THE MINUTES OF THE PUBLIC HEARING MEETING OF THE FRIDLEY CITY COUNCIL OF
JULY l7, 1978
The Public Hearing Meeting of the Fridley City Council was called to order
at 7:30 p.m. by Mayor Nee.
PLEDGE OF ALLEGIANCE:
Mayor Nee led the Council and audience in the Pledge of Allegiance to the
Flag.
ROLL CALL:

Councilman Barnette, Councilman Schneider, Mayor Nee,
Councilman Hamernik and Councilman Fitzpatrick

ADOPTION OF AGENDA:
MOTION by Councilman Hamernik to adopt the agenda as presented. Seconded by
Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared
the motion carried unanimously.
PUBLIC HEARINGS:
PUBLIC HEARING ON FINAL PLAT; PRELIMINARY SUBDIVISION P.S. #78-04 EAST RANCH
ESTATES 4TH ADDITION; THE SAME BEING 7910 UNIVERSITY AVENUE GODFATHER PIZZA):
MOTION by Councilman Hamernik to waive the reading of the Public Hearing notice
and open the Public Hearing. Seconded by Councilman Barnette. Upon a voice
vote, all voting aye, Mayor Nee declared the motion carried unanimously an�
the Public Hearing opened at 7:34 p.m.
Mr. Sobiech, Public Works Director, stated this plat is the northwest quadrant
of the intersection of 79th and University where Godfather Pizza presently
exists. He stated a building permit was approved, with the stipulation that
this platting take ptace. The park fee was paid at the time of the issuance
of the building permit.
No persons in the audience spoke for or against this proposed plat.
MOTION by Councilman Hamernik to close the Public Hearing. Seconded by
Councilman Fitzpatrick. Upon a vaice vote, al1 voting aye, Mayor Nee declared
the motian carried unanimously and the Pu51ic Hearing closed at 7:36 p.m.
PUBLIC HEARING ON FINAL PLAT; PRELIMINA.P,Y SUB�IVISION P.S. #78-05, MUNN'S
MOTION by Councilman Fitzpatrick to waive the reading of the Public Hearing
notice and open the Public Hearing. Seconded by Councilman Hamernik. Upon
a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously
and the Public Hearing opened at 7:36 p.m.
Mr. Sobiech, Public Works Director, stated this plat has been before the
Planning Commission on several occasions. He stated the proposed plat consists
of 10 lots, as noted on Page 2A of the agenda book.
Mr. Sobiech stated it is the intention of the petitioner to develop nine of
the lots. Each of the lots satisfies the minimum area and lot width requirements.
Mr. Sobiech stated Lot �o. l0 is to the north of the basic plat and the petitioner
intends to work with the City regarding dedication of this property for park
purposes.
Mr. Sobiech stated the Planning Commission's concern was mainly with the drainage
in the area. �

