PLEDGE OF ALLEGIANCE: � ' Mayor Nee led the Council and audience in the Pledge of Allegiance to the flag. _. . . . ROLL CAI.L: MEMBERS PRESENT: Mayor Nee, Counc.ilman Fitzpatrick, Councilman Schr�eider and'Councilman Qarnette - Cou~icilwoman Moses (arrived at 7:55 p.m.) MEh16ERS ABSENT: None I�tayor Nee stated Councilwoman Moses would be late for this meeting as she was attending a community neighborhood meeting. PROCLAMATION: Ms. Norma "Buzzy" Hansen appeared before the Council to request the i5suance of a prociamation proclaiming National Clown Week, August 1- 7, 1980. Ms. Hansen stated their organization is approaching communities in Anoka County re��uesting issuance of proclamations for National Clown Week. Ms. Hansen was dressed in her clown�attire and introduced fellow cloNms, Spongy and Munchkin. She stated they have appea�°ed in events in �ridley including the 49er's parade, Unity Hospital and at the nursing homes. _ MOTION by Councilman Schneider to appr•ove a proc'.amation proclaiming the week' of August 1- 7, 19IIQ as National Clown Week. APPROVAL OF MINUTES: REGULAR P1EETING, JULY 21, 1980: Councilman Schneider asked if on Page 3, the third paragraph, there should be some i°eference made that there is an existing house on the lot. Leonard Lind, 1620 75th Avenue N.E., appeared before the-.Council concerning road restrictions in the City. Mr. Lind stated he was not satisified with answers he has received and would like to submit his questions in writing for a response from the City. ' . ' NEW SUSINESS: CONSIDERATION OF 1981 PRELIMINARY QUDGET INCLUDING REVENUE SHARING AND SET7ING PUE3LIC HEARING FOR SEPTEMBER 15, 1980: Mayor Nee stated the City Charter requires the City Manager to develop the budget and this is done through conferences 4rith the Council and administrative personnel. h1r. Qureshi, City Manager, stated the proposed budget is $6,262,842. He stated there is a reduction in some of the special grants, such as community develop- ment and selective traffic enforcement, which were received in the past years. Mr. Qureshi stated the budget proposed r�ould essentially sustain the level of services, with slight emphasis in the areas of police and parks and recreation. He stated, when the pubiic hearing is held, a detailed analysis of the budget would be given. MOTION by Couacilman Fitzpatrick to receive the City Manager's proposed budget for 1981 and set a public hearing for September.l5, 1980. Seconded by Council- man Barnette. Upon a voice vote, a11 vating aye, Mayor Nee declared the motion carried unanimously. RECEIVING THE PLANNING COMMISSIOtJ MINUTES OF JULY 23, I980: IDERATIUN_DF SPECIAL USE PERMIT, SP OW;GQNSTRUGTION OF Mayor Nee stated Councilwoman Moses has requested this item be deferred until she arrives at the meeting. IDERATIO� OF REZONING REQUEST, ZOA �80-03, TO REZONE FR�M R-3 TO'C-2.• MOTION by Councilman Fitzpatrick to set the public hearing on the rezoning request for September 15, 1980. Seconded by Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. SIDERATION OF REQUEST FOR SPECIAL USE_PERMIT, SF �'80-08, TO ALLOW "ITY h�OTION by Councilman Fitzpatrick to consider this special use permit request, SP #80-08, after the public heariny and consideration of the rezoning request. Seconded by Councilman Schneider. Mr. flora, Public Works Director, stated there is a special use permit request for Lot 21, Block 6, �r�idley Park and also a specia7 use permit request for lots 22, 23 and 24 of Block 6, Fridley Park. He stated the Council has called for a public hearing on Septe+nber 15 to address the question af rezoning Lot 2I and then, in order to have an auto repai'r shop in a C-2 zone, a special use permit is required. He explained the second issue is the additional three lots, as there was a request to rezone these lots also to C-2, but the Planning Commission recommended they remain as R-3 and a specia1 use pern�it be gi.ven to use them for parking. Councilman Fitzpatrick stated the rezoning hearing will presumably be for all four lots in question altnough the recommendation from the Commission is to rezone only Lot 21. CONSIDERF�TION OF LOT SPLIT RE UEST, LS �;80-04, TO M?