The Kenneth Gi11 and George Schumann families are requesting pe nnission to put a
fence barrier behind 4630 and 4638 N.E.3rd St. We are next door neighbors and
do have our yarde fenced and what we are requeating is pexznission to put just eno�tgh
feticing to deter the motor acooter hot rodders who are using our easement for a race
track,There are about 4 or 5 sa.that you can see filing a compl8int is fruitless as
sane of them I am sure da not belong in our area.The past few years we have called
the police but by the time they arrive on the scene the cuZprits have disappeared
and I am sure our police department has more important things to do.These individuals
da not have licenses,some are under a�e,no lights on the vehicles and do not wear
a:�,�nets.Some times theY are buzzing anound at 10:00 o�clock at night.
','`�� situation is nerve racking; in the siunmer when school is not in session they
�.:�art in the morning and continue on throughout the day.Mr.Gill works nights and I
�night add when�we have our windaws open we can't hear the TV for the racket.
'�he Gills and the Schumanns will put up the feneing if . permission is given and we
alao do atate that in the event NSP or any other utility has need to knock them down
we will be responsible for re-erecting them although the spots we intend to puz them
�n will not interfere with the utility poles.

The signatures appearing on this letter are those of the individuals living
behind or adjacent to the Schumanns and the Gi11s who are in accord with our
request; it seems maybe they can now use thei.r back yards for picnics if our
request is granted. The Gordons built a beautiful gazebo in the back of their
hame which they teZ2 me they have not been able to use because of all the
dust the motor scootexs raise.We would hope that perhaps the council could
give us their decision at the April 2nd meeting. Do any of us need to be there?
When I obtained the signature fram the Swansons I saw the four letter words
painted on b�r red wood fence.Mr.Swar.son said he did not have red paint or he
would have painted aver it;he did paint over the GiZls white fence that had the
same four letter word on it.I for one want it left there in case you would like
to came out and look at it.

The City of Fridley City Council, at its regular Council �Jeeting on
Februa�ry S, 1973, had a hearing on possible suspension and/ar revocation
of license fox Canterbury Pub, Deane Gruye, owner. On a motion by Council-
msn Breider that the suspension and/or revocation of licen�e be tabled fox
sixty days and at the end of the sixty days the administration review his
operation and present a report to the Council, and if any further violations
occux during this time, license will be denisd. Seconded by Council�n
Starwalt.
This memorandum shall serve as an official notice fram the Police Departatent
that the Canterbury Pub has been observed over the past sixty days and no
' �additional violations and/or problems have been noted by the Police Depart-
mant. I� is therefore my reCwamendation that the Canterbury Pub b� alloMad
to cqatinue operation with their current licenses unless and until such time
that �ur�her vialations may be noted. Should furthex violations be noted

SUBJECT: CLAIM OF HENRY T. MELCHER
On January 29, 1973, Mr. Melcher wrote a letter to the City requesting
reimbursement in the amount�of �307.50 for shrubs which are dying on
his property. These are shrubs located immediateiy adjacent to the
sidewalk on MississipPi Street. It is Mr. Melcher contention that the
the shrubs are dying because of salt deposited on his propertY by City
snow removal equipmen�.
The claim was turned over to the City's insurance company. The insurance
company has informed the City that the claim has been denied.
This matter was originally brought to the Council's attention on
March 19a 1973. Mr, Melcher also appeared at the April 2, 1973 Council
meetir�g concerni�g the shrubs. Mr. Me1cher has offered to settle the
claim fqr �120.00. Mr. Melcher stated he would do mos� of the work if
the City would hau1 away the dead shrubs after they have been taken out.
� Attached is a re1ease form which the City would have Mr. Me1cher sign
if the Counci1 approves the payment of $120.00. The City in Qne other
instanc� did offer to pay for shrubs that had allegedly been damaged by
I the Ci�y snowplow. The City prepared the same type of releas� as the
,, one �Ghat is�.attach�d for Mr. Melcher's signature.� However, t�fie property
. owner in that instance refused to sign the release, therefare, the City
� ' did not t�r� the check over to the property nwner.

