I The public hearing covered street improvements on Chartne� Road, Lucia Lane, �ellwood
�rive, Pierce Street, 63rd Avenue, TH 65 E. Service Road; Talmadge Lane, Ironton
Street, Able Street, Hickory Street, 73i Avenue, Ashton Avenue, Osborne Way, A1den
; Way, and 75th Way.
� M�yor Nee stated the proposed assessment ro71 has been prepared under a formula
which has been in effect for about 25 years in the City.
� Mr. Sohiech, Public Works Director, stated, as noted, this is a public hearing to
. receive any comnents and input from residents affected by the street improvement
�; projetts. He stated, if residents have any comments about the actual improvement
Project,. they should contact the City's Engineering Division. He noted the City .
� stilt.has funds being retained which are to be used for sodding, drivewa
etc.

Mr. Sobiech stated the City has a one year performance bond and wi17 be reviewing
: alt projects next year to go over all the aspects to be sure the contractor did
fallow the specifications and proper construction. � �
,. ; Mr. Sobiech stated, generally, the costs for the projects have run about 15% below

: Mr.�Brunsell, City Clerk, stated the assessment wi77 be spread over a 70 year period
. with interest at the rate of 7�%, He noted the property owner can.pay the assessment
wi:thin 30 days without any interest. He further stated, if the assessment is not
i � paid within 30 days, property owners will still have until. November 15 to make
. PaYment, but interest wi11 be added for.the period from September 19 to November
15, 1977.

Mr. Ellis stated he is willing to pay for paving the street and concrete curb,
but Talmadge wi11 have to be torn up in order to have it�drain properly. �;
No other person in the audience canmented on the improvement projects for Channel �
Road, Lucia Lane, and Talmadge Lane. '
DELLWOOD ORIVE, PIERCE STREET, AND 63RD�AVENUE:
Mr. Sobiech stated this improvement consisted of concrete curb and gutter and
bituminous roadway, with extension of some storm sewer. 7he front foot assessment
was $76.44, with a side yard assessment of $2.33 per�foot.
Mr.�John Carland, 6416 �ellwood Drive N.E., questioned when they woul�d be
reimbursed for the damages which occurred due to flooding.
Mr. Sobiech stated the contractor was put on notice that before any final payment
would be made, the damages received by the residents must be taken care of. �
Mayor Nee explained the front foot assessment for property fronting on Highway 65 �
was $19.59 per foot:
Mr. Joe Randall, 7210 Idississippi Street N.E., and Mr. Leighton Clar, 172g 63rd Avenue
N.E., questioned their assessment, which was explained by Mr. Herrmann.
No other persons in the audience comnented on the improvements to Dellwood Drive,
Pierce Street, and 63rd pvenue.
IRONTON STREET: .
Mr. Sobiech, Public Works Director, explained the front foot assessment for
Ironton Street was $5.78. �

is not a thru-way, but for private use only. -
Ho persons in the audience comnented on this assessment for Irontpn Street.
ASHTON AVENUE: -
Mr. Sob9ech, Public 4lorks Director, st�ted this is an h1SAS street�designed to
Municipal State Aid Standards which consist of a 40 foot wide street. He noted
the assessment is $21,49 per front foot for industrial-comnercial properties
along�the east line of Ashton and the front foot assessment�for residential and
park properties is $12,72, and $1.24 per foot for side yard.
Mr. John Carland questioned why all the front foot assessments were not the same
for these projects. .
Nr. Sobiech stated some streets are wider and have additional base materials. He
indicated there was no restoration of driveways and no sodding required in this
particular area. Mr. Sobiech noted Mr. Carland's cost was slightly higher because
of the�extension of the storm drainage.
No other persons in the audience comnented regarding the improvement on Ashton
Avenue.
ABLE SiREET: .
Mr. Sobiech, Pubtic Works Director, stated the front foot assessment for Able
Street is $14.02 and that it is a commercial-industrial�type street. He stated
the majority of the existing base material was utilized and to bring it up to
industrial street standards, it�was necessary to install concrete curbing and
an additional overlay.
No persons in the audience commented on this improvement on Ab1e Street.
HICKORY STREET: �
Mr. Sobiech, Public Works Director, stated this street was made to 40 foot standards
Tne front foot assessment was $)9.7), He indicated, in this particular case,
Quite a bit of extra excavation work was involved.

