in case of fixe, but
there is this problem in other areas, and added that a fire truck could not
turn around on his street either.
Mr. Farr said there were other choices availal�le, but they felt this was the
most desireable layout. If the garages were moved back, more green area would
be lost. This is a very difficult area to work wrth. To develop any other
plan with anything other than a double loaded street would wreak havoc with
this location.
Councilman Utter asked what was the wa.dth of the street and a Representative of
Viewcon replied 24 £eet, with the garages set back 5 feet. Counca.lman Brea.der
askec] what was the distance between garages across the street and Mr. Farr
replied 34 feet. Mayor Liebl said this would give enough room to move around
' much like at the Georgetown complex. It was pointed out that there was
curbing extending out into the street to delineate each parking stall between
the garages. Councilman Utter asked how wide these islands were and Mr. Farr
replied 8' - 1D'.

Councilman Mittelstadt said he £elt this was a better plan than the last one �
presented, but he was still concerned ahout the tra££ic situation. You would
have the public going through this area out of curiousity because it is a new
concept, plus the residents trying to back out of their garages into the
street. Mr. Farr said that would be true, but no more than a normal townhouse
development. The City Engineer said with the townhouse pro�ect there were two
garages plus one stall and in this pro�ect there are only two parking spaces,
and any additional cars would have to park in the street. He felt the garages
should be moved back so there would be 10 £eet clearance, so a persan could see
before entering the tra££ic. He £elt they needed more parking spaces and added
that these units are Zess expensive than in the townhouse complex. Thas zs
the same plan that was submitted to the Council a Pew weeks ago, the only
difference is that it is colored so it is easier to visualize. Councilman Utter
said that the Council had requested that they work on getting additional
parking spaces to get the cars off the street two weeks ago, so that if there
was a fire, the truak could get down the street. The City Engineer said that
he would work with them to get some additional parking spaces and to try to
get the garages back 10 feet from the curb. Mr. Farr said that could probably
be done, but the grades are difficult and to put in more parking would sacri-
fice green areas.
A reporesentative from Viewcon said there were two reasons for choosing the layout
they are proposing. The fa.rst is that the street £ollowing the ridge would be
cheaper and it would be easier to put in the utilities, thereby keeping the cost
o£ the lots down. The second is that they are extremely reluctant to push down �
the trees to create an additional 8- 10 parking spaces. This would destroy
the soft residential £eeling they are trying to achieve.
Councilman Breider said that it seemed to him that this type of housing would
appeal to young people and to the older people whose children have grown and
left home. In both cases, it would be likely both would work which would mean
two cars. If this is the case, where would visitors park? Mr. Farr said he
believed there would be less people having two cars than in a single £amily
development. He thought there would still be room for guest parking. Council-
man Breider said it would be a fair assumption that there would be at least
two parties per weekend. Mr. Farr said he did not believe they would average
two cars per unit.
Councilman Mittelstadt said this was all discussed two weeks ago and he thought
they were to bring back a new plan with more parking, but it is 7ust the same. It
would seem they �ust wasted two weeks. The City Engineer explained for the purpose
of comparison, i£ this was an apartment building, the requirement would be two
parking spaces for every two bedroom unit. Mayor Liebl did not think this could
be thought of as a public dedicated street, it is a private road only for the
residents. He asked if there were any problems with Georgetown. The City
Engineer replied not that he knew o£.
MOTION by Councilman Utter to table this item to July lOth, and asked the City
Engineer to work with Viewcon to try to arrive at a better parking facility
and to try to get the garages moved back from the street further. Seconded �
by Councilman Breider.
Mayor Liebl said that the result of this motion would be to make the lots cost
more, and asked is that what they want? When this overall concept was approved,
he did not want only the people that could afford to pay $400 a month for housing,

