The Reg�lar Meeting of the Fridley City Council of October 3, 1977 was called to order
at 7:30 p.m. by Mayor Nee. �

VRESEMATION OF AWAR�:
Mayor Nee stated a Certificate of Appreciation was to have been presented to Mr. Charles
Gooder for his service on the Community 6eveloqnent Comnission; however, he was unable
to attend the�meeting this evening and thi�s Certificate will be forwarded to him.
Mayor Nee expressed�his appreciation and the Council's gratitude for Mr. Gooder's work
on the Comnission. Mayor Nee also extended coryratulations on Mr. Gooder's appointment
to the School Board.

MOTION by Councilman Hamernik to approve the minutes as presented. Seconded by
Councilwanan Kukowski. Upon a voice vote, all voting aye, Mayor Nee declared the motion
carried unanimously. .
A�OPTION OF AGENDA:
Mayor Nee requested that the following ?tems be added to the agenda: (1) Consideration
of a Tempprary Bingo License for the Amer�ican Legion; and (2) Consideration of an Ordinance
on an Exception to the Fire Limits as Requested by Georgetown Motels. ...

Fitzpatrick. Upon.a�voice vote, all voting aye, Mayor Nee dectared the rtation carried
unanimously.
OPEN FORUM, VISITORS:
Mr. Beckler of Mobile Homes Minnesota, thanked the Council for the temporary permit
for Yhe mobile home at 57tb and Cheri Lane. He stated this mobile home was entered
into tAe competition.conducted by the Metropolitan Counci7 a� was setected as a
winner in this category.
Mr. Beckler stated he has p7ans ta come before the Council to construct a single
family hane on this lot.
Councilman Schneider questioned his plans for the Aome and whether it was the same
design as the existing mobile home. Mr. Beckler stated tentative plans are for a three
bedroom ramb}er tbat wi11 meet all Unifarm.Building Codes, but wi71 have a similar
design as the mabile home.
'�., Mdyor Nee questioned if the City has had any further problems or comnents from the
residents of the area. Mr. Sobiech stated Councilman Schneider has contacted the �
+ residents and felt more favorabte, rather than negative�comnertts, were received.�

Comniss5on and grant Special Use Permit, SP 77-72 with the stipulation that all codes
and ordinance requirements for this type of operation be met. Seconded by Councilman

RECEIVING ANNUAL REPORT FROM SPRINGBROOK NATURE CENTER FOUNDATION:
Mr. Yern Moen, Chairman of the Springbrook Nature Center Foundation, appeared before
correction7inetha thirdhparagraph ofPtheir letteredatedeSeptember�281 1977aby changing
the amount of $40,478 to $39,92g,
MOTION by Councilman Schneider to receive the annual report from the Springbrook Nature
Center Foundation. Seconded by Councilwoman Kukowski. Upon a voice vote, all voting
aye, Mayor Nee declared the rtption carried unaninously.
_CONSIDERATION OF COMMUNICATION FROM GEORGE M. HANSEN COMPANY--1977 AUOIT:
Mr. Brunsell, City Clerk, felt the estirteted cost for this audit would be about E7,000.
He indicated 6eorge M. Hansen Company was familiar with municipal accounting and he
felt they were wetl qualified.
MOTION by Councitwoma.n Kukowski to approve the firm of George M. Hansen�Gompany as
auditars for the 7977 audit. Seconded by Councilman Hamernik.� Upan a voice vote,
all voting aye, Mayor Nee declared the motion carried unanimously.
MOTION by Councilman Schneider to adopt Resolution No. 108-1977, Seconded by Councilman
Hamernik. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried
unani�usly.

waman Kukowski. Upon a voice vote, all voting aye, Mayor Nee declared the motion

HOTION by Councilwoman Kukowski to adopt Resolution No. 770-1977, Seconded by Councilman
Schneider. Upan a voice vote, all voting aye, Mayor Nee declared the motion carried
unanimausty.
NOTION by Councilman Fitzpatrick to adopt Resolution No, I11_�977. Seconded by
Councilwoman Kukowski. Upon a voice vote, all voting aye, Mayor Nee declared the motion
carried unanimously.
MOTION by Counci7man Fitzpatrick to adopt Resolution No. 112_1g7), Seconded by

