Mr. Eioardman s±ated this property is located south of G94 on University Ave.
He stated tl�er2 is a short �'ead-end service road that cul-de-sacs right along
University Ave. 7his property is �resently zoned R-3. It is just north of a
C-2 dist��ict which is presently occupied by a Standarci Station and a gas pump
repair service facility. Qehind this property is R-3 proper�y ��hich is multiple
family and some single faiuily. South of 53rd Ave. in Columbia Neights is all
commercial along the service drive. Across University, north of 53rd, is all
R-1 and south of 53rd is R-3.

i�r. Boardman stated that the�ubject property is a little awkward in shape
and there was a little difficulty in fitting in the structure Dr. Schurstein
is proposing. The structure Dr. Schurstein is proposing wi71 have to go for
variance; hovrever, he is bringinn it befor2 Planning Commission to see if he
can get rezoning befare applying for a variance or� the buiiding.
Mr. Boardman stated that th�ere was a rezoning action on this property back in
1971. At that time, the petitioner was �sking for rezoning to C-2 fur an
office structure. At that time, Pianning Commission recommended approval for
the rezoning, City Council recommended approval for rezoniny. They had the
first reading on it and were holding the second read�ing for the Building Committee.
The application was then withdrawn because the financing was bad, and they could
not build the structure.
Mr. Boardman stated that Dr. Schurstein does have plans for a two-story office
structure. It is a difficult site because it is a triangular site. He stated
he has worked out the parking with as few variances as possible.
Mr. Lawrence Zimmerman, 5380 - 4th St. N.E., stated he wanted to knokt what was
proposed for the alley that was behind the property.
Mr.. Boardman siated they did have a problem with the a11ey that is right behind
the parking lot. There has been some talk abaut vacating the alley, but there �
are too many garages off the alley. He stated the alley may have to be improved
beca�se there are a 7ot of garages on the alley, especially further down by the
Standard Station. �
Mr. Harr�s asked if the petitioner wished to make a statemeni at this time.
Dr. Schurstein stated he h�s been thinking of different thinys for this lot far
a couple of years. When he first started, he was interested in an office/
resident complex, but there is a problem with financing something 7ike that.
7hey are now �pplying for rezoning the property to commercia7. Itt the last two
years, commercial has been more iikely to recPive financing than housing.
It would be terribly expensive for housing because of the odd shape of the lot.
Ne stated he would like to see this property developed, and that is why he has
conie before the Planning Commission to try to get a zoning change.
Mr. C. Schurstein stated that based on projections right now, they are looking
at a re�urn on the�r investment that ��ould be economical to build the building
and they are also pianning on building a substantial buiiding--probably a
precast building so the longevity of the structure itself will be easy to look
at and will be an asset to the area. They feel the proper�y has some con�nercial
val ue.
Ms. Hughes asked if tttey had any idea of what kind of tenants they would have.
Mr. C. Schurstein sta±ed they are planning on having tenants that are professionally-
oriented--atto7�neys, insuranc� companics, dental offices, medical offices, etc.
They are not looking at a drugstore or retail outlet.

Mr. C. Schurstein staied they feei it is an adequate p1an. 7hey feel there
is a good opportunity for certain types of investments and that the building
is in a class that would generate enough interest because of its size and cost.
They feel very confident that, given time, they can finance the building: He
stated he is a real estate broker so he does know so�ething about the business.
Ms. Gabe� asked if they had any idea how many tenants they would have in the
building.
Mr. C. Schurstein sta�e� that would depend on th� type of tenant. A regional
insurance office may require 3,000 sq. ft., while a doctor or dentist may
require only 1,000 sq. ft.
Ms. Vagovich, 5400 - 4th St. N.E., stated she has talked to most of the
neighbors, and they are all in favor of an office building as opposed to having
an apartment bui�ding.
Ms. Hughes stated that with the rezoning to CR-1 and with R-3 next to it, there
would have to be a fence, and the variances seemed qui�e simple. It seemed to
her that the noise impact f rom the highway was such that they would never want
to put residential in there. The office buiiding and the fencing could be of
real benefit to the neighborhood as far as noise. She co��d see no prob��ms
and felt the rezoning request was a reasonable proposai.
Ms. Gabel stated she could see no reason why anyone on the Appeals Comrnission
would have any probiem with it.

