Mayor Nee asked all the members of the Courcil if the.y �,rould waive the notice of the
Special Pleeting, and they did.
The Soecial hteeting of the Fridle,y City Council of January 2�, 1977 was called to
order at 10:30 p.m. by ttayor Nee.
ROLL CALL:
MEt46ERS PRESENT: Mayor Nee, Councilwoman Kukowski, Gouncilr�an Schneider, Councilman
Namernik, and Councilman Fitzpatrick
P1EM6ERS ABSENT: None
The City Planager explained the arage settlement with Local 49 as negotiated by the
h1AMA negotiating corr�nittee. The package called for n0� oer hour across-the-board
increase for 1977 and �0� per hour for 1978. The 1977 increase will go into effect
when the striking employees are called back to work. The �ackage calls for the City
to pa.y �60 �er month toward health and life insurance for the year 1977 and $60 per
month for the year 1978. The new rate goes into effect on February l, 1977.
MOTION �y Councilwoman Kukowski to concur with the recorr�endation that the City
Manager accept the negotiated settlement. Seconded b,y Councilman Schneider. Upon a
voice vote, all voting aye, t?ayor Nee declared the motion carried unanimously.
There vias a lengthy discussion on the lonqevity portion of the contract. The concensus
af the Council was that the longevity section of the contract should remain as is for
the years 1977 and 1975.

On Monday, Navember 22, 1976, I appeared before the City Council at their
study session in regard to changing or waiving the present park land
contributions.
On that night I represented Dr. William Barbush who was about ready to close
a sale. We have had to abandon platting because of this requirement.
A lU% fee is excessive.
I can see a nominal rate based upon appraised value but with a maximum per
lot or building site. I suggested at the meeting a$300 to $500 maximum
per building or lot. Even that is a little bit of extortion.
The City is better off to have the remaining business (non-homestead} sites
b�ilt on. Such development should ,be encouraged.
The Datsun people paid something like $75,000 for their site. Would a park
fee of $7,500 be reasonable?
I could give you a dozen of these examp7es that would seem as ridiculous.
Would you please keep me informed as to the progress in considering this
question. �

SUBJECT: ANTI-RECESSION FUNDS
DATE: NOVEMBER 29, 1976
On November 19, 197G, the City received $23,063 in Anti-Recession Revenue
Sharing Funds. This is for the July quarter and the October quarter. The
attached letter from the Secretary of the Treasury gives sorne of the
background regarding how the funds must be spent. The important part is
the funds must be appropriated or obligated within six months from the date
of receipt of the check and the funds must be used primari ly for the
employment of persons in the provisi on of basi c servi ces by the Ci ty,.
I interpret the rules and regul ati ons to mean that thi s expendi ture woui d
have to be made over and above the normal 1977 Budget expenditures inasmuch
as these funds are not part othe 1977 Budget.

provisions of Title II of the Public Works Employment Act of
1976.

change and will be redetermined before a payment can be made

Participants will be iniroduced to winemaking through demonstration and
lecture. Program wi11 include equipment ingredients, fermentation, aging,
bottling, and general wine appreciationo T��ro sessions vrill be held at the
Fridl�ey Branch Library at a cost of $2.00 per participant. 10 participants.
11) LAQIES DAY OUT
This program is offered for a11 women in Fridley interested in an
afternoon a�•�ay from the house. Past outings I�ave includ�d a trip to the Old
Log Theater, the Guthrie and the Chanhassen. Registration fee, dates and times
vary with the location of the trip. 50 participants per trip.
12) YOUTH tdRESTLING
This is a six session instructional program for youth in 4th, 5th and
6th grades who would like to learn to w�°estle. The program will be held at the
Fridley Senior High School on Plonday and tdednesday evenings beginning March 21,
�977. The program i•rili terminate April 6th with a taurnament for all youth.
Registration not open as of this date.
CITY E�1PLOYEE FUNCTIQNS
A} Spaghetti Luncheon - The Parks and Recreation Department prepared and
served a spaghetti dinner in October, 1976, for all interested City
employees. Cost per plate was $1.50.
B) Horseback Riding - A Sunday afternoon of horseback riding and a potluck
dinner was planned for all City employees in September. Response was
paor and the event was cancelled.
C) .'Ski Touring' - A movie of cross country skiing called 'Ski Touring' was
shoi�n during the lunchhours for all ei;�ployees interested in cross
cau��try s{;i i ng. .