An amount of $88,113 would have to be transferred from the Fridley Fi�e
Relief Fund to the atatewide Police and Fire Fund to buy back years of
credit for the existing paid men. In addition, buying back credits for
the volunteer portion of the pension plan for the existing paid men would
cost approximately $36,110 ($34,152 as of December 31, 1971, plus $1,958),
The last actuarial valuation of the plan showed that assets in the fund
attributable to the full time paid men were $124,020.
The affect of these proposed changes would cost the City elightly
L�ss per year than the present requixement as outlined belaw.
According to the actuarial valuation, dated December 31, 1971, the

House File 1468 and Senate File 1709 which amends the 1969 Police and Firemen's
Relief Association Guidelines Act; and

Guidelines Act on a Statewide basis; and .
WFiEREAS, Fridley City Council recognizes its obligation to fund its
local Police and Firemen's pension plans on an actuarially sound basis; and
WI�REAS, The Fridley City Council recognizes its responsibility to the
citizens of the community; and
WHEREAS, the League of Minnesota Municipalities has submitted House
File 1468 and Senate File 1709 to the Governmental Operations Committee
for consideration; -

AISCUSSION REGARDING Ta�LANDS OF PEACE - PRESEPITATION BY ANDREW KOHLAN,
ATTQRNEY, AND RICHARD JACQBSON� CHAIRMAN, FINANCE COMMITTEE:
Mr. iCOhlan said he was assisting the Islands of Peace with the current situ-
ation. He said there is difficulty in obtaining funds for the project as
the ,project i� not a non-prafit organization. He said many foundations had
stated they would like to contribute if the project were a non-profit organi-
zation. He added, thia would enable the contributors to receive a tax break
on their contributions. He added, the establishment of the non-profit
organization would make the project much more flexib�e and allow many moxe
people to participate in the project. He said it is his belief that the
project should be done right and with as many interested people participatir�g
as possible.
Mr. Kohlan suggested the Island of Peace lease the pxoperty from the Citv of
�'ridley, relieving the City af a great deal of responsibility for aaxe, maintenance,
>�nd operatzon. He said an agreement between the non-profit corporation and
_-'.:�e City could be obtained, as this aetion is essential to the project. He
�aid his request would be to authorize the setting up of a separate non-pro-
fit c�rporaticn for the Islands of Peace Project.
Councilman Breider asked if the Council had to do anything to enable the
corporation to be set up? The City Attorney said no. He said the Council
may have to take some action as far as the handling of the funds are concerned.
�ie said, now the funds are in control of the City Administration. iie said
there should be some aqreement in the part the City will play after the
establishment of the non-profit corporation is completed.
The City Attorney said he thought it would be in the best interest of all
;, to authorize Mr. �tohlan to go ahead and begin the procedure fox' the forma-
tion of the non-profit corporation. After this, there could be a determina-
tion on who would do what. He said the City had signed an option to purchase
' the additional property, He said the funds were to be raised by the Committee.
He said there is a quest�on of who would take title of the property and
who would maintain it.
Mr. Kohlan suggested the City take title of the property and lease the
property to the Island of Peace Froject in a long tezzn lease. He said, if
foz �ome reason the project does not develop, the City would still have title

said the cost would be less than purchasing a park for the same purpose. He

The City Manager said things had not been going along as well as he would
have liked them to ,pXOgress. He said there had been a meeting on April 3,
1973 with the cantractors. He had called the meeting in an attempt to improve
cooperation between them. Since then there has been a little better coopera-
tion, but he said he would like to have a meeting on the progress every two
weeks.
The City Mangc�r said he wanted to inform the Council that there had been some
delay, and if the store is not completed by May 15, 1973, he would like to
have it a matter af record.

RECETVING REPORT ON NEGOTIATIONS WITH FRIDLEY FIRE RETIRFMENT ASSOCIATION:
The Mayor said the City Manager had recommended approval of the tentative
agreement between the Fire Retirement Association and the Administration.
Mayor Liebl said if there is a bill prepared and submitted to the State
Legislature, it would have to be done this week. Mayox Liebl asked the City
Manager if the agreement could be signed. �
The City lyanager said the Administration had been negotiating with Mr. Aldrich
and the members of the F.ridley Fire Retizement Asaociation for several weeks.
He said the negotiations involved both the paid full time men and the volun-
teers. The GitX Manager said an �qreement had been reached the previous week
ir� whick� both sides agreed. The agreement wo�ld reduce the actual cost o� the
plan. He said there would be a change in the vesting, aiter ten years of
. .