Councilman Schneider stated he stood before a previous Council and said about
, the same things Ms. Eggert is saying now; however, it is his opinion, his home
is worth more now because of the development. He.pointed out thaY there are
� now well-kept, landscaped homes which would not have been possible without the
street.
; Councilman Schneider pointed out as a possible future.development, he wuld
. run his driveway out to the side street which he felt was a potential benefit.
! He pointed out if the street had not been re-atigned,�the assessment to her
� property would have been more and the intent of changing the street pattern was
, to reduce the assessment to the existing level.
' � Mr. Eggert agreed this�plan is less costly. He stated, granted he has access,
but access to only the cul-de-sac. He indicated, with this plan, he gets all
,, the traffic by his property�and felt this is definitely no benefit. He also
. stated now he has a house overlooking his back yard and cannot see that as
an asset.
Mr. Herrick felt that has nothing to do with the questiort of assessing the
lot. He indicated�another point the Council should bear in'mind, an additional
principle of assessment is (7) you have to shav a benefit; and (2) you have to
treat all properties equa7ly, He stated, if you get down to how this property
is assessed, he s not sure you wouldn't have a question from the developer that
he is not being treated equally because of no assessment on the front. �
Ms. Eggert stated she can see they are fighting a 7osing battle. She felt the
Council should sit down and consider sit�ations like this, as she didn't think
she is being unreasonable. She felt this was a unique situation and, if they
don't feel it is, give her a call and expTain it to her.
Councilman Schnei�der stated when Ms. Eggert says this is�"untque" because she
is the only one in the City in this situation, he felt�you could find 200 or
300 cases in the same situation.
� Councilman Hamernik stated he cannot agree this is a unique situation. He
� indicated the Council has had other almost identical cases.
Ms. Eg9ert questioned if that makes it right to follow this asse�sment policy.
Councilman Hamernik stated it is a valid attempt to make it as fair and as
equitable as possi6le.
Mayor Nee asked the City Attorney to advise Mr. and Ms..Eggert, in the event the
Council adopts the resolution as submitted for this assessment, what their
ri9hts would be. Pis. Eggert indicated he didn't have to since�they were apparently
aware of what procedures they could follow for appeal.
Mdyor Nee advised they could appeal this to the courts.
MOTION by Councilman Schneider to receive the letter from Mr. and Mrs. Eggert
dated September 73, 7977 r.egarding their protest of this assessment. Seconded
by Councilman Fitzpatrick. Upon a voice vote, all votin9 aye, Mayor Nee declared
the rtrotion carried unanimously.
OSBORNE�WAY:
Mr. Sobiech, Public Works Director, stated this street was built to Municipal
State Aid standards and design. The assessment for residentiai properties
restarationPenofdrivewaytimprovements�and no�soddinycular case, there was no �
Mr. Sobiech stated, in addition, an agreement was reached with the developer to
put in storm sewer to the development to�serve areas to the west. The storm
sewer is $3.61 per 700 square feet.

ALDEN WAY:
Mr. Sobiech, Public 4lorks Director, exptained this street was reconstructed to
Municipal State Aid Standards.

is that the residents on 75th Way are getting extra charge for the storm sewer
for which they have not already paid.
� Mr. Hogen stated he believes the reason the stonn sewer was voted down was
;� that Mr. Eltis was asked to contribute to this on their street and they did
� not wish to have it. He indicated the residents in their block wanted a street
; badly because�of the dust. Mr. Hugen stated the sYreet, as it looks now, is
� 400d.
i� - Mr. Bob Toner�, 7598 Alden Way N.E., questioned the assessing of the west side �
� of the street only.
' Mr. Qureshi stated there is no potential of additional storm sewer on Alden
., Way as.it is complete.
Mr. Franz Flath, 91 75th Way, questioned when Osborne will be open. Mr. Sobiech
stated they are working with the Anoka County Highway Department to improve
this signal and are waiting for finai parts. He stated it is anticipated to
be completed within the next few rtanths. Mr. Flath also�requested speed
signs be installed.
Mr. Thure Erickson, 7515 Alden Way, questioned why the St. Paul Water Works wasn't
assessed for more costs. �
Mr. Herrick s Wted he believed property��that is being�.used strictly for conduit
would be very difficult to assess as you don't have a vehicle for showing benefit.
Mr. Sobiech explained there was an exchange of parcels with the St. Paul Water
Works relinquishing two parcels to the City and the City relinqvishing one parcel.

