PLEDGE OF ALLEGIANCE: Mayor Nee led the Council and audience in the Pledge of Allegiance to the Flag. ROLL CALL: MEMBERS PRESENT: Councilman Barnette, Councilman Schneider, Mayor Nee, Councilwoman Moses and Councilman Fitzpatrick MEMBERS ABSENT: None APPROVAL OF MINUTES: PUSLIC HEARING MEETING, SEPTEMBER 17, 1979 MOTION by Councilwoman Moses to approve the minutes as presented. Seconded by Councilman Fitzpatrick. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. REGULAR MEETING, SEPTEMBER 24, 1979 MOTION by Councilman Schneider to table this item until the next meeting in order that the Council may have the opportunity to review these minutes. Seconded by Councilman Fitzpatrick. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. OPEN FORUM, VISITORS: Ms. Lee Ann Sporre appeared before the Council regarding a meeting on the subject of the airport and Highway 10 on Wednesday, October 17, 1979, at the Northtown Center Community Room at 7 p.m. She urged the Council mem- bers to pass the word around about this meeting, as she felt it was vital to the public interest. Ms. Sporre distributed a copy of an article which appeared in the Minneapolis Tribune on I�larch 5, 1968, entitled "Anoka County Airport Urged as Major Facility". She requested the Council to re- ceive this into the record as the article contained a map which showed the existing site of the Anoka County Airport and the proposed expansion area. Councilman Schneider asked if there have been any more official meetings regarding the airport. Mr. Qureshi, City Manager, stated if staff receives any such information, it would be passed on to the Council. OLD BUSINESS: ORDINANCE N0. 701 AMENDIN6 CNAPTER 405 ENTITLED CABLE TELEVISION FRANCHISE. � MOTION by Councilman Fitzpatrick to waive the second reading of Ordinance No. 701 and adopt it on the seccnd reading and publish. Seconded by � Councilman Schneider. " j Councilman Schneider noted that this ordinance does not contain the two additional amendments proposed by the cable television company. Mayor Nee stated that he felt these two proposals sho!�ld be processed through the Cable Television Commission. NEW BUSINESS: ORDINANCE N0. 702 ADOPTING TNE BUDGET FOR THE FISCAL YEAR 1980: MOTION by Councilman Fitzpatrick to waive the second reading of Ordinance No. 702 and adopt it on the second reading and publish. Seconded by Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unani- mously. � CONSIDERATION OF A REQUEST TO BUILD A STEEL BUILDING GARAGE FOR AN EXISTING HOUSE AT 7748 ELM STREET IN A NON-CONFORMING INDUSTRIAL AREA: Mr. Qureshi, City Manager, stated this is a request to build a garage at 7748 Elm Street and the property is a non-conforming use and expansion of a non- conforming use is prohibited. Mr. Anderson, the applicant, appeared before the Council regarding his request. He stated he is in need of a garage which would be 30 x 32 feet and of steel construction so it could be taken down. He stated he has been waiting 25 years for someone to buy him out, but it hasn't happened and that he needs this garage for greasing his vehicles. Mr. Herrick, City Attorney, stated the property is zoned industrial and if a new structure or enlargement is to be placed for residential purposes that is expanding a non-conforming use as, he understands, the property is not sufffcient in size to qualify for an industrial building. Mr. Anderson stated he had the property zoned industrial, but didn't believe he couldn't put up a garage. Councilwoman Moses pointed out in other industriai areas, fencing is required for items that are stored and in Mr. Anderson's case, all his trucks are out in the open. Councilman Barnette stated Mr. Anderson has the situation where there is a home site in an industrial area and is requesting approval to put up a structure in order to do some work on his trucks. He questioned why this couldn't be done. Mr. Herrick, City Attorney, stated the property is not properly zoned to expand for residential purposes and is not large enough for industrial purposes. He felt the only possibiiity Council could consider was if they treated the_garage as an industrial building and then variances would have to be granted. Mr. Herrick suggested this item be tabled to the next meeting in order to review the matter further. MOTION by Councilwoman Moses to table this item to the next meeting on October 15, 1979. Seconded by Councilman Barnette. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. CONSIDERATION OF A REQUEST TO ENCROACH 1.04 fEET ON A DRAINA�E EASEMENT AT 6249 BEN MORE DRIVE: PlOTIOfJ by Councilman Schneider to appi°ove the encroachment of 1.04 feet into a drainage easement at 6249 Ben More Urive. 