RE: FAMILY DAY CARE CENTER
DATE: DECEMBER 4, 1980
The City of Fridley has been asked to waive a requirement of the
Life Safety Code relating to the type of locks that may be installed
on doors. Section 5-213 of the Life Safety Code provides:
"A door shall be so arranged as to be readily opened
from the ::ide from which egress is to be made at all
times whe*� the building served thereby is occupied.
Locks, if provided, shall not require the use of a
key for operation from the inside of the building."
IL -is my ui,�cr�;.aading that this provision aYY2ies to a11 - -`° -�° -°~�
dwellings, including group day care homes, unless specifically
exempted by the State Fire Marshal. I further understand that no
exemptions have been granted. Therefore, it is my conclusion _
that this requirement applies. •
The Zife Safety Code is a code adopted by the State of Minnesota.
The local fire marshal is acting as an agent of the State Fire Ma.rshal
in enforcing this code. A question arises as to whether the City
Council should be the authority to grant a waiver. Inasmuch as the
code is a State code, I am of the opinion that the CiCy Council should
not grant such waivers.
It is my understanding that there is a procedure whereby the applicant
may apply to the fire marshal of the designated state agency for a waiver.
It would be my recommendation that the Council deny the request and
advise the applicant to seek a waiver through the state agencies.

Fridley, Minnesota
The Fridley Housing and Redevelopment Authority (HRA) has previously adopted,
and the City Council has approved, a Redevelopment and Tax Increment F'inancing
Plan for the City Center area. This plan provides for HRA acquisition af
property within the redevelopment and tax increment district and resale of
the property for private redevelopment. ;
Working with Mr. Jerry Boardman and Mr. Sid Inman, we have determined the
financing needed for acquisition of property in the redevelopment and tax
increment financing district. Exhibit 1.00 shows the structure of the bond
issue, with land acquisiiion costs, cost of the bond sale and discount
allowance, resulting ii� a total bond issue of $2,20G,000. The computation
of tax increment avail�ble for debt service is shown in Exhibit 2.00. Due
to early action in establishing a tax increment district, the increment from
the Village Green devFlopment has been captured, and will be used to pay the
debt service on this issue. The increment shown in Exhibit 2.00 is currently
being received by the tax increment district and does not rely on any
anticipated future development within the district.

pay the debt service or the bonds. This coverage is shown in Exhibit 2.10
detai)ing the cash flow of the project and showing tha� in each year the
tax increment plus investment earnings will pay for debt service assuming
the current property tax structure remains in effect.
We have worked with bond counsel in structuring this issue to comply with
all legal requirements, and it is our opinion that the praject is financially
feasible.

The request for a temporary ban on no parkir.g by Mr. Robert M.
Bryant has been reviewed. I offer the following comments
regarding this request.
1. There is unrestricted parking on adjoin_,ng streets of Cheri
Lane, 54th Aver.ue, 5300 Block of 7th Street, and the 5400 Block
of 7th Street, north of Cheri Lane. .
2, The request is apparently predicated an convenience rather
than necessity.

3.. Both sides of the 5400 Block of 7th Street, South of Cheri Lane,
are posted rio �arking. The parking ban is not required for
public safety reasons.
Recommendation:
l. That the request for a temporary ban be denied. Approval of this
request would set a precedent for reasons other than necessity.
In addition, request from any apartment renter living across the
street should then be honored.
2. Serious considc:ration be given to removing the no parking signs
from either or both sides of the 5400 Block of 7th Street,
south ot Cheri Lane, to accommodate the residents in this area.