Mr. Herrick, City Attorney, suggested, if it was necessary for tAe American Legion
to come back after a month, th.e owner of the.building shoutd also 6e requested to
attend the meeting so the Council could speak directly to him regarding.the improvements.
P�1710N by Councilman ScAneider to grant the American Legion a temporary one rtanth
license for bingo while processing of ihe existirg applicatian continues. Seconded
� by Councilwoman Kukowski.
Councitman Hamernik asked Mr. Kinkel if he was aware the Council was considering a
change in the bingo ordinance. Mr. Kinkel stated he was aware of the proposed change
and that his Bingo Chairman has a copy of the proposed changes.
Mr. Qureshi, City Manager, stated in processirg of the license, if there are no problems
and improvements are made as required, it wi11 not be necessary�for applicant repre-
sentatives to come back to Council. He indicated to Mr. Kinkel that the staff would
let him know i�f the item Would again come before Council after the one month period.
UPON A VOICE VOTE TAKEN ON THE ABOVE MOTION, all voted aye, and Mayor Nee declared the
motion carried unanimously,
Mr. Aldrich, Fire Chtef, explained the City has a fire limits ordinance to control the
types of construction in certain districts. He stated, in the commercial zones, it
was felt the City should limit the construction types in those areas to non-combustible
materials. He explained in industrial zoning, these areas are not included in the fire
limits because of the spacial separation around the building and a better grade of
construction materials is used for industrial-type buildings.
Mr. Atdrich stated the Georgetown people checked with staff to see if there was a fire
limits ordinance when they�submitted tAeir application. He explained, as an industrial
property, this wasn't included in the fire iimits; however, with the rezoning, it is in
the fire limits.
Mr. Aldrich stated the owner contacted the City regarding this �tter and was quite
concerned. He�stated, after a meeting with several manbers of the City staff, he
felt it.wou]d be in the best interests of the City and the property owner to delete
this land fran the fire limits and the owner would agree to have an autorciatic sprinkling
system installed. He stated this arrargement would still leave�the rest of the fire
ordinance intact, but any construction that goes in that part of the land will be
required to provide an automatic sprinkling systen,
Mayor Nee asked, from the standpoint of the occupants, if it would be safer to have
the automatic sprinkler system or non-combustible construction.
Mr. Aldrich.felt it would be safer with the automatic sprinklers as he stated, in 65
years of recnrd keeping, a loss of life has never been recorded�in a building that was
sprinkled, other than possibly the life of the pe�son who started the fire.
Councilman Schneider asked if, generally, in modern construction non-combustible
materials are used. Chief Aldrich stated generalty they are, but from a structural
standpoint, he would be more comfortable dealing with a fire in this situation where
the building is sprinkled.

upon first reading on the recomnendation from the Fire Department that the sprinkler
' i ( system is perhaps more safe for occupants than the non-rnmbustible construction.

The Public Hearing Meeting af the Fridley City Council of September 19, 1977 was
called to order at 7:42 p.m, by Mayor Nee. .� ',

PUBLIC NEARINGS:
PUBLIC HEARING ON ASSESSMENT F�R ST. 1977-1 AND ST 1977-2 STREET IMPROVEMENT � � �

MOTION by Councilwoman Kukowski to� waive the reading of the Public Hearing notice and
open the Public Hearing. Seconded by Councilman Schneider. Upon a voice vote, all
voting aye, Mayor Nee declared the motion carried unanirrously and the Public Hearing
opened�at 7:45 p.m. .
The public hearing covered street improvements on Channel Road, Lucia Lane, Dellwood
Drive,� Pierce Street, 63rd Avenue, TH 65 E. Service Road; Talmadge Lane, Ironton
Street, Able Street, Hickory Street, 73� Avenue, Ashton Avenue, Osborne Way, Alden
Way, and 75th Way.
Mayor Nee stated the proposed assessment roll has 6een prepared under a formula
which bas been in effect for about-25 years in the City.� i
Mr. Sobiech, Public Works Director, stated, as noted, this is a public hearing to '�� �
receive any comnents and input from residents affected by the street improvement '
projects. He�stated, if residents have any comnents about the actual improvement �
project> they should wntact the City's Engineering Division. �He noted the City . '.
still has funds being retained which are to be used for sodding, driveway probiems,
etc.
Mr. Sobiech�stated the City has a one year perforniance bond and will�be reviewing
alt projects next year to go over all the aspects to be sure the contractor did
follav the specifications and proper construction.
Mr. Sobiech stated, generally, the costs for the projects have run about 15% below
the final estimates. He noted the basic assessment cost is approximately $14.06 per
foot ca�ared with $14.08 in 1976; E14.49 in 1975; and $74.80 in 1974.
Mr. Brunsell, City Clerk, stated tbe assessment will be spread aver a 10 year period
with interest at�the rate of 7�%. He noted the property owner can pay the assessment
-within 30 days without any interest. He further stated, if the assessment is not
paid within 30 days, property owners wilt still have until November 15 to make
payment, but interest will be added for the period from SeptEmber 19 ta November
15, 1977.

