proposal. A member of the Fridley Norseshoe League requested that the
Council consider expanding a cenirai Couri for use by this league and
the Councii consensus was that this being a smail item, there would nat
be too much problem in providing this, but the representative should work
through the Park Corr�nission.

�on Lots 6 and 7 when the easement for Lat 8 was jogged over. Mr. Kok said he had
. no objection to part o� ihe easement being retain�d if they needed it to join up ��ith
the new Pasement for Lot 8, but he would want to determine that �his•garage wasn't on
any part of �he easement �hey wanted to re�ain. He said the garage was 12 feet
, back fro� his house. � �

Mr. 6oardman said the City would probabl�y retain that part of the South 6 foot
easement that lies 85:31 feet from his West property line, so that's the figure
that Mr. Kok should us� in measuring his property.
MOTION b� Drigans, seconded by Langenfeld, that the Planning Commission continue
the consideration of a vacation request, SAV #75-05, b� R�cl�ard Kok, to reduce the
drainage and utlity easement from 6 fcet to 0 feet on the South side of Lot 6, B1ock
1, Clark's Addition, the same being 6517 McKinley Street N.E., until August 6, .197�,�

Mr. Verlyn Vander Lugt was present.
Mr. Qoardman said this was an old street easement. The only �,ray the Ciiy could
use this easem�ni would be far access to tf�e park property but the c7rade on this
easement would not lend itself to such access, so this tti�as street right of ��ay the
City would never need. He said this righ� of way continues from Sit�erts Lane all
the way through the property purchaseu by Mr. VandPr Lugt.
Mr. Drigans asked if this was a bu�lclable lot and if a home could be built on
it without variances. Mr. Boardman said it was a b�i�dable 1ot and he didn't think.

� Mr. Va.nder Lugt said that if the street right o� way wasn't on Mr. Sivert's
property, he had, in his purchase agreement? permissior� from Mr. Sivert for a 33 ft.

way was on Mr. Vander Lugt's property, he felt that it went at� the way through on
Tract C. �
Mr. Vander Lugt said he was certain that the 66 fooi: easement went through Mr.
�i�rert's property, because after the last Councii meetinq he had stated that he
thought he would a�sk for a partial yacation of this right of way because his water
supply w�s on this easement.

Mr. Drigans asked if there w�re any other easements on this property other than
1 , the street right of way? Fle asked how services were provided? Mr. 6oardman said the
street right of way could be used for utility easements if services ever became avail-
able in this area.

Mr. Harris asked how sewer and water were handled in this area. Mr. Boardman
said that sev�er and water were not availabie i`or this area, and they were a71 on-
iand systen�s. Mr. Harris said he didn't think that the Metropolitan Waste Control
Agency would allow that type of system any more. Mr. Boardn�an said that all the
property in this area had on-land systems. He said the lot size of Mr. Vander Lugt's
property was suffiicient to qualify for this type of system.
MOTION by Scott that the Planninq Commission recommend to Council approval of the
vacation request, 5AV #75-07, by Ver.Zyn Vander Lugt to vacate the street easement .

Mr. Drigans said h�e thought they were rnoving too fast; on this rec�uest.
h1r. B�ardn�an sai d that tfie fact �hat there Gvas .going to be an on-1 and system
on this propert;y was nothing that should concern the Planning Commission on the
vacation request, because ihis met the Sta.te requirements and had alread,y been
discussed by t;he C;ty Co�ncil. He s�id the street riyht of way that i�ii°. Vander
Lugt wanted to vacate was street right of�way that -rhe City woulr.i never need, and
if there was not street right of way on �;he balar7ce of Tract C, it was in the
purchase agreement �hat access wo«lc# bp �r�n�;ed, a�d this cauld be worked out
legally if it was necessary. �

� Mr. Scctt said there vre7Te na util7ties goif�g to'this property. The City has
agreed in principle to provide ser��ice to the u�improved por�ion of tl�e road going
into ti�is property, that was plowing this road in the winter time, even if it was�
not improved. He said the o�ly thing �:he Plaraniri� Commission ��ras doing by no1;
granting tf�is vacation reques� was denying t,�e person to build a i�ouse. He has
met every ather criteria in the work, that ar7y other b�reaucratic organization
cou�d confror�t him with, and he has overco�,�e i:hem all. The only thing that was
s�toppii�g hi��� ��°om buildii7g h:s house was t�e fac� that h� couldn't build it on an
easement. He said he tiiought they were placing an inordinate burden on the purchaser
of this pro�erty and that Mr. Sivert� had cooperated, the neighbors had cooperated and
the p etiticner had been to several Council meetings to iron out a11 tha small
problems on this property. The only thing thai: was keeping him frani building a
home and iiving in FridIey was the fact that we �,rant to keep an easen�ent that will
never be used, by staff's testimony. .

