TEtJTATIVE GUIDCLINES FROM THE PLANING COMMISSION
ON SUaSTAtDARD LOTS
4/7/76
m
1. 7he Planniny Commission fee1s that it was consistent with the
Comprehensive Housing Plan that sub-standard lots should be
developed in Fridley, but each sub-standard 1ot siouid be con-
sidered separately.
2. That there be no variance allov!ed from the present ordinanc
allotving a maxiilium of .?5% lot coverage. (Fox example, on a
5200 square foot lot, vrhich -aould require a variance for lot
size, only 1,:00 square feet of the lot could be covered by
the house.and garage.)
3. Ifi,there is lard uvailable on eil:her side of a sub-standard lot,
every effort should be made to purchae thai 1ot at a fair
ma°ket price (y the petitiorei, so the lot size vaould be con-
. sistent -ith existing building sites in the area. If th pei;itianer
refuses Lo try and negetiate for additional vacant 1and, consideratio
shouTd be g7ven to denying the variazce. R11 denials have to be
based on good, sound considerations.
4. That the osmer/builder ma{:e as much of an effort as possible to
meet tle exi s-i ng codes.
5. That the ho«sc being built on a sub-standard 1ot biend in as
ae.:t;l;tiGally as possible with the existing houses in the nichborhoods
real i zi ig tlat a new hone cannot al aays bl ed i n±o an ol d ne ghborooci,
STAFF'S COMMENTS 4/23/76
a. Statement of hardship must include statement regardin g length
of ownership which would give indication if property was owned
for a number of years, or recently acquired with the intention
of speculating on development of a 40 foot lot.
b. All variances associated with the development of 40 foot lots
would require final approval by the City Council.

March 3, 1976
Dear Resident:
FRIDLEY, MINNESOTA 55432
In the past months, the City Council has been reviewing
recommendations submitted by the Enineering llivision re-
garding the flow in 0ak Glen Creek from East River Road
to the Mississippi River. One of the proposals consists
of the construction of a bypass storm sewer to handle the
pealc flow during spring melt and heavy rains. It would
be designed to maintain as natural a flow as possible in
the existing creek bed.
In conjunctian with this proposal, our survey crew has marked
with yellow ribbon those trees that would have to be removed
to construct this proposal.
This notice is being distributed for your information so that
you may visualize which trees on your property would be
affected.
If you have any questions or concerns, please contact Thomas
A.. Colbert, Assistant City Engineer; 571-3450.
TAC/jm
Yours very truly,

The Fricley Lions presented a check to he cit for the
areation of Moore Lake. This was approved by the Cii;,y Council.
This equipiont was never purchased, even after the Federal Gov-
ernment approved this method.
iJow it has come to our attention that he use of chemicals
are bein antisipated, even though this has been a failure and
not easilg dispense in lalce properly. This could result in
fish ki11..
At this time the rridley Lions disapointe by this inaction
of the City requesi; our creck be returned as long as no action
has been planned.

Attached please find Dan Huff's memo dated July 3, 1975 (attachment A)
with regard to the proposed aeration of the east side af Moore Lake.
It is my opinion that said memo is as apPlicable now as it was nine
months ago.
If installed, the only realistic quarantee that can be made for an
aeration system is that the fish-habitable porL-ion of Moore Lake will
be extended to its ettir depth. In addition, if the aeraLors are
operated through the winter, tre chance of fiski winter kill will be
minimized. Wi U1 the winter }:ill threat remcved, the Minncsota Department
of Natural Resources would be receptive to manaqing the fish popuZation
through stoc};ing and other techniques.
However ii mus be stated that aeration in itself does nat deal with the
overall problems of 2toore Lake. Urban development has resulted in the
accelerated eutrophicai:ion of Moore Lake through the influx of nutrients
and other pollutants from storm water runoff. To deal scientif icaZly
and realistically wit.h any problern, attempts must be made to;
1. Defi.ne the problem.
2. Define the desired objectives and eventual use of the east side
of Moore Lake.
3. Collect physical, hyclrol.oqical and bio3.ogical data.
4. Develope a plan for corrective action. Incorporated in this plan
may belake restoration techniques currently being used by other
qoveriimental agencies. Examples are: credging; la3,e bottom
consolidation, sedimentation onding, periodic street swecping of
residential Zeighborlioods, di_lution and f.lushing by adding fresh
water, storm sewer diversion, first flush di.version, education of
area residenis, etc.
5. Finance through local, state, or federal monies for the plan for
corrcctive action. To my knowledge there is no State assistance
available. A federal program that has aut.liorized the issuaJice of
$].5,000,000 in assistance is ciarrent].y receiving ap}lications or
this money, Uut a].1 applications must have technical data
substintiating any proposals. (see attachment B) Irregr@lss,
it musL- be re7lized that any financial assistance received from
the Federal Governmeni: is on a 50-50 basis and would require
matcting funds by tle City. .