�KE NEW 6UILDI�JG SITE, 5775 - 2-'z STREET, D&[ CONSTRUCTION: Mr. Flora, Public Works Director, stated this rPquest is to split off the South 14 feet of Lot 7 and add it to Lot 6, alock 26, Hyde Park in order to make a new building site. At this time, 7:55 p,m., Councilwoman Moses arrived at the.meeting. MOTION by Councilo�an Fitzpatrick to concur with the recommendation of the Planning Eommission and grant Lot Split, LS �i80-04. Seconded by Councilman Qarnette. Mr. Qureshi, City Manager, stated if this property has not paid the appropriate Water, Sewer and Storm Sewer assessments, they would pay their proportionate share. t+lr, lee Ekenberg, representing D& E Construction, stated they have taken soil borings on the iot to determine if it is buildable and the struct«re proposed conforms with all building codes. Mr. Ekenberg explained the reason they i,�ant the additional 14 feet is in order to meet the code requirements. He stated they have a 24 x 40 foot house planned for this lot and, under the Housiny and Ur�ban Development 235 program, they wouTd be putting in a driveway, but no garaye would be built at this time. Councilwoman P1oses questioned the requinement for a garage, since this was required several weeks ago when another app]icant was bu9lding a new home. • Mr. Qureshi, City Manager, explaiiizd this lot was �iatted before the ordinance adopting ti�e yarage requirement, therefore, the �ni;� requir�ment would be for a driveway and off-street parking pad. � Councilman Schneider asked-�if Lots 7 and S, with removal of this 14 feet, aiould remain legal 7ots. Mr. F7ora stat�d, they do meet the square footage rec,uire- ments, but are short one foot on the front footage. Councilman 5chneider questioned if it would be better to have a 13 foot lot split and then grant a�dariance for reduction of the lot size. Mr. Qureshi, City Manageri; stated; in lots that are platted before 1955, 'there is iower front tootage�requirement, whfch would be the case in this instance. Mr. Qureshi pointed out this is an area where the City has had drainage prob7ems. CONSIDERA7ION UF LOT SPLIT RE�UEST, LS #80-•05, TO MAKF NEW BUILDING SITE VACATED ORD_371 , 5750 - 3RD STRE[T, FDWARD S. JONAK: _ Mr. Flora, Public Works Director°, stated the o�vner of Lots 4, 5, and 6,�Block 2, wishes to split off the North 70 feet of these lots, including a17 that part of 67-Z Avenue N.E. (vacated, ordinance 371), City View, to make a new building site. Mr. Flora stated a utility easement would have to be vacated, and the petitioner is requesting a waiver of the vacation fee. r---- � )�`L i ; � � REGULAR MEETING OF,AUGUST 4, 1980 __,. PAGE 4 Mr. Qureshi stated the City is reguired legally to publish notice for vacation and the fee is to pay for these costs. Ne stated he would recommend the fee not be waived as he felt, if there is a new building site, there woul�! be a sizeable increase in the value of the property. Mr. Qur�shi felt, at the time of the public hearing, there should be a proposed plan showing the layout of.the house on the lot. ITEM FROM APPEALS COMMISSION MINUTES 0�= JULY 15, 1980: REQUEST FOR VARIANCES TO REDUCE SIDEYARD AND DRTVE4IAY SETBACKS TO ALLOW CONSTRUCTION OF PdEW DRIVEWAY, 7645 QAKCR STREET, R.M.S. CO., INC. Mr. Flora, Public Works Director, stated this is a request for a variance to reduce the side yard setback from 30 to 25 feet and to reduce the driveway ' setback from 5 to 0 feet to allow the construction of a new driveway on Lots 5 and 6, Block 1, Nagel's Woodlands at 7645 Baker Street. Mr. flora stated, in processing this request, a number of deficiencies were identified such as no concrete curbing, lack of screening, and arrangements for prnper drainage. Mr. Flora stated the petitioner agreed to install a concrete curb along the existing driveway and also along the new driveway and to provide additional landscaping. He stated staff is currently working with him on developing a ponding area, to the rear of the building, which would control the water in that area. Mr. Habig, representing R.M.S. Co., Inc., stated the owner of the properiy to the South was at the Appeals Commission meeting and had no objections. Mr. Habig stated, with the new driveway: it would enabie semi-trailers to drive-thru since it is now impossible for them to turn around. Councilwoman Moses qu�stioned the location of the holding pond. Mr. Habig stated most of the ponding area would be on Lot 7 and a small port�on on Lot 6. He stated i:his was the reason the owner of Lot 7 was at the Appeals Commission meeting and it was agreeable with him. Mr. Habig presented a drawing showing the proposed ponding area. Mr. Qureshi, City Manager, stated the variances could be approved