RESOLUTION NO. 64 -1979
A RESOLUTION ORDERING IMPROVEMENT, APPROVAL OF PLANS AND ORDERING
ADVERTISEMENT FOR BIDS: WATER, SANITARY SEWER AND STORM SEWER IM-
PROVEMENT PROJECT NO. 127
WHEREAS, Resolution No. 82 -1979 adopted on the 4th day of June, 1979,
by the City Council, received an agreement to waive the public hearing on
the proposed improvements, as specifically noted in the agreement attached
thereto for reference; and
' WHEREAS, all of the property owners whose property is liable to be
assessed with the making of the improvements (as noted on said agreement)
have signed the agreement requesting the improvements and constitute 100%
of the property owners who will benefit from the improvement and do waive
the right to a public hearing which is allowed under the normal procedures
set forth in Minnesota Statutes Chapter 429; and
WHEREAS, Resolution No. 83 -1979 adopted by the City Council of the
City of Fridley, Anoka County, Minnesota ordered all of these improvements.
NOW THEREFORE, BE IT RESOLVED, by the Council of the City of Fridley,
Anoka County, Minnesota, as follows:
1. That the following improvements proposed by Council Resolution
No. 41 -1979 are hereby ordered to be effected and completed -as soon
as reasonably possible, to -wit:
Watermains, Sanitary Sewer Laterals with service connections, Storm
Sewer and related appurtenances located as follows:
Paco Industrial Park (73rd and University)
That the work involved in said improvement as listed above shall
' hereafter be designated as:
WATER, SANITARY SEWER AND STORM SEWER IMPROVEMENT PROJECT NO. 127
2. The plans and specifications prepared by the City Engineer and the
City's Consulting Engineers for such improvements and each of them,
pursuant to the Council resolutions heretofore adopted, a copy of
which plans and specifications are hereto attached and made a part
hereof, are hereby approved and shall be filed with the City Clerk.
3. The work to be performed under WATER, SANITARY SEWER AND STORM SEWER
IMPROVEMENT PROJECT NO. 127 shall be performed under one contract.
The City Engineer shall accordingly prepare and cause to be inserted
in the official newspaper advertisements for bids upon the making of such
improvements under such approved plans and specifications. The advertise-
ment shall be published for three (3) weeks (at least 21 days), and shall
specify the work to be done and will state that bids will be opened and
considered at 11:00 a.m. on the 7th day of June, 1979 in the Council
Chambers of the City Hall, and that no bids will be considered unless
sealed and filed with the City Engineer, and accompanied by a cash depo-
sit, bid bond, or certified check payable to the City for five percent (5%)
of the amount of such bid. That the advertisement for bids for WATER,
SANITARY SEWER AND STORM SEWER IMPROVEMENT PROJECT NO. 127 shall be substan-
tially in form as that noted in Exhibit "B" attached hereto for reference
' and made a part hereof.

City Hall on the 7th day of June, 1979 at 11:00 a.m. for the fur- '

All in accordance with plans and specifications prepared for the City of
Fridley, Minnesota by the Public Works Director and Suburban Engineering,
the City's Consulting Engineers.
Plans and specifications may be examined at the office of Suburban Engineer-
ing, 6875 Highway No. 65 N.E., Fridley, Minnesota 55432 (Tel: 784- 6066),
and copies may be obtained for the contractor's individual use by applying
to the engineers and depositing with the engineers $25 for each set. The
deposit will be refunded to each bidder submitting a bonafide bid upon
return of the documents in good condition within ten (10) days from the date
of opening bids, and to non - bidders upon return of the documents in good
condition, prior to bid opening.
Bids must be made on the basis of cash payment for the work, and accompanied
by a cash deposit, certified check (on a responsible bank in the State of
Minnesota), or a bidder's bond and made payable without condition to the
City of Fridley, Minnesota in the amount of not less than 5% of the total
amount of the bid.
The City Council reserves the right to reject any and all bids and to waive '
any informalities in any bids received without explanation.
No bid may be withdrawn for a period of forty -five (45) days.