5econded by Councilman Qarnette. RECEIVING APPEALS COMMISSION MINUTES OF SEPTEMQER 18, 1979 I _ _ _._ � 276 REGULAR MEETING OF OCTOBER i, 1979 Page 3 Mr. Qureshi, City Manager, stated this property presently protrudes into the front yard and the owner wishes to screen in for a porch which will make the front of the house a straight line. Ms. Landis, the petitioner, appeared before the Council regarding her request. She stated the house has a jog in front and felt it would be nice to screen it off for a porch. She stated it is on the north side and felt this might also give extra protection against the wind. Mr. Russell Tenney, 528 Janesville Street, a neighboring property owner, stated he had no objection to Ms. Landis' request. Ms. Landis stated she spoke to the Schommer's and they had no objection as long as she wasn't going any closer to the property line. Mr. Larry Korzenowski, 529 Janesville Street, stated he objected to the variance as the building is only 22 feet from the street. He stated it is eye-catching as you go down the street. He fe}i it was really too close to the street and more structure would also increase the eyesore and not prove any useful purpose. Mr. Korzenowski felt the property is in such a state of disrepair and a porch would be detrimental to the whole street, if it is kept up the same as the rest of the house. Councilman Fitzpatrick stated in Mr. Korzenowski's reference to "more structure", he pointed out there is a structure there now and the proposed structure does not come up any further. Councilman Fitzpatrick stated he felt it was a reasonable request. He stated it is close ta the street, but he envisions the closing in of that area isn't going to encroach into the front yard or street any closer than it is now. He pointed out there are several homes on this side of the street that are cer- tainly less than 35 feet from the street. Councilman Fitzpatrick stated he is not totally unsympathetic with �1r. Kor- zenowski's suggestion, but didn't feel screening this in would make that much difference and that it was a reasonable request by the petitioner. Mr. Herrick, City Attorney, stated what is the question of hardship and whether case. He felt one question that may be be put on the back of the property. the Council should address itself to there is something unique about this pertinent is if the screen porch could Ms. Landis stated it would be a little awkward to get back there as there is a large tree and an entrance in the back to get to the water heater and the pipes. � Councilman Fitzpatrick felt the question of hardship is pretty much in the eye of the beholder. He pointed out that the petitioner noted there is a large tree located in the back of the property and the situation isn't ihe same for locating the porch in the back of the house as it is in the front of the house. MOTION by Councilman Fitzpatrick to approve the variance request to reduce front yard setbacks from the required 35 feet to approximately 18 (+/-) to allow enclosure of two sides of existing structure for a 10 x 16 foot screen porch, as requested by Rosemary Landis, 530 Janesville Street. Seconded by Councilman Barnette. Councilman Fitzpatrick stated he felt the request was reasonable and indicated he was not totally unsympathetic with Mr. Korzenowski, but didn't feel that if it is extended, it gives the appearance of encroaching more on the street . Mr. Korzenowski stated, as it stands now, it is not a pleasant structure to look at and felt this is just going to add to it. __l ( 277 REGULAR MEETING OF OCTOBER i, 1979 Page 4 Mayor Nee stated his reaction is that there isn't rationale to meet the criteria of a hardship. The premise for the variance is that.there is no other practical way to use the land and really wasn't intended for this sort of thing. UPON A ROLL CALL VOTE TAKEN ON THE MOTION, Councilman Fitzpatrick, Councilman Barnette, and Councilman Schneider voted in favor of the motion. Mayor Nee and Councilwoman Moses voted against the motion. Playor Nee declared the motion carried by a 3 to 2 vote. VARIANCE REQUEST TO REDUCE FRONT YARD SETBRCK fROM 35 FEET TO 27.2 !._, FEET TO ALLOW AN 8 x 20 FOOT_ ADDITION TO EXISTING ATTACHED GARAGE,_ Mr. Qureshi, City Manager, stated this request for a variance of the front yard setback was heard by the Appeals Commission and resulted in a tie motion by the Corrgnission. Mr. Johnson, the petitioner, appeared before the Council regarding his variance request. He stated, if they built the addition to the back of the property, there is no feasible way to get to the back as they would have to go through their dining room or kitchen area. They felt the proposal to buiTd to the front would be best as they could go out through the garage. Councilwoman Moses stated she visited with Mrs. Johnson who showed her their plans. She felt, from a re-sale value, you typically will find a family room behind the garage and usually adjoining an eating area. Councilwoman Moses stated, from her thinking, to have the family room come off the back of the house into an eating area would make the property more valuable, rathQr than having a hallway to the family room. She questioned if this possibility had been explored. Mr. Herrick, City Attorney, pointed out that variances to the ordinance are to be granted where, because of