with the stipuTation that ihe drainage pr�blem is resolved 4rith the City and the Neigh- boring property owners. He stated there should be an additional stipulation that Lots 5, 6 and 8 be tied together and an agreement tf�at no portion of these properties would be sold separately, uriless the City is notified and approval obtained. These are {1) That the building be used for storage and as a garage for parking cars; (2) That there be no automotive body or engine repair done on the property as a home occu- pation; (3) That the property should not be used for retail sales of automobiles or automobile accessories; and (4) That ttie lots shall be legally tied iogether and any separate sale of the lot will require }ot split approval by the City. Councilwoman Moses asked Mr. Christenson if he had ar�y problem with the above stipulations. Councilowman Moses stated that legally the City can't have a lot that only has a garage. � Mr. Christenson stated he didn't want the two lots combined as the vacant lot is all paid for and he has a mortgage on the other lot. _� Mr. Herrick, City Attorney, stated the �nly way the City could grant a special use permit for the garage is if it is an accessory building to a main building. Mr. Herrick stated joining the two lats wouldn't affect the mortgage, but would require Council approval before he can sell the lot independent of the oiher lot.. Mr. Qureshi, City Manager, stated a document would be filed on the lat; where the proposed garage would be located, to indicate the. lot cannot be sold with- out prior approval of the City Council. Mr. Christenson stated tie would have no problem 4�ith this requirement. Mr. Christenson stated if he didn't need a lot split, he would have no problem with getting approval from the Council before he sells the lot. Mr, Qureshi stated the City didn't want a lot with a garage only, but wanted to make sure there avould Le a structure or� the lot to gc� wtih the garage. Mr. Herricn stateci an agreement should be entered into with the petitioner and this filed with the deeds on both lots so that if a potential buyer were to examine the abstract, he vaould find tht�re is an agreement tf�at the lot cannot be sold �,�ithout obtaining a.pproval from the City Council. Councilwoman Moses asked Mr. Christenson if he had any problems with the other stipulations recommended by the Commission. Mr. Christerson stated he had no problems witfi these stipulations. • � Mr. Myron Sjostrom, 6240 Starlite Blvd „ a neighboring property owner, stated he would prefer to see the garage constructed in order to house the vehicles. Mr. Brunsell, City Clerk stated, to the exter.t possible, election judges are selected from the lists submitted by the political parties. He also stated if there are not sufficient names on the lists, then previous lists are used for selection of the judges. Ne pointed out there will be sone additional openings, so if anyone has names to submit, they should be turned in. Councilwoman Moses questioned if there is normally an equal number of both Democrat and Republican judges. Mr. Brursell stated, to the extent possible, there should be an even number. POWER OF OFFICERS Whenever in thejudgement of a City officiat, designated by the Cify manager, it is found by investigation that a pu6lic nuisance is being maintained or exists on property within the City. The foltowiny procedures shall be follo�ved to abate the nuisance. Written notice shall�be issued to the owner or occupant requiring the termination or abatement of said nuisance or to remove such conditions or remedy such defects. Service of said notice shail be in person or by mail. If the premises are not occupied and the address of �he owner is unknown, service on the owner may be made by posting a copy of the notic:e on said premises. If the nuisance is not abated witi�in 10 days of the date af said notice, the City official shall iss.ue an ordinance violation citation to the notified owner or oocupant. 