St. 1977-1 and St. 1977-2 Street Improvement Projects. Seconded by Councilman
� Namernik. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried

PUBLIC HEARING ON ASSESSMENT FOR ST. 1977-3 STREET IMPROVEMENT PROJECi:
MOTION by Councilwoire n Kukowski to waive the reading of the Public Hearing notice
and open the Public Nearing. Seconded by Councilman Schneider. Upon a voice vote,
a11 voting aye, Mayor Nee declared the motion carried unanimously and the Public
Hearin9 opened at 10:05 p.m.
Mr. Sobiech, Public Works Director, explained this project involves the improvement
of the street surfacing, curb and gutter, storm sewer and signal installation on
East River Road from Interstate 694 to approximately 61st Way.
Mr. Sobiech stated the East River Road improvement consisted mainly of curb and �
gutter construction amounting to a front foot assessment of $8.63. He stated there
was a signal installed and this cost was picked up by the General Fund supplied by
the MSA developrent fund.
��, In coN unction with this improvenent, Mr. Sobiech stated there was a west frontage
; road improvement involving mostly the Georgetown Apartments and Lynwood Manor
, Nursing Home. This assessment amounted to $13.84 per front foot.
, �.. � Mr. Sobiech stated, along with the roadway improvements, there was a storm sewer
and the benefitting properties received an assessment of $1.99 per 100 square feet

Mr. Brunse}1,�City Clerk, explained all properties involved in this assessment have
signed an agreement agreeing to the principle of these Tateral charges.
Mr. Herrmann, Assessing Department, stated the property owner in Auditor's Sub. N77,
Lot 16, Parcel 2060 has made payment to the City in the amount of $1,545.
Mr. Brunse7l stated this parcel shouid still be included in the assessment roll;
however, the funds are here to cover this assessment and it will be handled
administratively.

MOiION by Counci7wwnan Kukowski to close the Public Hearing on assessment for water
and sewer mains, laterals, and service connections. Seconded by Councilman Hamernik.
Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously

PUBLIC HEARING ON 197g�gUDGEi INCLUDING AMOUNTS TO BE BUDGETED FOR REVENUE SHARING

MOTION by Councilwortian Kukowski to waive the reading of the Pub}9� Hearing.notice
and open the Public Hearing. Seconded by Councilman Schneider. Upon a voice vote,
all voting aye, Mayor Nee declared the motion carried unanimously and the Public
Hearing opened at 10:40 p,m.
MM. Qtireshi, City Manager, reviewed the appropriations for�General Government,
Public Safety, Pu61ic Works, Recreation, and Reserve�amounting to a total of
�$3,962,664. The appropriations�.for "Other Funds" was also reviewed, amounting to
a total of $369,713, with a final total of E4,332,377,
Mr. Qureshi explained this budget proposes a mi17 levy of 74,g which is close to the
levy for 1977. Ne stated, if the same mill tevy is maintained, because of changes �
in the assessed valuation formula, the property owners would see a reduction in
taxes�for all homes valued to $80,000, if this budget is adopted. He pointed out
that he is speaking for tocal City�government taxes; however, if all goyerrvnent
units maintain the same level, the property owners should receive a reduction in
taxes for the first time in the City's history.
Mayor Nee stated the Council has worked on the budget for four or five months on a
program 6asis, evaluating various components of the proposal�. He stated, under
� the Charter, the City 14anager has the responsibiiity of proposing a balanced
budget.
' Mr. Qureshi then reviewed the revenue sharing funds which the City hopes to receive
�� fn 197g�amounting to $78G,520. He outlined the vaious proposed uses of these funds.
Mr. Qureshi exptained the anti-recession funds, which are a suppiementary fund�,
, in the amount of $9,036 have been allocated to Parks and Recreation.
,� Mayor�Nee stated there are no new programs, no increase in pernianent sfaff with
the possible exception of two police officers. He stated the City has been
. contracting with other governmentai agencies for CETA personnel and the City now
! has about 30 peopTe working under this program in a variety of projects�. These
, people are financed by Federal grant funds.�
,,, � Mr. Qureshi stated the CETA people are being used in areas where tbe City pro6ably
wouldn't be able to venture,�.if they had to rely on their.local resources. Some �
�. areas where these persons are 6eing used�are ir, housing, senior citizen programs, and
teen programs.