some unique situation, as far as the property � is concerned, an unnecessary hardship would be caused on the people living � there. Councilman Schneider asked if the family room couldn't be located in the back of the house and, therefore, no variances would be needed. Mr. Johnson stated the eating area in the kitchen is very sma]1 and if this was done, they would have the traffic around the table. Councilman Schneider felt, in this particular case, to grant the variance would be for a convenience factor and he is not comfortable, in his own mind, that a hardship can be just9fied. He stated, in the previous case, which was heard just before this request, there is a house that is already encroaching on a lot line and it appeared the porch being placed in another area created access problems Mr. Johnson stated he has an entrance to the front and didn't want to tear up the rest of the house. Councilwoman Moses stated she didn't want to prevent Mr. Johnson from having a family room, but, in her own mind, she felt that something could be planned for an alternative to build out the back of the house. MOTION by Councilwoman Moses to deny the variance request for Mr. Johnson, 7476 , Melody Drive. Seconded by Councilman Schneider. � Mayor Nee stated he would be uneasy granting the variance in Melody Manor and would see nothing but a flood of requests and all kinds of encroachments. Councilwoman Moses stated s�he had the same problem as this was the first re- quest they had for a variance in Melody P1anor and felt it would also set a precedent in that area. Seconded by Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. CONSIDERATION OF AUDITING SERVICES FOR THE YEAR ENDING DECEMBER 31, 1979: Mr. Brunsell, City Clerk, stated a letter was received from the George M. Hansen Company inquiring as to whether they could do the City's audit for the year ending December 31, 1979. He stated that this company has done the City's audit in the past and the City was well satisfied with their performance. Mr. Brunsell requested the Council take into consideration the request from the George M. Hansen Company. MOTION by Councilman Schneider to name the George M. Hansen Company to conduct the auditing services for the year ending December 31, 1979 due to the past performance of their work for the City. Seconded by Councilman Fitzpatrick. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unan- imously. RESOLUTION N0. 110-1979 CERTIFYING CHARGES TO THE COUNTY AUDITOR TO BE LEVIED AGAINST CERTAIN PROPERTIES FOR COLLECTION WITH THE TAXES PAYABLE IN 1980 WEEDS): MOTION by Councilwoman Moses to adopt Resolution No. 110-1979. RESOLUTIOW N0. 115-1979 RELATING TO SAFEGUARDING OSI'S COPYRIGHTS (LOGIS): Mr. Brunsell, City Clerk, stated, under the programs themselves, the City doesn't have access to them and this is principally to svhat the resolution refers. Mr. Brunsell stated there are some data elements in the manuals, but they don't have the actual program. He stated the City does give reports to other cities, but this isn't something that has the OSI label on them. Mr. Herrick, City Attorney, stated he would be uncomfortable if the City is taking upon themselves that any information it is given does not get into a third party's hands. , � ( i . I i ( Z? 9 REGl1LAR MEETTNG OF OCTOBER ], 1979 PAGE 6 Mr. Brunsell stated the City Attorney hasn't had the opportunit,� to review this information and it could be tabled to the next meeting. He explained, however, that Mr. Willard, Executive Director of LOGIS, is handling the details in the dealings with OSI and is recommending this to the City. Mr. Herrick questioned if Mr. Willard was comfortabTe with this resoiution. Mr. Brunsell answered in the affirmative and stated he himself had raised a • . few questions with Mr. Willard, but they didn't understand why the City had � any concern since Fridley was the only City that did raise some questions. Mr. Herrick, City Attorney, felt the language isn't that binding. As he pointed out, it is probably a violation of the law if the City doesn't release all.material they have to the public. He stated one of the sections seems to state that the City is not to copy their material unless it has their copyright on it. He felt, basically, they were trying to safeguard material from falling into the hands of unauthorized people. Mr. Herrick stated he wouldn't object to signing the resolution as he felt satisfied the City wouldn't get into a problem of liability. - Mr. Brunsell, City Clerk, pointed out the City has very iittle information that could be considered copyrighted information, with the exception of the listing of data elements and other similar information contained in the users' manual. BRUNSELL DATE; OCTOBER 17, 1979 RE; CHANGE IN LiCENSE FEES FOR SINGLE MULTIPLE DWELLINGS The Council recently took action to adjust the license fees for three or more rental units and to include the licensing of one and two rental units for the first time. We have had numerous calls from