SUBJECT: GOLF COURSE, NATURE CENTER FEASIBILITY STUDY

Councilmaa Breider and I have met with Donald Brauer, president of Brauer aad
Associates, and requested that he submit a proposal to do a feasibility study of
North Park, which is enclosed for your review. The reasons Brauer and Associates
were the initial firm contacted for a proposal are:
A. As I indicated to you in my report of December 15, 1972, this
firm is the only one, I am aware of, in the Twin Cities that have
planned and designed both golf courses and nature centers.
B. The Managers of two suburban cities in the Minneapolis-St. Paul
area have rated this firm very highly in competence, objectivity,
and indicated they were well pleased with the feasibility studies
performed.
The second item is a proposed schedule on North Park to assist the Council
in setting some target dates to arrive at a decisio¢ on the property. This
schedule anticipates two weeksfor you and other interested citizens to evaluate
the proposal. It would probably be a good idea to have Mr. Brauer here in two
weeks to discuss the study if you are of a mind to proceed as suggested.
The staff would be prepared to make a recommendation on the proposal in
two weeks if requested by the Council.

This proposal agreement outlines a scope of services, fee
schedule and other elements which will serve, if approved, as
a contractual agreement between the City"of Fridley, a municipal
corporation, herein referred to as the OWNER, and Brauer �
Associates, Inc., a Minnesota corporation, herein referred to
as the PLANNER.
It is the intention of the OWNER to retain the PLANNER to study
the North Park site, to evaluate potential alternate sites and
programs by other agencies, to study the feasibility of building
and maintaining a golf course and/or a nature interpretive center
on the North Park site, and to report specific recommendations
to the City Council.
The OWNER and the PLANNER agree as set forth below.
A. SCOPE OF SERVICES
The PLANNER'S Services shall include recreational design, golf
course architect, urban planning, engfneering and other profes-
sional services as follows:
1. Basic Services - Research and Analysis Phase
a. Collect and Review basic planning data including Fridley
an a�acent �unicipal Comprehensive Plans, Anoka Cowity
Park P1an Proposals, school district plans and proposals,
existing land use data, current development proposals,
utility extension programs, watershed district policies,
highway proposals and other available data on manmade
factors as a basis for feasibility and alternative
analysis.

b. Perceptual Study and Evaluation of the natural condi-
tions of the Nort ar site and surrnunding area,
together with a review of potential alternate sites in
public owners}nQ wit in a T0-mile radius. The
perceptual study and evaluation will consider soils,
topography, drainage, vegetation, shape, orientation,
access and other available data on natural factors which
should guide design recommendations.
c. Overview;of Golf including pertinent national, state,
an metropolitan area trends, projections and advantages
of adequate public golf facilities, and specific conclu-
sions which can serve as a basis for golf course develop-
ment and operation policies for the community.
d. Overview of Nature Centers including pertinent data and
experience on national an metropolitan area facilities,
projections of uses and users, advantages of natural
areas and interpretation programs and specific conclusions
which can serve as a basis for nature center development
and operational policies for the community.
e. The Golf Market in the area based upon projections
' gol ers an an inventory and evaluation of existing
public and private courses within a ten-mile radius
the geographical center of the city.

and expenses for existing facilities, estimated capacity
of the proposed facilities, fees and charges consistent

2. Basic Services - Community Interaction

a. Community Seminar - Assist the OWNER in selecting and
inviting representatives of key groups and influential
individuals, pre-registration and group assignments,
plan, program and moderate the session (one evening -
about 4 hours) designed around small group discussions
and reporting, and evaluate the input and the process.
b. Utilize the interaction input from the seminar in
prep g the Feasibility Report Recommendations.
3. Basic Services - Feasibility Report Recommendations
a. Summar Re ort Document will present in written and
grap ic orm t ei �T�asic data, analysis, conclusions and
recommendations outlined above. The PLANNER will pro-
vide fifty (50) copies of the completed report.
b. Meetin s and Presentations - The PLANNER will meet
regularly wit t e OWNER S staff representatives to
secure data, outline progress, discuss evaluations and
describe conclusions, and will make two (2) £ormal
presentations of the completed study as directed.
B. FEES FOR PROFESSIONAL SERVICES
The OWNER shall compensate the PLANNER for completion of profes-
sional services described in Paragraph A above as follows:
1. FOR THE PLANNER'S BASIC SERVICES as described in Paragraphs
Ala through Alh, a Lump Sum Fee of TEN THOUSAND DOLLARS
($10,000.00) including all expenses, payable monthly in pro-
portion to the work completed and billed.
2. FOR THE PLANNER'S BASIC SERVICES, as described in Paragraphs
A2a and A2b, a Lump Sum Fee of ONE THOUSAND DOLLARS
($1,000.00), including all expenses, payable monthly in pro-
portion to the work completed and billed.
3. FOR THE PLANNER'S BASIC SERVICES as described in Paragraphs
A3a and A3b, a Lump Sum Fee of THREE THOUSAND DOLLARS
($3,000.00) including all expenses, payable monthly in pro-
portion to the work completed and billed.