In order to insure a safe traffic pattern in the area and not have access
directly on East River Road, it is proposed to improve Hillcrest to what
is shown as "Blair Way" on the plat.
Mr. Sobiech stated sewer and �Mater would be extended to the plat from East
RiVer Road. Since there is no existing storm sewer piping in the area, a
surface drainage system must be utilized.
Mr. Sobiech stated certain items were forwarded to the Planning Commission
for their review such as information regarding soil borings, existing
topography and water table in the area. Mr. Sobiech stated some existing
organic materials would have to be removed and the Engineer's report indicates
that the soil materials on the site are adequate for construction of single
family homes.
Mr. Sobiech stated it would be recommended that the footings for the
basements. be four feet above the water table.
Mr.• Sobiech stated a drainage plan was presented with the plat. He stated ;
there is an indication that water collects along the south boundary lines ;
of the plat, and, on occasion, there is standing water on properties presently
existing to the south of the proposed plat. ;
Mr. Sobiech stated, one of the stipulations by the Planning Commission for
plat approval, was to make sure that this plat did not impact on the properties
to the south and possibly to work with these property owr.ers to eliminate the
standing water problem.
, Mr, Sobiech stated, in development of the drainage plan, about seven acres
of area was involved. He stated the main outlet for drainage of this area
is the drainage ditch which parallels the railroad tracks and flows into Locke
Lake.
Mr. Sobiech stated, in order to have a positive flow into Locke Lake, it
wouid be necessary to have the drainage ditch reconstructed and properly -
maintained. He stated what is also proposed is a landlocked holding pond
and it would be necessary for the petitioners to go before the Rice Creek
Watershed District to satisfy their storm sewer retention requirements.
Mr. Sobiech stated the petitioners intend to perform the site grading and
grading for the ditch to insure, before construction, that everything is
flowing in a proper manner. In referring to stipulation No. 5, as recorrpnended
by the Planning Commission, which states that all costs of the drainage system
be borne by the developer, Mr. Sobiech stated the petitioners have signed an
agreement that they are willing to pay for these costs.
Mr. Sobiech stated he feels the Burlington Northern Railroad has some �
responsibility for this ditch also, and permission to use this drainage �
ditch will have to be obtained from the railroad.
Mr. Sobiech also pointed out there are three City controlled lots wMich have
drainage easements on them and at this time cannot be used for anything other
than drainage purposes. He stated, in order to make sure this ponding area
is maintained, access would be needed and it is recommended a 20 foot'easement
be given between Lots 4 and 5.
Councilman Barnette questioned if the matter of alignmeni where Hillcrest
comes into Hickory Drive had been resolved.
I Mr. Sobiech stated the City has a�� existing easement and didn't see any
i probiem in working with the property owners, Mr. Berry and Mr. Nichols
; � regarding this alignment.
Councilman Schneider questioned who would be responsible for maintaining
the drainage easement.
Mr. Sobiech stated, once it is graded, it would be up to the individual
property owners to maintain it.
' Councilman Schneider questioned if the prospective buyers of these homes would
be aware they had to maintain the drainage easement. .

Mr. Herrick, City Attorney, said that would be part of the plat and generally �
the buyers are made aware of this when they buy the home. �'
Councilman Schneider questioned ifi this drainage system wauld be creating a
similar situation that now exists at Moore Lake.
Mr. Sobiech stated the purpose of the open drainage system is to have the
ponding to absorb the nutrients.
Mayor Nee stated, ecologically, it is a more desirable system than piping. i
Mr. Herrick pointed out the Rice Creek Watershed District would also be
looking at the quality of the water and would probably have some comments.
Councilman Fitzpatrick stated that most plats provide for drainage through
a storm sewer system; and with this plat, there is drainage onto public land.
He felt, therefore, the City is, in effect, providing the drainage for this
plat.
Mr. Herrick felt the City has a similar situation at Harris Lake where the
pond is owned by the City and also such a situation, in part, of some ponds in
North Innsbruck, He stated, if it was determined that the best way to drain
this area was underground piping, probably the City would construct a storm
sewer and assess it against the property, but he didn't see any difference
whether it is above or under ground.
Mr. Herrick stated the cost of the drainage system, in this case, would be
paid for by the developer which he feels is consistent with what has been done
in the past. He stated it appears there is a trend in trying to get surface
water detention rather than piping everything underground. Mr. Herrick stated
he didn't see any problem as far as setting a precedent or the legality, as
long as the City isn't using public funds to subsidize the development.
Mr. Qureshi, City Manager, stated the Council could take the approach of
having the City pruvide the ��nderground storm sewer system and the developer
pay the full assessment cost for the plat and also assess surrounding benefited
properties which drain to the systero. He stated, if the Council has any plans
,, to use the property for a park in the future, the open drainage system would
limit its use. He also pointed out that the recommendation of the Parks and
Recreation Commission was that this would not be a good location for a park.
Councilman Fitzpatrick stated he realizes they have a recommendation from the
Parks and Recreatipn Commission and Planning Commission that there not be a
park developed on this property; but on the other hand, the City has a petition
from residents in the immediate area requesting park facilities on that property.
Councilman Fitzpatrick also pointed out that there is already an existing
drainage problem on some of the properties on Hickory Drive and with this
drainage plan, it might tend to alleviate some of the problems.
Councilman Hamernik pointed out the proposed houses are awfully close to the
rear lot line and questioned the grade in this area.
Mr. Sobiech stated the houses would have to be at an elevation about 860
down to 855 in order to have a 4 to 1 slope.
Councilman Hamernik questioned what Mr. Sobiech meant by a"positive flow".
Mr. Sobiech stated the outlet at the bottom of the pond would have to be
, such so as the water comes in, it flows out immediately. He stated this is
an area where they would have to check with the Watershed District on their
requirements.
Councilman Hamernik asked on the basis of the soil borings and figures for a
50 year storm, how long it would take to relieve the pond.
Mr. Sobiech stated he is anticipating abaut 36 hours and with normal rain,
not anticipating any water at all in the ponding area.
� j Mr. Bud Berry, 6965 Hickory Drive, indicated he didn't know how this could be
� absorbed into the ground in 36 hours.

