APPEALS COMMISSION MINUTES F MAY 27, 19F30: A. RE UEST FOR VARIA!CE TO REDUCE REFlR YA,RD SETBACK FOR QUIIDIlG ----------------- AT 5750 P1AIi SiRFFT_ PART (1F PRPf1CFn TuQG aiiri nrnic rnnn'n v Mr. Flora, Public Works Qirector, stated the Rauenhorst Corporation is lasining three large buidings in this area, with two facing Main Sreet and one building abutting i:he railroad tracks. Mr. Flora stated a variance is requested fer the rear building, which would abut the tracks, to reduce the rear yard from the required 25 feet to 21 feet. He stated the Flppeals Comtissian has considered this variance request and r•ecommended apprnval. Mr. Flora stated, if the Council approved the variance, it is recom;ended , there be two stipulations, (1) increased landscaping along the front facing ' the residential properties and (7_) an underground sprinkling system. Ms. Michelle Foster, r•epresenting Rauenhoi°t Corporation, stated she 1YdS not sure what was meant in tlie stipulation for increased landscapiny. She stated ' a landscaping plan was submitted several months ago ar.d, 6ased on coinmerts from the City stafi=, the size was increased and another plan submitted. She stated, if this landscaping plan is acceptable> then the stipulation would not be a , prablem. . Mr. Flora si:ated the plan was received i:hs afternoon and staff is presently ; reviewing it and felt so:nething can be worked out. . _ _ _ 0 .i. f! ' REGUL/R MEETING OF JUNE 16, 190 PAGE 3 Mayor tJee questioned the truck r•r;ute and P.s. Faster stated they assume nost of the truck traffic would go to I-694. Mr. Flora stated, as far as the drainage, the City has a plan from Rauenhorst for a retaining pond. Ms. Foster did submit a s4;tch of the praposed develonient and stated they wou]d make the bui7dings as attractive as possible for the neighbornood. P10TTON by Councilman Fitzpatrick to concur with the recommendation of the Appeals Comrnission and approve the variance request to r,educe the rear yard setback from 25 feet to 21 feet with the stipulafions that the pei;itioner submit an acceptable landscaping pian, includng a sprinkling system, to the City Engineer. Seconded by Councilwoman Moses. Upon a voice vote, all voting aye, Mayor Nee declared the motior, carried unanimously. B. RESUEST FOR VARIANCE TO INCREASE SIGN SI7_E TO A(_tJ ADDITIOfd OF MESSAG[ I30ARD, 6881 HIGNWAY 65, EUGENE KREUZKEfPER; Mr. F1ora, Public 4forks Diractor, stated the 150 square foot sign for this estaU7ishment was allowed by a variance granted in 1969. He pointed out tlr. Kreuzkemper has added a modification to the existing sign by adding a 4 x 5 foot reader board which makes a total area of 1700 square feet. Mr. Flora stated Mr. Kreuzkemper purchased the sign and became aware he was in vioiation of the code, after it was instalied, and has requesi:ed a variance. He stated the Appeals Commission.has recommended approvai with the following stipulatios: (J.} That the variance will terminate on July 1, 19f31, at which time the message board will be removed, and is not renewable: (2) That if the motel is sold, the messa.ge board must be removed immediately; and (3) That the 'color 7V' sign nay not be replaced or reinsi;alled. Councilman Schneider stated Pr. Kreuzkemper ,uchased this matel last year and questioned if there was any reference made to the size of the sign when he purchased it. Mr. Kreuzkemper replied in the negative. Councilman Schneider asked F4r. Kreuzkemper if he was reasonably in agreement with the stipu7ations recoinmended by the Appeals Commission. Mr. Kreuzkemper stated he would prefer a little more time before the variance would terminate so he vaould realize some use from the investment made in the sign. Mr. Kreuzkemper felt, 6ecause of the landscaping behind it, the sign does fit in and in no way does ii distract from i:he property. 1ie stated, when he took down the sign regarding the color T', this nev sign was hung by the same brackets between the pylons. 6ouncilman Schneider asked t4r. Kreuzkemper ahat he felt rrould be a reasonable time before the sign had to be taen dovn. Mr. Kreuzkemper felt he would like to be able to keep the sign up for a least two years. Councilman Schneider stated, in this case> the sign doesn't seem out.of scale relative to the neighboring structures. He felt the message board really didn't expand the size of the sigrr and would be comfurtable with a date of July 1, 19II2 fo° removal of the sign. Councilman Fitzpatrick as{:ed if ti}e sign was already installed and if the company he purchased it from was licensed in the City to erect the sign. Mr. Kreuzkemper stal:ed he installed the sign himself and used the same brackets and electrical box ttiat was used for the "color TV" sign. C.ouncitman Schneider stated he is concerned about the people who sell the sign and knoingly violate the ordinance. ; i i i REGULAR MfTING OF UNE 16> i980 PGE 4 MOTION by Councilman Schneider to yrart the variance to increase an existing siyn oi' 150 squa°e feet to 170 square feet by a11ow}ng the addition of a 4 x 5 foot message board to be added to the existing siyn at b8f31 Highway 65, aith the Following stiulations: (1) That the variance vrill terminate on July 1, 1982, as opposed to July 1, 19H1 which was recommended by the Appeals Commission, at which time the message board will 6e removed and is not renewable; (2) That if the motel is sold the message board must be remoued immediately; and {3) That the "color TV° sign may not be replaced or reinsta1led, Seconded by Councilman Qarnette. Boardman, City 7anner --- - MEMO N0: #80-63 MEMO DATE: June 30, I980 • RE: Condo Conversian ' A question was raised pertaining to condominium development of public lands such as.the unused sciool buildings. The City presently has suffi- cient control in its zoning code since condo's are conrolled by residen- tial disiricts which sets residential desity. This stiil aliows City .-V` Council controt on all residentiai property if.densities dan't comply with aliowable densities. Where we lack control at this point in time is when a deveioper wants.. to convert existing rental property to condominiums, which is not altogether a bad situation, unless it depletes the available rental stock that is avail- abe to low and moderate income residents. These people are usuaily limit- ed in the options available to them in order to provide adequate housing and can`t compete in ownership market. . The State, with their condomin.um acfi, restricts the City's control on convers9on to the condom7nium form of ownership by making ordinance control subject to two tests: . . . Mr. Harris asked Mr. Swanson if he would like to make a statement. Mr. Swanson stated he has tri.ed to operate within the City Zaws andguidelines for the past eight years, and he will continue to do so. Tf there have been any problems, he has never heard abou them, and he has been complimented by the City ior some of the things that he has done such as plantings, shrubbexy, eCc. - Mr. $oardman stated that Staf has reviewed this and sees no pxoblems. Mr. Swanson has done everything he was supposed to do within the stipulations of the special use permit. He would recommend hat the Planning Commission grant the special use permit and not put in any stipulations of review on the special use permiL-. The Energy Commission, at iast night's meetin, again requested action on the proposed policies that wre sub!nitted Lo the City Council. .They are upset with the lacl: of action on the Councl's part and are willing ta make modifications as necessary, but want the Council or staff to tell them what is requireci to get the policyadopted. I feel that if tiere is no actionar support from the City Council for some policies, the Energy Commission as a wholE may resign.