south of this si�e. Tliis cti�ould position the building approximately 15 feet
afE the front lot line at� the north,�rest� coxner and give a 20 foot rear yard
(both dir,iensians are scaled) .
Vice Chairwoman Gabel stated that t�l� ; z.�a ;�een t�e:`ore t.'ze Planning Commission
on 12/17/80 for rezoning. Mr. Clark stated that there were several neighbors
at that hearing and it appeared that most of them would rather see it developed
into an o�fice building rather than an apartment building. He said it would be
better to encroach in tIie front yard, that it could be pushed forward 15 fezt
and line up with the building to the south of it. Vice Chairwoman Gabel stated
that she was at that public hearing and verified that the residents prefer
an office building rather than an apa-rtrnent build?ng. Mr. Clark said there are
thz'ee variances - parking lot, front yard and rear yard. Iie also said that part
of the zoning requirement Cwhen you have commercial, next to residential) is to
have fencing that has to be 4 feet high.
Dz. Schu�stein said he has owned the land for 2-1/2 years•and the building will
have 9600 sq. feet (4E300 sq. ft. each level) and there �aill be no barber shops or
beauty parlors. He has t���o tentative instirance tenants. Vice Chairceoman Gabel
asked hocs soon he would start construction. Dr. Schurstein he had to get rezoninc�
and the. variances be£ore hE could approacYL financing. Mz'. Fiomer Melton, 5334
4th Street N.E,, was present, and suggested �hat Dr. Schurstein's fence match
the fence of the structure to the south, �ahicfi is a 6 foot waod fence. He said
they have a lot of problems with kids and their motor dirt bikes in the alley
and he came mostly to find out �ohat is going to happen to the alley. Vice Cliair-
woman Gabel informed him that he and his neiqhbors could come before the eity
Couneil about the alley and that nothing will happen without notice of a public
hearing. Mr. Clark agreed that the Council �aould have to make a decision on

Mr. Roardman stated he had met with tilinfield Qeve7opments, Inc. He stated
they have drav�n up a new development as suggested by the Planning Commission
at their last meeting. They have split the building. They are proposing that
the buildiny�on the north remain commercial zaning, and the building on the
south go to t�l-1 industrial. There are 40 fcet between the entrances of the
two buildings, and 50 feet between the part of the building that go in.
Mr. Boardman stated that Mr. Geralc! Paschke, one af the neighbors who object�d �
to the development, has �dritten a letter to ��ir. Harris, Chairman of the
Planning Com�nission. One of the conditions Mr. Pascf�ke would like to see is
that the property on the north end, Lots 2 and 3, remain commercial, and the
three lots to the south, Lots 4, 5, and 6, be zoned �ndustrial for development.
Mr. 8oardman stated that Mr. Anderson, architect for 1rJinfield Developments,
Inc., was in the audience and wou7d answer any questions.
Mr. Darrell Anderson stated he thouehtth�of�the�erojectry They�havehnowr�omeal
was objectionable was the overall 1 ng p
back and have demonstrated th�y can split the building. They have lost sorte
square fooiage. They now have 94,000 sq. ft. Their intention is stiii to have
the similarly low profile structure.
Mr. Anderson stated there was some concern at the last meeting about the docks �
facing south towards the new community park. They have redone the building so
the docks face to the north.
Mr. Anderson stated another concern at the last meeting was the height of the
structui,e and what is going to be seen. He stated that, in traveling past
the struc��re, people are really only going to see the fo7iage and the w�lls,
and only about four foot maximum height of the structure is going to show behind
the wails. .
Ms. SchM�abel asked if Winfield Developments, Inc., was. still requesting the ,
entire strip to be r�zoned to M-1, or in vietiv af the fact that they had changed
one building to office and the other building to light industrial, were they
splitting the zoning into two sections?
Mr. Taylor stated �hey have had discussions with the City Attorney and are,
hopefuily, going to receive an opinion fro►n the City �lttorney wf�ich wauZd
allot� the office/warehouse type of use that is contemplated in both buildings
to be allo�ved �n a commQrcial district. With that in n�ind, t�ey. can delete
the rezoning of the northern building and retain it as commercial. ?hat would
preclude nia��ufacturing type uses, but it would•allow the office/warehouse.
So, in essence, fihey are ci�anging their z�ning.
Mr. Harris stated he had received the letter f�rom Mr. Paschke dated Jan. 16, 7981,
in �vhich htr. Paschke had stated he was unable to attend this Pl�nning Commission
meeting. Mr. Paschke had stated the Paco Industria] Park opened less than two
years ago, and j�e felt that, given rc�asonable time, future develapment will be
satistactory to all. Mr. Pascl�ke stated he felt the best p7an t�ould be for