4. PAYMENTS TO THE PLANNER shall be made as follows:
a. Statements will be submitted to the OWNER monthly with a
breakdown of time and expenses for progress on contract
work through the 25th day of each month.
b. Payments are due upon receipt of the statement and no
later than thirty (30) days from the date of receipt.
C. OWNER'S RESPONSIBILITY
The OWNER shall make available or allow access to all existing
data related to the work and all other data or information which
may develop that could possibly have a bearing on the decisions
or recommendations made under this Agreement. The OWNER shall
specifically provide:
1. Topographic ma �ing with locations of structures, aerial
photograp s, soil surveys, or other data which describes the
general nature and conditions of the North Park site, which
are available presently or received during the planning period.
2. Le�al Description of present ownership together with a brief
out3ine o a�pplicable legal restrictions (easements, deed
restrictions, purchase contract conditions, etc.).
3. Public Utilities, plans and reports including existing and
propose streets,water, sewer and drainage utilities with
hydrologic storage and flow requirements as they affect
the site.
4. Soil Borin s in the general area in order to determine the
nature an epth of unstable soils. (Only those presently
available through development or utility projects in the area
or nearly representative areas.)
5. Com rehensive Plan Documents and all related current documents
relating to zoning, lan use, highways and other development
conditions.
6. Anoka and Ramse Gount park planning data and information in
t e orm o policies, goals, or objectives, as well as specific
site acquisition and development proposals.
7. Aerial Photos and other base map data £or the entire study area.

8. Additional Data or information which will have a bearing on
t e conclusions and recommendations of the PLANNER.
D. TERM, TERMINATION, SUCCESSORS AND ASSIGNS
1. The term of the Contract shall be concurrent with the work
authorized. Estimated completion time for services described
under paragraph A is ninety (90) days from the date of
authorization to begin work.
2. Termination may be accomplished by either party at any time
by written notice, and shall be effective upon payment in full
for all services performed to the date of receipt of such
notice.
3. The OWN�R and the PLANNER each binds itself, its partners,
successors, assigns and legal representatives to the other
party of this Agreement, and to the partners, successors,
assigns and legal representatives of such other party with
respect to all covenants of this Agreement.
4. The PLANNER and the OWNER agree that neither may assign,
sublet or transfer his interest without the written consent
of the other.
E. PLANNER'S RECORDS, DOCUMENTS, AND INSURANCE
1. The PLANNER shall maintain time records for hourly fees,
design calculations and research notes in legible form to be
made available to the OWNER if requested.
2. The PLANNER reserves the right to secure and maintain statu-
tory copyright in all published books, published or unpub-
lished drawings of a scientific or technical character, and
other works related to this project in which copyright may
be claimed. The OWNER shall have full rights to reproduce
works under this Agreement either in whole or in part as
related to this PROJECT.
3. The PLANNER shall carry insurance to protect him from claims
under Worlanan's Compensation Acts; from claims for damages
because of bodily injury including death to his employees and
the public, and from claims for property damage.

F. EXTENT OF AGREEMENT AND APPLICABLE LAW
1. This Agreement represents the entire and integrated agreement
between the OWNER and the PLANNER and supercedes all prior
negotiations, representations, or agreements, whether written
or oral with respect to the project. This Agreement may be
amended only by written instrument signed by both OWNER and
PLANNER.
2. Unless otherwise specified, this Agreement shall be governed
by the law of the principal place of business of the PLANNER.