Mr. E11is stated he is willing to pay for paving the street and concrete curb,
but 7almadge wi17 have to be torn up in order to have it drain properly.
No other person in the audience canmented on the improvement projects for Channel
Road, Lucia Lane, and Talmadge Lane.
DELLM000 URIVE PIERCE STREET, AND 63RD AVENUE:
Mr. Sobiech stated this improvement consisted of concrete curb and gutter and
bituninous roadway, with extension of�some storm sewer. The��front foot assessment
was E16.44, with a side yard assessment of §2.33 per foot.
Mr. .lohn Carland, 6476 Dellwood �rive N.E., questioned when they would be
reimbursed for the damages which occurred due to floodinq.� .
Mr. Sobiech stated the contractor was put on notice that before any final payment
wou7d be made, the damages received by the residents must be taken care of.
Mayor Nee explained the front foot assessment for property fronting on Highway 65
was E19.59 per faot.
Mr. Joe RandaTt, 1210 Mississippi Street N.E., and Mr. Leighton Clar, 112g 63rd qvenue
N.E.�, questioned the9r assessment, which was explained by Mr. Herrmann.
No other persons�in the audience commented on the improvements to Deltwood Drive,
Pierce Street, and 63rd Avenue.
IRONTON STREET:
Mr. So6iech, Public Works Director, explained the front f6ot assessment for
Ironton Street was $5.78.
Cauncilman Schneider questioned why it was blocked off. Mr. Sobiech explained it
is not a thru-way, but for private use only.

ASHTON AVENUE:
- Mr. Sobiech, Public Works Director, stated this is an MSAS street designed to
Municipal State Aid Standards which consist of a 40 foot wide street. He noted
the assessment is 321.49 per front foot for industrial-commercial properties
along�.the east line of Ashton and the front foot assessment for residential and
park properties is $12,72, and $1.2q per foot for side yard.
Mr. John Carland questioned wny all the front foot assessments were not the same
for these projects.
Mr. Sobiech stated some streets are wider arM have additional base materials. He
indicated there was no restoration of driveways and no sodding required in this
particular area, Mr. Sobiech noted Mr. Carland's cost was slightly higher because
of the.extension of the storm drainage.

Mr. Sobiech, Public Works Director, stated the front foot assessment for Able
Street is E14.02 and that it ts a comnercial-industrial type street. He stated

industrial street standards, it was necessary to install concrete curbing and
an additional overlay.

Councilman Schneider stated he stood before a previous Council and said about
the same things Ms. Eggert is sayin9 now; however, it is his opinion, his home
is. worth more now because of the development. He pointed out that there are
now well-kept, landscaped homes which woutd not have been possible without the
street,

