The Regular Meeting of the Fridley City Council was called to order at
7:37 p.m. by Mayor Nee.

MOTION by Councilman Schneider to waive the second��reading of Ordinance
No. 709 and adopt it on the second reading and publish. Seconded by
Councilman Barnette. Upon a voice vote, all voting aye, Mayor Nee declared

Councilman Schneider requested that staff notify all occupants affected by
the new Chapter and to keep the Council informed as to when the facilities,
covered under this ordinance, come into compliance.
CONSIDERATION OF APPOINTMENT TO CABLE TELEViSION COMMISSION (TABLED MARCH 3,

MOTION by Councilman Schneider to nominate Duane Peterson, 7376 Stinson
Blvd. N. E., Fridley, for appointment to the Cab1e Television Commission.
Seconded by Councilman Barnette. •

RECEIVING PLANNING COMMISSION MINUTES OF FEBRUARY 27, 1980:
MOTION by Councilman Fitz�atrick to receive the minutes of the Planning
Commission Meeting of February 27, 1980. Seconded by Councilman Schneider.
�4ayor Nee asked if the City Engineer has talked to the Planning Commission
regarding drainage around the Schroer property. .
Ms. Barbara Hughes stated this item was brought up at the Planning Commission
meeting, however, tne City Engineer had only been on the job for about a week
and wasn't present at the meeting. She stated the Commission would still like
r�°- a visit from the City Engineer to explain the drainage.

Mr. Qureshi, City Manager, stated information can be given to the Planning
Commission on the plan and what standards the City is using. He stated they
are, basically, using the standards of the Rice Creek Watershed District.
UPON A VOICE VOTE TAKEN ON THE ABOVE MOTION, all voted aye, and Mayor Nee
declared the motion carried unanimcusly.
RECEIVING PLANNING COPIMISSION MINUTES OF MARCH 5, 1980:

MOTION by Councilman Fitzpatrick to concur with the recommendation of the
Planning Commission and grant Special Use Permit, SP #80-01. Seconded by
Councilman Schneider.
Councilman Barnette asked if this center would have to comply with the new
Fire Code.
Mr. Qureshi, City Manager, stated they would have to meet all the new codes
and an inspection would be made by the Fire Department to make sure they are
in compliance with all the codes.
Ms. Vikesland stated the Fire Department has made an inspection of the
premises and they have some regulations to comply with such as smoke detectors
and protective alarm sysi:ems.
Councilman Fitzpatr�ick questioned their non-profit status. Ms. Vikesland '
stated this is a non-profit corporation which means the funds will be going '
into the corporation and disbursed accardingly. She stated the only funds
coming in would be their own and they would be receiving no funds from other

agencies. She stated the corporation is GBS, Inc. and one of the directors
applied for the special use permit.
Councilman Schneider questioned if there might be a problem in granting
this special use permit to an individual, rather than the corporation.
Mayor Nee indicated the special use permit is granted to the site or
property.
UPON A VOICE VOTE TAKEN ON THE ABOVE MOTIOlV, all voted aye, and Mayor
Nee declared the motion carried unanimously.
MOTION by Councilman Schneider to receive the minutes of the Planr.ing
Commission Meeting of March 5, 1980. Seconded by Councilman Fitzpatrick. '
Upon a voice vote, all voting aye, Mayor Nee declared the motion carried �
unanimously.
RESOLUTION N0. 27-1980 AUTHOR?ZING CHANGES IN APPROPRIATIONS FOR THE
GENERAL AND OTHER FUNDS QUDGET FOk THE YEAR OF 1979:
Mr. Brunsell, City Clerk, stated the prirnary purpose of this resolution is
to set up a budget for some special revenue funds, primarily funded by
grants. .
MOTION by Councilman Fii:zpatrick to adopt Resolution No. 27-1980. Seconded
by Councilman Schneiaer, Upon a voice vote, all voting aye, Mayor PJee
declared the motion carried unanimously.
RESOLUTION N0. 28-1980 SEPARATING PRECINCT 3 OF WARD 2 INTO TldO VOTING
DISTRICTS AND DESIGNATING POLLING PLACFS THFREFORE: ,
Councilman Schneider asked if the residents have been notified of this
change. Mr. arunsell, City Clerk, stated the County �vould take care
of this because they have the voter registration certificates at the
County offices. �
MOTION by Councilman Schneider to adopt Resolution No. 28-1980. Seconded
by Councilman Barnette. Upon a voice vote, all vo�iny a;;e, Mayor Nee
declared the motion carried unanimously.
RECEIVING BIDS AND AWARDING CONTRACT - INDUSTRIFIL TYPE TRACTOR:
MOTION by Councilman Barnette to receive the bids for this industrial type
tractor and award th� contract to th? low bidder, Midway Ford, in the amount
of $9,476. Seconded hy Councilman Fitzpatrick, Upon a voice vote, all
voting aye, Mayor Nee declared the motion carried unanimously.
RECEIVING BIDS FQR NORTH PARK BUILDING:
Mr. Qureshi, City Manager, stated bids were received for the building in
North Park and the low bidder was Bud Johnson Construction Comparly.
Mr. Qureshi stated ten alternatives were listed in the bidding in order to
give the City flexibility in choosing additional items. He explained the
base bid was higher than allocations i,eceived from the grant.
Mr. Qureshi stated, since the time the bids 4�ere received, other areas were
reviewed in the building to determine what could be removed or scaled down
in order to bring the cost reasonably within the funds that are available.
He stated several change orders could be considered by the Council. One
change order would reduce the contract by $51,575 and removes such things
as inside cabinets, Kal�uall roof, small partitions and most of the air
conditioning> however, it. does retain the integrity of the structure as
proposed in the plans.

