INFORMAL PUBLIC HEARING ON NO PARKIPJG SIGNS FOR P�cKIN
FRDM P1ISSISSIPPI
This informal pu6lic h�aring was opened at 7 35 p.m. by Mayor Nee.
Councilman Schne�der stated, apparently, when McKinley Str2et was constructed in
1968, it was narrower than a usual City Street and put in this way in order to
save some of the trees. He stated, at that time, there was discuss�on there
wouldn't be park�ng on the street 6ecause it was narrow.
Councilman Schneider stated, over the last several months, he has had several
inquires from people wonderirog why the "no parking" is not being enforced. He
stated, therefore, notices were sent for this �nformal public hearing to hear
comments from the persons �n this area.
Mrs. Barbara McCue, 6631 McKinley, stated she would like to see park�ng on one
side and only in the one block between Mississippi and 66th.
Mr. Bob ICirwan, 6578 McK�nley Street, stated he has lived in this area for ten
years and was not too concerned about the parking on the street. He felt, if
there is parking on tF�e street, ii holds down the traffic and staied he was not
in favor of the "no parking" signs

Mr. Henry Lemin, 6621 McKinley, questioned what area on McKinley would he affected
by the "no parking" signs He stated, he understood, when McKinley from 65th Ave
to 66th Ave. was put in as a narrow street, it was on the condition that there
wouldn't be any overnight parking.
Councilman Schneider stated some of the concerns he heard came from persons in
his block because their primary access is through the narrow section of the block.
Mr. Lemm stated people living in the area are aware of the conditions and use
extreme caution in driving.
Councilwoman Moses stated, as far as the information before the Counc�l, it does
indicate "no parking" signs from M�ssissippi to 662 Avenue.
Councilman Schneider stated his thought was that, tf anything was done, �t would
be primarily between Mississippi to 66th Avenue.
Mr. Gary Rognrud, 6536 McKinley, stated he felt there has never been a problem,
as far as he could see, and everyone knows it is a narrow street. He stated he
was not in favor of the "no parking" signs on either side of the street
Mrs Marcella Girard, 6531 McKinley, stated persons who are parked overn�ght on
the street create a problem for her backing out of her driveway, espec�ally in
the winter wtth the ruts in the street.
Councilman Schnetder asked if she would be rn favor of no overnight parking like
from midnight to 6 a.m. Mrs. Girard stated that would be satisfactory with her.
Mr. Dan Borg, 6566 McKinley, felt there wasn't any problem with the parking and
could see no reason for the "no parking" signs. He stated, if someone was having
overnight company �t would create a problem with no parking on the street
Mrs. McCue stated one of the p�roblems is that she leaves for work at 5 30 a.m.
and in the winter it �s �ust about impossible to get out because the street had
not 6een plowed because cars were parked there
Mr. Anderson, 0577 McKinley, stated he would like no overm ght parking, but did
not want to see the street cluttered wtth "no parking" signs. He also felt the
speed lim�t should be reduced because of the num6er of children in the area.
Counctlman Schneider explained the City could not tmpose a lower speed limit, as
this would come under State �urisdiction.
Mr. Ryan Ben�aminson> 6547 McKinley, stated he was opposed to posting "no parking"
stgns.
Counc�lman Schneider read a letter he received from Mr. Sheldon Ben�aminson, 6547
McKinley, which indicated he was opposed to the "no parking" s�gns on McKinley.
Ms. Pat Qallot, 6550 McKinley, stated she has only lived at this residence for
a little over two years and when she moved there, dtdn't know there was no over-
night parking. She indicated they do have problems in the w�nter, with people
across the street from her backing on to the street, and getting stuck in the
ruts.
Councilman Schne�der asked her if she would be in favor of posting "no parking"
signs. Ms. Ballot stated to post it for no parkin9 after mid m ght would be fine.
� Councilwoman f�1oses asked, tf the overm ght parking is a deterrent to keep people
in the area from parking in the street and using their own driveway, and �f this
was the reason they wanted it.
Mrs. G�rard stated all she is asking for is one little spot so she can get out
of her dr�veway in the morning.
Mrs. Karen Kok, 6517 McKinley, stated she lived next to P4rs. Girard, and felt
the problem could be alleviated if the space between the Girard and Ben�aminson
driveway could be kept free. If no vehicles were parked there, Mrs. Girard
could always drive out of her driveway.

