THE MINUTES OF THE PUBLIC HEARING MEETTTdG OF THE FRIDLEY CITY COUNCIL OF
NOVEMBER 13, 1978
The Put�lic Hearing Meeting of the Fr�dley C�ty Council was called to
order at 7:32 p.m. by P�ayor Nee.
PLEDGE OF ALLEGIANCE:
Mayor Nee led the Council and audience in the Pledge of Allegiance to
the Flag.

ADOPTION OF AGENDA.
Mayor Nee, Councilman Fitzpatrick> Councilman Hamernik,
Councilman Schneider and Councilman Barnette

Mayor Nee stated the City staff has requested that two items be added:
(1) Authorizing up to $100 for a Plaque for Grace High School for foot-
ball championship and; (2} Approval of letter from Mayor Nee to Mayor
of Fourmies, France.
MOTION by Councilman Schneider to add an item authorizing up to $100 for
a plaque for Grace High School to the agenda. Seconded by Councilman
Fitzpatr�ck. Upon a voice vote, all voting aye, Mayor Nee declared the
motaon carried unanimously.
MOTION by Counci7man Hamern�k to add an item approving a]etter from
Mayor Nee to Mayor of Fourmies, France,and to adopt the agenda w�th the
two additions. Seconded by Councilman Schneider. lJpon a voice vote,
all voting aye, Mayor Nee declared the mot�on carried unantmously.
APPROVING STATEMENT OF CANVASS OF ELECTION FOR THE NOVEMBER 7, 1

The City Attorney, Virgil Herrick, outlined the information covered in
his memorandum of November 13, 1978 to the City Council regarding the
obligation of Che City Council acting as a Canvassing Board.
The City Clerk, Marvin Brunsell, summarized the election process in-
dicating that al] elect�on judges go through training by the County
Audttor's Off�ce and also training by the City Clerk's off�ce regard-
ing the conducting of the election.
Councilman Schnieder inquired why the information regarding the miss�ng
6allot is not in the summary report they have The C�ty Clerk ind�cated
that all such �nformation is marked hy the election judges on the forms
provided to them, and the summary provided to the City Council is
merely a concise report for their quick review. He then passed out
the computer printout sheets to the Councilmembers.
An inquiry was made by the City Council regarding what happened to the
spoiled ballots. The City Clerk �ndicated that those, along with all
the other 6al7ots, are kept �n the Anoka County Aud�tor's Office �n
sealed boxes.
Councilman Barnette inquired regarding the under-vote and over-vote in-
formation The C�ty Clerk explained that under-votes develop when
people do not vote for certa�n off�ces on the ballot, and the over-votes
occur when people vote for more than one person for the same office.

A citizen, Mr. Robert Pierce, addressed the Council and �ndicated that
the State has a rule that if a election is closer than 100 votes, there
is an automatic recount. He asked if the City had any kind of rule of
this type, and if they don't,should there be such a rule adopted by the
City? The Mayor responded that it would be appropriate for the Charter
Commission to initiate such a recommendation.
There also was a discussion re9arding absentee ballots and how the in-
formation from a6sentee ballots is transferred onto computer punch cards,
� and whether the computer punch cards on which the absentee ballot �n-
formation is transferred can be identified or not.
, Mayor Nee, Councilman Schneider and Barnettz all lndicated that they are
in an uncomforta6le position to certify such a close elect�on, but as
per the advice of the City Attorney, unless there are any obvious ir-
regularities in the election, they have no choice but to approve the
Canvass of Votes. Councilman Fitzpatrick ind�cated tYiat it seems that
�vhether the Canvass of Votes is approved or not, it has no effect on
the remedies available to the candidate for a recount. The City Attorney
responded that this was essentially true with the consideration by the
Council that there were no obvious improprieties or errors in the election
process.

Seconded by Councilman Schneider. Upon a voice vote, all voting aye,
Mayor Nee declared the motion carried unanimously.
UP TO $100 FOR A
ONSHIP.
Mayor Nee �nd�cated that as the Ctty has appropriated monies to provide
a plaque for recognition of Fr�dley Nigh School's Football team winning
the champ�onship, it would be appropriate to do the same for Fridley
Grace Htgh School.
MOTION by Councilman Schneider to appropriate up to $100 from the
cont�ngency fund for a plaque recognizing the Fridley Grace High School
Football team for winning the State Class A Championship because it
does bring honor and recognition to the City of Fridley. Seconded by
Councilman Barnette. Upon a voice vote, all voting aye, Mayor Nee de-
clared the motion carried unanimously.
APPR011AL OF LETTER FROM MAYOR NEE TO MAYOR OF FOURMIES, FRANCE:
The Council reviewed the letter wr�tten by Mayor Nee to Mayor Fernand
Pecheaux of Fourmies, France, stating that the City will pursue
appropriate avenues to enhance the Sister City Program.
MOTION by Councilman Schneider to appr�ve the letter from Mayor Nee to
the Mayor of Fourmies, France, regard�ng the S�ster City Program.
Seconded by Counctlman Hamerm k. Upon a voice vote, all voting aye,
Mayor Nee declared the motion carried unanimously
ADJOURNMENT:
MOTION by Counc�lman Hainernik to ad,7ourn the meeting Seconded by
Councilman Schnetder. Upon a voice vote, all voting aye, Mayor Nee
declared the motion carrted unanimously and the Publ�c Hearing
Meeting of the Fridley City Council of November 13, 1978, ad,7ourned
at 9:00 p.m.
