The City of Fridley does ordain as follows:
CHAPTER 201. PLAIdNIP�G Ct�MMISSION '
201.01 Title
There is hereby created a Planning Comnission for the City of Fridley, TITLE
Minnesota.
201.01 Purpose
The Planning Commission is established to promote the systematic PURPOSE
and contir,uing application of organized kno�ale��e and foresight in .
the pursuit or clearly defined and properly re..,ted goals and ob-
jectives in order to create an �ncreasingly better, more healthful,
corivenient, efficient and attractive environment. •
201.03 Scope
7he Planning Commission shall serve in an advisory capacity to the SCOPE , �
City Council. Problems shall be rer"erred to the Pla miing Commission • .
by the City Council, City Administration or Chairmen of the member .
. corrmiss�ons, and may be assianed to the member commissions for
detailed study and recommendations as required. Al1 recommendations
by the Planning Commission shall be made to the City Council.
The Planning Commission is charged with resf.onsibility for continu-
ous community plannir.g and development of compr2hensiye goals and
. policies, including but not limited to, land use, housing, environ- .
ment,parks and recreation, pu�lic services, human r2sources, and .
' other related community activities.
The Planning Commission shall advise the City Couneil in the develop- �
ment of programs to aive increased effectiveness znd direction in
implementing established City goals, policies and framework and
recommend actions needed to carry out planning responsibility.
201.04 Membership � ,
The Planning Commission shall.consist of the Planniny Commission MEMBERSHIP
Chairman, the Chairman of the Communii:y Development Gommission, ,
the Chairman of the Par•ks and Recreation Commission, the.Chairman
of the Appeals Commission, thE Chairman of the Environmental Quality
Commission and the Chairman of the Human Resources Comnission.
The Chairman of the Planning Com,rission shall be appointed by the
City Councii to serve for a three year term as a voting member of .`-
the Commission. . ; .
' The Planning Commission member�s serve as Cha�rmen of the member
commissions and are appointed according to provisions outlined in the
' Ordinance es•tabiishing each of the member c��nmissions.

201.05 Vacancy • •
Vacancies in the Planning Commission are outlined in the provisions VACANCY
ofi' the Ordinance establishing each of the member commissions. The Chair-
man may resign or be removed by a majority vote of the Council.
201.06 Organization
1. Following the appointment of inembership, the Commission ORGANIZATION
shall meet, organize and elect any officers, except chairman, as
it deems desirable.
2. Adopt rules for its meetings and the transaction of its busi-
ness, in order to fulfill the responsibilities of the Commission.
3. The Chairman shall assure the fulfillment of the following
responsibilities:
a. Call and preside aver the meetings of the Commission.
b. Appear or appoint a representative to appear, if deemed
necessary, before the City Council or any City Commission per-
taining to matters within the scope of thc Commission.
' c. Provide liaison with other governmental and citizens'
groups pertaining to matters �aithin.the scope of the Commission .
for the purpose of timely and relevant information for con-
sideration by the Commission.
201.07 Administrative Staff •
The City Manager shall assign one member of the Administrative ADMINISTRA-
Staff to serve as secretary to the Commission. The secretary TIVE STAF�
shall perform only such clerical duties on behalf of the Com-
mission as may be assigned by the Chairman kith the consent of the
City Manager. Additional advisory staff �snall b� assigned to the
Connnission by the City P4anager within the restraints of the adopted
general fund budget. The Adm�nistrative Staff sha11 be limited to
the Commission level unless specifically approved by the City
Council.
201.08 Compensation
The members of the Planning Commission shall serve without pay, CONPENSATION
but may be reimbursed for actual expenses if fur.ds therefore are
- provided in the adopted general fund budget.

Th� Commission shall make such reports as requested by the City REPORTS
Council. .
201.]0 Me?tings .
The Planning Corrmission shall meet twice monthly and more often MEETINGS
' as needed. The member commissions shall meet as directEd by the
Planning Commiss�on ai,d at their own discretior, as necessary to
fulfill the responsibilities of the member commission. All meetings
shall be open to the public. Minutes shall be kept of all Planning
Comnission and mernber commission's meetinss. Findings and recom-
mendations sf�all be transmitted by the respective Chairman to' the
Planning Commi�sior, and from the Planning Commission tc the City
Council.
201.11 Repeal
The foliowing chapiers and section of the Fridley City Code as REPEAL
ihey existed prior to the adoption of this ordinance are hereby .