Mr. Nichols, 6949 Hickory Drive, felt additional construction in this area
would only accentuate the drainage problems.
Mr. Sobiech stated these questions were addressed in the drainage plan and
he reviewed the preseni fT�w factors and what they wouid 'oe, after deveiopment.
Ne felt, therefore, the capacity required would have to be provided in the
ponding or holding area.
Mr. Terry Mickley, 7075 H9ckory Drive, whose property is on the south side
of the proposed development, voiced his concern about the drainage. He
pointed out the problems he now has with water standirg in his back yard.
he felt the tolerances ►veren't enough fio insure that someone isn't going to
have water problems.
Mr. Sobiech stated they are suggesting the railroad ditch be lowered to get
a more positive flow. He pointed out that Mr. Mickley's property has a berm
running across the back which keeps the water on his property. He felt, if
this were re-graded, it would help the drainage.
Councilman Hamernik asked, in Towering the Tevei of the raiiroad ditch, what
elevati,on they were looking for.
Mr. Sobiech stated they wished to have the elevation at the railroad drainage
ditch be at the bottom of the retention pond so as not to have a holding
situation.
� � Mr. Qureshi, City Manager, pointed out if there is any desire to use the
I property other than for a drainage area, Council should be sure they have
access to the property. He felt the design of the system might be different,
if the Council wanted to use the property for anything other than a drainage
� pond.
Mr. pureshi also felt the developers should make sure they advise prospective
buyers that there would be no park in the back of their yards.
Mr. Munn, the developer, questioned why an easement was needed if they were
not goir.g to have a park.
Gouncilman Fitzpatrick felt there has been a good deal of requests in the
area for park facilities and that this option should be left open. He stated
he believed it was pointed out the City wanted access to this area even though
there wasn't a park.
No other persons in the audience spoke regarding this proposed plat.
MOTION by Councilman Fitzpatrick to close the Public Hearing. Seconded by
Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared
the motion carried unanimously and the Public Hearing cTosed at 8:40 p.m.
Mayor Nee stated that Items 5, 7 and 8 are also related to this particular
plat so Council may wish to consider these items at this time.
MOTION by Councilman Fitzpatrick to consider :tems 5, 7 and 8 on the agenda
in conjunction with this plat. Seconded by Councilman Barnette. Upon a voice
vote, all voting aye, Mayor Nee declared the motion carried unanimously.
NEW BUSINESS;
i CONSIOERATION OF APPROVAL OF FINAL PLA7 P.S. �78-05, MUNN'S HILLCREST ADDITION:

MOTION by Councilman Fitzpatrick to concur witfi the recommendation of tf�e
Planning Commission and approve the final plat, P.S. #78-05, P1unn's Hillcrest
" Addition, with ihe foliowing stipuiations: (1) That the drainage plan
j functions to insure that property owners soutF� of the plat are not impacted
by the development; and if possible, work with them to reduce their existing
; problems; (2) That a 20 foot access easement to Lots 11, 12 and 13 be
constructed with ap�ropriate hard s�rface area to adequately handle maintenance
� equipment and to be placed prior to the occupancy of the proposed dwellings;
i (3) That a performance bond be obtained to insure the proper site gradings for
! each lot; (4) That the approval would be contingent on Burlington Northern
� properly maintaining the drainage ditch; and (5) That all costs.for the drainage
; system would be borne by the developer. Seconded by Councilman Barnette,

Mr. Sobiech, Public Works Director, stated the Council should also state
whether they wish to collect the park fee or have land dedicated for park �
purposes.
Councilman Fitzpatrick stated the remainder of Lot 10 would be sufficient to
cover 8 of the 9 buildable lots, therefore, they could dedicate Lot 10 and
pay a$300 fee for the additional lot.
MOTION by Councilman Fitzpatrick to add to the motion that the park fee would
be satisfied with the dedication of Lot l0 plus $300. Seconded by Councilman
�` Barnette.
� Councilman Hamernik felt the motion should include that the petitioner advise
potential buyers that the drainage area is strictly for drainage purposes and
not a park.

