7 38 p.m. by Mayor Nee.

PUBLIC HEARINGS
PUBLIC HEARING ON ASSESSMENT FOR STORM SEWER IMPROVEMENT PROJECT NO 125
MOTION by Councilman Schneider to waive the reading of the Public Hearing
notice and open the Public Hear�ng Seconded by Councilman Hamernik. Upon
a voice vote, all voting aye, Mayor Nee declared the motion carr�ed unanimously
and the Public Hearing opened at 7:40 p.m.
Mr Sobiech, Public Works Director, stated this is the proposed itnal
� assessment roll for storm sewer pro�ect No 125. He stated a certain amount
of piping was necessary to complete the drainage in the area and, this
particular ptece of piping, was constructed �n New Brighton by a joint powers
agreement in con�unction with completion of Palmer Drive
Mr. So6iech stated the final assessment rate �s 65 cents per lOD square feet
He stated the prelim�nary costs were esttmated at $1 13 per 1Q0 square feet
so the actual assessment was less than what was estimated
Mr. Lee Athearn, 5457 East Danube Road, asked if the 100 square feet is based
on the land or the house stze. Mr. Sobiech stated tt was the square footage
of the lot
No other persons in the audience spoke regarding th�s assessment.
Counctlman Schneider stated there would be additional storm sewer in some
areas and asked what that would entail.
Mr. Sobiech stated a final outfall from Frtdley to New Br�ghton would be
installed and outlined the area generally affected
Counctlman Schneider questioned if most of the area was built, after the poltcy
of having builders escrow funds.
Mr. Quresht, City �lanager, stated the improvement pro,7ect was actually ordered
� before any development took place He stated, if persons buyina property had
made a search, it would have shown the improvement was rntended He pointed
out that this is the reason why most of the property owners should have escrowed
the money for the improvement.
P4r. Herrmann, City Assessor, stated, depending on the agreement, most of the
time the Farr Development Corporation was responsible for the payments

PUBLIC HEARING ON ASSESSMENT FOR STREET IMPROUFMENT PROJECT ST. 1976-
MOTION by Councilman Hamernik to waive the reading of the Public Hearing
notice and open the Public Hearing. Seconded by Counctlman Schneider
Upon a voice vote, all voting aye, Mayor Nee declared the motion carried
unanimously and the Public Hearing opened at 7 45 p.m.
Mr Sobiech, Public Works Director, stated this improvement involved
Mississipp� Street from East River Road to Second Street covering the
Mtss�ssippi Street railroad underpass He stated the f�nal assessment
for curbing was $4.20 a front foot, with a side footage rate of 58 cents
The cost for the sidewalk was �6.8a a front foot, with a side footage
rate of 87 cents
Mr. Sobiech stated the City's share of the pro�ect ts approximately
$40,021 76.
Mr. Dav�d Brink, representing Designware Industries, referred to the cost
of about $40,000 for the sidewalk and curb7ng and stated, he unde�°stands,
the total cost for the contractor was in the neighborhood of �35,000, and
questioned the $5,000 d�fference.
Mr. Sobiech stated $35,373.25 was paid to the contractor, the remaintng
costs were for advertising, Engineertng Department, Administrative and
Special Assessment Department, Interest, Legal and FTSCaI, and ConttngencTes.
Mr. Brink quest�oned if this $5,000 goes agarnst the entire pro�ect. He
stated he was under the �mpression some of the design costs were to be split
and this wasn't going to be a direct assessment, and that the direct
assessment was to be only for curntng and sidewalk.
P9r Sobiech explained the County did pay certain engineering costs for the
pro�ect, however, in deliberat�ons with the County and Federal �overnment,
the City had input regarding the road design so these costs would still be
part of the pro�ect and would directly be the City's costs.
P4r. Brink questioned the side yard assessment and stated the ��est side of
their property, along the railroad tracks, is a road that was put in as an
access for the Bus Company. He stated he really didn't feel it is a City
street and yet they are being assessed for sidewalk and curbing.
P1r Herrmann, City Assessor, explained the formula used for assess�ng the
side yard.
f4ayor Nee stated another alternative would be assess it as front footage.
Mr. Herrmann stated if �t was assessed onfrontage instead of the formula
used for the side yard, the difference in the total assessment would be
about �380.00.
Mr Brunsell, City Clerk,felt the only question was �f that was a City street,
since the assessment was spread according to the City's poltcy.
P�r. Brink stated, although they have 85% of the road, it is a road they don't
use and only created for one need.
P1rs Robert Swoboda, Jr., 6501 P1ain Street, questioned the amount of her
assessment �n comparison to her ne�ghbor's.
Mr. 6runsell, City Clerk, explained, since Mrs, Swoboda's property was a
corner lot, she would be paying the full front yard assessment plus 1/3
of the side yard Frontage
Mr Herrmann stated, the City's policy regarding corner lots, was to assess
the s�de yard 1/3 of the footage, with the remain�ng 2/3 spread halfway
up the block
P�rs. Swoboda ind�cated she didn't think this wds fa�r that they have to carry
the load.