101.02 Purpose
7he Parks and Recreation Commission is established to promote the PURPOSE

ational activities necessary for the pnysical, mental, emotional,
morat health and well being of the residents of the City of Fridley.
101.03. Scope .
. ' The Parks and Recreation Commission shall act as an'advisory SCOPE
commission to the Pianning Commissi�n for coniinuous community
planning and deveiopmenz or comprenensive yoals and policies. A�ty
change in related community planniny and comprenensive City yoals
and policies must oe reviewed by the Planning C.on�mission who will Lhen
' �make recommendations to tt�e City Council.
The Parks �;id Recreatian Commission shall advise the City Council,

may be assigned by the Chairman and with the consent of the City
Manager. Additional advisory staff shall be assigned to the Com-

general fund budget. Administrative Staff shall be limited to
Commission level unless specifically approved by the City Council.
101.09 Project Committees
The Commission may establish special project committees to further
the objectives of the Commission and provide for greater citizen
• participation. Such project committees shall be appointed by the
Commission for special projects and shall cease to exist when their
activities are completed. The qualifications for membership, compo-
' sition and duties of such project committees shall be at the dis-
cretion of the Commission. The project corrmittee shall be chaired
by a member of the Commission.
101.10 Compensation

reimbursed for actual expenses if funds therefore are provided
in the adopted general fund budget.

For the purpose of financing the parks and recreation program FUNDS
authorized by this chapter, the accounting shall be the responsi-
bility of the treasurer of the City. The Conunission shall be autho-
rized to establish charges or fees for the restricted use of any
facility or to make any phase of the recreation program wholly or
partially self-sustaining. Any employees wf�o handle cash in the
process of coilection shalt be bonded.
101.12 Reports
The Commission shall make such reports as requested by the City
Council or Planning Commission and shall prepare an annual report
of its activities.
101.13 Meetings

Meetings shall be called by the Chairman and shall be held as MEETINGS
necessary to fulfill the responsibilities of the Commission. All

This organization shall be known as the Environmental Quality TITLE
� Comnission of the City of Fridley.
121.0?. Purpose
� The Commission is established to stimulate interest in, and to PURPOSE
• promole an a��areqess of, environmental concerns among citizer,s of
� the City of Fridley; to serve as resource agen�y to the City on
matters regarding the environment, including information on environ-
mental problems, laws, policies and regulations of the county, -
� metropolitan, state and federal levels to the extent of their effect
on Fridley; and to advise the City Council, the City Manager and
other appropriate City commissions on matters pertaining to the
maintenance or improvment of the environment; including the review
and recommendation of programs and policies within the City.
121.Q3 Scupe

MEETINGS
1. Title
The Council hereby creates an Appeals Commission to serve as the TITLE
Board ef Appeals and Adjustments and to exercise all authority
and perform all functions of said Board pursuant to hiir.nesota
Statutes 462.351 and 462.364.
Z � Purpose
The Appeals Commission is established to provide a process by which .
the public may appeal the literai provisions of the zoning ordinance,
sign ordiannce and building code, for reasons of exceptional circum-
stances when strict enforcement would cause undue hardship and strict
con�rormity of the standards would be unreasonable and impractical or
not feasible under the circumstances.
PURPOSE
3. Scope _ �
a. The Appeals Commission shall act as an advisory Commission SCOPE
�to the Planning Commissicn for continuous commun�ity planning
and development of the comprehensive City goals and policies.
Any change in related community planning and comprehensive City
goals and policies must be reviewed by the Planning Commission
who tvill tne'n make recommendations to the City Council.
b. The Commission shall have the power and duty of hearing and
recommending to the City Council, after a policy �•eview by the
Planning Commission, as herein provided, appeals or requests in
the following case�: �
1. �Appeals where it is alleged that there is an error in
any order, r�ecuirement, decision, or determination made by
an administrative officer in the enforcement of the zoning
ord;nance, sign ordinance or of the State Building Code.
2, Requests for variances from the literal provisions of
the zoning ordinance, sign ordinance or of the State Building
Code in instances where strict enforcement would cause ur.due
hardship because of circumstances unique to the individual
property under consideration.
� ' In recommending a varianc" the Commission, and the Council on
approval, may impose conditions to ensure campliance and to protect
; adjacent properties.