After reading �1ayor P�ee's Memorandum, I certainly concur with his
� Me►n�rar,dum, and as far as I am concerned, it is the current un��ritten
policy af the Parks and Recreation Depar�ment ihat fees should be and
will be waived for any individual unable to meet the costs or expenses
of a program. Tf a t�rritten policy is desired, and i feel strongly
�that tf�ere should be a written policy, I might suggest something that
may read as follows: � .
Gdaiver of Fees - The City Council�authorizes the Parks and
Recreation Director, on an individual basis, to eii:her
completel� ��aive or to 1ower a registratian fee as establ�ished
' in the case of anyone wha cannot reasonably afford the set
fee due to financia? difficulty, and who has expressed an
interest or desire to 5e enrolled in a certain program.
This k�aiver will pertain to all City af Fridley recreation
programs except those programs wnere specific cantractual
services incur an indebtedness to the City.
. As you will note, I have taken the liberty to not restrict this to
, children, but�to anyone of any age, because it is my belief that
. recreation should service everyone and that is the current �irection
that our Department is now taking.
, In keeping ti•�ith th.is policy, if adopted, I have informed my staff
that on a11 future Parks and Recreation program flyers, there is to
appear a stateT>>ent to the effect "No individual shall be exc1uded due
to financial inability to participate. These individuals should
contact the Pa�°4:s and Recreation Department."
-Hopefully, this information will be helpful to the City Council and
yourself in reaching a decision concerning the waiver of fees for
recreation activities. Evidently, the Fridley Youth Sports Association
and the Hockey Association of Fridley do have such a policy and they
should be encouraged to continue and promote �his policy,

INFORMATION ON SENIOR CITIZENS UTiLITY RATES
JANUARY 11, 1977
Attached is the information I have received f rom th.e City of Columbia
Heights and from the League regarding reduced utility rates for senior
citizens. The League has listed those communities in tne State of
Minnesota that they are aevare of that have senior citizen rates. There
are relatively few cities in ihe State that have senior citizen rates.
Those that do, apparently, have the reduced rates tied to income level.
The City o� Colambia Heigh ts allows reduced utility rates for incomes
below $4,000 per year. The people have to apply for the reduced rates
and be recertified each year.
There would be some extra administrative �vork and expense in conjunction
with this process. We can proc�ram the computer to handle the reduced
water rates and there would be no problem in handling this part of it.
• The extra expense would be associated with the administrative p rocess.

In response to your inquiry regarding additional information
regarding the above program, I have talked to the Edina
Grime Prevention Officer that works closely with this fund •
as well as Chief Bext Merfeld. Their combined comments are
as follows .
1. The Edina Police Department feels that this is
a very worthwhile progra.m.
2. The program tends to solve more crimes then would
be otherwise solved and consequently reduces the
amount of investigative time by expediting leads
on cases.
3. The police department does not control the fund.
4. The Chief of Police is the liaison officer to the
Citizen Executive Board.
5. There are essentially two police personnel that
administer the program on a day to day basis
internally, that being the Chief of Police and
the Crime PrPVention Officer. By administering
we mean they have authority to expend moneys up
to $100 on a day to day basis when, in their
judgment, the moneys are justified.
6. For amounts larger than �100 or for purposes of
publicized rewards, the request must go before
the Citizens Executive Board.
?. The Police Department maintains a cash fund, the
amount of which is confidential, for use in
emergen.cy purposes.
8. Under this system, there are sufficient funds
�that major operations can be investigated prior
to arrest. For example, they are now investigating
a major fencing operation in which under cover
officers have no�v made three buys of which they
do not expect to see the return of these funds.

In other words, they have funds available to
continually buy into a system until they reach
the tap figure at which time they can make the
mass arrest. •
10. The only bad aspect noted from the two�individuals
that I talked to was the noted comment that it was
�felt that the Police Department was becoming a little
too involved in some administrative time consuming
tasks such as making up newsletters and other aspects
that go into the time consumption of publicizing
the program.

1.0 PURPOSE , .
The purpose of this memorandum is to clarify conditions.and terms wherein the
Civic Center,,Classraom., Council Chambers and Community Room may be used as a
meeting place. This memorandum is applicable to use of rooms by residents of
Fridley, Minnesota. �
2.0 PROCEDURE

2.7.1 Community Room - the large room on the south side of the ha11 leading
from the.East Entrance of the Civic Center. The use of the room includes
the tables and chairs within it. �
2.1.2 Kitchen - the facility adjoining the Community Room and containing
appliances for food storage and preparation.
2.1.3 Council Chamber - the large room on the north side of the hall leading
from the East Entrance of the Civic Center which is presently used by
the Anoka County Court and Fridley City Council.
2.1.4 Classroom - the room labeled as such on the lower levei of the Civic
Center and the tables and chairs within it.
2.1.5 Non-governmental - not elected, appointed or employed by a local,
county, state, or federal government. .
2.1.6 Non-profit organization - a religious, educational service, or ,
charitable organization; one which does not operate for profit.
2.1.7 Private firm or corporation - one belonging to or concern.ing a
particular person or group; not open to, intended for or controlled
by the public.
2.2 Responsibility
2.2.1 The City Manager is authorized to enter into agreement for use of the
Community Room and Classroom within the authorized uses outlined in this