Councilman Namernik stated he is not comfortable with stipulation No. 4 that
approval is eontingent on.Burlington Northern properly maintaining the drainage
ditch.
Mr. Herrick, City Attorney, stated they are talking about more than maintenance,
, and an agreement would have to be reached with Burlington Northern to bring the
ditch up to a certain level agreed upon. He stated he supposed there is room
for negotiation whether the City, through the developer, is going to pay for
it or the railroad is going to pay for it. He thaught the railroad has some
responsibility, if the ditch originally drained the land and they permitted
the silt to collect.
Mr. Herrick felt stipulation No. 4 might be amended to provide that approval
is contingent upon the City obtaining an agi°eement with Burlington Northern
that the ditch will be constructed to a satisfactory depth to provide adequate
drainage of the area.

MOTION by Councilman Fitzpatrick to amend stipulation No. 4 to read as follows:
"That approval is contingent upon the City reaching an agreement with Burling-
ton Northern that the ditch be constructed to a satisfactory depth to
adequately drain the area." Seconded by Councilman Hamernik. Upon a voice
vote, all voting aye, Mayor Nee declared the motion carried unanimously.
UPON A VOICE VOTE ON THE MAIN MOTION, all voted aye, and Mayor Nee declared
the motion carried unanimously.

by Councilman Schneider. Councilman Qarnette stated it seems the matter re-
garding the street alignment will have to be decided and the City will have
to m�et with Mr. Berry and Mr. Nichols. Mr. Sobiech, Public Works Director,
stated this �°esolution will direct staff to prepare the alignments and
authorize them to discuss this with the affected property owners. UPON A

P.UBLTC HEARING OPJ PROPOSED TAX LIMIT BASE INCREASE:
MOTION by Councilman Fitzpatrick to waive the reading of the Public Hearing
nvtice and open the Public Hearing. Seconded by Councilman Hamernik.
Upon a voice vote, all voting aye, Mayor Nee declared the motion carried
unanimously and the Public Hearing opened at 9:12 p.m.
Mr. Brunsell, City Clerk, stated in 1971, the State Legislature adopted
�egislation which put a limit on the taxes a City could levy. He stated
'this limit is based on dollars per person and it doesn't make any difference
�►ow much assessed va]ue the City has or how much new industrial or commercial
development there is in the City. Mr. Brunsell stated Fridley is a maturing
cammunity and growth has not been that much which puts a restriction on the
�ity's operation as the limit was based on taxes in 1971.
Mr. �runsell, stated, in 1977, the Legislature amended their legislation
io permit City's to change their tax base and this lias to be taken advantage
of in 1978. He pointed out this does nat mean the Coun�il is considering a
tax levy. He stated, even though the Counci7 may not want to use this tax
base, action must be taken this year in order for them to make any changes
3n the future.

; Mr. Brunsell preser+ted a chart showing the cost of living and where City
� taxes have increased at a lesser rate compared to the cost of living. ,
� Charts were also presented showing the costs for City services and how the
; costs have risen for commodities the City must use.

Mr. Brunsell briefly explained the Fiscal Disparities Act by which 40°6 of j
i the commercial and industrial valuation is shared on a metropolitan wide i
; basis and the City loses under this law. He explained another item affecting i
� � the mill rate is the limited value law which places a restriction on the amount

of valuation increase the assessor can place on property within a given year
He a7so stated the homestead formula used also affects the mill raie. Mr.
Brunsell presented charts showing mill rate comparisons and how the mill
rate was affected by laws that were enacted by the Legislature.
� 'For purposes of comparison, Mr. Brunsell stated, in 1969, a house valued
• at $50,000 paid City taxes of �252 and in 1979, a house valued at $50,000
paid City taxes of $170. Mr. Brunsell also presented a chart showing the
amount paid by an average household per year for the various City services.
� Mayor Nee stated the main point is this is the year the Legislature has
� permitted the cities to make an adjustment in the tax base and it must be
� done this year or not at all.