7he Commission shall consist of five members, all members shall be
appointed hy the City Council for three year terms, except the City
Council shall stagger the appointments so that the terms of no more
than two members shall expire in any one year. Attempt shall be
made to have all.City wards represented on the Commission. Upon
the expiration of their terms of office, members shall continue to
serve until their successor shall have been appointed.
� The Co�nission shall each year, rrom their own numbers, choose a
' Chairman and a Vice Chairman. At any meeting of the Commission, if
the regular Chairman is unable �to attend, the Vice Chairman sha}}
act in his place.
5. Vacancy
Commission members may resign or be removed from office by a VACANCY
majority vote.of the City Council. Attempt shall be made to have
all City wards represented on the Commission. The Commission
, member appointed to fill any vacancy shall serve for the remainder
of the vacated term. ,
6. Organization
1. iFollowing the appointment of inembership, the Commission ORfANIZATION
shall meet, organize and elect any officer�., as it deems desir-
able.
2. Adopt rules for its meetings and the transaction of its
business, in order to fulfill the responsibilities of the
Commission.
3. The Chairman shall assure the fuifillment of the following
responsibilities:
� a. Call and presida ovar meetings of the Commission.
b. Appear or appoint a representative to appear, if deemed
necessary, before the City Council'of any City Commission
pertaining to matters within the scope of the Commission.
c. Provide liaison with other governmental and citizens'
groups pertaining to matters within the scope of the Com-
mission for the purpose of obtaining timely and relevant
irtformation for consideration by the Commission.
7. Administrative Staff
_ The City Manager shall assign one member of the Administrative
' Staff to serve as secratary to the Commission. The secretary shall
perform only such clerical duties on behalf of the Commission as may
be assi�ned by the Chairman with the consent of the City Manager.
Additional staff shall be assigned to the Commission by the l',ity
Manager within the restraints of the adopted general fund budget. The
Administrative Staff shall be limited to Commission level unless
specifically approved by the City Council.
8. Project Committees
The Commission may establish special project committees to further
the objectives of the Commission and provide for greater citizen
participation. Such project committees shall be appointed by the
Commission for. special projects and shall cease to exist when their
activities are completed. The qualifications for membership, compo-
sition and duties of such project committees shall be at tne dis-
cretion of the Commission.

10. Reports •
The Commission shall prepare such reports as requested by the City REPORTS
Council or Planning Commission. ' .
11. Meetings .
Meetings shall be called by the Chairman and shall be held as neces- MEETINGS

of the Commission shall be open to the public. Minutes shall be kept
of all meetings. Findings and recommendations shall be trans�itted

205.182 Petition by Owner
At any time within thirty days, any propert.y owner wi�o deems h�mself
aggrieved by an alleged error in any order, requirement, decision
or determination made by an administrative officer in the enforce-
ment of this chapter which affects his property, may appeal to the
Commission by filing a written appeal with the City Manager. The
appeal shall fully state the order appealed from the facts of the
matter,.and also the mailing address of the owner.
205.183 Recommendation by Appeals Commission
within thirty (30) days after filing an appeal from an adminis-
trative order or determination, the Commission shall set a date for
hearing thereon and shall hear such persons as want to be heard,
either in person or by agent or attorney. Notice of such hearing
shall be mailed not less than ten (10) days before the date of
hearing tothe person or persons who file the appeal.' Within a
reasonable time, after the hearing, the Appeals Commission shall make
its recommendation and forward a copy of such recommendation to the
City Council through the Planning Commission.

205.185 Variances

practical diffieulties or particular hardships preventing the
strict application of the regulations of this chapter. An appli-
cation for a variance shall be filed with the zoning administrator

practical difficulties claimed as a basis for a variance. �
205.186 Action of the Council
The Council shall at its next regular meeting after receiving the ACTION OF
, recommendation of the Appeals Commission with a policy review by the THE COUNCIL
Planning Commission, decide on the action to be taken.
205.187 Lapse of Variance by Non-use
; Whenever within one (1) year after granting a variance, the re-
cipient of the variance shall not have completed the work as.per-
mitted by the variance, then such variance shall become null and
. Void unless a petition for extension of time in which to complete
� the work has been granted by the Commission. Such extension shall
, be requested in writing and filed with the City Manager at least
! twenty (20) days before the expiration of the oriqinal variance. '
� The request for extension shall state facts showing a good faith
� . attempt to complete the work permitted in the variance. Such petition
� shall be presented to the Appeals Commission for hearing and decision
� in the same manner as the original request for variance.