Mr. Qureshi stated change order No. 2 would add Alternate 1 in the amount
of $10,800 to provide additional storage space. He felt it would be cost
effective to add the space at this time, since the cost is less than $24
a square foot, while the rest of the building is actually costing over $70
a square foot.
Anofiher change could be for the use of Kalwail instead of conventional
roof system. He stated this would be more pleasing and give an openness
appearance, and would also have diffuse light and reduce any artificial
�: light needed. He pointed out on the negative side there is the cost
factor and the insulation rate would be R-6 instead of R-12, which is
half the insulating value of a normal roof. He stated in winter it
would lose energy, and in summer would have the potential of creating
a high temperature inside. He also felt there might be a greater potential
#or vandalism. Additional funds would have to be raised if some of these
alternates are going to be added to the project.
Ms. Barbara Hughes of the Parks and Recreation Commission stated the
Commission did review the plans and supports the recomrnendatifln of the
City Manager and staff. She stated the Commission was in agreement to
add Alternate 1 for the storage room which they felt was appropriate.
She statedthey will go out with members of the Springbrook Foundation
and•try to raise money to help complete the building.
Ms, Hughes stated she was pleased with the building plans and what they
can get for the price.�
Councilman Barnette stated it seems, over the last six years, he has
heard money was going to be raised.
Ms. {iughes stated the Springbrook Foundation has been very instrumental
in getting the initial grant., She pointed out the Commission is unanimous
in saying this is a fridley park and building is the City's responsibility
She stated she was happy with the interest in the community to provide
�_, some of the things on a velunteer basis, however, the Commission is ready
to say they should be doing this out of City funds.
Mr. Siah St. Clair, Naturalist/Resource Coordinator, stated, he felt, even
with the change orders and deletions, the City would still have an excellent
building to maintain the programs.
Councilman Barnette questioned the item regarding site grading. Mr. Qureshi
stated he felt there was adequate fill potential on the site and this was
added as an assurance to the contractor who was not familiar with the site.
Councilman Barnette also pointed out that the City would provide sewer and
water connections within five feet of the building and assumed this would
come from the sewer and water portion of the City`s funds.
Councilman Barnette also questioned if the air conditioning would be elimi-
nated entirely.
Siah St. C1air stated air conditioniny.wouid be omitted in the exhibit area
and auditorium type rooms. He felt they would have adequate ventiliation
in these areas because of the type of windows.
Councilman Barnette stated this is exactly the type of thing some people
thought would happen, that is, committing the City to a large sum of money.
He stated he didri't think it was the original intent of the whole idea.
Ms. Nughes felt the usage in North Park shows the community supports the ;
project. She stated the project can be done now with the money they have �
and probably couldn't be done in the future for this cost. She stated �
she felt they should not lose the grant money and use it wisely and that ;
it would be a very fine facility when it is finished. �

Councilman Barnette stated Dick Harris ar.d Jim Langenfeld questioned the
expenditure of City funds to the nature center and asked the reaction of
the Planning Corrunission to this plan.
Ms. Hughes stated she didn't believe the Planning Commission had seen
this plan between the time v�hen the bids were opened and now, or at least
not as a formal body.
Councilman Barnette stated he thought it might be to everyone's advan-
tage to have the Planning Commission's reaction to the pTan.
M� Nughes thought that things dealing with parks have to go through the
Parks and Recreation Commission, and felt there wasn't time to go to the
Planning Commission.
Mr. Dick Young, member of the Parks and Recreation Commission, stated.the
Commission discussed the proposal for the building at the last meeting and
he felt not to add the additional room, under A]ternate I, wauld be an error.
He pointed out this couldn't be added at a later time for the price of
about $25 a square foot.
Ms. Jan Seeger, member of the Parks and Recreation Commission, stated she
wished to reaffirm Barb Hughes' comments. She stated she has seen the
cutbacks made in the buiTding and was in agreement,. She felt, because
of the deadline, they have to make some decisions.'
Councilman Barnette questioned to what deadline they were referring.
Ms. Hughes stated the contractor had indicated he would only hold the
prices on the alternates to a certain date and that the base bid would
have to be awarded within 30 days.
Mr. Qureshi, City Manager, stated the contractor indicated he would hold ;
the prices submitted on the,alternates until April 14 so alterna�es could
be added until this date at these prices.
tA0TI0N by Councilman Schneider to receive the bids and award the base •;
bid to the low bidder, Bud Johnson Construction Company, in the amount of ''
$376,600. Seconded by Councilman fitzpatrick. Upon a voice vote, Councilman
Schneider, Councilman Fitzpatrick and Mayor Plee voted in favor of the motion.
Councilman Barnette voted against the motion. Mayor PJee declared the motion
carried by a 3 to 1 vote.
MO7ION by Councilman Schneider to approve Change Order No. 1 deleting
$51,575 from the contract with Bud Johnson Construction Company for t�e
6uilding at North Park. Seconded by Councilman fitzp'ati°ick. Upon a voice
vote, Councilman Schneider, Councilman Fitzpatrick and Mayor Nee voted in
favor of the motion. Councilman Sarnette voted against tf�e motion. Mayor
Nee declared the motion carried by a 3 to i vote.
P90TION by Councilman Fitzpatrick to approve Change Order No. 2 with Bud
Johnson Construction Company which adds Alternate 1 in the amount of $10,800
for construction of a storage room in tne bui7ding at North Park. Seconded
by Councilman Schneider. Upon a voice vote, Councilman Fitzpatrick,
Councilman Schneider and Mayor Plee voted�in favor of the motion. Councilman
Barnette voted agairtst the motion. Mayor Nee deciared the motion carried
by a 3 to 1 vote.
D10TION by Councilman Fitzpatrick to approve Change Order No. 3 for the
use of Kalwall material on the roof of the building at North Park.
Seconded by Councilman Schneider. '
Ms. Hughes stated the Commission discussed the use of this material on
the roof, but didn't think there would be enough money. She stated they
also believed this material had equal R value as a normal roof. She felt
there is a lot io be said of the atmosphere Kalwail would create, but is
not sure how the Commission would react. She asked if the Conenission
might investigate this item further.

