The Fridley Housing and Red2velopment Authority, at their March 26, 1981 public hearing
meeting, approved Reso�ution HRA 6-1981 adopting the Moore Lake Redevelopment Plan and
submitting this p7an for Fridley City Council approval as required by MSA Chapter 462.521.
fhe HRA heard testimony at this meeting which established the eligibility of this area as
a redevelopment district and led to the HRA findings that (1) the land in the district
would not be made available for redevelopment without the financial aid to be sought, (2)
the redevelopment plans for the redevelopment areas in the locali�y will afford maximum
opportunity, consistent with the sound needs of the locality as a whole, for the redevelopment
of such areas by private enterprise; and, (3) the redevelopment p�an conforms to a general
plan for the development of the lacality as a whole.

LUTION OF THE CI?Y COUNCIL Of= FRIDLEY, MINNESOTA APPROV-
THE MOORE LAKE REDEVELOPMENT PLAN
WNEREAS, un er provisions of the 1973 Housing and Redevelapment Act,
Minnesota S atutes, Section 462, 411 et, seq., the City Council of Fridley,
Minnesota ust approve redevelopment projects to be executed by the Nousing
and Redevelopment Authority of Fridley; and
WHEREAS, t e Fridley Housing and Redevelopment Authority has determined that
a redevelo ment project as set forth in the Moore Lake Redevelopment Plan
date April 26, 1981, should be undertaken in the area legally described in
said plan, and has made application to the City Council for approval of the
project, w ich application compiies with the provisions of Chapter 462
Minnesota tatutes; and
WNEREAS, t�e project and the plan was reviewed and approved by the Fridley
City Plann ng Commission on the 4th day of March, 1981; and
WHEREAS, t e Fridley Housing and Redevelopment Authority has included a
relocation plan, redevelopment plan, finance plan, arid acquisition plan, as
part of th Moore Lake Redevelopment Project; and
WHEREAS, p rsuant to notice �iven as required by the provisions of Minnesota
Statutes, ection 462.521, the City Council conducted a public hearing
regarding he Moore Lake Redevelopment Project;
NOW, THER�FORE, BE IT RESOLVED TNAT TNE CITY COUNCIL OF FRIDLEY HEREBY FINDS
AND QETER INES: �
l. That he project area is blighted and deteriorated due to economic
obsol scence of commercial and residential structures, poor soil
condi ions, development patterns,-traffic and parking design, and
unsig tly general conditions; and
2. That he execution of the Moore Lake Redevelopment Plan by the Fridley
Housi g and Redevelopment Authority is authorized by the Municipal
Housi g and Retlevelopment Act,�and
3. That �he land in the project area would not be made available for
redev lopment without the financial aid to be sought.
4. That he redevelopment plan conforms to a general plan for the
redev lopment of the City of Fridley.
5. That he Moore Lake Redevelapment Plan will afford maximum opportunity,
consi tent with the sound needs of the City of Fridley as a whole, for
the r development of the project area by private enterprise.
6. That he Moore Lake Redevelopment Project shall require an undetermined
numb r of commercial and residential relocations fo which the City shall
insu e that all applicable State and Federal laws shall be adhered to.

WHEREAS, I is desireable and in the Public interest that the Housing and
Redevelopm nt Authority of Frialey, Minnesota, uridertake the Moore Lake
Redevelopm nt Project as outlined in a report titled "The Moore Lake
Redevelopm nt Plan" and dated February 26, 1981; and
WHEREAS, The Nousing and Redevelopment Authority has determined that the area
described in the above said plan situated in the City of�Fridley, County of
Anoka, and S�ate of Minnesota, is that area proposed as the Moore Lake
Redevelop ent Project area; and
WHEREAS, he said Redevelopment Project area is blighted and deteriorated due
to economic obsolescence of commercial and residentiai structures, poor soti
conditions, development patters, traffic and parking design and unsightly
general c nditions; and
WHEREAS, he Housing and Redevelopment Authority has determined it is
necessary to undertake a Redevelopment project for the purpase of removing,
preventin or reducing blight, blighting f actors or causes of blight through
any work r undertakings as are allowed by MSA Chapter 462. 421 Subdivision
13.
WHEREAS, he Nousing and Redevelopment Authority has cons�dered the legal
requireme ts of relocating displaced persons and businesses in the Moore Lake
Redevelop ent Area; and
WHEREAS, he Housing and Redevelopment Authority has reviewed the Finance
Plan and cquisition Plan and concurs that said plans are in conformance with
state law and overall objectives; and
WHEREAS, he redevelopment of the Moore Lake Project area cannot be
accomplis ed without governmental assistance as provided under the Municipal
Housing a d Redevelopment Act, Chapter 462, and know specifically as a Tax
Increment Development Project; and

Pursuant to y ur request, we have reviewed the Moore Lake Recievelopment Plan
and the Moor Lake Redevelopment Area Tax Increment Plan No. 1. We have
diseussed our eview with Mr. Boardman, and summarize it herein.
The requirem nts to be met for the valid creation of a redevelopment project by a
housing and r development authority are provided in the following provisions of the
iViunicipal Ho sing and Redevelopment Act, Ninnesota Statutes, Chapter 462 (the
"Act"): Ninn sota Statutes, Section 462.421, Subd. 13, "redeve2opment project"
definition; 1Vii nesota Statutes, Section 462.421, Subd. 15, "redevelopme�t plan"
definition; 1Vii nesota Statutes, Seetion 462.425, Subd. 24, "general plan for the
develapment f the locality as a whole" definition; Minnesota Statutes, Section
462.445, Sub . 1(6); Nlinnesota Statutes, Section 462.515, redevelopment plan
requirements; Minnesota Statutes, Section 462.521, Subd. 1, applieation for
approval of a edevelopment project; Minnesota Statutes, Section 462,521, Subd. 2,
requirements or appraving resolutions.
We have ofte suggested that essential elements for the creation of a redevelop-
ment plan incl de: (1) description of boundaries of the redevelopment project area;
(2) land use; () properties to be acquired; and (4) relocation obligation. Minnesota
Statutes, Sect on 462.421, Subd. 15 states that a redevelopment plan provides an
outline for th development or redevelopment of an area and must be sufficiently
eomplete to (1) indicate its relationship to definite local objectives as to
appropriate la d use; and (2) indicate general land uses and general standards of
development r redevelopment.

The Fridley Housing and Redevelopment Authority at their March 26, 1981 public hearing meeting
reviewed �he Tax Increment Plan #1 to the Moore Lake Redevelopment District. The public
hearing was opened and continued by the HRA until May 14, 1981. .
The continuation was the result of a staff request based on a report from Jim Holmes,
Attorney of the firm Holmes and Graven (included in Redevelopment Plan information). This
report .questianed the legality of the establishment of the district in the fprm that
was being presented and suggested major modification. 7he pian is being modified by staff
and iegal counsel at this time, however, more detailed legislative iests have to be complied
with wh�ch wi71 require additional time.
The HRA, thanks the City Council for its cooperation and speeial consideration in setting
up the special pu6lic hearing meeting for �he purpose of reviewing this item, however, due
to the changes that are being made to the plan we wou7d like to request a continuation of
your public hearing to your b1ay 18, 1981 meeting, if this is acceptable to you. Thank y4u