COMPARISON OF POLICE PENSION COST

' We have made comparisons of the cost to the City if all the present authorized
force of twenty-seven sworn officers stay in the private Fridley Police Pension
Plan, compared to the cost of putting new officers in the PERA - Police and
tFire Plan. Existing officers would stay in their present plan as is.
We fiave made comparisons both on the assumption that the new officers starting
in the year 1973 will go in the PERA Plan, and another comparison showing the
, differences in cost if the officers hired in the year 1974 and after were put
in the PERA - Police and Fire Plan.
These comparisons are made on the basis of laws that are in effect at the present
time. The charts do not take into consideration the savings that would accrue
to the City for any expansion of the Police force. That is, under the present
plan, the cost to the City for a Police Officer is 46% of salary compared to 12%
under the PERA - Police and Fire Plan.
The costs shown for the combined plans include the cost of retiring the deficit.
There are many more comparisons that could be made for different combinations, but
time does not permit us to include them at this time.

SUBJECT: ADDITIONAL INfORMATION ON COST OF POLICE PENSION

The pension cost comparisons shown in the January 22, 1973 agenda
were based on the assumption there will be no increase in the present
size of the Police force. It is almost certain there will be some
increase in size of the force in the years to come. At the present
time, the base salary of a top Patrolman in the City of fridley is
$12,204.00 per year. The normal cost to the City of Fridley for the
Fridley private pension plan based on a salary of $12,204.00 per year
is $5,565.00 per year per man. The cost to the City for that same
employee if he were covered by the PERA Police and Fire Pian would
be $1,464.00 per year. This is a difference of $4,101.00 per year
for each man who would be placed in the PERA plan rather than the
private Police pension plan.
On page 2A of the agenda, is a summary sheet showing the pension cost
to the City for the two plans. The total amount saved if the pension
plans were combined, and if the force remained at the present size,
would be $6,040,125.00 through the year 2005. If the five additional
people, who will be hired in the year 1973, were put on the private
pension plan, the cost savings to the City would be $4,391,768.00.
This is a difference of $1,648,357.00. Although, this seems like an
unbelievably large sum of money, one has to take into consideration
that salaries ten or fifteen years from now will not be at the same
level they are today, therefore, the cost for pension plans will not
be the same as they are today.
Although cost savings may not be realized for several years, when the
total savings are averaged for the period 1974 through 2005, the average
is $188,753.00 per year (chart on page 2A of agenda).

Per your direction, I attended a meeting in Columbia Heights on
January 17, 1973, to discuss subject above with representatives of other cities
in Anoka �ounty. At this point in time, three cities--Columbia Heights, Anoka
and Fridley--are in favor of hiring a legislative liaison. Coon Rapids and Blaine
are still undecided as to their participation in the project. It was decided by
all cities present that after Coon Rapids and Blaine had had further opportunity
to discuss this matter with their councils, we would meet again to formulate a
joint powers agreement. This agreement wouid then be brought back to the individual
councils for their consideration if it is decided to proceed with the Legislative
liaison program.
Attached is a letter from Malcolm Watson setting a date for a meeting with
Mr. David Kennedy to discuss the legislative liaison work. Perhaps the Mayor
and/or members of the Council would want to attend this meeting next Tuesday
to participate in this discussion.
I anticipate having a recommendation back to you by February 5, 1973, to
resolve this matter.

The City of Fridley is in receipt of ypur letter dated
January 11, 1973 regarding the property described as follows:
Lots 27 and 28, Block 12, Hyde Park Addition.

A check with the City Assessor's office revealed that the
property has not been devalued. The Assessor believes that the
increase of traffic flow past the property of£sets the conversion
of Third Street N.£. into a one-way street. We are, however, in
agreement that access to the property may have become more difficult
due to the construction of the slip o£f and one-way. Because o£ the
more difficult entrance to the property, the City has temporarily
been maintaining the unimproved alley in Block 12 to provide
additional access to the property. Please note that prese�it City
policy provides that maintenance of unimproved alleys is the
responsibility of the owners of the adjoining properties. T'herefore,
in ordei that the Gity continues maintenance of tiie unimproved alley,
a request by you to the City Council must 6e approved. Please arrange
with the City Engineerirlg Department to have the request placed on
the agenda for a future City Council meeting.
The pt'�posal to allow the purchase o£ the triangular piece of
property (pGart of Lots 29 and 30, Bloc�C 12, Hyde Park Addition)
adjoining y�our property, must follow a course of action by the City
which would declare the triangular piee:e of property excess and
therefore make the property available f�r public auction. This
would be the only method whereby you cc.ild purchase the property.
However, as you can see, the public auction would not guarantee
that you would be the only potential buyer of the ex.cess property.

