WHER AS, the citizens of the City of Fridley recognize the profound impact
of man's ac ivity on the interrelation of al) components of the natural environment,
particularl; the influences of popufation growth, urbanization, industrial expansion,
resource ex loitation and the new and expanding tzchnology; and
WHEP. AS, the citizens of the City of Fri�'ley recognize further the importance

Quality Commission of the City of Fridley. , .
SECTION 2. DEFiNITIOi`. For purposes of this ordinance, the environment is'
defined as all of ihe natural physicai resources of
dir, (and, su face and sub-surface woter, the biotic resources, the man-made
enviranment, Environment includes fhe sensorily preceived features of noise, sight
and smell, all plants, wildlife and man himself. . .
SEC710N 3. PUf:POSE. The Commission is established ta stimufate intere�t in, and
to promote an awareness of, environmenia) concerns among
citizens of th City of Fridiey; to scrve as resource agency to the City on matters
regarding thc environment, includinc� information on environmental problcros, . laws,
policies and r gulations of the county, metropolitan, state and federal levels to the
extent of thei effect on Fridley; and to advise tl�e City Council, the City Managerr

improvemen of the environment, including the� review and recommendation of
programs a d policies within the City: �
SECitON . SCOPE. The scope of fihe Commission shall be� advisory to the
City Council, the City Manager and to other appropriate
Commission of fne City on matters relevant to the environment.
SEC7fON 5. DUTIES Af�ID RESPONSIQILITIES. The duties and resporssibilities of
the Commission shall be: �

c arc�inate and-support educational programs which provide citizens
i formation about environmental cancerns and acq�aint fihem with
c mmunity prob(em-solving methods. �
SECTtON 6 MEMBERSH!°. The Comrnission shall consisfi of seven members, each
appointed by the Mayor upon the approva) of a
majority of he members of the City Council. Members of the Commission shal) be
residents of the City, sha(I have an interest in tl�e environment of the City, and
shall be app irrted with �due regard to their fitness for the efficient dispatch of the
functions, d sies and responsibiiities vested in and imposed uj�on tne Commission.
The Chairma shall be appointed at-large. The remaining six members shal{
consist of two members from each City 4ward. Members of the Commission shall
be appointe for terms of tE�ree years, except for high school or college students who
shali 6e ap ointed for terrrs of one year each, and except for the first Commission
appointed, vl�ich shall have two members with one-year terms, one each from Ward .1.
and �"Jard 2 two members witfi two-year terms, one each from Ward 3 and Ward 1,
and three mem��crs with threc-year terms, one each �from Ward 2 and VVard 3, plus
the at-larye Chairman. Upon the ex�ira�ion of his tcrm of affice, a member shal(
continue to serve until his success�r shal( have been appointed. .

In response o your inquiry of February 28 concerning municipal environmental commissions,
we are sendi g the following materials:

I have spoke to one knowledgable person in each of the above communities about their
environmenta commissions, I have attempted only to discover if the commissions are oper-
ating, and w th what scope and with what effectiveness they are operating. If you are
interested i further communication with any of the persons I spoke with, please
contact me a ain. What I learned about these few commissions follows:
Cottaqe G
The Cottage rove commission was established in July, 1970 by ordinance. It's name,
and hence it functions and duties, were changed, shortly thereafter. It is now the
Cottage Grov Parks, Recreation and Natural Resources Commission. They have turned their
attention fr m environmental considerations to parks and recreation planning.
Review vf de elo ment ro osals with re ard to environmental considerations is done b
the Plannin Commission staff. Mr. Rick Lewis of that staff told me that they construe
their zoning ordinance enclosed) to allow them to require any type of information from
a developer ith a proposal, up to and including a full-blown Environmental Impact
Statement. r. Lewis feels that their review process is highly effective, but it
certainly is not visible at all to the public.
Edina
The Edina En �ronmental Quality Commission was established in Novmeber of 1971, and
has been ope ating rather successfully since then.
Their philos phy, as expressed by Dr. Ronald Hays, the chairperson, is that they can
be most effe tive b wQrkin with the Cit Council, rather than fighting them. To
this purpose they attempt to anticipate problems, rather than review current proposals.
They have dr fted several ordinances which have been ado ted b the Council includin
flood lain onin , sign zoning, soil erosion and removing or cutting vegetation.