service the volunteer members could receive a lump sum payment over four years
providing they had at least ten years of service. He said the retirement
age would be changed from 55 years of age to 50 years of age for volunteer
members. The City Manager said most of the plans for volunteers have a
retirement aqe of 50. He said there is also an increase in the benefits for
widows and also for disabilities. •
The City Manager said he had received a letter from the actuary for P.E.R.A.
and the fund has sufficient assets to pay the past obligation of the men.
The City Manager said from the City's standpoint, it is a mutually beneficial
proposal. He added, the City would have to work fast and there is not a 100$
chance that it can be passed by the Legislature in the present tezm. He said
the administration would do everything possible to get it to the Legislature
before the end of the term.
�:ayor Liebl questioned if there is presently,$120,000 in the fund? Mr. Aldrich
�aid there is nearly $400,000, $124,000 in the paid men's side and $253,000 in
the volunteer men's side.
Mayor Liebl asked if by paying the $88,113 this would pick up all liabilities
for all of the permanent and volunteer men? Mr. Aldrich said this would only
take care of the paid men. Mr. Aldrich said the remainder of the men would
stay in the volunteer side which is adequately funded.
Mayor Liebl asked for an explanation on why there had been a change and the
Association was going in two different ways.
Mr. Aldrich Said the P.E.R.A. plan is very similar to the present plan and
there was a need for something to negotiate. He said the P.E.R.A. plan made
the benefits the men already had, stronger in some ways. He said the new
proposal gives some benefits to the City and some benefits to �he fund.
Councilman Breider asked if the membership had concurred with the proposal?
Mr. Aldrich said yes, they had unanimously agreed. Councilman Breider asked
if any future votes were necessary. Mr. Aldrich said no. He added, it is •
ready to go, all that is remaining to be done is to work on the bill.
Mr. A1driLh said there was another feature of the proposal which had not
been incarpora�ed in the report on the agenda as it was not a cost factor. He
said this feature was the sel� adjustment clause. He said this would allow the
Aesociation and the City Council to adjust the level of benefits in the
�uture if the adjustment of those benefits does not effect the cost of the plan.
He said the benefits could be adjusted without going to the Legislature. He
said this was a very important�part of the bill and a good feature.

Councilman Breider said he believed the self adjustment clause to be a
magnificent feature.
Councilman Breider said the City Manager and the City Attorney should be
instructed to draft a bill.to be presented to the Legislature this term.
The City Manager said he had met with the City Attorney that day, and because
of the lateness of the session it was suggested that Mr. Savelkoul be contacted
and asked to aid in the preparation of the bill. The City Manager said he
had discussed this point with Mr, Aldrich and he was in agreement to the
pzoposal. He said Mr, Savelkoul would be an�asset in drawing up the bill
and walking it through the Legislature because of his experience. The City
Manager said the schedule of the City Attorney prevented him from completing
th� biZl rapidly. He said the expense of obtaining Mr. Savelkoul's services
had not been discussed, but there was a possibility oF splitting the cost
with the Assocxation. The City Manager said the Ctiy would have had the
�ezvices of Mr. David Kennedy, but this had fallen through.
The City Attorney agreed saying, the bill would have to be introduced this
session, and he would not have the time to do it. He said he believed Mr.
Savelkoul would be an asset in drawing up the bill and introducing it.

added, the Gity has not tried to do this. He said k�e believed everything else

INFORMAL REPORT ON NORTH PARK COMMITTEE PROGRESS BY COUNCILMAN BREIDER:
. Councilman Breider said there had been a meeting of the Committee and the field
trip scheduled for �e week previous to Easter Sunday. He said these had been
rescheduled due to the many conflicting activities the week prior to the holiday.
The meetings are scheduied for May 5, 1973 for the field trip arfd Apri 1 23
for the meeting. Counciiman Breider said Mr. Brauer of Brausr and Associates
had indicated to him that at the April 23rd meeting, verbal recommendations for
the utilization of North Park will be presented by Brauer and Associates.
Councilman 8reider said his recommendation would be to not have the Committee
make their recammendations to the Council that evening. Ne said he would like
the Committee to have some time to analyze the recommendations and allow the
Committee to conduct an interaction session prior to making recommendations.
He said after the interaction session he would ask the Committee to present
their recommendations to the Council.
Mayor Liebl asked if the Gommittee would have a recommendation by June? Council-
man Br'eider� said they Shcauld have a recommendation before the end of May. Mayor
L,iebl said if the makter had to be brought to a vote, there would be enough time
for a referendum. Councilman Breider said yes, plenty of time.
