THE MINUTES OF THE PUBLIC HEARING MEETING OF THE FRIDLEY CITY COUNCIL OF
OF �ANUARY 15, 1979
The Public Hearing Meeting of the Fridley City Council was called to order by
Mayor Nee at 7 42 p.m.
PLEDGE OF ALLEGIANCE:
Mayor Nee led the Council and audience in the Pledge of A7legiance to the Flag.

MOTION by Counctlman Hamerntk to adopt the agenda as presented. Seconded by
Councilman Schneider. Upon a vo�ce vote, a11 vot�ng aye, Mayor Nee declared
the motion carried unanimously.
PUBLIC HEARING.
IC HEARING ON FINAL PLAT; PRELIMINARY SUBDIVISION P.S. �78-06. CABA REALTY
MOTION hy Councilman Hamernik to waive reading of the public hearing notice
and open the publtc hearing, Seconded by Councilman Barnette. Upon a voice
vote, all voting aye, Mayor Nee declared the motion carried unaniinously and the
public hearing opened at 7:43 p.m.
Mr. Sobtech, Public Works Director, pointed out the general location of this
plat and that the Plamm �g Commission has recommended approval
Mr. Sobtech stated the plat will consist of 1% acre parcels and stated there
would be appropriate drainage and utility easements along the lot lines. He
stated there are no developments proposed at th�s time for the property, but
�ndicated, w�th future development, provisions must be made for dra�nage and
the method of retention or detention. He pointed out that any potential
developers for this property should be made aware there is a requirement for
drainage retention.
Mr. Sobiech stated he felt, �f developers get together i�, developing this
property, there wouldn't be any problem taking care of the drainage since
the area is large enough.
Councilman Schneider questioned how the drainage would be taken care of, if
the parcels were developed separately.
Mr. So6iech stated, at the �ime the building permtt is issued, it would be
indicated on the permit that the frequency rate of stormwater run-off would not
6e any greater than it was before development.
Counctlman Hamernik felt the Commission wanted the drainage taken care of before
issuance of the building permit. Mr. Sobiech felt thts was dtfficult to do
without develcpment plans.
Mr Sobiech also felt �t could be stipulated, with the plat approval, that any
future development must take tnto account the drainage retention. He stated,
in the past, affidavits have been filed with the plat so that developers are
aware of this requirement.
Mr. Herrick, City Attorney, stated he didn't feel there was a great difference
whether the Council wtshed this drainage requirement to be tied in with the
plat or the building permit. He stated, if the Council feels more comfortable
with havtng a notice filed with the plat, this would be no problem.

Councilman Fitzpatrick stated this part�cular area is an area where the
Environmental Quality Commission �s very sensitive. He felt, even though
the City has taken care of drainage in the past, with the issuance of the
building perm�ts, he thaught �t might be better to recognize the problem
prior to this time and at the time the plat is filed. He felt th7s was an
immediate concern on the part of the Environmental Quality Commission.
Mr. Sobiech stated he would concur with CouncTlman F�tzpatrick's comments
as he felt this drainage requirement would then come to the immediate
attention of potential developers.
Mr. Wormsbecker, the pet�tioner, indicated he was not happy with the drainage
system on the property and indicated they would be w�lling to go along with
the staff's recommendation. Mr. Wormsbecker stated he has a company interested
in development, but it would cost them �9,000 to set up the drainage. He
stated he can see there is a problem with run-off, but is not quite sure how
to handle it.
Councilman Hamernik felt, if the matter of drainage was handled for the entire
parcel, this may reduce the cost.
Mr. Wormsbecker felt, if this was done, you may get into a problem regard�ng
the location of retention ponds, since you don't know for sure where a developer
may want to locate hts build�ng, f°ir Wormsbecker stated the staff is recommending
thts piece of property be platted, otherwise they probably wouldn't proceed with
the platting.
Mr. Sobiech stated, with development of the House of Lords, it was recommended
this property be platted rather, than having metes and bounds, and making it
easier to develop.
Mayor Nee stated, from Mr. Wormsbecker's comment, he was under the impression
they didn't want to market the property.
Mr. Wormsbecker indicated th�s was not the case and they were �nterested in
marketing the property.

MOTION by Councilman Hamernik to close the public hearing. Seconded by
Councilman Barnette. Upon a voice vote, all voting aye, Mayor Nee declared
the motion carried unanimously and the public hearing closed at 8:57 p.m.
NEW BUSINESS
DTSCUSSION OF LICENSE FEES:
AND
TION OF FI
CHAPTER 11 OF THE CITY
Mr. Brunsell, City Clerk, stated the staff made a review of all license fees
charged by the City. He stated a cost study was made on all the fees to try
and determine the cost of issuing each license including all inspection work
that goes a7ong with the �ssuance of a license.
Mr. Brunsell stated the Council is requested to consider a proposed ordinance,
as showr on Pages 2B and 2C of the agenda book, that lists the suggested
l�cense fees where changes are recom�nended. He stated this list accounts for
about one-th�rd of the licenses the City issues and the ma�ority of the fees
did not change and, therefore, are not included in this ordinance.
Mr. Herrick, City Attorney, stated the fee has to bear some relationship as
to the cost of admtnistering the license.
MOTION by Councilman Fitzpatrick to wa�ve the reading and approve the ordinance
upon first reading. Seconded by Councilman Hamernik, Upon a voice vote, all
voting aye, Mayor Nee declared the motion carried unanimously.
0. 11-1979 AUTHORIZING GHANGES IN THE APPROPRIATIONS FOR THE
MOTION by Councilman Schne�der to adopt Resolution No. 11-1979. Seconded by
Councilman Qarnette. Upon a voice vote, all voting aye, Mayor Nee declared
the motion carrted unanimously.

010520. Seconded by Gouncilman Schneider. Upon a voice vote, all voting aye,
Mayor Nee declared the motion carr�ed unanimously.