� that would be discrimination. You have to provide housing £or all qroups of
people. He guessed this revision would raise the cost per unit $SOD -$600.
Mr. Farr said he failed to see the difference between a"rental" townhouse
pro�ect and a"sale" townhouse pro�ect. He said Viewwn could make the street
as wide as the City wants it, but it would ruin the site. Councilman Utter
said he would hate to see the beauty of the site lost, but he was afraid they
would be hurting themselves in the lony run.
Councilman Mittelstadt said that he would vote against �he motion because,
although there is a question on the parking, the preliminary plans for the
units themselves are sata.sfactory,and could be approved tonight. Mayor Liebl
said he would not want to see a pro�ect where all the units look alike. He
wanted this development to proceed using the natural terrain. He said he
agreed with Councilman Mittelstadt, the qua2framiniums could be accepted, and
Viewcon could be instructed to work with the City Engineer on the qarage and
parking problems.
The City Engineer explained this is preliminaxy approval, if the Gouncil approves
the plans, they qo back to the Planning Commission for their final approval and
recommendations. Then the plans go to the Building Standards - Design Control for
theix recommendations, so the Council will have to see the plans at least once
more. He suggested the Council could require an additional 15 parking spaces,
this would be 2a spaces per unit, so if there were a couple of parties on a
weekend, the guests cars could be accommodated. The garages could be set back
� 10 feet rather than 5 feet from the street. When this is accomplished, the
plans could be sent back to the Planning Commission £or their final approval.
Councilman Breider o,ffered to withdraw his second to the motion, if Councilman
Utter wa.shed to withdraw his motion. MOTION WITI-IDRAWN BY CGUNCILMAN UTTER_
MOTION by Councilman Breider to approve the preliminary plan of Phase I(quadra-
miniums) requested by Viewcon Ine., with the stipulation that 15 addrtional
parking spaces be provided and also that the garages be moved back from the
street approximately 10 feet. Seconded by Councilman Utter.
MOTION AMENDED by Councilman Mittelstadt to leave the number "15" open, and
leave that to their discretion. It may turn out to be 12, 14 or 16 depending
on the terrain.
Mayor Liebl called £or a second to the amendment, received none, therefore
AMENDMENT DIED FOR LACK OF A SECOND.

REZONING REQUEST ZOA #72-03, THE WALL CORPORATION BY DENNIS MADDEN (RIEDEL
ESTATE): Rezone from R-1 to R-3 for townhouses and apartments.
The City Engineer reported that the Planning Commission recommended approval.
Mayor Liebl said he would like to look at the plans, and the City Engineer
brought them £orward to the Council table. He said along 7th Street and
Mississippi Street, they have provided townhouses as a buf£er with the apart-
ments on the Sth Street side facing City Hall. The apartments would be 2i
stories high and are situated on the lower elevations. Mayor Liebl asked how
many units would be facing 7th Street and Mississippi and the City Engineer
replied 63, w�th 1D5 apartments along 5th Street.
MOTION by Counczlman Mittelstadt to set the public hearing for July 17, 1972 to
hear the rezoning request by the Flall Corporation. Seconded by Counczlman �
Breidet. Upon a voice vote, all ayes, Mayor Liebl declared the motion carried
unanimously.
The City Engineer reported the second item (rezoning request ZOA #72-05 by

AN ORDINANCE 71MENDING SECTION 45.103 RELATING TO THE LOT AREA AND LOT
WIDTH REQUIREMENTS FOR C-1, C-15, C-2, C-2S:
MOTION by Councilman Sreider to instruc� the Administration to submit the
ordinance for Council consideration on July 10, 1972. Seconded by Councilman
Mittelstadt. Upon a voice vote, all ayes, Mayor Liebl declared the mmtion
carried unanimously.
SUILDING PERMIT: A-1 MOTOR SPORTS BY MS. VICKT S.�IFF: Lor.s 13 & 14,
Slock 2, Commerce Park, £or snowmobile salus and service.
The City Engineer reported that the Planning Commission's opinion of this
xequest was that it would not fit the critexia for CR-2 zoning, and that a
rezoning and a special use permit would be required for her to conduct the
business she intends.
Mayor Liebl asked what type of businesses would fit in the CR-2 district. The
City Enga.neer read £rom the Code Book the uses permitted which includes
"business machine repair shops". Mayor Liebl felt this request could fa11
under that category. The City Engineer said there is a£ine line of distinetion
and the key to this da.strict is "---Limited business uses o£ essentially a
non-retail or service nature requiring a minimum o£ access by the general
public---". In this case there would be traffic £rom the general public. It
is a matter oP interpretation, and the Council had instructed that this request
by sent back to the Planning Commission for their opinion.
The Acting City Attorney said that in lookinq at this area, there is light
industrial, the Post Office, Fridley Auctions and a veterinarian's oPfice all
nearby. There are no doctor's dentist's or real estate offices in this area,