Lo�:s 2 and 3 to remain commercial and Lots 4,,�5, and 6 arauld make a good
it�dus�rial site which, if dor+e properly, would noi: distract from the Park to
the south, the office building i:o the north, or the rest of the industrial
prpperty to the west. Prr. Paschke had stated rezoning tFie entire property
from commercial to industrial and constructinu ta�o buildings would not be
acceptable to him. In his opinion, tf�ere should be a comn�rcial buffer between
the office building anci the industria7 area. He also felt the property does
not meet any of the requirements for zoning (hardShip or need).

the rezoning. Since then, she has spent some tim� doinc� soi�e backgro�nd work.
She felt the Planning Commission ►-�as under a fa�se impression at the last
meeting. She had checked to see t�hen the property was actual7y platted and
zoned, and i�; �aas appraved by ti�e Ci ty Counci 1 i n Feb. 19?9. �t the 1 ast
meeting, th�y r�ere 7ed t;o b�lieve it tvas only six months ago, when it actually
has been a]most two years ago. She had also checked the Planning Commission
and City Council minutes, and the bas�ic concerns for the entire area at.the
time ��he platting occ�.�rred were �,+ith: (1) the setback requirements, basically
along 73r�d Ave, l�Jhat a�as goi ng to happen Gvi th the bui 1 di ngs bui 1 t on 73rd
because of the difference in zoning across th� street? and (2) the drainage
prob 1 em.
h1s. Schn�bel sta�ted there was not alot of discussion in the Planning Commission
or City Council minutes in ierms o-f concern over this strip of land a7ong
Jniversity being comm�rcial and 1�1-1 and M-2.
Ms. Schnabel stated she still has the concerns she expressed at the last
Planning Comiiiission meeting as to wi�at happens if this land is rezoned and
these developers �re unable to either secure financing or proceed as proposed.

a�prove tl�e rezonii�g, that should this proposal fal7 through for any reason,
the rezoning would revert back to the original zoning.
Ms. Hughes stated she liked the split i�� zoning. S1�e has had some further
thoughts about the necd for office space in the Twin Cil:ies and northern
subur�bs. She had c.lone some lookinc� at trends, and she has changed her mind
a little blt in terms of the kind of need and desirabilii:y of that kind of
S�7c1CG. Slle stated she �vas not so concei�ned about all of the lots reinaining
co�nmercial. She ti�ould just as soo►� give a straight rezoning and was comfortable
l�aving it that zoning for tivhatever dcveloper comes along. �

ACTION I INFO.
�arrel Farr Corporaiion is amending their Innsbruck North Townhouse Plat VI
by eliminating six garage sites. They require this amended plat to be
approved and filed, so they can process the properties affected.
The Planning Commission reviewed the amendment at th�ir January 7, 1981
meeting and have referred it to City Council for actien.
Amendments to replat require a Public Hearing by �t7e Council prior to ap-
proval. In order to expedite this minor change, it �s suggested that the
City Council set a Public Nearing on this amendm�nt for February 9, 1981
publ�c heari7�g meeting.

