the publ�.c hearing, Seeonded by Gouncilman Breider. Upvn a voice vote, all voting
aye, �Iayar Liebl declared the motion carried unanimously.

T�� City Enginee� said the first �tem would be north o� 74th and west of Uniwersity
and the as�essment pric� would be $15,25 per front foQt for the water laterals.

The City �ng�neer said the first priee was approximately $14.44 per front

The City �ngineer wen� on to discuss the south storm sewer system and atated
Ghi.� ia anoCh�r sy��em where there may be aome question. Ae said the arsa has
besm divid�d iu to two districts. iie asid the completed �ystem would bs �3,30
p�r lAQ s�u�re feet far interceptors. He said this is anather arsa wher� �here
ie nv �ntsrc�ptqr system. He said the system receiving portlons Qf interceptoxs
eaa� o� th� �ai�road track would be completed this winter.
Mayax Lieb� asked i� this type of inethod had been used before, had the system
been iaaCal�ed �n two different operations. The Finance Director said yea.
He said it had been dane where the lateral system did not cover the satne $xea
as the mai�. �e said this is the reason for two diatricts,
�he City �ng�neer said the estimated cost of the system had bee� $8,1$ psr
140 pex �quare f�et, He said this amou� included the mains and 1at�xals, �oW
the aa�oun� wQUld bs $6.25 for the same lOQ aquare feet for the aomplete eystem.
He �aid �h�� would be about 30% saving which had been achieved because of the
mat�rial ussd �or f�l� from Burlington Northern, �e said some of the matar�ala
had been ab�ai�ed for �o cost and thi$ was keepiag the cost at � lower figure,

the ��nnis courts and include them if they wi�h. He said he cauld only
�A juat so far on recreation. He said perhapa, the pe4ple would no� ev��
waat th� �ennis courts. He stressed, i� the association wante the tenni�
cou� t they could put it in.
The City Engineer said most of the points of stipulation had been agreed
upon and the others cu��ld be tiaorked out. He said there wou�d be an
additional s�ipulations that they would provid� �roper drainage. He said
ihe st3pulatiori and conditions previously agreed upon coneeXnin$ the tTaf�ie
w�u1d �emain the same. He said the apartment plan area had been modifisd amd
the complex would include a recreation facility, He said if �h� Council
wauld agrse to the stipulations, they would b� incorporated in the oxi�inal
agreement between the City and the Wa11 Corporation. He added, if th� CauaCi�
would approve the final plan and stipulations, the agreement could be ex�cuted.
Mayox Liebl said he would like to stress the importance o� item numbeT
eight of the stipulations. He said he would encpurag� the us� of brick
a$ this was very important and he hoped the reprESentatives af the Wa�1
Gorpoxation would keep this point in mind. Mayvr Lieb� eaid �his woula ����ot
�he overal� prq�ect. Mayox Liebl read the stipulation� aloud �o the C4uncil
and the aud�ence, He said he thought point would be mandatary to th�
app�ara�c� of the cvmplex.

staff, Planning Gommission and Gouneil during th� period of time they
had bee� plannin$ Che complex. He thanked the Council for th�ir t�me
and said he wou�d expedite the plans.

aad architect. H� said tha agreement at the mestin� had bs�� diat�ibuted
to �h� Cauncil. He said the property owaer aad the City had �oms to the
agr��ment as pravided in the report. He added, unless the Council would

On December 29, 1972, 59 townhouse permits and three apartment permits
were typed and readied for issuance to the Wall Corporation. The permits
were not given to the Wall Corporation pending the submittal of final
landscape and mechanical plans for final plan approval by the City Council.
The City did collect a permit fee, plan check fee together totaling $5,328.56
and also we collected a State surcharge of $1,217.90. No SAC charges were
collected because the permits were dated prior to January 1, 1973. The
building permits were extended once on April 2, 1973 and again on July 2, 1973.
During which time the Wall Corporation changed the final plan to a total
townhouse project of 155 units.
The following is the calculations on the permits, credits, and amounts
due on this complex.

None of the above includes the recreational building permit or
SAC charge. Also the normal performance bond requirements will be
necessary. It must also be understood that the City in its calculations
for SAC charges has shown a credit only because of the original permit
date and in fact has not collected any SAC charges to date. Therefore

on the new permit, the Wall Corporation will have to agree to reimburse
the City in a lump sum payment within 30 days of being so notified.

2. DRAINAGE

Provide a drainage pond on the said property as shown on Exhibit "A"
which would receive the drainage from the adjoining properties and
drain the said property. The surface water will be stored in the pond
during the rain and will be let through with an.overflow into the
existing storm sewer at Bennett and 7th Street slowly after the rain
8torm subsides. The location of the permanent portion of the pond
would not be any closer than 100 feet from any road right of way lines.
The design of the permanent portion of this pond would be based on the
S year frequency (8.2 acre feet) with the temporary expansion of the
pond to be designed for 50 year frequertcy (12.0 acre feet) and the
limits of the temporary ponding around the time of the rain could extend
beyond the 100 foot limits. The water in the permanent pond would be
pumped up to a fountain for aeration purposes to eliminate the stagnation
8ffect of the water in the permanent pond. The bottom and the shorel.ine.
of the pond will be such that it is as maintenance free as practical
and the whole shoreline and the grounds around the ponding area will be
landscaped. The design of the complete draina�e and storm sewer system
in this property shall be approved by the City Engineering Department
gt►d storm sewer piping constructed to the City's specifications. City
agrees the,watershed area for this property shall not be increased.