people with single rental units who object to paying the $20 fee. In contrast, we have had no complaints that I am aware of from owners of three or more rental ur�its. Although the $20 fee for one or two rental units could probably be justified on a cost liasis, the $20 fee does hit the owner of a single rental unit particularly hard. 2'his is particularly true when comparing the cost of single rental units to per--unit cost of larger units. I am therefore recommending that the City amend the fee schedule to provide for a$10 for single rental units, rather tYian $2�. The $20 fee would remain in effect for two rental units. Mr. Langenfeld said the one thing he liked about-a special use permit was the fact thaL- if someone came before them wi_th a somewhat questionable request, the commission could place con�rols and stipulations on the requ�s�. Public purpose served is to provide open space for off-street parking without encroaching on publi� right of way. ��Also for the aesthetic consideration not to reduce the "building line of sight" encroachment into a neighbor's front yard. B. STIITED HI�RDSIiIP: "To be in line wi.th other homes and to allow room for back yards." C. ADAIINISTRATIVE STI�'F REVIEW: Tiiese three lots are all on the sautherly gide of the cul-.�e-.sac joining Kerry Lane and Rice Creek Drive. The other lots, surrounding these three, have varying setback�s; Loi� 3 has a 26.55 verified setback; Lot 4 has a 50 foot setback; Loi� 6 has a 40.33 ver_ified setback; and on the east side of I.nt 1 theLe is a 38.4 setback. The visibility of tYie differences in setbacks is some�,�hat eliminated by fihe cul-de-uac and cuzve of the streets. The useable back yard area would be increased with approval of the variances as the back of the land is quite steep. Ms. Schnabel asked Darrel Clark if he had any further comments to make on this item. Mr> Clark said no, he felt the attached map should answer any questions. Mso Schnabel said with all the various numbers and writings on the map, it gets a li ttle confusing, and asked Mr. Clark to go over the area. Mr. Claxk said the existing home on Lot 6 was setback 40 feet, the proposed home on Lot 5 would be bacic 25 feet. The home, under construction, on Lot 4, was setback 50 feet. Lot 3 had a previous variance granted fox a 26.5 foot setback. The proposed home on Lot 2 would have a 30 foot setback and a 25 feet setUack on Lot 1. He pointed out the house left of Lot 1 and not on the diagram was setback 38 feet. Ms. Schnabel asked the petitioner, Mr. 0'Bannon, for comments. He said the drawing sets up what he proposes. He has set each house step by step around the cul-de-sac. He said Lot 5 will have a small backyard because of a steep 0 APPEALS COMMISSION MEETING, OCTOBER 9. 1979 • PAGE 3 drop-off on the lot. Both Lots 1 and 2 have backyardsthat go into a cliff. Ms. Schnabel said she was not aware of the dxop-off on Lot 5. Mr. Kemper asked where the house to the east of Lot 1 was placed in comparision with the proposed home on Lot 1. Mr. 0'Bannon said the garage of the house east of Lot 1 would line up wiCh the outer- most front edge of the proposed home on Lot 1. Mr. Clark scaled the home home locaCion for the Commission. Mr. Kempex said Mr. d''Bannon does have a hardship. There was a drop-off on Lot 5 and both Lots 1 and 2 have a cliff in the backyard. The house on Lot 3 had a similar request about a year ago. He felt Mr< 0'Bannon had been able to compromise lining up the homes on the cul-de-sac and has done a good job of making them look nice. Ms. Schnabel said she was concerned about the setback on Lot 5, The garage on Lot 6 was setback 40 feet, with the house back even further. She thought the setback on Lot 5 could be more then 25 feet. There are no windows on the home on Lot 6 on this side, but there was a deck, so the placement should not bother them. On Lot 4, there was a window in the front portion, but even that should not create a visual problem. Mr. Kemper asked how much room was in the backyard if the proposed home was setback at 25 feet. L�liJ Mr. 0'Bannon said there would be a 25 foot backyard. Ms. Gabel asked if the drop-off would:be:terraced. Mr. 0'Bannon said they are planning on leaving it in its natural state. Mr. Kemper suggested discussing each lot separatly. Mr. 0'Bannon explained he sighted the house on Lot 1 with the one to the east, that was how he came up with the 25 foot setback, Mr. Kemper said the line of sight looked okay Uetween the 3 houses on Lots 1 and 2 and the one to the east. He felt there were no visual problems and had no•objections to the setbacks for Lots 1 and 2. Ms. Schnabel said she understood the bacicyard problems on Lot 5, but did not like the idea of having this house so much closer to the street then the neighboring homes. Mr. 0'�annon said the house on Lot 4 was not setback 50 feet, it was closer to 45 feet. � He also said when placing a home on a lot in this type of a situation, he t?