CONCLUSIONS OF LAW, AND

The followin� Findings of Fact, Conclusions of Law, and Order
are made by the Fridley City Council pursuant to an application by
IGordon iledlund for certain variances, which are more parCicularly described
below:
A hearing was held on the request for variances on February 9,
1980 at 9:30 A.M. at the Fridley City Hall. This hearing was held
pursuant to a Stipulation of the parties as contained in Anoka County
District Court File No. 42853 and in conformity with provisions of *finnesota
Statutes and Ordinances of the City of Fridley.
Gordon Hedlund was represented by David J. Hauser, Attorney at
Law. City of Fridley was represented by Virgil C. Herrick of Talle, iierrick
& Piunns.
FINDINGS OF FACT: •
1. That the City of Fridley is a home rule city governed by a
City Charter. The City was established in 1957.
2. That Gordon Hedlund is a resident of the City of New Brighton.
3. That Gordon Hedlund applied to the City for the following
variances:

4. Notice of this hearing was published in the Fridley Sun on
(date) and mailed notice was sent to all property owners within (feet) of
the subject properties. �
S. The City has adopted a City Code which includes Chapter 205,
entitled, "Zoning". Section 205.05 "Lot Requirements and Setbacks" conCains
certain minimum lot sizes required for development as single family
residentiul ].ots. This section provides, in p�rt, as foll.ows:

6. The above requirements have been in effect in the City of
Fridley since (date); the City's deveZopment plans including, utility
capacities and the amount of park lands, have been based on densities
determined by said lot requirements.
7. That the Plymouth Addition was platted in 1884. Almost all
of the lots contained in said plat are 40 foot lots. The remaining lots
vary from the 40 foot lots by only a small amount.
8. That the residential development in the area surrounding
the subject property was developed primarliy in the early to mid 1950's.
This development was in conformity with the above minimum lot standards.
The building sites in said are� are primarily 80 feet in width, with a few
lots being 60 feet.
9. That Gordon Hedlund purchased the subject lots on November 19,
1977 at tax forfeiture auction conducted by the Anoka County Auditor's
Office. He paid $800 for Lot 15, Block 2, Plymouth Addition and $.
for Lot 30, Block 12, Plymouth Addition.
10. That prior to conducting said auction, the Gity of Fridley
advised Anoka County officials that they approved the sale of said lots
but that they were to be sold as "non-buildable sites".
11. That prior to the auction, Anoka County Commissioner Michael
0'Bannon appraised the subject lots as required by Minnesota Statutes. His
appraisals were $775 for Lot 15, Block 2 and ($ ) for Lot 30, Block 12.
Both appraisals are clearly marke8, �'not buildable site". Commissioner
0'Bannon testified that if said lots were buildable, that they would have
a value of ($ ).
12. The County Auditar published a Notice of Auction Sale.
This notice specifically advised the buyer *_o °check with municipality for
local building ordinances and variances". Hedlund admitted that he knew
that these lots did not meet the City's minimum standards at the time he
purchased them.
13. That tl�e subject properties could be�used by adjoining owners
to enlarge their existing siCes, for accessory buildings, or for recreational
uses, or C}iese lots could be used for garden purposes. Each of said
permissible uses wouid have a value of at least as much as 1ledlund paid
for thc propertics.

14. That the market value of the aubject properties, i.f said lots
were buildable, is $9,000 to $12,000 per lot.
15. That if Hedlund is permiCted to build on said subject
property, said construction will have a detrimental effect on the market
value of adjacent properties.
16. That a number of the neighboring residents have expressed
their opposition to the requested variances.
AND AS CONCLUSIONS OF LAW, THE COURT FINDS:
1. That the City has the sole authority to regulate the size
of residential lots. ,
2. A landowner is not entitled to a variance as a matter of
right but must show unnecessary hardship based on some unique character of
the property.
3. The property owner has failed to show that the property
has no economic use with�ut said variance.
4. That the property owner was aware of the zoning restrictions
when he purchased the property; any damage suffered is self-inflicted.
Therefore, he is estopped £rom objecting to said restrictions.
5. That the zoning restrictions have been in effect for
approximately 25 years. The surrounding properties were developed in
reli.ance on said regulations. The time to object to the validity of
said ordinance has passed.
ORDER:
The requested variances, as describQd above, are hereby denied.