An alternate proposal would be to allow you to use the
triangular piece of City property until sucfi time as the City desires
it for a specific use, Such a proposal would preclude construction
of any buildings or improvements on the property and would require
that you agree to reasonably maintain the property while under your

MT. Brown told the Commissioners that as soon as weather permits, the Maintenance
Staff would be placed on a rotating schedule, �imilar to the one•used last Winter.

Mrr Fitzpatrick asked the Commissioners if any of them had formed opinions regnrding
development of North Park, and if so, if they would care to make their opinion�
kn n a[ this time. Mr. Kirkham stated that he was in favor of a NatNre Center, n1_r.
Wagar supported a Golf Course, an� Mr. Blair and h1r. Stimmler are not as vet committed.
It was the general feeling that a Rice Crecl, nature center was not an alternaticc

Mr. Fitzpatrick stated that he had been at a maeting of the islands of ?'eacc.
Committee, in the early part October; where the City Attorney, Mayor, and the
City Manager were all present. He said that the meeting was well attencled but
ended in a state of indecision.
Mr. Brown called the Commissioners' attention to an article in the Minneapolis
Tribune, about Mr. Wilmes and the Islands of Peace. Copies uf the artic�e will
be mailed to the Commissioners. '
Mr. Brown went on to explain that Mr. Wilmes and the Committee have had letterhead,
envelopes, and pamphlets printed, in hope that by sending out some information to
area American Veterans groups and other Civic-minded groups, donations would aicl
in the development of the Islands. To date, they've received about $400.00 and
this is about anough to take care of the expenses of the Committee and their
mailings.
According to the information Mr. Brown has, Mr. Wilmes has now approached Brooklyn
Park, in the hope that Durham Island can be donated or purchased for this proj�ct.
Mr. Wi,lmes has approached Calvin Griffith about having a benefit game, sponsored
by the Minnesota Twins.
' "I'he Commission took no action regarding the Islands of Peace Project. Mr. Brown
will keep them informed of any further progress.

The meeting was called to-order at 9:15 p.m. in the City Hall lunchroom
by Father Ed.
CERTIFICATE OF COMPLIANCE:
Members received a copy of the letter from the Fridley District #14
Superintendent of Schools, dated December 28, 1972, to James E. Greeley,
Washington counsel for General Television, and carbon copy to FCC. It
commented on the application for the certificate of compliance filed by
General Television with the Fcc.
The CATV Commissiom recommended the City of Fridley should convey to
the FCC its concern over errors and omissions in the application. B.
Hughes was instructed to draft a letter outlining the points as follows:
1. insert "3 hour period for six consecutive" in Section H to follow
line 13.
2. Section K- Operating Rules: change "cable costs" to read "cablecasts
envisioned to be made upon public access, educational and lease
channels to conform with Section 76.251 (a) (11)."
3. Section J: point out the ordinance appears to prohibit franchisee from
considering charges for educational or government access channels
at any time.
4. To ask for clarification of the language "basic trunk line".
, The company had proposed tWO basic trunk lines with six hub
lines into the Fridley three wards.

City Council as soon as possible.

John Haines was directed to prepare a draft of Bylaws to cover operations of the
CATV Commission. He will review the ordinance to see what items must be
included in bylaws, rules and regulations, or other documents.

Order of Business.
Mr. Haines said a dra£t would be ready for the next meeting.
MEETING DATES:

ADVERTISEMENT FOR BIDSi STREET IMPROVEMENT PROJECT ST. 1973-1 AND
MUNICIPAL STATE AID STREET IMPROVEMENT PROJE:CT ST. 1973-2
WHEREAS, Resolution No. 122-1972 adopted by the City Council on the
2nd day of October, 1972 aet the date for hearing on the improvements, as
specifically noted in Che Notice of Hearing attached hereto for reference
as ERFIIBIT "A"; and
WHEREAS, a11 property owners whose property is liable to be assessed
with the making of the impzovements (as noted in said notice) were given ten
(10) days notice by mail and publistyed notice of the Council hearing through
two (2) wQekly publicaYions of the required notice, and the hearing was
held and the property owners heard thereon at the hearing, as noted in said
notice; and
WliEREAS, Resolution Na. 136-1972 adopted by the City Council of the
City of Fridley ordered all of these improvements; gnd
WHEREAS, Yhe City Council has provided general fund monies for the
construction of the Robert Louis Stevenson Elementary School Walkway.