-ies to place it in the middle of the neighboring.homes. You would not want Lot 5 to be Lot 6's bacicyard . . Ms. Schnabel said that was true, but there were no �aindows on this side of Lot 6. Mr. 0'Bannon said there was a deck located there. r i■ 6C APPEALS CONIMISSION MEETING, OCTOBER 9, 1979 PAGE 4 Ms. Schnabel asked if there were any comments from staff regarding the setback. She understood, when talking to the Planning Department, there had been a comment made. She was refering to the staff review sheet. Mr. Clark said the only comment was by Jerry Boardman. He said he did not see any real hardship, but the hillside does cut down the amount of rear yard. Ms. Schnabel. questioned the size of the boulevards. Mr. 0'Bannon replied they are 10 feet on the straight street, and 7 feet on the cul- de-sac street. � Mr. Kemper asked if it would be possible to angle the home on the lot, or would that create a problem with the side yards. Mr. 0'Bannon replied angling the home would create other problems. He stated as the house is proposed, there are no problems with the side yards. He stated a L-shaped rambler would not work because the back of the house would be on the edge of the drop-off. Mr. Barna asked how much the drop-off was. Mr. 0'Bannon stated 15-20 feet. You cannot climb the hill easily. MOTION by Mr. Plemel, seconded by Mr. Barna to close the public hearing. Mr. Kemper said he sees no real problem with the requests, but acknowledges that the Chairperson was concerned about the setback on Lot 5a Ms. Schnabel said her main concern was Lot.S. She felt Lots 1 and 2 would fit in, and there was definitely a backyard problem with the hil7�. I.at 3 was previously granted a.similar variance request and fits into the neighborhood nicelyr so these should also. She had objected to Lot 5`s variance request because first of all, she was not aware of the drop-off in the backyard and secondly, was led to believe there was an objec- t ion by staff on this request. She said when reading the staff review report tonight, she does not detect that and has no problern with it now. Mr. Clark asked Mr. 0'Bannon when he would be buildingo Mr. 0'Bannon stated he would like to dig Lot 5 this fall, but was not sure. He felt one of the lots would be started this fall. Ms. Gabel said she would be concerned about the setback on Lot S ii the street was straight. Secondly, she felt, many variances have had to be granted in this area be- cause of topographical reasons and these requests were consistent with those.. She also felt the area looked very nice. • Mr. Kemper and Mr. Plemel both agreed that Mr. 0'Bannon had done a good job in the area. Mr. Clark said his main concern was that all lots in Shaffer's Addition were the same size prior to this lot being split. But since there were no objections from neighbors, about 2 h�uses on 1 lot,perhaps that was not a real concern. Ms. Gabel said she understood the neighbors had objected to the previous proposal of a double bungalow. Mr. Clark stated that was true. ` Ms. Schnabel said she understood public notices wexe sent out to the neighbors for the lot split that has already been heard before the Planning Commission. Notices are not normally sent out for lot splits. - l�r. Clark said the reason was because the lots would be smaller then the rest of the neighborhood. Ms. Schnabel pointed out the neighbors were properly notified for both the Planning Commission and Appeals Commission meetings ana there were no objections. Mr. Plemel asked if these were factory built homes. Mr. Ted Holsten, 3213 Townview Ave. N.E., Mpls., said no. He pointed out the lot widths are 80 feet, but they would not be as deep as usual. Ms, Schnabel asked if the homes would be built at the same time. Mro Holsten r�plied the builder, Allan Homes, have one possibly sold at the present timeo That one would probably be built first and then the second one would be built. Ms. Schnabel aslced what the homes would lo�k lilceo Mr. Holsten presented a plan of the homes. They are 23 feet X 42 feet, 3 bedrooms, with a detached double garage. The price, with the garage, should be around $55,000. He pointed out the area homes are older, the same size or small.er and there are double bungalows across the street. A single. home on the one lot w ould be too expen- sive for the area. - Ms. Schnabel asked if the soil would be a problem. Mra Holsten said he had not had soil tests taken, but from what he observed by digging down 2 to 3 feet, there should be good firm soil. Some of the trees on the lot will have to be removed to get down to that soil. Chairwoman Schnabel asked for further discus�i.on from the commission. Mr. Kemper said this community needs more inexpensive housing and these should help. He said Lhe petitioner was correct, there was a Catch-22 system here. You build one house on the large lot, you take the home out of the inexpensive range and an expensive home talces it out of the neighborhood. GF APPEALS GOMMISSION MEETING. They thought perhaps staff could draw up some sor� of format for the petitioner to