Mrs. Girard stated this would be fine with her, but didn't know �f it would work.
Counctlman Schneider asked, if only a small area was posted, if it was enforceable.
Mr. Herrick, City Attorney, stated he would be of the opinion that if the Council
authorized it, it would be enforceable
Mr. Pineault, 6620 McKinley, pointed out that there are ordinances regardin9 park-
ing on the street when �t is snowing.
Mr. Nyberg, 6561 McKinley, indicated he would be in favor of no parking from mtd-
night to 6 a.m.
Councilman Schneider asked if anyone from 6526 McKinley was present. There was
no response.
MOTION by Councilman SPhneider to close the informal public heartng and the Council
would review the situation and come back with a recommendation at the next meeting
on December 3, 1979. Seconded by Councilwoman Moses. Upon a voice vote, all voting
aye, Mayor Nee declared the mot�on carried unanimously and the hearing closed at
8:05 p.m.
AND WATER IMPROVEMENT PROJECT N0. 1980-1, SIVERTS
MDTION by Councilman Schneider to wa�ve the readtng of the public hearing nottce
and open the public hearing. Seconded by Councilwoman P1oses. Upon a voice vote,
aii voting aye, Mayor Nee declared the motion carried unanimously and the public
hearing opened at 8.08 p.m.
Mr. Qureshi, City Manager, stated the proposal is to put in the sewer and water
laterals in Siverts Lane from 69th Avenue to the South and provide a roadway over
the right-of-way. He stated the roadway proposed is a narrow roadway, without
curb and gutter, because it �s felt the volume of traffic would be limited and
also to keep the cost to a bare mim mum
Mr. Qureshi stated the est�mated cost for the street, without curbing, would be
$10 89 a front foot and $1.46 a foot for the side yard.
The estimated cost per foot for the water lateral is $10.94 and an estimated cost
of $520 for the service. The estimated cost per foot for the sewer lateral is
$7.31 and an estimated cost of $300 for the serv�ce.
Councilman Schneider stated he knows there are people who are concerned with th�s
improvement. He stated he met with some of the residents th�s last Saturday and
several questions were raised.
Councilman Schneider questioned the plans for the public property to the East.
Mr. Quresh�, City Manager, stated the County has acquired it and this would be
under their control, as part of their Park system.
Councilman Schne�der quest�oned if it would be a high useage area.
Mr. Boardman, City Planner, stated the plan, at this time, would be a shelter area
and parking lot.
Counctlman Schneider questioned if there would be access through Siverts Lane.
Mr. Boardman stated they couldn't be denied access, if this road was constructed.
Mr. Quresh� stated this property �s already a public access so the C�ty cannot
deny the County access, but would work with them on their plans.
Mr. Bob Anderson, 1360 69th Avenue, stated his feelings as far as the sewer and
water and the road is that he is totally against it. He felt it was too much
money and that the road did need work, �ut doesn't necessarily mean it should
be paved.