hir. Brunsell explained a lot of dtfferent assessment patterns have been looked
at, 6ut this system has been used throughout the City and seems to be the most
equita6le.
Mayor Nee stated this same question comes up at all the public hearings
regarding the assessment on corner lots. He stated the City has been
cons�stent in us�ng thts formula to remove some of the costs for property
owners on corner lots.
He stated the question the Council has to address is if the improvement
improves the value of the property up to the amount of the assessment.
Mr. Herrick, City Attorney, stated every community has the problem on how to
deal with corner lots. If the City were to assess these lots totally for both
front and side yards, obviously that would be a heavy burden on the property
owners. He stated, therefore, the City has adopted thts policy and recently
the League of Mtnnesota Cities published a study that the majority of the
cities handled the matter of assessing corner lots in a manner similar to
what Fridley uses.
Mr. Swoboda asked if the City was to maintain the grass on his side of the
boulevard. He stated the grass was only cut twice this summer.
Mr. Sobiech stated the Zoning Code provides that ad�acent property owners
maintain the boulevard.
Mr Charles Ames, 6473 Ashton Avenue, questtoned the amount of h1s assessment.
Mr. Sobiech, Public Works Director, expla�ned that since the County acqutred
property for an easement, Mr. Ames' lot has become a corner lot.
Mr. Herrmann, City Assessor, explained Mr Ames was being assessed for a side
yard as well as the front footage
Counc�lman Barnette felt Mr. Ames was a victtm of c�rcumstances where h�s
property became a corner lot because of the County acquiring property for
an easement
Gouncilman Fitzpatrick felt he was be�ng assessed a side yard assessment when
his side yard really didn't approach the improvement and stated he had a
pro6lem with a side yard improvement 80 feet away.
Councilman Hamerm k felt, s�nce Mr. Ames' property wasn't a corner lot, and
through no fault of his own, tt has now become a corner lot, possibly all
properties that were acquired to put in the street should be evaluated.
Mr. Nerrick felt, if there was pu6lic property 6etween Mr Ames' property
and the lot which isn't capable of being developed, he d�dn't think the C�ty
could assess it.
Mrs. Swoboda then again questioned her assessment as she felt the�r
ctrcumstances were the same as Mr. Ames'.
Mr. Herrick stated, he thought, when Mrs. Swoboda was talking about their
property that the lot was sub�ect to an easement, but if it is property
they don't own, he felt it was a different situation.
Mr. Nerrick felt he would like a map which showed the ownership of the lots
and where the street r�ght-of-way was in relat�onship to the lots

Mr. Brunsell, City Clerk, stated this assessment roll is not for work that
has been done recently, but covers charges made for properties that have tied
tnto a water or sewer main that haven't previously paid a lateral assessment
He stated the ma,7or�ty of the owners of the properties involved have signed
an agreement agree�ng to the principle of these lateral charges.
Mr. Brunsell stated the assessment is f�gured tn two ways, either by us�ng
today's average lateral charge or using charges that were levied in the
general area at the time the lines in question were tnstalled, plus accrued
interest to the present time. He stated the assessment rate used on the
affected properties �s the lower of the two formulas �
A iady in the audience noted that Lot 2, Target Addition, was recently
subd�vided into three lots and asked if it was previously assessed as one lot
Mr. Brunsell stated it was not previously assessed for laterals. He noted
there was an extra expense of $1,200 to get to the water main and stated that
this amount is credited against the gross assessment. He explained each
property pays a certain cost per front foot, tf they tie into a main.

PU6LIC HEARING ON ASSESSMENT FOR TREATPIENT AND REMOVAL OF TP.EES (1978
MOTION by Councilman Barnette to waive the reading of the Public Hearing
notice and open the Public Nearing. Seconded by Councilman Schneider, Upon a
voice vote, all voting aye, Mayor Nee declared the motion carried unanimously
and the Public Hearing opened at 8 50 p m
Mr. Qrunsell, City Clerk, stated these charges are for the treatment or
removal of trees as part of the tree removal program. He stated there is a
$25 00 administrat�ve charge added to each parcel of land in addition to the �
contractor's charge. The Ctty and State absorb 50% of the contractor's cost
on residential property. He explained the assessment is split over a five
year period at an interest rate of 7z percent

PUBLIC NEARING ON STREET AND ALLEY VACATION

Mr. Sobiech, Public lJorks Director, stated this is a request io vacate a
utility easement between Lots 24 and 25, Block 2, Meadowmoor Terrace so that
both lots may 6e used for the construction of a commercial building.