Mr. Leonard Lind, 1620 75th Avenue, stated the State reduced the tax on the
homeowner and now the City wants to do away with it. He stated the big
dea] was to get industry in the City and now it doesn't do any good.
Mr. Brunsell stated they have industry and business in the City, but that
doesn't mean the City can levy on that base, as 40% of the valuation of
industrial and commercial properties is shared on a metropolitan basis,
and the City loses about $7,000,000 in assessed valuation per year because
of the Fiscal Disparities Law. Mayor Nee stated, if there wasn't any Fiscal
Disparities, Mr. Lind, as a homeowner, would be better off.
Mr. Lind asked how come this isn't changed. Mayor Nee pointed out the
Legislature passed this legislation and they really have control over this.
He stated that what the City collects now for taxes is less than a 1/2%
of the value. No other persons in the audience spoke regarding this item
on the tax limit base increase.
MOTION by Councilman Hamernik to close the Public Hearing. Seconded by
Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee de-
clared the motion carried unanimously and the Public Hearing closed at
9:38 p.m.
RECESS:
! MOTION by Councilman Schneider to recess at 9:38 p.m. for the administrative
public hearing on expenditure of Revenue Sharing Funds for 1979. Seconded
by Councilman Namernik. Upon a voice vote, all voting aye, Mayor Nee de-
' clared the motion carried unanimously.

j Mr. Qureshi, City Manager, conducted the administrative public hearing re-
j garding consideration of expenditures of Revenue Sharing funds for 1979.
Ne stated the funds expected to be received for 1979 are $216,612 and outlined
what these funds were proposed to be used for and in what departments and
purposes they would be used.
Mr. Qureshi stated it is administration's intent to have input from the public
regarding use of the Revenue Sharing Funds and if any of the public has any
suggestioris, to contact him.
No persons in the audience spoke regarding the use of Revenue Sharing Funds
for 1979.

MOTION by Councilman Hamernik to adopt Resolution No. 59-1978. Seconded
by Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared
the motion carried unanimously.
APPOINTMENTS - CITY EMPLOYEES:
' MOTION by Councilman Hamernik to concur with the appointments of Joyce
' Rasmussen and Lori Anderson as Police Technicians at $816/month, effective
July 31, 1978. Seconded by Councilman Schneider. Upon a voice vote, all
voting aye, Mayor Nee declared the motion carried unanimously.

POLICE OFFICER APPOINTMFNT:
Mr. Qureshi, City Manager, stated there is a vac:ancy for a police officer
and asked if Council wished to consider this item now or at a later
time.
MOTION by Councilman Namernik to delay consideration of this police officer
appointment until the budget is completed in October. Seconded by Council-
man Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the
n�ction carried unanimously.
CLAIMS:
� MOTION by Councilman Schneider to authorize payments of Claims No. 160E12
through 194896. Seconded by Councilman Barnette. Upon a voice vote, all
voting aye, Mayor Nee declared the motion carried unanimously.
CONSIDERATION OF LETTER TO BE CIRCULATED TO VARIOUS CONSULTANTS REGARDING THE
DOWNT04lN REVITALI7_ATION PROJECT:
MOTIOC� by Councilman Hamernik to concur with ihe draft letter Re: Proposed
Consultant Study and authorize the City Managerto circulate it to prospective
consultants for the downtown revitalization project. Seconded by Councilman
Barnette. Upon a voice vote, all voting aye, Mayor Nee declared the motion
carried unanimously.
Mr. Qureshi, City Manager, stated, after receiving input from i:he consultants,
specifications will be developed and brought back for Council's approval.

Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion
carried unanimously and the Public Hearing Meeting of the Fridley City Council

A RESOLUTIO:� AUTHORIZING A TAX LIt4IT BASE It�CREASE
blHEREAS, 7he 1977 Legislature adopted t1.S.A. 275.52, Subd. 5, which
authorized certain cities to levy starting in 1979 an additional amount
not to er.ceed 10 percent o-F its 197� adjusted levy limit base, with such
amount so levied to become a permanent part of the levy limit base, and
t�F{EREAS, In order to qualify for this increase in levy limit
base, a city must have levied at least 98 percent of its levy limit base .