Mayor Nee asked if he had City sewer and water Mr. Anderson stated he dtd and
has no need for the road. Mr. Anderson stated he was told the cost for the sewer
and water and road would be about $4,600.
Councilman Schneider stated two corner lots would be involved, and hoth property
owners could make a persuasive argument that the completion of the road doesn't
directly benefit their properties He stated water and sewer would only 6enefit
them, if they were to split off their property in the future, since they already
have City sewer and water.
1 Ftr. Brunsell, C�ty Clerk, stated the assessment cost would be spread on the South
portion of those lots because they could spl�t this off and make another lot.
Mrs. Logid, 1340 69th Avenue, stated she would have no use for th�s road and
asked if she would be assessed.
Mrs. Nelson, 1370 69th Avenue, felt the person who is going to prof�t from the
road should pay for it.
Mr. Brunsell stated the people living on 69th Avenue would not be assessed for
sewer and water. He explained the City's policy regarding assessment for street
surfacing and how the assessment is spread down the block so persons living on
corr,er lots do not absorb all the cost for the s�de yard
Mr Ron Germundson, 1390 69th Avenue, stated there is no way the street will
benefit him and as far as he was concerned, it was a private driveway
Mayor Nee stated the proposed assessment for the road improvement to Mrs Log�d's
property would be about $151 and about $141 for Mr. Germundson's property.
Mr. Ing Siverts, 6850 Siverts Lane, stated in the public hear�ng notice it
ment�ons storm sewer and questioned if that would be necessary.
Mr. Quresht, C�ty Manager, explained that the notice used is a standard form and
' in this case, there may be a minimum kind of piping, mostly for surface drainage
Mr. Burton Smith, 6840 Siverts Lane, stated he needed the sewer and water service
He stated the street would be m ce, but he is more concerned with the sewer and
water.
Councilman Schnetder stated there are three homes fronting on Siverts Lane and
all homes presently have wells and septic systems. He stated he gathered from
the letter from Mr. Siverts that sewer and water are no longer an issue for the
people l�ving on Siverts Lane.
Councilman Schne�der stated the Halgrims live to the North of P4r Siverts at
6860 Siverts Lane and from the discusston on Saturday, Mr. Halgrim was from
neutral to favorable regarding the improvements.
Councilman Schneider questioned if the sewer and water improvement were ordered,
if the assessments could be held in abeyance until such time that the lots might
be split. He stated this would involve the two corner 1ots owned by the Anderson's
and the Bacon's.
Mr. Herrick, City Attorney, stated, from a legal standpo�nt, �t could be a deferred
assessment, but he was not sure of the financtal problems it m�ght create for the
pi^o,7 ect.
� Mr. Brunsel7, C�ty Clerk, stated often t�mes there are properties that wouldn't
benefit right away from putting in the sewer and water 1ines and if the City
proceeded on that basis, he felt there would have been a lot of sewer and water
lines that would never have been constructed. He stated he was not aware that
the City has done anything like this in the past.
Mr. Herrtck, Cii,y Attorney, stated the standard the City is to follow in thts
kind of assessment �s that the Council must make a determination whether the
property that is to be assessed is benefttted at least as much as the assessment

Mr. Herrick stated, on the other lots on 69th, the proposal for assess�ng is
conststent w�th the City's policy He stated it is a factual determinat�on as
to whether there is benefit by putting in the street.
Mr. Siverts asked the City's defi m tion of a street. P1r. Qureshi, City Manager,
stated, if the Ctty plows and ma�ntains it, it is a City street.
Mr Siverts stated he has a letter from Anoka County whtch states he owns the
land.
Mr. Herrick stated almost all public streets are on easements, the underlying ,
ownersh�p of the property is still prtvate, but sub�ect to an easement for a
publ�c street. He stated he hasn't examined the records, in this case, but
felt it was a public street as the Ctty has maintained it.
Mr. Siverts stated he would not be in favor of the alignment of the road, as
proposed on the map, and explained the ad�ustment he would l�ke made.
Mr. Quresht stated staff could work with Mr Siverts to ad�ust the alignment to
save the trees, since there is a 66 foot r�ght-of-way and the ro�d proposed would
only be about 30 feet.
Councilman Schnetder felt it would make sense to ad�ust the alignment and use
the East purtion and the only question would be turn-around area for the snow-
plows.
Mr. Anderson felt, �f the street is put on the East, it would be crowding his
property. P4r. Qureshi explained they would be putting a bend in the road be-
yond his property.
Mr. A1 Ertckson, 1380 69th Avenue, stated he couldn't see the two lots on the
corner paying about $4,500 for someone else's sewer and water s�nce they al-
ready have it.
Councilman Schneider did point out that the P9etropolitan Council and Legislature ,
are concerned with the problem of sept�c tanks going bad and there has been
talk of legislation to require mandatory yearly inspections of septic sysiems
and if they go bad, a requirement to hook up to the City's system. He felt it
was probably a question of time when the sewer would have go go in.
Mr. Siverts asked Mr. Smith if he has a permit to put in his own sewer and water
system Mr. Smith stated he has to have the soil inspected and has to find fill
with a certa�n percolation rate
Councilman Schneider asked Mr. Anderson and Mr. Bacon if the Ctty were to proceed
wlth the sewer and water improvement and hold any charges in abeyance, unt�l the
rear portions of their lots were split, if they would have any problems Wlth th�s
improvement.
Mr. Bacon felt th�s would be agreeable with him. Mr. Anderson felt it would 6e
agreeable, providing he has the opportum ty to have it reviewed legally and if
and when the lot is split, that would be the only time the assessment would be
made. He stated, if he was to sell the property �n one whole piece, he would
not be �n favor of paying the assessment--only �f it was split.
Mr. Herrick stated it would be legally possi6le to put in the tmprovement and
hold the assessment and file a not�ce on those lots that if they were ever spltt,
they would be sub�ect to paying whatever the rate would be at that time for sewer
and water. He stated that would happen anyway because they couldn't split the �
lots, without paying the sewer and water charges
Mr. Aasland, 1330 69th Avenue, talked about the drainage past his home and didn't
feel a storm sewer �vas necessary. He stated the land is relatively flat and not
conducive to fast run-off. Mr. Aasland also stated he felt Siverts Lane was a
private entrance to three properties and how far these owners wanted to go, as
far as improvement, should be worked out with them and the City.