GENERAL TELEVISION, INC: AD�ITION TO CHARACTER GENERATOR:
Mayor Nee stated Generat Television, I�c, has submitted a letter regarding the
character generator the City is now using. The request is for the City to add one
memory at a cost of $623.
Mr. Qureshi stated, in�discussions with Mr. Hengerford, he wanted a guarantee from
the City for use of the character generator for at least five years, with the
condition that if they need it� they would pay the City back at the rate of £125
Pei� year for each year it wasn t used.
Councilman Hamernik asked if this wvuld satisfy the desires of the Cable Television
Comnission. � .
Mr. Qureshi stated, basically, this is the same as what the City is now doing. He
� stated the Cable Television Comnission is aware of this request and he feTt there
. wasn't any problem, If there was, however, they wouldn't proceed.

Notice is hereby given that the Council of the City of Fridley will meet at tF.e
City Hall in said City on the 19th day of September , 1977, at
7:30 o'clock P.M., ta hear and pass upon all objections, if any, to the proposed
assessments in respect to the following improvements, to-wit:

open to public inspection by all persons interested, in the office of the Cler<

On the attached pages you will find the final assessment rolts for the ST. 1977-7
and ST. 1977-2 Street Improvement Projects. �
We usually prepare a separate project book for state aid streets such as are in
the ST. 1977-2 Street Improvement Project, and for the standa-rd streets such as
are in the ST. 1977-1 Street Improvement Project. Because of the location of some
of the streets involved in this project, some properties receive assessments for
both regular and state aid streets. For this reason we have listed the assessment
rolls for the two projects in one boaklet so that the total cost for an individual
property owner is easily accessible. Separate final cost were prepared for each
proJect.
A surtanary of the costs follows:
ST 1977-t--CHANNEL ROAD, LUCIA LANE AND TALMADGE LANE (Paaes 14-18i
The front foot assessment rate including curbing is $14.06 per foot.
The side-yard assessment rate is $2.64 per foot.
Three water and sewer services were put in under this portion of the street improve-
ment project. The costs of the services vary due to the type of construction necessary
to put in these services.
977-1--DELLWOOD DRIVE, PIERCE STREET, AND 63RD AVENUE (Additional costs for
r:sever:fac.ilities which were put in to ensure proper street drainage are in-

The front foot assessment rate including curbing is $16.44 per foot.
The side-yard assessment rate is $2.33 per foot.
One water and sewer service was put in under this portion of the street improvement
project. The cost of the service was $1,476.16.
ST. 1977-1--NIGHWAY N0. 65 EAST SERVICE ROAD (This street was constructed at a
reduced width due to the limited nature of the local traffic.} (Pages 19-22)
The front foot assessment rate was �19.59 per front foot. The higher rate is due
to the fact that this street is assessable on only one side.

project. The costs of the services vary due to the type of construction necessary
to put in these services.
ST. 1977-1--ABLE S7REET (This street had special reconstruction includin9 an over-
lav and concrete curb and gutter to accommodate heavy comanercial traffic.) (Pages 26&27
The front foot assessment rate is $14.02 per foot.
5T: 1977-1--HICKORY STREET (This street was built to industrial standards at the
request of the property owner. The cost reflects a contingency for future wearing
course at time development is completed in this area.} (Pa4es 28 and 29.�
The front foot assessment rate is $19.11 per foot.
5T. 1977-1--73� AVENUE (hlinor storm sewer appurtenances required in putting in the
new street were done under SW and SS No. 121 Project and these costs have been trans-
ferred to the street project. The cost also reflects a contingency for a future wear-

This portion of the street improvement project was assessed according to standard
City assessing procedures, with commercial property paying the full cost per foot,
and residential and park property assessed at normal residential rates with balance
being paid from State Aid funds. Some properties also have a double frontage and
receive a lesser rate on the back street.
The front foot assessment rate for industrial and commercial property is $21.49 per
f0ot:
The front foot assessment rate for residential and park property is $12.72 per foot.
The side-yard assessment rate for residential and park property is $1.24 per foot.
The assessment rate for tfie back street on properties with a double frontage is

provided in State Statutes Chapter 18.023 and Chapter 104 of the City Code.
There is a flat �25.00 administrative charge added to each Parcel of land.
This assessment will run for five years with seven and one-half (72)
percent interest per annum.
The roll inc7udes work done in the latter part of 1976 and the work done
in 1977.