Mr. Qoardman answered that he couldn't see any problem with vacating the
street easement. There was absalut�ly no tie un that property. We cannot use
that street easement because the grades are ioo steep i:o use it for access �o the

utilities on property. Mr. Qoardman said it was, but on these properties, utilities
were provided by the property owner. He said that in th�is area, Tract A was park

served from Central Avenue, if utilities were available. Tract C and D could be
served from Siverts Lane. Mr. Qoardman'said that if utilities ever did�go into
this area, the easen�ent on Mr. Sivert's property could serve Mr. Vander Lugt's

Mr. Scoi;t said the City has agreed in principle to provide the services that we
generally asso�iate with an improved street, noi; to maintain this road, but to plow
it, and the people can contract with the City to repair this street, to keep the

Mr. Scott said it was City policy not to maintain anything but an improved road.
There had been a public hearing for improving this road, but the residents of the
area stated �;hat they did not want an improved road in this area. They have been
maintaining.it th�mselved. Therefore, the Cit:y cannot lec�ally main�ain ihis road.
One of �he Councilmen said that due to the natu:�e of the area, they would not improve
the road, but they would run the plo��� through t:�ere. Nr. Scott said that all �;he
neighbors were in agreement with this whole concept.'

. Mr. Drigans asked the size of Lot 30. Mr. Narris said this t�as a 3B 1/2 foot
lot, and w�th the 30 feei; of street right of way this lot would be 68 1/2 feet wide.
He said the {�reseni; depth was 129.3 and with the additional 6 ft.acquired through the
vacation of the alley, it wouid be i35.3 feet deep. This would make the lot 9,268
square�ft. which was in excess of our minimun lot requirement of 9,000 square feet.
Mr. Drigans asked whathappens to the other 6 feet section of alley when the
highway ience ran along this area? �
Mr. Cornelius Warzecka, 4675 3rd S�r�et rd.E. said he lived in this�area, and
tfie people maintained their property all t;he way up to the highway i'ence.
� Mr. Harris asked Mr. Lemke if he had a plan that would fit on this lot, due to.

An easemer�t must be granted bet�;�een Lois �. and 5 of the proposeci plat, to a11ow the
sewer to be brougl�t out to serve the �(;wo houses that -Face Eas�t River Road, and also
allow the water main to L�e looped out to the ma�in on Cast River Ro�d, to ensure proper
��aater circulation of the ��ater system. Qack in the previaus approvals, it was noted,
and it i�ras sti11 true, that o�Lher right of ways are necessary to get access to this
plat. l�fe no�N have on file, a 25 foot easen;ent on Lot 31 for s�;reei; right of way, bui
we have riothing on file o« Lot 34 to g�ive the other fialf of the dedication, or to
provide adequate r-ight of way �o bring the streei•in from Rivervie�v Tei�race for pubiic
access to another public strect. The Co�ncil had previousl,y authorized the negotiations
for these right of ►�rays, but until �ve have a plat proba�ly on file, the City, if it
spent any �noney, woul dn `t liave a pi°oject to assess i�t to, and that was one of t}�e reasons
�these right of ways hadn't been acquired.
Mr. Clar{: suid that the Engine�rir�g Department had lookcd at this plat, und has
said that i t 4vas feasi bl e to serve i t W1 �Il se��rer a��d water, pravi ding ti�e ri ght of
ways were acquired. He said that James Nedren, was present, representir�g Riverwood
School, and h� had recalled some of the original conversations, and there �vas some
dilemma back in previous approvals as. to �rhetl�er the access sl�ou�d go out to East
River Road, or.out to Rivervie��� Terrace, or both.� Tt was thc consensus of the staff,
Planning Commission, Streets � Utilities, and Council, that the access should be to
Rivervie�N Terrace, and not go out to East River Road, because this was a blind inter-
section. � �

drainage and utility easement on �;he South side of Lot 6, Block 1, Clark's
Addition, the same being 6517 McKinley Street N.E.
Mr. Richard Kok vaas present.
� Mr. Clark said this item had been continaed a couple of times, once because
the petitioner was not present and another time to allo�ti� the Engineering staff to
determine the utility pat�:erns in this particular block. He said there was a memo
� and a map in the agenda explaining the part o�f t'�is easernent that had to be retained.
P�lr. Clark continued that the Engineering Depar�f:���ent had no objection to 85.31 of
ihis easement being vacated on Lot 6, Blocic l, �lark's Addition, but they N;ould
� need �;he balanc� of this easement to line up 4��ith an eas�ment i;hey would need to
fol lo�� the f�ot'til-SOUlII boundaries of Lot 7, alock 1, Clark's Addition, and Lot 8,
alock 3, P�oore Lake Parl: lst Addil�ion. He said the mapshoti�,�ed that the-existing ga�age
did encroach into the 6 foot eas�ment. Gy retaining part of this easement, a very
� small portion of the garaqe ��ras still in the easement, but the recommendation was to
allo��r this very small pori.ion to encroach into the easement.