Councilman Barnette pointed out that storm sewer isn't 6e�ng considered in this
pro�ect and the notice received is a standard form used by the City, but is not
involved in this particular pro�ect. He explained that the properties on 69th,
wtth the exception of Anderson's and Bacon's would not be assessed for sewer and
water, but only for the road improvement if th�s is ordered.
Councilman Schneider stated, �n his own mind, he is comfortable with everything,
except the street surfacing. He felt there were fa�orable reactions to the sewer
and water or it is not being opposed by anyone that is directly affected, if they
� can make arrangements regarding the assessments on the corner lots. He felt, as
far as the street, there would be only three families using it and questioned if
some tmprovement could be made, without making it a full surfaced street
Mr. Qureshi stated the only additional cost would be putttng a small amount of
blacktop on the street. He felt if this wasn't provided, there would be a prob-
lem of continually putting a stabilizer on it.
Mayor �ee felt the question the three families have to settle is if they are
willing to live with the results of the street, after it has been dug up, and
if not, if they are willing to pay to have it paved.
No other persons in the audience spoke regarding this proposed tmprovement.
MOTION by Councilman Schneider to close the public hearing. Seconded by
Councilman Qarnette. Upon a voice vote, all voting aye, Mayor Nee declared the
mot�on carried una m mously and the public hearing closed at 9�55 p m
Mayor Nee informed the people that Counctl actton on this improvement would be
at the Council meet�ng on December 3, 1979.
PUBLIC HEARING ON FINAL PLAT, P.S. #79-02, INNSBRUCK VILLAGES 3RD AD�ITION BY

Mr. Qureshi, City Manager, stated, basically, there was a survey error and in
order for the actual buildings to conform with the plat, it is necessary to
approve th�s plat.
Mayor Nee stated this plat would involve a slight realignment to correct an
error so the plat conforms with the actual structure that has been butlt.
There was no response from anyone in the audience regarding this item of business.

PUBLIC HEARING ON REVIEW OF MISSISSIPPI RIVER CORRIDOR CRITICAL AREAS PLAN
FOR THE CITY OF FRIDLEY:
P�OTION by Councilwoman Moses to watve the reading of the public hearing notice
and open the public hearing. Seconded by Councilman Schneider. Upon a voice
vote, all voting aye, Mayor Nee declared the motion carried unanimously and the
public hearing opened at 9•57 p.m.
, P4r. Boardman, City Planner, stated the City is trying to fulfill the requirements,
under state legtslation, which designates the Mississippi River under the Cr�tical
Areas Corridor. He stated the draft plan for the City, regarding the Mississ�ppi
River Corridor Critical Areas, is now before the Council.
Mr. Boardman stated the plan covers the goals and ob�ectives as laid out �n the
Comprehensive Plan and there is an implementation section, which is requ�red,
that lays out what they anticipate on implementation and capital improvements

