RESOLUTION NO. 47 -1976
A RESOLUTION EXPRESSING THE CITY COUNCIL'S INTENT TO HIRE A POLICE
OFFICER TO FILL AN EXISTING VACANCY AND SEEKING CLARIFICATION OF
THE POLICE PENSION STATUS
WHEREAS, the City Council took action on December 15, 1975, by the
adoption of an ordinance which indicates that all new police officers hired after
January 15, 1976 are to be placed in the PERA Police and Fire Fund; and
WHEREAS, there apparently is a question on the part of PERA as to the
propriety of placing newly hired Fridley police officers in the PERA Police and
Fire Fund; and
WHEREAS, the Police Civil Service Commission has approved an eligibility
list of candidates for police officers, and a vacancy exists in the Police Department
for a police officer after the resignation of a police officer effective April,
1976; and
WHEREAS, it is the City Council's intent to hire a police officer to fill
the existing vacancy; and
WHEREAS, the City Council wishes to get clarification as to the pension
status of the new police officer to be hired before they make the actual appointment
as it puts a different financial burden on the City; and
WHEREAS, the City Council seeks to clarify any inconsistencies that may
exist between their position as stated in Ordinance No. 605, adopted on December 15,
1975, and the position of the PERA Board; and
WHEREAS, the Assistant City Manager /Public Safety Director has been in the
IPERA Police and Fire Fund since August, 1972, and recently the PERA has raised a
question in regard to his eligibility in this fund.
NOW, THEREFORE, BE IT RESOLVED, that the City Council hereby directs the
City Attorney and the City Administration to take such action as is necessary to
clarify the pension status of police officers hired after January 15, 1976 and
the Assistant City Manager /Public Safety Director.