followa Ms. Gabel said she thought when the petitioner fills out the application, staff did not have enough time to properly review the application at that time. Mr. Clark asked if they wanted staff to put woxds in the applicant's mouth. The Commission said no. Ms. Gabel said some hardships do not make sense. For e�ample, "Want Co build a 10 x 20 foot addition." What type of hardship was that. Mro Clark stated a hardship would be different for each request. Ms. Schnabel said they have received a memo recently stating that economic feasibility could be considered. Mr. Kemper asked if the staff reads the application immediately to see if .it make sense. How can they do that if- it was not stated. Ms. Gabel pointed out the commission finds out the hardship through the discussion � with the petitioner at the meeting, but it was not noted on the application as such. Mr. Boardanan told the Planning Commission when considering this item, that it was very -important to consider planning for the whole district. The entire area was quite large with many undeveloped lots. He stated other landowners in this area have contacted him regarding the question of lot splits. His two main questions were how to get access to all of this land and what kind of use the land would service Fridley best. He realized Mr. Bauler only wants to split off 60 feet, but this would make the lot substandard in width and a very deep lot. This lot c�uld become landlocked in the future. When planning we have to look at 15 to 20 years dawn the road. He realized this will put a burden an Mro Bauler now. The City already has a 30 foot road right- of-way along�Mr. Bauler`s lande This was platted many years ago on the old Irvington Addition. All the streets and alleys in the area have been vacateda The Ci.ty would have to obtain an additional 30 feet to make room for a road. Mr. Boardmar. recommended denial of the lot split. Mr. Harris sazd the reason for continuing this request was the question of access to the rear properties, plus, to find out what the other property owner's intents where. Mxo Boardman said they did not ask each o�,mer what their intent was, because perhaps in 5 years from now they may sell to a developex and we have to plan for that now. Mro Harris said they were also looking for some sort of a plan for this area. Mro Boardman said this was what he did on his proposed road plan and lot plan. Because of lack of time, everything �aas not planned from an engineering standpoint, but tha plan as far as a road system, lot division and lot size was feasible. He asked if we do this split now, what problems are �ae creating down the line. He recommenc:ed denial because the lot would be too narrow. It would be only 60 feet wide, which was substandard And that has never been allowed before. If the commission olcays the lot split, it would be saying the lot was buildable, which was not tr�e. Mr. Harris asked if the terrain was too steep for roads. Mr. Boardman said there are variations in the terrain, but there are low points which are fairly level and could be serviceable. The proposed plan was about the best one for xoad access and creating lots. -' . Ms. Gabel pointed out on the p�riposed road plan, some houses w"ere in the way. .She questioned what happes to them. . , Mr. Boardman replied this road plan was not definite. It may have to be moved around for those homes, some lots made smaller or larger or if the price was right, the developer would purchase the hom�sand relocate them. Ms. Hughes asked how many property ownexs were affected. � Mr. Boardman said the land was owned by 9 homeowners and they eact� have a large amount of land. He then showed a map of �ach homeowner's land. Mr. Boardman suggested to Mr. Bauler to sglit off some other area of his land. _ Mr. Bauler•, 1420 Rice Creek Road, said he has a bizyer for this land already and he did not want to sell anymoxe of his Iand. � . Mr. Boardman said this neighbor would be able to put in his tennis court, w ith this- lot split and then split off his original land and sell. He has seen this happen before. ilr. Bauler would then be left with inaccessi ble land on his back property.� � Mr. Rabert Barnette, 54I Rice Creek Blvci., spealcing as a frierid for Mr. Bauler, pointed aut the only reason Mr. Bauler was selling was because of financial need. He said if he sold this 60 feet to his neighbor, ultimately the tennis court would go in, and when the road was needed, it would be part of the neighbor's land that woulc3 be condecnned. The burden would be on the purchaser of the property, not on Mr. Bauler. It would be up to the neighbor to settle on.the cost of this lot, not Mr. Bauler. The burden should not be on the petitioner because of something 20 years down the road. . Mr.. Boardman said the buxden was on the City, because they would be saying the lot split was buildable and it was not. . Mr. Harris said he did noi: see how the Planning Commission could approve a lat split for this size because it goes against