THE MINUTES OF THE PUBLIC HEARIN6 MEETING OF THE FRIDLEY CITY COUNCIL OF AUGUST 8, 1977
The Public Hearin9 of the Fridiey City Council of August 8, 7977 was called to order
at 7:35 p.m. by Mayor Nee.

Mayor Nee led the Council and the audience in the Pledge of Allegiance to the flag.

tAl1TI0N by Cou�ciiman Hamernik to adopt the agenda as presented. Seconded by Council-
vmman�Kukowski. Upon a voice vote, all voting aye, Maynr Nee declared the motion
carried unanimously. �
PUBLIC HEARINGS:
I�TION by Councilman Schneider to waive the reading of the Public Hearing notice and
:open the Public Hearing. Seconded by Councilman Hamernik. Upon a voice vote, all
votSng aye, Mayor Nee declared the motion carried unanimously and the Public Hearing
opened at 7:37 P.M.
. Ms. Karla Larson was present representing Mr. D�Aigle.
Mr. Sobiech, Public Works �irector, explained this is the proposed plat generaily
located east of Central Avenue and West of Arthur Street> on the south side of 76th
Avenue. He said that the plat would consist of 13 single family lots.
Mr. Sobiech stated thrt the Planning Comnission recommended approval of the preliminary
plat at the July 13, 1977 Planning Commission meeting, with the stipulations that
a walkway easement be provided off of Arthur Street which would provide egress to
the Park property owned by the City of Fridley south of the Droposed lots.
Mr. Sobiech explained that at a previous City Council hearin9 the question had
wme up, Would development of this proposed plat lock in the park property to
����tfie South'and would the developer of the lots be�making use of the park property?"
���Mr. Sobiech continued to explain that a Proposed Parks and Open Space Plan was
�presently in the Parks and Recreation Commission and would be farwarded to the
City Counc9l for approval soon. Mr. Sobiech said that-the Proposed Parks and Open
Space Plan had considered doing away with that particular piece of property.
Mr. Sobiech indicated that after he had done some investigation as to the
possibitity of the development of that park property and the effect it.would have on
the peoP�e in the peighbortrood bad led him to cansider two alternatives:
Mr. Sobiech showed the two alternatives on the screen. The first'would allow the
devetopnent of the property to the South to be done by the developer (petitioner).
Ne said that the atternative might tend to be difficult in that it would be hard
for the City to make neyotiations with the petitioner at this time. Ne said that
it woutd result in the same number of lots with the addition of f9ve lots to the
south.
Mr. SoEiech indicated that the ather alternative> the most agreeabte one, would
a7ow the developmen of the proposed plat keeping in mind the possibility of develop-
� ment of the park pr�erty to the South. He explained that this alternative would
entait a similar design as the first alternative which woutd stitl result in 13 lots.