He pointed out if the street had not�been re-aligned, the assessment to her
Property would have been rtpre and the intent of changing the street pattern was
to reduce the assessment to the existing level.
Mr. Eggert agreed this plan is less costly. He stated, granted he has access,
but access to oniy the cul-de-sac. He indicated, with this plan, he 9ets alt
the traffic by his property and felt this is definitely no benefit. He also
stated now he has a house overlooking his back yard and cannot see that as
an assef.
Mr. Herrick felt that has nothing to do with the question of assessing the
lot. He indicated another point the Council should bear in�mind, an additional
. Pri�ciple of assessment is (1) you have to show a benefit; and (2j you have to
treat all properties equally, He stated,�if you get down to�how this property
is assessed, he's not sure you wouldn't have a question from the developer tbat �
he ts not being treated equally because of no assessment on.the front. �
Ns. Eggert stated she can see they are fighting a losing 6attte. She felt the
�Council should sit down and cansider situations like this, as she didn't think�
she is being unreasonable. She felt this was a unique situation and, if they
don't feel it is, give her a calt and explain it to her.
Councilman Schneider stated when Ms. Eggert says this is "unique" because she �
is�the only one in the City in this situation, he felt you could find 200 or
300 cases in the same situation.
�� Councilman Namernik stated he canrrot agree this is a unique situation. He
�ind9cated tbe Councii has had other almost identicat cases.
Ms. Eggert questioned if that makes it right to follow this assessment poticy.
Councilman Hamernik stated it is a valid attempt to make it as fair and as
equitable as possible:� �
Mayor Nee asked the City Attorney to advise Mr. and Ms. Eggert, in the event the
Council adopts the resolution as su6mitted for this assessment, wbat their
rights would be. P1s. Eggert indicated he didn't have ta since they were apparently �
aware of what procedures they could follow for appeal.
� Mayor Nee advised they could appeal this to the courts.
MOTION by Councilman Schneider to receive the tetter from Mr. and Mrs. Eggert
dated�September 13, 1977 regarding their protest of this assessment. Seconded
by Councilman Fitzpatrick. Upon a voice vote, all voting aye, Mayor Nee declared

OSBORNE�WAY: �
Mr. Sobiech, public Works Director, stated this street was built to Municipal
State Aid standards and design. 7he assessment for residential properties
was $12.72 per front foot. He stated, in this particular case, there was no

Mr. Hogen stated he believes the reason the starm sewer was voted down was
that Mr. Ellis was asked ta tontribute to this on their street and they did

6adty 6ecause of the dust. �Mr. Hogen stated the street, as it looks now, is �
good.
Nr. Bob ioner, 7598 Alden Way N.E., questioned the assessirg of the west side
of the street an7y. � � .
Mr. Qureshi stated there is no potentia7 of additional storm sewer on Alden
Way as it is canplete.
Mr. Franz Flath, 91 75th Way, questioned when Osborne wi17 be open. Mr. Sobiech
stated they are working with the Arwka County Highway Department to improve
this�signal and are waiting for final parts. He stated i.t is anticipated to
6e canpleted within the next few months. Mr. Flath also requested speed
signs be installed,
Mr. Thure Erickson, 75i5 Alden Way, questioned why the S4.�Pau7 Water Works wasn't
assessed for more costs. .
Mr. Herrick stated he believed property��that is being used strictly for conduit
would be very difficutt to assess as you don't have a vehicle for showing benefit.
Mr. Sobiech explained there was an exchange of parceTs with the St. Paul Water
Works relinquishing tvro parcets to the City and the City relinquishing one parcel.

Mr. Sobiech, Public Works Director, explained this project involves the improvement
of the street surfacing, curb and gutter, storm sewer and signal installation on
East River RoaA from Interstate 694 to approximately 61st Way. �
Mr. Sobiech stated the East River Road improvement consisted mainly of curb and
9utter construction amounting to a front foot assessment of $8.63. He stated there
was a signal installed and this cost was picked up by the General Fund supplied by
the MSA devetoqnent fund.
In conjunction with this improv�nent, Mr. Sobiech stated there was a west frontage
road improvement involving mostly the Georgetown Apartments and Lynwood Manor
Nursim� Home. 7his assessment amounted to $13.84 per front foot.
Mr. Sobiech stated, along with the roadway improvenents, there was a storm sewer
and the 6enefitting properties received an assessment of $1,99 per 100 square feet.