4. Minimize the losses due to periodic flooding and eliminate obstruc-

The bounaaries of the Creek and River Preservation District are hereby
established as shown on the official Zoning Map of the City of

205.1573 Definitions
For the purpose of this district the following definitions shall apply:
1. ACCESSORY Bt1ILD1NG: A subordinate building or use which is
located on the same lot on which the main building or use is situated
and which is reasonably necessary anci incidental ta the conduct of the
primary use of such building or main use.
2. CHANNEL: A natural or artificial depression of perceptible
extent, with definite beds and 6anks to confine and conduct, either
continuously or periodically, the water in respective creeks.
3. CON�ISSION: h1eans Fridley Planning C�mmission
4. COMMISSIONER: Means the Commission of the Department of Natural
Resources of the State of Minnesota,
5. COUNCIL: Means the Fridley City Council.
6. CRP-1: (floodway) Creek and River Protection Zone 1. This Zone
is synonomous w�th the term "floodway".
7. CRP-2: (flood fringe) Creek and River Protection Zone 2. The
Zone is synonomous w�t� t�e term °flood fringe". !
8. EQUAL DEGREE OF ENCROACHMENT: A method of determining the
locat�on o f oo way ounaaries so t�at f ood p ain ar�d on ot�i s�i es
of a stream are capab e of canveying a proportionate s�are of f ood
ows.
9. FLOOD OR FLOODING: A temporary rise in flow or stage that results
in inundation of the areas adjacent to the channel.

channel rectification, culvert, building, wi•re, fence, stockpile, refuse,
fill, deposit, clearing of trees or vegetation, struc�ure or matter in,
along, across or projecting, in whole or in part, into any flood plain.
16. PRESERVATION DISTRICT: River and Creek Preservation District. The
District boundaries shall be contiguous with the regional flood boundaries
indentified as a part of t�e F ood Insurance Study for the City of Frid ey.
17. PROFILE: Official Creek and River profile.
18. REGULATORY FLOOD PROTECTION DATUM: A point not less than one (1)
foot above the regional flood (100 year flood) level.
19. REGIONAL FLO�D: A flood �which is representative of large floods
known to ave occurrre genera y in �nresota an resona y
c aracteristic of w at can be expected to occur on an average frequency in

20. STRUCTURE: Anything that is built or constructed, an edifice or
building of any kind, or any piece of work artificially built up or
composed of parts joined together in some definite manner, whether of a
temporary or permanent character.

l. Distract Use
The intent of this section is to provide a supplemenatry overlay
district which is made up of two protection zones. CRP-1, CRP-2,
within any of the existing original zoning districts. Development of
this district will follow the requirements of the original zoning
district in addition to the requirements of this section.

4. Permitted Uses in CRP-2 Zone (fload fringe)
No buildirig or structure or ary portion thereof, shall be placed within
protection zone CF;P-2 of the Preservation District, unless a Special Use
Permit is granted. ��or shall there be any grading, filling or excavating
of land or any land use established on any property within the Preserva-
tion District unless a Special Use Permit is granted. A Special Use
Permit shall be granted within the CRP-2 zone except in accordance with
the following regu at�ons.
A. No Special Use Permit shall be authorized which would result in
incompatible land uses or which would be detrimental to the
protection of surface and ground water supplies.
B. No Special Use Permit shall be authorized for structures which
will increase the financial burdens imposed on the community and
its individuals through increasing floods and overflow of water
onto land areas adjacent to the creeks and rivers.
C. No Special Use Permit sha11 be issued unless the proposal is in
keeping with land use plans and planning objectives for the City of
Fridley and which will not increase or cause danger to life ar
property.
D. No Special Use Permit shall be issued in those cases which are
inconsistent with the objectives and encourage land use that is in
compatible with the preservatior of the natural Tand forms and
vegetation.
E. No Special Use Permit shall be issued for any fiill unless shown
to have some beneficial purpose to the property and the amount
thereof must not exceed that necessary to achieve the intended
purpose, as demonstrated by a plan submitted by the owner shok�ing
the uses to which the filled land will be put, the kind of fill,
and the final dimensions of the proposed fill or other materials.
Such fill shall be protected against erosion by rip-rap, vegetative
cover, or bulkheading if deemed necessary.
F. No Special Use Permit shall be issued for gargage or waste
disposal sites or systems.
G. No Special Use Permit shall be issued unless the applicant, in
support of his application, submits engineering data, site plans
and other plans and information as the City may require, in order
to determine the regulatory flood pro�ection elevation in
unnumbered A zones, and the effects of suc� deve opment on the bed,
bank, channe , floodway or flood plain in the Preservation
District. The applicant shall submit four copies of the
application and the information.
N. No Special Use Permit shall be issued unless the proposed use
or obstruction has been reviewed by all governmental bodies having
jurisdiction over such use or obstruction, if said review is
required by statu±es, ordinances, rules or regulations applicable
to such governmental boclies and to such use or obstruction, but in
all cases the City of Fridley will make the final determination.