The 7ateral charges made under this assessment roll are made under
the authority provided in Ordinance No. 113 and under Resolution
No. 86-1962. Each of the properties have connected onto City
water or sewer without having paid a lateral charge.
All properties involved have signed an agreement agreeing to the
principle of these lateral charges.
This assessment is figured in two ways, either using today's aver-
age lateral charge, or using charges that were levied in the
general area at the time the lines in question were installed, plus
accrued interest to the present time. The assessment rate used on
the affected property is the lower of the above two formulas.

fighting and access purposes.
STATED HARDSHIP:
Variance request to 0 feet back of building abutting
Burlington Northern R.R. to accommodate covering over
existing loading dock to provide enclosed facility for
material handling, incor�ing and outgoing, and provide
protected area for skids etc. and vehicles to conform
to Fridley Planning Commission desires,
Refusal of variance would create a hardshin in that it
�ould curtail our utilization p:lans for total space
needed for appearance and storage.
Variance to front yard setback from 35 feet to lt� feet
to alloc� construction of a 6' X 14� enclosed entry.
C. ADhiINISTRATIVr, STAFF REVIE�N:
The rear yard zero lot line request involves mainly
Burlington Nortnern Railroad tracks. The petitioner
wants to enclose the rear loading dock area, add an
area to the north for loading dock purposes, and
install a vestibule entry on the front. The existing
building is 2g feet from the curbing on Ashton Avenue.
Please note that Staff requires a more complete landscape
pl,an before any permits could be issued for this project.

Mr. A1 Toe�ws representing Industrial Spray Painting
Company explained to the Commission and the Audience that
the Company was in the pr,ocess of buying the building and
itt so doing, planned to completely finish the construction.
He said that they planned to clean the rear area by
building over the dock comnletely, enclosing s�rhat presently
existed in the dock area. He said that they rranted to add
on to the supplies room and to hard surface the outside area
and completely fence the buiiding property. He said that
all the necessary landscaping v+ould also be,done at that tine.
Vice-Chair;�roman Gabel asked if prior to this time, had
Industrial Spray Painting Company just leased the building.
Mr. A1 Toe�vs said that they previously lea5ed the building
and vrere noer in the process of buying the building. He
pointed out that closing �•rou3d be August 3>> >977.
Vice-Chairti��oma¢Gabel asked if there had been problems
with the previous orJners.
Mr. A1 Toeirs commented that the previous o�aner had never
finished the existing building. He said that the previous
owner had money problems and never completely finished the
building.
Mr. A1 Toer�s said that the main thino ti��as that the Compzny
had to do something because children haci been getting into
the building and disruuting things. Ae said that the Company
had to do something to urotect the area and he felt +.hat the
best tivay wcsuld be to cover the entire area of building and
loading dock and fencing in the property.
Vice-Chairrroman Gabel asked where the fencing tivould be
located and hir. Toe�vs indicated on the plan the exact
.location of the fencing.
Mr. Ralph Officer of 315 Hugo Street N.E., Fridley,
asked if all the nlanned projects required a variance.
Mr. Holden indicated on the plan the areas that would
require a variance.
Mr. Officer questioned the statement made on the
variance request that �vas on the Public Hearing Notice
that stated, "the setback from the required 35 feet to 14
feet so that a six foot addition could be added". Iie said
that 1y. plus 6 did not equal 35 feet. He ti�fanted to know
if the City had established a different setback here by
putting a street in.