HEARING ON ZONING ORDINANCE AMENDMENT ZOA #78-06, QY G. W PASCHKE
NE FROM M-2 TO M-1 SOUTHEAST CORNER OF MAIN STREET AND 77TH AVENUE

Mr Sobiech, Publtc Works �irector, stated th�s is a request to rezone property
from M-2 to M-1 along 77th Avenue to the east of Main Street
The Planning Commission at their July 12, 1978 meeting d�d recommend approval
of the rezoning.
Mr. Sobiech stated the rezoning would follow the development that is taking
� place along Ranchers Road.
Councilman Hamernik questioned the drainage and Mr So6iech stated this has
been worked out with the petitioner.

Councilman Fitzpatrick. Upon a voice vote, all voting aye, Mayor Nee declared

TS RE: TREE REMOVAL - MR. BAILEY TILLER•
Mr. Qailey Tiller asked the Council when he was going to be paid for the
trees that were removed from hts property. He stated the tree which was removed
was not diseased so it should be replaced.
Mr. Tiller also felt the Council Chambers should have another speaker system
so people can hear what is sa�d. He stated, even w�th h�s hearrng a7d, he
missed the item on the tree removal assessment.
Mr. Tiller requested, since the City has a nature center, they should see
the the animals are taken care of and this year they are badly in need of food.
PUBLIC HEARING ON 1979 CI7Y BUDGET IfVCLUDING AMOUNTS TO BE BUDGETED FOR REUENUE

MOTION by Councilman Schneider to waive the reading of the Public Hearing
notice and open the Public Hearing. Seconded by Councilman Barnette. Upon a
votce vote, a11 vottng aye, Mayor Nee declared the motion carried unanimously
and the Publ�c Hearing opened at 9:�� p.m.
Mr. Qureshi, City Manager, stated beginning in March, department heads are
requested to provide information and recommendatlons to the Clty Manager as
to the needs of their department. He stated it is then the City Planager's
responsibility to review this rnformation and work, under the direction of
the Council, to prepare the budget.
Mr. Qureshi stated this year the City took the approach where each department
was given an opportunity for Council to review their operations He stated
the budget was reviewed at numerous Council conference meetings and the needs
of the departments were discussed. He stated, from these meetings, the budget
was reviewed and modified and is now before the Counc�l and public for thetr
information and input.
Mr Qureshi stated, when the department heads submttted their budget recommen-
dations, they were requested to list their prtorities in the event there
were budget cuts, the Council would be aware of the areas they emphasized or
de-emphasized.
� Mr Qureshi then reviewed the three phases of the budget which included the
est�mated revenues, appropriations, and the areas covered by revenue sharing
funds. A breakdown was subinitted on how the funds were allocated by function
and department
Mr. Quresh� stated this budget pro�ects 14.97 mills which is slightly lower
than the 1978 levy. He pointed out, however, the levy is not the same due
to the change in the assessment formula He stated the approach has been,
basically, to sustatn thetr level of services and have a stable mill levy

Mr. Herrmann, City Assessor, stated one mill produces �156,000.
Councilman F�tzpatrick asked the total assessed valuation on which this mill
levy is based.
Mr. Herrmann stated about �156,000,000, 6ut this is not final, as yet, since
the City doesn't know how much will be taken out for fiscal disparities.
Mr. Herrmann stated the Ctty's loss last year for fiscal disparities was about
$6,0OO,ODO.
Councilman Fitzpatrick questioned the difference rn assessed valuation this �
year as compared with last year Mr. Herrmann stated about $10,000,000.
Mayor Nee asked if anyone would like to address the Council regarding the
budget.
There was no response from the autlience.
MOTION by Councilman Hamernik to close the Public Hearing. Seconded by
Councilman Schneider. Upon a voice vote, all voting aye, Mayor PJee declared
the mot�on carried unanimously and the Public Hearing closed at 9.20 p.m,
Councilman Schneider complimented the staff for the excellent �06 of preparing
this year's budget
Mr Qureshi stated he wished the public would take more interest, as they do
on a day-to-day basis, and also submit their input at the public hearing.
NEW BUSINESS.
RESOLUTION N0. 92-1978 CDNFIRMING ASSESSMENT FOR STORM SEWER IMPROVEMENT
MOTTON by Councilman Schneider to adopt Resolution No. 92-1978. Seconded
by Councilman Barnette.
Councilman Schneider noted some minor changes would have to be made in �
Items 3 and 4.
M�° 6runsell stated the word "except" would be eltminated in Item 3 and
under Item 4, the word "None" wou7d be filled in.
UPON A VOICE VOTE TAKEN ON THE ABO�E MOTION, all voted aye, and P1ayor Nee
declared the motion carr�ed unanimously.

Mr. Qureshi, Ctty Planager, stated the County has been us�ng the City facilities
qutte heavily and, therefore, an increase is pr000sed in the lease agree-
ment. Mr. Qureshi stated the County staff indicated they wou1d recommend
to the County Board of Commtsstoners that the new rates be accepted
as they felt it was reasonable