the Environmental Quality Commission "was always one step behind."
d) The members of the Commission were not rofessionals in the field. Developers
usu lly submit impact statements which are highly technical, and difficult for
lay eople to deal with.
Crystal
The Enviromm �tal Commission in Crystal was also established in 1971 by
ordinance. t is strictly advisory to the city council. The commission has done
research and made recommendations to the council in the areas of non-returnable
containers, itterin , and ener conservation. They also have participated in a stud
of the uali of Twin Lakes, and have Task Forces which deal continuously with citizen
education an attention to le islation.
The Commissi n is currently working on a proposal for a resource recycling center,
and in a joi t effort with Brooklyn Park, an environmental park. The commission
has begun wo k on the form for an environmental impact statement requirement, but has
made no form 1 proposals to the council.
According to Mr. Lundeen, Administrative Assistant in Crystal, the commission's only
problem has een with attendance at meetings. There is a group of ten or twelve
people in th community who are interested in environmental concerns, but usually only
four or five attend meetings. A quorum is six members, so often action is stymied
for lack of quorum.
Mr. Lundeen oes recommend the organization of the commission in Crystal as one that
might be suc essfully copied. �

In addition o the information above, Mr. Peter Johnson of Minnetonka had some
suggestions or an alternaiive method of environmental review of development pro-
posals.
1) Mr. Johnson would suggest that advocates of "open space" be added to the Park
Boa d. These persons would help to advance proposals for the acquisition of
lan for "open space" purposes, as opposed to land for only organized or
sem -organized recreational purposes.
2) He lso suggest that attention to environmental considerations be made a formal
par of the review process of the Planning Commission or Planning Depart-
men . One way to accomplish this would be to amend zoning and subdivision
ord nances to include requirements for some type of environmental impact
sta ement in the plans of proposed developments.
Mr. Johnson is adamant in the belief that an Environmental Commission made up �f
la eo lz, with mandatory review power over development proposals, will not work. -
His suggesti ns for an alternative, I realize, may not satisfy those in Northfield
who are pressing for a commission of citizens. However, Mr. Johnson does have experience
with the onl mandatory review commission about which I have any information.

703. SNOWMOBILES
7he following d finitions shall apply in the interpr�tation and application of this chapter and the following
words and term , wherever they occur in this chapter, are defined as follows: (Ref. 472)
1. "Snowmobilej' means a self-propelted vehicle designed for travel on snow or ice or natural terrain sleered by
wheeis, skis or Irunners.
2. "Owner" mear�s a person, other than a lien hoider having the property in or title to snowmobile, entitled to the
use or possessipn ihereot.
3. "Operate" me�ans to ride in or on and. control the operation of a snowmobile.
4. "Operator" m�eans every person who operates or is in actual physical control of a snowmobile'.
5. "Roadway" nieans that portion of a highway improved, designed, or ordinarily used for vehicular travel,
including the shoulder.
6. "Street or higF}way" means the entire width between boundary lines of any way or place when any part thereof
is open to the yse of the public, as'a matter of right, for the purposes of vehicufar traffic.
7. "Right of way'h means lhe entire strip of land traversed by a highway or street in which the public owns the fee
or an easement Ifor roadway purposes.

No person shall perate a snowmobile upon the roadway, shoulder or inside bank or slope of any trunk, county
state aid, or county highway in ?his City and, in the case of a divided trunk or county highway, or the right of way
between the op osing lanes of traftic, except as provided in this Ordinance. No person shall operate a
snowmobile �vithin the right of way o( any trunk, county state aid, ar county highway between the hours of
one-hali hour afl r sunset to one-half hour before sunrise, except on the right hand side of such right of way and
in the same direc ion as ihe highway traffic on the nearest lane of the roadway adjacent thereto. No snowmobile
shall be operate at a��y time within the right of way of any interstate highway of freeway wiihin this state.