205.1575 Additional Restrictions
In addition to the requirements set out in Section 205.1574 of this
section, �!� any Spec�ial Use Permit ���,1,�/�4¢ issued for an obs�ruction in
the CRP-2 zone ��fx��� shall meet the following provisions:��`¢/�+¢�
l. Structures: Structures for habitation constructed on fill shall
be constructed on fill so the basement floor, or first floor, if there is
no basement, is above the regulatory flood protection elevation with
the fi11 at that eievati�n at least fifteen (�5) feet beyond the limits
of any structure or building erected thereon. Where existing streets
or utilities are at elevations which make compliance with the foregoing
sentence impra'ctical, or in other special circumstances, the Planning
Commission may authorize other techniques of eleva�ing the first floor
(including basaments) above the Regulatory F� od Protection Elevation
under the SpeciaT Use Permit, that conform with the f ood proofing
requirements of the State Building Code.
2. Other Uses: Accessory iand uses, such as accessory buildings,
yards and parkir�g lots may be at eleva±ions low�r than the regu�atory
flood protection elevation if a Special Use Permit is first granted
pursuant to this district. Accessory structures must comply vaith
section 205.1574 2A (2) (a-d) of this district.
3. Storage: Any storage or processing of materials that in time of
flooding may be k�uoyant, f1ammable, explosive or could be injurious to
human, animal or plant life, is prohibited.
4. Nan-Residential Structures: Commercial, manufacturing, and

l. The City shall administer and enforce these district regulations
and shall maintain a record ofi the elevation of the first floor
inc uding basement of al new structures o•r additions to exisiin

2. Special Use Permit: A Special Use Permit shall be applied for and
obtained prior to the construction, erection, addition or alteration of
any obstruciion wholly, or partly in the Preservation District.
3. Application for Permit:
A. Application for Special Use Permits under this district shall
be made by the owner or owners of the land, in duplicate to the
City, on forms furnished by the City and shali be accompanied
initially by the �¢X,T�y��'�i� information, �dQ///,�,(ip/,�h,6,�,61X
,iyf��p`p�,���'�qf,�j/data, and pl ans as i s de�med necessa�y by the zaning
administrator for determining compliance with this district, and
for determining the effects of the proposed activity in ihe
Preservation District and the buildability of the particular site
for the proposed improvement, use or obstruction.
B. The City Council may attach such conditions to the granting of
the Special Use Permit as �t deems necessary to fu fi the
purpases of the Gr inance. Such condi�ions may inc ude'�iut are not
imited to, the fo lowing:
(1) Modification of waste disposal and water supply
facilit�e
(2) Limitations on period of use, occupancy, and operation.
(3) Imposition of operational controls, sureties, and deed
restrictions.
(4) Requirements for construction of channel modifications,
dikes, evees, and other protective measures.
(5) Flood proofin measures, in accordance with the State
Building Co e. The app icant s a submit a p an or document

storage of materials, water supply (including withdrawal and
discharge of yround and surf ace water) and sanitary f acilities.
4. Issuance of Permit: The City shall issue the Special Use Permit upon
approva1 of the application �pf¢�f¢���¢ by the City Council.
The applicant shall be required to submit certification by a registered

River Preservation District must oniy be for reasons of exceptional
circumstances when the strict enforcement of these requlations would
cause i�ndue hardship and strict conformity with the standards would be

1. Powers and Duties
The City shall hear all requests for Special Use Permits and Variances
under this district. Requests for Special Use Permits and Variances shall
be subject to Sections 205.053 and 6.141 respectively, of the City Code.

City shall submit to the Commissioner a copy of any application for a
Special Use Permit or Variance where a hearing is to be held to
consider such application. The Commissioner shall receive at least
(10) days notice of the hearing. Such notice shall specify the time,
place and subject matter of the hearing and shall be accompanied by
such supporting information as is necessary to indicate the nature and
effect of the proposed use. A copy of all decisions granting a Special
Use Permit or Variance to the provisions of th� Creek and River
Preservation District st�all be forwarded to the Commissioner within ten
(10) days of such action.