FROM: MARVIN C. BRUNSELL, ASST. CITY MGR./FIN. DIR.
SUBJECT: AN ORDINANCE AUTHORIZING THE SALE OF WINE LICNESES
DATE: APRIL 22, 1976
'rJe have an inquiry from Bob Schroer regarding the issuance of a Wine
License. On November 10, 1975, the City Cou;cil held a public hearing
on the matter of adopting an ordinance authorizing On-Sale Wine Licenses.
The Council had before them at that time a proposed ordinance relating
to the issuance of a Wine License. This ordinance w as not adopted.
The ordinance is being b rought before you at this time because of Bob
Schroer's inqui ry.
Pe rhaps the Coun ci 1 coul d adopt the ordi n an ce even though the re may be
no immediate need. The proposed license fee for the tdine License was
$2,000 per year, plus an additional $100 per year for Sunday sales of
wine. I am attaching the material listed below relaiing to ihe above.

including hand-letterd signs, will

Horv cioes r ivine license dif fer frorr
an on-sale liqccor license?
Wine licenses, authorized by
Laws i975, C.hapter 345, Section 4,
which bccame effective August 1,
may be issued witfout numerica)
iimit in addition to conventionai
licenses. They may also b issued
in a city having a municipal liquor
dispensary. .
Only a restaurant inay be
granted a wine license. Except as
to seating capacity, the same
qualifications apply as for on-sale
liquor licenses; the restaurant must
be "an establishment, under the
ontra! of a singfe proprietor or
manaer, having appropriate
facilities for serving meals, and
where, in consideration of
payment therefor, meals are
regularly served at tables to the
general public, and whicii employs
an adequate staff to provide the
usual and suitable service to its
guests.". IC must have facilities for
seating at least 25 uests at one
time. The liquor control director is
infernreting this lan,age as not
permittino the issuance of ►vine
ticenses to clubs holding special
club licenses.
Anotherdifference is that a wine
license permits only the on-sa(e of
wine not exceeding, 14 per cent
alcohol by volume in conjunction
vvith the sale of food. Stroner
I Sctemker 1975

wine and other intoxicatin; liquors
still may be sold for consumption
on the premises only under an on-
sale fiquor license.
The fee also is different in the
two cases. A wine license may not
be more than half the on-sale
liquor license fee vr $2,000,
vhichever is lower. Thus, in a
municipal liquor store city having
no private license,, only the 52,U00
maximum app(ies to vine license
fees.
Unlike o►rsale licenses (except
in a few special law situations),
wine licenses must be approved by
the state (iquor control director. As
in the case of oter liquor licenss,
the application form is prescribed
by the liquor control director
thoiigl the council may require
additiona! information.
Another difference concerns
Sunday sales. Sunaay sales of aII
knds of intoxicatino (iquor are
prmitted only after a popular vote
authorizing such sales an then
only by hotels, restaurants, or
ciubs holdin on-safe licenses. /
vine license authorizes the sale af
vine on all days of the veek
"unless the issuing authorty
restricts the Iicense's authorization
to the sal of wine on all days
other than Sunday." Nothing is
said about a prior vote and the
legislative inention evidently 4vas
to leave to the council, the issuin
au:hority in the case of cities, sole
discretion with reard to Sunday
wine sales. Tte state liquor control
director is so interpreting the law.

Since wine is included in the
definition of intoxicting liquor in
the state liq.or control act,
restrictions in ttat act on sale and
consumption apply to rvine sales
by vine licensees. Restriction on
hours apply to week-clay sales.
Presumably Sunday sales are
limited to the Iours behveen 12
noon and miclni;ht; at any rate,
the council will tx within the law if
it limits sales to those hours.
'
Restictions on sates to minors and
to intoxicateci persons apply. So
does the statutory procedure for
suspension and revocation of
(iquor (icensees.
7here is no express requirement
for a bond in the ease of wine
licensees. On-sale licensees must
furnish a band of 3,000 to 5,000,
the amaunt to be determined by
the council, which may provide for
liability insurance instead. This .
provisior may not apply to wine
licensees, but under the council's
authority to impose stricter
segulaliors, the council may make
similar provision for a bond by
ordinance. The liquor control .
director is including a bond form
in t17e pacl:et of material he sends
to cities contemplatin the
issuance of_ vine licenses.
The ►e authority for vine
licenses is nofi self-executing;
therefore, any council wishing to
issue winc licenses must adopt
appropriate amendmenls .to its
lquor licersing ordinance. If ihe
city has a tiunicipal Iiquor store
but io private licenses other than
clubs, the council mrst enact a
new ordinnce. Mociel ordinances
are avaifaUle from the League.