purpose of tr�ns orting said sno�vmobile (rom the place of the owners residence to property that has been
authorized f��r sn wmobile use. The operator of said snowmobile shall proceed irom the p(ace o( residence to an
authorized opera or area by a direct route and shall conform to all provisions of this Ordinance and other

equipped with t e following:

operation oi the otor to the minimum necessary for operation. Mufflers shall comply with Rec�ufation CONS.

now found themselves in a rather nebulous situation of attempting
to enforce a conglomerate of various rules and regulations. I
had an occasion today to talk to Chief Nelson from Coon Rapids who
expressed to me that they have considerable problems with complaints
regarding snowmobiles at this time. In further discussion with Chief
Nelson I find that they have a considerable amount of ordinances
and regulations governing the use of snowmobiles including the re-
quirement of permits. Chief Nelson's comments are basically the
same as those that I have received from other Law Enforcement offi-
cials that the ordinances are practically impossible to enforce.
The unforceability of ordinances basically rests with the multitude
of variances that exist within each ordinance and within ordinances
of each city coupled with the extreme difficulty of practically
apprehending snowmobile violators due to their fast mobility from
the time of the complaint to the time the officer arrives on the
scene. This is also coupled with the great variance in age of the
snowmobile operators.
Apparently as a result of this rather difficult situation on a.
state-wide basis, our State legislature, on April 11, 1974, approved
a new statute(84.90) governing the limitations on the operation of
recreational motor vehicles. In reviewing this rather simplistic
law we find it to be quite practical although a strict enforcement.
of this new statute has not been initiated as of this time. Of
particular importance in Minnesota Statute 84.90 is subdivision 2,
which in essence states that within the seven-county metropolitan

area, na person shall enter and operate a recreational motor
vehicle on lands not his own, except where otherwise allowed
by law, without the written or oral permission of the owner,
occupant, or leasee of such lands. Written permission may be
given by a posted notice of any kind or description that the
owner, occupant, or leasee prefers, so long as it specifies
the kind of vehicles allowed, such as saying "Recreational
vehicles allowed", "Snowmobiles allowed", "Trail bikes allowed",
"All terrain vehicles allowed", or words substantially similar.
Another important section of this law is subdivision 6 which states
that nothing in this section shall limit or otherwise qualify the
power of municipalities of the state to impose additional restric-
tions or prohibitations on the operation of recreational motor
vehicles on property not owned by the operator in accordance with
law. �
As I had previously alluded to we in the City of Fridley have done
extensive research and work regarding the problem of recreational
motor vehicles ouer the past few years. Both the City Manager's
and Public 5afety Director's office have extensive files on
samples of various ordinances throughout the Twin Cities area, as
well as a proposed ordinance that I had personally drafted for
review by the City Attorney in the early part of 1974. In addition
the City Attorney had submitted a memorandum to City_Council on
April 15, 1974, listing three alternative actions the Council could
have taken regarding the snowmobile or recreational vehicle prob-
lems. The City Attorney also had attached to his memorandum a
draft of an ordinance that he had prepared. Due to the voluminous
nature of all of this material I am not attaching same to this memo-
randum, however the material is available for review. It should be
noted, however, that all. past material and proposed ordinances
would have to be modified in light of the latest State statute.
I�would like to call to the Council's attention the extreme diffi-
culty the Fridley Police have had in attempting to enforce our
current ordinance 703.022. This ordinance states that no person
shall operate a snowmobile upon the right of way of any municipal
street except for the limited purpose of transporting said snow-
mobile from the place of the owner's re:sidence to property that has
been authorized for snowmobile use. Th.e police officers have found
this particular ordinance to be practically impossible to enforce
for obvious reasons. Almost without ex:ception all individuals
stopped on City streets state they are going to and from the desig-
nated area. This law then in effect ha.s given violators a tapl to
use to avoid being charged with a viola.tion. This, of�course, is
somewhat frustrating to the police offi.cer, but in reality it
becomes much more frustrating to those citizens that are disturbed
by the snowmobiles being operated upon the streets. It becomes
very difficult for the complaining citi.zens to understand why "the
police can not or will not do anything" or why "the police simply
stop the snowmobiler and let him go".