SP ��80-02 by the Anoka CounL-y Taslc Force for Battered jdomen. Upon a voice
vote, a.11 voting aye, Chair.man liarris declared the public hearing open at
7:40 p.m.
Mr. Boardman stated that this request comes before the Planning Commission under
a special use permit. iJnder State La�a, all cities must allow group homes
within residential areas if they meet certain requirements. One of these
requirements is that there be no more than six unrelated adUlts or persons
within that unit over and above the staff. As l�e understood it-, the program
will a11ow for living space for six women and their children. Beaause of this
situation, that would not fall ��ithin the staL-e requirements of having six
unrelated persons and requires a special use pe nnit. He stated the City of
Fridley has no problems c,zith this rec;uest.
Ms. Carol L'rickson, 9950 Bluebird St., Coon Rapids, sta�ed she was the Chair-
person of the Taslc Force for Batt�xec� Women. She stated the Anoka County Task
Force for Pat�ered iNOmen is a nozi-p;-ofit orgai�ization and has been for the
past three years. The general membership votes annually on a$oard of Directors.
The Board consists of lay peoPle fro� the communit�=. The Bo�rd of Airectors
ap�oints people to tl�ei_r Advi_sory Beard. Tlie Advisory Iioard represents people
from var.ious service systems in the conununiLy. They have a cc:mmiissioner, a
policen�an, a chaplain, a counselor, and a doctor to give advice t.o the Board
as far as how services are to be provided. Siuce the beginning three years
ago, they have had two main goals:
1. To malce the public and people in helping professions aware that
�aomen in ouz community and Anolca county are living in fear and
physically aUused on a daily basi.s. The Taslc T'orce wanted people
to begin to be sensitive to this issue and to Uegin to seek alter-
natives for the battered woman.
2. To provide a shclter \Jt11C11 is one of the best inunediate alternatives
f.ar the bati�ered woman. 2hrough the clata they have collected,
i:hey have fa�md tltere are more than 15 women a month in Anoka
County ��ho need a place to stay, A shelter provides them caith
temporary relief from phvsical abuse, it provides them freedom
fram the fear of being abusGd, so thcy have time to think aUout
��aliat the�� ���ant to do for themselves and their children. The
shelter has been the ulLimaLe goal..
Ms , Eri.cl:son stated �hat ;.ast spring, the P'Iinnesota Stare Legislature allocated
�7ioucy for two ziddi�ional sl�clters in Itegion 11. They applied for one of those

are women wlio have been abused. '
Ms. Lrickson stated they have worlced long and hard L-o �ind a facility that
�aou].d meeL their necds . Tl�e faca.lity they �ound in I'ridley meets those needs,
and they are here to aslc for the special use permit in order L-o use thar facility.
Ms. Ericicson stated before anst�ering any questions, she would like to show a
seven-minute slide presentation. It is the sL-ory of a woman who was in a sheltez
and tells about her er.perience. Ms. �rickson stated it would give the Planning
Commission members a feel of what actually happens in a shelter.
Ms. Erickson stated that when they submitted the grant, they received more than
20 letters of support from various people in l�noka County--the different police
departnients, sheriff's department, county commissioners, councils, hospitals,
and doctors--all supporting what they �aere doii�g and the fact that a shelter
was needed in Anolca County.
Ms. Gabe1 stated the buildin� proposed for the shelter was a large facility.

the last 20 months. Out of tY:e 132 women they worlced with (all from Anoka
Cattnty), 66% have 1-2 children, 28`/ have 1 child, 38% have 2 children,
20"/o have 3 children, 3% have 4 children, 4% have 5 children, and 2% have 6 children.
This would give the Planning Commissioii members an idea of how many children
the women had and ho�a many each �aomar .aould have at the shelLer .
Ms. GaUel aslced how many full-time staff people would Ue at the shelter 24 hrs.

Ms, r.ambow stated they tlave 11 staff people, 9 are fu11-time and 3 are part-
time. Dependin�,upon the Lime of day, they will try to have at least t�oo
aclvocates on duty during the day, 8:00 a.m, - 4:00 p.m, The reason for two
advocates during the day is that oiten ane of L-he aclvocat-es has to provide
transportation for the toomeii. There would oLten be the occasion �ahen there
would be three staf:f people d'urin.g the day, if the child advocate is there at
Lhe same time. They have one {u11.-tinie physician worl;in� entirely with the
children, and aiiother half-time physicia�i who �aill be providing sCructured
pro�iams for th� children.

Ms. Rambow ,.l-ated Lhey did not se� any maximum t-ime. They will provide the
services .;s lon�; as a 4�oman needs it. Prom contacting other shelters, they
found out that in the State of Minneso�a, the average lengt-ti o£ stay is ten
days.
Ms. Rambow srated she has becn hired as one of the staff coordinators. She
also has experienced violence in her home situation. She explained that an
advoca�e in a shelter �enerally provides the woman wi.th some options; it
gives t:he woman an opport:unity to bc away from the violent atmosphere, and to
malce some decisions. Many women for various reasons go back to their home.
Other women do not ���anl' to go bacic and that is when the advocate will help them
find hausing. If the woman is goin� to take legal steps, the advocate will
help her find a lat�yer and will provide traxisportation, whatever is necessary.
Ms. Gabel stated that because of the present activity at the facility, there
is playground equipr�ent. Would that playground equipment remain?
_ P1s. Itambo�a stated that at this time, they were not sure if that playground
equipment �aould remain or not.
Ms. Gabel stated that if this was an 18-month grant, was this then an 18-monCh
lease on the facility? She assumed ihey w aald try to keep this an on-going
facility.
Ms. Rambow st-ated t:11e reason it caas stated that �aay �.�as because their basic
funding comes fron� the Department of Corrections. She stated they saw no
problem in this ar_ea, Uecause no shelter that has been set u�, has ever not
received fundi�g.
Pis. Gabel stated that she understood that the shelter is usually kept secret
from the husbands. She was curious as to how this was done and how they
w�ould handl.e any proUlems . •
P1s. Rambow stated their building is secured. In talking with other shelters,
that is not a problem. Obviously, the location is Icept as confiuential as
possible. Just in the very nature of domestic violence, nat many people would
want to come into a situation �ahere they were not in control. That violence
is usually in the home where no one l:nocas what is happening. She stated that
if the Con�nission �aas interested in kno�aing ho;a many calls the police have
�:eceived. to some of tlle other shelters, Jeif Janacel: �aas a member of th�ir
Board of Directors and he could share some of tilis information with the