and geAeial neighborhood in Rivers Edge Addition about unsafe pedea-
trlaa accees for the children along East River Road to Robert Louis
$tevanaon School and we would like to provide a safer accesa for the
children of. this area to the achool.
Over the Lgst three months the City's representatives have been
wqrking with different property owners along the South leg of Rivers
Sdge Way to get their permiasion to iastall Che walkway.
Basically all along this roadway prope�ty ownera appreciate khe
wx6dap of inata111ng the walkway but they feel it ahould be inskalled
pq eomeoae else's psopssty rather than theirs. -
Oa pugusC 17, 1972 we met again with the representativea of School
Diattict No. 14 to aee what different alternatives for the locations
of xhe walkway they would definitely want the City to consider. Four
locations were dlsqusaed with the School Diatrict representativea aa
�hown oq the attachad map. We are making a report regarding thia
waJ,kway to the City Coancil at their meeting of August 21, 1972 at
7:30 P.M.

said that the school has said that if the north sidewalk is pat in,they will
cease to bus the children from the area. They would come out to East River Road
on River Edge Way, then down a direct path to the school. Councilman Mittel-
stadt said that in that case, perhaps the wnole �roiect should be deiayed one
year.

he heard about the notices and found that the school thou�ht the Ci*y was going

The Acting City Attorney said yes in a concamnation ther�e are two. In natters
such as these, sometimes the City hires one and the p:o�erty owners another. in
this case an independent fee appraiser was hired that had no interest in either
side of the matter.
-Mayor Liebl said that this all comes dorm to spending so much money to possibly
save the life of one child, and he for one, felt that it must be done. he said
it xas his duty and obligation rto do what he felt was right even though it r.iay
step on someones' toes a little. He said he was very.gratePul to those people
on the north section of the sidecralk that were uilling to give the right of
way needed�to tte City of Fridley. This is not something that would be assessed,
but which every tax payer in the City would pay for.' If u child gets killed
valking on East River Road it Kill be a direct Council r=sponsibility. He aske�
how much it woul�l cosr to put in both the norzh and sou.h sections, not counting
any condemnation. ?t:�� City Enainecr said that $4,G00 was budgetted, this doe�
not count acquisition costs, but covers constructioa and some fencing. Mayor
Liebl asked :f the construction of the sidewalk cost $B4OUG, would that be a
waste of money2 The City Enginaer said that was a Council decision. During the
first discussions when a roadway was prc�,esed, the people did no: want that,

During our recent luncheon we discussed the possi6ility of a luncheon in
Fridley, and at that time you suggested I give you several possible dates
and you would run them by Mayor Liebl to see when he would be available.
I would like to suggest February 13, 14, 15, 20, 21, or 22, as possible
dates. It would be a noon lunc eon. --
I would invite yourself, the mayor, councilmen, members of the business
cortmunity and some of the civic leaders such as the Chamber of Commerce,
League of Women Voters, etc.
A member of our upper management will attend and following lunch he will
take a short time to tell our telephone story to members of the Fridley
corronunity and give everyone in attendance dl7 opportunity to ask whatever
questions they choose regarding the telephone business. We have held
these luncheons in other suburban comnunities and they have been successful
for several reasons. It gives the members of the community a better
understanding of a business whose product tf�ey use daily, and it presents
a unique opportunity for those in attendance to ask our upper management
questions. I would appreciate if you could take a minute to call me as
to a date you might suggest for the luncheon.
We do have a public hearing scheduied February 12 on the vacation of the
alley on the property we purchased on 59th Avenue N. E. That is why I
purposely picked dates after the hearing so there would be no inference of
collusion between an elected official of Fridiey attending, and the
Telephone Company.
I know you are busy, Jerry, but I would like to give you a call and have
lunch in January. I would like to have you meet Mr. John Innes, District
Manager for our Company, who is responsible for telephone service in
Fridley and the northern suburbs. He is a great guy, and I am sure you
would enjoy meeting him.

