This project involves the construction of water and sewer lines and services in the area of 61st Avenue from East River Road to Ashton Avenue. The assessment rates are, as follows: WATER .LATERAL The cost per front foot for water main is $14.04. SEWER LATERAL 1'he cost per front foot for sewer main is $7.49. WATER SERVICES The cost per water service is $325.44. SEWER SERVICES The cost per sewer service is $223.87. "Gross System Revenues" shall mean any and all compensation or other consideration collected or received or in any manner derived by the company or any subsidiary, holding company or subsidiary of said holding company, from the operation of its cable television service, including but not limited to advertising, merchandise sales, leased channel fees and origi- nation or access cablecasting operations for which a per-program or per- channel charge is made, within the corporate limits of the City of Fridley. 405.05 Payment to the City On or before A ril 1 of each ear followin the commencement of cablecast- ing, the company shall pay to the City a use fee equal to five percent 5% of the annual gross system revenues received by the company for services �rovided within the City durinq the precedinq calendar year. This fee payment shall be in addition to anY other tax or payment owed to the City by the company. In the event that anv payment is not made by April 1 as provided above, interest on the amount due shall accrue from such date at the annual rate of 125% of the lowest "Prime" commercial lending rate established by any Fridley bank at the time delinquency occurs. Upon the petition of the company and a showing that it is in the public interest to do so, the City Council may, by a 4/5 affirmative vote, waive collection of all or any part of that portion of the payment required by this section that is attributable to compensation received by the company froa� its cablecasting operatioi}s for which a per-pro�ram or per-channel charge is made. 3 , NUMERICAL ORDER OF PROPOSED CABLE TELEVISION ORDINANCE AMENDMENTS 405.051 Use Fee Dedication All monies received b� the City from the company under Section 405.05 of s ordinance shall be segregated from the General Fun City for purposes of CATV re ulation and other activities directly re- lated to achieving the public purposes for which this Franchise is rant- ed. 405.06 Audit At the time of its annual use fee pa ment the companv shall file with the C�ty a detailed financial statement prepared by a Certified Public Account- aiso t�le any turther financial information in regard to the company, its subsidiaries, its holding company or its subsidiaries which may be re uir- ed by the City Manager to assure compliance with the terms of this Ordi- nance. 405.251 Additional Services On or before the first da of April, 1979, and on or before the first day of April of each succeedin ear, the company shall submit to the City Council a plan for the comin ear's operations which shall contain the following information: � 1. The proposed number ofi channels to be provided and the allocation of those channels to specified uses, includ- ing proposed number of channels to be devoted to network affiliated television stations, non-network independent television stations, including educational television sta- tions, and channels to be devoted to locally originated programs and leased channel uses. 2.� An estimate of the total number of cablecasting hours per week per channel which the company proposes to devote to local programming, and a general description of the types of local programs it proposes to ori �'c� nate. � 3. A description of its proposed advertisin pro ram. 4. A statement of the use and availabilit of channels and facilities by local political candidates. 5. A description of any plan for providinq a duplex s stem and FM multiplex stereo and music channels. 405.252 Studio Facilities The con�pany shall construct, maintain and operate a color studio and pro- duction facility within the City limits. At the request of the City Council, the company shall submit to it }�s a plan for � ee�e�-s�a��e �e-�e-Eeps���e�e�-w��b��-�be-s}�y. �b}s-��ap-sqa��-}�E�a�e-��e�s-s�e� as, this facility which shall include a description of studio size, type of facility, technical equipment, hours and time it will be operated and estimated construction or reconstruction time. 'The City Clerk has with the assistance of the engineers heretofore selected by this Council for such purpose, calculated the proper amounts to be spec- ially assessed for the • . WATER AND SANITARY SEWER IMPROVEMENT PROJECT N0. 126 in said City against every assessable lot, piece, or parcel of land in accordance with the provisions of law, and has prepared and filed with the City Clerk tabulated statements in duplicate showing the proper description of each and every lot, piece, or parcel of land to be specially assessed and the amount calculated against the same. 2. Notice has been duly published as required by law that this Council would meet`i.n_special session at this time and place io pass on the proposed assessment. . 3. Said proposed assessment has at all times since its filing been open to � inspection and copying by all persons interested, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessment, or to any item thereof, and no objections have been filed, except 4.