This Commission shall be known as the Community Development
Commission for the City of Fridley.
216.02 Purpose

TITLE
The Community Development Commission is established to promote PURPOSE
and maintain high quality community standards to ensure a well bal-
anced and orderly development, ret�abilitation and redevelopment of
the City of Fridley; including, but not limited to economic develop-
ment, industrial and commercial development, housing, transportation
services, public utilities, community development proje�ts, and other
related development activities.
216.03 .Scope
The Community Develo,ment Commission shall act as an advisory Com- SCOPE

' Mr.. Mattson explained the elevations were verified and it was found they are correct
', �and it is felt there would be a distinct probl�n with the curbing. He said the
water would be seeping into the building through the �joints and this building is
not designed to handle this.• '
Mrs. Wahlberg asked if there was any curbing there now. Mr. Schmidt said there
wasn`t because the ordinance did not exist at that time. He said they ar.e
• asking to let them forget about this curbing. Mrs. Wahlberg asked i£ there-has
been any seepage now and Mr. Schmidt said there hasn't been as the water has a
cha.n ce to drain away from the structure < ' ��
Mr. Kemper asked_if there was any type of concrete abutment existing. Mr. Schmidt
there �vas none as this is used only as an.access area to the par.king lot.
Mr. D9attson stated that to prevent seepage if the curbing had ta be instalJ,ed

Chairman Drigans informed the Board that it has been suggested by various.people
that any �rvicess by which the City could spe�d up certain variance applications
would enhance the building season in Fridley. He said specifically the area
tha� the Board should concern themselves with is the residential structures that
.are currently existing where they propose an addition of living ar.ea or a garage
addition. He said the process now, with the reorganization of the Commissions,
requires that all requests from the Appeals Board funnel through the Planning
Commission and then to the.Council. tie said it does delay the approval proces:;

Board should not concern tk�emselves with the industr.ial so much but worry more
about the residential because that is where the real hardship is, where the

applications. He said people sometime do no� even know that they need a building
permit and some want to get it done in the building season opposed to a contractor
in the business who knows the Code and whose business ii is to know the Pror.adure
to go through.
Mrs. Gabel asked if the Board could safely say R-]. anly, that would include new

� Mr. Drigans said this had been discussed at the last Planning Commission meeting
but no recommendation had been made. Ne said that i:hey•were asking that Ordinance No.
584 be amended to include this recommendation and also to include something- that had
just been policy before. 7his was the notification of all adjacent property owners
t��ithin 200 feet of the variance location.
Mr. Drigans�said the problem was the amoun� of time it takes to process a
variance (about six weeks) and this was a�particular hardship in a residential area. •
The Appeals Commission felt this was a particular problem for people who did not know
the procedure to follotv when they �•�anted to build a garage or an addition to their
home. These people are usually not in the construction trade, ai�d i:hey �rant to modify
their residence in some �vay, and are usually going to do the job themselves. They draw
up their �1ans, have the financing, and then come in for a building permit. .Then they
find out ihey need a variance 4rhic:h has to be approvea before th� bui1ding permit can
be issued. When they find out they �vi11 �have to wait a mi�numum of six��vreeks �.o get
variance approval it creates a lot of animasity. Residents relt they were being
harassed by the administrative staff. Ydhen they appear before the Appeals Commission
they usually say they didn`t knovr they �,rould need a varianc�. . �
The Appeals Commission felt there ►�rere somE variances the l�ppeals Cammission
could make the final decision on. These r�rould be on residential property (R-i Zoning
only}. All other zo;�ing districts w�ouid go through�the normal procedure. In order
for'the Appeals Comm7ssion to give final approval four things would be necessary.
1. There would have to be unanimous� agreement of 1:he Appea1s Commission. ,_
2. i'he staff would have to concur with the recommendation of the Appeals Cammissior

Mr. prigans said the reason they included �the staff was the fact that the staff �
deals with the building code on a daily basis. They know what variances have been
granted in an area, and what type of variances have been granted before. Their function

under the section Praject Committees, this sectipn of the ordinance did not have

SUBJECT: The Acquisition of Lots 1-2-3, Block 15, Fridley
Park �ddition for Park Purposes.
Lots 1,2, and 3, Block 15, Fridley Park Addition are located
in neighborhood #9 (defined by barriers which include Mississippi
Street, East River Road, and Burlington Northern Railxoad).
The 1970 population for the area was approximately 232 total
persons which included 13% between the ages of 0 to S and 26%
between the ages of 5 to 15. This area has not been subject to �
population changes or moves which would be necessary to maintain a
young population. Therefore, it can be anticipated that the
population between the ages of 0 to 5 has decreased considerably and
the 5 to 15 age group has remained fairly constant but will reduce '
in numbers over the next 5 years. This will mean an overall matur-
ing of the neighborhood with a total reduction of the number of
persons taking place.
In Iooking at the recent housing statistics we can anticipate
a fluctuation in the ovexall character of the neighboxhood over the
next 10 to 15 years. There are a total of 60 units in the neighborhood
of which approxima�tely 56.8% are between 20 to 30 years old, 10% of the
units are in need of major repair. 83.3% of the units are still owner
occupied, however, this is somewhat below the City average.
It is anticipated that the neighborhood will ehange primarily to
a renter occupied neighborhood and will follow the comprehensive plan