Uy the C;olumbia �ieights Yoli.ce Depart.ment for over S 2 years , He has been

Task roi•ce. He is no��� on tlie Board o:C D-irccCors and is the liaison person
between the '.�asl: 1 orce and tlie sr�ff riud the local police departments . He is

wi.th thc problem and how ro handle L-he prol�lem and also so there is a good
relationship-between Lhe police departments and the slielter ilself. He stated.
thcy ar.e in desperate need of this kind of facility. It is really a problem
in Anolca County and it is very frustraLing for the �olice to deal with this
issue, particularly when there is no place to talce the women and children c�hen
there is a problem. The exisCin� shelters are few and too far away.
Ms. Iiughes asl:ed ho�a many calls was typical for a shelter to make to a police
department ior help.
Mr. Janacek stated that he tried to check a she1L-er that appeared to be in
the slme type of an area as the one in Fridley, and that was the Robert Lewis
House in Burnsville. This shelter has been operaL-ed since August 1979 and,
si.nce t.hen, they have called the police tcaice and an arrest was not made �oith
either call. In fact, one ca11 �aas a mistake. In }3urn.�ville, the shelter's
addx'ess is listed on the Urochure. One of the advantages to keeping the
shelter in Fridley a partial secret is that the man wt�o is doing this kind of
violence is not likely to have access to the information. He stated they are
not goi.ng to have the shelter's address printed anywhere, and dispatchers will
not give the address over the radio. Iie predicted that Fridley would get
fewer calls than Burnsville.
ris. Gabel asked if L-his shelter would service only Anoka County women?
Ms. �ri.cicson stated they would give priori.ty to Anoka County women, but just
as otl�er shelters have served women from Anoka. Count�y, they would also serve
women from other ar.eas . ris . Lricicson staeed that besides the st�i�lter in
Burnsville, there is one in Ramsey County and two in I-Iennepin County.
Ms. Gabel stated tha� f.rom the slide presentation, s1�e understood that most
of the women do not have transportation. If a woman did have a car, would she
be a1l.owed to l:eep it out of sioht in the large garage Iocated on the property?
Ms. R<�mbo�a stated that it ��*ould not Ue possi.ble. (?ne of Lhe exciting things
aUout L•his facility �aas ehat the garage is carpeted and insulated and wiZl be
used as an area for the childzen to play. This is unheard of for �his lcind
of facility. She stated she had tallced to the director of Lhe Day Activity
Center (D^C} a,�.d was informed th�t when the DAC is in session, they have
approximately 10-11 cars there at the same tin�e. The sh�lter will never have
L-hat many cars �arl:ed there at any given time. Very few women she has �aorlced
with in Anolca County have had trai�.sportarion so that will not lie a problem.

to foundations throu�hout the sCatc and beyond asking L-ar money, as they know
they wi_11 need that to cantinue to support the pro�ram. Other shelt-ers use
L•he Stat-e fundinb as a base and then ttiey are all supplemented by foundations,
Mr. Treuenfels asked whaL- kind of services are provided at the shelter.
Ms. Rambow stated they help in getting legal assistance for a woman, help her
get assistance from the Welfare Department if she needs iL-, they help her
establi_sh a liome on Iler own if L-hat is what s11e decides . The primary thing
is pr.oviding a place ior the woman a.nd her children to live--providing food,
clothing, everything Ll:ey need--a safe environment for them to.live to take
time to think about ��hat has happened and what she wants to do.
Mr. Treuenfels stated that i� a woman decides to return to her home, do they
do any type of counseling? .
Ms . TZambow stated they do not provide cot�nseling �•aiChin the shelter . It is
not the advocate's role to provide counseling. The provxde a netcaork of
counseling services available in the community and tt�e county. An advocate
is, more or less, there to offer supporL- and act as a resoUrce person. An
advocate does not in any �aay influence the �aoman, bu� suppoxts her in any
decis_ion s}.ie niakes.
Mr. Treuenfels asked a�out the group sessions he7_d at the shelter.
Nls . Rauibow si:ated when tney refer to group sessions, they are tal.lcing about
suppoxt groups, where the �oomen get together, L-alk aUout their experiences
and offer support to each other. T1s. Ranibo�� stated they felt the support
groups are very imporLant and it is somethin� t-hey will try to stress. They
also llope that �ahen the �aomen leave the shelter, they <<�ill �aant ta continue
to help by doing volunteer help a?Zd heiping other women.
Ass. Gabel asked if they find that the children of the abused women are
uSual�:y abused also?
Ms. KaLhy Picotte, 1339 Poppyseed Court, New Brighton, stated she works for
Hennepin County in Domestic AUuse, ai�d she sees about 20 women a weeic who
come to tLe Counry to get an order for protection. All o� the children experience
abuse, if not ph��sic21 abuse, then emotional abuse. They are almost a11
emotionally abused because they see sou�eone Ll1ey love being Ueaten up.