2. Technical Assistance
The City may transmit the information received by it to the
appropriate Watershed District or the Commissioner�for technical assis-
tance �;o evaluate the proposed project in relation to flood heights and
velocities, for determination of the re�ulatory flood protection elevation
within un numbered �i zones, and to determine seriousness of flood damage
to the use, the adequacy of the plans for protection, compliance with
all sections �dd+li'dr��l�'Gl�l�'Yc��'�l�'(��6l:�YO'�6,(1���'�'l��'�'f�'YO'�f of this district
and comp�ance wii:h Statewide Standards and Criteria for Mana ement of
Flood Plain Areas of MinnesQta Minnesota Reg��lations NR 85-93 , and other
technical matters.
205.1578 Existing Non-Conforming Uses
An obstruction or structure, or the use of a structure or premises,
which was lawful before adoption of this ordinance, but which is not in
conformity with the provisions of �his district, may be continued,
subject to the following conditions:
1. No such use shall be expanded, changed, enlarged, or altered in a way
which its nonconfarmity.
2. No structural alteration or addition to any nc�ncorformir�g
structure cver the life of the structure sha exceed �C percer,t of
its assessed va ue at the time of its becoming a nonconforming use,
un ess the entire structure is permanent y char.ged to a confor��ing

1. Any person who violates any provisions of this district, or fails

costs of prosecution and expenses involved in the case. Each day such
violation continues sha11 be considered a separate offense.

District in violation of this ordinance is hereby declared to be a public
nuisance and creation thereof may be enjoined and the maintenance thereof

Annually, u�Je contract concrete curb and gutter work to install curb cuts
and handicap ramps throuyhout the City. Tl�is year we are incorporating
into the project the replacement af concrete slab sections for repair of
the intersection at East and Wesi: Danube Roads.
Since the contract will be in excess a� �2Q,000, request the City Council
authorize this work and the advertisement for bids.
The bid opening is scheduled �For February 25th at 11:00 a.m. in the Civic
Center. We will plan ta revieaa the bids and submit them to the City
Council at the March 16th meeting for award. Funds for this project were

STREET IMPROVEMENT PROJECT STREET 1981 - 1.
WHEREAS, the construction of certain improvements is deemed to be in the
interest of the City of Fridley and the property owners affected thereby.
BE IT RESOLVED, by the City Council of the City of Fridley, as follows:
1. That the preliminary report submitted by the Public Works Director is
hereby received and accepted.
2. That the City Clerk shall act to ascertain the name and address of the
owner of each parcel of land directly affected or within the area of
lands as may be proposed to be assessetl for said improvements, and
calculate estimates of assessments as may be proposed relative thereto
against each of said lands.
3. That the area proposed to be assessed for said improvements and each of - ;
them as notetl in said agreernent are all the l�nds and areas as noted in !

We are currently planniny two street projects on State Aid streets: 69th
Avenue from Olcl Ccntral to Stinson Boulevard; and 73rd Avenue intersection
improvement on both sides of University Avenue.
With the Medtronic cans4ructior► on �LhQ north sid� of 69th A�aenue, it would
be advantageous far the Citylat this time,to �mprove 69th Avenue to pr�vide
for future increased traffic due to ti�z Medtr�onic expansion. We are pro-
�osing t� improve th� intersection of Old Central and 69th to provide for
left and right turning lanes and improve the �treet with c�ncrete curb and
gutter to Stinson Boulevard.
With the increaspd cansuruction adjacent to 73rd Avenue west of l�niversity
and the recent Register�d t.and Survey and sale ct the industrial property
east of 73rd, it is essential that this intersection be improved with left
and rig�rt turninr� iai7es to safely har�dle the volume of traffic generated.
Incorporated in this proj�ct w�ill be the extension of 73rd At�enue to the
railroad trackse This work will complem�nt the development of Paco Indus-
trial Park. The attached resolution ordering t}�� im�rovement and calling
for the Public Hearing will allow us to sysi;ematically proces5 the neces-
sary resolutions and bid advertisements, so we will be able to open bids
and award them in April. This schedule should provide us advantageous
contracts and maximize the construction season.
