RES 1976-102 - 00007450164 RESOLUTION NO. 102 -1976 A RESOLUTION DETERMINING THE NECESSITY OF AND PROVIDING FOR A TAX LEVY IN EXCESS OF NORMAL CITY CHARTER TAX LIMITS BE IT RESOLVED, By the Council of the City of Fridley as follows: SECTION 1: That the Council of the City of Fridley heretofore received from the City Manager a proposed budget of the City of Fridley for the year 1977 which proposed budget when examined evidenced the necessity of an additional tax levy in excess of the City Charter limits and, accordingly, there was then adopted on the 2nd day of August, 1976, a resolution declaring the necessity for an additional tax levy and specifying the purpose for which such additional tax levy is required. FURTHER, The Council proceeded to hold public hearings pursuant to these (3) weeks published notice in the official newspaper of the City. That such public hearing was held on the 20th day of September, 1976 and all persons interested therein were afforded an opportunity to be heard and make objections, if any there be, to the budget as then proposed. That after such hearing and after full discussion of the contents of the budget and all objections thereto the Council further proceeded to correct and amend the budget in such way as was deemed necessary by the Council to be in the best interests of the City; and after such corrections and amendments the Council did pass and adopt by Ordinance on first reading on the 4th day of October, 1976 a budget for the City of Fridley for the operation of its business during the year 1977 a copy of which budget is attached hereto for reference purposes as EXHIBIT "A ". SECTION 2: Further, upon the examination of such budget originally proposed, corrected, and amended and adopted by the City of Fridley on the 4th day of October, 1976, it reasonable appears, and the Council does not find that the tax levy necessary to provide monies for the operation of the business of the City of Fridley during the year 1977 under said budget, is and will be, when computed in accordance with law, in excess of the normal City Charter limit of ten (10) mills on each dollar of the assessed valuation of the property in the City, but that_, nevertheless, it is reasonable and to the best interest of the City in order to provide for the ' proper operation of the business and functions of the City during the year 1977, to exceed such normal City Charter tax levy limit, and to levy taxes thereof sufficient to provide the monies necessary to the operation of the business of the City in accordance with said budget. SECTION 3: That to provide money in accordance with the needs and purposes of the budget of the City for the year 1977, taxes shall be levied in accordance with law sufficient to provide monies provided for any purpose herein shall be appropriated to and used for any other purpose, except as might otherwise be authorized by law, either under the general law of the State of Minnesota or the City Charter of Fridley. $1,974,563 For the General Fund $ 36,600 For Debt Service Fund - Civic Center Bonds $ 45,920 Capital Improvement Fund $2,057,083 PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF FRIDLEY THIS 4TH DAY OF OCTOBER, 1976.