the ordinance. Mr. Bauler said he did not want to se�l off more of his land closer to his house. That was all part of his home and he had lived there since 1938. .. Mr. Harris said there have been no lot splits o� le�s than 75 feet since 1966. Mso Gabel asked if CoC, would buy another configuration of his land. �he Com�mission tried to work out various �aays to split the land, but because of�needed xoad right-of-way and future land development, nothing was feasible. This lot would be more valuable then the original request, somewhere in the area of $15.. - 16,000. This lot would also meet all the requirements. An easement would be given for future road -right-of-way to give access to the land to the rear. This split would stillleave Mr. Bauler the land around his home and allaw him tv do what he wants with it. Mr. BarnetCe pointed out that �h�.neighbor was not;interested in,tt�is land. He also stated he has had some discussions with the Metro- politan Council on the number of units to be made available in a 10 year period. The Council now feels it cannot requixe a community to build X numbex of homes in 10 years if the redexal inonies axe not available. They now look at a 3 year period and say we have so much money that can be granted to a community and therefore the units w ill be built according to the monies available. This does not change the goals or objectives of tlie Comprehensive Plan, but wi�l change some numbers in the implementation process. ' � I � PI.ANNING COMMISSION ME�T7NGL OCTOBER 3, 1979 PAGE 5 Mr. Boardman said the Metropolitan Council was an "A95" Review CommiCtee and only made sure the money granted by HUD or Minnesota Housing Finance was used properly. Mr. B�ardman said he had talked to Coon Rapids on the drainage guestion for the new 6 acre development on Hwy. 47 in Blaine. He said he got all the reports, charts, statustics, etc. from the architect firm that was developing this area and was satis- tied that proper controls vn quantity and quality of drainage were being used. They are using a 100 year rain or 24 hour - 6 inch rain; run-off, which was the same re- quired by the Rice Creek Watershed District. The problem now, was there were no present storage controls for run-off. There was a lot of silting in the area and the developer was embarrassed by that. He said they will be cleaning the ditches of this silt in the next 2 to 3 weeks. The quantity of run-off was being controlled and the quality of the water was improving. Mr. Boaxdman stated thexe had been no silting into North Park only the ditches. � Mr. Boardman introduced �he Critical Area Plan that was passed out t'Q the commission. He asked for a Public Hearing on October 24, 1979, to discuss this. Mr. Harris said he noticed a 4 feet x 8 feet yellow sign along the river by 62nd Ave. regarding boats. Mr. Boardman said they are loos�, but those requlations are encompassing the entire river. We help interpret them and then add our own requirements. Ms, Gabel asked hnw we find out if we are consistant with other comanunities on this plan. Mr. Boardman explained the process was to have our City approve the plan first, then send it to our sister communities for approval. From there it goes the Metropolitan Council for approval and on to the Minnesota Environmental Quality Commission. The MEQC looks it over and.sends it back to us to tell us where to change or strengthen our requirements. � � Mx. REPORT FROM OFFICERS: Chairperson Ash stated that he had nothing to report� other than that he wished that the members had a good summer. Mr. Langer also stated that he had nothing to report. Mr. Ash stated that because the Secretary, Jean Schell was absent, there would be n� report from her. 2. NEW BU5INESS: There was no new business ta be brought before the Commission. 3. OLD BUSINESS: A. Report from Subcommittee Members: M r. Ash stated that there were two subcommittees that had met during the summer. He stated that he did receive a report from the one subcommittee. M r. Ash then called upon the chairman � of the subcammittee, D4r. Fierce to give his report to the Commission. September 4. 1979 CHARTER COMMISSION Page 2 $ A M r. Pierce stated that he had copies of this report for the members of the Commission. He then distributed the copies to the members. (See Attachment) M r. Pierce then read the report from the subcommittee with their rationale. Mr. Ash questioned the members of the Commission� after Mr. Pierce had concluded the reading of the subcommittee report, if t hey had any discussion or questions, regarding item 1, 'Recounts in City elections'? M r. Berg questioned as to what the numbers involved were? Mr. Schaaf stated that the State Statue 204A.515 that they referred to, used the following numbers: If there were 100, or fewer vates cast, than 5 votes or less difference between the candidates, would trigger a recount. If there are mare than 100, but less than 500 votes cast. then 10 votes or less would trigger a recr,unt. If there are �00 votes, but less