2.3.1.1 The Council Chambers and overflow room to be referred to hereafter
as the Community Room and the Classroom,are primarily designed and

intended for official local Qovernment meetings. �herefore, priority
for use of the Community Room anc� Classroom w�ll be given to govern-
tnental use.
2.3.1.2 The rooms may not be used for purposes that would cause any inter- �
ference whatsoever with Court, Council, or other governmental meetings,
regular or emeroency, scheduled in the buildin� area. If interference
� could possibly occur, the government function has priority and other
� meetings would be immediately cancelled. The cancellation privilege
shall apply regardless of reservation by the non-governmental users.
2.3.1.3 Dances shall not be held in the Community Room or Ciassroom; nor any
games or activities where physical exercise is a part of the program.
2.3.1.4 An attendant (City Employee) will be present in the building during
the period occupied by all non-government users. The custodian may
serve as the attendant durinq his normal�work?ng hours.
2.3.1.5 Use of the Civic Center will bF normally restricted to the Community
Raom, Kitchen, .Classroom, and basement level toilet facil�ties.
Council Chambers will�not be used by non-governmental users, except
. when express perr�ission is granted and approved by the City Council.
2.3.1.6 The Corranunity Room or Council Chambers will not be available to
non-government organizations on nights when the City Council is in
formal session.
2.3.1.7 The Community Raom may be made available when Court is in session,
sa long as the activity scheduled does not distract from or interfere
with dignity or orderly procedure of the Court.
2.3.1.8 Activities scheduled for the Cormnunity Room, Classroom�, and the Council
Chambers shall be restricted to the hours of 7:�0 p.m, to 10:30 p.m.
Tuesday throuqh Friday. Activities scheduled for Saturday shall be

2.3.7.10 Reservations by non-aovernmental ac�encies shall be made for use af

basis only. This procedure allows opportunity for eq��al use of the
facility by all grouqs.
2.3.1.11 No alcoholic beverayes will be brought into, served, or consumed
on the premises.
2.3,1.12 Users shall sign and agree to absolve the City from all liability
claims in_event of an accident or injury while using-the Community
. Room, Classroom, or Council Chambers.
2.3.1.13 The user shall agree to provide all chairs or tables needed in
excess of 70 chairs and tvro tables.

2.3:1.14 The Community Room, Classroom, and Council Chambers may not be
used by private firms or corporations unless such rreetir.g is
scheduled for purpose of ineeting with local city officials, the
Chamber of Commerce, or the Jaycees. The City ma,y not provide
this type of facility in competition with private firms.
2.3.1.15 A standard agreement form will be signed by the user representatives
prior to use for other than local governmer,t functions.
2.3.2 Reservations:
2.3.2.1 Applications for use of the Community Room and Classroom shall be
submitted to the Office of the City Manaqer at least ten (10) days
prior to date reservation is desired. Advance notice is required to
insure scheduling. .
2.3.2.2 Applications for use of the Cauncil Chambers shall be submitted a
minimum of three (3) weeks in advance. This wili allow sufficieni
time for Council approval of usage so as not to interfere with
-public hearings, etc.

2.3.3 Priorities:
2.3.3.1 Local qovernment meetings shall have first priority for use of the
Community Room,.Gl.assr--o�m, or Council Chambers. This shall include
functions of the City of Fridley Park and Recreation Department
and the Citv Commissions. � d�� •

2.3.3.2 Non-profit organizations such as service orqanizations, church groups,
community clubs, political groups, and private club reservations �r�ill
be on a first come first served basis. Reservations by non-profit
organizations will not be scheduled more than sixty days in advance.
2.3.4 Care of the Facilit_y:
2.3.4.7 The user shall agree to pay for all damages to City property or
equipment over and ahove normal wear and tear.

THE APPLICANT (USER) AGREES T0: �
1. Absolve the City f rom a11 liability claims in event of an accident or injury
incurred by users while usinq the facility(s}.
2. Pay far all damages to City property or equipment over and above normal wear
and tear.
3. Assume full responsibility for the conduct of the �roup during the time the
faci7ity is being used.
4. Leave the room in "as received" condition and kitchen and equipment in cleaned
condition after use. � ��'°°
5. Pay an attendant charges in addition to the above f�e charc�es, after 1(T:30 p.m.
Tuesdays throuqh Fridays and a11 day Saturday, at rate of individual's salary,
considering time and one-half for overtime.
6. Abide by the terms of this agreement and conform with ��rritten no�;�y established
by the City Council qoverning use of the Community Room, Kitchen, Classroom,
and Counc:l Chambers. —"
8. Reserve the right of the City of Fridley to cancel this agreement in event of
emergency or conflicting use.