Mr. Qureshi, City Manager, reviewed the appropriations for General Government,
Public Safety, Public Works, Recreation�, and Reserve�amounting to a total of
E3,962,664. The appropriations for "Other Funds" was also revierved, amounting to
a total of $369,713, with a final total of E4,332,377.
Mr. Qureshi explained this budget proposes a mill levy of 14.g which is c7ose to the
levy for 1977, He stated, if the same mitl levy is maintained, because of changes
in the assessed valuation formula, the property owners would see a reduction in
taxes for all homes valued to $g0,000, if this budget is adopted. He pointed out
that he is speaking for local City government taxes; however, if all goverronent
units maintain the same level, the property owners should receive a reduction in
taxes for the first time in the City's history.
Mayor Nee stated the CounciT has worked on the budget for four or five months on a
program �basis, evaluating.various components of the proposai. He stated, under
tAe Charter, tAe City Manager has the responsibitity oi proposing a balancetl
budget.
Mr. Qureshi then reviewed the revenue sharing funds which the City hopes to receive
Sn T978 amounting to $186,520. He outlined the vaious proposed uses of these funds.
Mr. Qureshi explained the anti-recession funds, which are a supplementary fund,
in the a�rount of E9,036 have been allocated to Parks and Recreation.
Mayor Nee stated there are no new programs, no increase in permanent staff with
tAe possible exception of two police officers. He stated the�City has been
contracting with other goverronental agencies for CETA personnel and the City now
ha5 about 30 people working under this program in a variety�of projects. These
P�p]e are financed by Federat grant funds.. �
Mr. Qureshi stated the CEiA people are being used in areas where the City probably
wou7�dn't be able to venture, if they had to rely on their local resources. Some
areas where these persans are being used are in housing, senior citizen programs, and
teen programs.

character generatar the City is now using. The request is for.the City to add one

Mr. QuNeshi stated, in discussions with Mr. Hengerford, be wanted a guarantee from
the City�for use of the character generator for at least five years, with the
conditlon that if they need it, they would pay the City back at the rate of $725
per year for each year it wasn't used.
Counci}�n Hamernik asked if this wauld satisfy the desires of the Cable Television
Commission.
Mr, Qureshi stated, basicaliy, this is the same as what fhe City is rrow doing. He
stated: {he Cable Television Comnission is aware of this request and he felt there
wasn'i�any problem. If there was, however, they wouldn't�proceed. �

Chapter 355 of the 77 Session Laws amends the maximum penalty for misdemeanors by
increasing the maxi:mum fine from $300.00 to $500.00 or imprisonment for 90 days, or
both. Section 609.032 increases the maximum penalty for ordinance violations and
indicates that any law of this state or city charter which limits the power of any
city, town, county or other political subdivision to prescribe a maximum fine of
�3QO.Q0 or imprisonment for 90 days for an ordinance violation shall, after August 1,
1977, be deemed to provide that such city, town, county or other political subdivision
has the. power to prescribe a maximum fine of �500.00 or imprisonment for 90 days or
botfi. I am sure tf�at we do not have a charter limitai,ion if Fridley.
Probably, we should amend Chapter 901. Penalties of the City Code to prescribe a fine
in an amount not to exceed $500.00 or imprisonment in jail for a period not to exceed

Chairperson Harris opened the public hearing at �;50 p.m. Mr, garris explained
to P1r. Ansarf that at the September 14th Planning Commission meeting, Mr. Boardman
had explained the mode of operation and and the general location in the building
in which this operation was to take place. He said there had been several quesEions
by the members of the Commission which �r. goardman was unable to answer so they
tabled the action until Mr. Ansari could be present.
Ms• Shea suggeated that p�. Ansari read pages 9-LO of the September 14th Planning
Coo�mission minutes to familiarize himself with what took place at that meeting.
Ms. Gabel asked if Mr, pnsari would be providing the oil and tools needed or
if the customers would bring these things in.

Mr. Ansari stated that it was very difficult at this time to really outline in
minu[e detail what would happen. He referred to the September 14th Planning

considerable time on this project and had been getting a dead end wherever he

if insurance coverage would be available for this facility and theinsurance people
had said it would be. Since people would be working on their own cars, it was
understandable that liability would he two-part; (1) injuries inflicted by persons
upon themselves; and (2) responsi6ility of the garage when someone slips, for