Mr. Boardman stated there are cr�tical area regulations whlch is an overlay
district. He stated these regulat�ons are pretty much laid out 6y the State.
He stated the City �s presently operating under state regulations and the
City is required to meet those regulations as closely as poss�ble.
Mr. Boardman stated th�s plan was recommended for approval by the P7ann�ng
Commission and changes were made to the plan, as recommended by the Comm�ssion,
He stated a copy has been sent to the Metropolitan Counc�l for their review
and their comments are included.
Mayor Nee referred to page 28 of the plan which shows an exception. He stated ,
he understands a single family residence doesn't have to have all the documen-
tation. Mr Boardman stated the primary concern is for a large development.
Mr. Boardman stated he knows there is a lot of concern about setbacks. He
referred to page 31 of the plan which requires that all new structures and
facilit�es should not be closer than 40 feet from the bluff line or 100 feet
from any normal high water line. He stated these would probably cause the
most problems, but the City does have the authority to grant variances in those
areas
Mr. Boardman stated the procedure for review of the Mississippi River Corridor
Crittcal Areas Plan was similar to the review of the Comprehensive Plan. He
stated other agencies make a review and subm�t a recommendation back to the
City. He stated the approval of this pl�n by the Council would be only for
rev�ew by the various metro agencies He stated the overlay district has to
go through the normal procedure for ordinance changes.
Mrs. Irene Maertens, 144 Riversedge Way, stated she was surprised there were
changes by the Planning Commission, as she had attended their meeting, but had
to leave before �t was over. She stated a week before the public hearing, she
had tried to find out information about the FMC property from the Parks and
Rec�eation Director antl Plamm �g �epartment, but to no avail.
Mrs. Maertens comment about this plan is that it is very vague. She stated
the vagueness is about the park system and capital improvements. She stated ,
�mplem��nting authorities have been assigned, but there are no estimated costs.
Mr. Boardman, City Planner, then submitted some estimated fi gures to Mrs.
Maertens.
Mrs. Maertens questioned the river access and referred to page 18 of the plan.
She stated it says there are no official public access points, but several do
exist and one is by her home. She asked about the potential of that being
designated.
Mr. Boardman stated the primary access point is from the FMC property and
discussion of proposed river access is down by the I-694 bridge. He stated
the area where Mrs. Maertens is located is shown as an overlook and there �s
access into that park area.
Mrs. Maertens stated her only comment on what happened regarding the FMC property
is that it didn't go through the Commission channels and came directly to the
Council and Council approved it. She felt they weren't informed of what happened.
Mayor Nee stated the item was brought before Council and the County wanted a
decision with�n 10 days
Mrs Maertens stated even a week before the Plamm �g Commission public hearing
the Council already had approved this and the �irector of Parks and Recreation
stated he didn't know of it. She stated there apparently �s a lack of communica- �
tion on such an important pro�ect as this one
Mr. Dick Harris, Chairman of the Planning Commission, stated he was speaking
as a private c�tizen and wanted to make the Counctl aware of the unusual
boundaries in this plan, as it extends all the way to East River Road. He
felt the stringent conditions shouldn't be placed on persons that live several
blocks from the River. He stated this was discussed by the Plamm �g Commission
and �t was the�r feeling to let it go, as written, and let the Counc�l decide