recommendation for multiple development.
Neighborhood #7, directly West of Neighborhood #9 has a total
of 21.8 acres of recreation areas,' park and school property, to
satisfy a population which would only require 5.4 acres for any
anticipated future population. These facilities could be easily used
for the needs of Neighborhood #9 with the provision for safe access
across East River Road. This access is anticipated with the provision
of phase•3 of the bikeway systems plan. At present time there are
signals provided at 61st and Mississippi Street along East River Road.
Because of this data, the sizes of the lots in question and the
administration of total 1ot size facilities I would recommend that
these lots not be utilized for park facilities and efforts shDUld
be transferred to providing safer access to available facilities.

which she said she tivouid try to find and examine for ideas.
Mrs. Wyatt explained that only two members(of the Committee designated to pick
the best name,for each park from the entries) shawed�up at the meeting held for that �
purpose. She said the name, far the five parlcs were then chosen by the two members.,

� Mr. Peterson said that this aras a situaiion where when any tax delinquent
property becomes available, the Parks & Recreation puts a red iag on it because it
might fall into the all-over program af land acquisition, because this�was the
type of land w� shouid get. He said the Par°k Director said this property was not
needed, and based on that we recommended that these lots be released, un1ess the
Planning Commis�ion felt differently. � ��
Mr. Baardman said this was in the South �alf of Section 15, and was in a� .
area designated as Neighborhood 9, which has a popul�rtion �f 232 people� He said
the recomrnendation for this neighborhood was that at present the low population in
this area doesn't warrant addit�ionai park land and accent should be p1aced on access
to adjaceni park �acilities. t�ith the bike��ay sys�em, we wou'Id have that access.
Mr. Peterson said that this property wasn`t large enouah far anything.but a
tot lot. h1r. Boardman said that there were 13 children.bet��reen 0 to 5 years old
and 26 children betti�een 6 and 15, so this was not a good�area for a tot lot.
Mr. Harris said there was only one tot lot in this entire area: Mr. Boardman
said some sort of agreemeni �hould be urorked aut with Stevenson Schoal and �h� Isiand
of Peace. Mr. Peterson said they did work with the scl�ools on park programs. They have
put in jungle gyms on school property so there would be a�universa�l appeals to a11 age
groups. Ne said the top pr�ority in �his area was access.
� Mr. Boardman said the park survey shows that the area between 64th 4Jay to
Mississippi ►-ras not adequate1y served by parks, but he didn't kno�,t if the population
in this area t�lould justify the purchase of property. He said that what they had
anticipaied in this a,rea in the comprehensive plan Vras that this was a changing area.
We anticipate that future growth in this area wou1d be more the apartment type develop-�
ment, and that any recreation area that would be needed b� provided by the developer of �
the complex.. , � : � .
� Mr. Harris asked ��hai they could do for ihe people in this area�now? Mr. Boardman
said the main problem wou1d be in providing access across East River Road. Mr. Harris
asked Mr. Peterson if he could bring this �o the attention of the Parks & Recreation
Department. : - � � . _
Mr. Peterson s�id there weren't very many 4 and 5 year olds in this area, and _
�tvith the park budget for ilext year, they weren't goii�g to be abTe to prov}de as many
services as �hey did this year. They i�ave higher prioz^ity areas, where they can serve
200 people, so this was a low oriority area. bJe can contact the school, and see if an
agreement could be reached to provicie.some recreation tf�ere. There was no money to
pick up the delinquent�taxes and assessments, sa this was ti��hy tive recommended releasing
these 1ots. . .�

1976 CITY CGUNCIL NtEETING AND HOLIDAY SCHEDULE
The attached holiday schedule is proposed for 1976. The holidays
listed are those required by City Ordinance. Because Christmas Day
and New Year's Day both fall on a Saturday, the day before each
holiday is declared the work holiday. �
In addition to those holidays, the day af tier Thanksgiving is
proposed as a holiday. This day has been a designated Gity holiday
for the past three years. The total of el.even proposed holidays is
the same as the total of holidays scheduled in 1975.
A11 regular employees will receive el.even holidays or 88 hours.
City Hall will be closed on these holidays.
The Department Heads will have Che discretion to fit these
holidays into their departmental schedules.