Mayor Nee indicated that if the tand remained as public land, then the lots would
remain 80 feet wide. Mr. Sobiech said that if the developer went with the present �
plans, then his lots wou�ld be in excess of the minimum standard.
Mayor Nee 9ndicated to the audience that as lang as they didn't expect the City
to put in tennis courts, D�aygraund equipment, etc. the idea of leaving the land
as public land could be considered. The neighbors all said that they wanted the
land to be left exactly as it was. They weren't askiny for City development of
the land.
Councilman Schneider indicated that if the lot was teft in its natural state,
than the five-foot walkway easement should �e sufficient. Mr. Sobiech said that
the City wanted something more substantial. He felt that a 30 foot easement
vputd be what the City would want to enable all City equipment easy access to
the park property. Mr. Sobiech pointed out that walkway easements would have
to be obtained separately.
Mr. Qureshi, City Manager, said that the 30 foot easement would be required so
-�.� �� that in the future if the 7and were developed, the City-would not infringe on
any private property if they had to put in sane type of sewer system or water system.
Councilman Schneider said that if the land was to be left in its present state,
rro development vrould be necessary or done.
Mr. Sobiech said that if at a later date> tbe City of Fridley decided to develop
the land, they would already have the land easements.
Councilwoman rukowski said that the Council was telling the neighbors that they
plan to teave the land as it presently was - in its natural state - but the
Councit is making plans for easements to enable the development of the land into
a park. She questioned this procedure.
� Councilman Fi�tzpatrick said that in that type of situation where the neighbors
wanted the land lef: in its natural state and the City allowed it; the City would
have to stitl provide for tbe day that neighbors would decide that since the land
was City land, then let the City maintain it. At that point in time, the City
would need to have access to the land and he could understand the need for the 30
foot easement.
Councilman Fitzpatrick said that he had a problem with the fact of the City owning
land of that amount that wouldn't be accessable to the publc.
� �Mayor Nee asked that even with the easements> would the lots be standard lots.
� . Mr. Sobiech said that every 1ot in the proposed subdivision woutd 6e at least
the standard size. He said that the City had to have the easements for some
. future time that the City would have to have access to the land. �
Councilman Schneider didn't think the City would have to run water and sewer
nains just to develop a smalt park. Mr. Sobiech said that any minimum size
park area had to have water and sewer accesses.
Mr. Qureshi said that the City didn't want to be put into the position of having
to buy property back from the people. He said that he merely wanted the land
to be made available to the City if it needed it. He said that the land could
always be vacated at a later date.
Councilman Schneider said that his concern for the 30 foot easement was that
-�� �� the City could just go into the area and start developing the land without the
� neighbors ever being notified. Mr. Qureshi said that there was a process that
���. Fiad to be followed before tbe City developed anything. He said�that the City
atways took into consideration what the neighborhood wanted.
�'� H�. Herrick said that he�thought that the pubtic access provision would have to
be met. He said that the tand would have to accessable to more people than just
r tMe ad,jacent neighbors.

�S4bdivision P.S. p77-O5, Meadowmoore 7errace 2nd Addition, by Gary �'Aigie
with the stipulation that there be a 30 foot easement between lots 3 and 4, 61ock 1,
for�drainage, utilities, walkways, and access for equipment to the-park property ��
and there be adjustments on the existing lots to be sure they meet minimum ptot
size and there be a five foot walkway easement off south side of lots 7 and 2,
block 1 and a 5 foot easement from the north line of lot 7, block 1 Don's 5th
Addition. Seconded by Councilwoman Kukowski. Upon a voice vote, all voting
aye, Mayor Nee declared the motion carried unanimously. The Final Plat Sub-
divisian P.S. �77_OS was approved at 8:20 P.M. .
MOTIQN by Councilman Schneider that it is the intent of the City Councii at this
.. . time, that there be no development on the out-lot without going tbrough proper
procedures which would include appearing before the City Council. Seconded by
.Councilman Hamernik. Upon a voice vote, al) voting aye, Mayor Nee�declared the

Chairperson Harris indicated that he was voting against the motion
because he .felt there would be a� incompatibility in the area.
He felt thaL a single-family dwelling would be better•
qs. 6abel indicated that she would be voting against the motion
for reasons of incompatibility. She said that there were all
single-family dwellings in the area and she feit it would be a
• ffipot rezoning.

Mr. 8oardman explained that originally a plat went through in 1 �
1964. At that time he explained it had not been recorded to the
County and has not been recorded in the County since.
He said that according to Code, they have to have a plat recorded
�n the County within 90 days otherwise they have to get
�eapproval from the City. He said that at this time they are •
�equesting reapproval on the plat. He indicated that
there had been some recommendations that should be placed on the
plet that were not on the plat previously, namely the
easements needed — a ten foot walkway easement along the south
side of lots 1 8 2, Block 1, for access to the City Park property;
also five foot drainage and utility easement along the street
. side of all the Iots.
Chairperson Harris wanted to know why the City needed additional
easements over and above the already requested 60 feet. �
Mr• Boardman indicated that he wasn't sure of the reasoning
but that it was standard procedure in the Engineering Department.
Ms- Gabel wanted to know if the easement could be used in the
frontage setback requirements.
nr• Boardman said that the property owner couldn't build on the
easement but that they could use the footage when determining
the setback.
ChaYrperson Harris asked Ms. Karla Larson if she had had an
opportunity to see the proposed plan•
�s. Larson discussed the proposed plat with the Planning Commission.
Mr• Limesand wanted to know what would be built on the lots
that were being discussed-
ns. Larson indicated that there would be 13 single-family homes.
She asked if the audience was concerned that the plans would be
for low housing development-
The audience indicated that that was their main concern.
ns• Larson indicated that the lowest price that would be �
paid for any of the homes would be $49,900 and the cost would
only go up from that point. 3he explained that there would be
seven styles that would all be different.
The audience was very much against any type of home that would
resemble the 235 Program homes that had been build in the area.
fl s- Thomas wanted to know if there would be any guarantee that
ail the homes wouldn•t be the same.