. WNEREAS, The City of Fridley levied 99.5� of its levy limit
far taxes collectible in 1978, and
WNEREAS, The City of Fridley has experienced a population
decline compared to the^year 1974, and
WHEREAS, The taxing limits are based on dollars per capita, and

leveling aff of tax irzcome in relation to budget needs and inflationary

I�O�d, THEREFORE, BE 1T RESOLVED, That the City of Fri�ley, by
action of the City Council, requests authority to levy an additional amount,
to be determined by the Commissioner of Revenue, (estimated to be up to
�294,889), o�' gen�eral property taxes, over and above the State levy limitation,
so as to be able to maintain current service levels in City programs for.the .
year 1979 and subsequent years, . �

Sun Newspaper on June 14, 21, 28 and July 5, and . ,

SUBJECT: A RESOLUTION AND PUBLIC HEARING NOTICE AUTHORIZING A TAX BASE INCREASE
DATE: JULY 12, 1978
The attached resolution has been published as a public hearing notice, advertising
the fact that a public hearing will be held on July 17 regarding a tax base
increase.
The adoption of this resolution, the publication of the resolution, and the public
hearing are part of the administrative steps that are necessary if the City is to
consider increasing its tax base.
After the public hearing, the Council can either elect to do nothing regarding
increasing the tax base, or adopt a resolution authorizing a tax base increase.
If the City�Council adopts a resolution authorizing a tax base increase, that
resolution must be published once in the legal newspaper of the City. The citizens
of the City of Fridley have thirty days from the date of publication to gather a
petition and submit it to the City Council if they want the question put on the
ballot at the next eleetion. If the City goes ahead with the administrative
procedures relating to increasing the tax base, the Council must adopt the second
resolution at the July 17 meeting in order to meet the time requirements for the
question to be put on the September 12 Primary Election.
The fact that the Council goes through the administrative steps to increase the
tax base does not mean that the City Council must use any part of the tax base
during the year 1979, or any future year. Separate actions by�the City Counci7 are
necessary before any part of this tax base can be used. However, this is the only
year the City Council can take the administrative steps to provide for increasing
the tax base.

Revenue Sharing provi.sions require that the chief executive hold a
public hearing on the proposed use of Revenue Sharing Funds. This
public hearing must be held at least seven days prior to the time
the chief executive forwards the budget to the legislative body.
The purpose of this hearing is to fulfill this requirement.

For most statc a�ld local governments, the bud�;et pracess consists of the devclopment of a
Uudget by thc executive branch (c.g., govcrnor, mayor) and cnactment by a lcbislative body (e.g.,
state

/'"'�Thc regulations require that at Icast sevcn days before the executive autllority submits its
pro�iosed budget to the legislative body, a puUl'zc hearing must be held by the executive authority at
which local citizens ancl groups can present written or verbal comments on how they propose the
�x revenue sharing money should be spent (31 C.i'.R. §S l.13(a)). An executive authority is the chief
executive o�cer or other elected or appointed official of tl7e recipient whose statutory responsibility
is to assemble budget data and prepare the budgct document for preseiitation to the legislative body
for enactment or approval (31 C.F.R. 51.10(f�).
At least ten days before this proposed use hearing, the public must be notified by publication
and publicity (¶331). A reasonable effort must be made by the recipient government to have senior
citizens and senior citizen groups participate in the hearing (�315).
' The executive whic,i holds the proposed use hearing is not required to have a plan for
expenditure of revenue sharing funds at the proposed use hearing. The spirit and intent of the

proposed use hearing, as designed by Congress, was for t.he executive to discuss the use of revenue
� sharing funds with the public before his budget is presented to the legislative body. But the law does
. not require the executive to prepare a plan for eapenditure of revenue sharing funds before the
hearing. �
The executive may discuss the proposed executive budget ��s�ith members of the legislative
branch before he submits the budget to the legislative branch fonnally, and also before the proposed
use hearing.
Exemptions, alternatives and �vaivers
Not all recipients are required to hold the proposed use hearing. A recipient cauld be exempt
or provide an alternative to the hearing, if the recipient met the cot�dition described below and
obtained a waiver from ORS. The procedures for obtaining a�vaiver are detailed in ¶307.
Waiver rules effective from Janiiary 1, 1977 to September 30, 1977
Recipieiits �vere exempt from the proposed use hearing if:
� The recipient received less than $10,000 per year in revenue sharin� funds.
� The unavoidable expenses of holding and publicizing the hearing �vould exceed five (5)
percent of the recipient government's re��enue sharing entitlements for its fiscal year.
Unavoidable expenses are defincd as those incremcntal expenses associated with holding the