Mr. Janacek sCated that two panic buttons would Uc installed inside L-he
facility. These buttons woul.d be placed high enou�h so chiLdren could not "
reach tl�em. When a button is hit, i� turns on a scries of exterior floodlights
and activates a tape dialin� system whicl� is hoolced up to central con�munications
in Anolca County, stati.ng there is at� unknown emer�;ency at the shelLer in i'ridley.
The I'ricl].ey police would respond to that call. �le st-ated he did not think it
woul.d ever be necessary because of Lhe physical malce-up of L-he building. He
stated Lhey have discussed mesh screens on the windows but do not feel that is
going to Ue a problem. If it ever becomes a problem, there are many alternatives,
one �vould be replacing the glass on the first floor with Lexan, which is difficult
to break. No security tencing is planned at this time.
Mr. Hari-is asked if they foresa�a any impact on the surrounding residents from
this pa:.ticular type of operation?
Mr. Jan:tcek stated thaL the only impact would be L-he fact that the shelter wi11
be o�en 24 hours a day and the building wi11 be lighted 24 hours a day. The
security lights will be used only in the event of an emergency.
Mr. Langenfeld asiced if there was going to be any er.tensive interior remodeling?
Ms. Kambow stated that extensive remodeling was t�ot necessary. One wall aas
going to be added on the lower story. Other than L-hat, the Couaty will be
adding bathing facilities because there are izo overnight facilities at this
time.

they foresee a need for expansian?
Ms. Ericicson stated theYe probably would be the ne�d, but funding has been
very hard to get. She �aas sure that as time went on,the counties north of
Anoka County �vill have shelters. At this time, their plans are onl}� to keep
this she'_.ter open and operating.
Mr. Harris aslced if there �vas enough physical facilitie� within the structure
to handle 20-22 people? -
Ms. Ericicson stated that, yes, there was.

Mr, llarris stated he was concerned abput the general health, safety, and
welfare oL putting 22 pcople in a facil.ity. Was Lhere enough room for the
bathing facilities that would be installecl and ho�o many Uathrooms are there
now?
Ms. Rambow stated there are four bathrooms--two on each floor, and there is
room for the bathing facilities to be installed.

Ms. Huglies stated this cer.tai�.ily taas a facxlity tha� was needed and, as long
as the facilit}> ��Jas built for a lcin� of public use, this was a reasonable
continuing use of that facility. She was pleased with the reaction from the
Gounty and the CountS Co�nmissioners.
Ms. Gabel s�ated tl.at, as a community, they had the responsiUiiity to provide
this ki.nd of service .
rir. Boardman stated that the Ca�ty has also been caorking with Metxopolitan Council
throu�h the existing Section 8 program to also provide lzousing assistance to
the �aomen Ueing housed at the shelter.

Mr. Boardman stated he fele the Police Deparir,�ent was in favor of L-he facility.
Ms. Ericicson stated they have a lett-e.1 fram Jim Hill and a letL'er from some

Ms. GaUel asked ti�here people in the community could call to donate clothing
and other items to the sheller.

Mr. Treuenfe7.s staeed he could not support this request because of its
discricninaL-i.on againsti the male population . It seemed to be in dire, fl_agrant
opposition Lo Lhe ordinance wl3ich cxeated the liuman Resources Commission.
He would be in favor of it i_f it was a shelter for Uattered persons.
Ms. Hu�lies sL-ated she did noL- feel L-he ordinance was Lhat direct in its
prohibitions and that you can indeed Provi.de facilities for groups that have
to be sef;regated for very good reasons. She agreed with Mr. Treuenfels that
it ought to be battered people, bu� there are some priorities that have to
be set and some reasons why Uattered wnmen have to be chosen firsC.
Ms. Gabe1 st-ated she did not see it as discrimination, but rather as providing
a need .
Mr. Iiarris stated that he and Mr. Treuenfels ha�re heen s�udying the social
service delivery system in Anolca Cou�zty. They had an interesting discussion
with Don Wegscheider of Lhe North Suburban Pediatric Cl.inic in Coon Rapids
about this very problem. t�1x. Harris stated it �•�as his personal feeling that
maybe this is phase one, a remedy but not a cure. Perhaps, one should think
alon� the lines of correcting the home situation alse and the reasons these
things ar.e happening. BaL-t�red women are not the only people being battered
in the county, there are battered womei-� and some Uattered men. He felt that
at some poiizt in time, perhaps programs should Ue expanded to encompass the
home situatioiis to provide a cure for the sztuation.
Ms. Ericl<.son stated the shel.ter is only a temporary sol.ution and is just one
step in beginning to do somethin;. Before they can look at a family syst-em to
see ��ahat is tar�ng, they first have to stop the abuse, aud one raay of doing ehat
is to have the woman in a safe place. She stated she is a social worker for
Anoka County and does family and maxriage counseling, She �aill noti do marriage
counseling if,abuse is involved, because she canno� work on the rela�zonship
until the abuse has stopped. The shelter is just f:he beginaing and there is
a loC of taork to be done.
r1r. Langei�feld stated that c�hen you get involved with psycho-social situaeions,
he thought: the ultimat-e goal i_s to first meet the needs of the initial px�oblem
and then �;o after the preventzon. Iie felt I'ridley should be proud to provide
a service f-or this kind of tragedy.

Mx. Boardman stated this item had been tabled. At the reb. 27 meeting, the
Fridley P1«nnin� Commission had expressed concern about drainage and he would