than 2,000 votes cast, 20 votes would trigger a recount. If there were 2,000 to 10�000 votes cast, a 1� figure wauld trigger a recount. If there were over 10,000 votes cast, than 9.00 votes between the candidates wauld -�rigger a recount. M r. Schaaf stated that these figures govern school baard, county, and city elections. � M r. Pierce stated that he had noted that in the Pavlak case, the legisla�ure had vated to pick up the legal expenses. He questioned as to whether the City Council could do the same in a contested city race� as he felt that was a good idea. Mr. Schaaf stated that he felt that with the State Statue 204A.515 the figures there� would eliminate much of any need for legal expense, because you would have the automatic recount, so that a candidate would not have to go into the legal expense of contesting the race. Mr. Schaaf questioned that as long as this is state law� was there a need to have it in the City Charter? �After discussion, it was decided that because man.y people look to the City Charter for guidance� this should be dealt with, and explained in the City Charter. Langer, to�accept the recommendation of the subcommittee� to have the attorney's draft up the proper legal language, to provide for autamatic recounts, as is st�.ted in State Statue 204A.51s for the Charter Commission to approve. Ash stated that this would mean that they would just not deal with it at this time, but that it could be brought back at a later time. Mr. Van Dan, stated that he felt that this type of issue bears debating, and that it should be dealt with. He further stated that he has looked into ways of dealing with it. He stated that the first amendment guarantees the freedom of expressing ones beliefs, but it does not grant the freedr�m from l�bel, or slander, so in that respect, he stated� the Commission could develop this idea further. He stated that as in the "Midnite Flyers", it does not give somebody in a campaign a chance to rebuff. M r. Commers stated that if there was �nything �hat is li belous, or put out malicously, that is always grounds far an unfair camgaign practices charge. Regarding item 3, 'Filling of Counci.l vacancies', Ms. Nagengast questioned that under Multiple vacanci.es� if the City Council would decide as to which vacancy should be filled first. As an example, if there was a Ward 1: and a Ward 2.vacancy, which one would they fill? Mr. Pierce stated that the subcommittee had not discussed that idea. He suggested that they could stipulate that the vacancy ' that occurred first, woul.d have to be filled first. Mr. Schaaf suggessted that they could stipulate that the vacancy that has the quickest expiration date should be filled first. S�mber 4. 19�9 CHARTER COMMISSION Pa�e 4 M r. Starwalt stated that he had some wording that he would like to read to the Commission, so that they ma ybe could arrive at something from this. He then sta�ed that he had written. "appoint additional members to raise the membership to four� and such an appointee� serving until elected� or replaced by a person elected at the next scheduled general election for the unexpired portion of the term. • Mr. Schaaf questioned as to whether the Commission's intention was that if there should be a vacancy� and someone other than the appointed member should win� the election, if their term would begin when they were certified. He stated that if that was the Commissions intention, that he felt that should be claxified in the Charter. Mr. Pierce stated that yes, that had been their intention. M r. Truenfels questioned as to what provision is made, if there were to be a common disaster� and the city is l�ft without any members of the City Council? Mr. Swanson stated that since the Commission was looking at multiple vacancies, etc., he felt that they should look at a provision also to take in the case of not having a City Council as in a common disaster. �e further sta�ed, that many corporations have restrictions on their officers as far as travel, so as to prevent a common disaster. Mr. Pierce questioned Chairman Ash� as to if he would like his subcommittee to call the League of Ci�ies, to see what they would have to say about t17is s�tuation? Mr. Ash stated that he felt that would be a good idea. M r. Van Dan stated that he would like the subcommittee �o also consider Mr. Starwalt's amendment for their consideration. Swanson, that item 3, be returned to the subcommittee with any words that he himself had recommended, an� others tha� they have recommended, plus looking at the pa�t data that has been before the Commission, and bring it back to the Commission for their consideration. Pierce stated that his opinion was to leave the appointee in, until the next general election, but that other members of the subcommittee fel.t that could be too long of a time span. Mr. Ash asked if the other subcammittee chairmen had their reports? Mr. Brennan stated th at no, he did not h ave a report at this time, and he then asked for valunteers for his subcommittee.