11s• Larson indicated that they couldn't really know before the
lots were sold but again emphasized that it was not low income
housing and that it would be unlikely that all the homes would
be exactly the same.
Ms. Peggy Strasser wanted to know if the seven homes would be
built and then used as display models.
ns. Larson said that there would be no model homes built. The
s8id that people would go ir�to the Realty office and decide
�at they wanted'and then the home would be built to their
specifications.
I��s. John Hennes said that when the 235 Program was brought into
the area they had been told that there would be a variety of
homes but because of the water table, they ended up all being
built as split entry homes• She wanted to know if the City
could check the water table to insure that that wouldn't happen
again•
flr• Bergman indicated that the Planning Commission was talking
about the approval of a preliminary plat a�d the approval of
that plat would not be any guarantee of the type of house that
would go on the lot nor would it involve any commitments as to
what would go on the lots. He said that the decision would
not tie the lots to anything other than a single-family dwelling
and the size of the lot.
Mr• Boardman said that the City didn't have much control over
whether a developer would or would not develop low income
housing• He indicated that the original 235 Program is no
longer available• He said that the only types of Programs
available would be the type of individual subsidy programs
or mortgage loan programs. He said that the City didn't always
have the control and that most of the time it u�ould be between
the developer and HUD•
11r• Peterson indicated that the City has developed through the
various hearing processes within the City a housing goal as far
as housing is concerned and part of that goal was to encourage
all types of housing within the City of Fridley.
Mrs. Ray Czypta indicated that the point they W�nted to make was
that the area already had low income housing and that they
didn't-want any more.
ihairperson Harris suggested that the neighbors concerned about

get more satisfaction letting the developer know what they
would and wouldn't like. He was sure the developer wanted to
be in harmony with the neighborhood.
Ms. Larson again pointed out that she was almost sure that the
developer didn`t want to construct housing for low income programs.
She invited the neighbors to stop by the office at any time and
they could discuss all the plans that the developer had.

and the rest of the plat was parceled off as 960. He said that
the plat was first presented in 1964 which was 11 years after
the lot split. He said that the original plat was i� error•
He gave the information to Ms. Larson and asked that she submit
it to Suburban Engineering and then get in contact with City Hall•
Chairperson Harris explained to the audience that there had been
a lot split on lots 7, 8 Block 2 which would be the west end
of the property. He indicated that the lot split took piace.in
1953 and if the people that split the lots had received a
mortgage, then a plat had to have been approved•
MOTION by Mr• Bergman, seconded by Mr• Langenfeld to close the
Public Nearing• Upon a voice vote, all voting aye, the motion
carried unanimously. The Public Hearing was closed at
1U:47 P.M.
f7s. Gabel indicated to the audience that they should definitely
get together with the cieveloper of the land and voice their
oppositions. 3he said that the Planning Commission reaily
couldn`t do a lot rega�ding the styles of the houses. She said
that they, as the general public, could make themselves heard
by going directly to the developer and letting him know what
they did and did not want.

of the Northeast Quarter of Section 12, T-30, R-24, Anoka
County, generally located East of Central Avenue N.E. and West
of Arthur Street N.E., on the South side of 76th Avenue NE
with the following adjustments and/or corrections:
3} That Lot 7 8 8, glock 2, be removed from the Plat.
2} That five foot easements as recommended by City
Engineering be included {76 Avenue, Garfield 3treet,
and Arthur Street}.
3} A five foot easement off Lot 1& 2 of Block 1 and a
five foot easeme�t off lot 1, Block 1, Don's 5th,