Mr. Holden exnlained that by putting in the street,
imraediately the building i�rould be non-co�forming.
Mr, Arnie Toeais of 12�9 NL 96 Lane (also representing
Industrial Spra.y Painting Company) questioned the putting
in pf Ashton Street. He rranted to lsnow irhy the street
couZdn�t be moved over more so that the Company would be
a conforming building.
Mr. Holden (guessed) that at the time the street rras
planned, there rras probably enough space in the front of
the building to conform to the existing setback requirements.
Mr. Arnie Toevrs asked if the setback reouirement
of 100 feet applied to both sides of the street.
Mr. Holden expl2ned that the setback required of the
M-1 zoned building :�ras different than the setback requirements
of an R-1 zoning (�vhich is :,hat exists across the street
from the Industrial Spray Painting Company), He t�ent on to
say that technically the setback iaas iQ0 feet because the
Company ti�as adjacent to R-t housing.
Mrs. M. 5porre asked ivhat the building v�ould look like
after it tivas completed.

Mrs, hiargaret Sporre of 180 Hugo Street Ni indicated
that her mai,n concern was the presence of fire hazards.

enclosed reould that improve their ability to control the
number of fires that the Company had e�perienced in the past.

greatly help the problem.
Mrs. Sporre asked Mr. Toerrs about the fires inside the
building. 6Uhat e�ould be done to control those fires.

on that problem and he said that it tivas under control. He
said that they had installed fire prevention equipment,

building.
Mr. Holden said that it had been inspected many timos
hy.the Fridley Fire Denartment. He pointed out that the
building rras very tiaell constructed. He said that if the
building »as not the type of construction it i�ras, it
mould have been leveled many times from fires.
Mr. Plemel asked if there t�as discrepancies•found by
the Fire Department, did the Company have to co�nly.
Mr. A1 Toerrs said that anything the Fire Denartaent
indicated, the Company alrrays cor�plied. He pointed out
that many areas of the building are presently totally
porrdered sprinl>led. He said that that t�as a �aost advanced
means of fire pre�ention.
Vice-Chairrroman Gabel asked t�fr. Toerrs if this �ras a
recent improvement.
Pir. A1 Toerrs said that it had been done in the last
six months.
Pir. Holden said that because of the number of fires,
he figured the Insurance Company t��ould make sure they would
have all the most up-to-date preventions.
Pir. A1 Toel,s pointed out that since �958 the Company
had one laroe fire and one spray booth : fire. He didn�t
feel that that �ras such a large amount of fires.
Vice-Chaircroman Gabel asked if the fires had decreased
since they had iraproved the building.
Mr. A1 Toe�as indicated that since they had had only
ttivo fires since 1958, it rras rather hard to decide if the
fire hazard had decreased.

Mr. 5porre indicated that a petition had been circula:ed
through the neighborhood that �ras against the granting of
the variance. He said that the majority of the neighborkiood
had signed the petition against the variance, He suggested
that the item be tabled until the next meeting so that the
petition could be brouoht back to the peoole that had signed
it to get input to them to better explain exactly crhat tvas
being planned. He requested that the Toelvs' get some type
of sketch to somerrhat shorr vrhat the building tivould look li'r.e,
He explained that he preferred not to present the petition
to the Comnission until the neighbors rrere better.informed
as to �rhat �ras being nroposed. He said that by having some
additional information neither Industrial Spray Painting
Companynur the neighborhood urould have hard feelings,
Mr. A1 Toe�rs pointed out that some of the items they
were doing had been specified by the City of Fridley as
having to be done. He didn't feel that any netition could
stop some of the improvements that they were plannino.

approached by a person that had come to her home to have
her sign a petition that the person knew nothing about.
Mrs. Officer said that the pesson couldn't anserer any of
the questions that she had asked her.
Vice-Chairrroman Gabel said that perhans there had been
some misconception and that maybe if the neighborhood could
see that the plan s�ould be a vast improvement, they mi�ht
not be so reluctant about it.
Mr. Barna pointed out that the Abpeals Coamission eJas
not the final body on the matter. He said that if the
Commission approved or disapproved, it vaould still go to
the Planning Commission and then to the City Council.
Mr. Sporre said that some of the apnrehension had been
the fear of the expansion of the factory. He explained that
over the course of the years the neighbarhood had some
unfortunate and alarming incidents ��rith people leaving the
factory in the vray they had conducted themselves; drivin�
through the resideiial streets and he said that this vaas
maybe �•rhy the neighborhood had reacted in su�h a harsh
manner. He said that the neighborhood �vould want to see
exactly what mas being planned.