request for a specia]. use permit to operate a business dealing with the

I Public purpose served by this requirement is to protect the building
fram unnecessar;/ maintenance due to vehicles hitting the building.
B. S7ATED HARQSHIP:
(1) Request building set back of 25 feet from 1ot line in two 1oa�ing
dock areas. Docks must be 10 feet wide for accessability, l.oss
of loading docks would preclude building of the preposed addition.
(2) Request a dect°ease in width of building curb to 2 feet in the area
adjacent to tP�e loadi ng docks . Use of 5 foot curb would resul t in
15 foot drive width; the addii;ional �vidth makes the docks more
readily accessible to truck use.
C. ADftINISTftAtIVE STAFF REVIEW:
(1} In reviewing the possible alternatives with the petitioner, the
petitioner decided that they were not acceptable. They were;
(a) Put the docks on the rear of the building (grade not feasible).
(b} Reduce the width so as to tuck the docks parallel to th�
addition and faee the docks west off th� existing building
(reduction in addition vaas not acceptabie).
(c} Eliminate the loading docks (both existing tenants need the
loading docks).
If the Qoard approves this item and item #2, •it will leave room
for an 18 foot wide dt`ive which vaill 1eave room for two vehicles
to r�eet. Therefore, we do not have any staff stipulations that
we t,rou 1 d recommend .
(2) If item #€1 is approved, �ve would recommend that item �2 also be
approved so as to provide an 1£3 foot driveway. The required 5 feet
is necessary wi�ere cars are parked into the curb. In this instance,
there will be nu parking along this curb.
The Peti.oneers were present. itir. Gustavsor� st�.ted that the
proposed addition requires loading docks both idortll, and South,
and to get the loading dacks they are short five feet on the
setback. He fu.rther stated that they are alsa requestin� a,
reduction in the curbing iror,i five to tv��o feet. The Co:nmission
members �.nd the petioneers then exax,lined the plans that they
have subr�iitted.
i�ir. Gustavson explained that they have a grindi.ng business,
and that the south half of the buildin� is an ice factory� and
that they are running out of sp�.ce and require more space.
i.'Is. Gabel questioned what buiZding �vere next to their business?
1�1r. Gustavson s�a�ed that on one side was the trailer park, and
on the other was Spiral .�:anufacturing, and Dick's Auto Parts.
IVis. Gabel questioned how does the traffic flow there? .
P�'ir. Gustavson stated that sorce large trucks go around� but that
most enter and leave on the side that they are dealing with.

-that is not the general rule, because �they might only have

i���s. Gabel questioned what type of business they were going
to have in the part of the building that would be rental?
P.1r. Gustavson stated that they have tenativel.y rented the
space to �.nother ,rinding shop, only they �vould do a different
type of grindin�.� This he stated would be a one, or two maX1
shop. He further st.�.ted that the only otner one they have
discussed it vrith was proposing to salvaging engines from
cars �.nd inst�.11ing thera in other auto:aobiles. i:ir. Gustavson
stated that they wauld prefer ta get another r�achine shop
in the rental are�..
PyTs. Gabel stated that she would like a clariiication on what
the rental side would be used ior in the case of en;ines.
Tti7r. Gustavson explained that right now Dick's is tov�ing
the c�.rs in but that he is not involved �vith the crushing, and
the junk yard business. He si�.ted that i�t was nis understanding
that �ick's was lool�ing for �, place to operate his towing
business.
P��! s. Ga,bel stated that `vh�t she w�.s looking at � was avoiding
any storage of junk on this property also, because that has
been a probler:-� in the pa.st.
P�ir. Gustavson stated that �this stipula;;ion of not storing any
junk ar excess car parts would have to be written into a lease.

would be provisions for inside storage af trash, with no out-

i+Ir. Gustavson stated that there is now }31ack Hills Spruce and
they would be putting in ced�.r trees along the retaining rvall.
He further stated that there are pla.ns to put in a privacy
fence.

the �ommission because ",�r. Langer was the Vice-Chairman of the

topic for the Commission. These items read as follows:

to this issue?
r�s. I�'�t;engzst stated tnat she felt that this needed to be
addressed, but since it ivas an ordinance already, she was at
this time undecided, on whether it should also be included
in the Charter.
M r. Breider stated th�.t he felt that a ethics code was difficult,
becausE h� fe1t� �h.at i�' someon.e �vanted to be dishonest, this
code would not deter him. Therefore, he stated that he felt
that the Charter need not inc�.ude an ethics code.
�Zr. Treuenf els stated that he f el� that some statement con-
cerning ethics should be put in �the Charter. He stated that
even if i� was a priil �sophical va.e�v, it should be put into
the charter� because then tYie City has sta�:ed a position towards
certain ethirs that they would expect from the officials of
the City. :;�r. Treuenfels further stated that they should at
least in.clude a statem.ent that if there is evidence of wrong-
doing� or misconduct� they coul.d �e removed from office.
1�2r. Breider stated that ther.e is now recall procedures that
are available to remove an offi�ial irom ofi'ice if it is so
warranted.

Mr. Schaaf s�:ated that something he felt tha�t could be included�
but that he also didn't feel real strong about� was a simple
disclosure statement.
P�Ir. Berg stated that he questioned whether disclosure state-
ments might not have a negative effect so�netiines. Because, �
he stated� these disclosurs's might not allow people with
certain interests� and holdings to have a decision making �
position in certain areas, in which their input could be used.
And also that it might de-�er some individuals from becoming
City officials� and or Comrnission members, just because of the
nuisance of going through a disclosure statement.
P�Iuch di.scussion ensued about the positive, and the negative
effects the present ethics ordinance has on the City of Fridley
officia.ls, and the need if any for any changes � additions,
or deletions.

Chairperson Liz Kahnk called meeting to order.
Motion: That the minutes of Feb. 4, 1980 meeting be approved as
submitted. Seconded and passed unanimously.
The chair informed the group that the Mayor and City Council had
re-approinted Jean Schell to another term on the commission.

Mr. Hill brought to our attention that a proposal has been made to
the City Council that either actual mileage be paid or a gas allowance
be made to members of volunteer city commissions.
Motion: That the Police Civil Service Commission supports some form
of reinbursement to volunteer commissioners and recommends
to the City Council that they consider paying for "actual
out of packet expenses" incurred by Commissioners. Seconded
and passed unanimously.
The proposed Police Corporal Job Classification was discussed.
rlotion: Move to makeproposed Poli�e Corporal Jab Classificati�n
part of the Fridley Police Civil Service Regulations.
Seconded and passed unanimously.
The proposed application form for the Corpor4l position was examined
and discussed.
The various alternatives for conducting the examination of candidates
for the Corporals position were discussed.
Motion: Moved that the Assessment Center process for examination of
candidates for Corporal's Position be utilized and that we
recommend to city council that the same Assessment Center
service that wi11 be used by the city for examinations of
Deputy Director Position be contracted. Seconded and passed
unanimously.
Mr. Hill presented a proposed format for �he "Notification of Police
Corporal Exam".