1C Page 2 -° ORDINANCE NO.. 110.03. Qn August 5, 1980, I met with Mrs. J. Kubiatowich ta gain info�mation as to the exact nature of the complaint. I also spoke with Mr. Kubiatowich by phoneo Th�y �r�ere upset that the City could�a]Tavr a vacart bu�lding to stand boarded up, plus the storar�� of mo�or vehicles on the lot next to them. They reporte� �iiat Mr. Phillips, ow��er af 1632 Rice Creek Road, �oes keep the grass moweda . I told them that I thought, under� our present codes, it might be impossible to cite a legal violation; however, we would try. to contact Mr. Phillips and re- quest that he either remove the vehicles, or park them in a more orderly fashion� On August 6th, a lett�r was sent to Mr. Phillips asking him to meet me on August 13th at 1:30 p.m. (letter attached). I visited the site at 1:30 p.m. on August 13th, an� h9r. Phillips was not there. He has the property posted NO TRESPASSING; therefore, I did not enter the site. I conducted a visual review from both streets and from Mr. Kubiatowich's property, which �nabled me to view all of his property� Following is a report of this . inspection: ' � There are four licensed'vehicles parked on the premises. The house is boarded up and appears not to be lived in. The grass was probably last mowed a week to ten days ago. The lot did not have any debris on it, and evergreen shrubs and trees are planted and growing around the perimeter of the site, on the north and west sides. � There are no apparent violations to our Code evident. I suggest that we write Mr. Phillips another letter an� request him to place the four vehicles together in one spot, and continue ta mow the grass at regular intervals9 also, explain that he might consider removing the structures, divide the lot into two building sites, and either bui]d two new homes or se11 the lots to a developer. He asked what "today's junk problems" were and how those probiems would be hanclled. � Mr. Deblon stated that the Citp Council, through the Public Works Director, has expressecl a desire to upgrade and toughen up the Junk Ordinance. In respaase to that request, input. and ordinances were solicited from adjacent communities -to see how other communities handled their junk pzoblems. A new draft of t�ie junk ordinance is being put together at this time. He stated that, for exaciple, with today's energy situation, peaple may tend to hang onto junk cars longer for parts, so those kinds of things could become p?-oblems. Mr. Saba stated that a lot moxe people are going to be staring materials for recycling; and unless the Eity pxovides a place for that storage, peogle are goirig to store it in their backyards. Ms. Hughes stated that Mr. Saba had brought up a good point: She €elt they should caution those re�aritin� the ordinance, that they take into cansideration recyclable materials or tnings that are�being accumulated for.recycling. Ms. Schnabel s�ated that in regard to the revised junk ordinance, she was concern.ed that the City not get into the policy of harassing the business ,, _ people in the City simply because it is easier to enforce the ordinance on them than it is the homeowners. The businesses provide services to the residents Qf the City, and if they drive them out by harassing t&iem, the City is doing itself a real disservice. Mr. Harris stated that in Mr. Deblon's memo to Mr. Boardman dated June 18, 1980, Mr. Deblon referred to Section ��2, "Capital Improvement Program - for transporta- tiori, sewers, parks and open space facilities".' They finally got approval from the Federal Government on last year's request for iunding for $1�8,000 in park monies and that money is now available. Thay just went through a preliminary on thzs year's LAWCON fu�dzng. They are not sure what is going to happen on that at the federal or state level, but Fridley ranks ��4. It looks like they will probably be available to receive in the range of $200,000 for next year if the funding holds up. At this point in time, that funding has not been dried up. CDBG funds are not dried up yet; however, he did not foresee a lot of funding coming to the city for parks and recreation. The more and more they get into CDBG's, the more and more they have to relate it to low and moderate income housing. If they don't relate it to a 14CP/, benefi� for those people, they don't generally get the funding. � - Mr. Harris stated the last aZtexna�:ive is a local bonding issue. Did Mr. Boarciusan have a feeling at this point in time of about how many dollars they would be talking about for a bond issue �o camp]_et� the project? Mr. Hazris asked if a public hearing was nec�essary for the Implementation Section. Mr. $oardman stated he felt the Planning Comanission should have a public hearing on the Implementation Section at their first meeting in September. That would give the Commission one more meeting for review of the Implementation Section.