Uice-Chair�+oman Gabal indicated that hFr. Sporre had
asked about tablin� the item and going back to the neighbors
and better explaining to them what exactly cahat rras being
planned; ho���ever, she said it would be entirely up to the
petitioner since he had been the one to make the variance
request.
Mr. Arnie Toews indicated that they didn�t want any
more delay in getting started on the project. He
requested that the Commission proceed on the request.
Mr. Kemper suggested polling the people that tivere
present as to their feeling after hearing exactly trhat the
plan encompassed.
Ms. L. Sporre said that she erould v�ant to bring the
petition back to the people that nad signed it and better
explain to them exactly vnat was being planned. She didn�t
feel that the names on the petition should be totally
disregarded, She felt that the matter should be tabled

the neighborhood vrould give the Toews' their supnort on
the pronosal, She, herself, s✓ould support the proposal
with certain aualifications nlaced on it such as the
screening, landscaping, traffic control, parking, curbs,
and the kind of ventilation system that vrould be required,
She indicated that there �ras a problem that existed �riih
the present ventilation system. She said that ti�rhen a person
walked docm Ironton Street to visit the Nature Center
there was an offensive odor in the air. She would like to
see that the ventilation system be brought up to standard,
'She indicated that there cras concern about the indust:ial
encroachment on the surrounding residential property.
Ms. Sporre said that the simple fact was that the codes
appreciate the value that industry provides and customarily
it �vas an industrial requirement to set back from the
residential. She said that very close attention had to be
given to the type of quality construction that would be done
on the addition. She indicated that she would be willing
to present the information to the people that had originally
signed the petition. She said she evould present this
information in a very positive manner. She said that she
would prefer that the matter be tabled until the next meeting.
Mr, Plemel asked ��rhat Ms. Sporre meant as to the
encroachment on the surrounding residential property.
Ms. Sporre said she felt it was more desirable to have the 100
foat setback rather than the 25 foot setback that was being proposed.
� She said that that setback ivould affect properLy
value. She indicated if rrhat rras planned i•;ould be
aesthetically pleasing, then perhaps it rrould not be so
di�agreeable to the residential property o�rners.

Mr. Ralph Officer said that he vaas also a businessman
in the City of Fridley as e�ell as livino 1� blocks from
the Company, He said that he had confidence that the
Fridley building insbectors, Fridley Fire �epartment,
the Fridley Public CJorks Dir�ctor, and the Fridley Parks
and Recreation people all �:��ere familiar rJith the situation
at hand as far as �rhere the street .ras located and rrith tne .
fact that the building rras present before the resiriential
people ivere. He said that the only thing located in the area
before the Company lras the railroad,
Mr. Officer commented about Ms. Sporre's comc�ent re�arding

stopped from rralking into the Nature Park by the nroperty

that those people had signed a petition that they knetir
nothing about. Ee said that he tiras sure that the City of
Fridley n�ould insure that it was a proper building, tnat
it tivould be ��rell-built, ��ell maintained, and up to all the
codes. He didn�t feel that the citizens really clould have
much influence as to tne design of the building. He said
that it 1�ould be done to improve the appearance of the
building, at the request of the City. He indicated that
���hat ���as being proposed �ras a variance that rrould enclose
the front doors. He said that the addition trould do ti�ro
things; first it ti�rould direct thepedestrian .:: traffic into
the building from improved parking lots; and secondly, it
vould be an energy saving idea,
Vice-Chairero�an Gabel suggested that the Toeivs' sit

planning to do. She said that the item vrould go to the
Planning Conmission on September 14, 1977. She said that
normallq the Planning Commission would only receive the
minutes; hoc�ever, the item could be opened to discussion
should anyone feel it ��rould be necessary to express some

on to say that it v�ould also go before the City Council,

Mr. Arnie Toetivs indicated that since Industrial Spray
Painting Company had been deeded Ironton Street they will
consider fencing in their entire property unless the continual
lighting of fires on their property ceases. He said if they
would be forced to do that, then the entire area vJOUld be
off-limits to aZl foot traffic.
t•4r. A1 Toei•rs said that as far as offensive orders; he
indicated that the buildino r�as constructed according
to coaes. He said that it �7as built according to all
pollution standards, he said they 1��ere rrithin a11 fire codes,
insurance codes and he felt that rras the best they could do.