I have received approval from my client to enter into the
following agreement with the City of Fridley, which I think
can be done by an exchange of correspondence between our
offices.
Continental will purchase its bond from the City of Fridley
for the sum of $1500, which would discharqe Continental from
further liability on the bond. If Mr. Chies does slope the
banks and fill in the depressions to eliminate the safety
hazard presently existing prior to the deadline set by the
City so that the City incurs no obligation to correct that
dangerous condition, that amount would be refunded to Conti-
nental and it would remain discharged Prom further liability.
If, however, the City finds it necessary to complete the work
itself, the $1500 would be used by the City for that work.
The cost of that work would be assessed against the land and
if collected from that assessment Continental would be reim-
bursed for all or a portion of the $1500 that was used to
correct the condition. If the City does have to perform this
work but spends less than $1500, Continental wauld be reim-
bursed both from the leftover funds and £rom the assessment
procedure.
If this arrangement is acceptable to the City, confirming
correspondence from your office would be satisfactory.

force on PERA. He added, thera was not enough �f� ajlowed to do all the

' The City Engineer said of the four possible locations for the walkway,
along Rivers Edge Way, the question is, ahould the C i t y provide the
walkway and in what location7 He said they had had problems with one party
' agreeing to the proposal and the next party against it: They all think it
is a good idea, he added, but no one wants it on their property.
' Councilman greider asked Councilman Nee if he planned to have meetings on the
�tter, rye answered yes, there was a definite need. He contlnued by saying
he would like to have some support on the proposal.

to use it as !he property owner had constructed a shed on the property. The
City Manager said they should consider the shortest and most direct route to
keep the children off the street. The City Engineer said any of the four lo-
cations would work. The City Manager said perhaps the last time the plan was
proposed there were errors made in the method of approaching the people of
the area, He said at the completion of the talks with the people in the area,
he felt, the only method of obGaining the land would be through condemnation.

The Mayor asked if the date of February 13, 1973 would be convenient
for the Council members. Counciiman Starwalt safd he would be able to
dttend the noon luncheon on that date.
Councilman Nee said the letter stated the invitation was fssued for
o�er members of the community. The Gity Manager said their first
Goncern was to set a da[e when the Council would be able to attend.
After this, he added, invitations would be fssued to others.

MR. MARC WHITEHEAD• CHIES BROTHERS:
The City Attorney said the letter proposed a solution Co the long
5tanding problem with Mr. Chies. He called to the �ouncil's attsnGlon
the recent Public Hearing in which a decision #or Mr. Chies to do the
work was reached, He added, his offfce was advised by the Engfneering
Department that it would not be p�actical to do the work until sprfny.
At this time, Mr, Whitehead is offering the City of Fridley $1,500 to
enable someone other than Mr. Chies to complete the wprk and discharge
Continental from further Iiability on the bond. He 5tated this ampunt
would be sufficient to remove the hazard5 fn the area, but not sufficient
to finish the grade for development. He said ha recommended acceptance
of the offer.
' Councilman Utter asked the City Engineer's views on the offer. He said
the amount would just barely take care of gpme of the ciangerous slopes.
But, he added, it may be a step in the right direction.

in the Public Hearing, requiring Mr. �hies to abate the nuisance (n the

The City Attorney agreed, the City Engineer's points were valid. He
added, it would be difficult at this time to determine what the obliga-
tion consisted of. Councilman Breider said the first con�ern would be
to remove the hazards in the area,
The City Attorney said if the City were forced to dp the work and
the amount actually needed to complete the project wer� more than the
offered $1,500, the City cou,ld assess the remainder to the properXy
owner, Mr. Chies.
The City Engineer said he had talked to Mr. Chies about abating �he
slopes and had been advised the work could not be done until the spring.
Counciiman Breider said in fiis opinion, $1,500 would not be an adequate
amount to accomplish much.
The City Attorney asked Councilman Breider if he would agree to reje�t
' the offer at this time and ask 11r. Chies to complete the work in the
spring as previously agreed upon? Councilman Breider said he would
agree with this action.
MOTION by Councilman Breider to reject the proposed oFfer of $1,500
and adhere to the original plan of requiring Mr. Chies to comPleXe
the work in the spring. Seconded by Councilman Starwalt. Upon a voice