easement on �he (�or�ch bounda.�,y of Lot 7 be vaca�:ed also. �ir. Clark said there ��vasn't
any recommer�dation, just that if it ���a�s vac.ated, to be sure the same part of this
� easement ��as reta�ined as on the South side ofi Lot 6. Mr. C1ar{c said there �-rere no
uti 1 i ti es i n thi s easement, i:hey ��aanted to rei.ai n, but i 1' they have 1 ooked at the
area, they would be a���are ti�at there v�as a loti�' spo�l: North of Lot 8, and Eas�L of Lot
6, and it mt�st �Lrap water. If the people in the area should ever petition the Ci�;y
� to drain that low area, we would huve to have an easement to get a storm sewer back
into th�is area, and feel that the logical alignment �vould be bet�veen Lots 7 and 8.

North side of Lot 7, if the easement was vacated on Lot 6,,except for the part needed
f�r a potent�ial storm se���er easement. A half of an easement wasn't good �or anything.
Pir. David Harris said he agreed witf� �1r. Drigans. .

ir► this easement would cause him problerns if he vrarted to sell i:his property. He

Mr. David f,arris said wha�L P1r. Kok was questioning ti�as i;hat if a title searc9�
tivas done Ot1'this pro�erty, prior to selling it, he��might have a problem. Mr. Clark

him quite honestly and frankly that they probably wouldn't be pu�: in until next
spring, because there are hearinc?s on the plat still necessary, and after that there

BE IT RESOLVED, Qy the Council of the City of Fridley as follows:
SECTION l. That the Council of the City of Fridley in the month of
August, 1975 received from the City Manager a proposed budget of tne City of
Fridley for the year 1975, which proposed budget when examined evidenced the
necessity of an additional i;ax levy ir► excess of the City Charter limi�ation.
SECTION 2. That the purposes for which such addit�ional tax levy is
required includes �dditional sums far the General F�nd, additional sums for
Firemen's Relief, additional su�ns -For Police Re1ief, additianal sums for a
debt service on Civic Center and additional sums for coniribution t�a �he
Public Employee� Retirem�nt F�nd.

Mrs.� t�!ahlberg said she questioned the hardship in the request f�r a sicieyard
variance f rom 15 feet•to five feet. Mr. Jacqbson said the reason they wanted to
have this variance was because the tenant of the office facing 52nd Avenue wanted
1200 sc�uare feet of space, and this was haw tf�ey would meet that request. .

A RESOLUTION BY TIiE CITY OP PRIDLEY R�QUESTING THE
MINN�SOTA HIGIIWAY llEPARTMENT TO CONSTRUCT NOISE
BARRIERS ALONG INT�RSTATE 694 IN FRIDLEY
WHEREAS, the City of Fridley is concerned about the
noise pollution associated with Interstate 694 which affects
the health and welfare of the residents adjacent to the
freeway; and
WI�EREAS, the State of Minnesota Highwa.y Department has
completed a study which indicates that due to high noise
levels, certain areas along Interstate 694 in Fridley rank
high in priority to receive federal and state funding to
construct noise barriers at no cost to ��he City; and
WHEREAS, a public meeting was held to receive comments
, from residents adjacent to the freeway regarding a proposal
from the Minnesota Highway Department for construction of
noise barriers; and
iti'HEREAS, a majori�y of the residents affected by the
proposed improvement indicated that they were in favor o�
the noise barriers; and
WHEREAS, a second public information meeting will be
scheduJ.ed to receive comments regarding plans and specifi-
cations prepared by the t�4innesoi;a Highcaay Department.
NO1V, THER�FQR�, BE IT RESOLVE}�, that the City Council
of the City of Fridley rec�uests the Minnesota Hig}iti�ay
Department to proceed wi�h design of plai�s and specifications
to constrtzct wood r�oise barriers along the South side of
Intersta.te 69� from 7th Street to Madison 5tree�, FilJmore
Street to Matterhorn Drive and r,a�terhorn Drive to the East
City limits; and, on the Nor.th side of Interstate 694 from
Polk Street to I�Iatterhor.n Drive.

on the lst day of January in each year, beginning in the year 1°i6 and con-
tinuing until all of said installments shall 'nave been paid, each installment
to be collected with taxes col1ectible during said year by the Cour�ty Auditor.
10. The City Clerk �s hereby directed to make up and file in the offic.e of the
County Au��tor uf Anoka County a certified stutement ofi the amount: of all