which was why it was conceived; to be a huffer between the industrial and the �
residential across the street. Perhaps a rezoning is the answer. Councilman
Utter said that actually there are quite a few business places up there but
not much flow of traffic. In going by Totino's, there is no steady movement
of trafPic. The Acting City Attorney said that most of the traffic is just
at the ending and beginning of a shift.
Mr. Gordon Jensen, Attorney for Ms. Vicki Skiff, said that the main concern
seems to be what type o£ operation they are planning. They £eel they are going
to be a service type of business. The snowmobiles wi11 all be tested using a
dpnometer, so there will be no outside testing. To the rear of thls lot is
an industrial area, to the north is the Post Of£ice and the Fridley Auctions.
The traffic would only be people bringing in their snowmobiles for repairs,
and this should give no problem because both 73rd Avenue and Osborne Road are
controlled intersections. Their customers would be working people that would
have to bring in their snowmobiles after regular workang hours. As to the noise
pollution, they also are concerned ahout that. There is a nice residential
neighborhood across University Avenue to the east, but there is noYSe generated
from University Avenue, to the west there is manufacturing and to the south
there is vacant land, so they do not feel they could possbily disturb any
residential neighborhoods. He said the property owner to the south has no
ob7ection to their use. If the Council would wish to place stipulations on
them to control any noise, they would agree to this.
Mayor Liebl said that he believed this business would £it under the CR-2 �
category as the Code states machine shops. The Council could still stipulate
that any noise would have to be controlled. He said he would not want to be
arbitrary in making a decision. IP the use falls within the zoning district,
the Council would have to grant the permit. He then asked the Administrative
Assistant his opinion on whether the applicant could fall within tlie CR-2.
The Administrative Assistant said he did not balieve the CR-2 district would
exactly fit what the applicant wants to do. There is no more than 25o retail
sales allowed, and the applicant has said that they w�ll have up to 400. Sf
this business is allowed into CR-2 zoning, it would change the direction the
City has been moving toward, and in that case, perhaps another look should be
taken at this section af tkie ordinance, not only for this area, but for the
whole City. He added that the Post Office has been mentioned, however, govern-
ment uses are allowed under CR-2 2oning.
Nlr. Sensen said he did not see any category in the zoning ordinance whiah
specifies snowmobile sales and service, the closest seems to be CR-2. Mayor
Liebl said he would disagree if this was close to a residential neighborhood,
however this is a commercial area. I£ this request is denied, it would set a
precident for the rest of the area. He would not want to over-burden a certain
area with too much traf£ic at any certain time o£ th� day, but this would fit
nicely.
Councilman Mittelstadt said he would agree this would fit wzthin the CR-2
zoning, except that they have stated they intend to use about 40°s for sales area
and the Code states no more than 25%. Mr. Jensen said they hope to operate a �
business with the sale of boats and snowmobiles covering approximately 400 of
the total area, It will be a 50' X 60' building with a pro�ection of adding
onto the west side in the spring. During the summer they would be selling
boats, these are bulky items so not too many could be displayed. The display

� area required £or the sale of boats can not be compared to that needed for the
sale of mixers, toasters, etc. They do not want any outside display as these
are expensive items. Ms. 5kif.f is not planning on trying to cut costs, it
will be a nice building which would employ about 6 people, 4 for the sexvicing,
1 for the office and one for operating the sales area.
Mayor Liebl asked if the walls between the sales and service area would be sound
proofed. Mr. Jensen said yes, there would be work going on in the service area
at the same time someone is trying to conduct a sale.
Councilman Breider asked what percentage of their business would be the drive-
in type. Mr. Jensen said he did not know, but they expected that the snowmobiles
needing repair work would be brought in on trailers. The snowmobiles would not be
tested by ra.ding around in the .£ields. Councilman Breider said that he sees
snowmobiles going up sidewalks, across the highway where they are not supposed
to cross, and he would think this would be true here also, Tf someone needed
a minor repair, they would ra.de the snowmoba.le to the repair shop. Councilman
Mittelstadt said that about 900' £rom this site is a ma�or snowmobile trail
and as soon as people know the shop is there, they would ride over to get a
part and this would pxobably amount to al�out '� of their business, if not more.
The Acting City Attorney sazd whether that be true or not, it cannot be used as
a reason for denial. Councilman Breider said he did not feel this type of
business would fit into a CR-2 zoning, that he was not prepared to turn CR-2
into a snowmobile outlet and that he agreed with the Planning Commission 1000.
Mr. Jensen said they do not mean to run a commercial outlet.
� MOTION by Councilman Breider to concur with the Planning Commission's opinion
that this use Ms. Skiff is proposing does not conform wrth the a.ntent of CR-2
zoning. Seconded by Councilman Mittelstadt. Upon a voice vote, Utter,
Mittelstadt and Breider voting aye, Liebl voting nay, Mayor Liebl declared the
motion carried.
Mayor Liebl said he would like a resume submitted to the Council in regard to
CR-2 zoning. The Council must be consistant, and he said he was not sure he
agreed with how the rest o£ the Council feels. I£ there are similar requests
in the future, the Council had better be sure they do not act contrary to
what was done this evening.