Mr. Harris asked if the request was for 9,000 squar� feet or 13,000 square feet.
Mr. Ansari stated it would depend on the availability of space. When he first
started, 13,000 square feet had been available. He did not lmow now how much
would be available as Mr. Brama of Bryant-Franklin ���Eb Corporation could not
hold Mr. Ansari to that amount of space until Mr. ,�nsari received approval and
could get started. Mr. Brama had gone on to rent the space and Mr. Aneari did not
know how much he wuuld get until he received this approval from the City.
Chairperson Harris stated the reason he had asked that question was because
he wondered if there would be a physical retaining wall or a separation wall.
Mr. Ansari answered that if they gpt into this facility, instead of leaving bays,

they would remove the partitions and �eee+ one unrestricted area. There were
two corrections he would like to make. In the contiguous bays they occupied,

they would remove the separating walls so there would be a better free flow
of cars and better supervision. In that particular building, the walls are
temporary wal.ls in every bay. The other change he would like to make was that
in the minutes it had said there would probably be no hoists, but Mr. qnsari
have
said he would like to $�¢ quite a few hoists to raise cars up and down. These
probably
would,�be electric, rather than hydraulic. There would be personnel on duty
to help with this. As discussed, their people would bring the cars from the

Mr. Langenfeld asked if Mr. �,nsari had talked to any people who had had success
with this type of operation.
Mr. Msari stated that, to his knowledge, no one had been successful on the
ecale he was going on. Operations had been successful when there were only
two or three �alls. He £elt there was a need fcx his type of operation and that
it would work.
Mr. Langenfeld asked if Mr. Ansari felt there would� ak seasons and poor
seasons, thinking of the cold weather in ,7anuary and February.

Mr. Ansari stated that �pIE�� definitely would be a seasonal business. It would
be a challenge to make it a permanent business. They would have to promote
and come up with services for the entire year as cars were driven the entire year.

D�� Harris asked if Mr. pnsari intended to put in an exhaust system.
Mr. Ansari stated they would have to, especially in some areas where the
car engines would be allowed to run continuously for long periods of time�

the car in for routine maintenance, they would not need this. He said it was

Mr. Ansari stated he would have at least two people--a mechanic who would
guide people on how to do things and another person to bring the cars in and

Mr. Ansari stated they were planning on being open 10 hours a day, the peak
hours being 12;00 noon to 10:00p.m., at least to start with.
Mr. Langenfeld �,¢jE�� stated he was interested to know how Mr. Ansari planned
to charge for people working in this garage. His concern was that �� they might
have
�I�i�l�➢�¢4� to charge quite a sum to make money and hire a mechar.ic.
Mr.,Ansari stated he would probably charge on an hourly basis and on a per-job
basis, because, by necessity, they would have to put together a package that for
using the facilities for changing oil, for example, the customer would pay the
garage x amount of dollars and be allowed 1/2 hour to do the job, He stated it
ha� to be a paying proposition; but if these rates were equated with the going

Chairperson Harris asked if there would be any outside storage of vehicles and
Mr. pnsari stated there would not--just a waiting period in the parking lot
if the building was full.

FUNDING
At the present time, the Foundation has on hand cash from contri-
butions and �und raising activities in the amount of $6,232,00.
Uotunteer Tabor and donated materiats have been received in the
amount of $20,70b,00 (see Schedule I attactied), Total fund;
available for matching amount to $26,938.00, �ohich amount approxi-
rmaptely equals the funds necessary to match the SNR grand of
92/��0�.�0. .
Improvements completed to-date, as detaited below, are vaTued at
$40,478.00, Items remaining to be compieted under Phase I can be
accomptished within the budget of $54,000 proposed in the originat
plan.
PHASE I PROGRESS REPORT
Specific accomplishments during this past summer under Phase I of
the plan include:
1. Completion of paving and curbing of the parking lot.
2. Canpletion of perimeter fencing,
3. Completion of the boardwalk; 900 feet, as planned.

Dear Council Members:
We are currently planning our fall and winter work program and would appreciate
an indication that we may be invited to conduct the 1977 audit of'the City as
we have iu past years,
We would perform an audit of the balance sheets of the various funds of tb.e City
as ot December 31, 1977 and the xelated financi.al statements for the year then
ended, The audit would be perfoxmed in accordance with the procedures
established by the State Auditor and the American Institute of Certified Public
Accountants. These procedures are compatible with the pronouncements of the
National CounciL on Governmental Accounting,
The sudit which we will perform will be an examination which conststs of a review
of internal control, accounting procedures, and the details of all records, in-
cluding subsidiary records and supporting data as to mathematical accuracy,
propriety and completeness of a11 transactions on a test basis. The test
eacamination presumes that the items selected are representative of all the
transactions,
Although such an audit is the one most frequently used today, it will not neces-
sarily discover fraud or defalcation, However, should fraud or defalcation exist,
ft may be uncovered as the result of one or more of the procedures applied on a
test basis.
As itt previous years, we plan to do as much work before the year end as possible
so that we may present our report at an early date.
We have enjoyed our relationship with the City during the past years and hope that
we may be allowed to conduct the I977 audit.