I could now list various alternative actions City Council could
take from the extremities of not doing ,�nything to total abolition
of the use of snowmobiles in the City of Fridley. I do not fee1,
however, that the extremes are very pra��tical to implement. For
this reason it would be my recommendati��n that Cit� Council simply
direct the City Attorney to draft a new ordinance which addresses
limitations of the use of "Recreational motor vehicles", rather
than our current ordinance regarding "S:nowmobiles". In drafting
this ordinance I would strongly urge th.at the primary portions
of Minnesota statute 84.90 be utilized. In addition, I would
suggest that the City Attorney receive recommendations from the
� Police Department regarding additional restrictions,that need be
added to this ordinance with respect to the use of snowmobiles in
the designated areas. Such sections would basically address the
issue of maximum speed, hours of operation, et cetera. It would
also be my recommendation that the current City Ordinance 703
regarding snowmobiles be abolished by enactment of the redefined
recreational motor vehicle ordinance. With the abolition of our
current snowmobile ordinance I would also recommend that the section
permitting the use of snowmobiles on City streets simply be not
addressed which would make it a violation, or specifically addressed
making it a violation to operate on any City streets except under
certain emergency conditions. This in effect would require those
snowmobilers who desire to use designated City areas to trailer
their snowmobiles to the areas. It would then be practical for
Law Enforcement officials to tag those violators operating on
public roadways since the operators would then have no defense for
such action. I should also like to call to your attention that in
Dan Huff's memo to you on January 9, 1975, regarding his phone
�� survey that 9 of the 19 communities, abc�ut 50%, do not allow public
streets to be utilized for the operation of snowmobiles. It is
fully realized that this will create some hardships on some people
and that Council more than likely will receive several complaints
from legitimate snowmobilers regarding this type of action. This,
however, is strictly a political policy determination that must be
made by City Council.
If it is Council's desire to allow the use of the City streets by
snowmobilers for the purpose of operating to designated areas, it
may be more feasible simply to allow all City streets to be used
by snowmobilers under certain restrictions. As drastic a°measure
as this may sound, we must understand that the current ordinance
regarding this subject is practically u.nenforceable and becomes a
causation factor for strained public relations for those citizens
that want and demand the law enforced.
I appreciate the fact that the control and use of recreational
vehicles, particular snowmobiles, is a very delicate situation.
I feel Council should also keep in mind. that the majority of
complaints that all of us receive regar�ding this subject matter
are basically from those people that do not enjoy the noise or
appreciate the use of these machines. Consideration should be

876 the terms def ned herein shall have the meanin; ascribed t�x them.
Subd. 2. `Per�,on" inclucles an in�lividual, partnership, corporztiatr, the state
and its agencies and sutxtivisians, and any body of pe*sons, tivhe.ther incorporated
or not.
Subd. 3. "Sno�vmobile" means a self-propelled vehicl•� designed tor t� avel on
sno��� or ice steered by skis or rimners.
Subd. 4. "O�vner" means a person, other than a lien holcler, Y:�ving the prop�
erty in or title ta a sno�vmobile en�itled to the use ar possessiori tiierenf.
Subd. 5. "Operate" means t:o ride in ar on and contr�l t::e op.eration of a snocw
mobile.
Subd. 6. "Operator" means every person who operates or is. in actual physical
control ol a snowmobile. .
Subd. Z"Register" means the act of assigning a registration number to a
sno�vmobile.
Subd. S. "Commissioner" means the commissioner of natural reso�,irces acting
directly or through his authorizecl agent.
Subd. 9. "Roadway" means tI7at portion of a highwa� improved, designed, or
ordinarily used for vehiculartraveL
Subd. 10. "I>eaIer" means a person, partnership, or coz�poration en;�aged in the
business of selling snowmobiles at whalesale or retail.
Subd. 11. "Mantif:�cturer" �neans 1 person, nartnerstup, or corporation engaoed
in the bus?ness of mar:ufa.;turinL; sno�vcnobiles.

(f) Any sled, iPttilCr, or other device bcing to�c�ed by a sno��,mnbile must be
equipped �vitli reflective materials as required by rule and rebulation of thc com-
missiotier.