Motion: Move that proposed format for the notification of Corporal
exam be used. Seconded and passed unanimously.
Scheduling of notification and exam was discussed.
Motion: Move that tentative exam date be between 4-1-80 and 4-15-80
and that cut-off date for receipt of applications be 2 weeks
before that date. Seconded and passed unanimously.
Mr. HiZ1 distributed to each member a preliminary draft copy of
report entitled "The 'I�ain Cities Suburban Police Office Selection
Standards Study".

The 3 million gallon water reservoir on 61st Avenue was drained and
inspected on March 27, 19£30 for the first time in 13 years. Investigation
r.evealed substantial spalling of concrete and paint on the interior.
The concrete walls require patching and sealing to prevent further
deterioration of the structure. This work will take approximately two
months and should be accomplished prior to stmimer when the water
demand starts to increase.
A resolution to the City Council has been prepared to obtain approval
to repair the water reservoir, now whi].e it is still empty and before
our water demands increase. The cost of this work is estimated at
$20,000.00. Funds are available in the Public Utility Fund.

WHEREAS, the 3 Million Gallon Reservoir is blistering and extensive

WHEREAS, the Public Works Director has submitted plans and specifications for
the above described work;
For immediate repairs and improvements for THE 3 MILLION GALLON WATER STORAGE
RESERVUIR
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Fridley,
Minnesota, as follows:
l. Such plans and specifications, a copy of which are attached hereto and
made a part herof, are hereby approved.
2. The work to be performed under Project # shall be performed
under one contract.
The Public Works Uirector shall accordingly prepare and cause to be inserted
in the official newspaper advertisements for bids upon the making of such
improvements under such approved plars and specifications. The advertisement
shall be publisi�ed for two (2) weeks (at 1east 10 days), and shall specify
the work to be dor�e and will state that bids wi11 be opened at 1:00 p.m, on
the 30t�� day of April, 1980 in the Council Chambers of the Gity Hall, and
that no bids will be considered unless sealed and filed with the City Clerk
and accampanied by a cash deposit, bid bond, or certified check payable to •
the City for five per cent (5/) of tne amount of such a t�id.

Our towing contractor, Shorty's Towing, has requested a fifteen
percent adjustment in the current towing rates due to inflationary
factors. Roger Schuur stated in a phone conversation that most of
his business is in interstate commerce and that the Federal Government
has just authorized a thirteen percent surcharge to be added in
interstate work.
A survey of four adjoining cities on 1980 towing contract rates
reflects that Shorty`s rates with a fifteen percent increase would
be about equal to the.four cities. A fifth city, Columbia Heights,
would be below the increased rates, however Colum}�ia Heights is in
the second year of a two-year contract and two attempts have been
made this year to break tYie contract by their tower.
Virgil Herric}: has advised that the City may accept th.e increase
without rebidding if that is Council's desire, which would be my
�ecommendation.

Please be advised that on March 17, 1980 bids were opened for the
purpose of securing a contractor to perform tree removal services for
the year 1980. As you will observe on the attached bid sheet, Bredwell
is .the apparent low bidder. After checking past performances by the
� contractor and carefully reviewing all specifications, we would
. recommend that the City Council award our 1980 tree removal contract
to this company. .
For informational purposes, the City of�Fridley will once again
be participating in the 1980 Shade Tree Disease Control Program.
For the year 1980, the City wiil be reimbursed 47.4% of all eligible
sanitation and reforestat�on expenses. We will also be reimbursed
90% of .all costs incurr2d for tree planting after the first 50 trees.

As per'my earlier discussion with the City Council, the above
lawsuit has been settled for Che sum of $55,OQ0. It is agreed
between the two defendants that this sum will be paid equally.
Therefore, I am requesting a check from the City in the amount
of $27,500 Co be paid jointly to A.3. Chromy Construction Co.
and Western Casualty and Surety Company. Upon the transmittal
of this check to counsel for the defendants, I wi11 obtain a
release of the claim and a dismissal of the lawsuit.
I would appreciate it if you would put this claim on the next
council agenda.

As you are aware, we have been negotiating with N:r. Quereshi for the park fee or
dedication in regards to Blomberg Estates. Our last meeting was with Mr. Quereshi
and N.r. Herrick and at this time I would like to propose it to the council:
I. Our grading and drainage plans have been revised and submitted to your
engineering dept., and Rice Creek t�Jatershed. Rice Creek 4Jatershed has scheduled it
for Narch 26, 1980. At this time it appears to be satisfactory to the city.
II. In lieu of park fee, dedication of three (3) outside lots wi.th conditions
as follows:
a. assessments to be applied overall parcel and against each lot equally�
to the 37 remaining. This excludes the dedicated Tand to the city and
the one for drainage.
b. this dedicated land may be used for park purposes, or if it is found it
is not needed as such, it may be sold to the public� with the proceeds
to be put into the park fund.
c. If the land is sold, any use or structure must be within the covenants
of builcli.ng as specified by B&G Investments for Blomberg Estates.
d. If the lanci is sold� it must be marketed through Tom or Karla Blomberg
at Sundial Realty, Inc., with the conmission for such sale not to
exceed ten percent (1�) .
IIT. The land exchange between developer and Mr. & Mrs. Leo Heyne has been agreed
upon and is ready to set in motion.
We hope that this will satisfy the Councils needs and thank you for your indi.vidual
time and effort.