A RESOLUTION SETTING AN ELECTION FOR MAYOR AND COUNCILMEMBER AT-LARGE
WHEREAS, there will be a General Election in the City of Fridley on
November 8, 1977, and
WHEREAS, there is a requirement to hold an Election for the office of
Mayor for a three year term, and Councilmember At-Large for a three year term.
NOW, THEREFORE, BE IT RESOLVED, that pursuant to the Charter of the City
of Fridley (Chapter 4, Section 4.02 as amended), the Council hereby provides
for and calls the General Election of the City of Fridley to be held in the City
of Fridley on Tuesday, the 8th day of November, 1977, at which election, electors
of the City shall vote and cast a ballot with respect to the office of Dtayor and
Gouncilmember At-Large, and thereafter the candidates receiving the highest
number of votes for each office elected shall be deemed the elected official for
said offices, and
That the City Clerk shall giye at least fifteen (15) days notice of the
time and place of holding such election, the names of the candidates who have
filed, and of the offices to be elected, by posting a noti.ce thereof in at least

The election judges listed on the attached resolution were taken
from the lists received 6y the City last year for the presidential

State Statutes, Chaper 2Q4A.17, states that for a partisan political
office, the county cF�airman of each of the two political parties
shall furnish to the county auditor of his residence a list of qualified
voters for the various election precincts. Since the law does not
require a list of qualified voters from the two political parties for
non-partisan elections, we used the lists prepared by the parties for
last year's election.

WfiEREAS, certain water and sewer charges for the City of Fridley
are delinquent in payment, and,
WHEREAS, Section 7 of Ordinance Number 113, Section 1.02 of the
City Charter provides for certifying delinquent charges to the County Auditor

SUBJECT: CERTIFICATION OF DELINQUENT WATER AND SEWER ACCOUNTS
TO THE COUNTY FOR COLLECTION
DATE: SEPTEMBER 30, 1977
The attached resolution is for the purpose of certifying delinquent water
and sewer accounts to the County for collection with the taxes due in the
year 1978.
All of the property owners have been notified of the fact their utility
bills are being certified to the County, and have been given an opportunity
to pay.
The penalty shown on this resolution i� in addition to the regular penalties
that accrue on utility bills.
The larger 6ills, for the most part, are apartment buildings. All accounts
that are douhle bungalows, apartment buildings and commercial are noted on
the attached list.
All of the delinquent charges were certifed one year ago, and if taxes on
the property are being paid, the City is receiving that money. All of the
charges on this resolution are for a year, or less, of utility service.

On October 24, I972 an Agreement was executed betv�een the City of i14inneapolis,
Caunty o£ Anoka and City of Fridley authorizing installatien of a traffic signal
at the intersection of 37th Avenue N.E. and nast River Read, also lrno�m as ldsrshall
Street N.E. or County State Aid Highway No. 1. �

Dear Dick:
Please acknowledge this letter as a request for reimbursements
for costs incurred in a storm drain installation which was
placed on Trunk Highway 65, Central Avenue in the winter of
1973-74. This drain was part of a storm drain in our total
Central Avenue Urbaniaation Project plan, and picks up the
drainage from the Skywood Mall area and places it in the proper
size pipe carrying it to Sullivan Lake.
This construction was completed in 1974 and was not to be billed
to you until the entire urbanization plan, including the signal
improvement, grading curbs, intersection revisions and so
forth, was completed and approved and the cost-sharing agree-
ments made. Since our project is now under construction, we
now make this request.
The State of Minnesota has.paid their share of this project
cost and we will be billing Hilltop for their share at this
time.
We are enclosing: our cost apportionment summary, a copy of
the final estimate to the contractor, Par Z Construction Co.,
an office memo to Mr. Crawford, District Engineer, on final
review and cost proration, the Columbia Heights-State of
Minnesota Agreement #57602 and the State's Cost Summary of
their share in the same project. Your resolution #145-1973
also refiers to this project.
We trust you will find this in order and if further information
is desired, please feel free to call us.