A RESOLUTION AUTHORIZING A TAX LEVY LIMIT BASE INCREASE
WHEREAS, the City Council of the City of Fridley did on this 17th
day of July, 1978, hold a public hearing pursuant to M.S. 275.52, Subd. 5,
for the purpose of receiving public comment on whether or not the Fridley
City Council should adopt a Resolution providing for a permanent increase
in Fridley's 1'ax Levy Limit Base in an amount not to exceed $294,889, and
WHEREAS, this Council recognizes that permanently increasing the Tax Levy
Limit Base by said amount does not obligate the City Council to use any
or all of said amount as part of the 1978 or future years' Tax Levy
Resoluiions,
HOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Fridley
as follows:
1. That a permanent increase of ten (10) per cent or the
amount of $294,889 to the Tax Levy Limit 8ase is hereby
approved.
2. That pursuant to P1.S. 275.52, Subd. 5, this Resolution
shall be published in the City's official newspaper on
the 19th day of July, 1978.

WHEREAS, the construction of certain impravements is deemed to be
in the interes_tof the City of Fridley and the property owners affected
thereby.
BE i'T RESOLVED, by the City Council of the City of Fridley, as
follows:
1. That the preliminary report submitted by the City Engineer is
hereby received and accepted.
2. That the City Clerk shalt act to ascertain the name and address
of the owner of each parcel of land directly affected or within
the area of lands as may be proposed to be assessed for said
iroprovements, and calculate estimates of assessments as may be
proposed relative thereto against each of said lands.
3. That the area proposed to be assessed for said improvements and
each of them as noted in said Petition are alt the lands and areas
as noted in said Petition. A1l of the same to be assessed
proportionately according to the benefits received.
4. That the estimates of assessments of the Clerk shali be available
for inspection to the owner of any parcel of land as may be
affected thereby.

We, the undersigned, constituting one hundred percent (1000) of the
property owners in number and in interest, in the following streets:
Hillcrest Ave. From Nickory Drive to Blair Way
Blair Way From Hillcrest Ave. East to Cut-de-sac
who will benefit by the proposed improvement, hereby petition that the
following improvements be made:
Sanitary sewer lateral and services
Watermain lateral and services
Street and storm drainage grading, piping and appurtenances
We understand that the cost of said improvement will be assessed against
the benefiting property in the above described area. We, the under-
signed, being 100% of the property owners who wili benefit from the
aforementioned improvements hereby waive the right to a public hearing
for the•improvement which is allowed under the normal procedures set
forth in Minnesota Statutes Chapter 42g.

WHEREAS, Resolution No. adopted on the day of ,
1978 by the City Council, received a petition to waive the public hearing on the
proposed improvements, as specifically noted in the Petition attached hereto for

WHEREAS, all of the property owners whose property is liable to be
assessed with the making of the improvements (as noted on said Petition)
have signed the attached Petition requesting the improvements and constitute
100% of the property owners who will benefi� from the improvement and do waive

PETITION TO WAIVE A PUBLIC HEARING ON THE MATTER OF THE CON-
STRUCTION OF CERTAIN IMPROVEMENTS: STREET IMPROVEMENT PROJECT
ST. 1978-1, ADDENDUM #5
WHEREAS, the construction of certain improvements is deemed to be
in the interes_t of the City of Fridley and the property owners affected
thereby.
BE IT RESOLVED, by the City Council of the City of Fridiey, as
follows:
l. �hat the pretiminary report submitted by the City Engineer is
hereby received and accepted.
2. That the CiCy Clerk shall act to ascertain the name and address
of the owner of each parcel of land directly affected or within
the area of iands as may be proposed to be assessed for said
improvements, and calculate estimates of assessments as may be
proposed relative thereto against each of said lands.
3. That the area proposed to be assessed for said improvements and
each of them as noted i� said Petition are alt the lands and areas
as noted �in said Petition. All of the same to be assessed
proportionately according to the benefits received.
4. That the estimates of assessments of the Clerk shall be available
for inspection to the owner of any parcel of land as may be
affected thereby.
5. That all property owners whose prope�ty is liable to be assessed
with the making of the improvements have signed a Petition attached
hereto requesting the improvements and constitute 100% of the
property owners who wiil benefit from the improvement and do waive