out that most of the inprovements lvere recomnended by the

Ms, Lee Gasner of 361 Ironton Street NE exbressed
concern o� the setback. She said that it vrould af:ect the
value of the pro�erty if the lot is too close to an
industrial building. She incicated that even if the person
purchasing the hone didn�t mind, many times the loan companies
��ould make that a consideration,
Vice-Chairrronan Gabel said that if the Company put
on the mansard roof and acds an entry ti�aay to the front of
the building and.oenerally cleaned up the aApearance of
the building, it should be aestheticalZy more pleasing as
v�ell as non-detracting fron P'Is. Gasper's property.
t�ir. Holden oointed out that there r�as 86�000 �ouare feet
and the Company could esuand to the Vorth and South tivithout
any variances.
Ms. L. Sporre questioned if a request for a building
permit came in� rrould the City place the requirements for
proper screening and landscaping on it.

Mr. Barna commented that he lived 2-� blocks from the
building in question. He didn�t feel that any of the,
imnrovements pointed out on the dra��ting ��rould detract
from the building. He felt that all the items rrould
improve the building and he ti�rould have no objections to
the variances.

As of August 17, 1977, during ti�rhich an Anoka County transportafion meeting
was held, the City of Fridley decided to initiate a baratran�i+ �yst�i This
letter of intent is provided pursuant to your r2quest for a preliminary appli-
cation. It stands as an example of the City's sincere interest in deveToping
a paratransit program. The follrn�ing is an outline describing Fridley's propos�d
intentions for a paratransit system:
1) ,To serve disadvantaged r�arket groups in the
comnunity.
2) Provide flexible, non-fixed route transit ;Jhicn
would operate in harmony with existing MTC transit
service.
3) Avert ridership from the single occupant automobile.
Prese�itly, tne City of Fridley's proposal for paratransit is in a conceptual
stage. Ho;•�ever, the City has dafined so:ne nasic elements for a successful para-
transit program in Fridley:
1) Acquisiton of small van-type vehictes for easy
maneuverability in residential neighoorhoods.
2) A dial-a-ride system which schedules and dispatches
paratransit vehicles to and from distrinations.
3) Priority placed on service for targeted disadvantaged
groups, (handicapped, elderly)
4) A reservation system which receives calls at a central
location and assures paratransit occupants a seat.
5) Paratransit avaiTable on weekends for group use (on a
reservation basis).
6) The possible hook-up with the demonstrative project
connecting Unity and Mercy Hospitals and the areas
regional shopping centers.
7) A combined effort for a paratransit system with the
City of Columbia Heights. Advocating cooperation and
increased ridership in southern Anoka County.
The City of fridley is seriously committed toward initiating a para-
transit system and is confident a paratransit program would operate on
art efficient and economically sound level. It is requested that additiortal
information concerning funding and shared costs for paratransit be provided
to the City of Fridley. If there are any questions concerning this letter,

BE IT RESOLVED by the City Council of the City of Fridley, Minnesota, as follows:
1. The City Clerk has with the assistance of the engineers heretofore selected
by this Council for such purpose, calculated the proper amounts to be
specially assessed for the
1977 WATER AND SEWER MAINS, LATERALS, AND SERVICE CONNECTIONS
in said City against every assessable lot, piece, or parcel of land in
accordance with the provisions of law, and has prepared and filed with the
City Clerk tabulated statements in duplicate showing the proper description
of each and every lot, piece, or parcel of land to be specially assessed
and the amount calculated against the same.

Thank you for your August 31st letter relative to personhel
assistance for the islands of Peace. I agree that you have
a tremendously unique project that all of us should whole-
hearted2y support. I have been at the Islands of Peace on
several occasians and have had the opportunity of assisting
1�lx'. Wilmes on several occasions.
I have discussed the contents of your letter with our County
Park Superintendent, Dave Torkildson, who shares my views.
Since the City of Fridley is quite closely involved with the
Islands of Peace project, t4r. Torkildson wanted to discuss
the matter with them to avoid any probZems in the County
qettirtg directly involved and providing personnel. Our
palicy in the past has been to furnish CETA employees through
the loaal governing unit but Z am hopeful there will be no
objections to this type of County involvement.
I will pursue the matter fnrther, and by copy of this letter
to both Dir. Torkildson and the CETA Office am asking that
they work with you on this.