WNSIDERATSON OF REQUEST BY MARVIN O'BERG FOR DELETING BALANCE OF PENDSNG
ASSESSMENT5 FOR CIRCLE FLOW IN HYDE PARK AREA (PART OF T H. #47 SLIP-OFF):
Mayor Liebl read the four points contained in the letter from Mr. & Mrs. O'Berg
dated June 14, 1972 aloud, and commented that he understood Y.he O'Bergs have
about $2000 in escrow because of the pendinq assessment.
1 The City Engineer explained the Council approved the slip-o£f and circle flow
pattern by Resolution #194-1979, later they approved the installation of the slip-
o££, but held off on completion o£ the circle flow, and that is still a pending
assessment. Mr. & Mrs. O'Berg would like to know i£ the City still plans on the
impro��ement, if so when, and if not a.n the near Puture, they would like their

money back out of escrow. If the Council wishes to release the money to the �
O'Bergs, the only way this could be done is to rescind Resolution 194-1969.
Mayor Liebl asked what has been the past policy and the City Engineer said
that once an improvement a.s ordered in, the matter is taken out of the Council's
hands, and it is the lending institutions that require the money be placed in
escrow.
Mr. Ken Strand, 6801 Oakley Street N.E., said he was also involved, and he could
not get h�s money back either until the Council rescinds their previous order,
The City has not set a date for completing the project, it could be 20 years
from now, and in the meantime, their money is setting there earning no interest.
He would like to get a date set when and i£ the project is going in. Mayor
Liebl said that the resident's money is in escrow, not drawing interest, and
they should have some sort of a deadline indicated. He said the Council has
an obligation to everyone selling their prol�erty for development so these
people should be notified, perhaps a hearing should be held so a final decision
could be made this year. Councllman Mittelstadt said this has already been done
over the past 2-3 years. The Council already approved the plan, now the only
thing needed is a date to get started.
Nirs. O'Berg said that it is not known at this point what type of commercial
will be going in, the taxes axe very high, and she did not think they would
realize what it would cost them. It may be that they would only need an entrance
and exit and would not want the whole pro7ect. She said with things in a state
of limbo, there is no point in trying to keep their houses nice. She asked
why not drop the plan entirely until a developer comes in� Mayor Liebl �
thought the people should be contacted to see whether they wanted the circle
£low pattern. Mr. Frank Gabrelcik said he did not think the people would be
in favor of the rest of the improvement because of the cost of the slip-o££.
Mayor Liebl said he would like to hear what the rest of the property owners
think, only three are represented tonight and there are about 40 involved.
The City Engineer said that the State has already given their approval of the
plan based on Resolution #194-1969. Fridley would have a problem with them if
the plan was amended without their concurrence. The land is not moving as fast
as expected, so he suggested a date could be set, such as 1975 as a realistic
figure. At the end of that time another public hearing could be held.
Councilman Breider suggested laying this over until the July lOth Meeting to
see what the feelings of these people are. Councilman Mittelstadt said he would
conduct a personal survey of the nezghborhood, and he wanted the Council to
know that if they did not want the mrcle flow, he would act in accordance,
and if the plan were to be delayed until 1978-1979, he really could not see
waiting that long.
Mr. Strand said that when Councilman Mittelstadt goes down to talk to the
people, he should have some figures availahle, including the probal�le cost in 1975.

CONSIDERATIOPS OF APPROVAL OF AGREEMENT WITH FRANK GABRELCIK FOR i3SED CAR LOT
LICENSE:
MOTION by Councilman Mittelstadt to approve the agreement as found in the Council
Agenda June 19, 1972. Seconded by Counca.lman Utter. Upon a voice vote, all ayes,
Mayor Liebl declared the motion carried unanimously.
RECEIVING MEMQ FROM FINANCE DIRECTOR IN REGARD TO CHANGING PRECINCT LINES TO
CONFORM WITH LEGISLATIVE LINES:
MOTION by Councilman Breider to instruct the Administration to change the precinct
lines within the ward boundaries so that no one precinct falls within two
legislative districts, and to research the state law to see if this can be done
before the fall elections. The motion was seconded and upon a voice vote, all
ayes, Mayor Liebl declared the motion carried unanimously.