Mayor Nee asked tf it could be ad�usted and Mr. Boardman stated some modifications
were made regardtng tree removal. Mr. Boardman stated he didn't know whether or
not they could leave �t out and get by with it, as the State sets the boundaries
on the designation.
Mr. Harr�s felt those types of condit�ons didn't seem reasonable restrictions for
people whu live several blocks away from the river.
Mr. Boardman felt the purpose is to leave the vegetation growth within that
� district along that area.
Mr. Harris felt there was some inconsistenc�es and that the criteria should be
appl�ed evenly. He stated he believed that the Governor has requested that the
Federal Government go slow on this whole pro,7ect of wild and scenic rivers, and
he hoped the State would take another look at this �hole Qperation.
Mr. 6oardman stated there are ttmetables set up by the State and mon�es have al-
ready 6een received from the Environmental Planning Board to do these studies
Mr. Harrts stated it bothers him if someone down the street wants to cut down
a tree and has to come in for a permit.
Mr. Boardman stated they are referrtng to new construction and expansion of exist-
tng structures and saying if they remove a tree, they have to replace it.
Mr. Harris felt they should be concerned about removal of trees on the river bank
and within 300 feet, but from there on he can't get concerned about �t
Mrs. Maertens, referred to page 22 of the plan, which states the implement�ng
authority for the Islands of Peace is Anoka County She questioned how this
came under the County's ,7urisdiction.
Mr. Qoardman stated the implementing authority �s throuyh a foundation. The
actua1 agency that is in charge of the park property �tself is the City. He
, stated there has been some talk of including this whole section and including
the FMC property as a reg�onal facility and the City would still own the park
property, but lease the property to Anoka County, as the tmplementtng agency
for the metropol�tan funds
Mrs. Maertens asked if the concept ts that, once the FMC property is developed,
then Islands of Peace and Durham Island goes w�th it
Mr. Boardman stated the FMC property is being purchased with funds from the
Great River Road Pro�ect and there has been discussion that the Islands of
Peace would be classified as a spur route He stated all that means is that
Islands of Peace would now be able to receive Federal funding under the Great
River Road pro,7ect and any improvements could be done with Federal monies.
If Federal monies are spent within Chases Island and Islands of Peace, the County,
as the tmplementing agency, would have to be involved. He stated this doesn't
mean the City would have to give up their right of the ownership of the land.
Mr. Maertens asked about the cost to purchase the FMC property. Mr. Boardman
stated he didn't have that figure and Mayor Nee stated what F�4C was paying in
taxes was very low.
Mr. Harris felt that the Parks and Recreation Commission should be notified of
any plans, as �t relates to the Islands of Peace He stated it seemed the Planning
Commission ts always down at the end of the line
� Mr. Boardman stated he has tried to keep the Planning Commission up to date on
this and �nformed them about the FP�1C property and potential about �t be�ng pur-

formed, but it seems it is after the fact. Mr Boardman stated they did move
very quickly on the acquisition part.
Counc�lman Fitzpatrick stated what the Council approved when the County was be-
fore them was a land use request.

Mr. Harris stated there is more to it than �ust approving a land use. He
stated that particular parcel was �n the Comprehens�ve P7an as part of the
2,200 units for low and moderate income housing. Mayor Nee stated FMC wasn't
w�lling to sell the property for that use.
Mr. Harris felt next time something comes up l�ke this, they should stop and
look at the ramifications He stated everything has to be done yesterday. He
felt from now on, when something comes in, tt should be looked at very care�ully.
He felt, if the City is committed to 2,200 more um ts, they should start think-
ing about it.
Mayor Nee stated the City hasn't approved this figure. Mr. Harr�s stated the
Metropolitan Council is committ�ng the City and the last figure he rece�ved
was 2,200 units for• the next ten year•s. He questioned if the City was going to
have any latitude not to approve it.
Counc�lman Schneider stated he ob�ected to saying that 2,200 um ts is what the
City has to approve.
Mr. Boardman stated he dtdn't think, necessarily, the City planned around a
certa�n number. He stated they are looking at �t as a need for the City. He
statetl they want to look at it real�stically as to need and how to solve it,
within certain cost limits and land availab�lity.
Mayor Nee stated he can only tell him that the Council is not be�ng led by the
nose by the Metropolitan Counc�l.
Mr. Herrick, C�ty Attorney, stated at a well-planned and detailed meeting of
attorneys that are specializing in planning in mum cipal areas, there was a
fa�rly substantial discussion about the Comprehensive Plan. He stated a
statement was made by some of the individuals that, once the Comprehensive
Plan is adopted, if there is any incons�stency between this plan and zo m ng,
the inconsistency will 6e resolved by the comprehensive plan. He stated the
problem that concerns him and other people �s that, while it is true they have
been working on it for a long time, and had public hearings, he doesn't see
anyone coming to the public hearings, He �s questio m ng if landowners in the
area are aware of the �mplicat�ons. He felt, before the Comprehensive Plan is
adopted, there better be a very careful analysis that it ts not inconsistent
with the zoning and if there are things in it that would make a ma�or change
tn the present destgnatton, it would seem that some add�tional effort has to be
made to get more people involved in the consideration.
Mr. Boardman stated there are several areas where there is a mixture of uses

stated he would l�ke to look at it carefully. He stated there is a six months
process, after the initial approval by the Council, where it �s rev7ewed by the
Metropolitan Council and metro agenctes, and would then like to set up review
by the various cTVic orgam zations and extensive display for the public.

River Crit�cal Areas Plan. Seconded by Councilman Schneider. Upon a voice vote,
